1.This Act may be cited as the
Lifespan Respite Care Act of
2005
.
2.The
Public Health Service Act
(42 U.S.C.
201 et seq.) is amended by adding at the end the
following:
<enum>XXIX</enum><header>Lifespan respite care</header>
<section commented="no" display-inline="no-display-inline" id="ID89F087BFFD964C95B6E11DF0F4D11421" section-type="subsequent-section"><enum>2901.</enum><header>Findings and
purposes</header>
<subsection commented="no" display-inline="no-display-inline" id="ID48B03007EE9445EE84625765004D4E47"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID283B4E762BC944CA82225429192262A9"><enum>(1)</enum><text display-inline="yes-display-inline">an estimated 26,000,000 individuals in the
United States care each year for 1 or more adult family members or friends who
are chronically ill, disabled, or terminally ill;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEA8F1210CFAB4FD1A50092002198C426"><enum>(2)</enum><text display-inline="yes-display-inline">an estimated 18,000,000 children in the
United States have chronic physical, developmental, behavioral, or emotional
conditions that demand caregiver monitoring, management, supervision, or
treatment beyond that required of children generally;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2E933F2F3F8247C9BB00C863BC3EB465"><enum>(3)</enum><text display-inline="yes-display-inline">nearly 4,000,000 individuals in the United
States of all ages who have mental retardation or another developmental
disability live with their families;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID684E409DEA12415F8837819E24364D73"><enum>(4)</enum><text display-inline="yes-display-inline">almost 25 percent of the Nation’s elders
experience multiple chronic disabling conditions that make it necessary to rely
on others for help in meeting their daily needs;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID44C2536EEF7D4D6588143E3C25376DA5"><enum>(5)</enum><text display-inline="yes-display-inline">every year, approximately 600,000 Americans
die at home and many of these individuals rely on extensive family caregiving
before their death;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7A16C196A4D2472800641F7DA300BE23"><enum>(6)</enum><text display-inline="yes-display-inline">of all individuals in the United States
needing assistance in daily living, 42 percent are under age 65;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID30B009F2621544E8A347F120ED8DF865"><enum>(7)</enum><text display-inline="yes-display-inline">there are insufficient resources to replace
family caregivers with paid workers;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9DA23DDD7FBB41EEB08368B600D50552"><enum>(8)</enum><text display-inline="yes-display-inline">if services provided by family caregivers
had to be replaced with paid services, it would cost approximately
$200,000,000,000 annually;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3066BA8F687244C1B5CA5F0680BE4BC9"><enum>(9)</enum><text display-inline="yes-display-inline">the family caregiver role is personally
rewarding but can result in substantial emotional, physical, and financial
hardship;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5DE6174FF75945599D20BA2331B000F7"><enum>(10)</enum><text display-inline="yes-display-inline">approximately 75 percent of family
caregivers are women;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID04F55D418D864E46A6637956FD683259"><enum>(11)</enum><text display-inline="yes-display-inline">family caregivers often do not know where
to find information about available respite care or how to access it;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC5301AF4E23A43EFADA48FEFC45BA14F"><enum>(12)</enum><text display-inline="yes-display-inline">available respite care programs are
insufficient to meet the need and are directed at primarily lower income
populations and family caregivers of the elderly, leaving large numbers of
family caregivers without adequate support; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52DD3E2F706D4189906E7D61D42B3C07"><enum>(13)</enum><text display-inline="yes-display-inline">the limited number of available respite
care programs find it difficult to recruit appropriately trained respite
workers.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2A199D17612243F285E6E996A66FCBFA"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this title are—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID87AC89947A3F44F19BDED2934350452B"><enum>(1)</enum><text display-inline="yes-display-inline">to encourage States to establish State and
local lifespan respite care programs;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9398F609791A4641B195B6955894B76E"><enum>(2)</enum><text display-inline="yes-display-inline">to improve and coordinate the dissemination
of respite care information and resources to family caregivers;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID34BD0B61B56647F692098C6C10125104"><enum>(3)</enum><text display-inline="yes-display-inline">to provide, supplement, or improve respite
care services to family caregivers;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID540EAF190991407DA065D884C000CD3F"><enum>(4)</enum><text display-inline="yes-display-inline">to promote innovative, flexible, and
comprehensive approaches to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDCC84B37F3CDB4E2A9D1E7C9653BBEEAA"><enum>(A)</enum><text display-inline="yes-display-inline">the delivery of respite care;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID214CF0543768435788FBD2DF1D37457C"><enum>(B)</enum><text display-inline="yes-display-inline">respite care worker and volunteer
recruitment and training programs; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID853771E32D894299B7A88E2FF300F197"><enum>(C)</enum><text display-inline="yes-display-inline">training programs for family caregivers to
assist such family caregivers in making informed decisions about respite care
services;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF08C4D50C3EF46FE8BF0F4DBA93B16B6"><enum>(5)</enum><text display-inline="yes-display-inline">to support evaluative research to identify
effective respite care services that alleviate, reduce, or minimize any
negative consequences of caregiving; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8E56DEE0D1DD497C83A871184D29B29E"><enum>(6)</enum><text display-inline="yes-display-inline">to promote the dissemination of results,
findings, and information from programs and research projects relating to
respite care delivery, family caregiver strain, respite care worker and
volunteer recruitment and training, and training programs for family caregivers
that assist such family caregivers in making informed decisions about respite
care services.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID32127409D58A49E4ADEEEB181F298748" section-type="subsequent-section"><enum>2902.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDE3E70EB603CE4988BA03F6953C864EFE"><enum>(1)</enum><header>Eligible
recipient</header><text display-inline="yes-display-inline">The term
<term>eligible recipient</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID8A4AB9BAA1CA4965B76C0721275B00EC"><enum>(A)</enum><text display-inline="yes-display-inline">a State agency;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD76C78EF9C20467D0026AD998886445D"><enum>(B)</enum><text display-inline="yes-display-inline">any other public entity that is capable of
operating on a statewide basis;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDABA0DA33579E498FBBA3000614CE4040"><enum>(C)</enum><text display-inline="yes-display-inline">a private, nonprofit organization that is
capable of operating on a statewide basis;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD1226659D1E1458EAF3B117D005D393B"><enum>(D)</enum><text display-inline="yes-display-inline">a political subdivision of a State that has
a population of not less than 3,000,000 individuals; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID80994620B9464BE09953A75F2E132600"><enum>(E)</enum><text display-inline="yes-display-inline">any recognized State respite coordinating
agency that has—</text>
<clause commented="no" display-inline="no-display-inline" id="IDAED5FF76D36449C787970000FCF400DB"><enum>(i)</enum><text display-inline="yes-display-inline">a demonstrated ability to work with other
State and community-based agencies;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDC8A0B03B48804521A0DF7C5E054D69E7"><enum>(ii)</enum><text display-inline="yes-display-inline">an understanding of respite care and family
caregiver issues; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID13891A5EBE354042B5C96F085C71C266"><enum>(iii)</enum><text display-inline="yes-display-inline">the capacity to ensure meaningful
involvement of family members, family caregivers, and care recipients.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC5C47405A4334665A0601D79741DCD94"><enum>(2)</enum><header>Adult with a
special need</header><text display-inline="yes-display-inline">The term
<term>adult with a special need</term> means a person 18 years of age or older
who requires care or supervision to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDA768A3D8D4EA4DF38FD9A1C56E027C76"><enum>(A)</enum><text display-inline="yes-display-inline">meet the person’s basic needs; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID835BA1ED3744424299061EA3F6F46064"><enum>(B)</enum><text display-inline="yes-display-inline">prevent physical self-injury or injury to
others.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7A6782A1A66B4430B8A6F33056D1A6D2"><enum>(3)</enum><header>Child with a
special need</header><text display-inline="yes-display-inline">The term
<term>child with a special need</term> means a person less than 18 years of age
who requires care or supervision beyond that required of children generally
to—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID939BF9B4137F4D08963B89C1345191AD"><enum>(A)</enum><text display-inline="yes-display-inline">meet the child’s basic needs; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3126257DB27D4147ADE50005BCC460A2"><enum>(B)</enum><text display-inline="yes-display-inline">prevent physical self-injury or injury to
others.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID530F0E13A08C422389953BE135297BD1"><enum>(4)</enum><header>Family
caregiver</header><text display-inline="yes-display-inline">The term
<term>family caregiver</term> means an unpaid family member, a foster parent,
or another unpaid adult, who provides in-home monitoring, management,
supervision, or treatment of a child or adult with a special need.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53C6E6955D1842B6B4DC27C55B5F4C27"><enum>(5)</enum><header>Respite
care</header><text display-inline="yes-display-inline">The term <term>respite
care</term> means planned or emergency care provided to a child or adult with a
special need in order to provide temporary relief to the family caregiver of
that child or adult.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEFB3AE7759004BD08699896D45C65FF3"><enum>(6)</enum><header>Lifespan
respite care</header><text display-inline="yes-display-inline">The term
<term>lifespan respite care</term> means a coordinated system of accessible,
community-based respite care services for family caregivers of children or
adults with special needs.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID83173A6B9D814D6EB0A292D91D123112" section-type="subsequent-section"><enum>2903.</enum><header>Lifespan respite
care grants and cooperative agreements</header>
<subsection commented="no" display-inline="no-display-inline" id="ID45542A3D93144A65929F4080C0A77100"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this section are—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID47A5FB29914F4110919B52A5F65713E5"><enum>(1)</enum><text display-inline="yes-display-inline">to expand and enhance respite care services
to family caregivers;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5A92C6458D89408EA4C4D1ACA7EB5067"><enum>(2)</enum><text display-inline="yes-display-inline">to improve the statewide dissemination and
coordination of respite care; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7C5C756616DE461ABFF11328C800E8D3"><enum>(3)</enum><text display-inline="yes-display-inline">to provide, supplement, or improve access
and quality of respite care services to family caregivers, thereby reducing
family caregiver strain.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDAF3A613FA2EC455EB73D8D7EC9BC30C8"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">Subject to subsection (f), the Secretary is
authorized to award grants or cooperative agreements to eligible recipients who
submit an application pursuant to subsection (d).</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID273B8E9D7575497A9E07B89670AEF31F"><enum>(c)</enum><header>Federal
lifespan approach</header><text display-inline="yes-display-inline">In carrying
out this section, the Secretary shall work in cooperation with the National
Family Caregiver Support Program Officer of the Administration on Aging, and
respite care program officers in the Administration for Children and Families,
the Administration on Developmental Disabilities, the Maternal and Child Health
Bureau of the Health Resources and Services Administration, and the Substance
Abuse and Mental Health Services Administration, to ensure coordination of
respite care services for family caregivers of children and adults with special
needs.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7BD7A9020B8A45BEA45BC8E402004DD6"><enum>(d)</enum><header>Application</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDE51895D73C6A412DB6A6A4D66FE829DB"><enum>(1)</enum><header>Submission</header><text display-inline="yes-display-inline">Each eligible recipient desiring to receive
a grant or cooperative agreement under this section shall submit an application
to the Secretary at such time, in such manner, and containing such information
as the Secretary shall require.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID89677B32AC0B47B6A7E32DFF0071F4DD"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">Each application submitted under this
section shall include—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDD835C0C63BE3432FBE94006D1787C78C"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the applicant’s—</text>
<clause commented="no" display-inline="no-display-inline" id="ID545FEB9E9E514C66AF5C6167D3C3D7A2"><enum>(i)</enum><text display-inline="yes-display-inline">understanding of respite care and family
caregiver issues;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDE7BE2BD697D14390B5C4877E8141D304"><enum>(ii)</enum><text display-inline="yes-display-inline">capacity to ensure meaningful involvement
of family members, family caregivers, and care recipients; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDFBE6E87602794EEB8531CFDACE00D2DB"><enum>(iii)</enum><text display-inline="yes-display-inline">collaboration with other State and
community-based public, nonprofit, or private agencies;</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID81A3F3FB01164AAF87A338DE1D00001B"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to the population of family
caregivers to whom respite care information or services will be provided or for
whom respite care workers and volunteers will be recruited and trained, a
description of—</text>
<clause commented="no" display-inline="no-display-inline" id="ID012BCEC0A6084643B75CA3A780DE437D"><enum>(i)</enum><text display-inline="yes-display-inline">the population of family caregivers;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID2819CA5ABE444BDFA88546CFEFC305B7"><enum>(ii)</enum><text display-inline="yes-display-inline">the extent and nature of the respite care
needs of that population;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDB6C9F5694EBD4A43841B1B57F961B079"><enum>(iii)</enum><text display-inline="yes-display-inline">existing respite care services for that
population, including numbers of family caregivers being served and extent of
unmet need;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID5F4B2C1DF1A1402BACA800075E5FC152"><enum>(iv)</enum><text display-inline="yes-display-inline">existing methods or systems to coordinate
respite care information and services to the population at the State and local
level and extent of unmet need;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDABFCBCE6BBA942D4B19DBD7754B0F7A7"><enum>(v)</enum><text display-inline="yes-display-inline">how respite care information dissemination
and coordination, respite care services, respite care worker and volunteer
recruitment and training programs, or training programs for family caregivers
that assist such family caregivers in making informed decisions about respite
care services will be provided using grant or cooperative agreement
funds;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDF455132B63A143DCB098C7F074B13D37"><enum>(vi)</enum><text display-inline="yes-display-inline">a plan for collaboration and coordination
of the proposed respite care activities with other related services or programs
offered by public or private, nonprofit entities, including area agencies on
aging;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID4459AF86B912490D0000123B02670056"><enum>(vii)</enum><text display-inline="yes-display-inline">how the population, including family
caregivers, care recipients, and relevant public or private agencies, will
participate in the planning and implementation of the proposed respite care
activities;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDA399266AE6E242B2A1D6C1B96267AEF6"><enum>(viii)</enum><text display-inline="yes-display-inline">how the proposed respite care activities
will make use, to the maximum extent feasible, of other Federal, State, and
local funds, programs, contributions, other forms of reimbursements, personnel,
and facilities;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID6E86B352DC66498587F184F42020EA1D"><enum>(ix)</enum><text display-inline="yes-display-inline">respite care services available to family
caregivers in the applicant’s State or locality, including unmet needs and how
the applicant’s plan for use of funds will improve the coordination and
distribution of respite care services for family caregivers of children and
adults with special needs;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDFBC36810526D48928F938B2247A5C993"><enum>(x)</enum><text display-inline="yes-display-inline">the criteria used to identify family
caregivers eligible for respite care services;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID86C64E8A96C04C02B8C5E5E14FC12C06"><enum>(xi)</enum><text display-inline="yes-display-inline">how the quality and safety of any respite
care services provided will be monitored, including methods to ensure that
respite care workers and volunteers are appropriately screened and possess the
necessary skills to care for the needs of the care recipient in the absence of
the family caregiver; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDD7CBC08298CD4794BBFBE282178B284F"><enum>(xii)</enum><text display-inline="yes-display-inline">the results expected from proposed respite
care activities and the procedures to be used for evaluating those results;
and</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID124772DD721B4B2897148C009CE6FF41"><enum>(C)</enum><text display-inline="yes-display-inline">assurances that, where appropriate, the
applicant shall have a system for maintaining the confidentiality of care
recipient and family caregiver records.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4043B068BCBB422AAE21007C5F630641"><enum>(e)</enum><header>Review of
applications</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID403C6C5088CE4FB7B0F7F7FCF21B58CA"><enum>(1)</enum><header>Establishment
of review panel</header><text display-inline="yes-display-inline">The Secretary
shall establish a panel to review applications submitted under this
section.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC14DAB77D9634DBD9C99A161D9A7CFD0"><enum>(2)</enum><header>Meetings</header><text display-inline="yes-display-inline">The panel shall meet as often as may be
necessary to facilitate the expeditious review of applications.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID61D6A9D28450489781054D2300B8AE41"><enum>(3)</enum><header>Function of
panel</header><text display-inline="yes-display-inline">The panel shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID2ECD4E99BD874547A1F0EBCE00EA6BA1"><enum>(A)</enum><text display-inline="yes-display-inline">review and evaluate each application
submitted under this section; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID45DC4123F6B848E7B6B133718F2207E3"><enum>(B)</enum><text display-inline="yes-display-inline">make recommendations to the Secretary
concerning whether the application should be approved.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7B64CC7C7B6F42DBA93D00E68385CEA7"><enum>(f)</enum><header>Awarding of
grants or cooperative agreements</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDF15BDFFDED7D4695B7A3C5522BDFE7CD"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary shall
award grants or cooperative agreements from among the applications approved by
the panel under subsection (e)(3).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6C7F64108FEC45FC989EFE94CE4653DC"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">When awarding grants or cooperative
agreements under this subsection, the Secretary shall give priority to
applicants that show the greatest likelihood of implementing or enhancing
lifespan respite care statewide.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID848F7A5036804FE8BC0058A2B7B19E7E"><enum>(g)</enum><header>Use of grant or
cooperative agreement funds</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDC853810FCC4645F39BF90700FE4D9B74"><enum>(1)</enum><header>In
general</header>
<subparagraph commented="no" display-inline="no-display-inline" id="IDA38DB62331454906B0E65E354F9B5E5E"><enum>(A)</enum><header>Mandatory uses
of funds</header><text display-inline="yes-display-inline">Each eligible
recipient that is awarded a grant or cooperative agreement under this section
shall use the funds for, unless such a program is in existence—</text>
<clause commented="no" display-inline="no-display-inline" id="ID4987A3D791BC41DAB29E0020F73D68B7"><enum>(i)</enum><text display-inline="yes-display-inline">the development of lifespan respite care at
the State and local levels; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDECA4F4816766418B9D09C3CA4D8C0653"><enum>(ii)</enum><text display-inline="yes-display-inline">an evaluation of the effectiveness of such
care.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCA2255639DA1454283F0E79292A3EDEB"><enum>(B)</enum><header>Discretionary
uses of funds</header><text display-inline="yes-display-inline">Each eligible
recipient that is awarded a grant or cooperative agreement under this section
may use the funds for—</text>
<clause commented="no" display-inline="no-display-inline" id="ID6B00C2EC5D524B40B37E2621EF066FAC"><enum>(i)</enum><text display-inline="yes-display-inline">respite care services for family caregivers
of children and adults with special needs;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDC1E3B6CACC5B4AA1806E99CD2F38232D"><enum>(ii)</enum><text display-inline="yes-display-inline">respite care worker and volunteer training
programs; or</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID8B10670D48D942EAA4FF57EF6DC429EF"><enum>(iii)</enum><text display-inline="yes-display-inline">training programs for family caregivers to
assist such family caregivers in making informed decisions about respite care
services.</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC65FC7C6B351420F00803551DD64D532"><enum>(C)</enum><header>Evaluation</header><text display-inline="yes-display-inline">If an eligible recipient uses funds awarded
under this section for an activity described in subparagraph (B), the eligible
recipient shall use funds for an evaluation of the effectiveness of the
activity.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC76E09B15E7547D78B4EC456810848F8"><enum>(2)</enum><header>Subcontracts</header><text display-inline="yes-display-inline">Each eligible recipient that is awarded a
grant or cooperative agreement under this section may use the funds to
subcontract with a public or nonprofit agency to carry out the activities
described in paragraph (1).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1CDA6C358D454556963912C30047AF2F"><enum>(h)</enum><header>Term of grants
or cooperative agreements</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID04C951C7B9E749F787CE065127BC0064"><enum>(1)</enum><header>In
general</header><text display-inline="yes-display-inline">The Secretary shall
award grants or cooperative agreements under this section for terms that do not
exceed 5 years.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID458C00CE0D3F474188FC2395A520939E"><enum>(2)</enum><header>Renewal</header><text display-inline="yes-display-inline">The Secretary may renew a grant or
cooperative agreement under this section at the end of the term of the grant or
cooperative agreement determined under paragraph (1).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9380807A2C804F0D959FE481AF96AB88"><enum>(i)</enum><header>Supplement, not
supplant</header><text display-inline="yes-display-inline">Funds made available
under this section shall be used to supplement and not supplant other Federal,
State, and local funds available for respite care services.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCB4912E131834C32BC026FEDF253A372"><enum>(j)</enum><header>Authorization
of appropriations</header><text display-inline="yes-display-inline">There are
authorized to be appropriated to carry out this section, such sums as may be
necessary for each of fiscal years 2006 through 2010.</text>
</subsection></section><section commented="no" display-inline="no-display-inline" id="ID1549592DC1A04952BF1053A6CF567699" section-type="subsequent-section"><enum>2904.</enum><header>National lifespan
respite resource center</header>
<subsection commented="no" display-inline="no-display-inline" id="ID207C67C32D114CBAB5EED9FBDAE3BFC4"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">From funds appropriated under subsection
(c), the Secretary shall award a grant or cooperative agreement to a public or
private nonprofit entity to establish a National Resource Center on Lifespan
Respite Care (referred to in this section as the <quote>center</quote>).</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID905E3EC796934D4EA268006600AAA9FA"><enum>(b)</enum><header>Purposes of the
center</header><text display-inline="yes-display-inline">The center
shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDB7D7C0D1D3CA4AE0B828B6B1B3A357BA"><enum>(1)</enum><text display-inline="yes-display-inline">maintain a national database on lifespan
respite care;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB0FD0F09DC654A8BAB3EBE2DF73D06F0"><enum>(2)</enum><text display-inline="yes-display-inline">provide training and technical assistance
to State, community, and nonprofit respite care programs; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID07618BAE0DFE4CE7BF79A51160B3D87D"><enum>(3)</enum><text display-inline="yes-display-inline">provide information, referral, and
educational programs to the public on lifespan respite care.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4EA8B6457EAF4347A6994891DB058DB4"><enum>(c)</enum><header>Authorization
of appropriations</header><text display-inline="yes-display-inline">There are
authorized to be appropriated to carry out this section, such sums as may be
necessary for each of fiscal years 2006 through
2010.</text>
