		<section changed="deleted" commented="no" display-inline="no-display-inline" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Diesel Emissions Reduction Act of

			 2005</short-title></quote>.</text>

		</section><section changed="deleted" commented="no" display-inline="no-display-inline" id="id1A844BB06D154CE4A762A31FD13DA014" reported-display-style="strikethrough" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idAB274ABE9F184247B7C5315E967206F9" reported-display-style="strikethrough"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means

			 the Administrator of the Environmental Protection Agency.</text>

			</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID3fa6890195204db98147a349f5e56ee8" reported-display-style="strikethrough"><enum>(2)</enum><header>Certified engine

			 configuration</header><text display-inline="yes-display-inline">The term

			 <term>certified engine configuration</term> means a new, rebuilt, or

			 remanufactured engine configuration—</text>

				<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDa4b1680d6b714a158b6ea6c7f70ee5a7" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">that has been certified or verified

			 by—</text>

					<clause changed="deleted" commented="no" display-inline="no-display-inline" id="IDee2b5e094d1c4b0e82e0ca531ac90d20" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator; or</text>

					</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id0A9A5AF11C4C454E90BF347C5E3FB462" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">the California Air Resources Board;</text>

					</clause></subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID62a74fd9c4d44d07b774cd995de10ff2" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">that meets or is rebuilt or remanufactured

			 to a more stringent set of engine emission standards, as determined by the

			 Administrator; and</text>

				</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id3FCDF35B242B447EB1596043D7CA4A5F" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a certified engine

			 configuration involving the replacement of an existing engine or vehicle, an

			 engine configuration that replaced an engine that was—</text>

					<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id47B14F6E371746B28FA145644437F9E7" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">removed from the vehicle; and</text>

					</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id895E66D30BF74EF19B227222D8970167" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">returned to the supplier for

			 remanufacturing to a more stringent set of engine emissions standards or for

			 scrappage.</text>

					</clause></subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID72f6eedb6bd942b2afed1ac9164331ae" reported-display-style="strikethrough"><enum>(3)</enum><header>Eligible

			 entity</header><text display-inline="yes-display-inline">The term

			 <term>eligible entity</term> means—</text>

				<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID0588dcfd87cc43cc96f2366f2247b36a" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">a regional, State, local, or tribal agency

			 with jurisdiction over transportation or air quality; and</text>

				</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDfdc0b00be76345d690f8f9cdced42c2f" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">a nonprofit organization or institution

			 that—</text>

					<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id8FA117F2979D45F79F2109BEBB859496" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">represents organizations that own or

			 operate diesel fleets; or</text>

					</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id4D07561550394220A75DCB08D76187DD" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">has, as its principal purpose, the

			 promotion of transportation or air quality.</text>

					</clause></subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDec2dd3194781434cb58631a8f16db430" reported-display-style="strikethrough"><enum>(4)</enum><header>Emerging

			 technology</header><text display-inline="yes-display-inline">The term

			 <term>emerging technology</term> means a technology that is not certified or

			 verified by the Administrator or the California Air Resources Board but for

			 which an approvable application and test plan has been submitted for

			 verification to the Administrator or the California Air Resources Board.</text>

			</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID67aa846cb42e4972aa6593ae92a2f8e9" reported-display-style="strikethrough"><enum>(5)</enum><header>Heavy-duty

			 truck</header><text display-inline="yes-display-inline">The term

			 <term>heavy-duty truck</term> has the meaning given the term <term>heavy duty

			 vehicle</term> in section 202 of the Clean Air Act (42 U.S.C. 7521).</text>

			</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID336f9f366931453db5ba7559f457ee81" reported-display-style="strikethrough"><enum>(6)</enum><header>Medium-duty

			 truck</header><text display-inline="yes-display-inline">The term

			 <term>medium-duty truck</term> has such meaning as shall be determined by the

			 Administrator, by regulation.</text>

			</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDa381776c8ca64a698ea44f858aae390d" reported-display-style="strikethrough"><enum>(7)</enum><header>Verified

			 technology</header><text display-inline="yes-display-inline">The term

			 <term>verified technology</term> means a pollution control technology,

			 including a retrofit technology, that has been verified by—</text>

				<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID3a96c6a3a8124a0da57db4be653de119" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the Administrator; or</text>

				</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID77b15e8f6cc04e47b66eb68a3631cd1e" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the California Air Resources Board.</text>

				</subparagraph></paragraph></section><section changed="deleted" commented="no" display-inline="no-display-inline" id="idF12A017E39E34704A1BEB84DFF725DE1" reported-display-style="strikethrough" section-type="subsequent-section"><enum>3.</enum><header>National grant and

			 loan programs</header>

			<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="idD1201DA9559C4FB7901D976761BE32A6" reported-display-style="strikethrough"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Administrator

			 shall use 70 percent of the funds made available to carry out this Act for each

			 fiscal year to provide grants and low-cost revolving loans, as determined by

			 the Administrator, on a competitive basis, to eligible entities to achieve

			 significant reductions in diesel emissions in terms of—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idEF83B9A7508F4F7A80D4EBD6C77409A0" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">tons of pollution produced; and</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id84168E3C753F483BBA6DA7837B7596BC" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">diesel emissions exposure, particularly

			 from fleets operating in areas designated by the Administrator as poor air

			 quality areas.</text>

				</paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id0B371FFF64DC449D934220531C7A7D1C" reported-display-style="strikethrough"><enum>(b)</enum><header>Distribution</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id7F486FAF55C0401393DE350492AAFE07" reported-display-style="strikethrough"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Administrator

			 shall distribute funds made available for a fiscal year under this Act in

			 accordance with this section.</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idE98F554DDED6412487CEE3B2F8557276" reported-display-style="strikethrough"><enum>(2)</enum><header>Fleets</header><text display-inline="yes-display-inline">The Administrator shall provide not less

			 than 50 percent of funds available for a fiscal year under this section to

			 eligible entities for the benefit of public fleets.</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id984F0B4A0CDB4A049E57ADEE802275DC" reported-display-style="strikethrough"><enum>(3)</enum><header>Engine

			 configurations and technologies</header>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id3C8080EB889A4BC2968EE11EDD1BA20A" reported-display-style="strikethrough"><enum>(A)</enum><header>Certified engine

			 configurations and verified technologies</header><text display-inline="yes-display-inline">The Administrator shall provide not less

			 than 90 percent of funds available for a fiscal year under this section to

			 eligible entities for projects using—</text>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="idC6073AF38D034957AAA15F152401FB58" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">a certified engine configuration; or</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="idFA9412F41E8E459EBCD4C9C28AE1760B" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">a verified technology.</text>

						</clause></subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id1743A2AB601C43A3B825C60558D482B1" reported-display-style="strikethrough"><enum>(B)</enum><header>Emerging

			 technologies</header>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id96655B2AB66E441696C99399B53BE6EB" reported-display-style="strikethrough"><enum>(i)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Administrator

			 shall provide not more than 10 percent of funds available for a fiscal year

			 under this section to eligible entities for the development and

			 commercialization of emerging technologies.</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id6E75B2A71E4B440E97E6240749FDF34C" reported-display-style="strikethrough"><enum>(ii)</enum><header>Application and

			 test plan</header><text display-inline="yes-display-inline">To receive funds

			 under clause (i), a manufacturer, in consultation with an eligible entity,

			 shall submit for verification to the Administrator or the California Air

			 Resources Board a test plan for the emerging technology, together with the

			 application under subsection (c).</text>

						</clause></subparagraph></paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id327850F4F7AF41A8AB954E87D189B49E" reported-display-style="strikethrough"><enum>(c)</enum><header>Applications</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idE1EF26E115194B2E94D537D33E6134EA" reported-display-style="strikethrough"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">To receive a grant or

			 loan under this section, an eligible entity shall submit to the Administrator

			 an application at a time, in a manner, and including such information as the

			 Administrator may require.</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id372F8B518C9F4D45A050148029A41BB1" reported-display-style="strikethrough"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">An application under this subsection shall

			 include—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id7DFA940F8AF54C149981D9696D1BB457" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">a description of the air quality of the

			 area served by the eligible entity;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id6C43514AFAE44A5E8EB25B535C949D90" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the quantity of air pollution produced by

			 the diesel fleet in the area served by the eligible entity;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id85EB0DCD7A354856B2FB5C726F0377E7" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">a description of the project proposed by

			 the eligible entity, including—</text>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id057D163355924EA29AAD7B59F76B220A" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">any certified engine configuration,

			 verified technology, or emerging technology to be used by the eligible entity;

			 and</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="idA7A5A82B3A35457689523FEC6226A892" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">the means by which the project will achieve

			 a significant reduction in diesel emissions;</text>

						</clause></subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id36185BC1BDD742AB868B46769D110283" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">an evaluation (using methodology approved

			 by the Administrator or the National Academy of Sciences) of the quantifiable

			 and unquantifiable benefits of the emissions reductions of the proposed

			 project;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id2A34E32EE18A410C82E95D5B947EDAAE" reported-display-style="strikethrough"><enum>(E)</enum><text display-inline="yes-display-inline">an estimate of the cost of the proposed

			 project;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id6EBDEB9F4008428980B3FB548866B592" reported-display-style="strikethrough"><enum>(F)</enum><text display-inline="yes-display-inline">a description of the age and expected

			 lifetime control of the equipment used by the eligible entity;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id6173B3EE64884CD6ACF36552312119E9" reported-display-style="strikethrough"><enum>(G)</enum><text display-inline="yes-display-inline">a description of the diesel fuel available

			 to the eligible entity, including the sulfur content of the fuel; and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id9AB20E4B43E94B3D805C464DF4C8D1A3" reported-display-style="strikethrough"><enum>(H)</enum><text display-inline="yes-display-inline">provisions for the monitoring and

			 verification of the project.</text>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idA3C7FA05AD6B435F9FD99C2EF772A54A" reported-display-style="strikethrough"><enum>(3)</enum><header>Priority</header><text display-inline="yes-display-inline">In providing a grant or loan under this

			 section, the Administrator shall give priority to proposed projects that, as

			 determined by the Administrator—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id8A69EECCC01341379159B03CA3AC518D" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">maximize public health benefits;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id1A00C41FEBF0489486261D455A0DBEB4" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">are the most cost-effective;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idD6810D25BADD4ACCBBDA727725EE6263" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">serve areas—</text>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id768F188009D941BC8F590606C3C62CB8" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">with the highest population density;</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id60966B77A4404DFA96B29DA8DFD0C4D6" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">that are poor air quality areas, including

			 areas identified by the Administrator as—</text>

							<subclause changed="deleted" commented="no" display-inline="no-display-inline" id="idC9AC5A5D7EA842D0BFCA802D1AAB324A" reported-display-style="strikethrough"><enum>(I)</enum><text display-inline="yes-display-inline">in nonattainment or maintenance of national

			 ambient air quality standards for a criteria pollutant;</text>

							</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="id31465721108E46109B0B6AB71ABE0CFD" reported-display-style="strikethrough"><enum>(II)</enum><text display-inline="yes-display-inline">Federal Class I areas; or</text>

							</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="id367710A123E444C98E0C0D59DA479C0F" reported-display-style="strikethrough"><enum>(III)</enum><text display-inline="yes-display-inline">areas with toxic air pollutant

			 concerns;</text>

							</subclause></clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id45E4531D836E45E0BAF094BB4B6461A6" reported-display-style="strikethrough"><enum>(iii)</enum><text display-inline="yes-display-inline">that receive a disproportionate quantity of

			 air pollution from a diesel fleet, including ports, rail yards, and

			 distribution centers; or</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="idA59987E5B4924351B7A43EC1610B6DA8" reported-display-style="strikethrough"><enum>(iv)</enum><text display-inline="yes-display-inline">that use a community-based multistakeholder

			 collaborative process to reduce toxic emissions;</text>

						</clause></subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id3F0C8E648D964B1BB8F18F5BBB935F45" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">include a certified engine configuration,

			 verified technology, or emerging technology that has a long expected useful

			 life;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idF4A9E65A09944F3CBAFC050F4D6936E2" reported-display-style="strikethrough"><enum>(E)</enum><text display-inline="yes-display-inline">will maximize the useful life of any

			 retrofit technology used by the eligible entity; and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idF8AA9BCD09264395AB280A0519BE5BD0" reported-display-style="strikethrough"><enum>(F)</enum><text display-inline="yes-display-inline">use diesel fuel with a sulfur content of

			 less than or equal to 15 parts per million, as the Administrator determines to

			 be appropriate.</text>

					</subparagraph></paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id11B7512C794745F6B85F41CB38A5DD99" reported-display-style="strikethrough"><enum>(d)</enum><header>Use of

			 funds</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id8CB0F8785C9748C3955669C1B6E1C30D" reported-display-style="strikethrough"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">An eligible entity

			 may use a grant or loan provided under this section to fund the costs

			 of—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id391F7BF8DF294EABA4A6606AAB0B9E24" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">a retrofit technology (including any

			 incremental costs of a repowered or new diesel engine) that significantly

			 reduces emissions through development and implementation of a certified engine

			 configuration, verified technology, or emerging technology for—</text>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id84B9E0D553C3410EB4B89B6F59B8BD60" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">a bus;</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id3D06BFB2AEE1483A841A8CA9CE318010" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">a medium-duty truck or a heavy-duty

			 truck;</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id2110E9640D4045A49402395F0163A191" reported-display-style="strikethrough"><enum>(iii)</enum><text display-inline="yes-display-inline">a marine engine;</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id27156D6983F043F19A76100BAC9590A4" reported-display-style="strikethrough"><enum>(iv)</enum><text display-inline="yes-display-inline">a locomotive; or</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="idFDC0CDFB4A22414C9B3193A74D22FEA6" reported-display-style="strikethrough"><enum>(v)</enum><text display-inline="yes-display-inline">a nonroad engine or vehicle used in—</text>

							<subclause changed="deleted" commented="no" display-inline="no-display-inline" id="id4F99EAD4CE8849BDADFA8104C3BD7BAA" reported-display-style="strikethrough"><enum>(I)</enum><text display-inline="yes-display-inline">construction;</text>

							</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="id8D38E187B5BF4466B9773459490816C3" reported-display-style="strikethrough"><enum>(II)</enum><text display-inline="yes-display-inline">handling of cargo (including at a port or

			 airport);</text>

							</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="id78CFDDEB8BCC4432A956F0860BD5B7FF" reported-display-style="strikethrough"><enum>(III)</enum><text display-inline="yes-display-inline">agriculture;</text>

							</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="idFD7C3E4B0BA54D8682B068FA7B7DBF42" reported-display-style="strikethrough"><enum>(IV)</enum><text display-inline="yes-display-inline">mining; or</text>

							</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="id8A5F0577B4DD4F2ABD00A4FFFD7F9577" reported-display-style="strikethrough"><enum>(V)</enum><text display-inline="yes-display-inline">energy production; or</text>

							</subclause></clause></subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idD98415ED589E4E6187CD0CDAC19F0579" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">an idle-reduction program involving a

			 vehicle or equipment described in subparagraph (A).</text>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID524118f67c55491280755f0af5023767" reported-display-style="strikethrough"><enum>(2)</enum><header>Regulatory

			 programs</header>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idB706D7CD17B84B08B368480629669DB8" reported-display-style="strikethrough"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Notwithstanding

			 paragraph (1), no grant or loan provided under this section shall be used to

			 fund the costs of emissions reductions that are mandated under Federal, State

			 or local law.</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idC9B644D5BAA24839BAD4909D41F60DFF" reported-display-style="strikethrough"><enum>(B)</enum><header>Mandated</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), voluntary

			 or elective emission reduction measures shall not be considered

			 <term>mandated</term>, regardless of whether the reductions are included in the

			 State implementation plan of a State.</text>

					</subparagraph></paragraph></subsection></section><section changed="deleted" commented="no" display-inline="no-display-inline" id="idE168EEF6A71B424AB114AD4FC315DF43" reported-display-style="strikethrough" section-type="subsequent-section"><enum>4.</enum><header>State grant and loan

			 programs</header>

			<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id2C07BD8D384642759442931BC271187F" reported-display-style="strikethrough"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subject to the

			 availability of adequate appropriations, the Administrator shall use 30 percent

			 of the funds made available for a fiscal year under this Act to support grant

			 and loan programs administered by States that are designed to achieve

			 significant reductions in diesel emissions.</text>

			</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id09F328AA0FE646D8A67EB3F7CA24D3C2" reported-display-style="strikethrough"><enum>(b)</enum><header>Applications</header><text display-inline="yes-display-inline">The Administrator shall—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id1368EDA391B94DA88B367EEC3B8E6160" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">provide to States guidance for use in

			 applying for grant or loan funds under this section, including information

			 regarding—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id471DDC7CC4E342B3B5101A92D46AC1E3" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the process and forms for

			 applications;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idC4776356FC44417A8A19610233DEC6F7" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">permissible uses of funds received;

			 and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id26A48A00F67E435F98239AB4FC680AFF" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">the cost-effectiveness of various emission

			 reduction technologies eligible to be carried out using funds provided under

			 this section; and</text>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idD78CB0D3964548809557741AF0D73D35" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">establish, for applications described in

			 paragraph (1)—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id49A777E822A643629D70936EEBD6305F" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">an annual deadline for submission of the

			 applications;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idB30DFC7E767042968F8ECC7FDA38E1FF" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">a process by which the Administrator shall

			 approve or disapprove each application; and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id2069603A04EE49FFAB6EAF7D4FB097B5" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">a streamlined process by which a State may

			 renew an application described in paragraph (1) for subsequent fiscal

			 years.</text>

					</subparagraph></paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="idA295DDC020814BB4AAC997741D87A909" reported-display-style="strikethrough"><enum>(c)</enum><header>Allocation of

			 funds</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idBB05153AAD214D3EB62DBE17926F4929" reported-display-style="strikethrough"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">For each fiscal year,

			 the Administrator shall allocate among States for which applications are

			 approved by the Administrator under subsection (b)(2)(B) funds made available

			 to carry out this section for the fiscal year.</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idAEFDBCD06DA64A9DA3D9AE5E59F0326D" reported-display-style="strikethrough"><enum>(2)</enum><header>Allocation</header><text display-inline="yes-display-inline">Using not more than 20 percent of the funds

			 made available to carry out this section for a fiscal year, the Administrator

			 shall provide to each State described in paragraph (1) for the fiscal year an

			 allocation of funds that is equal to—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id941C47D8D5D1474092BE6B7E270D7C84" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">if each of the 50 States qualifies for an

			 allocation, an amount equal to 2 percent of the funds made available to carry

			 out this section; or</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id83A4D6977E394250BC6694B516B7BE22" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">if fewer than 50 States qualifies for an

			 allocation, an amount equal to the amount described in subparagraph (A), plus

			 an additional amount equal to the product obtained by multiplying—</text>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id2756B8EF2ABE44E581281A9847E4012A" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">the proportion that—</text>

							<subclause changed="deleted" commented="no" display-inline="no-display-inline" id="id4DABD11BDAFD4F5DA3FA6212552235D0" reported-display-style="strikethrough"><enum>(I)</enum><text display-inline="yes-display-inline">the population of the State; bears

			 to</text>

							</subclause><subclause changed="deleted" commented="no" display-inline="no-display-inline" id="idEF393FCFA2944632BA9EC4825D46231B" reported-display-style="strikethrough"><enum>(II)</enum><text display-inline="yes-display-inline">the population of all States described in

			 paragraph (1); by</text>

							</subclause></clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="idDBD4E28640394F2680BDD90BB1C292ED" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">the amount of funds remaining after each

			 State described in paragraph (1) receives the 2-percent allocation under this

			 paragraph.</text>

						</clause></subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id71312502FA214F22988CACA8EE4DCF02" reported-display-style="strikethrough"><enum>(3)</enum><header>State matching

			 incentive</header>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id9D7464370E6849E5BF6FE00993686A59" reported-display-style="strikethrough"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">If a State agrees to

			 match the allocation provided to the State under paragraph (2) for a fiscal

			 year, the Administrator shall provide to the State for the fiscal year an

			 additional amount equal to 50 percent of the allocation of the State under

			 paragraph (2).</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idD1F59A13646C4DD78EF9FDE791647441" reported-display-style="strikethrough"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">A State—</text>

						<clause changed="deleted" commented="no" display-inline="no-display-inline" id="id959252AC73A04795BA0555B3677AADDE" reported-display-style="strikethrough"><enum>(i)</enum><text display-inline="yes-display-inline">may not use funds received under this Act

			 to pay a matching share required under this subsection; and</text>

						</clause><clause changed="deleted" commented="no" display-inline="no-display-inline" id="id601275E23B8A4557B254250C6BAAC07A" reported-display-style="strikethrough"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not be required to provide a matching

			 share for any additional amount received under subparagraph (A).</text>

						</clause></subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id5A672281CA2747B1A49BC5AAD7AEF795" reported-display-style="strikethrough"><enum>(4)</enum><header>Unclaimed

			 funds</header><text display-inline="yes-display-inline">Any funds that are not

			 claimed by a State for a fiscal year under this subsection shall be used to

			 carry out section 3.</text>

				</paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="idD8D5E085508046E599CD77340525936E" reported-display-style="strikethrough"><enum>(d)</enum><header>Administration</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id6345D96303CC4DA08C73F3A6F6C4EA0C" reported-display-style="strikethrough"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subject to paragraphs

			 (2) and (3) and, to the extent practicable, the priority areas listed in

			 section 3(c)(3), a State shall use any funds provided under this section to

			 develop and implement such grant and low-cost revolving loan programs in the

			 State as are appropriate to meet State needs and goals relating to the

			 reduction of diesel emissions.</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id6DD069056E084824A7C9784C95B5BE50" reported-display-style="strikethrough"><enum>(2)</enum><header>Apportionment of

			 funds</header><text display-inline="yes-display-inline">The Governor of a State

			 that receives funding under this section may determine the portion of funds to

			 be provided as grants or loans.</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id9AA8706B4B814EAA96A615DC276969E6" reported-display-style="strikethrough"><enum>(3)</enum><header>Use of

			 funds</header><text display-inline="yes-display-inline">A grant or loan

			 provided under this section may be used for a project relating to—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id531483100BC94633B14BB717E571DBEC" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">a certified engine configuration; or</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idA75677ACF48344049B297425AB604DDB" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">a verified technology.</text>

					</subparagraph></paragraph></subsection></section><section changed="deleted" commented="no" display-inline="no-display-inline" id="idD04A8B6DE2774F24AC23D64B027EABA7" reported-display-style="strikethrough" section-type="subsequent-section"><enum>5.</enum><header>Evaluation and

			 report</header>

			<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id1EBB0BE6297C4759A7108B72CBA4663E" reported-display-style="strikethrough"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 2

			 years after the date of enactment of this Act, and biennially thereafter, the

			 Administrator shall submit to Congress a report evaluating the implementation

			 of the programs under this Act.</text>

			</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id3F7B4F1500DF42F4B46D98F0E9491BC1" reported-display-style="strikethrough"><enum>(b)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The report shall include a description

			 of—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id59953149591949A2935D4380BA898E9E" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">the total number of grant applications

			 received;</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id9EDF35EDCF2C4DC0934BC3C5FE2B1839" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">each grant or loan made under this Act,

			 including the amount of the grant or loan;</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id697E950381704CEE9CD5560D9D479BF8" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">each project for which a grant or loan is

			 provided under this Act, including the criteria used to select the grant or

			 loan recipients;</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id734AA746D3284B88A64A426DFA083898" reported-display-style="strikethrough"><enum>(4)</enum><text display-inline="yes-display-inline">the estimated air quality benefits,

			 cost-effectiveness, and cost-benefits of the grant and loan programs under this

			 Act;</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id5B89A5A0E5C5405BB11F8A95C26040D2" reported-display-style="strikethrough"><enum>(5)</enum><text display-inline="yes-display-inline">the problems encountered by projects for

			 which a grant or loan is provided under this Act; and</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id3684E576070D4B658EDA53DD31E11AFB" reported-display-style="strikethrough"><enum>(6)</enum><text display-inline="yes-display-inline">any other information the Administrator

			 considers to be appropriate.</text>

				</paragraph></subsection></section><section changed="deleted" commented="no" display-inline="no-display-inline" id="id4BA4AD49B6A0481B99DDFA0EA8969687" reported-display-style="strikethrough" section-type="subsequent-section"><enum>6.</enum><header>Outreach and

			 incentives</header>

			<subsection changed="deleted" commented="no" display-inline="no-display-inline" id="id74FD17CA8FF948C5851072C616AF3723" reported-display-style="strikethrough"><enum>(a)</enum><header>Definition of

			 eligible technology</header><text display-inline="yes-display-inline">In this

			 section, the term <term>eligible technology</term> means—</text>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id2AD626871902439BAF42F3B7AB8256D0" reported-display-style="strikethrough"><enum>(1)</enum><text display-inline="yes-display-inline">a verified technology; or</text>

				</paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="idFEDBAC4A22F64CEA8230E5282413A9C2" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">an emerging technology.</text>

				</paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID3670d8d092f84e709b283fa9ace41639" reported-display-style="strikethrough"><enum>(b)</enum><header>Technology

			 transfer program</header>

				<paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id414F3336FF794077B1D5A6B7A5EDEF2C" reported-display-style="strikethrough"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Administrator

			 shall establish a program under which the Administrator—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="idD9E8C37F110448ED8DEF9AC0C2857E66" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">informs stakeholders of the benefits of

			 eligible technologies; and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="id6B78F09168F74D15B787E377405F79D7" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">develops nonfinancial incentives to promote

			 the use of eligible technologies.</text>

					</subparagraph></paragraph><paragraph changed="deleted" commented="no" display-inline="no-display-inline" id="id2B48E97E58D5454FA706DAB6CA65623D" reported-display-style="strikethrough"><enum>(2)</enum><header>Eligible

			 stakeholders</header><text display-inline="yes-display-inline">Eligible

			 stakeholders under this section include—</text>

					<subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID1d63228d678b4ed89f5328a3536cf837" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">equipment owners and operators;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDaf6b6adf8b9d45dc8393153624d126a4" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">emission control technology

			 manufacturers;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDac541054f3484cce9e3dcde42afa09b4" reported-display-style="strikethrough"><enum>(C)</enum><text display-inline="yes-display-inline">engine and equipment manufacturers;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID331f90022db24744b340a4b2cc7ceb2c" reported-display-style="strikethrough"><enum>(D)</enum><text display-inline="yes-display-inline">State and local officials responsible for

			 air quality management;</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="IDc0cd5f6f7e6d413aa301f47cb46e73d0" reported-display-style="strikethrough"><enum>(E)</enum><text display-inline="yes-display-inline">community organizations; and</text>

					</subparagraph><subparagraph changed="deleted" commented="no" display-inline="no-display-inline" id="ID40453d8682d84cbf9f34d8c054e1c809" reported-display-style="strikethrough"><enum>(F)</enum><text display-inline="yes-display-inline">public health and environmental

			 organizations.</text>

					</subparagraph></paragraph></subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID733f887d1b754957969f64c9eb4d9193" reported-display-style="strikethrough"><enum>(c)</enum><header>State

			 implementation plans</header><text display-inline="yes-display-inline">The

			 Administrator shall develop appropriate guidance to provide credit to a State

			 for emission reductions in the State created by the use of eligible

			 technologies through a State implementation plan under section 110 of the Clean

			 Air Act (42 U.S.C. 7410).</text>

			</subsection><subsection changed="deleted" commented="no" display-inline="no-display-inline" id="ID7372544ad74849a790f3ae83c1803d36" reported-display-style="strikethrough"><enum>(d)</enum><header>International

			 markets</header><text display-inline="yes-display-inline">The Administrator, in

			 coordination with the Department of Commerce and industry stakeholders, shall

			 inform foreign countries with air quality problems of the potential of

			 technology developed or used in the United States to provide emission

			 reductions in those countries.</text>

			</subsection></section><section changed="deleted" commented="no" display-inline="no-display-inline" id="id74794302FF7542D99447780FA34F1559" reported-display-style="strikethrough" section-type="subsequent-section"><enum>7.</enum><header>Effect of

			 Act</header><text display-inline="no-display-inline">Nothing in this Act

			 affects any authority under the Clean Air Act (42 U.S.C. 7401 et seq.) in

			 existence on the day before the date of enactment of this Act.</text>

		</section><section changed="deleted" commented="no" display-inline="no-display-inline" id="id830E4AFDD7F4438193462489DB2BB968" reported-display-style="strikethrough" section-type="subsequent-section"><enum>8.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There is

			 authorized to be appropriated to carry out this Act $200,000,000 for each of

			 fiscal years 2006 through 2010, to remain available until expended.</text>

			 Emissions Reduction Act of 2005</quote>.</text>

		</section><section changed="added" id="ID96a8e24ee9f344d0811fe9da974fe121" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph changed="added" id="ID0dda0fc5ad704f71b2a196f984bbc7a6" reported-display-style="italic"><enum>(1)</enum><header>Administrator</header><text>The

			 term <term>Administrator</term> means the Administrator of the Environmental

			 Protection Agency.</text>

			</paragraph><paragraph changed="added" id="IDc26ce7fbdaf74d83bcdc1bdcd5b4ec73" reported-display-style="italic"><enum>(2)</enum><header>Certified engine

			 configuration</header><text>The term <term>certified engine

			 configuration</term> means a new, rebuilt, or remanufactured engine

			 configuration—</text>

				<subparagraph changed="added" id="ID397fd2b2aaa2450a8571c9c333e1c533" reported-display-style="italic"><enum>(A)</enum><text>that has been certified

			 or verified by—</text>

					<clause changed="added" id="IDf525b8bca9bd4ba1875583447a40a019" reported-display-style="italic"><enum>(i)</enum><text>the Administrator;

			 or</text>

					</clause><clause changed="added" id="ID34414e55525d43d4a8f3f51d3dbd66f6" reported-display-style="italic"><enum>(ii)</enum><text>the California Air

			 Resources Board;</text>

					</clause></subparagraph><subparagraph changed="added" id="ID9caec1b941c847a5a0f64eb09b75dd5e" reported-display-style="italic"><enum>(B)</enum><text>that meets or is rebuilt

			 or remanufactured to a more stringent set of engine emission standards, as

			 determined by the Administrator; and</text>

				</subparagraph><subparagraph changed="added" id="ID5b0930efbca142e68315b53502a719d2" reported-display-style="italic"><enum>(C)</enum><text>in the case of a

			 certified engine configuration involving the replacement of an existing engine

			 or vehicle, an engine configuration that replaced an engine that was—</text>

					<clause changed="added" id="ID387cfb8f44b74e8ca48dd96d25c93fce" reported-display-style="italic"><enum>(i)</enum><text>removed from the vehicle;

			 and</text>

					</clause><clause changed="added" id="IDe469fef1b84a4409a2b00288f61aa7ff" reported-display-style="italic"><enum>(ii)</enum><text>returned to the supplier

			 for remanufacturing to a more stringent set of engine emissions standards or

			 for scrappage.</text>

					</clause></subparagraph></paragraph><paragraph changed="added" id="ID052d8b6cf3fb4a7f91d519ae345b9e25" reported-display-style="italic"><enum>(3)</enum><header>Eligible

			 entity</header><text>The term <term>eligible entity</term> means—</text>

				<subparagraph changed="added" id="IDef9ccece013346dd83e11a3bfaad92c6" reported-display-style="italic"><enum>(A)</enum><text>a regional, State, local,

			 or tribal agency or port authority with jurisdiction over transportation or air

			 quality; and</text>

				</subparagraph><subparagraph changed="added" id="ID89f19255b020468e9891ee875fef2a7e" reported-display-style="italic"><enum>(B)</enum><text>a nonprofit organization

			 or institution that—</text>

					<clause changed="added" id="ID3bf47eb4429349b8a1a2b4b028348054" reported-display-style="italic"><enum>(i)</enum><text>represents or provides

			 pollution reduction or educational services to persons or organizations that

			 own or operate diesel fleets; or</text>

					</clause><clause changed="added" id="IDc21b9dfb5ce24208855b7501250a0ee5" reported-display-style="italic"><enum>(ii)</enum><text>has, as its principal

			 purpose, the promotion of transportation or air quality.</text>

					</clause></subparagraph></paragraph><paragraph changed="added" id="IDc1d1103ff628425c8686d0689d1dc472" reported-display-style="italic"><enum>(4)</enum><header>Emerging

			 technology</header><text>The term <term>emerging technology</term> means a

			 technology that is not certified or verified by the Administrator or the

			 California Air Resources Board but for which an approvable application and test

			 plan has been submitted for verification to the Administrator or the California

			 Air Resources Board.</text>

			</paragraph><paragraph changed="added" id="IDee463db8d99b46ac9f5cfcc290b30299" reported-display-style="italic"><enum>(5)</enum><header>Fleet</header><text>The

			 term <term>fleet</term> means 1 or more diesel vehicles or mobile or stationary

			 diesel engines.</text>

			</paragraph><paragraph changed="added" id="IDd8843003a26a471b9e0fb88236493e31" reported-display-style="italic"><enum>(6)</enum><header>Heavy-duty

			 truck</header><text>The term <term>heavy-duty truck</term> has the meaning

			 given the term <quote>heavy duty vehicle</quote> in section 202 of the Clean

			 Air Act (42 U.S.C. 7521).</text>

			</paragraph><paragraph changed="added" id="ID44cb39e6728e4eb3a6517093e1720b3c" reported-display-style="italic"><enum>(7)</enum><header>Medium-duty

			 truck</header><text>The term <term>medium-duty truck</term> has such meaning as

			 shall be determined by the Administrator, by regulation.</text>

			</paragraph><paragraph changed="added" id="ID1d01374c308d4b1dac6d85c262a9d018" reported-display-style="italic"><enum>(8)</enum><header>Verified

			 technology</header><text>The term <term>verified technology</term> means a

			 pollution control technology (including a retrofit technology), advanced

			 truckstop electrification system, or auxiliary power unit that has been

			 verified by—</text>

				<subparagraph changed="added" id="ID44e8e3a88ecd489a8492c7bb5df3b1df" reported-display-style="italic"><enum>(A)</enum><text>the Administrator;

			 or</text>

				</subparagraph><subparagraph changed="added" id="IDc5a000e877b64f90b5f4f6fd849a2446" reported-display-style="italic"><enum>(B)</enum><text>the California Air

			 Resources Board.</text>

				</subparagraph></paragraph></section><section changed="added" id="ID1f8fd6db3f6b4281a892967291502f8e" reported-display-style="italic"><enum>3.</enum><header>National grant and loan

			 programs</header>

			<subsection changed="added" id="ID53af0914e5b942b2b6da83f083b94c1a" reported-display-style="italic"><enum>(a)</enum><header>In

			 general</header><text>The Administrator shall use 70 percent of the funds made

			 available to carry out this Act for each fiscal year to provide grants and

			 low-cost revolving loans, as determined by the Administrator, on a competitive

			 basis, to eligible entities to achieve significant reductions in diesel

			 emissions in terms of—</text>

				<paragraph changed="added" id="ID2cac759708bc49c882cdc1d40df216e4" reported-display-style="italic"><enum>(1)</enum><text>tons of pollution

			 produced; and</text>

				</paragraph><paragraph changed="added" id="IDdd76350854bc4aa7919858c05303b758" reported-display-style="italic"><enum>(2)</enum><text>diesel emissions

			 exposure, particularly from fleets operating in areas designated by the

			 Administrator as poor air quality areas.</text>

				</paragraph></subsection><subsection changed="added" id="IDa16a8f655a2b49cc99d63855192d5e06" reported-display-style="italic"><enum>(b)</enum><header>Distribution</header>

				<paragraph changed="added" id="ID32a61c6bc3434207ab8c1e001f7dbc49" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>The Administrator shall distribute funds made available

			 for a fiscal year under this Act in accordance with this section.</text>

				</paragraph><paragraph changed="added" id="IDfcb125db535845aeb751f6d063312f36" reported-display-style="italic"><enum>(2)</enum><header>Fleets</header><text>The

			 Administrator shall provide not less than 50 percent of funds available for a

			 fiscal year under this section to eligible entities for the benefit of public

			 fleets.</text>

				</paragraph><paragraph changed="added" id="ID97b818ff2c2340baad560c032f625cad" reported-display-style="italic"><enum>(3)</enum><header>Engine configurations

			 and technologies</header>

					<subparagraph changed="added" id="ID1ea3d54e58b14dbbaf79ebad7db07d96" reported-display-style="italic"><enum>(A)</enum><header>Certified engine

			 configurations and verified technologies</header><text>The Administrator shall

			 provide not less than 90 percent of funds available for a fiscal year under

			 this section to eligible entities for projects using—</text>

						<clause changed="added" id="ID08a22d6abfef44a4b77a217278f5a2de" reported-display-style="italic"><enum>(i)</enum><text>a certified engine

			 configuration; or</text>

						</clause><clause changed="added" id="ID385d074bd8494ab68ddc0c750f3e6997" reported-display-style="italic"><enum>(ii)</enum><text>a verified

			 technology.</text>

						</clause></subparagraph><subparagraph changed="added" id="ID7536c31df03a4901a5e8994e5b34edcf" reported-display-style="italic"><enum>(B)</enum><header>Emerging

			 technologies</header>

						<clause changed="added" id="IDe1a3f0856e8949e6a4822aae679bbd79" reported-display-style="italic"><enum>(i)</enum><header>In

			 general</header><text>The Administrator shall provide not more than 10 percent

			 of funds available for a fiscal year under this section to eligible entities

			 for the development and commercialization of emerging technologies.</text>

						</clause><clause changed="added" id="ID9be2c97bd0884faea51dfa8bdf006a25" reported-display-style="italic"><enum>(ii)</enum><header>Application and test

			 plan</header><text>To receive funds under clause (i), a manufacturer, in

			 consultation with an eligible entity, shall submit for verification to the

			 Administrator or the California Air Resources Board a test plan for the

			 emerging technology, together with the application under subsection (c).</text>

						</clause></subparagraph></paragraph></subsection><subsection changed="added" id="ID5de5c49ef0fd4dcbbb9e1ac40ee8de21" reported-display-style="italic"><enum>(c)</enum><header>Applications</header>

				<paragraph changed="added" id="ID64849fe8587c44a48d29728ac9265eb5" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>To receive a grant or loan under this section, an

			 eligible entity shall submit to the Administrator an application at a time, in

			 a manner, and including such information as the Administrator may

			 require.</text>

				</paragraph><paragraph changed="added" id="IDa0f1caf34b08412da1f74416c81f491b" reported-display-style="italic"><enum>(2)</enum><header>Inclusions</header><text>An

			 application under this subsection shall include—</text>

					<subparagraph changed="added" id="IDbc5eae5caac04f709868adaea0fc03e0" reported-display-style="italic"><enum>(A)</enum><text>a description of the air

			 quality of the area served by the eligible entity;</text>

					</subparagraph><subparagraph changed="added" id="ID1431df488f1f45b68b9e44f3a8b4bb2d" reported-display-style="italic"><enum>(B)</enum><text>the quantity of air

			 pollution produced by the diesel fleets in the area served by the eligible

			 entity;</text>

					</subparagraph><subparagraph changed="added" id="IDf97d6a9774414d20aad6e5ff0b9cd0b0" reported-display-style="italic"><enum>(C)</enum><text>a description of the

			 project proposed by the eligible entity, including—</text>

						<clause changed="added" id="ID261a4386beeb4d609372230da522efc7" reported-display-style="italic"><enum>(i)</enum><text>any certified engine

			 configuration, verified technology, or emerging technology to be used or funded

			 by the eligible entity; and</text>

						</clause><clause changed="added" id="IDc7112cd5eec04959a16c193280bca993" reported-display-style="italic"><enum>(ii)</enum><text>the means by which the

			 project will achieve a significant reduction in diesel emissions;</text>

						</clause></subparagraph><subparagraph changed="added" id="ID9e3a1265382f4e2493e9790d22c71304" reported-display-style="italic"><enum>(D)</enum><text>an evaluation (using

			 methodology approved by the Administrator or the National Academy of Sciences)

			 of the quantifiable and unquantifiable benefits of the emissions reductions of

			 the proposed project;</text>

					</subparagraph><subparagraph changed="added" id="ID63df2f73171d4f86bcd19dfe476aeea3" reported-display-style="italic"><enum>(E)</enum><text>an estimate of the cost

			 of the proposed project;</text>

					</subparagraph><subparagraph changed="added" id="IDdba7e0aecad44baebce47be30cdaefb2" reported-display-style="italic"><enum>(F)</enum><text>a description of the age

			 and expected lifetime control of the equipment used or funded by the eligible

			 entity;</text>

					</subparagraph><subparagraph changed="added" id="IDcce567b90fb749e682ea5809e765bb23" reported-display-style="italic"><enum>(G)</enum><text>a description of the

			 diesel fuel available in the areas served by the eligible entity, including the

			 sulfur content of the fuel; and</text>

					</subparagraph><subparagraph changed="added" id="ID4a19291664184f609b036be92d61c523" reported-display-style="italic"><enum>(H)</enum><text>provisions for the

			 monitoring and verification of the project.</text>

					</subparagraph></paragraph><paragraph changed="added" id="IDa017624b7cfd4ccd8f1183515ddd4fe4" reported-display-style="italic"><enum>(3)</enum><header>Priority</header><text>In

			 providing a grant or loan under this section, the Administrator shall give

			 priority to proposed projects that, as determined by the Administrator—</text>

					<subparagraph changed="added" id="ID85ae9f35ca6c45a393c4796beab794b5" reported-display-style="italic"><enum>(A)</enum><text>maximize public health

			 benefits;</text>

					</subparagraph><subparagraph changed="added" id="ID6da115e274a144a089efd82d754a18fd" reported-display-style="italic"><enum>(B)</enum><text>are the most

			 cost-effective;</text>

					</subparagraph><subparagraph changed="added" id="IDfe88904c3c82486e93bdc3c6ccb3372a" reported-display-style="italic"><enum>(C)</enum><text>serve areas—</text>

						<clause changed="added" id="ID0e6094bf51d24ed2951f712afcee1938" reported-display-style="italic"><enum>(i)</enum><text>with the highest

			 population density;</text>

						</clause><clause changed="added" id="ID245431ac562a42e7aaac5a5a017cf663" reported-display-style="italic"><enum>(ii)</enum><text>that are poor air

			 quality areas, including areas identified by the Administrator as—</text>

							<subclause changed="added" id="ID141429143cd642929ed80c0a923147d2" reported-display-style="italic"><enum>(I)</enum><text>in nonattainment or

			 maintenance of national ambient air quality standards for a criteria

			 pollutant;</text>

							</subclause><subclause changed="added" id="IDe55ebb967f5f440b8d041a3ec8397395" reported-display-style="italic"><enum>(II)</enum><text>Federal Class I areas;

			 or</text>

							</subclause><subclause changed="added" id="ID9d8f513b0b4940c08a4035306c5d03d5" reported-display-style="italic"><enum>(III)</enum><text>areas with toxic air

			 pollutant concerns;</text>

							</subclause></clause><clause changed="added" id="ID7bc3dea117bc423e8b5d1137ed63cfd0" reported-display-style="italic"><enum>(iii)</enum><text>that receive a

			 disproportionate quantity of air pollution from diesel fleets, including ports,

			 rail yards, truckstops, terminals, and distribution centers; or</text>

						</clause><clause changed="added" id="IDec624fe4bba54df998cee9d0f9d9d640" reported-display-style="italic"><enum>(iv)</enum><text>that use a

			 community-based multistakeholder collaborative process to reduce toxic

			 emissions;</text>

						</clause></subparagraph><subparagraph changed="added" id="ID7e927ea4ab22420cbeb327a5a0ea89cb" reported-display-style="italic"><enum>(D)</enum><text>include a certified

			 engine configuration, verified technology, or emerging technology that has a

			 long expected useful life;</text>

					</subparagraph><subparagraph changed="added" id="ID97364af6091d43048c09703703f1606c" reported-display-style="italic"><enum>(E)</enum><text>will maximize the useful

			 life of any certified engine configuration, verified technology, or emerging

			 technology used by the eligible entity;</text>

					</subparagraph><subparagraph changed="added" id="ID4fc5de58d5b9424b9acb3ae6e5617408" reported-display-style="italic"><enum>(F)</enum><text>conserve diesel fuel;

			 and</text>

					</subparagraph><subparagraph changed="added" id="ID0babf554dbf647648bf32fbd3fe04a2e" reported-display-style="italic"><enum>(G)</enum><text>use diesel fuel with a

			 sulfur content of less than or equal to 15 parts per million, as the

			 Administrator determines to be appropriate.</text>

					</subparagraph></paragraph></subsection><subsection changed="added" id="ID70a2742a151e4450926fa852ea70032f" reported-display-style="italic"><enum>(d)</enum><header>Use of funds</header>

				<paragraph changed="added" id="IDb0a2d9797e254491bd86d7c18a6d059f" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>An eligible entity may use a grant or loan provided under

			 this section to fund the costs of—</text>

					<subparagraph changed="added" id="IDf0c767518d76423b90ffe52aa575dc83" reported-display-style="italic"><enum>(A)</enum><text>a retrofit technology

			 (including any incremental costs of a repowered or new diesel engine) that

			 significantly reduces emissions through development and implementation of a

			 certified engine configuration, verified technology, or emerging technology

			 for—</text>

						<clause changed="added" id="ID6ae0a9704b8945c6a36e60bd5eb314a7" reported-display-style="italic"><enum>(i)</enum><text>a bus;</text>

						</clause><clause changed="added" id="ID0cdc0c13172c46f19ed25dfbbaa77436" reported-display-style="italic"><enum>(ii)</enum><text>a medium-duty truck or a

			 heavy-duty truck;</text>

						</clause><clause changed="added" id="ID51d2ee098e734647907dee5d4b0c2952" reported-display-style="italic"><enum>(iii)</enum><text>a marine engine;</text>

						</clause><clause changed="added" id="ID03f68d77a2c8440da2abc7c6caa4dbcd" reported-display-style="italic"><enum>(iv)</enum><text>a locomotive; or</text>

						</clause><clause changed="added" id="IDa6abc4cafd9842ddaa2c3ec6139bb6af" reported-display-style="italic"><enum>(v)</enum><text>a nonroad engine or

			 vehicle used in—</text>

							<subclause changed="added" id="ID5bbc2a5a1542433a8faeff749aa294b4" reported-display-style="italic"><enum>(I)</enum><text>construction;</text>

							</subclause><subclause changed="added" id="IDb73d0d73787c41c0bc6d7a39464084b2" reported-display-style="italic"><enum>(II)</enum><text>handling of cargo

			 (including at a port or airport);</text>

							</subclause><subclause changed="added" id="ID6fe795035c5b40229c2f10e80b4538e9" reported-display-style="italic"><enum>(III)</enum><text>agriculture;</text>

							</subclause><subclause changed="added" id="ID0f171dcaedb8405d91e0f3286785ee64" reported-display-style="italic"><enum>(IV)</enum><text>mining; or</text>

							</subclause><subclause changed="added" id="IDdb4d61b912be425db381afc972ddb469" reported-display-style="italic"><enum>(V)</enum><text>energy production;

			 or</text>

							</subclause></clause></subparagraph><subparagraph changed="added" id="ID81fde581140947c480767d88bac2f1b9" reported-display-style="italic"><enum>(B)</enum><text>programs or projects to

			 reduce long-duration idling using verified technology involving a vehicle or

			 equipment described in subparagraph (A).</text>

					</subparagraph></paragraph><paragraph changed="added" id="IDbcf81091dcc74597a216eb67c92eb383" reported-display-style="italic"><enum>(2)</enum><header>Regulatory

			 programs</header>

					<subparagraph changed="added" id="IDb24d7bcc2b494358a9020f66cc42db0b" reported-display-style="italic"><enum>(A)</enum><header>In

			 general</header><text>Notwithstanding paragraph (1), no grant or loan provided

			 under this section shall be used to fund the costs of emissions reductions that

			 are mandated under Federal, State or local law.</text>

					</subparagraph><subparagraph changed="added" id="ID996b90571a9f4003a992e1c4ffc2cba7" reported-display-style="italic"><enum>(B)</enum><header>Mandated</header><text>For

			 purposes of subparagraph (A), voluntary or elective emission reduction measures

			 shall not be considered <quote>mandated</quote>, regardless of whether the

			 reductions are included in the State implementation plan of a State.</text>

					</subparagraph></paragraph></subsection></section><section changed="added" id="ID779edddda6914e748dd4a749e18a4454" reported-display-style="italic"><enum>4.</enum><header>State grant and loan

			 programs</header>

			<subsection changed="added" id="ID3d18e8e85b6541908045e117703e397e" reported-display-style="italic"><enum>(a)</enum><header>In

			 general</header><text>Subject to the availability of adequate appropriations,

			 the Administrator shall use 30 percent of the funds made available for a fiscal

			 year under this Act to support grant and loan programs administered by States

			 that are designed to achieve significant reductions in diesel emissions.</text>

			</subsection><subsection changed="added" id="ID55c0f5dcd07245d199229fab231d3af3" reported-display-style="italic"><enum>(b)</enum><header>Applications</header><text>The

			 Administrator shall—</text>

				<paragraph changed="added" id="ID32b589782755408ca1fa0851904b62e9" reported-display-style="italic"><enum>(1)</enum><text>provide to States

			 guidance for use in applying for grant or loan funds under this section,

			 including information regarding—</text>

					<subparagraph changed="added" id="ID16c43a59408d4af18cb48fb1f703c85e" reported-display-style="italic"><enum>(A)</enum><text>the process and forms for

			 applications;</text>

					</subparagraph><subparagraph changed="added" id="ID5061f80aaac54185aba84daf3ef324d7" reported-display-style="italic"><enum>(B)</enum><text>permissible uses of funds

			 received; and</text>

					</subparagraph><subparagraph changed="added" id="ID4180d4340d87405db19d5f0620104f47" reported-display-style="italic"><enum>(C)</enum><text>the cost-effectiveness of

			 various emission reduction technologies eligible to be carried out using funds

			 provided under this section; and</text>

					</subparagraph></paragraph><paragraph changed="added" id="ID34205df94bcc44008056ed602d63d951" reported-display-style="italic"><enum>(2)</enum><text>establish, for

			 applications described in paragraph (1)—</text>

					<subparagraph changed="added" id="ID8172bf2ff4f74a4d84844068202db41d" reported-display-style="italic"><enum>(A)</enum><text>an annual deadline for

			 submission of the applications;</text>

					</subparagraph><subparagraph changed="added" id="ID3ff63a29bcb84a7da60c157d642e6047" reported-display-style="italic"><enum>(B)</enum><text>a process by which the

			 Administrator shall approve or disapprove each application; and</text>

					</subparagraph><subparagraph changed="added" id="IDafb32a2fadef4bb99ad0fec59de8e11e" reported-display-style="italic"><enum>(C)</enum><text>a streamlined process by

			 which a State may renew an application described in paragraph (1) for

			 subsequent fiscal years.</text>

					</subparagraph></paragraph></subsection><subsection changed="added" id="IDd664dc21d6244c26b0c0f5a1233a346e" reported-display-style="italic"><enum>(c)</enum><header>Allocation of

			 Funds</header>

				<paragraph changed="added" id="ID9b7ed244fdb141988e474f6212b6a564" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>For each fiscal year, the Administrator shall allocate

			 among States for which applications are approved by the Administrator under

			 subsection (b)(2)(B) funds made available to carry out this section for the

			 fiscal year.</text>

				</paragraph><paragraph changed="added" id="IDaa1fb6179d44458682daf33c02521e16" reported-display-style="italic"><enum>(2)</enum><header>Allocation</header><text>Using

			 not more than 20 percent of the funds made available to carry out this Act for

			 a fiscal year, the Administrator shall provide to each State described in

			 paragraph (1) for the fiscal year an allocation of funds that is equal

			 to—</text>

					<subparagraph changed="added" id="IDb62e0609847d4b2a8f9178b22bb432ad" reported-display-style="italic"><enum>(A)</enum><text>if each of the 50 States

			 qualifies for an allocation, an amount equal to 2 percent of the funds made

			 available to carry out this section; or</text>

					</subparagraph><subparagraph changed="added" id="IDc94c7a2726714aa29bbdd3306d2d120a" reported-display-style="italic"><enum>(B)</enum><text>if fewer than 50 States

			 qualifies for an allocation, an amount equal to the amount described in

			 subparagraph (A), plus an additional amount equal to the product obtained by

			 multiplying—</text>

						<clause changed="added" id="ID6a4ab4d3ce70405490bd913e148300a5" reported-display-style="italic"><enum>(i)</enum><text>the proportion

			 that—</text>

							<subclause changed="added" id="IDea87f4d2b8eb41c38500c42c85a30c73" reported-display-style="italic"><enum>(I)</enum><text>the population of the

			 State; bears to</text>

							</subclause><subclause changed="added" id="IDa9f4c0cfb1ce47f79bbf9f78e99cafa5" reported-display-style="italic"><enum>(II)</enum><text>the population of all

			 States described in paragraph (1); by</text>

							</subclause></clause><clause changed="added" id="IDf1fd8dddc05d4f5a8a99485c18b4dab6" reported-display-style="italic"><enum>(ii)</enum><text>the amount of funds

			 remaining after each State described in paragraph (1) receives the 2-percent

			 allocation under this paragraph.</text>

						</clause></subparagraph></paragraph><paragraph changed="added" id="ID046ea38c5ce443069cae00f09206fa3f" reported-display-style="italic"><enum>(3)</enum><header>State matching

			 incentive</header>

					<subparagraph changed="added" id="IDa3178b813d3a485d837a1d88e1804718" reported-display-style="italic"><enum>(A)</enum><header>In

			 general</header><text>If a State agrees to match the allocation provided to the

			 State under paragraph (2) for a fiscal year, the Administrator shall provide to

			 the State for the fiscal year an additional amount equal to 50 percent of the

			 allocation of the State under paragraph (2).</text>

					</subparagraph><subparagraph changed="added" id="ID2b366b2f4f06427a9607c5990590b4f8" reported-display-style="italic"><enum>(B)</enum><header>Requirements</header><text>A

			 State—</text>

						<clause changed="added" id="ID0606f01b697a47b1a6e959f3bb4be6bc" reported-display-style="italic"><enum>(i)</enum><text>may not use funds

			 received under this Act to pay a matching share required under this subsection;

			 and</text>

						</clause><clause changed="added" id="ID699f35d7b2ed40709d1a11c6f4b08ae9" reported-display-style="italic"><enum>(ii)</enum><text>shall not be required to

			 provide a matching share for any additional amount received under subparagraph

			 (A).</text>

						</clause></subparagraph></paragraph><paragraph changed="added" id="ID903b605ff1974ee598ad6abf23fab092" reported-display-style="italic"><enum>(4)</enum><header>Unclaimed

			 funds</header><text>Any funds that are not claimed by a State for a fiscal year

			 under this subsection shall be used to carry out section 3.</text>

				</paragraph></subsection><subsection changed="added" id="ID2ecfacf255424ef9ab0e93f5dcae30e9" reported-display-style="italic"><enum>(d)</enum><header>Administration</header>

				<paragraph changed="added" id="ID8481ae95466e41c3a8ead0bf94b26dc2" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>Subject to paragraphs (2) and (3) and, to the extent

			 practicable, the priority areas listed in section 3(c)(3), a State shall use

			 any funds provided under this section to develop and implement such grant and

			 low-cost revolving loan programs in the State as are appropriate to meet State

			 needs and goals relating to the reduction of diesel emissions.</text>

				</paragraph><paragraph changed="added" id="IDbc1b78f71e2848adb4bc8db0525aeda6" reported-display-style="italic"><enum>(2)</enum><header>Apportionment of

			 funds</header><text>The Governor of a State that receives funding under this

			 section may determine the portion of funds to be provided as grants or

			 loans.</text>

				</paragraph><paragraph changed="added" id="IDa0912415f7824da9a13c68213f3d502a" reported-display-style="italic"><enum>(3)</enum><header>Use of

			 funds</header><text>A grant or loan provided under this section may be used for

			 a project relating to—</text>

					<subparagraph changed="added" id="ID50526c60bb844cf88cd65044c5c9ceb6" reported-display-style="italic"><enum>(A)</enum><text>a certified engine

			 configuration; or</text>

					</subparagraph><subparagraph changed="added" id="ID0d95438cbb654e6598e40e5093ffc3a3" reported-display-style="italic"><enum>(B)</enum><text>a verified

			 technology.</text>

					</subparagraph></paragraph></subsection></section><section changed="added" id="IDf4e9e72584cf47279d8885104c2221c8" reported-display-style="italic"><enum>5.</enum><header>Evaluation and

			 report</header>

			<subsection changed="added" id="ID52f34c3fb36046c89a9dbea8dd6e9b3f" reported-display-style="italic"><enum>(a)</enum><header>In

			 general</header><text>Not later than 1 year after the date on which funds are

			 made first available under this Act, and biennially thereafter, the

			 Administrator shall submit to Congress a report evaluating the implementation

			 of the programs under this Act.</text>

			</subsection><subsection changed="added" id="ID36bf043fe1804190852f6b4cd780c0ea" reported-display-style="italic"><enum>(b)</enum><header>Inclusions</header><text>The

			 report shall include a description of—</text>

				<paragraph changed="added" id="ID67059bab10714d5f8c411e2743e5a80a" reported-display-style="italic"><enum>(1)</enum><text>the total number of grant

			 applications received;</text>

				</paragraph><paragraph changed="added" id="IDf6a857dbdb0646648e5d240650f224b1" reported-display-style="italic"><enum>(2)</enum><text>each grant or loan made

			 under this Act, including the amount of the grant or loan;</text>

				</paragraph><paragraph changed="added" id="IDc424e97651334ff9acddd3f9ad2ea4e3" reported-display-style="italic"><enum>(3)</enum><text>each project for which a

			 grant or loan is provided under this Act, including the criteria used to select

			 the grant or loan recipients;</text>

				</paragraph><paragraph changed="added" id="IDac0decce29d74956b299b1580e397abf" reported-display-style="italic"><enum>(4)</enum><text>the actual and estimated

			 air quality and diesel fuel conservation benefits, cost-effectiveness, and

			 cost-benefits of the grant and loan programs under this Act;</text>

				</paragraph><paragraph changed="added" id="IDf8a7f24d3aa24248a14d4d9dd12e8b6f" reported-display-style="italic"><enum>(5)</enum><text>the problems encountered

			 by projects for which a grant or loan is provided under this Act; and</text>

				</paragraph><paragraph changed="added" id="ID26aff4c7a6fd4cd598e71cf94b5305b3" reported-display-style="italic"><enum>(6)</enum><text>any other information the

			 Administrator considers to be appropriate.</text>

				</paragraph></subsection></section><section changed="added" id="IDb02efdf3565e454c8fc05b83193f4029" reported-display-style="italic"><enum>6.</enum><header>Outreach and

			 incentives</header>

			<subsection changed="added" id="ID2feae2b7426b4c69b790b1aea522836c" reported-display-style="italic"><enum>(a)</enum><header>Definition of eligible

			 technology</header><text>In this section, the term <quote>eligible

			 technology</quote> means—</text>

				<paragraph changed="added" id="ID9b219d8f15404229903681db8306f3d3" reported-display-style="italic"><enum>(1)</enum><text>a verified technology;

			 or</text>

				</paragraph><paragraph changed="added" id="ID76b36e5d6bd54f9ba4eab5f7394710ce" reported-display-style="italic"><enum>(2)</enum><text>an emerging

			 technology.</text>

				</paragraph></subsection><subsection changed="added" id="IDdf13552faa3a4a698a61687fc3576ea1" reported-display-style="italic"><enum>(b)</enum><header>Technology transfer

			 program</header>

				<paragraph changed="added" id="IDec364f5a167d45d4bb5e37552e2c6d66" reported-display-style="italic"><enum>(1)</enum><header>In

			 general</header><text>The Administrator shall establish a program under which

			 the Administrator—</text>

					<subparagraph changed="added" id="IDc555593de1b94fa2abc98dde2129e401" reported-display-style="italic"><enum>(A)</enum><text>informs stakeholders of

			 the benefits of eligible technologies; and</text>

					</subparagraph><subparagraph changed="added" id="IDaae268c52e3c4c81bb6ee15e1cd1154c" reported-display-style="italic"><enum>(B)</enum><text>develops nonfinancial

			 incentives to promote the use of eligible technologies.</text>

					</subparagraph></paragraph><paragraph changed="added" id="ID91a18c3b7b0f4c9492ea6eb22f3a6aa4" reported-display-style="italic"><enum>(2)</enum><header>Eligible

			 stakeholders</header><text>Eligible stakeholders under this section

			 include—</text>

					<subparagraph changed="added" id="ID9d52483e6f994c22b6d96ac68eb28829" reported-display-style="italic"><enum>(A)</enum><text>equipment owners and

			 operators;</text>

					</subparagraph><subparagraph changed="added" id="IDe918bb8de2c24641b887f4d2f49daa19" reported-display-style="italic"><enum>(B)</enum><text>emission and pollution

			 control technology manufacturers;</text>

					</subparagraph><subparagraph changed="added" id="ID2162b2d899f4463eb3f175b9887cedf0" reported-display-style="italic"><enum>(C)</enum><text>engine and equipment

			 manufacturers;</text>

					</subparagraph><subparagraph changed="added" id="ID86308895e82343c5a59a61a1e4d836d6" reported-display-style="italic"><enum>(D)</enum><text>State and local officials

			 responsible for air quality management;</text>

					</subparagraph><subparagraph changed="added" id="ID6fe01ec276cd4b7b8f1cf14a958c3058" reported-display-style="italic"><enum>(E)</enum><text>community organizations;

			 and</text>

					</subparagraph><subparagraph changed="added" id="ID0dd122b36bcf44e7887db488b4ac141c" reported-display-style="italic"><enum>(F)</enum><text>public health,

			 educational, and environmental organizations.</text>

					</subparagraph></paragraph></subsection><subsection changed="added" id="ID549a0da3ba3948948285cb8c2e40c008" reported-display-style="italic"><enum>(c)</enum><header>State implementation

			 plans</header><text>The Administrator shall develop appropriate guidance to

			 provide credit to a State for emission reductions in the State created by the

			 use of eligible technologies through a State implementation plan under section

			 110 of the Clean Air Act (42 U.S.C. 7410).</text>

			</subsection><subsection changed="added" id="ID8cd3ff7973be4389ad2aff26510bf529" reported-display-style="italic"><enum>(d)</enum><header>International

			 markets</header><text>The Administrator, in coordination with the Department of

			 Commerce and industry stakeholders, shall inform foreign countries with air

			 quality problems of the potential of technology developed or used in the United

			 States to provide emission reductions in those countries.</text>

			</subsection></section><section changed="added" id="IDdaa2d72060244825bcd8236c47d947f1" reported-display-style="italic"><enum>7.</enum><header>Effect of

			 Act</header><text display-inline="no-display-inline">Nothing in this Act

			 affects any authority under the Clean Air Act (42 U.S.C. 7401 et seq.) in

			 existence on the day before the date of enactment of this Act.</text>

		</section><section changed="added" commented="no" display-inline="no-display-inline" id="IDfb3671ebb4ab42e49aca08318ce82dd8" reported-display-style="italic" section-type="subsequent-section"><enum>8.</enum><header>Authorization of

			 appropriations</header><text display-inline="no-display-inline">There is

			 authorized to be appropriated to carry out this Act $200,000,000 for each of

			 fiscal years 2007 through 2011, to remain available until expended.</text>
