		<section commented="no" display-inline="no-display-inline" id="id3BAD268617A24921B9C828F8E55F69E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Common Sense Indian Gambling Reform

			 Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="idD16402E04AFD4D77BF24EABDC790829B" section-type="subsequent-section"><enum>2.</enum><header>Consultation with

			 State, local, and tribal governments</header><text display-inline="no-display-inline">Section 20 of the Indian Gaming Regulatory

			 Act (25 U.S.C. 2719) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id70608B23241E44EDB449AA3AE3B60BF0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking paragraph

			 (2) and inserting the following:</text>

				<quoted-block display-inline="no-display-inline" id="idFCCF191D87AE447DAFD8D0CF55F4EA4A" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="id8142810267E9475A9FA74195F5AC50DC"><enum>(2)</enum><text display-inline="yes-display-inline">the Indian tribe has no reservation as of

				October 17, 1988, and the land is located in the State of Oklahoma and—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id86AFFBC3F4934D2994ABBEE1CBCC317B"><enum>(A)</enum><text display-inline="yes-display-inline">is within the boundaries of the former

				reservation of the Indian tribe, as defined by the Secretary; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8548917A7C744DD78CF43922668B7CAF"><enum>(B)</enum><text display-inline="yes-display-inline">is contiguous to other land held in trust

				or restricted status by the United States for the benefit of the Indian tribe

				in the State of

				Oklahoma.</text>

						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF84104D519B04E5E9A888B7057CA53F6"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="id0EBEE48AF2EC42C585C0FC6297A279C0"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) and (3) as

			 paragraphs (3) and (4), respectively;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id076271D6230A47F1906AAA166AD3314C"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (4) (as redesignated by

			 subparagraph (A)), by striking <quote>paragraph (2)(B)</quote> and inserting

			 <quote>paragraph (3)(B)</quote>; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBFD80B60DF2D4405A97349E9B113608E"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>(b)(1)

			 Subsection</quote> and all that follows through clause (iii) of paragraph

			 (1)(B) and inserting the following:</text>

					<quoted-block display-inline="no-display-inline" id="idBEA2EBFB86604218B0F1B21580D48449" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="idB39D33BAB8384E409133D6852A5FC221"><enum>(b)</enum><header>Exceptions</header>

							<paragraph commented="no" display-inline="no-display-inline" id="id35EB4C8101C1493BBA677F971837D1BB"><enum>(1)</enum><header>In

				general</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="idC11188BDB2594521BA9B874F969CEFDB"><enum>(A)</enum><header>Effect on

				community</header><text display-inline="yes-display-inline">Subject to

				subparagraph (B) and paragraph (2), subsection (a) shall not apply to Indian

				lands for which the Secretary, after consultation with the Indian tribe and

				officials of all State, local, and tribal governments that have jurisdiction

				over land located within 60 miles of such Indian lands, determines that a

				gaming establishment on that land—</text>

									<clause commented="no" display-inline="no-display-inline" id="idD22AA4298F3B48B694C02B368DFD5328"><enum>(i)</enum><text display-inline="yes-display-inline">would be in the best interest of the Indian

				tribe and its members; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idBCA32B891AA94AE2BCF5CA2D12571C29"><enum>(ii)</enum><text display-inline="yes-display-inline">taking into consideration the results of a

				study of the economic impact of the gaming establishment, would not have a

				negative economic impact, or any other negative effect, on any unit of

				government, business, community, or Indian tribe located within 60 miles of the

				land.</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2CBE59433DC548649665F89E55D8AF66"><enum>(B)</enum><header>Concurrence of

				affected State</header><text display-inline="yes-display-inline">For a

				determination of the Secretary under subparagraph (A) to become valid, the

				Governor and legislative body of the State in which a gaming activity is

				proposed to be conducted shall concur in the determination.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF381156C892E4678BE8DF15E37152BF2"><enum>(C)</enum><header>Effect of

				paragraph</header><text display-inline="yes-display-inline">This paragraph

				shall not apply to any land on which a gaming facility is in operation as of

				the date of enactment of the <short-title>Common Sense

				Indian Gambling Reform Act of 2005</short-title>.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DB14A8B9FB94819B8DD6ED9FCED13A1"><enum>(2)</enum><header>Primary

				nexus</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="id7E34AF1C424748A59E50DAE502F85843"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The land described in

				paragraph (1) shall be land—</text>

									<clause commented="no" display-inline="no-display-inline" id="id32BF413C06BF48CCB74AB6077F462650"><enum>(i)</enum><text display-inline="yes-display-inline">within a State in which the Indian tribe is

				primarily located, as determined by the Secretary; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idBBD3ACDF27A94690BEF6444DA8E512B1"><enum>(ii)</enum><text display-inline="yes-display-inline">on which the primary geographic, social,

				and historical nexus to land of the Indian tribe is located, as determined in

				accordance with subparagraph (B).</text>

									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD60E5F660994E8FBD0B9396658C2593"><enum>(B)</enum><header>Determination</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), a

				geographic, social, and historical nexus to land of an Indian tribe shall exist

				with respect to land that is—</text>

									<clause commented="no" display-inline="no-display-inline" id="id72B2052A21E247EABBB2BFBE54D63312"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id9F57BD7808C3421187F3060A8617A765"><enum>(I)</enum><text display-inline="yes-display-inline">owned by, or held in trust by the United

				States for the benefit of, an Indian tribe;</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="id4597EF74EBA34A8C9A7A387CFF62F6F1" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">located within the boundaries of—</text>

											<item commented="no" display-inline="no-display-inline" id="ID75deaf4b9d564ba985d05d4e7a5516aa"><enum>(aa)</enum><text display-inline="yes-display-inline">the geographical area, as designated by the

				Secretary, in which financial assistance and social service programs are

				provided to the Indian tribe, including land on or contiguous to a reservation;

				or</text>

											</item><item commented="no" display-inline="no-display-inline" id="IDda51518eda2a4a2dbfd764a0128dcde3"><enum>(bb)</enum><text display-inline="yes-display-inline">the geographical area designated by the

				Indian tribe during the Federal acknowledgment process of the Indian tribe as

				the area in which more than 50 percent of the members of the Indian tribe

				reside in a group composed exclusively or almost exclusively of members of the

				Indian tribe; and</text>

											</item></subclause><subclause commented="no" display-inline="no-display-inline" id="IDc456b4c0e1c243d2bf5cf9b121e8d797" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">located within the geographical area in

				which the Indian tribe demonstrates that the Indian tribe has historically

				resided, as determined by the Secretary; or</text>

										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idEC6E861DBBB641FD81F41F5E719D48D4"><enum>(ii)</enum><text display-inline="yes-display-inline">located—</text>

										<subclause commented="no" display-inline="no-display-inline" id="idE8378430D8E34D6B942909DB27F690AD"><enum>(I)</enum><text display-inline="yes-display-inline">in a State other than the State of

				Oklahoma; and</text>

										</subclause><subclause commented="no" display-inline="no-display-inline" id="id33C22B419F29497C954416066CAD68A4"><enum>(II)</enum><text display-inline="yes-display-inline">within the boundaries of the last

				recognized reservation of the Indian tribe in any State in which the Indian

				tribe is located as of the date on which a determination under this

				subparagraph is

				made.</text>

										</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE77C671EF9AC46E7AAC2DB7B114FFEFD"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) and (d) as

			 subsections (d) and (e), respectively; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2D3B9D077EEE453782B1E3519C386BE2"><enum>(4)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the

			 following:</text>

				<quoted-block display-inline="no-display-inline" id="id596B595B3CA9485AAF9E397CA563BFF3" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="id2F773529FE5A409C9DDEDFF171784F99"><enum>(c)</enum><header>Contiguous land

				requirement</header><text display-inline="yes-display-inline">Notwithstanding

				any other provision of this Act, an Indian tribe shall conduct any gaming

				activity subject to regulation under this Act on 1 contiguous parcel of Indian

				lands.</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idF66C00814D3E441FBCEF1124C0ACDA4A" section-type="subsequent-section"><enum>3.</enum><header>Tribal gaming

			 ordinances</header><text display-inline="no-display-inline">Section 11 of the

			 Indian Gaming Regulatory Act (25 U.S.C. 2710) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="idC9B6D3D826144DC1924B1123A97C8EC5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1)—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="id2C6CFE3E4E334F239326E6B5AC109A97"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking <quote>,

			 and</quote> and inserting a semicolon;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id971B9543662B49F0959E46D19FDBC450"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking the period

			 at the end and inserting <quote>; and</quote>; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8EEEFE5DA3A14B078EB990C25EABD41A"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="id6704A6D2AD6146D0915FE9FC1DF877EB" style="OLC">

						<subparagraph commented="no" display-inline="no-display-inline" id="id1856799CEA7844EE8FF5CC77FDE89261"><enum>(C)</enum><text display-inline="yes-display-inline">the class II gaming is conducted—</text>

							<clause commented="no" display-inline="no-display-inline" id="id5DED62D3C8B04DBAABAA486CAE87B8FC"><enum>(i)</enum><text display-inline="yes-display-inline">on lands that were Indian lands before the

				date of enactment of this subparagraph; or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="idC758000C9855452F9E2813E0AB4E8EFE"><enum>(ii)</enum><text display-inline="yes-display-inline">on land taken into trust for the benefit of

				the Indian tribe after the date of enactment of this subparagraph, but only if

				the application of the Indian tribe requesting that the land be taken into

				trust for the benefit of the Indian tribe stated the intent of the Indian tribe

				to conduct class II gaming activities on the

				land.</text>

							</clause></subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8C1A582C47AF4B43BD9441B54AEAF1D6"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idBDC2EFA0DEB6444583016C173B5E7135"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>

					<clause commented="no" display-inline="no-display-inline" id="id8C7E305FB48945F6ADC733F3EDCBEF76"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>

						<subclause commented="no" display-inline="no-display-inline" id="id55D5B1D73CF34590992BF31E7EB59AFD"><enum>(I)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>such

						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8B3EEED2ACE241F78211EE48D56AAFEA"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>,

			 and</quote> and inserting a semicolon;</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="idB4CF4EB824174DACA70069A6990CFF8E"><enum>(iii)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the period

			 at the end and inserting <quote>; and</quote>; and</text>

					</clause><clause commented="no" display-inline="no-display-inline" id="id02B28A8D49DB4B568365E4E1E424F687"><enum>(iv)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				date of enactment of this subparagraph; or</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="id9AC40AA76CC449AC892A4C9BB065385B"><enum>(ii)</enum><text display-inline="yes-display-inline">on land taken into trust for the benefit of

				the Indian tribe after the date of enactment of this subparagraph, but only if

				the application of the Indian tribe requesting that the land be taken into

				trust for the benefit of the Indian tribe stated the intent of the Indian tribe

				to conduct class III gaming activities on the

				land.</text>

								</clause></subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0D623ED38967458991F557E1BC0D89F9"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				term <term>State</term> means the Governor of the State and the legislative

				body of the

				State.</text>

				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="id475CFB7510464DAFB5437201D473870F" section-type="subsequent-section"><enum>4.</enum><header>Investigation and

			 approval</header>

			<subsection commented="no" display-inline="no-display-inline" id="id4AD4C25F9C1B4B38887E38AD2C10DB59"><enum>(a)</enum><header>Powers of the

			 Chairman</header><text display-inline="yes-display-inline">Section 6(a) of the

			 Indian Gaming Regulatory Act (25 U.S.C. 2705(a)) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id0DEB2E8D9EA0447A9672137CBDC417A9"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking

			 <quote>and</quote> at the end;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id44A41A92E5BC475D8EB71139C3DC88E1"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking the period at

			 the end and inserting <quote>; and</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7A4EE675777E48048ACD2735A791033E"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="idE6D50B2279744474997CC5C09AB6F235"><enum>(5)</enum><text display-inline="yes-display-inline">approve or disapprove the involvement in a

				gaming activity subject to regulation by the Commission of any 1 of the 10

				persons or entities that have the highest financial interest in the gaming

				activity, as identified by the Commission under section

				7(b)(3)(A).</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7E1149FE2F5A4D2F845A5FBE074C8FF1"><enum>(b)</enum><header>Powers of the

			 Commission</header><text display-inline="yes-display-inline">Section 7(b) of

			 the Indian Gaming Regulatory Act (25 U.S.C. 2706(b)) is amended by striking

			 paragraph (3) and inserting the following:</text>

				<quoted-block display-inline="no-display-inline" id="id432ABB55BC404DFFBBCE86231C6867AD" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="id6DC772694B0C4E0EA4C6C6E72DDC58E2"><enum>(3)</enum><text display-inline="yes-display-inline">shall—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id0DF4603BD9234219ACF0F94CB915C452"><enum>(A)</enum><text display-inline="yes-display-inline">identify the 10 persons or entities that

				have the highest financial interest (including outstanding loans, debt-based

				financing, and other financial interests) in each gaming activity subject to

				regulation by the Commission; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E9210C14CC64706A221A66A1AA864E7"><enum>(B)</enum><text display-inline="yes-display-inline">conduct a background investigation

				of—</text>

							<clause commented="no" display-inline="no-display-inline" id="idD5343D7B88AF472C8E98CEEBABA0EEAE"><enum>(i)</enum><text display-inline="yes-display-inline">each of the persons and entities identified

				under subparagraph (A); and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id91981400DBF14CD9AF5544DDD4DAC512"><enum>(ii)</enum><text display-inline="yes-display-inline">any other person or entity, as the

				Commission determines to be

				appropriate.</text>

							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id68517072A63949B8930F6F493B52742A"><enum>(c)</enum><header>Tribal gaming

			 ordinances</header><text display-inline="yes-display-inline">Section

			 11(b)(2)(F) of the Indian Gaming Regulatory Act (25 U.S.C. 2710(b)(2)(F)) is

			 amended by striking clause (i) and inserting the following:</text>

				<quoted-block display-inline="no-display-inline" id="idC876B6CD13CB4D5692D2DEB8DE35AEC3" style="OLC">

					<clause commented="no" display-inline="no-display-inline" id="idB6CB8B2B87E2452CA6A562ACE12F6F05"><enum>(i)</enum><text display-inline="yes-display-inline">ensures that—</text>

						<subclause commented="no" display-inline="no-display-inline" id="id766756BD46F944F0AC0E99C928F7B1F2"><enum>(I)</enum><text display-inline="yes-display-inline">a background investigation will be

				conducted by the Commission on—</text>

							<item commented="no" display-inline="no-display-inline" id="id1F1F86ECB0D34114927F9936ED541747"><enum>(aa)</enum><text display-inline="yes-display-inline">each tribal gaming commissioner;</text>

							</item><item commented="no" display-inline="no-display-inline" id="id4BD552E2781B44BE899B172D3FE63E03"><enum>(bb)</enum><text display-inline="yes-display-inline">key tribal gaming employees, as determined

				by the Commission;</text>

							</item><item commented="no" display-inline="no-display-inline" id="id05D6677FFBA14F5D85551E35D6EFD563"><enum>(cc)</enum><text display-inline="yes-display-inline">primary management officials; and</text>

							</item><item commented="no" display-inline="no-display-inline" id="idBFE675FE849B4BC08FD487701146A347"><enum>(dd)</enum><text display-inline="yes-display-inline">key employees of the gaming enterprise;

				and</text>

			 of the Indian Gaming Regulatory Act (25 U.S.C. 2717(a)(2)(B)) is amended by

			 striking <quote>$8,000,000</quote> and inserting

			 <quote>$16,000,000</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id2B9D6B86A6174ABABAAB10A8DF37FDBC" section-type="subsequent-section"><enum>5.</enum><header>Changing use of Indian

			 land</header><text display-inline="no-display-inline">The Indian Gaming

			 Regulatory Act (25 U.S.C. 2701 et seq.) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="idBC6401F156F746ECA6AE8A917090A6CE"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating sections 21 through 24 as

			 sections 22 through 25, respectively; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46579E1464A1409FB669CAAB2CC23EC0"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 20 the

			 following:</text>

					<section commented="no" display-inline="no-display-inline" id="id79BCD1169F1C423CA53BAF5554979756" section-type="subsequent-section"><enum>21.</enum><header>Changing use of

				Indian lands</header><text display-inline="no-display-inline">Before an Indian

				tribe uses any Indian lands for purposes of class II or class III gaming, the

				Indian tribe shall—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id46A56D0AE9E44A80B73286B07C428908"><enum>(1)</enum><text display-inline="yes-display-inline">submit to the Secretary an environmental

				impact statement that the Secretary determines to be in accordance with the

				National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) relating to

				that use; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD44016DF7EF145BCADC4153D736AD1BF"><enum>(2)</enum><text display-inline="yes-display-inline">obtain the consent of the Secretary with

				respect to the change in use of the Indian

				lands.</text>

						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id1DD7E8E2F8B649BE9BA2F47D60D1B630" section-type="subsequent-section"><enum>6.</enum><header>Effect of

			 Act</header><text display-inline="no-display-inline">This Act, and the

			 amendments made by this Act, shall not affect any compact or other agreement

			 relating to gaming subject to regulation under the Indian Gaming Regulatory Act

			 (25 U.S.C. 2701 et seq.) in existence on the date of enactment of this

			 Act.</text>
