		<section commented="no" display-inline="no-display-inline" id="H3CB7464F57074AE8B61876F78BC3B6D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Spectrum Availability for

			 Emergency-Response and Law-Enforcement to Improve Vital Emergency Services

			 Act</short-title></quote> or the <quote>SAVE LIVES Act</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="H5A793B2392144DF8AC9817501FA6C350" section-type="subsequent-section"><enum>2.</enum><header>Setting a specific

			 date for the availability of spectrum for public safety organizations and

			 creating a deadline for transition to digital television</header>

			<subsection commented="no" display-inline="no-display-inline" id="HA8E9168CC66048DAB9E867DBF4236560"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 309(j)(14) of the Communications

			 Act of 1934 (47 U.S.C. 309(j)(14)) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H2419BBD0CDA34BF38702FB23E612C4D7"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking

			 <quote>December 31, 2006</quote> and inserting <quote>December 31,

			 2008</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H04847A981C5840B090B21EDA52C3C37B"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subparagraph (B);</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE51F7B49BBF4E1D886933F880E2E5F"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (C)(i)(I), by striking

			 <quote>or (B)</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBE374B3EA8BF4865B377645ECE6D6DAF"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking

			 <quote>(C)(i)</quote> and inserting <quote>(B)(i)</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD447999A39824F83B8ADD909A1ADDB71"><enum>(5)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (C) and (D)

			 as subparagraphs (B) and (C), respectively.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCA96364944A74067BEF3F3CBAFB67B41"><enum>(b)</enum><header>Implementation</header>

				<paragraph commented="no" display-inline="no-display-inline" id="H61F54D518443498A82FDEACEBA5E2192"><enum>(1)</enum><header>Final DTV

			 allotment table of in-core channels for full-power stations</header><text display-inline="yes-display-inline">The Federal Communications Commission (in

			 this Act referred to as the <quote>Commission</quote>) shall—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="H84DFC833AD64432B9604CD6162143B93"><enum>(A)</enum><text display-inline="yes-display-inline">release by December 31, 2006, a report and

			 order in MB Docket No. 03–15 assigning all full-power broadcast television

			 stations authorized in the digital television service a final channel between

			 channels 2 and 36, inclusive, or 38 and 51, inclusive (between frequencies 54

			 and 698 megahertz, inclusive); and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF7D334C5F5D44B63A09D64811D962887"><enum>(B)</enum><text display-inline="yes-display-inline">conclude by July 31, 2007, any

			 reconsideration of such report and order.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCC7B85E269D347D283C3924F14330093"><enum>(2)</enum><header>Status

			 reports</header><text display-inline="yes-display-inline">Beginning February 1,

			 2006, and ending when international coordination with Canada and Mexico of the

			 DTV table of allotments is complete, the Commission shall submit reports every

			 6 months on the status of that international coordination to the Committee on

			 Commerce, Science, and Transportation of the Senate and to the Committee on

			 Energy and Commerce of the House of Representatives.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA88B977B708E4D4BB0428EFD8429AF09"><enum>(3)</enum><header>Terminations of

			 analog licenses and broadcasting</header><text display-inline="yes-display-inline">The Commission shall take such actions as

			 may be necessary to terminate all licenses for full-power broadcasting stations

			 in the analog television service and to require the cessation of broadcasting

			 by full-power stations in the analog television service by January 1,

			 2009.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HF8ACC99FB67D4C558200128BA5EB9C1F" section-type="subsequent-section"><enum>3.</enum><header>Auction of recovered

			 spectrum</header>

			<subsection commented="no" display-inline="no-display-inline" id="H9ECB66789BC648BA80A3B0D2BAEC4D07"><enum>(a)</enum><header>Deadline for

			 auction</header><text display-inline="yes-display-inline">Section 309(j)(14) of

			 the Communications Act of 1934 (47 U.S.C. 309(j)(14)), as amended by section 2,

			 is amended in subparagraph (B)—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id5F05F644C3894D97B40A6105BD2AFE0F"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii), by striking the second

			 sentence; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA0119DB61B8C4A94BB5578724BF069F9"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new

			 clause:</text>

					<quoted-block display-inline="no-display-inline" id="H5EABED98E3E64DFF85533449E2C8FCC" style="OLC">

						<clause commented="no" display-inline="no-display-inline" id="H307E0BD1860144F38B5DBDF491644178"><enum>(iii)</enum><header>Additional

				deadlines for recovered analog spectrum</header>

							<subclause commented="no" display-inline="no-display-inline" id="id0F445034AE1D4290A4CFC6806266CA5E"><enum>(I)</enum><header>In

				general</header><text display-inline="yes-display-inline">Not earlier than 1

				year after the date on which the Commission submits to Congress the report

				required under section 7502(a) of the Intelligence Reform and Terrorism

				Prevention Act of 2004 (Public Law 108–458; 118 Stat. 3855), and not later than

				April 1, 2008, the Commission shall—</text>

								<item commented="no" display-inline="no-display-inline" id="id9BBCFE4F0DD449ACB591136F9488959A"><enum>(aa)</enum><text display-inline="yes-display-inline">conduct the auction of the licenses for

				recovered analog spectrum; and</text>

								</item><item commented="no" display-inline="no-display-inline" id="idDDD8A74B8C4E434DB451EC8D1BC520E6"><enum>(bb)</enum><text display-inline="yes-display-inline">not later than June 30, 2008, deposit the

				proceeds of such auction in accordance with paragraph (8), except for those

				funds authorized to be used in accordance with sections 4(f) and 5 of the SAVE

				LIVES Act.</text>

								</item></subclause><subclause commented="no" display-inline="no-display-inline" id="H2BDAC4BDA1174141A4A59D05C4C5686E"><enum>(II)</enum><header>Recovered

				analog spectrum defined</header><text display-inline="yes-display-inline">In

				this clause, the term <term>recovered analog spectrum</term> means the spectrum

				reclaimed from analog television service broadcasting under this paragraph,

				other than—</text>

								<item commented="no" display-inline="no-display-inline" id="HA50207D6447B4DB1A8C6E0C281B825BE"><enum>(aa)</enum><text display-inline="yes-display-inline">the spectrum required by section 337 to be

				made available for public safety services;</text>

								</item><item commented="no" display-inline="no-display-inline" id="H9F4E25974E614A0290FC95A673A98EAD"><enum>(bb)</enum><text display-inline="yes-display-inline">the spectrum auctioned prior to the date of

				enactment of the SAVE LIVES Act; and</text>

								</item><item commented="no" display-inline="no-display-inline" id="id51B4D63819594495810124E6EB967467"><enum>(cc)</enum><text display-inline="yes-display-inline">any spectrum designated by Congress for use

				by public safety services between the date of enactment of the SAVE LIVES Act

				and the auction described in subclause

				(I).</text>

								</item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9A35EB70ADF7464AA7620026AB607527"><enum>(b)</enum><header>Extension of

			 auction authority</header><text display-inline="yes-display-inline">Paragraph

			 (11) of section 309(j) of the Communications Act of 1934 (47 U.S.C. 309(j)(11))

			 is amended by striking <quote>September 30, 2007</quote> and inserting

			 <quote>September 30, 2009</quote>.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="id75E8A5C60C5542CF95A6629BB34772E7" section-type="subsequent-section"><enum>4.</enum><header>Digital transition

			 program</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDC9A4C6880273486C96C2C8E95A444216"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Beginning no earlier

			 than January 1, 2008, and not later than July 1, 2008, the Commission, in

			 consultation with commercial television broadcast licensees, shall distribute

			 to eligible persons digital-to-analog converter devices that will enable

			 television sets that operate only with analog signal processing to continue to

			 operate when receiving a digital signal.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id63F7CF0CF6CF46AA8BEA229F34896059"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Each eligible person seeking a

			 digital-to-analog converter device under subsection (a) shall submit an

			 application to the Commission at such times, in such manner, and containing

			 such information as the Commission requires.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id98BFBF6C924D4580BACD1C5B5F95D085"><enum>(c)</enum><header>Procurement</header><text display-inline="yes-display-inline">The provisions, rules, and regulations of

			 the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251 et

			 seq.) shall apply to the procurement, by the Comptroller General of the United

			 States, of the digital-to-analog converter devices described in subsection

			 (a).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idF3C907AAA7E942778630124D689C1A5F"><enum>(d)</enum><header>Study</header><text display-inline="yes-display-inline">Not later than 12 months after the date of

			 enactment of this Act, the Commission shall, in consultation with commercial

			 television broadcast licensees, consumer groups, and other interested parties,

			 complete a study of—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDf52e5fe7e91e48659c2d6b3e0c829084"><enum>(1)</enum><text display-inline="yes-display-inline">the geographic location of eligible persons

			 by Nielsen Designated Market Areas;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7a581a7499ee4dc699fea141eb8ac11b"><enum>(2)</enum><text display-inline="yes-display-inline">the use of not only broadcast studios for

			 distribution of such digital-to-analog converter devices, but the ability of

			 commercial television broadcast licensees to partner with grocery stores,

			 electronics stores, and post offices to serve as distribution centers for such

			 devices; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa92c815a3ddd4660ba712cbca24efdfc"><enum>(3)</enum><text display-inline="yes-display-inline">the ability of the Commission and

			 commercial television broadcast licensees to partner together to develop a

			 public communications campaign to inform over-the-air viewers of—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idDAAA9CAE84794465A69A365791460D37"><enum>(A)</enum><text display-inline="yes-display-inline">the need for a digital-to-analog converter

			 device; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF87B45746E9480B9743A795352009C0"><enum>(B)</enum><text display-inline="yes-display-inline">the availability of such a

			 digital-to-analog converter device free of charge for eligible persons.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3A791D5C35FF460DB3592058405F645E"><enum>(e)</enum><header>Eligible person

			 defined</header><text display-inline="yes-display-inline">In this section, the

			 term <quote>eligible person</quote> means any person relying exclusively on

			 over-the-air television broadcasts with a household income that does not exceed

			 200 percent of the poverty line, as such line is published in the Federal

			 Register by the Department of Health and Human Services under the authority of

			 section 673(2) of the Community Services Block Grant Act (42 U.S.C.

			 9902(2)).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id288FF414D98C4EE79555A4F096CD7BC9"><enum>(f)</enum><header>Authorization

			 of appropriations</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id3C25AB069F2249A68BB9424FACEFB737"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">There are authorized

			 to be appropriated $468,000,000 from the proceeds of the auction of licenses

			 for recovered analog spectrum under section 309(j)(14) of the Communications

			 Act of 1934 (47 U.S.C. 309(j)(14)).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id028C7E7450E94D7BA312F3794B92DFDC"><enum>(2)</enum><header>Distribution</header><text display-inline="yes-display-inline">Of the funds authorized to be appropriated

			 under paragraph (1)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id8D6B15ABF2354D4FABB2A9E4A35299DF"><enum>(A)</enum><text display-inline="yes-display-inline">$463,000,000 shall be available to procure

			 digital-to-analog converter devices; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF7E9B8648E66436783253697848710CC"><enum>(B)</enum><text display-inline="yes-display-inline">$5,000,000 shall be available to cover the

			 costs of administration of the digital transition program established under

			 this section.</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id054EDE9CF41B4246B82146F8C5A72C58" section-type="subsequent-section"><enum>5.</enum><header>Establishment and

			 authorization of appropriations for grant program to provide enhanced

			 interoperability of communications for first responders</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDBA6E8DEF67F44F0A93EE0D9E72FBED24"><enum>(a)</enum><header>Establishment

			 of program to assist first responders</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idF9B406716363417691C2A4847A10955D"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary of

			 Homeland Security shall establish a program to help State, local, tribal, and

			 regional first responders—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idCA97B2FE011543879709BD04AE9BD586"><enum>(A)</enum><text display-inline="yes-display-inline">acquire and deploy interoperable

			 communications equipment;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC6A4602BB90247249141B314A121E5F1"><enum>(B)</enum><text display-inline="yes-display-inline">purchase such equipment; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA9B2152BEE1041089E3528A9B7187CB8"><enum>(C)</enum><text display-inline="yes-display-inline">train personnel in the use of such

			 equipment.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id957CBF99AF2D4C94B9E056D1316B7DC9"><enum>(2)</enum><header>Common

			 standards</header><text display-inline="yes-display-inline">The Secretary, in

			 cooperation with the heads of other Federal departments and agencies who

			 administer programs that provide communications-related assistance programs to

			 State, local, and tribal public safety organizations, shall develop and

			 implement common standards to the greatest extent practicable.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDCA4D333C070C410E8D205513F8473984"><enum>(b)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible for assistance under the

			 program established in subsection (a), a State, local, tribal, or regional

			 first responder agency shall submit an application, at such time, in such form,

			 and containing such information as the Under Secretary of Homeland Security for

			 Science and Technology may require, including—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID847752ACD1CB48A0B38E7C09CFF3B1A1"><enum>(1)</enum><text display-inline="yes-display-inline">a detailed explanation of how assistance

			 received under the program would be used to improve local communications

			 interoperability and ensure interoperability with other appropriate Federal,

			 State, local, tribal, and regional agencies in a regional or national

			 emergency; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBAB42767824C469F848CCB2A04590160"><enum>(2)</enum><text display-inline="yes-display-inline">assurance that the equipment and system

			 would—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDf4da394334b74d939f46f746dd5bb207"><enum>(A)</enum><text display-inline="yes-display-inline">not be incompatible with the communications

			 architecture developed under section 7303(a)(1)(E) of the Intelligence Reform

			 Act of 2004;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5220f8e6ac6743548e08f02dc0b97980"><enum>(B)</enum><text display-inline="yes-display-inline">would meet any voluntary consensus

			 standards developed under section 7303(a)(1)(D) of that Act; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc5ca175cd2584399b3db295bf0e9e0c4"><enum>(C)</enum><text display-inline="yes-display-inline">be consistent with the common grant

			 guidance established under section 7303(a)(1)(H) of that Act.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID77E3E9708A574A0EB1B091614C86C107"><enum>(c)</enum><header>Review</header><text display-inline="yes-display-inline">The Under Secretary of Homeland Security

			 for Science and Technology shall review and approve, in the discretion of the

			 Under Secretary, all applications submitted under subsection (b).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id4A25098A95A5426087921172D411F9D9"><enum>(d)</enum><header>Single

			 grants</header><text display-inline="yes-display-inline">The Secretary of

			 Homeland Security, pursuant to an application approved by the Under Secretary

			 of Homeland Security for Science and Technology, may make the assistance

			 provided under the program established in subsection (a) available to all

			 approved applicants in the form of a single grant for a period of not more than

			 3 years.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id62BBA44D6EDF424BADE8F714C8498115"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than January 1, 2008, the

			 Commission shall report to the Committee on Commerce, Science, and

			 Transportation of the Senate and the Committee on Energy and Commerce of the

			 House of Representatives the amount required to carry out the program described

			 in section 4.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idFC11237B7CDC49A894B96A60A606C281"><enum>(f)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">To the

			 extent that proceeds from the auction of licenses for recovered analog spectrum

			 under section 309(j)(14) of the Communications Act of 1934 (47 U.S.C.

			 309(j)(14)) are available and exceed the amount required to carry out the

			 program described in section 4, there are authorized to be appropriated from

			 such proceeds such sums as are available to fund the grant program established

			 under this section.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="HAD0C630DC0864D43820069BD5546E07F" section-type="subsequent-section"><enum>6.</enum><header>Consumer education

			 regarding the digital television transition</header>

			<subsection commented="no" display-inline="no-display-inline" id="H61946E0872194B91AAD1AB8CCF94BBE"><enum>(a)</enum><header>Commission

			 authority</header><text display-inline="yes-display-inline">Section 303 of the

			 Communications Act of 1934 (47 U.S.C. 303) is amended by adding at the end the

			 following new subsection:</text>

				<quoted-block display-inline="no-display-inline" id="H3D14524DE7F840BABF00C625A7EAC6DA" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="H0609559DF51D4B2E87768927EC118619"><enum>(z)</enum><text display-inline="yes-display-inline">Require the consumer education measures

				specified in section 330(d) in the case of apparatus designed to receive

				television signals that—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="H744C0CF9D3734746B5211487A07E95F7"><enum>(1)</enum><text display-inline="yes-display-inline">are shipped in interstate commerce or

				manufactured in the United States after 180 days after the date of enactment of

				the SAVE LIVES Act; and</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25A038E7BF484DA4B2E6C90003D023E9"><enum>(2)</enum><text display-inline="yes-display-inline">are not capable of receiving and displaying

				broadcast signals in the digital television service on the channels allocated

				to such

				broadcasts.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H2F9A7EDC7FC74DD4AD3DEE038B7CC0DF"><enum>(b)</enum><header>Consumer

			 education requirements</header><text display-inline="yes-display-inline">Section 330 of the Communications Act of

			 1934 (47 U.S.C. 330) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="H787284AFF8E34B1CA14B65EDB3DEB217"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d), by striking

			 <quote>sections 303(s), 303(u), and 303(x)</quote> and inserting

			 <quote>subsections (s), (u), (x), and (z) of section 303</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFF7B99F72A234BF78EF007C563577CAC"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as

			 subsection (e); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HADFACEDC480E4E10A0B57B83B6B5399D"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the

			 following new subsection:</text>

				education regarding equipment, television receivers, and other materials

				related to the digital to analog conversion</header>

							<paragraph commented="no" display-inline="no-display-inline" id="H4F455FC042394806A3A99040AB81D777"><enum>(1)</enum><header>Requirements for

				manufacturers</header><text display-inline="yes-display-inline">Any

				manufacturer of any apparatus described in section 303(z) shall—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H59909198B17F402684B0D43C55113087"><enum>(A)</enum><text display-inline="yes-display-inline">place on the screen of any such apparatus

				that such manufacturer ships in interstate commerce or manufactures in the

				United States after 180 days after the date of enactment of the SAVE LIVES Act,

				a removable label containing the warning language required by

				<internal-xref idref="HF03D2607D2C34773833726EB4B3469FC" legis-path="(d)(3)">paragraph (3);</internal-xref> and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7BD5BDF963A841FEBF75956500E2C95"><enum>(B)</enum><text display-inline="yes-display-inline">also include such warning language on the

				outside of the retail packaging of such apparatus in a manner that cannot be

				removed.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD503C13843E14474A2054F1BEB9BDDE"><enum>(2)</enum><header>Requirements for

				retail distributors</header><text display-inline="yes-display-inline">Any

				retail distributor shall place adjacent to each apparatus described in section

				303(z) that such distributor displays for sale or rent after 180 days after the

				date of enactment of the SAVE LIVES Act, a separate sign containing the warning

				language required by

				<internal-xref idref="HF03D2607D2C34773833726EB4B3469FC" legis-path="(d)(3)">paragraph (3)</internal-xref>.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF03D2607D2C34773833726EB4B3469FC"><enum>(3)</enum><header>Warning

				language</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="id50DBF58F3FC44D16A5EE7683928CD92E"><enum>(A)</enum><header>Rulemaking

				proceeding</header><text display-inline="yes-display-inline">Not later than 120

				days after the date of enactment of this Act, the Commission, in consultation

				with consumers and representatives from the broadcast, cable, and satellite

				industries, shall complete a rulemaking proceeding to develop warning language

				to be used by manufacturers and retail distributors concerning the size and

				format of the warning language required by this paragraph.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ACBE1DF246A4D98821BC8862ED16B24"><enum>(B)</enum><header>Content of

				warning</header><text display-inline="yes-display-inline">The warning language

				required by this paragraph shall clearly inform consumers, in plain English

				understandable to the average consumer, of the following:</text>

									<clause commented="no" display-inline="no-display-inline" id="id8E81F3B026FF472DAA598328EDBB5D6B"><enum>(i)</enum><text display-inline="yes-display-inline">After December 31, 2008, television

				broadcasters will cease analog over-the-air broadcasts and will broadcast only

				in digital format.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id471EDE08B94C49D2B06F315238F0346F"><enum>(ii)</enum><text display-inline="yes-display-inline">That a television set carrying the label

				required under paragraph (1) will no longer be able to receive broadcast

				programming unless it is connected to a digital tuner, a digital-to-analog

				converter device, or cable, satellite, or other multichannel video

				services.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id8794096E5EA0440DB5090DB676976FDB"><enum>(iii)</enum><text display-inline="yes-display-inline">Beyond December 31, 2008, a television set

				carrying the label required under paragraph (1) will, however, continue to

				display images from devices such as DVD recorders and video game consoles or

				content recorded for display on an analog television using devices such as

				VCRs, digital video recorders, or DVD recorders.</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="idBB0007BE383E4FBABE07998B524FAB01"><enum>(iv)</enum><text display-inline="yes-display-inline">For more information regarding the

				transition to digital television consumers should call the Federal

				Communications Commission at 1–888–225–5322 (TTY: 1–888–835–5322) or visit the

				Commission’s website at: www.fcc.gov.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3310D5B8048641A4A7F70CAA17CD8220"><enum>(4)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Any violation of the requirements of this

				section, shall be enforced by the Federal Trade Commission as if it were an

				unfair or deceptive act or practice proscribed under section 18(a)(1)(B) of the

				Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)).</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H19FA39635E834BC28E9BCF453772D687"><enum>(5)</enum><header>Sunset</header><text display-inline="yes-display-inline">The warning language required by paragraph

				(3) shall not apply to any manufacturer or retail distributor on or after

				January 1, 2009.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC0CECE01E7CB485C9E4F69B96D452431"><enum>(6)</enum><header>Commission

				outreach</header><text display-inline="yes-display-inline">Beginning not later

				than 1 month after the date of enactment of the SAVE LIVES Act, the Commission

				shall engage in a public outreach program to educate consumers about—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="H9B333695C68B400AAFBEACFB2069126"><enum>(A)</enum><text display-inline="yes-display-inline">the deadline for termination of analog

				television broadcasting; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57000C6721F7430789B2D9B6AE0826BC"><enum>(B)</enum><text display-inline="yes-display-inline">the options consumers have after such

				termination to continue to receive broadcast

				programming.</text>

								</subparagraph></paragraph></subsection><after-quoted-block></after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8F93770458054D8D92795DD5E1E1F68"><enum>(c)</enum><header>Preserving and

			 expediting digital television tuner mandates</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id210028F6AD4C4AD7841AC273CD71F670"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Commission shall

			 require not later than—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id730902A6040B4580BFBDAC567015BAAA"><enum>(A)</enum><text display-inline="yes-display-inline">July 1, 2005, that digital television

			 tuners be integrated into television receivers having analog tuners in the case

			 of television sets with screen sizes 36 inches or greater;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0A73BCCC619949878840780C6699F915"><enum>(B)</enum><text display-inline="yes-display-inline">March 1, 2006, that digital television

			 tuners be integrated into television receivers having analog tuners in the case

			 of television sets with screen sizes between 25 inches and 35 inches;

			 and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9EB871B0D16246AFBBADF319D61CCF6C"><enum>(C)</enum><text display-inline="yes-display-inline">March 1, 2007, that digital television

			 tuners be integrated into television receivers having analog tuners in the case

			 of television sets with screen sizes between 14 inches and 24 inches.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9D24D1DEE1DF417D832B649CB257D6D1"><enum>(2)</enum><header>Study</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id21AE944155D041E59848F449C28467B6"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date of enactment of this Act, the Commission shall conduct a study

			 to determine whether digital television tuners are necessary in television sets

			 with screen sizes 13 inches or smaller.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA1FD3180492440F09BD29FF01AF1CBB5"><enum>(B)</enum><header>Mandates for

			 television sets with screen sizes 13 inches or smaller</header><text display-inline="yes-display-inline">Upon completion of the study required under

			 subparagraph (A), if the Commission determines that digital television tuners

			 are necessary in television sets with screen sizes 13 inches or smaller, the

			 Commission shall enact, not later than July 1, 2008, digital television tuner

			 mandates for such television sets.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id38CCCC179DA84F4887B05A8168B80604"><enum>(d)</enum><header>Informed

			 consumer requirement</header><text display-inline="yes-display-inline">Not

			 later than 90 days after the date of enactment of this Act, the Consumer and

			 Governmental Affairs Bureau of the Commission shall develop and distribute to

			 all consumers seeking to purchase a televison set a brochure that clearly

			 describes the different options available to a consumer, including information

			 that—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID5ec2cc5dfd0344fbabca85fe4ab1e9e3"><enum>(1)</enum><text display-inline="yes-display-inline">in order for a consumer to receive and

			 display a digital television signal, a consumer must have—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id8EC43509F3904370919D4CF7D9A56886"><enum>(A)</enum><text display-inline="yes-display-inline">both a digital television display or

			 monitor and a digital tuner; or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id30B3D97A9B0C41CFAFAE5F4011B50488"><enum>(B)</enum><text display-inline="yes-display-inline">an integrated digital television

			 set;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcf1bd34754b8402b9f55f6c30340af93"><enum>(2)</enum><text display-inline="yes-display-inline">there is a difference between a digital

			 television and high-definition digital television signals and a digital

			 television and high-definition digital television set; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb283191559884091951d40ec29e6c775"><enum>(3)</enum><text display-inline="yes-display-inline">current televisions—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id8DEACDED5A0741CF9F595A35FA2B6BFC"><enum>(A)</enum><text display-inline="yes-display-inline">are not obsolete;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5E836C9E96CF4147A038E4F1C03B9202"><enum>(B)</enum><text display-inline="yes-display-inline">can receive digital television signals with

			 the use of a digital-to-analog converter device and will display such signals

			 in an analog format; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4948DD4C92F94F84A51B829DF7997D9F"><enum>(C)</enum><text display-inline="yes-display-inline">will continue to work with cable,

			 satellite, VCRs, DVD recorders, and other devices.</text>

					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id33043482EDFC41C690CCBDD8ADB45F7C" section-type="subsequent-section"><enum>7.</enum><header>Digital to analog

			 conversion available for cable subscribers</header>

			<subsection commented="no" display-inline="no-display-inline" id="H3B9BB1BDA8004A7CAE703D000528FF72"><enum>(a)</enum><header>Digital to

			 analog conversion permitted</header><text display-inline="yes-display-inline">Section 614(b) of the Communications Act of

			 1934 (47 U.S.C. 534(b)) is amended by adding at the end the following new

			 paragraph:</text>

				<quoted-block display-inline="no-display-inline" id="H89C257C872DF4920BA142E1975D6A0F6" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="H78A3B99E306843D780A7497B7E48F8D8"><enum>(11)</enum><header>Digital</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="H68641BBD814247EFBA35A6B724E17B96"><enum>(A)</enum><header>Digital primary

				video signal</header><text display-inline="yes-display-inline">A cable operator

				shall carry the primary video of the digital signal of a local broadcast

				station in its originally broadcast format without material degradation upon

				such local broadcast station's—</text>

							<clause commented="no" display-inline="no-display-inline" id="id36E50DC40E4D48D3ADA694B67D397CDA"><enum>(i)</enum><text display-inline="yes-display-inline">cessation of analog broadcasting;

				and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id22DDB55D80C64BFFA17DAA840EA88A04"><enum>(ii)</enum><text display-inline="yes-display-inline">election of cable carriage under this

				section or section 615.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFF0B9B4B4C6A4276AE76067B8831E392"><enum>(B)</enum><header>Digital to

				analog conversions permitted</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), the

				conversion by a cable operator, at any location from the cable headend through

				equipment on the premises of a subscriber, of a digital television signal into

				a signal capable of being viewed by such subscriber with an analog television

				receiver shall be permitted subject to the conditions described in subparagraph

				(C).</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id981B5F2B3A4147A7AD6309180A96ED57"><enum>(C)</enum><header>Conditions on

				permitted downconversion</header><text display-inline="yes-display-inline">If a

				cable operator provides a converted signal for any station in a local market

				under subparagraph (B), that—</text>

							<clause commented="no" display-inline="no-display-inline" id="id72301D483B534D648A0EAA347B2BAA89"><enum>(i)</enum><text display-inline="yes-display-inline">is carried under this section or section

				615; and</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id35C9C9B9B58146F5B9B123160190F9C6"><enum>(ii)</enum><text display-inline="yes-display-inline">has ceased to broadcast in the analog

				television service;</text>

							</clause><continuation-text commented="no" continuation-text-level="subparagraph">such cable operator shall provide

				such a converted signal for each such station that is located within the same

				local market.</continuation-text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB2B097EE6C704B07938933CD978CADB2"><enum>(D)</enum><header>Conversion

				sunset</header>

							<clause commented="no" display-inline="no-display-inline" id="id5529A1EC0C5047029FDA3C4B697D39C5"><enum>(i)</enum><header>In

				general</header><text display-inline="yes-display-inline">Subject to clause

				(ii), beginning not earlier than December 31, 2011 and not later than December

				31, 2012, the Commission shall cease to impose on a cable operator the

				requirement under <internal-xref legis-path="(11)(B)(ii)">subparagraph

				(B)</internal-xref>, if the Commission determines that such requirement is not

				necessary to ensure the continued ability of the audiences for foreign-language

				and religious television broadcast stations to view the signals of such

				stations.</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id948E2D0CFCDD48CFB95C74B7975AE3DF"><enum>(ii)</enum><header>Considerations</header><text display-inline="yes-display-inline">In making a determination under clause (i),

				the Commission shall take into consideration—</text>

								<subclause commented="no" display-inline="no-display-inline" id="idE495EA352FA24D89A3713AD8B5F4EB5D"><enum>(I)</enum><text display-inline="yes-display-inline">the penetration of digital televisions,

				digital receivers, and digital-to-analog converter devices among audiences of

				foreign-language and religious television broadcast stations; and</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="id6628C26C15114E3D940A37956FFCCD0F"><enum>(II)</enum><text display-inline="yes-display-inline">the market incentives of cable operators,

				in the absence of the requirement under subparagraph (B), to carry the signals

				of foreign-language and religious television broadcast stations in the format

				most available to be viewed by the audiences of such stations.</text>

								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id36C6AF183C664EE186CD27157CCC19AD"><enum>(E)</enum><header>Review</header><text display-inline="yes-display-inline">Not later than 1 year after the date of

				enactment of the SAVE LIVES Act, and every 2 years thereafter until December

				31, 2012, the Commission shall review the considerations described in

				subparagraph

				(D)(ii).</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="H48FBB3D7FE214FD3BAB05941DFCEA9DE"><enum>(b)</enum><header>Tiering</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id5395FD942364469FBDB7F83883BAE38A"><enum>(1)</enum><header>Amendment to

			 Communications Act</header><text display-inline="yes-display-inline">Section

			 623(b)(7)(A)(iii) of the Communications Act of 1934 (47 U.S.C.

			 543(b)(7)(A)(iii)) is amended—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="H842E59D2E0174C3E9C02386F4B1B4CD4"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Any signal</quote> and

			 inserting <quote>Any analog signal</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8E3442CF011E4077913E71398264CBD5"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>and a single digital

			 video programming stream, designated by such station, that is transmitted

			 over-the-air by such station, and</quote> after <quote>television broadcast

			 station</quote>.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H01A0BC892EE143FE961BF5F6D2E4FDB4"><enum>(2)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">This subsection and the

			 amendments made by this subsection shall take effect on January 1, 2009.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9726A938C95A4727BC971A3218DFC47C" section-type="subsequent-section"><enum>8.</enum><header>Recycling of

			 television sets</header>

			<subsection commented="no" display-inline="no-display-inline" id="id1D198080D68F4B9E9062B45103E8068F"><enum>(a)</enum><header>Individual tax

			 credit for recycling of electronic waste</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idAD8FC0429AEA412BBC52E65C0D6D196A"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subpart B of part IV

			 of subchapter A of chapter 1 of subtitle A of the Internal Revenue Code of 1986

			 is amended by adding at the end the following new section:</text>

					<quoted-block display-inline="no-display-inline" id="ID6A4445FEA8154D14B2F66FE156C3D8AF" style="OLC">

						<section commented="no" display-inline="no-display-inline" id="ID745947D6C8D64E179258C02F92FC5C35" section-type="subsequent-section"><enum>30B.</enum><header>Credit for recycling

				electronic waste</header>

							<subsection commented="no" display-inline="no-display-inline" id="IDE6BB70737C5142DB8647FFBB911653D7"><enum>(a)</enum><header>Allowance of

				credit</header><text display-inline="yes-display-inline">In the case of an

				eligible taxpayer, there shall be allowed as a credit against the tax imposed

				by this chapter for the taxable year an amount equal to $8 per unit of

				qualified electronic waste that is collected from consumers and

				recycled.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID69E966E1B4A04CC3A0E53E4761C1D3B1"><enum>(b)</enum><header>Disallowance of

				credit</header><text display-inline="yes-display-inline">No credit shall be

				allowed under this section for recycling a unit of qualified electronic waste

				which is collected from a consumer in a State which has adopted and implemented

				a statewide program in accordance with State law which mandates or provides

				incentives for recycling electronic waste, including a mandatory per-unit,

				upfront charge to consumers for the purpose of recycling electronic

				waste.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID897F2819A4D54414B5F3579668142401"><enum>(c)</enum><header>Final

				regulations</header>

								<paragraph commented="no" display-inline="no-display-inline" id="IDC5FEFCD57B124B83805CF65C81F79D01"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Not later than 180

				days after the date of enactment of the SAVE LIVES Act, the Secretary, after

				consultation with the Administrator of the Environmental Protection Agency,

				shall issue such final regulations as may be necessary and appropriate to carry

				out this section.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID618D2F2F4B39413C914E0EBFF9934EED"><enum>(2)</enum><header>Inclusion</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID955B851728CD45A5B3453FFE7D31CDD8"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">Subject to

				subparagraph (B), the regulations issued under paragraph (1) shall

				include—</text>

										<clause commented="no" display-inline="no-display-inline" id="IDC17E9C2DF3B74A0F9F7178F988121864"><enum>(i)</enum><text display-inline="yes-display-inline">requirements for certifying recyclers as

				eligible to recycle qualified electronic waste;</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID32069F2CDE1F4B8BB65268BD00D61491"><enum>(ii)</enum><text display-inline="yes-display-inline">requirements to ensure that all recycling

				of qualified electronic waste is performed in a manner that is safe and

				environmentally sound; and</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID3B1700EEB74A4FAA85861248A1A287E0"><enum>(iii)</enum><text display-inline="yes-display-inline">a provision which allows a tax credit under

				this section to be shared by 2 or more eligible taxpayers, provided that the

				total tax credit for a unit of electronic waste under this section does not

				exceed $8.</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD2749E536A7647248C96A3BC67368BB4"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary shall not certify a recycler

				as eligible under this subsection unless the recycler is—</text>

										<clause commented="no" display-inline="no-display-inline" id="IDD9BA4CCA8E72419EA950C948694F5F84"><enum>(i)</enum><text display-inline="yes-display-inline">a taxpayer; or</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID721E86821E7049E6BA3FC5159DBAB08B"><enum>(ii)</enum><text display-inline="yes-display-inline">a State or local government.</text>

										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID52F70DAF0E1548E6A96F21CD0FC010DE"><enum>(d)</enum><header>Termination</header><text display-inline="yes-display-inline">This section shall not apply with respect

				to any unit of qualified electronic waste which is recycled after the date

				which is 3 years after the date on which the final regulations issued pursuant

				to subparagraph (c) take effect.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4520DBE3795B4F83891FB3D6685C4D0D"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="IDF0CA579B896449AEB213B77E34E069F0"><enum>(1)</enum><header>Cathode ray

				tube</header><text display-inline="yes-display-inline">The term <term>cathode

				ray tube</term> means a vacuum tube used to convert an electronic signal into a

				visual image, for use in a television or other similar piece of electronic

				equipment.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id32EB0ABCD4BC4705BE93A5CC0D433B73"><enum>(2)</enum><header>Consumer</header><text display-inline="yes-display-inline">The term <term>consumer</term>

				means—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="IDB6DDB9C39FCD4480B67D9119B3455885"><enum>(A)</enum><text display-inline="yes-display-inline">an occupant of a single, detached dwelling

				unit or a single unit of a multiple dwelling unit who—</text>

										<clause commented="no" display-inline="no-display-inline" id="ID557375C159DA44738F2048654EDE5729"><enum>(i)</enum><text display-inline="yes-display-inline">has used a television or another piece of

				electronic equipment that contains a display screen; and</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID9128853CA0B54B8FA094EA6ACFB967F3"><enum>(ii)</enum><text display-inline="yes-display-inline">used the equipment described in

				subparagraph (A) at the dwelling unit of the occupant; and</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID727F3C0215B34013A1E810F4B51D1A88"><enum>(B)</enum><text display-inline="yes-display-inline">a commercial, educational, or other entity

				that discarded for recycling not more than 20 display screens per year during

				the previous 5 years.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFE4F29F90F634E40902BC64D6B7343CD"><enum>(3)</enum><header>Display

				screen</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID9A0A9F4F589340598368457C71E99E5E"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>display screen</term> means a cathode ray tube, flat panel screen, or

				other similar video display device with a screen size of greater than 4 inches,

				measured diagonally.</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID448495918A474D8A8723B998442E76BF"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>display screen</term> does

				not include commercial or industrial equipment, or household appliances, that

				contain—</text>

										<clause commented="no" display-inline="no-display-inline" id="IDD55568FB1E9348D48E8ACBD143B8439E"><enum>(i)</enum><text display-inline="yes-display-inline">a cathode ray tube;</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID0E39685A61F94C9D86A58A76858D24C5"><enum>(ii)</enum><text display-inline="yes-display-inline">a flat panel screen; or</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID45E159BB66FA48FDBECA75D047857188"><enum>(iii)</enum><text display-inline="yes-display-inline">another similar video device.</text>

										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7DBFDA28AB3841149D8F6DDAE69CEB83"><enum>(4)</enum><header>Eligible

				taxpayer</header><text display-inline="yes-display-inline">The term

				<term>eligible taxpayer</term> means any person which—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="IDD5B60AA2EF6B4270B58821E252BA8A23"><enum>(A)</enum><text display-inline="yes-display-inline">collects from consumers and recycles, or

				arranges for the recycling of, not less than 5,000 units of qualified

				electronic waste during the taxable year of such person;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID39DC7B346C4D4ADF9F2D338B7479E22E"><enum>(B)</enum><text display-inline="yes-display-inline">submits with the tax return of such person

				documentation of the final destination of all units of electronic waste

				collected from consumers during the taxable year of such person for the purpose

				of recycling; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFE45BB7AC79E4B6ABAEBA6ED55F6F278"><enum>(C)</enum><text display-inline="yes-display-inline">certifies that all reclamation and

				recycling carried out by such person was performed by an eligible

				recycler.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF929460A30F54EA3BBADABB3A53A0A4A"><enum>(5)</enum><header>Qualified

				electronic waste</header><text display-inline="yes-display-inline">The term

				<term>qualified electronic waste</term> means any display screen.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42D7CACB3E024F4EB8A6BDFC22734EA1"><enum>(6)</enum><header>Recycle</header><text display-inline="yes-display-inline">The term <term>recycle</term> means the

				performance of a process by 1 or more persons by which a display screen

				is—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID44CA1D1D7CFB40A3B48F25D447607A07"><enum>(A)</enum><text display-inline="yes-display-inline">sorted;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8080BA481D8C4CF3B412B8A44EE613E8"><enum>(B)</enum><text display-inline="yes-display-inline">if necessary, transported;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID73C972B264E94037BE4374483E708D4D"><enum>(C)</enum><text display-inline="yes-display-inline">to the maximum extent practicable,

				separated to recover any component or commodity inside the display screen that

				can be reduced to raw materials or products; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5B3CF769D2C2440BBE1E440FFF603C2C"><enum>(D)</enum><text display-inline="yes-display-inline">treated such that any remaining material is

				disposed of properly and in an environmentally sound manner consistent with the

				<act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (42 U.S.C.

				6901 et

				seq.).</text>

									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id04B84CF6535D4278BA3D25C34AFF61BA"><enum>(2)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendment made by

			 this subsection shall apply with respect to electronic waste recycled after the

			 date on which the final regulations issued pursuant to section 30B of subpart B

			 of part IV of subchapter A of chapter 1 of subtitle A of the Internal Revenue

			 Code of 1986 (as added by this subsection) take effect.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id83782121BFC34B75BDCEDD52BCF92146"><enum>(b)</enum><header>Consumer credit

			 for recycling electronic waste</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idBB70FAAE9E7048F8B3B71CBB01662507"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Subpart A of part IV

			 of subchapter A of chapter 1 of subtitle A of the Internal Revenue Code of 1986

			 is amended by inserting after section 25B the following new section:</text>

						<section commented="no" display-inline="no-display-inline" id="ID3DA56EDDE9D94BF9920C70FFBF509783" section-type="subsequent-section"><enum>25C.</enum><header>Consumer credit for

				recycling electronic waste</header>

							<subsection commented="no" display-inline="no-display-inline" id="ID4D318F44713B44278F0624088A094273"><enum>(a)</enum><header>Allowance of

				credit</header><text display-inline="yes-display-inline">In the case of an

				eligible consumer, there shall be allowed as a credit against the tax imposed

				by this chapter for the taxable year an amount equal to $15 for the recycling

				of 1 or more units of qualified electronic waste.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAA78225291C74474A2991833FDA82CA3"><enum>(b)</enum><header>Final

				regulations</header>

								<paragraph commented="no" display-inline="no-display-inline" id="ID0E45192BF1FB4C05A0D6BE04C0999AA4"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Not later than 180

				days after the date of enactment of the SAVE LIVES Act, the Secretary, after

				consultation with the Administrator of the Environmental Protection Agency,

				shall issue such final regulations as may be necessary and appropriate to carry

				out this section.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD7C504205E9A48A59A1AC5381674A12E"><enum>(2)</enum><header>Inclusion</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="IDAEEC51DD3A734CC0A59E8B3B788B1318"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">Subject to

				subparagraph (B), the regulations issued under paragraph (1) shall

				include—</text>

										<clause commented="no" display-inline="no-display-inline" id="IDF4B81EABEE0A4E7D9CC3DC572E9CCD89"><enum>(i)</enum><text display-inline="yes-display-inline">requirements for certifying recyclers as

				eligible to recycle qualified electronic waste; and</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="IDFE27F7F9A42F4952BE5E6768CA4E4AD7"><enum>(ii)</enum><text display-inline="yes-display-inline">requirements to ensure that all recycling

				of qualified electronic waste is performed in a manner that is safe and

				environmentally sound.</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF4551F688E7E405AB55FF4938F909100"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Secretary shall not certify a recycler

				as eligible under this subsection unless the recycler is—</text>

										<clause commented="no" display-inline="no-display-inline" id="IDC766ED1EE0B84F47BC84A53B8D480220"><enum>(i)</enum><text display-inline="yes-display-inline">a taxpayer; or</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID969C5CDA1E5B4E13999FD535E9A79CB0"><enum>(ii)</enum><text display-inline="yes-display-inline">a State or local government.</text>

										</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2C61085A76B544279A8AC79836629B15"><enum>(c)</enum><header>Termination</header><text display-inline="yes-display-inline">This section shall not apply with respect

				to any unit of qualified electronic waste which is recycled after the date

				which is 3 years after the date on which the final regulations issued pursuant

				to subsection (b) take effect.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="idE8CF8CA4201646C894D44B1BB16B7DA2"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="id9E401385904C428F890D813F3874E3E9"><enum>(1)</enum><header>Cathode ray

				tube</header><text display-inline="yes-display-inline">The term <term>cathode

				ray tube</term> means a vacuum tube used to convert an electronic signal into a

				visual image, for use in a television or other similar piece of electronic

				equipment.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id98ADD2B278264AAF9AA38FC09836BC85"><enum>(2)</enum><header>Consumer</header><text display-inline="yes-display-inline">The term <term>consumer</term>

				means—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="id203E12AEF9594155844217717FE8346D"><enum>(A)</enum><text display-inline="yes-display-inline">an occupant of a single, detached dwelling

				unit or a single unit of a multiple dwelling unit who—</text>

										<clause commented="no" display-inline="no-display-inline" id="id926DF607497E44A3A75DB605036BE4CB"><enum>(i)</enum><text display-inline="yes-display-inline">has used a television or another piece of

				electronic equipment that contains a display screen; and</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="id3BFA4B5C533944E8AC0294D50186F360"><enum>(ii)</enum><text display-inline="yes-display-inline">used the equipment described in

				subparagraph (A) at the dwelling unit of the occupant; and</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAE504B2365AD492D98EF9E8810605FC6"><enum>(B)</enum><text display-inline="yes-display-inline">a commercial, educational, or other entity

				that discarded for recycling not more than 20 display screens per year during

				the previous 5 years.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id497BDE5A11E54DB582891B7E9252412A"><enum>(3)</enum><header>Display

				screen</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="id587E68AD772343E298F6F3ADDBFD37D7"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>display screen</term> means a cathode ray tube, flat panel screen, or

				other similar video display device with a screen size of greater than 4 inches,

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB4D650ABB96142518D1BE2858372D3BA"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>display screen</term> does

				not include commercial or industrial equipment, or household appliances, that

				contain—</text>

										<clause commented="no" display-inline="no-display-inline" id="id0BAA45B36E16498AAD97DDD71CFE08C3"><enum>(i)</enum><text display-inline="yes-display-inline">a cathode ray tube;</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="idFB9FC7E68C874D43A85623483A5E96DF"><enum>(ii)</enum><text display-inline="yes-display-inline">a flat panel screen; or</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="id4F4D3143809D4E4AAD74F104C10DEB5B"><enum>(iii)</enum><text display-inline="yes-display-inline">another similar video device.</text>

										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID084904C332DE4F459C3F6ED36D6C4995"><enum>(4)</enum><header>Eligible

				consumer</header><text display-inline="yes-display-inline">The term

				<term>eligible consumer</term> means any individual—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID0FDC03AE99C74937A46A029AC9F17124"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to whom a credit under this

				section has not been allowed in any preceding taxable year; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3E9AC51445E544C2B4B81B6BD9FF6A36"><enum>(B)</enum><text display-inline="yes-display-inline">who submits with the tax return of such

				individual such information as the Secretary requires to document that each

				unit of qualified electronic waste was recycled by a recycler certified by the

				Secretary under subsection (b).</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3012917D3DC643449B01DEB6E630FF4D"><enum>(5)</enum><header>Qualified

				electronic waste</header><text display-inline="yes-display-inline">The term

				<term>qualified electronic waste</term> means any display screen.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD278F11294949C2BED86E722CA306A9"><enum>(6)</enum><header>Recycle</header><text display-inline="yes-display-inline">The term <term>recycle</term> means the

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBCD05F3984574233BC309979E2CA3153"><enum>(C)</enum><text display-inline="yes-display-inline">to the maximum extent practicable,

				separated to recover any component or commodity inside the display screen that

				can be reduced to raw materials or products; and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8C3DCA7CBD5B413EAA97B4CFA0C1C4C6"><enum>(D)</enum><text display-inline="yes-display-inline">treated such that any remaining material is

				disposed of properly and in an environmentally sound manner consistent with the

			 recycling program</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID430F72B60A794244893D4B91AE2A8200"><enum>(a)</enum><header>Study</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDD17B08F5C11941F1B7F300AB859A2112"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Administrator of

			 the Environmental Protection Agency, in consultation with appropriate executive

			 agencies (as determined by the Administrator), shall conduct a study of the

			 feasibility of establishing a nationwide recycling program for electronic

			 waste, as that term is defined under section 30B of the Internal Revenue Code

			 of 1986, that preempts any State recycling program.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD48C1D9860594A419082F0C89B9DB368"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The study shall include an analysis of

			 multiple programs, including programs involving—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID1AFF6281A0FD458DBC1ECF51779BE1D7"><enum>(A)</enum><text display-inline="yes-display-inline">the collection of an advanced recycling

			 fee;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID669EA8718FC54EB2B34516FE914C29E4"><enum>(B)</enum><text display-inline="yes-display-inline">the collection of an end-of-life

			 fee;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID050BCD8F286443AEBF8059A2A8C55DDC"><enum>(C)</enum><text display-inline="yes-display-inline">producers of electronics assuming the

			 responsibility and the cost of recycling electronic waste; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD65E3059496D44048A4A503213E32B9D"><enum>(D)</enum><text display-inline="yes-display-inline">the extension of a tax credit for recycling

			 electronic waste.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID45038FC01FB74D43861210E529495D49"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of

			 enactment of this Act, the Administrator of the Environmental Protection Agency

			 shall submit to Congress a report describing the results of the study conducted

			 under subsection (a);</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H0AB5CAA1443B470AB8C32D00D2316535" section-type="subsequent-section"><enum>10.</enum><header>Completion of certain

			 pending proceedings</header>

			<subsection commented="no" display-inline="no-display-inline" id="idCF54EE80D5DB41459FD6F90B624BE74C"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Commission shall

			 complete action on and issue a final decision not later than—</text>

			 enactment of this Act, and every 3 months thereafter until July 1, 2007, the

			 parties in the matter of the Implementation of Section 304 of the

			 Telecommunications Act of 1996, Commercial Availability of Navigation Devices,

			 Second Report and Order, CS Docket No. 97–80, shall report to the Committee on

			 Commerce, Science, and Transportation of the Senate and the Committee on Energy

			 and Commerce of the House of Representatives on the status of negotiations for

			 two-way devices.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6FEFB39F1792451AB0DA0BDFF5E9EAD6"><enum>(2)</enum><header>Final

			 order</header><text display-inline="yes-display-inline">Not later than December

			 31, 2007, the Commission shall complete action on and issue a final decision in

			 the matter of the Implementation of Section 304 of the Telecommunications Act

			 of 1996, Commercial Availability of Navigation Devices, Second Report and

			 Order, CS Docket No. 97–80.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idABCB5DE7ED47437890E09989926C1BC6" section-type="subsequent-section"><enum>11.</enum><header>Exception to removal

			 and relocation of incumbent broadcast licensees operating between 746 and 806

			 megahertz</header><text display-inline="no-display-inline">Section 337(e) of

			 the Communications Act of 1934 (47 U.S.C. 337(e)) is amended by adding at the

			 end the following new paragraph:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id46A0ED9B05C24F8E9A3615D734E879AD"><enum>(A)</enum><text display-inline="yes-display-inline">television translator stations;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5393BFD4E18C4A59B60BF58CFDCA9449"><enum>(B)</enum><text display-inline="yes-display-inline">low-power television stations; or</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA9EFEBB19D34493796115A269C5F9FAF"><enum>(C)</enum><text display-inline="yes-display-inline">class A television

				stations.</text>
