		  to modify the computation of eligibility for certain Federal Pell Grants, and

		<section commented="no" display-inline="no-display-inline" id="IDB4D5EB2BA49C4D909056258F00831969" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Federal Pell Grant Eligibility

			 Clarification Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID22DAAF471124471CADBCA28E797713F1" section-type="subsequent-section"><enum>2.</enum><header>Consideration of

			 current year circumstances</header><text display-inline="no-display-inline">Section 480(a) of the

			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv(a)">20 U.S.C.

			 1087vv(a)</external-xref>) is amended—</text>

			<paragraph commented="no" display-inline="no-display-inline" id="ID42A61574302540C090E11BDCE8593FE2"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking

			 <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and

			 (3)</quote>; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID095401ECC97B41F296C81384F26BC1D6"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="IDA2A3E1E2B03B41DAB7C8FB87793783B8" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="IDEB3DEC787EA247FF8DD3C57408EFF5F3"><enum>(3)</enum><header>Consideration

				of current year circumstances for certain Pell grant awards</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDEE481991F9F94815A27D6E07AF264354"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">If a student is a

				resident of a State that is in an extended benefit period (as determined under

				subparagraph (C)), then for purposes of calculating total income under

				paragraph (1) for a student seeking assistance under subpart 1 of part A, the

				Secretary shall reduce the student’s total income by an amount by which—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID4AD27E8B5BAC47F3AF6F24D8079C9D46"><enum>(i)</enum><text display-inline="yes-display-inline">the adjusted gross income plus untaxed

				income and benefits for the preceding tax year minus excludable income (as

				defined in subsection (e)), exceeds</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDF96674E0624843E288974377F66158B4"><enum>(ii)</enum><text display-inline="yes-display-inline">the projected gross income plus untaxed

				income and benefits for the current tax year minus the projected excludable

				income (as defined in subsection (e)).</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1119DE9947A44269AF3C5339AD77B580"><enum>(B)</enum><header>Anti-fraud

				procedures</header><text display-inline="yes-display-inline">The Secretary

				shall establish procedures to ensure that computations made pursuant to

				subparagraph (A) are not fraudulent.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCCCAE4E165F0496F9358DCE8433E8E4D"><enum>(C)</enum><header>Extended

				benefit period</header><text display-inline="yes-display-inline">For purposes

				of subparagraph (A), a State shall be considered to be in an extended benefit

				period if—</text>

							<clause commented="no" display-inline="no-display-inline" id="id9514D9677775410B81AC8B2BB348FFDE"><enum>(i)</enum><text display-inline="yes-display-inline">such a period is then in effect for such

				State under the Federal-State Extended Unemployment Compensation Act of 1970;

				or</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="id4B80247BE6FA4624A2217AFBE88C3ABD"><enum>(ii)</enum><text display-inline="yes-display-inline">such a period would then be in effect for

				such State under such Act if section 203(d) of such Act were applied as if it

				had been amended by striking <quote>5</quote> each place it appears and

				inserting

				<quote>4</quote>.</text>
