		  Act to phase out the 24-month waiting period for disabled individuals to become

		  eligible for medicare benefits, to eliminate the waiting period for individuals

			 period for medicare disability benefits</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID86F837F7489B4F7797FCCFFC8AC9B270"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 226(b) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 426(b))

			 is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID9F7563E2F9A542559F257E491924C849"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking <quote>,

			 and has for 24 calendar months been entitled to,</quote> and inserting <quote>,

			 and for the waiting period (as defined in subsection (k)) has been entitled

			 to,</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID000DFCF6C566473DA79CD216C8DCC44B"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)(B), by striking <quote>,

			 and has been for not less than 24 months,</quote> and inserting <quote>, and

			 has been for the waiting period (as defined in subsection (k)),</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEE5DAEB76A4D44CAAF17F77520BDC753"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (2)(C)(ii), by striking

			 <quote>, including the requirement that he has been entitled to the specified

			 requirement that the individual has been entitled to the specified benefits for

			 the waiting period (as defined in subsection (k)),</quote>; and</text>

			 <quote>for each month beginning with the later of (I) July 1973 or (II) the

			 twenty-fifth month of his entitlement or status as a qualified railroad

			 retirement beneficiary described in paragraph (2), and</quote> and inserting

			 <quote>for each month beginning after the waiting period (as so defined) for

			 which the individual satisfies paragraph (2) and</quote>;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID915C038B97BC4A97B1C4DE099C85AD93"><enum>(B)</enum><text display-inline="yes-display-inline">in the second sentence, by striking

			 <quote>the <quote>twenty-fifth month of his entitlement</quote> refers to the

			 first month after the twenty-fourth month of entitlement to specified benefits

			 referred to in paragraph (2)(C) and</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFF428ECEA3424248847C6AA0A58C6597"><enum>(C)</enum><text display-inline="yes-display-inline">in the third sentence, by striking <quote>,

			 but not in excess of 78 such months</quote>.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5DC804568C6A4CF290C91CD05A0ED8F3"><enum>(b)</enum><header>Schedule for

			 phase-out of waiting period</header><text display-inline="yes-display-inline">Section 226 of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 426) is

			 amended by adding at the end the following new subsection:</text>

				<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="IDAD2BCE5F226246F9BA19F9BE2AE3EE14" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="ID6A7D2481F09741C7BFE995D6EE193880"><enum>(k)</enum><text display-inline="yes-display-inline">For purposes of subsection (b) (and for

				purposes of section 1837(g)(1) of this Act and section 7(d)(2)(ii) of the

				Railroad Retirement Act of 1974), the term <term>waiting period</term>

				means—</text>

						<paragraph commented="no" display-inline="no-display-inline" id="IDA817CE95412E41FE93EC3DB9045339F1"><enum>(1)</enum><text display-inline="yes-display-inline">for 2006, 18 months;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID960D438AE0064183A7F0E140C18926CA"><enum>(2)</enum><text display-inline="yes-display-inline">for 2007, 16 months;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42554D32F3364DE39E5B85C5D5823EE7"><enum>(3)</enum><text display-inline="yes-display-inline">for 2008, 14 months;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID86251EC3A98F44C58CC388245D1D65E2"><enum>(4)</enum><text display-inline="yes-display-inline">for 2009, 12 months;</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID085926C5699B431EB364F7B7DC7538BD"><enum>(5)</enum><text display-inline="yes-display-inline">for 2010, 10 months;</text>

			 amendments</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDADF5154608944172A138B6D5FD6EFBE0"><enum>(1)</enum><header>Sunset</header><text display-inline="yes-display-inline">Effective January 1, 2015, subsection (f)

			 of section 226 of the <act-name parsable-cite="SSA">Social Security

			 Act</act-name> (42 U.S.C. 426) is repealed.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1E570BC6190B47AFBA524FDCFFC144B2"><enum>(2)</enum><header>Medicare

			 description</header><text display-inline="yes-display-inline">Section 1811(2)

			 of such Act (42 U.S.C. 1395c(2)) is amended by striking <quote>entitled for not

			 less than 24 months</quote> and inserting <quote>entitled for the waiting

			 period (as defined in section 226(k))</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAA3DAE632345404084B9A050FF27FA85"><enum>(3)</enum><header>Medicare

			 coverage</header><text display-inline="yes-display-inline">Section 1837(g)(1)

			 of such Act (42 U.S.C. 1395p(g)(1)) is amended by striking <quote>of the later

			 of (A) April 1973 or (B) the third month before the 25th month of such

			 entitlement</quote> and inserting <quote>of the third month before the first

			 month following the waiting period (as defined in section 226(k)) applicable

			 under section 226(b)</quote>.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3016FB07209A49DFA83E900B4754E24C"><enum>(4)</enum><header>Railroad

			 retirement system</header><text display-inline="yes-display-inline">Section

			 7(d)(2)(ii) of the Railroad Retirement Act of 1974 (45 U.S.C. 231f(d)(2)(ii))

			 is amended—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID14DC778FCA1D48FEAA78A09DA1FFE7F9"><enum>(A)</enum><text display-inline="yes-display-inline">by striking “, for not less than 24 months”

			 and inserting “, for the waiting period (as defined in section 226(k) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name>); and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8636BA3CBF66421A8F3152F2291B337A"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>could have been entitled

			 for 24 calendar months, and</quote> and inserting <quote>could have been

			 entitled for the waiting period (as defined is section 226(k) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name>),

			 and</quote>.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6A2AE1931BF8401A88CEC00E8FFE15F8"><enum>(d)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">Except as provided in

			 subsection (c)(1), the amendments made by this section shall apply to insurance

			 benefits under title XVIII of the <act-name parsable-cite="SSA">Social Security

			 Act</act-name> with respect to items and services furnished in months beginning

			 at least 90 days after the date of the enactment of this Act (but in no case

			 earlier than January 1, 2006).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID570F0383EACC4D288AD4349201CCBB43" section-type="subsequent-section"><enum>3.</enum><header>Elimination of waiting

			 period for individuals with life-threatening conditions</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID1283E4B53DBE4FBCAADA78C09BAAC1CE"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 226(h) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 426(h))

			 is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID47C5065C9F8D4BDEA9038C22A020D790"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1), (2), and

			 (3) as subparagraphs (A), (B), and (C), respectively;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID36EA2F5897CD40D18C3792B2BB15F200"><enum>(2)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A)

			 (as redesignated by paragraph (1)), by inserting <quote>(1)</quote> after

			 <quote>(h)</quote>;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA9542AB88B1946C4AD94F8D6D177A6B6"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (1) (as designated by

			 paragraph (2))—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDABB25B8810F44B50A0A3B194836BC200"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A)

			 (as redesignated by paragraph (1)), by inserting <quote>or any other

			 life-threatening condition identified by the Secretary</quote> after

			 <quote>amyotrophic lateral sclerosis (ALS)</quote>; and</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEE802B13F77F4F8DB6D880B3A509FFE2"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (B) (as redesignated by

			 paragraph (1)), by striking <quote>(rather than twenty-fifth month)</quote>;

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6945544626A2475AA153B789D3E20117"><enum>(5)</enum><text display-inline="yes-display-inline">by adding at the end the following new

			 paragraph:</text>

					<quoted-block display-inline="no-display-inline" id="ID2479F5878C674F6DA30CE7A13C1E0F01" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID940C2AF08E824B3B956D899E2231EBAD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of identifying

				life-threatening conditions under paragraph (1), the Secretary shall compile a

				list of conditions that are fatal without medical treatment. In compiling such

				list, the Secretary shall consult with the Director of the National Institutes

				of Health (including the Office of Rare Diseases), the Director of the Centers

				for Disease Control and Prevention, the Director of the National Science

				Foundation, and the Institute of Medicine of the National Academy of

				Sciences.</text>

						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9274E1B65B0446BBA91628AC57592902"><enum>(b)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendments made by

			 this section shall apply to insurance benefits under title XVIII of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> with respect to

			 items and services furnished in months beginning at least 90 days after the

			 date of the enactment of this Act (but in no case earlier than January 1,

			 2006).</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID639C056A4DB24A58B6112E4449AE7670" section-type="subsequent-section"><enum>4.</enum><header>Institute of Medicine

			 study and report on delay and prevention of disability conditions</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDDDAEF3FF6C984AD9A7853C0D22D566B2"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services

			 (in this section referred to as the <quote>Secretary</quote>) shall request

			 that the Institute of Medicine of the National Academy of Sciences conduct a

			 study on the range of disability conditions that can be delayed or prevented if

			 individuals receive access to health care services and coverage before the

			 condition reaches disability levels.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4490C6D16BC847D1B30E1A68E72880BC"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than the date that is 2 years

			 after the date of enactment of this Act, the Secretary shall submit to Congress

			 a report containing the results of the Institute of Medicine study authorized

			 under this section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID86711C1AF80F4933A68922F7E24B0C2D"><enum>(c)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There is

			 authorized to be appropriated to carry out this section $750,000 for the period

			 of fiscal years 2006 and 2007.</text>
