		<official-title display="yes">To authorize the acquisition of interests

		  in undeveloped coastal areas in order better to ensure their protection from

		  development.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">

		<section commented="no" display-inline="no-display-inline" id="IDA6A6B7A67F5B46CE83EBBFECCF722978" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Coastal and Estuarine Land Protection

			 Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID98E840768B0749D5B462ABED37FE0028" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="IDCF9C0C9F58C343BD9BC6571E18B20056"><enum>(1)</enum><text display-inline="yes-display-inline">Coastal and estuarine areas provide

			 important nursery habitat for two-thirds of the nation’s commercial fish and

			 shellfish, provide nesting and foraging habitat for coastal birds, harbor

			 significant natural plant communities, and serve to facilitate coastal flood

			 control and pollutant filtration.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCA9102693CA643AE9958BCBA74B966DF"><enum>(2)</enum><text display-inline="yes-display-inline">The <act-name parsable-cite="CAMA72">Coastal Zone Management Act of 1972</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C.

			 1451</external-xref> et seq.) recognizes the national importance of these areas

			 and their ecological vulnerability to anthropogenic activities by establishing

			 a comprehensive Federal-State partnership for protecting natural reserves and

			 managing growth in these areas.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID405D59E235E14BD781080089B64BFA1D"><enum>(3)</enum><text display-inline="yes-display-inline">The National Estuarine Research Reserve

			 system established under that Act relies on the protection of pristine

			 designated areas for long-term protection and for the conduct of education and

			 research critical to the protection and conservation of coastal and estuarine

			 resources.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6D07873D824C427D8C97DF28BA4FF0BB"><enum>(4)</enum><text display-inline="yes-display-inline">Intense development pressures within the

			 coastal zone are driving the need to provide coastal managers with a wider

			 range of tools to protect and conserve important coastal and estuarine

			 areas.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID580FE7288F574C5F817ECFA900CC5FF6"><enum>(5)</enum><text display-inline="yes-display-inline">Protection of undeveloped coastal lands

			 through the acquisition of interests in property from a willing seller are a

			 cost-effective means of providing these areas with permanent protection from

			 development.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFEBAACFB800043EB89C4BE05306DC6AA"><enum>(6)</enum><text display-inline="yes-display-inline">Permanent protection of lands in the

			 coastal zone is a necessary component of any program to maintain and enhance

			 coastal and estuarine areas for the benefit of the Nation, including protection

			 of water quality, access to public beachfront, conserving wildlife habitat, and

			 sustaining sport and commercial fisheries.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9EB65AF7C17E4F809548147B84C5D4A8"><enum>(7)</enum><text display-inline="yes-display-inline">Federal-State-nongovernmental organization

			 pilot land acquisition projects have already substantially contributed to the

			 long-term health and viability of coastal and estuarine systems.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF4DE9F99CA6F42ACB3E8B8ABCAFC9FD7"><enum>(8)</enum><text display-inline="yes-display-inline">Enhanced protection of estuarine and

			 coastal areas can be attained through watershed-based acquisition strategies

			 coordinated through Federal, State, regional, and local efforts.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID3140C1628995440180FEAC2E04939CCD" section-type="subsequent-section"><enum>3.</enum><header>Establishment of

			 Coastal and Estuarine Land Protection Program</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID6349019D137C47C798944C1B45F700E6"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary of

			 Commerce shall establish a Coastal and Estuarine Land Protection Program, in

			 cooperation with appropriate State, regional, and other units of government for

			 the purposes of protecting the environmental integrity of important coastal and

			 estuarine areas, including wetlands and forests, that have significant

			 conservation, recreation, ecological, historical, or aesthetic values, and that

			 are threatened by conversion from their natural, undeveloped, or recreational

			 state to other uses. The program shall be administered by the National Ocean

			 Service of the National Oceanic and Atmospheric Administration through the

			 Office of Ocean and Coastal Resource Management.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5A511DF7AD994124B3B5BCD2C6FA7531"><enum>(b)</enum><header>Property

			 acquisition grants</header><text display-inline="yes-display-inline">The

			 Secretary shall make grants under the program to coastal States, except coastal

			 States that have lost less than 1 percent of their wetlands to development or

			 conversion to other land uses by the date of enactment of this Act, with

			 approved coastal zone management plans or National Estuarine Research Reserve

			 units for the purpose of acquiring property or interests in property described

			 in subsection (a) that will further the goals of—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID97B0F9BABE1542A8A71D26D89F661C69"><enum>(1)</enum><text display-inline="yes-display-inline">a Coastal Zone Management Plan or Program

			 approved under the <act-name parsable-cite="CAMA72">Coastal Zone Management Act

			 of 1972</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1451">16 U.S.C. 1451</external-xref> et seq.); or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6585BC8B736744D700351B566E05FD06"><enum>(2)</enum><text display-inline="yes-display-inline">a National Estuarine Research Reserve

			 management plan; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7CFA3C1E0EDC4EC7BFC961D38F075ED7"><enum>(3)</enum><text display-inline="yes-display-inline">a regional or State watershed protection

			 plan involving coastal States with approved coastal zone management

			 plans.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID07AFD2A6C31B49A795009307B1663E69"><enum>(c)</enum><header>Grant

			 process</header><text display-inline="yes-display-inline">The Secretary shall

			 allocate funds to coastal States or National Estuarine Research Reserves under

			 this section through a competitive grant process in accordance with guidelines

			 that meet the following requirements:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID34C41D3B8C3C4F4FA2A773CEE0E4C015"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall consult with the

			 State’s coastal zone management program, any National Estuarine Research

			 Reserve in that State, and the lead agency designated by the Governor for

			 coordinating the establishment and implementation of this Act (if different

			 from the coastal zone management program).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD2C3FCD0A5DF4F80A4A6D95EF1B8878E"><enum>(2)</enum><text display-inline="yes-display-inline">Each participating State shall identify

			 priority conservation needs within the State, the values to be protected by

			 inclusion of lands of the program, and the threats to those values that should

			 be avoided.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBBC9C58E1F8B4EBE98E066005B00B185"><enum>(3)</enum><text display-inline="yes-display-inline">Each participating State shall evaluate how

			 the acquisition of property or easements might impact working waterfront

			 needs.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID551166C78E4B4D3AA21FFB0064B08996"><enum>(4)</enum><text display-inline="yes-display-inline">The applicant shall identify the values to

			 be protected by inclusion of the lands in the program, management activities

			 that are planned and the manner in which they may affect the values identified,

			 and any other information from the landowner relevant to administration and

			 management of the land.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA955449695204A5E8025808D2DFF10F8"><enum>(5)</enum><text display-inline="yes-display-inline">Awards shall be based on demonstrated need

			 for protection and ability to successfully leverage funds among participating

			 entities, including Federal programs, regional organizations, State and other

			 governmental units, landowners, corporations, or private organizations.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID267C015FEA1D4C2DB03F9E3BE5DAB188"><enum>(6)</enum><text display-inline="yes-display-inline">Applications must be determined to be

			 consistent with the State’s or territory’s approved coastal zone plan, program

			 and policies prior to submittal to the Secretary.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7D660AE43AA34798B46E08F66677A6A3"><enum>(7)</enum><text display-inline="yes-display-inline">Priority shall be given to lands described

			 in subsection (a) that can be effectively managed and protected and that have

			 significant ecological or watershed protection value.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID873E16A582154986A2A520C6E9EDDB3D"><enum>(8)</enum><text display-inline="yes-display-inline">In developing guidelines under this

			 section, the Secretary shall consult with other Federal agencies and

			 non-governmental entities expert in land acquisition and conservation

			 procedures.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1A7F9E28E51148A79ED35C6B451F7B34"><enum>(9)</enum><text display-inline="yes-display-inline">Eligible States or National Estuarine

			 Research Reserves may allocate grants to local governments or agencies eligible

			 for assistance under

			 <external-xref legal-doc="act" parsable-cite="CAMA72/306A(e)">section

			 306A(e)</external-xref> of the <act-name parsable-cite="CAMA72">Coastal Zone

			 Management Act of 1972</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1455a">16 U.S.C. 1455a</external-xref>)

			 and may acquire lands in cooperation with nongovernmental entities and Federal

			 agencies.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC51B79D07A3F4F5500A58690A5D5A44C"><enum>(10)</enum><text display-inline="yes-display-inline">The Secretary shall develop performance

			 measures that will allow periodic evaluation of the program’s effectiveness in

			 meeting the purposes of this section and such evaluation shall be reported to

			 Congress.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDF065D67C7D934CDAB3C00085D4888309"><enum>(d)</enum><header>Matching

			 requirements</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID23331680A9C14D0ABAD6ACA35243D0D9"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary may not

			 make a grant under the program unless the Federal funds are matched by

			 non-Federal funds in accordance with this subsection.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6086695454094C44BAF1BCF230C463C0"><enum>(2)</enum><header>Maximum Federal

			 share</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID704D63A1413949B0BEA9C5DB35E78F41"><enum>(A)</enum><header>75 percent

			 Federal funds</header><text display-inline="yes-display-inline">No more than 75

			 percent of the funding for any grant under this section shall be derived from

			 Federal sources, unless such requirement is specifically waived by the

			 Secretary.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID122B58AB12C548830016D138CFAE73A3"><enum>(B)</enum><header>Waiver of

			 requirement</header><text display-inline="yes-display-inline">The Secretary may

			 grant a waiver of the limitation in subparagraph (A) for underserved

			 communities, communities that have an inability to draw on other sources of

			 funding because of the small population or low income of the community, or for

			 other reasons the Secretary deems appropriate.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID95B250678E7E42DCBC2664022C552C41"><enum>(3)</enum><header>Other Federal

			 funds</header><text display-inline="yes-display-inline">Where financial

			 assistance awarded under this section represents only a portion of the total

			 cost of a project, funding from other Federal sources may be applied to the

			 cost of the project. Each portion shall be subject to match requirements under

			 the applicable provision of law.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6E441A1994344C759885BC8065D59835"><enum>(4)</enum><header>Source of

			 matching cost share</header><text display-inline="yes-display-inline">For

			 purposes of paragraph (2)(A), the non-Federal cost share for a project may be

			 determined by taking into account the following:</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID7EA9ABC3F0144AB1AB86D6D0BB7E1431"><enum>(A)</enum><text display-inline="yes-display-inline">Land value may be used as non-Federal match

			 if the lands are identified in project plans and acquired within three years

			 prior to the submission of the project application or after the submission of a

			 project application until the project grant is closed (not to exceed 3 years).

			 The appraised value of the land at the time of project closing will be

			 considered the non-Federal cost share.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID857A950F89EB4094B2E6824DEB790000"><enum>(B)</enum><text display-inline="yes-display-inline">Costs associated with land acquisition,

			 land management planning, remediation, restoration, and enhancement may be used

			 as non-Federal match if the activities are identified in the plan and expenses

			 are incurred within the period of the grant award. These costs may include

			 either case or in-kind contributions.</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7DC06DC176864EB681A6259B3EB74BBE"><enum>(e)</enum><header>Regional

			 watershed demonstration project</header><text display-inline="yes-display-inline">The Secretary may provide up to $5,000,000

			 for a regional watershed protection demonstration project that will meet the

			 requirements of this section, and—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID48F3F6FCEC70436DBF00BBF9DFBEFFDD"><enum>(1)</enum><text display-inline="yes-display-inline">leverages land acquisition funding from

			 other Federal land conservation or acquisition programs such that other Federal

			 contributions, at a minimum, equal the amounts provided by the

			 Secretary;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB9F53F1B1B9E403CBDA6212B14793008"><enum>(2)</enum><text display-inline="yes-display-inline">involves partnerships from a broad spectrum

			 of Federal, State, and non-governmental entities;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID89CA18A976E4462F966C7FD5C48876EF"><enum>(3)</enum><text display-inline="yes-display-inline">provides for the creation of conservation

			 corridors and preservation of unique coastal habitat;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1059660741884EBEA44C3400691D3BB5"><enum>(4)</enum><text display-inline="yes-display-inline">protects largely unfragmented habitat under

			 imminent threat of development or conversion;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1FD980E3478042F2BB04DA4ED71B2924"><enum>(5)</enum><text display-inline="yes-display-inline">provides water quality protection for areas

			 set aside for research under the National Estuarine Research Reserve program;

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID22C00983731043DD87D2E3E0FABD1BEF"><enum>(6)</enum><text display-inline="yes-display-inline">provides a model for future regional

			 watershed protection projects.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID557F572E2C314EB0932162002C7E5297"><enum>(f)</enum><header>Reservation of

			 funds for National Estuarine Research Reserve sites</header><text display-inline="yes-display-inline">No less than 15 percent of funds made

			 available under this section shall be available for acquisitions benefiting

			 National Estuarine Research Reserve acquisitions.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID11DCBF4C0B3B4A03AF2C17A24F8D6516"><enum>(g)</enum><header>Limit on

			 administrative costs</header><text display-inline="yes-display-inline">No more

			 than 5 percent of the funds made available to the Secretary under this section

			 shall be used by the Secretary for planning or administration of the program.

			 The Secretary shall provide a report to Congress with an account of all

			 expenditures under this section for fiscal year 2006, fiscal year 2007, and

			 triennially thereafter.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4561B5C979754E2E9C6D53939C3E9038"><enum>(h)</enum><header>Title and

			 management of acquired property</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID9F4A0FF5D2B4497EA734C1D502CE001F"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">If any property is

			 acquired in whole or in part with funds made available through a grant under

			 this section, the grant recipient shall provide such assurances as the

			 Secretary may require that—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="ID1C0FDBCD928243EAA7C187C7F5D859BE"><enum>(A)</enum><text display-inline="yes-display-inline">the title to the property will be held by

			 the grant recipient or other appropriate public agency designated by the

			 recipient in perpetuity;</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4B8964A128CB430592B69CFCB9CE53FF"><enum>(B)</enum><text display-inline="yes-display-inline">the property will be managed in a manner

			 that is consistent with the purposes for which the land entered into the

			 program and shall not convert such property to other uses; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID335E211C4B764C798878FE24E7D64F15"><enum>(C)</enum><text display-inline="yes-display-inline">if the property or interest in land is

			 sold, exchanged, or divested, funds equal to the correct value will be returned

			 to the Secretary, for re-distribution in the grant process.</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD4C4312D0724703AD876050A7E26358"><enum>(2)</enum><header>Conservation

			 easement</header><text display-inline="yes-display-inline">In this subsection,

			 the term <term>conservation easement</term> includes an easement, recorded

			 deed, or interest deed where the grantee acquires all rights, title, and

			 interest in a property, that do not conflict with the goals of this Act except

			 those rights, title, and interests that may run with the land that are

			 expressly reserved by a grantor and are agreed to at the time of

			 purchase.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7B41D2741EA649F590F4F849D300936B"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the term <term>coastal

			 State</term> has the meaning given that term by

			 <external-xref legal-doc="act" parsable-cite="CAMA72/304(4)">section

			 304(4)</external-xref> of the <act-name parsable-cite="CAMA72">Coastal Zone

			 Management Act of 1972</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1453(4)">16 U.S.C.

			 1453(4)</external-xref>), and any other term used in this section that is

			 defined in section 304 of that Act has the meaning given that term in that

			 section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID85BF88EDC1C7468597A8374872D01EB4"><enum>(j)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated to the Secretary—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDEC30569335B847FBAEB9F36123DB0894"><enum>(1)</enum><text display-inline="yes-display-inline">such sums as may be necessary for each of

			 fiscal years 2006 through 2009 to carry out this section (other than subsection

			 (e)); and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID74BE97CC23994913B927FCF888EF5124"><enum>(2)</enum><text display-inline="yes-display-inline">$5,000,000 for fiscal year 2006 to carry

			 out subsection (e), such sum to remain available without fiscal year

			 limitation.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDEE296249572747879125BEDC90830026" section-type="subsequent-section"><enum>4.</enum><header>Assistance from other

			 agencies</header><text display-inline="no-display-inline">Section 310(a) of the

			 <act-name parsable-cite="CAMA72">Coastal Zone Management Act of 1972</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/16/1456c(a)">16 U.S.C.

			 1456c(a)</external-xref>) is amended by striking <quote>any qualified person

			 for the purposes of carrying out this subsection.</quote> and inserting

			 <quote>any other Federal agencies (including interagency financing of Coastal

			 America activities) and any other qualified person for the purposes of carrying

			 out this section.</quote>.</text>
