			<paragraph commented="no" display-inline="no-display-inline" id="ID1fc03a6314fd4adca2840c10d646b3c5"><enum>(1)</enum><text display-inline="yes-display-inline">the Governors’ Ethanol Coalition, in the

			 report entitled <quote>Ethanol From Biomass America’s 21st Century

			 Transportation Fuel</quote>, found that—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="ID9e7aba139c80489eb6ebdb9ac2827b33"><enum>(A)</enum><text display-inline="yes-display-inline">the dependence of the United States on oil

			 is a major risk to national security and economic and environmental

			 health;</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID76f1ed7707084533943983c6ef86b61a"><enum>(B)</enum><text display-inline="yes-display-inline">the safest and least costly approach to

			 mitigating these risks is to set and achieve aggressive biofuels research,

			 development, production and use goals; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdf498d07dd7b47d1bd083889089ba10f"><enum>(C)</enum><text display-inline="yes-display-inline">significant investment in cellulosic

			 biofuels, including a dramatic expansion of existing research programs,

			 production and consumer incentives, and commercialization assistance, is

			 needed;</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa98837519dd54846b840f37907c387fe"><enum>(2)</enum><text display-inline="yes-display-inline">the National Academy of Sciences has found

			 that there are abundant sources of waste biomass, and approximately 280,000,000

			 tons of waste biomass generated, in all regions of the United States each

			 year;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26a6c254c98448eb8c7468c87f44e1a5"><enum>(3)</enum><text display-inline="yes-display-inline">the Natural Resources Defense Council has

			 estimated that by 2025, 200,000,000 additional tons of biomass could be

			 harvested each year from dedicated energy crops grown throughout the country,

			 yielding $5,000,000,000 annually in profit for farmers;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf313311e5fe04d03b5ef54a5ea29b68b"><enum>(4)</enum><text display-inline="yes-display-inline">the Department of Agriculture has estimated

			 that energy derived from existing biomass supplies could displace 25 percent of

			 current petroleum imports while still meeting agricultural demands;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID84272cb32d554082aca1892298783ec9"><enum>(5)</enum><text display-inline="yes-display-inline">if all diesel fuel in the United States

			 were blended with a 4-percent blend of biodiesel, crude oil consumption in the

			 United States would be reduced by 300,000,000 barrels each year by 2016;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc8905b1bc2ca41b4933b0b46d9e471e4"><enum>(6)</enum><text display-inline="yes-display-inline">there is sufficient domestic feedstock for

			 the production of at least 8,000,000,000 annual gallons of renewable fuels,

			 including ethanol and biodiesel, by 2012;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb0767abbe7f04f9095b0f75a41d04100"><enum>(7)</enum><text display-inline="yes-display-inline">the Natural Resources Defense Council has

			 estimated that biomass could supply 50 percent of current transportation

			 petroleum demand by 2050;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47963a50ae054ac19096a300f02889d4"><enum>(8)</enum><text display-inline="yes-display-inline">the National Academy of Sciences has

			 estimated that enough agricultural crop residue is produced each year to

			 entirely replace the 700,000,000 barrels of petroleum used in organic chemical

			 production in 2004;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfa72e907192d4e7f86905d91be4902aa"><enum>(9)</enum><text display-inline="yes-display-inline">the Biotechnology Industry Organization, in

			 its report entitled <quote>New Biotechnology Tools for a Cleaner

			 Environment</quote>, found that if all plastics in the United States were made

			 from biomass, oil consumption would decrease by up to 145,000,000 barrels per

			 year;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3e2b197e8c1546ddb0d064ad5de789d5"><enum>(10)</enum><text display-inline="yes-display-inline">the National Academy of Sciences has

			 reported that biobased products have the potential to improve the

			 sustainability of natural resources, environmental quality, and national

			 security while competing economically;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6be4a8ab862d4693a687064a9be9b4e0"><enum>(11)</enum><text display-inline="yes-display-inline">the Department of Agriculture has made

			 significant advances in the understanding and use by the United States of

			 biomass as a feedstock for fuels and products;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46BDA40F8B8B462F9F40BE1727875383"><enum>(12)</enum><text display-inline="yes-display-inline">through participation with the Department

			 of Energy in the Biomass Research and Development Initiative, the Department of

			 Agriculture has also made valuable contributions, through grant-making and

			 other initiatives, to the support of biomass research and development at

			 institutions throughout the United States;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID568b3f66e6f24ee18e362eed977b7018"><enum>(13)</enum><text display-inline="yes-display-inline">the Government Accountability Office has

			 found that—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="IDc8d2e1f3687e465b871ba0dc06fef333"><enum>(A)</enum><text display-inline="yes-display-inline">actions to implement the requirements of

			 the Farm Security and Rural Investment Act of 2002 (Public Law 107–171; 116

			 Stat. 134) for purchasing biobased products have been limited; and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7ec35d99631a453497699e5e2399c25a"><enum>(B)</enum><text display-inline="yes-display-inline">greater priority by the Department of

			 Agriculture would promote compliance by other agencies with biobased purchasing

			 requirements;</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7804a170860a4d76a3549b582c7bb303"><enum>(14)</enum><text display-inline="yes-display-inline">an Assistant Secretary of the Department of

			 Agriculture for Energy and Biobased Products would provide the priority, staff,

			 and financial resources to fully implement biobased purchasing requirements and

			 other provisions of the energy title of the Farm Security and Rural Investment

			 Act of 2002;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID830b27f6f83149b884ebece92e7fcab1"><enum>(15)</enum><text display-inline="yes-display-inline">Federal Government contractors and the

			 Architect of the Capitol are currently exempt from biobased purchasing

			 requirements of the Farm Security and Rural Investment Act of 2002;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3621daa6d0a14ef780a5b11785908357"><enum>(16)</enum><text display-inline="yes-display-inline">expansion of those biobased purchasing

			 requirements—</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="ID62fdae9562d0443c8899409e58384bf7"><enum>(A)</enum><text display-inline="yes-display-inline">to Federal contractors would significantly

			 expand the market for, and advance commercialization of, biobased products;

			 and</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID97bd3c5ab7f744ccb863d72fe87a7768"><enum>(B)</enum><text display-inline="yes-display-inline">to the Architect of the Capitol would, in

			 combination with a program of public education, allow the Capitol Complex to

			 serve as a showcase for the existence, use, and benefits of biobased

			 products;</text>

				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID885265ca38554196afb22d52d8756cd2"><enum>(17)</enum><text display-inline="yes-display-inline">fuel derived from cellulosic biomass could

			 have near-zero net carbon dioxide and sulfur emissions, and substantially

			 reduced carbon monoxide, particulate and toxic emissions relative to

			 petroleum-based fuels;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe8813a4008004b91add06efb54577ed7"><enum>(18)</enum><text display-inline="yes-display-inline">the bipartisan National Commission on

			 Energy Policy has predicted that with a dedicated Federal research,

			 development, and demonstration effort, cellulosic ethanol could be less

			 expensive to produce than gasoline by 2015;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe14d5398ca5e411680c4dee0479a91d8"><enum>(19)</enum><text display-inline="yes-display-inline">the 2004 report of the Rocky Mountain

			 Institute, entitled <quote>Winning the Oil Endgame</quote>, estimated that a

			 mature biomass industry would create up to 1,045,000 jobs;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID61c84fabe8844d8084cd4bf8dfe8c1ae"><enum>(20)</enum><text display-inline="yes-display-inline">the National Academy of Sciences has found

			 that there are significant opportunities to produce biomass ethanol more

			 efficiently;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID61461786a5814c84bf9a6e9ed2f7cc24"><enum>(21)</enum><text display-inline="yes-display-inline">the National Commission on Energy Policy

			 has found that current Federal programs directed toward reducing the cost of

			 biofuels are under-funded, intermittent, scattered, and poorly targeted;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe8a1b13de052438c88751dc35a4bb9f6"><enum>(22)</enum><text display-inline="yes-display-inline">a report commissioned by the Department of

			 Defense urged the United States to invest in a new large-scale initiative to

			 produce biofuels as an alternative supply source, and as a feedstock for future

			 fuel vehicles;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1BC1119D537042738D57A5A09E3E0ED8"><enum>(23)</enum><text display-inline="yes-display-inline">the Consumer Federation of America has

			 found that the blending of ethanol into conventional gasoline can significantly

			 benefit consumers by lowering prices at the pump;</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf4323ba5dc024d1f9b42e72c00574350"><enum>(24)</enum><text display-inline="yes-display-inline">45 leading national security, labor, and

			 energy policy experts joined the Energy Future Coalition in supporting a

			 national commitment to cut the oil use of the United States by 25 percent by

			 2025 through the rapid development and deployment of advanced biomass, alcohol,

			 and other available petroleum fuel alternatives; and</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8875631d3b794bfbb067a0db9ba84fe6"><enum>(25)</enum><text display-inline="yes-display-inline">an aggressive effort to advance technology

			 for conversion of biomass to fuel and products is warranted.</text>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id76FBE22E8B2B4152A4B40CB2B00EAF24" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="id3B578E8C156E4572AFE0EB2BAC379915"><enum>(1)</enum><header>Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the

			 Department of Agriculture.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3878FFEECAAC484B8C15BD9D21236B57"><enum>(2)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the

			 Development Act of 2000 (Public Law 106–224; 7 U.S.C. 8101 note) is

			 amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="idDB2E5D1C889B4BC48D8E8D2BC73FB053"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraphs (2), (3), and

			 (9);</text>

				<term>biobased product</term> means a commercial or industrial product

				(including chemicals, materials, polymers, and animal feed) produced from

				biomass, or electric power derived in connection with the conversion of biomass

				to fuel.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0648bf8097a9417ea68ce194c5b0fcf3"><enum>(4)</enum><header>Biomass</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="idBA4BD034052C4C7E9EE1F254C831797D"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The term

				<term>biomass</term> means—</text>

								<clause commented="no" display-inline="no-display-inline" id="IDb1a7d2b3e5034c5ca3fea18d78bb66cf"><enum>(i)</enum><text display-inline="yes-display-inline">organic material from a plant, including

				grasses and trees, that is planted for the purpose of being used to produce

				energy, including vegetation produced for harvest on land enrolled in the

				conservation reserve program established under subchapter B of chapter 1 of

				subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3831">16 U.S.C. 3831</external-xref> et

				seq.) if the harvest is consistent with the integrity of soil and water

				resources and with other environmental purposes of the conservation reserve

				program;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID15f20527525c495fb9a3b0e6d2bc05d2"><enum>(ii)</enum><text display-inline="yes-display-inline">nonhazardous, lignocellulosic, or

				hemicellulosic matter derived from—</text>

				resources:</text>

				agricultural crop residue, including vegetation produced for harvest on land

				enrolled in the conservation reserve program established under subchapter B of

				chapter 1 of subtitle D of title XII of the Food Security Act of 1985

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDad093e22a359413981941c1279ef3f14"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>biomass</term> does not

				include—</text>

								<clause commented="no" display-inline="no-display-inline" id="ID483760afc771495ca1042ce452a66845"><enum>(i)</enum><text display-inline="yes-display-inline">unsegregated municipal solid waste;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idDFD5510F47F843B1A3724E108C5CF674"><enum>(ii)</enum><text display-inline="yes-display-inline">incineration of municipal solid

				waste;</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="ID86015f65c81c443bacfc1ffad6dc9900"><enum>(iii)</enum><text display-inline="yes-display-inline">recyclable post-consumer waste paper and

				paper products;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe6a6a53e67884534a344b6c288246c48"><enum>(2)</enum><header>Energy</header><text display-inline="yes-display-inline">The Secretary of Energy, though the point

				of contact of the Department of Energy and in consultation with the Board,

				shall provide, or enter into, grants, contracts, and financial assistance under

				this section through the appropriate agency, as determined by the Secretary of

				Energy.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA346763EF8D54FA18DDCF1EE704BDCB0"><enum>(c)</enum><header>Objectives</header><text display-inline="yes-display-inline">The objectives of the Initiative are to

				develop—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID3b537e3c993e4b58af389dfdccce2708"><enum>(1)</enum><text display-inline="yes-display-inline">technologies and processes necessary for

				abundant commercial production of biobased fuels at prices competitive with

				fossil fuels;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDce267ef4032f4f039fd005c9c0e5118d"><enum>(2)</enum><text display-inline="yes-display-inline">high-value biobased products—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="id619D5430641D4477A9CFB5D08C533EBA"><enum>(A)</enum><text display-inline="yes-display-inline">to enhance the economic viability of

				biobased fuels and power; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9281CAB45AFD4E67B7C723352C9E9BB1"><enum>(B)</enum><text display-inline="yes-display-inline">as substitutes for petroleum-based

				feedstocks and products; and</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID28948ee89bd547efb13a13180d14b166"><enum>(3)</enum><text display-inline="yes-display-inline">a diversity of sustainable domestic sources

				of biomass for conversion to biobased fuels and biobased products.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe593c0e5ac224be4b920eca631ad2bbf"><enum>(d)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the Initiative are—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID8bca7700bc0546b597d3a39dfa8464e7"><enum>(1)</enum><text display-inline="yes-display-inline">to increase the energy security of the

				United States;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ac940ef5ddd4cefb422c80278d7aeec"><enum>(2)</enum><text display-inline="yes-display-inline">to create jobs and enhance the economic

				development of the rural economy;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0a0357a5a49b40bd8cbdbbf41483df37"><enum>(3)</enum><text display-inline="yes-display-inline">to enhance the environment and public

				health; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54b44556649f43bc9cf650f44520b15a"><enum>(4)</enum><text display-inline="yes-display-inline">to diversify markets for raw agricultural

				and forestry products.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID46f5c97cbbe34607a7a826c33edb04b0"><enum>(e)</enum><header>Technical

				areas</header><text display-inline="yes-display-inline">To advance the

				objectives and purposes of the Initiative, the Secretary of Agriculture and the

				Secretary of Energy, in consultation with the Administrator of the

				Environmental Protection Agency and heads of other appropriate departments and

				agencies (referred to in this section as the <term>Secretaries</term>), shall

				direct research and development toward—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID04d3c9409337465a8cf7a28c30d4de7e"><enum>(1)</enum><text display-inline="yes-display-inline">feedstock production through the

				development of crops and cropping systems relevant to production of raw

				materials for conversion to biobased fuels and biobased products,

				including—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDf6aaba53ba7a4149863d16953b02308e"><enum>(A)</enum><text display-inline="yes-display-inline">development of advanced and dedicated crops

				with desired features, including enhanced productivity, broader site range, low

				requirements for chemical inputs, and enhanced processing;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0f7a76c7924c436094ad0dbde4a437cf"><enum>(B)</enum><text display-inline="yes-display-inline">advanced crop production methods to achieve

				the features described in subparagraph (A);</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID32254e71bb8e427cae792d2cbc0aa0bb"><enum>(C)</enum><text display-inline="yes-display-inline">feedstock harvest, handling, transport, and

				storage; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7cfd134ad53945518a089c2b63a111f9"><enum>(D)</enum><text display-inline="yes-display-inline">strategies for integrating feedstock

				production into existing managed land;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67e61e695f744de99603a984561d8be5"><enum>(2)</enum><text display-inline="yes-display-inline">overcoming recalcitrance of cellulosic

				biomass through developing technologies for converting cellulosic biomass into

				intermediates that can subsequently be converted into biobased fuels and

				biobased products, including—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDcc54e1a19cf1466ab658c32e26f6c254"><enum>(A)</enum><text display-inline="yes-display-inline">pretreatment in combination with enzymatic

				or microbial hydrolysis; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3088c06f1d2d4991bd9211967c92b308"><enum>(B)</enum><text display-inline="yes-display-inline">thermochemical approaches, including

				gasification and pyrolysis;</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID924983fe7ae64477ab6aae9a2975261f"><enum>(3)</enum><text display-inline="yes-display-inline">product diversification through

				technologies relevant to production of a range of biobased products (including

				chemicals, animal feeds, and cogenerated power) that eventually can increase

				the feasibility of fuel production in a biorefinery, including—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID552824069cf54038a29e49bc74dde49c"><enum>(A)</enum><text display-inline="yes-display-inline">catalytic processing, including

				thermochemical fuel production;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID435046b8dbb747879bd8157f1a858d92"><enum>(B)</enum><text display-inline="yes-display-inline">metabolic engineering, enzyme engineering,

				and fermentation systems for biological production of desired products or

				cogeneration of power;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID82d13dcdc6724ea3879b53bf51b35622"><enum>(C)</enum><text display-inline="yes-display-inline">product recovery;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3cffd6c7ed494c97b36987c58848f885"><enum>(D)</enum><text display-inline="yes-display-inline">power production technologies; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID36137e9f675b4e2aa505b3dce02c1b71"><enum>(E)</enum><text display-inline="yes-display-inline">integration into existing biomass

				processing facilities, including starch ethanol plants, paper mills, and power

				plants; and</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID62b2de4c67c040a5a7f3ed4a25837984"><enum>(4)</enum><text display-inline="yes-display-inline">analysis that provides strategic guidance

				for the application of biomass technologies in accordance with realization of

				societal benefits in improved sustainability and environmental quality, cost

				effectiveness, security, and rural economic development, usually featuring

				system-wide approaches.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6f78fdd0edf2418d971c5caf03022e11"><enum>(f)</enum><header>Additional

				considerations</header><text display-inline="yes-display-inline">Within the

				technical areas described in subsection (e), and in addition to advancing the

				purposes described in subsection (d) and the objectives described in subsection

				(c), the Secretaries shall support research and development—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="IDc4a659fb8f6f486593c8d61ba74604d7"><enum>(1)</enum><text display-inline="yes-display-inline">to create continuously expanding

				opportunities for participants in existing biofuels production by seeking

				synergies and continuity with current technologies and practices, including the

				use of dried distillers grains as a bridge feedstock;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54c6ed049e0440b998a42f8292d0551e"><enum>(2)</enum><text display-inline="yes-display-inline">to maximize the environmental, economic,

				and social benefits of production of biobased fuels and biobased products on a

				large scale through life-cycle economic and environmental analysis and other

				means; and</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1971b69fb27649b085ebef454efebcc2"><enum>(3)</enum><text display-inline="yes-display-inline">to assess the potential of Federal land and

				land management programs as feedstock resources for biobased fuels and biobased

				products, consistent with the integrity of soil and water resources and with

				other environmental considerations.</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE54285AF36E248268A119DF7C6B57B60"><enum>(g)</enum><header>Eligible

				entities</header><text display-inline="yes-display-inline">To be eligible for a

				grant, contract, or assistance under this section, an applicant shall

				be—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id4F98419258A148BA9DF8D7BADA73F6D4"><enum>(1)</enum><text display-inline="yes-display-inline">an institution of higher education;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id33CA2F0214414925ADABC16F4532DB0C"><enum>(2)</enum><text display-inline="yes-display-inline">a national laboratory;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id026B1BD30477402DBA14DAC971BF24C3"><enum>(3)</enum><text display-inline="yes-display-inline">a Federal research agency;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBAB14C2BD81F4701AAC3E1BD5F3C7FFD"><enum>(4)</enum><text display-inline="yes-display-inline">a State research agency;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id02EFBF496DD04F98A1C842A8247D8CFD"><enum>(5)</enum><text display-inline="yes-display-inline">a private sector entity;</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01A1A663BFD142DC902CA76200091F04"><enum>(6)</enum><text display-inline="yes-display-inline">a nonprofit organization; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2771F0D5D8A94A638D63E2E66E1192F0"><enum>(7)</enum><text display-inline="yes-display-inline">a consortium of 2 of more entities

				described in paragraphs (1) through (6).</text>

							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID96e644116c2c40daa2cbf23f6e4a7e95"><enum>(h)</enum><header>Administration</header>

							<paragraph commented="no" display-inline="no-display-inline" id="ID8990d0d097874be8a55382fd67166175"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">After consultation

				with the Board, the points of contact shall—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="IDb822e38ed52841e29687ab32d4c18b7b"><enum>(A)</enum><text display-inline="yes-display-inline">publish annually 1 or more joint requests

				for proposals for grants, contracts, and assistance under this section;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID77f7521989ff43828f70e6010a0f5dc9"><enum>(B)</enum><text display-inline="yes-display-inline">establish a priority in grants, contracts,

				and assistance under this section for research that advances the objectives,

				purposes, and additional considerations of this title;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID71f5f57879754e40b16d0a3e69d05f19"><enum>(C)</enum><text display-inline="yes-display-inline">require that grants, contracts, and

				assistance under this section be awarded competitively, on the basis of merit,

				after the establishment of procedures that provide for scientific peer review

				by an independent panel of scientific and technical peers; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID07f20250f81f45c988658fe72d850c4e"><enum>(D)</enum><text display-inline="yes-display-inline">give some preference to applications

				that—</text>

									<clause commented="no" display-inline="no-display-inline" id="IDd41cb2a46c334757b7b534ebae3d3299"><enum>(i)</enum><text display-inline="yes-display-inline">involve a consortia of experts from

				multiple institutions;</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="ID8ed2100483a54baeaf610ef50d863e80"><enum>(ii)</enum><text display-inline="yes-display-inline">encourage the integration of disciplines

				and application of the best technical resources; and</text>

									</clause><clause commented="no" display-inline="no-display-inline" id="id0B4E2604D9304B2FA5C99FDA5618FB29"><enum>(iii)</enum><text display-inline="yes-display-inline">increase the geographic diversity of

				demonstration projects.</text>

									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3892a394f25b409fafa84921c85f4716"><enum>(2)</enum><header>Distribution of

				funding by technical area</header><text display-inline="yes-display-inline">Of

				the funds authorized to be appropriated for activities described in this

				section—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID517176fb8728420f9a9e96296dfad1d1"><enum>(A)</enum><text display-inline="yes-display-inline">20 percent shall be used to carry out

				activities for feedstock production under subsection (e)(1);</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3ace6be03ad343278d7366e1ef46c91c"><enum>(B)</enum><text display-inline="yes-display-inline">45 percent shall be used to carry out

				activities for overcoming recalcitrance of cellulosic biomass under subsection

				(e)(2);</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd7557e9ef5864516985b1ea23864e1da"><enum>(C)</enum><text display-inline="yes-display-inline">30 percent shall be used to carry out

				activities for product diversification under subsection (e)(3); and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7b83b8c348214c2596e91fce1a7c8474"><enum>(D)</enum><text display-inline="yes-display-inline">5 percent shall be used to carry out

				activities for strategic guidance under subsection (e)(4).</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa4e6a325e09347249dce4f12cd0cd1c0"><enum>(3)</enum><header>Distribution of

				funding within each technical area</header><text display-inline="yes-display-inline">Within each technical area described in

				paragraphs (1) through (3) of subsection (e)—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID8c39ce0728154a4ba81eca392e7f472c"><enum>(A)</enum><text display-inline="yes-display-inline">15 percent of funds shall be used for

				applied fundamentals;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7ecf8dbd86e84288a861dec9ee4f67e1"><enum>(B)</enum><text display-inline="yes-display-inline">35 percent of funds shall be used for

				innovation; and</text>

				information transfer to agricultural users</header>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID9685e357ff874011a6361f633fd0e773"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Administrator of

				the Cooperative State Research, Education, and Extension Service and the Chief

				of the Natural Resources Conservation Service shall ensure that applicable

				research results and technologies from the Initiative are adapted, made

				available, and disseminated through those services, as appropriate.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdbeebf3b39c4459eac4b1706b5c5a23e"><enum>(B)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of

				enactment of this paragraph, and every 2 years thereafter, the Administrator of

				the Cooperative State Research, Education, and Extension Service and the Chief

				of the Natural Resources Conservation Service shall submit to the committees of

				Congress with jurisdiction over the Initiative a report describing the

				activities conducted by the services under this

				subsection.</text>

								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDdd54925b41c2471b8fba4b29c72a5c33" section-type="subsequent-section"><enum>106.</enum><header>Reports</header><text display-inline="no-display-inline">Section 309 of the Biomass Research and

			</section><section commented="no" display-inline="no-display-inline" id="IDa8380e08f0fd48628c45a62cac88f807" section-type="subsequent-section"><enum>109.</enum><header>Biomass-derived

			 hydrogen</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID2e42ece0db8b4e31be3fb93e0152c798"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 conduct a research, development, and demonstration program focused on the

			 economic production and use of hydrogen from biofuels, with emphasis on the

			 rural transportation and rural electrical generation sectors.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID305af4a23804443aa0b939154f2c440c"><enum>(b)</enum><header>Transportation

			 sector objectives</header><text display-inline="yes-display-inline">The

			 objectives of the program in the transportation sector shall be to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDb0bef5101e6c4a0e8cf86fe6fea6cf46"><enum>(1)</enum><text display-inline="yes-display-inline">conduct research, and to develop and test

			 processes and equipment, to produce low-cost liquid biobased fuels that can be

			 transported to distant fueling stations for the production of hydrogen or for

			 direct use in conventional internal combustion engine vehicles;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc7246590f79d42c09f6eef5ad541bf5a"><enum>(2)</enum><text display-inline="yes-display-inline">demonstrate the cost-effective production

			 of hydrogen from liquid biobased fuels at the local fueling station, to

			 eliminate the costs of transporting hydrogen long distances or building

			 hydrogen pipeline networks;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID935020b3491740c490ea9805019fb261"><enum>(3)</enum><text display-inline="yes-display-inline">demonstrate the use of hydrogen derived

			 from liquid biobased fuels in fuel cell vehicles, or, as an interim

			 cost-reduction option, in internal combustion engine hybrid electric vehicles,

			 to demonstrate sustainable transportation with significantly reduced local air

			 pollution, greenhouse gas emissions, and dependence on imported fossil

			 fuels;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd27acec1542a467db6ff190f46d90c55"><enum>(4)</enum><text display-inline="yes-display-inline">evaluate the economic return to

			 agricultural producers producing feedstocks for liquid biobased fuels compared

			 to agricultural producer returns as of the date of enactment of this

			 Act;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf4e201f61216414f8ab6559ade5bed23"><enum>(5)</enum><text display-inline="yes-display-inline">evaluate the crop yield and long-term soil

			 sustainability of growing and harvesting feedstocks for liquid biobased fuels;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2ca932dab739446e95818f56f4682d7b"><enum>(6)</enum><text display-inline="yes-display-inline">evaluate the fuel costs to fuel cell car

			 owners (or hybrid electric car owners running on hydrogen) per mile driven

			 compared to burning gasoline in conventional vehicles.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDaa8371d954a14354907d3f2fbc6b96cc"><enum>(c)</enum><header>Electrical

			 generation sector objectives</header><text display-inline="yes-display-inline">The objectives of the program in the rural

			 electrical generation sector shall be to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID45b536791edb40d1994df345377683f8"><enum>(1)</enum><text display-inline="yes-display-inline">design, develop, and test low-cost

			 gasification equipment to convert biomass to hydrogen at regional rural

			 cooperatives, or at businesses owned by farmers, close to agricultural

			 operations to minimize the cost of biomass transportation to large central

			 gasification plants;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID97602d87eb2548efad771fa172e755da"><enum>(2)</enum><text display-inline="yes-display-inline">demonstrate low-cost electrical generation

			 at such rural cooperatives or farmer-owned businesses, using renewable hydrogen

			 derived from biomass in either fuel cell generators, or, as an interim cost

			 reduction option, in conventional internal combustion engine gensets;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe5177ec073a9447fa6275fe9f29a4019"><enum>(3)</enum><text display-inline="yes-display-inline">determine the economic return to

			 cooperatives or other businesses owned by farmers of producing hydrogen from

			 biomass and selling electricity compared to agricultural economic returns from

			 producing and selling conventional crops alone;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85e2c0202e9041ea93ab9c782da6a4e5"><enum>(4)</enum><text display-inline="yes-display-inline">evaluate the crop yield and long-term soil

			 sustainability of growing and harvesting of feedstocks for biomass

			 gasification, and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4fbf907685ee4661849413799bd4fd50"><enum>(5)</enum><text display-inline="yes-display-inline">demonstrate the use of a portion of the

			 biomass-derived hydrogen in various agricultural vehicles to reduce—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id18CFEAEB66494484B64058BF1FCE2C05"><enum>(A)</enum><text display-inline="yes-display-inline">dependence on imported fossil fuel;

			 and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14673B1E36A84F43A2C31873E3EF92EE"><enum>(B)</enum><text display-inline="yes-display-inline">environmental impacts.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9adc5c8205b34bc5a0fb1d3034ff2587"><enum>(d)</enum><header>Authorization

			 for appropriations</header><text display-inline="yes-display-inline">There is

			 authorized to be appropriated to carry out this section $5,000,000 for each of

			 fiscal years 2006 through 2010.</text>

				<subsection commented="no" display-inline="no-display-inline" id="ID7e50376034224ef9a27cb3140de5425e"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of this section is to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID47d38067cc0944d28557a722ebbd1216"><enum>(1)</enum><text display-inline="yes-display-inline">accelerate deployment and commercialization

			 of biofuels;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID892323c1e0b744669d60006b25d9a399"><enum>(2)</enum><text display-inline="yes-display-inline">deliver the first 1,000,000,000 gallons of

			 cellulosic biofuels by 2015;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID45278e894acf4bdba5d46fbbbc6e92bd"><enum>(3)</enum><text display-inline="yes-display-inline">ensure biofuels produced after 2015 are

			 cost competitive with gasoline and diesel; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3e751601353a48849faf5ca1d1e8ff04"><enum>(4)</enum><text display-inline="yes-display-inline">ensure that small feedstock producers and

			 rural small businesses are full participants in the development of the

			 cellulosic biofuels industry.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID42b600d17de64f95ba06b7d9692a2419"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID5343610918c84667942f71444405ae47"><enum>(1)</enum><header>Cellulosic

			 biofuels</header><text display-inline="yes-display-inline">The term

			 <quote>cellulosic biofuels</quote> means any fuel that is produced from

			 cellulosic feedstocks.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3eaaf959e34a45f68459624b0483ccc3"><enum>(2)</enum><header>Eligible

			 entity</header><text display-inline="yes-display-inline">The term

			 <term>eligible entity</term> means a producer of fuel from cellulosic biofuels

			 the production facility of which—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="IDe07e1a450b4d45e881c46a0d69fe1bff"><enum>(A)</enum><text display-inline="yes-display-inline">is located in the United States;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa3d0776ac69e4860a9d6dcb6919d2b42"><enum>(B)</enum><text display-inline="yes-display-inline">meets all applicable Federal and State

			 permitting requirements;</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id525495CCADF441DF90BA179EE100EE67"><enum>(C)</enum><text display-inline="yes-display-inline">is to begin production of cellulosic

			 biofuels not later than 3 years after the date of the reverse auction in which

			 the producer participates; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4BE3F3BE90824D3C989DBD6C52947023"><enum>(D)</enum><text display-inline="yes-display-inline">meets any financial criteria established by

			 the Secretary.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id312AC67A26DB4E5785D2BDFB3F9E580B"><enum>(c)</enum><header>Program</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id971DA9C70742409F98D0811AAC8EBE1E"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary, in consultation with the

			 Secretary of Energy, the Secretary of Defense, and the Administrator of the

			 Environmental Protection Agency, shall establish an incentive program for the

			 production of cellulosic biofuels.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7536E2DABFFE4A6399AF89AA4F3B4C33"><enum>(2)</enum><header>Basis of

			 incentives</header><text display-inline="yes-display-inline">Under the program,

			 the Secretary shall award production incentives on a per gallon basis of

			 cellulosic biofuels from eligible entities, through—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id7EFF7915E5A04966AD0D146260656F26"><enum>(A)</enum><text display-inline="yes-display-inline">set payments per gallon of cellulosic

			 biofuels produced in an amount determined by the Secretary, until initiation of

			 the first reverse auction; and</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEDCC3B90D69945C5BA08E6A895037AED"><enum>(B)</enum><text display-inline="yes-display-inline">reverse auction thereafter.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe589f04d2cc747e88d32dfcf80c923b9"><enum>(3)</enum><header>First reverse

			 auction</header><text display-inline="yes-display-inline">The first reverse

			 auction shall be held on the earlier of—</text>

						<subparagraph commented="no" display-inline="no-display-inline" id="id9D86A845FA3E4250827137CD2B785747"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 1 year after the first year

			 of annual production in the United States of 100,000,000 gallons of cellulosic

			 biofuels, as determined by the Secretary; or</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCCFD8386FDB14C4BA9B298E56F6C35C5"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 3 years after the date of

			 enactment of this Act.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID91b5dd7c8a2f4136a869447b798a20bd"><enum>(4)</enum><header>Reverse auction

			 procedure</header>

						<subparagraph commented="no" display-inline="no-display-inline" id="idA9B8EB10F72D4B93B640F613CB8A966E"><enum>(A)</enum><header>In

			 general</header><text display-inline="yes-display-inline">On initiation of the

			 first reverse auction, and each year thereafter until the earlier of the first

			 year of annual production in the United States of 1,000,000,000 gallons of

			 cellulosic biofuels, as determined by the Secretary, or 10 years after the date

			 of enactment of this Act, the Secretary shall conduct a reverse auction at

			 which—</text>

							<clause commented="no" display-inline="no-display-inline" id="IDd19c4d843eb14dbf9d2ecd704cb4ce94"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary shall solicit bids from

			 eligible entities;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID4e68b9e62bd94d08ace9b5b370394be7"><enum>(ii)</enum><text display-inline="yes-display-inline">eligible entities shall submit—</text>

								<subclause commented="no" display-inline="no-display-inline" id="id69DEAEB79FF144B9BA32AFA0D8F28002"><enum>(I)</enum><text display-inline="yes-display-inline">a desired level of production incentive on

			 a per gallon basis; and</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="id90DD5816871545D38D6C6B363A79D40C"><enum>(II)</enum><text display-inline="yes-display-inline">an estimated annual production amount in

			 gallons; and</text>

								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID2f4093a864474f768642d41d644f04aa"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary shall issue awards for the

			 production amount submitted, beginning with the eligible entity submitting the

			 bid for the lowest level of production incentive on a per gallon basis, until

			 the amount of funds available for the reverse auction is committed.</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID84e777a58e2e4d61b51a5b2a90c40d4e"><enum>(B)</enum><header>Amount of

			 incentive received</header><text display-inline="yes-display-inline">An

			 eligible entity selected by the Secretary through a reverse auction shall

			 receive the amount of performance incentive requested in the auction for each

			 gallon produced and sold by the entity during the first 6 years of

			 operation.</text>

						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc82b2d297c4f473986c90da85163f236"><enum>(d)</enum><header>Limitations</header><text display-inline="yes-display-inline">Awards under this section shall be limited

			 to—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID0cd90981181c4518b6ca8920baba50cd"><enum>(1)</enum><text display-inline="yes-display-inline">a per gallon amount determined by the

			 Secretary during the first 4 years of the program;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd35a7323739f4b92a36abfbceaa83595"><enum>(2)</enum><text display-inline="yes-display-inline">a declining per gallon cap over the

			 remaining lifetime of the program, to be established by the Secretary so that

			 cellulosic biofuels produced after the first year of annual cellulosic biofuels

			 production in the United States in excess of 1,000,000,000 gallons are cost

			 competitive with gasoline and diesel;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb220401701dd46e592bcfa8007cbdcc7"><enum>(3)</enum><text display-inline="yes-display-inline">not more than 25 percent of the funds

			 committed within each reverse auction to any 1 project;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9513D7254C6436DBB4B907E0122C303"><enum>(4)</enum><text display-inline="yes-display-inline">not more than $100,000,000 in any 1 year;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1C242A4574BF4EB7912E6D7F9F6BAB1D"><enum>(5)</enum><text display-inline="yes-display-inline">not more than $1,000,000,000 over the

			 lifetime of the program.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID83a66fcb128349c8aa17cdc1b50ab135"><enum>(e)</enum><header>Priority</header><text display-inline="yes-display-inline">In selecting a project under the program,

			 the Secretary shall give priority to projects that—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID37994623ef0c4939800c97d40701f545"><enum>(1)</enum><text display-inline="yes-display-inline">demonstrate outstanding potential for local

			 and regional economic development;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0848cd18f7364eada3fab0d9181cbca6"><enum>(2)</enum><text display-inline="yes-display-inline">include agricultural producers or

			 cooperatives of agricultural producers as equity partners in the ventures;

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id58B0D07E3C6645B69B74EBFC746EF25D"><enum>(3)</enum><text display-inline="yes-display-inline">have a strategic agreement in place to

			 fairly reward feedstock suppliers.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCE0F4EE0C793409EB90FA23FD7523A0B"><enum>(f)</enum><header>Funding</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idE612722D26F84227B23F8608AB794DD0"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 use to carry out this title $250,000,000 of funds of the Commodity Credit

			 Corporation, to remain available until expended.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID983036676fdb4870b52d93264dbf09ac"><enum>(2)</enum><header>Authorizations

			 of appropriations</header><text display-inline="yes-display-inline">In addition

			 to amounts made available under paragraph (1), there are authorized to be

			 appropriated such sums as are necessary to carry out this section.</text>

					</paragraph></subsection></section></title><title commented="no" id="id3A0A81FC377C483C844ED5C51F1FA48E" style="OLC"><enum>III</enum><header>Assistant Secretary of Agriculture for

			 Energy and Biobased Products</header>

			<section commented="no" display-inline="no-display-inline" id="ID1840eb0fc675463586b01ecb0fd52075" section-type="subsequent-section"><enum>301.</enum><header>Assistant Secretary

			 of Agriculture for Energy and Biobased Products</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDabaf59c2cdb242edbb4862b11c0d33a7"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 1 year after the date of

			 enactment of this Act, the Secretary shall establish in the Department a

			 position of Assistant Secretary of Agriculture for Energy and Biobased Products

			 (referred to in this section as the <quote>Assistant Secretary</quote>).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa1f44ef9dc4345f486ac77ca03a92bff"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Assistant Secretary shall be

			 responsible for—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDc2a7420143fe420a9ff341348829d050"><enum>(1)</enum><text display-inline="yes-display-inline">the energy programs established under title

			 IX of the Farm Security and Rural Investment Act of 2002 (7 U.S.C. 8101 et

			 seq.); and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID015a9cfda6d44dce9ae619c8faa9648c"><enum>(2)</enum><text display-inline="yes-display-inline">all other programs and initiatives that the

			 Secretary considers appropriate.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDbc2f9160e80b46489170f837be8a21d8"><enum>(c)</enum><header>Confirmation

			 requirement</header><text display-inline="yes-display-inline">The Assistant

			 Secretary shall be appointed by the President, by and with the advice and

			 consent of the Senate.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID067373de71f44bb0b4f3e13221c1b348"><enum>(d)</enum><header>Personnel</header><text display-inline="yes-display-inline">The Secretary, acting through the Assistant

			 Secretary, may transfer or assign work to personnel, or assign staff hours, on

			 a permanent or a part-time basis, as needed, to the Office of the Assistant

			 Secretary to carry out the functions and duties of the office.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idCD0A03A92CD048248EAC9728AA8E5E6F"><enum>(e)</enum><header>Budget</header><text display-inline="yes-display-inline">The Secretary shall establish a budget for

			 the office of the Assistant Secretary.</text>

			<section commented="no" display-inline="no-display-inline" id="id99E959F65BDA485EA775BBAA755EBA42" section-type="subsequent-section"><enum>401.</enum><header>Federal

			 procurement</header>

				<subsection commented="no" display-inline="no-display-inline" id="id5B23711BCE744D93B7D607CD892623C7"><enum>(a)</enum><header>Definition of

			 procuring agency</header><text display-inline="yes-display-inline">Section 9001

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDe3be64f88bcb4ff6bc5e3c245dc7da32" section-type="subsequent-section"><enum>403.</enum><header>Education </header>

				<subsection commented="no" display-inline="no-display-inline" id="idA2083A834B834264BAD55E7575A0BB05"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Architect of the

			 Capitol shall establish in the Capitol Complex a program of public education

			 regarding use by the Architect of the Capitol of biobased products.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idC19023D4BB9C4671945AB3379ABA6453"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the program shall

			 be—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idCC5B0E89AC344D4DB8DAA6F1ED849E5C"><enum>(1)</enum><text display-inline="yes-display-inline">to establish the Capitol Complex as a

			 showcase for the existence and benefits of biobased products; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9BDC97F87D704660A0C1C866A62FF48B"><enum>(2)</enum><text display-inline="yes-display-inline">to provide access to further information on

			 biobased products to occupants and visitors.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID9283f9d0dada424291b9a54d473eb5c3" section-type="subsequent-section"><enum>404.</enum><header>Regulations</header><text display-inline="no-display-inline">Requirements issued under the amendment made

			 by section 402 shall be made in accordance with regulations issued by the

			 Committee on Rules and Administration of the Senate and the Committee on House

			 Administration of the House of Representatives.</text>

			</section></title><title commented="no" id="idE9D9815032EF4AF789DC7321ABBFBA42" style="OLC"><enum>V</enum><header>Bioeconomy Grants and tax incentives</header>

			<section commented="no" display-inline="no-display-inline" id="idAAEABE18FFB54DB988BA2D159EEE210B" section-type="subsequent-section"><enum>501.</enum><header>Small business

			 bioproduct marketing and certification grants</header>

				<subsection commented="no" display-inline="no-display-inline" id="idD1F3ED5F43984F0596C8EF50AA67C98C"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Using amounts made

			 available under subsection (g), the Secretary shall make available on a

			 competitive basis grants to eligible entities described in subsection (b) for

			 the biobased product marketing and certification purposes described in

			 subsection (c).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9c6b466272b74dd587df7ed78c3f2f32"><enum>(b)</enum><header>Eligible

			 entities</header><text display-inline="yes-display-inline">An entity eligible

			 for a grant under this section is any manufacturer of biobased products

			 that—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idE3BF7EF96225486BBA368B36BD867B78"><enum>(1)</enum><text display-inline="yes-display-inline">has fewer than 50 employees;</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD5E4580E0A8C4AD4BD69AD281D1864C9"><enum>(2)</enum><text display-inline="yes-display-inline">proposes to use the grant for the biobased

			 product marketing and certification purposes described in subsection (c);

			 and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8B51EE4D6AE144D2B5E81C5E9E85EB6A"><enum>(3)</enum><text display-inline="yes-display-inline">has not previously received a grant under

			 this section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc35d71b403d94a8986c1968cc061e9e3"><enum>(c)</enum><header>Biobased

			 product marketing and certification grant purposes</header><text display-inline="yes-display-inline">A

			 grant made under this section shall be used—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID8c35528f30cf4e46b5bc7397277b2154"><enum>(1)</enum><text display-inline="yes-display-inline">to plan activities and working capital for

			 marketing of biobased products; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfaa394c96eea447cb597701638ec3f85"><enum>(2)</enum><text display-inline="yes-display-inline">to provide private sector cost sharing for

			 the certification of biobased products.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6cc5ebf6095440338b1695c172c4132c"><enum>(d)</enum><header>Matching

			 funds</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id92E313482A4F421ABDD6F5F5FD7C9744"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Grant recipients

			 shall provide matching non-Federal funds equal to the amount of the grant

			 received.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28B6AAC3E85E4ECEBED160F5544ED8D3"><enum>(2)</enum><header>Expenditure</header><text display-inline="yes-display-inline">Matching funds shall be expended in advance

			 of grant funding, so that for every dollar of grant that is advanced, an equal

			 amount of matching funds shall have been funded prior to submitting the request

			 for reimbursement.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID26672a7149cb4494b10917fd7fce4db5"><enum>(e)</enum><header>Amount</header><text display-inline="yes-display-inline">A grant made under this section shall not

			 exceed $100,000.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDceafd979743346098cd61bb973a5d08e"><enum>(f)</enum><header>Administration</header><text display-inline="yes-display-inline">The Secretary shall establish such

			 administrative requirements for grants under this section, including

			 requirements for applications for the grants, as the Secretary considers

			 appropriate.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID00f4f7c14b3b4192b8e844a8828aed24"><enum>(g)</enum><header>Authorizations

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated to make grants under this section—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID3710dd5176414e81b48631ce72e68270"><enum>(1)</enum><text display-inline="yes-display-inline">$1,000,000 for fiscal year 2006; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7277531148a6434a9dca2126c1003eed"><enum>(2)</enum><text display-inline="yes-display-inline">such sums as are necessary for fiscal year

			 2007 and each subsequent fiscal year.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDbea0e0a9ec084203b517ef65a9fa3624" section-type="subsequent-section"><enum>502.</enum><header>Regional bioeconomy

			 development grants</header>

				<subsection commented="no" display-inline="no-display-inline" id="ID91d70740761d4d9ebf39e6c384a0e18a"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Using amounts made

			 available under subsection (g), the Secretary shall make available on a

			 competitive basis grants to eligible entities described in subsection (b) for

			 the purposes described in subsection (c).</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID739389834d19455d92bff795d0ba606f"><enum>(b)</enum><header>Eligible

			 entities</header><text display-inline="yes-display-inline">An entity eligible

			 for a grant under this section is any regional bioeconomy development

			 association, agricultural or energy trade association, or Land Grant

			 institution that—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idFDCFC16715B64E09B9DB2C7E8A25C91D"><enum>(1)</enum><text display-inline="yes-display-inline">proposes to use the grant for the purposes

			 described in subsection (c); and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEBD3E44F34E34D37A1569BEE27460EF3"><enum>(2)</enum><text display-inline="yes-display-inline">has not previously received a grant under

			 this section.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID01b5aaafa67a42e087b2f038479eaa3d"><enum>(c)</enum><header>Regional

			 bioeconomy development association grant purposes</header><text display-inline="yes-display-inline">A grant made under this section shall be

			 used to support and promote the growth and development of the bioeconomy within

			 the region served by the eligible entity, through coordination, education,

			 outreach, and other endeavors by the eligible entity.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB2DE9B7910BA4B729E4B10B02CF12979"><enum>(d)</enum><header>Matching

			 funds</header>

					<paragraph commented="no" display-inline="no-display-inline" id="idD1E6491904A54BD4A6805C5660FF6750"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Grant recipients

			 shall provide matching non-Federal funds equal to the amount of the grant

			 received.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5c5bd042889b480f908471d56697e863"><enum>(f)</enum><header>Amount</header><text display-inline="yes-display-inline">A grant made under this section shall not

			 exceed $500,000.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6ee07c11b7d440e5907804a1922af43c"><enum>(g)</enum><header>Authorizations

			 of appropriations</header><text display-inline="yes-display-inline">There are

			 authorized to be appropriated to make grants under this section—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID69cc77a5b8c242ae87b8dff7e81e71df"><enum>(1)</enum><text display-inline="yes-display-inline">$1,000,000 for fiscal year 2006; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6ac3337a48d244448ccc663cc66e52e9"><enum>(2)</enum><text display-inline="yes-display-inline">such sums as are necessary for fiscal year

			 2007 and each subsequent fiscal year.</text>

					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID08a029c3cc3c4f758878d6462ead9ee7" section-type="subsequent-section"><enum>503.</enum><header>Preprocessing and

			 harvesting demonstration grants</header>

				<subsection commented="no" display-inline="no-display-inline" id="IDf4cde37310d54f7cbda6107849d6a2c5"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 make grants available on a competitive basis to enterprises owned by

			 agricultural producers, for the purposes of demonstrating cost-effective,

			 cellulosic biomass innovations in—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="IDfee33d88dd584e01b300541aa66e8781"><enum>(1)</enum><text display-inline="yes-display-inline">preprocessing of feedstocks, including

			 cleaning, separating and sorting, mixing or blending, and chemical or

			 biochemical treatments, to add value and lower the cost of feedstock processing

			 at a biorefinery; or</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9bc4048af2054b4cb473597b7fd3be5c"><enum>(2)</enum><text display-inline="yes-display-inline">1-pass or other efficient, multiple crop

			 harvesting techniques.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9f7c7db6bda54a7d9dcc1bff0757e779"><enum>(b)</enum><header>Limitations on

			 grants</header>

					<paragraph commented="no" display-inline="no-display-inline" id="id060D60396A2A4D78A1A8EF68D5DCA8FE"><enum>(1)</enum><header>Number of

			 grants</header><text display-inline="yes-display-inline">Not more than 5

			 demonstration projects per fiscal year shall be funded under this

			 section.</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC522FE23AC89428A80B6645D9DB255C0"><enum>(2)</enum><header>Non-Federal

			 cost share</header><text display-inline="yes-display-inline">The non-Federal

			 cost share of a project under this section shall be not less than 20 percent,

			 as determined by the Secretary.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDbe6e6785429e43898a93f4be54eade64"><enum>(c)</enum><header>Condition of

			 grant</header><text display-inline="yes-display-inline">To be eligible for a

			 grant for a project under this section, a recipient of a grant or a

			 participating entity shall agree to use the material harvested under the

			 project—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idBB795EBE2FFE4FA3AA2C2D59C146B514"><enum>(1)</enum><text display-inline="yes-display-inline">to produce ethanol; or</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD94A0896D07F4404B0E095B2F17465CF"><enum>(2)</enum><text display-inline="yes-display-inline">for another energy purpose, such as the

			 generation of heat or electricity.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb609dfbd7d4c4361a02f38e4a159e04e"><enum>(d)</enum><header>Authorization

			 for appropriations</header><text display-inline="yes-display-inline">There is

			 authorized to be appropriated to carry out this section $5,000,000 for each of

			 fiscal years 2006 through 2010.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="id5B855BE9D1AE4354A8D700A7E857BC2F" section-type="subsequent-section"><enum>504.</enum><header>Sense of the

			 Senate</header><text display-inline="no-display-inline">It is the sense of the

			 Senate that Congress should amend the Federal tax code to encourage investment

			 in, and production and use of, biobased fuels and biobased products

			 through—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDb3aca9d05e214a949d8eede99acc6631"><enum>(1)</enum><text display-inline="yes-display-inline">an investment tax credit for the

			 construction or modification of facilities for the production of fuels from

			 cellulose biomass, to drive private capital towards new biorefinery projects in

			 a manner that allows participation by smaller farms and cooperatives;

			 and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9f3d8731ce9f48df9aed3316db770235"><enum>(2)</enum><text display-inline="yes-display-inline">an investment tax credit to small

			 manufacturers of biobased products to lower the capital costs of starting and

			 maintaining a biobased business.</text>

				</paragraph></section></title><title commented="no" id="id7D3C4A7C7642480FA96B42E6AA98C3BA" style="OLC"><enum>VI</enum><header>Other provisions</header>

			<section commented="no" display-inline="no-display-inline" id="idC8DD679AE4D941BBB74674A3DC679598" section-type="subsequent-section"><enum>601.</enum><header>Education and

			 outreach</header>

				<subsection commented="no" display-inline="no-display-inline" id="idDD70C86DC16649DF812F0469F15EA017"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Secretary shall

			 establish, within the Department or through an independent contracting entity,

			 a program of education and outreach on biobased fuels and biobased products

			 consisting of—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="ID0f29cbcc677e42029e0e03d11c0b1d34"><enum>(1)</enum><text display-inline="yes-display-inline">training and technical assistance programs

			 for feedstock producers to promote producer ownership, investment, and

			 participation in the operation of processing facilities; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfc10d56914b641c393aac66c1be33039"><enum>(2)</enum><text display-inline="yes-display-inline">public education and outreach to

			 familiarize consumers with the biobased fuels and biobased products.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7be006a4b7524549969782f23e9d56e3"><enum>(b)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There is

			 authorized to be appropriated to carry out this title $1,000,000 for each of

			 fiscal years 2006 through 2010.</text>

				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID858d32643e3f42f6b2aa14e73d10005b" section-type="subsequent-section"><enum>602.</enum><header>Reports</header>

				<subsection commented="no" display-inline="no-display-inline" id="id198CDCFB62F344719A288C8974FDFF38"><enum>(a)</enum><header>Progress

			 report</header><text display-inline="yes-display-inline">Not later than 1 year

			 after the date of enactment of this Act, the Secretary shall submit to the

			 Committee on Agriculture of the House of Representatives and the Committee on

			 Agriculture, Nutrition, and Forestry of the Senate a report on progress in

			 establishing the Office of the Assistant Secretary of Agriculture for Energy

			 and Biobased Products under title I.</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="idCF38CE72BF2F4576A17C698DA91D9CA8"><enum>(b)</enum><header>Biobased

			 product potential</header><text display-inline="yes-display-inline">Not later

			 than 1 year after the date of enactment of this Act, the Secretary shall submit

			 to the Committee on Agriculture of the House of Representatives and the

			 Committee on Agriculture, Nutrition, and Forestry of the Senate a report

			 that—</text>

					<paragraph commented="no" display-inline="no-display-inline" id="idD810D4C8BCDE4D7EA268B4E7CE594F20"><enum>(1)</enum><text display-inline="yes-display-inline">describes the economic potential for the

			 United States of the widespread production and use of commercial and industrial

			 biobased products through calendar year 2025; and</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3AC1DFE9A02C4700BE40888A65F0BCCC"><enum>(2)</enum><text display-inline="yes-display-inline">as the maximum extent practicable,

			 identifies the economic potential by product area.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb9e85289887941a288b9b1c8d232cd0a"><enum>(c)</enum><header>Analysis of

			 economic indicators</header><text display-inline="yes-display-inline">Not later

			 than 2 years after the date of enactment of this Act, and every 2 years

			 thereafter, the Secretary shall submit to Congress an analysis of economic

			 indicators of the biobased economy during the 2-year period preceding the

			 analysis.</text>
