		  education and to assist students in affording graduate

		<section commented="no" display-inline="no-display-inline" id="IDB60B05AEA3304D518497C590F23FC62E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Getting Results for Advanced Degrees

			 Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID492C8332ECF14839A5EC73BA9B1B3C71" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following

			 findings:</text>

			<paragraph commented="no" display-inline="no-display-inline" id="IDD137DA6890A742A5A2E663A07DF8AAB6"><enum>(1)</enum><text display-inline="yes-display-inline">From 1976 to 2000, graduate enrollment in

			 the United States increased 38 percent. In the fall of 2000, there were

			 1,850,000 graduate students enrolled in the United States.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF1F3E84658414D158538D689A35CFFDF"><enum>(2)</enum><text display-inline="yes-display-inline">In 2003, 84 percent of graduate students in

			 the United States were citizens of the United States or resident aliens, and 16

			 percent were temporary residents who were foreign or international

			 students.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE143C416090B4176B481C0EC9FC391C5"><enum>(3)</enum><text display-inline="yes-display-inline">In a 2002 borrower’s survey, the average

			 debt reported by graduate students was $45,900.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0B41773A7D66476B8F88424D17265A3C"><enum>(4)</enum><text display-inline="yes-display-inline">In 1999–2000, 60 percent of all graduate

			 and first-professional students, and 82 percent of those enrolled full-time and

			 full-year, received some type of financial aid, including grants, loans,

			 assistantships, or work study. The average amount of aid received by aided

			 full-time, full-year students was approximately $19,500 per year.</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDCF616D92DE047C9963C9ED186F0F061"><enum>(5)</enum><text display-inline="yes-display-inline">Annual aid in the form of grants to

			 full-time, full-year recipients was awarded in larger average amounts to

			 doctoral students ($13,400) than to either master’s students ($7,600) or

			 first-professional students ($6,900). First-professional students took out

			 larger loans on average overall ($20,100) than did their counterparts at the

			 master’s level ($14,800) and doctoral level ($14,100).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2EFBEB3C095F4A8D91326F72BB8C0F88"><enum>(6)</enum><text display-inline="yes-display-inline">Median annual earnings in 2003 increased

			 with educational attainment. There was a substantial earnings differential from

			 the highest to the lowest levels of attainment:</text>

				<subparagraph commented="no" display-inline="no-display-inline" id="idAEEB6687894F4F7496C658B961145578"><enum>(A)</enum><text display-inline="yes-display-inline">The median earnings of workers who had a

			 master’s degree were almost twice those of high school graduates and $10,000

			 more than those of individuals with a bachelor’s degree.</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4BEB8FE71BD4422D943C3C5282565FF5"><enum>(B)</enum><text display-inline="yes-display-inline">The median earnings of workers who had a

			 doctoral degree were 2<fraction>1/2</fraction> times those of high school

			 graduates, $30,000 more than those of individuals with a bachelor’s degree, and

			 $20,000 more than those of individuals with a master’s degree.</text>

				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id24ADACE0A31541DD9AA097244B0B3E22"><enum>(C)</enum><text display-inline="yes-display-inline">The median earnings of workers with a

			 professional degree were more than 3 times those of high school graduates,

			 almost double those of individuals with a bachelor’s degree, $35,000 more than

			 those of individuals with a master’s degree, and $15,000 more than those of

			 individuals with a doctoral degree.</text>

				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="IDA6E84C6B5C50426D9F2CB32A059BF59C" section-type="subsequent-section"><enum>3.</enum><header>Jacob K. Javits

			 fellowship program</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID498A768573F847DF845FBA8B40AD0200"><enum>(a)</enum><header>Criteria for

			 awards</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="HEA65/701(a)">Section 701(a)</external-xref> of

			 the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1134(a)">20 U.S.C.

			 1134(a)</external-xref>) is amended by striking <quote>, financial

			 need,</quote>.</text>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1134a(a)">20 U.S.C.

			 1134a(a)</external-xref>) is amended by striking paragraph (1) and inserting

			 the following:</text>

				appoint a Jacob K. Javits Fellows Program Fellowship Board (referred to in this

				subpart as the <quote>Board</quote>) consisting of 9 individuals representative

				of both public and private institutions of higher education who are especially

				qualified to serve on the Board.</text>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDB693D5A7907444FB54C3D64622D0FF6"><enum>(B)</enum><header>Qualifications</header><text display-inline="yes-display-inline">In making appointments under subparagraph

				(A), the Secretary shall—</text>

							<clause commented="no" display-inline="no-display-inline" id="ID510EFAE9AEC14648B2435C18A5C810C4"><enum>(i)</enum><text display-inline="yes-display-inline">give due consideration to the appointment

				of individuals who are highly respected in the academic community;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="ID37B011FE18D343D9A1194EA108A10B97"><enum>(ii)</enum><text display-inline="yes-display-inline">assure that individuals appointed to the

				Board are broadly representative of a range of disciplines in graduate

				education in arts, humanities, and social sciences;</text>

							</clause><clause commented="no" display-inline="no-display-inline" id="IDED17AACF2D944FC39C2672EF5E96265B"><enum>(iii)</enum><text display-inline="yes-display-inline">appoint members to represent the various

				geographic regions of the United States; and</text>

				serving

				designation</header>

							<subsection commented="no" display-inline="no-display-inline" id="ID1CF31727412C4D5CAE08C812EDEBAA56"><enum>(a)</enum><header>Purpose</header><text display-inline="yes-display-inline">It is the purpose of this subpart to

				provide, through eligible institutions, a program of fellowship awards to

				assist highly qualified minorities and women to acquire the doctoral degree, or

				highest possible degree available, in academic areas in which such individuals

				are underrepresented for the purpose of enabling such individuals to enter the

				higher education professoriate.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID233226D7BC82413A9E4D386B872B4415"><enum>(b)</enum><header>Designation</header><text display-inline="yes-display-inline">Each recipient of a fellowship award from

				an eligible institution receiving a grant under this subpart shall be known as

				a <quote>Patsy T. Mink Graduate Fellow</quote>.</text>

							</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9061E5E8CEA3444981AC2A3C3CACB484" section-type="subsequent-section"><enum>732.</enum><header>Definition of

				eligible institution</header><text display-inline="no-display-inline">In this

				subpart, the term <quote>eligible institution</quote> means an institution of

				higher education, or a consortium of such institutions, that offers a program

				of postbaccalaureate study leading to a graduate degree.</text>

						</section><section commented="no" display-inline="no-display-inline" id="ID71BAE59578C44D7D8350FBC6684EF44B" section-type="subsequent-section"><enum>733.</enum><header>Program

				authorized</header>

							<subsection commented="no" display-inline="no-display-inline" id="ID0CA7D27DC4F640279161DAE52AE4EE4C"><enum>(a)</enum><header>Grants by

				Secretary</header>

								<paragraph commented="no" display-inline="no-display-inline" id="ID739DB30B592C4D50B088A0E45E2E04AF"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">The Secretary shall

				award grants to eligible institutions to enable such institutions to make

				fellowship awards to individuals in accordance with the provisions of this

				subpart.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID399AD56859B04C3B879F254BF2324687"><enum>(2)</enum><header>Priority

				consideration</header><text display-inline="yes-display-inline">In awarding

				grants under this subpart, the Secretary shall consider the eligible

				institution’s prior experience in producing doctoral degree, or highest

				possible degree available, holders who are minorities and women, and shall give

				priority consideration in making grants under this subpart to those eligible

				institutions with a demonstrated record of producing minorities and women who

				have earned such degrees.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDE5DF351587764D35BD84462EE15FCC5A"><enum>(b)</enum><header>Applications</header>

								<paragraph commented="no" display-inline="no-display-inline" id="ID1605CE98D0384C13AB7A0BBB90B2C102"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">An eligible

				institution that desires a grant under this subpart shall submit an application

				to the Secretary at such time, in such manner, and containing such information

				as the Secretary may require.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC09AEC67425E4B8287D9CD991F9859CA"><enum>(2)</enum><header>Applications

				made on behalf</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID545E763C2E024260A882BE78960EF6E8"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">The following

				entities may submit an application on behalf of an eligible institution:</text>

										<clause commented="no" display-inline="no-display-inline" id="IDD8D95AFEA8E14530A79DD13541E7DA70"><enum>(i)</enum><text display-inline="yes-display-inline">A graduate school or department of such

				institution.</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID20720F3862CE492794E051CA0C3A0782"><enum>(ii)</enum><text display-inline="yes-display-inline">A graduate school or department of such

				institution in collaboration with an undergraduate college or university of

				such institution.</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID19E65067DD3E4C8CA0FA446E07412DD2"><enum>(iii)</enum><text display-inline="yes-display-inline">An organizational unit within such

				institution that offers a program of postbaccalaureate study leading to a

				graduate degree, including an interdisciplinary or an interdepartmental

				program.</text>

										</clause><clause commented="no" display-inline="no-display-inline" id="ID59A6612873204130B07D85E104882B9A"><enum>(iv)</enum><text display-inline="yes-display-inline">A nonprofit organization with a

				demonstrated record of helping minorities and women earn postbaccalaureate

				degrees.</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCF9E678A394E41948691A7F87D162A9E"><enum>(B)</enum><header>Nonprofit

				organizations</header><text display-inline="yes-display-inline">Nothing in this

				paragraph shall be construed to permit the Secretary to award a grant under

				this subpart to an entity other than an eligible institution.</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID690F7A63597A40248D61B088099E6CC9"><enum>(c)</enum><header>Selection of

				applications</header><text display-inline="yes-display-inline">In awarding

				grants under subsection (a), the Secretary shall—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID8D02FA5172A3442EAAE79B163039B711"><enum>(1)</enum><text display-inline="yes-display-inline">take into account—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID1EA65497B15C4E7E850A0AE912EE4ADA"><enum>(A)</enum><text display-inline="yes-display-inline">the number and distribution of minority and

				female faculty nationally;</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID714C7D646A164312B294F48FBC012448"><enum>(B)</enum><text display-inline="yes-display-inline">the current and projected need for highly

				trained individuals in all areas of the higher education professoriate;

				and</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAB1B6054CD154EE2957E5C6C4C29D744"><enum>(C)</enum><text display-inline="yes-display-inline">the present and projected need for highly

				trained individuals in academic career fields in which minorities and women are

				underrepresented in the higher education professoriate; and</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2FEA423C48814833A87A25C03A3F82E7"><enum>(2)</enum><text display-inline="yes-display-inline">consider the need to prepare a large number

				of minorities and women generally in academic career fields of high national

				priority, especially in areas in which such individuals are traditionally

				underrepresented in college and university faculties.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5DF9EC684FEE47A2B5FA579DFA9A22A6"><enum>(d)</enum><header>Distribution

				and amounts of grants</header>

								<paragraph commented="no" display-inline="no-display-inline" id="IDA8033A4086A94FA6850BA38913B8F225"><enum>(1)</enum><header>Equitable

				distribution</header><text display-inline="yes-display-inline">In awarding

				grants under this subpart, the Secretary shall, to the maximum extent feasible,

				ensure an equitable geographic distribution of awards and an equitable

				distribution among public and independent eligible institutions that apply for

				grants under this subpart and that demonstrate an ability to achieve the

				purpose of this subpart.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE71CC572783942EA9FDF8235C982654A"><enum>(2)</enum><header>Special

				rule</header><text display-inline="yes-display-inline">To the maximum extent

				practicable, the Secretary shall use not less than 50 percent of the amount

				appropriated pursuant to section 736 to award grants to eligible institutions

				that—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID5160BDD8F84D4112B2983C6FE0D8E6AF"><enum>(A)</enum><text display-inline="yes-display-inline">are eligible for assistance under title III

				or title V; or</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBFC78D13A3F3462686CA929206FAAF0C"><enum>(B)</enum><text display-inline="yes-display-inline">have formed a consortium that includes both

				non-minority serving institutions and minority serving institutions.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDECD9A68F78FF403DA68FB01D361EF1BC"><enum>(3)</enum><header>Allocation</header><text display-inline="yes-display-inline">In awarding grants under this subpart, the

				Secretary shall allocate appropriate funds to those eligible institutions whose

				applications indicate an ability to significantly increase the numbers of

				minorities and women entering the higher education professoriate and that

				commit institutional resources to the attainment of the purpose of this

				subpart.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85D00EC3A33B4A19A79991886C2DB955"><enum>(4)</enum><header>Number of

				fellowship awards</header><text display-inline="yes-display-inline">An eligible

				institution that receives a grant under this subpart shall make not less than

				15 fellowship awards.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3EB9B6CD680642999107DBEFB4724897"><enum>(5)</enum><header>Reallotment</header><text display-inline="yes-display-inline">If the Secretary determines that an

				eligible institution awarded a grant under this subpart is unable to use all of

				the grant funds awarded to the institution, the Secretary shall reallot, on

				such date during each fiscal year as the Secretary may fix, the unused funds to

				other eligible institutions that demonstrate that such institutions can use any

				reallocated grant funds to make fellowship awards to individuals under this

				subpart.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9EB78C6F22A1456688D8AB0048E832AC"><enum>(e)</enum><header>Institutional

				allowance</header>

								<paragraph commented="no" display-inline="no-display-inline" id="IDD96898C0526D4DE6BC334938BA2C31AA"><enum>(1)</enum><header>In

				general</header>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID29F46A9F52CF4771B126B3F24CEEB126"><enum>(A)</enum><header>Number of

				allowances</header><text display-inline="yes-display-inline">In awarding grants

				under this subpart, the Secretary shall pay to each eligible institution

				awarded a grant, for each individual awarded a fellowship by such institution

				under this subpart, an institutional allowance.</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9EFD7C6514FF44BABE6B02D62C00C3BC"><enum>(B)</enum><header>Amount</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), an

				institutional allowance shall be in an amount equal to, for academic year

				2006–2007 and succeeding academic years, the amount of institutional allowance

				made to an institution of higher education under section 715 for such academic

				year.</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4E2D8DAF436748F9A703E8FDA6175B80"><enum>(2)</enum><header>Use of

				funds</header><text display-inline="yes-display-inline">Institutional

				allowances may be expended in the discretion of the eligible institution and

				may be used to provide, except as prohibited under paragraph (4), academic

				support and career transition services for individuals awarded fellowships by

				such institution.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF6E423E73D824D2FBC3FDE8B74757114"><enum>(3)</enum><header>Reduction</header><text display-inline="yes-display-inline">The institutional allowance paid under

				paragraph (1) shall be reduced by the amount the eligible institution charges

				and collects from a fellowship recipient for tuition and other expenses as part

				of the recipient’s instructional program.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEA998B5BD4E4488888F129325963B85B"><enum>(4)</enum><header>Use for

				overhead prohibited</header><text display-inline="yes-display-inline">Funds

				made available under this subpart may not be used for general operational

				overhead of the academic department or institution receiving funds under this

				subpart.</text>

								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID58FB7C704883441CBAC39E81EB42201F" section-type="subsequent-section"><enum>734.</enum><header>Fellowship

				recipients</header>

							<subsection commented="no" display-inline="no-display-inline" id="ID158CD8010EC748F3B027679D1EB7E5BE"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">An eligible institution that receives a

				grant under this subpart shall use the grant funds to make fellowship awards to

				minorities and women who are enrolled at such institution in a doctoral degree,

				or highest possible degree available, program and—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID2432098D42064E8898E7B687CF6AA6AC"><enum>(1)</enum><text display-inline="yes-display-inline">intend to pursue a career in instruction

				at—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="ID0F70685867324B0583701386CFB1A978"><enum>(A)</enum><text display-inline="yes-display-inline">an institution of higher education (as the

				term is defined in section 101);</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD5FA2E05F5684469B912D7A5787ACAE7"><enum>(B)</enum><text display-inline="yes-display-inline">an institution of higher education (as the

				term is defined in section 102(a)(1));</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4DE1371824914ADB8CEA7BFFD964B8C1"><enum>(C)</enum><text display-inline="yes-display-inline">an institution of higher education outside

				the United States (as the term is described in section 102(a)(2)); or</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA965BF2BEC8C49D39509A3648381DD45"><enum>(D)</enum><text display-inline="yes-display-inline">a proprietary institution of higher

				education (as the term is defined in section 102(b)); and</text>

									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1365D828B55D4113AA438F3735D44651"><enum>(2)</enum><text display-inline="yes-display-inline">sign an agreement with the Secretary

				agreeing to begin employment at an institution described in paragraph (1) not

				later than 5 years after receiving the doctoral degree or highest possible

				degree available, and to be employed by such institution for 1 year for each

				year of fellowship assistance received under this subpart.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEEEA42FE9C8F442C9E93C33054CE9A9D"><enum>(b)</enum><header>Failure To

				comply</header><text display-inline="yes-display-inline">If an individual who

				receives a fellowship award under this subpart fails to comply with the

				agreement signed pursuant to subsection (a)(2), then the Secretary shall do 1

				or both of the following:</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID34EA3F6776E84BC88A37ABE1A192E1F9"><enum>(1)</enum><text display-inline="yes-display-inline">Require the individual to repay all or the

				applicable portion of the total fellowship amount awarded to the individual by

				converting the balance due to a loan at the interest rate applicable to loans

				made under part B of title IV.</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDED8CA87E26304846ACC3C75D07BD2208"><enum>(2)</enum><text display-inline="yes-display-inline">Impose a fine or penalty in an amount to be

				determined by the Secretary.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID35F07213921942B99770F4F6EF249A66"><enum>(c)</enum><header>Waiver and

				modification</header>

								<paragraph commented="no" display-inline="no-display-inline" id="ID2E7421319710448082C719EADA2D78B0"><enum>(1)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary shall promulgate regulations

				setting forth criteria to be considered in granting a waiver for the service

				requirement under subsection (a)(2).</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFD91A799459E43698B10F319D33BDB7B"><enum>(2)</enum><header>Content</header><text display-inline="yes-display-inline">The criteria under paragraph (1) shall

				include whether compliance with the service requirement by the fellowship

				recipient would be—</text>

									<subparagraph commented="no" display-inline="no-display-inline" id="IDFBD620EC566244668052BA6A5D8DEB66"><enum>(A)</enum><text display-inline="yes-display-inline">inequitable and represent a substantial

				hardship; or</text>

									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1CFA24E0525244A7899D870A83F44B17"><enum>(B)</enum><text display-inline="yes-display-inline">deemed impossible because the individual is

				permanently and totally disabled at the time of the waiver request.</text>

									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8E324AED6D7646628B8C3196080805FE"><enum>(d)</enum><header>Amount of

				fellowship awards</header><text display-inline="yes-display-inline">Fellowship

				awards under this subpart shall consist of a stipend in an amount equal to the

				level of support provided to the National Science Foundation graduate fellows,

				except that such stipend shall be adjusted as necessary so as not to exceed the

				fellow’s tuition and fees or demonstrated need (as determined by the

				institution of higher education where the graduate student is enrolled),

				whichever is greater.</text>

							</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC9B3FBB7A6394633BC8C570E59348942"><enum>(e)</enum><header>Academic

				progress required</header><text display-inline="yes-display-inline">An

				individual student shall not be eligible to receive a fellowship award—</text>

								<paragraph commented="no" display-inline="no-display-inline" id="ID7FD0106890774848A9D7096944B98A04"><enum>(1)</enum><text display-inline="yes-display-inline">except during periods in which such student

				is enrolled, and such student is maintaining satisfactory academic progress in,

				and devoting essentially full time to, study or research in the pursuit of the

				degree for which the fellowship support was awarded; and</text>

								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7631DB9912CE4CEEB01E803D6AD479E7"><enum>(2)</enum><text display-inline="yes-display-inline">if the student is engaged in gainful

				employment, other than part-time employment in teaching, research, or similar

				activity determined by the eligible institution to be consistent with and

				supportive of the student’s progress toward the appropriate degree.</text>

								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID109438F0B18C4783AC6ACB28634FA942" section-type="subsequent-section"><enum>735.</enum><header>Rule of

				construction</header><text display-inline="no-display-inline">Nothing in this

				subpart shall be construed to require an eligible institution that receives a

				grant under this subpart—</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID50C0BBF75B474DCDAAF2E8EB54CF49A7"><enum>(1)</enum><text display-inline="yes-display-inline">to grant a preference or to differentially

				treat any applicant for a faculty position as a result of the institution’s

				participation in the program under this subpart; or</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2FB30254B3CD4C4F837EC1F1685C648B"><enum>(2)</enum><text display-inline="yes-display-inline">to hire a Patsy T. Mink Fellow who

				completes this program and seeks employment at such institution.</text>

							</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDD1D640990FB14271A9285C70BCDBE353" section-type="subsequent-section"><enum>736.</enum><header>Authorization of

				appropriations</header><text display-inline="no-display-inline">There is

				authorized to be appropriated to carry out this subpart $25,000,000 for fiscal

				year 2006 and such sums as may be necessary for each of the 5 succeeding fiscal

				years.</text>

						</section></subpart><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDCCDA96064C3449F7B596854E9E159E03" section-type="subsequent-section"><enum>6.</enum><header>Cost of attendance for

			 students with 1 or more dependents</header><text display-inline="no-display-inline">Section 472 of the

			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C.

			 1087ll</external-xref>) is amended by striking paragraph (8) and inserting the

			 following:</text>

			<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID2B6DD5DACF08453E9A8F9870CD03BB4A" style="OLC">

				<paragraph commented="no" display-inline="no-display-inline" id="ID04546B0F6EAE48A9ABCB65A0F799D28B"><enum>(8)</enum><text display-inline="yes-display-inline">for a student with 1 or more

				dependents—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="idE45BDC590CF7492C9A6702195CFFBBD7"><enum>(A)</enum><text display-inline="yes-display-inline">an allowance based on the estimated actual

				expenses incurred for such dependent care, based on the number and age of such

				dependents, except that—</text>

						<clause commented="no" display-inline="no-display-inline" id="idAA2C0FA0FBF844ECA67317FA3F7DE757"><enum>(i)</enum><text display-inline="yes-display-inline">such allowance shall not exceed the

				reasonable cost in the community in which such student resides for the kind of

				care provided; and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="id7B1E1BBF2E6C43F99DA7D17EB3798122"><enum>(ii)</enum><text display-inline="yes-display-inline">the period for which dependent care is

				required includes class-time, study-time, field work, internships, and

				commuting time; and</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75E266A93912410E982DBA3DD3755361"><enum>(B)</enum><text display-inline="yes-display-inline">if the student is a graduate student, an

				allowance based on the estimated actual living expenses incurred for such

				dependents, based on the number and age of such dependents, including—</text>

						<clause commented="no" display-inline="no-display-inline" id="IDB2D9F9D9C74441D7B0AAAE9DE1CDE474"><enum>(i)</enum><text display-inline="yes-display-inline">room and board for such dependents;

				and</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="IDCBAC727474E64F22A57F62D4EFB99A1D"><enum>(ii)</enum><text display-inline="yes-display-inline">health insurance for such

				dependents;</text>

						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section commented="no" display-inline="no-display-inline" id="IDD7ACF31BE51F4AE9B46E310834794098" section-type="subsequent-section"><enum>7.</enum><header>Unsubsidized stafford

			 loan limits for graduate and professional students</header><text display-inline="no-display-inline">Section

			 428H(d)(2)(C) of the <act-name parsable-cite="HEA65">Higher Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-8(d)(2)(C)">20 U.S.C.

			 1078–8(d)(2)(C)</external-xref>) is amended by striking <quote>$10,000</quote>

			 and inserting <quote>$12,000</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID616C8082DBCE426398ABE956E99A36C1" section-type="subsequent-section"><enum>8.</enum><header>Allowance of room,

			 board, and special needs services in the case of scholarships and tuition

			 reduction programs with respect to higher education</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDA3C7DD1BD8474037BCD77990482F9CD2"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Paragraph (1) of

			 section 117(b) of the Internal Revenue Code of 1986 (defining qualified

			 scholarship) is amended by inserting before the period at the end the

			 following: <quote>or, in the case of enrollment or attendance at an eligible

			 educational institution, for qualified higher education

			 expenses</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID3E764C5AB3234FB8BA26DD0476AED6F0"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Subsection (b) of section 117 of such Code

			 is amended by adding at the end the following new paragraph:</text>

				<quoted-block display-inline="no-display-inline" id="ID600424A7F9AF49E2AD7E34A6824A6BA3" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="ID1B87F455CC804AFE8CC6B4195128C1AB"><enum>(3)</enum><header>Qualified

				higher education expenses; eligible educational institution</header><text display-inline="yes-display-inline">The terms <term>qualified higher education

				expenses</term> and <term>eligible educational institution</term> have the

				meanings given such terms in section

				529(e).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID88A9FF1983E74CC7BA8B1E5BC0F92DA0"><enum>(c)</enum><header>Tuition

			 (5) of section 117(d) of such Code (relating to special rules for teaching and

					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9D050A37EBDF4FD494A6AB24C2528751"><enum>(d)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendments made by

			 this section shall apply to expenses paid after December 31, 2004 (in taxable

			 years ending after such date), for education furnished in academic periods

			 beginning after such date.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID5D2893FFE6A34F1A95013BD4F4E17E54" section-type="subsequent-section"><enum>9.</enum><header>Program funding

			 through tax-exempt securities</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID8685E77B8B0642C08487FF6E0A48EE1F"><enum>(a)</enum><header>Special

			 allowances</header>

				<paragraph commented="no" display-inline="no-display-inline" id="idFBFAA55FCFE041EF95663EB870E556BF"><enum>(1)</enum><header>Technical

			 correction</header><text display-inline="yes-display-inline">Section 2 of the

				under such subparagraphs or paragraph, as the case may be, on or after the date

				of enactment of the Taxpayer-Teacher Protection Act of 2004;</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDB2209FFAC27A481AB41A19C3453065C8"><enum>(IV)</enum><text display-inline="yes-display-inline">for which the maturity date of the

				obligation from which funds were obtained for such loans was extended on or

				after the date of enactment of the Taxpayer-Teacher Protection Act of 2004;

				or</text>

								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDD1BFF90440334A61951881128081D871"><enum>(V)</enum><text display-inline="yes-display-inline">sold or transferred to any other holder on

				or after the date of enactment of the Taxpayer-Teacher Protection Act of

				2004.</text>

								</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA53681CFF5F346ABA09D626B84FCC7A6"><enum>(3)</enum><header>Rule of

			 construction</header><text display-inline="yes-display-inline">Nothing in the

			 amendment made by paragraph (2) shall be construed to abrogate a contractual

			 agreement between the Federal Government and a student loan provider.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB761C8E0680F437D9848FB82EB3C3BE0"><enum>(b)</enum><header>Available funds

			 from reduced expenditures</header><text display-inline="yes-display-inline">Any

			 funds available to the Secretary of Education as a result of reduced

			 expenditures under <external-xref legal-doc="act" parsable-cite="HEA65/438">section 438</external-xref> of the

			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-1">20 U.S.C.

			 1087–1</external-xref>) secured by the enactment of subsection (a) shall be

			 used by the Secretary to carry out the programs and activities authorized under

			 this Act.</text>
