		<official-title display="yes">To amend titles XIX and XXI of the Social

		  Security Act to provide States with the option to cover certain legal

		  immigrants under the medicaid and State children’s health insurance

		  programs.</official-title>

		<section commented="no" display-inline="no-display-inline" id="ID10C9148E213941CBB75E5538F2DD5806" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Immigrant Children’s Health

			 Improvement Act of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDBC45E63CCE814A7F00C0CDC9463C0001" section-type="subsequent-section"><enum>2.</enum><header>Optional coverage of

			 legal immigrants under the medicaid program and schip</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID3537E27AEA784CC595FCC6224BC0DB92"><enum>(a)</enum><header>Medicaid

			 program</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1903(v)">Section 1903(v)</external-xref> of

			 the <act-name parsable-cite="SSA">Social Security Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b(v)">42 U.S.C.

			 1396b(v)</external-xref>) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDB0995D4E508A47CD914F679BC3B8311E"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking

			 <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and

			 (4)</quote>; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8C42DC9D8909490CAD379FADF4562932"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

					<quoted-block display-inline="no-display-inline" id="ID4C1724DE378B4D6CA795001147005DF9" style="OLC">

						<paragraph commented="no" display-inline="no-display-inline" id="ID6B85F95BABCE4515ACBF4CFD7600CFB0" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID4100EB60BA7C4ADEBD8FBA5CE9D183FE"><enum>(A)</enum><text display-inline="yes-display-inline">A State may elect (in a plan amendment

				under this title) to provide medical assistance under this title for aliens who

				are lawfully residing in the United States (including battered aliens described

				in section 431(c) of the Personal Responsibility and Work Opportunity

				Reconciliation Act of 1996) and who are otherwise eligible for such assistance,

				within any of the following eligibility categories:</text>

								<clause commented="no" display-inline="no-display-inline" id="ID31521D090BA04B728CAEB3F900F50087" indent="up1"><enum>(i)</enum><header>Pregnant women</header><text display-inline="yes-display-inline">Women during pregnancy (and during the

				60-day period beginning on the last day of the pregnancy).</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDD7982D78E31849D0B613382FEFD087C3" indent="up1"><enum>(ii)</enum><header>Children</header><text display-inline="yes-display-inline">Children (as defined under such plan),

				including optional targeted low-income children described in section

				1905(u)(2)(B).</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA9CFE4722A634B7B841892C6B810C6AE" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="IDF7C92D0202F049798E8D2CE4ACE2F7A8"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of a State that has elected to

				provide medical assistance to a category of aliens under subparagraph (A), no

				debt shall accrue under an affidavit of support against any sponsor of such an

				alien on the basis of provision of assistance to such category and the cost of

				such assistance shall not be considered as an unreimbursed cost.</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDE6C8E9568FE649E3A0FAEEEC43991EE9" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The provisions of sections 401(a), 402(b),

				403, and 421 of the Personal Responsibility and Work Opportunity Reconciliation

				Act of 1996 shall not apply to a State that makes an election under

				subparagraph

				(A).</text>

								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA243EFD413B9475D834C9400FAB6ABC2"><enum>(b)</enum><header>Title

			 <enum-in-header>XXI</enum-in-header></header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/2107(e)(1)">Section 2107(e)(1)</external-xref> of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg(e)(1)">42 U.S.C.

			 1397gg(e)(1)</external-xref>) is amended by adding at the end the

			 following:</text>

				<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="ID2819A1A207CD434997A346DAB7ABB476" style="OLC">

					<subparagraph commented="no" display-inline="no-display-inline" id="ID02F8F7E310B643538065F952FE6C6050"><enum>(E)</enum><text display-inline="yes-display-inline">Section 1903(v)(4) (relating to optional

				coverage of permanent resident alien children), but only if the State has

				elected to apply such section to that category of children under title

				XIX.</text>

					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCA1A26B7F47547BF9410EDCD2BFA3D27"><enum>(c)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendments made by

			 this section take effect on October 1, 2005, and apply to medical assistance

			 and child health assistance furnished on or after such date.</text>
