		<official-title>To amend the Wild and Scenic Rivers Act to designate

		  portions of the Musconetcong River in the State of New Jersey as a component of

		  the National Wild and Scenic Rivers System, and for other

		  purposes.</official-title>

		<section display-inline="no-display-inline" id="H57130B08600D40EE82A97202C011B4B5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Musconetcong Wild and Scenic Rivers

			 Act</short-title></quote>.</text>

		</section><section id="HDF1BED3B2C294586B509088EABECFEAB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>

			<paragraph id="HFC843794A9D34BDF93C17E13E8CFA492"><enum>(1)</enum><text>the Secretary of

			 the Interior, in cooperation and consultation with appropriate Federal, State,

			 regional, and local agencies, is conducting a study of the eligibility and

			 suitability of the Musconetcong River in the State of New Jersey for inclusion

			 in the Wild and Scenic Rivers System;</text>

			</paragraph><paragraph id="HFE8A3AEF2BAD4657A5519EA7837642D1"><enum>(2)</enum><text>the Musconetcong

			 Wild and Scenic River Study Task Force, with assistance from the National Park

			 Service, has prepared a river management plan for the study area entitled

			 <quote>Musconetcong River Management Plan</quote> and dated April 2002 that

			 establishes goals and actions to ensure long-term protection of the outstanding

			 values of the river and compatible management of land and water resources

			 associated with the Musconetcong River; and</text>

			</paragraph><paragraph id="H0C422E0E133B471082A8D89D103FBE6C"><enum>(3)</enum><text>13 municipalities

			 and 3 counties along segments of the Musconetcong River that are eligible for

			 designation have passed resolutions in which the municipalities and

			 counties—</text>

				<subparagraph id="id8CFE12E89A714D9F9DAE5B9F3E50F60D"><enum>(A)</enum><text>express support

			 for the Musconetcong River Management Plan;</text>

				</subparagraph><subparagraph id="idA9DFEDB0E8664F7AA78FCFEF24A126DC"><enum>(B)</enum><text>agree to take

			 action to implement the goals of the management plan; and</text>

				</subparagraph><subparagraph id="id86B0BF6B09134B4084D8E35E654B532B"><enum>(C)</enum><text>endorse

			 designation of the Musconetcong River as a component of the Wild and Scenic

			 Rivers System.</text>

				</subparagraph></paragraph></section><section id="HA6A29680809A4FF0862301B7D8F3624C"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph id="HDD2FE2C5D77D444B98DAE97B26C8079E"><enum>(1)</enum><header>Additional river

			 segment</header><text>The term <term>additional river segment</term> means the

			 approximately 4.3-mile Musconetcong River segment designated as

			 <quote>C</quote> in the management plan, from Hughesville Mill to the Delaware

			 River Confluence.</text>

			</paragraph><paragraph id="HF530BC3A10D8497F989C97A9CF565595"><enum>(2)</enum><header>Management

			 plan</header><text>The term <term>management plan</term> means the river

			 management plan prepared by the Musconetcong River Management Committee, the

			 National Park Service, the Heritage Conservancy, and the Musconetcong Watershed

			 Association entitled <quote>Musconetcong River Management Plan</quote> and

			 dated April 2002 that establishes goals and actions to—</text>

				<subparagraph id="id0CC893919F4948BC861B728D88873BDD"><enum>(A)</enum><text>ensure long-term

			 protection of the outstanding values of the river segments; and</text>

				</subparagraph><subparagraph id="idF3C82FCCE69C4C5598463FE21E1722BA"><enum>(B)</enum><text>compatible

			 management of land and water resources associated with the river

			 segments.</text>

				</subparagraph></paragraph><paragraph id="HC4F4800B9D114F0295B029154C6031D"><enum>(3)</enum><header>River

			 segment</header><text>The term <term>river segment</term> means any segment of

			 the Musconetcong River, New Jersey, designated as a scenic river or

			 recreational river by section 3(a)(167) of the Wild and Scenic Rivers Act (as

			 added by section 4).</text>

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB62243B7158949AF86AE8C413B4287DB"><enum>(4)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of the Interior.</text>

			</paragraph></section><section id="H5FA92FC1E18345C487AE403CC540073"><enum>4.</enum><header>Designation of

			 portions of Musconetcong River, New Jersey, as scenic and recreational

			 rivers</header>

			<subsection id="H2EE1D1DF5C4B455989B870755126CEB3"><enum></enum><text>Section 3(a) of

			 the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)) is amended by adding at the

			 end the following:</text>

					<paragraph id="HA83EF33E5B4C4A14B7EA51DAA019247E" indent="up1"><enum>(167)</enum><header>Musconetcong River, New

				Jersey</header>

						<subparagraph id="id7B8835546823447BB95610FD355B7214"><enum>(A)</enum><header>Designation</header><text>The 24.2

				miles of river segments in New Jersey, consisting of—</text>

							<clause id="H626B4D4AF5F94652B1854D8E250019FC"><enum>(i)</enum><text>the approximately 3.5-mile segment

				from Saxton Falls to the Route 46 bridge, to be administered by the Secretary

				of the Interior as a scenic river; and</text>

							</clause><clause id="HCAEDA746CF954D8FAA81EDB6BD796E89"><enum>(ii)</enum><text>the approximately 20.7-mile

				segment from the Kings Highway bridge to the railroad tunnels at Musconetcong

				Gorge, to be administered by the Secretary of the Interior as a recreational

				river.</text>

							</clause></subparagraph><subparagraph id="HA220132DC2D3418ABC60008B9594C615"><enum>(B)</enum><header>Administration</header><text>Notwithstanding

				section 10(c), the river segments designated under subparagraph (A) shall not

				be administered as part of the National Park

				System.</text>

						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section id="id209E7F291ED84937ABC2ACFE508D62CB"><enum>5.</enum><header>Management</header>

			<subsection id="H42154E9DE45A4EC19F2700B25314B4EA"><enum>(a)</enum><header>Management

			 plan</header>

				<paragraph id="id38F6D4DDB0F04ACCBBCB93140B1CBA3D"><enum>(1)</enum><header>In

			 general</header><text>The Secretary shall manage the river segments in

			 accordance with the management plan.</text>

				</paragraph><paragraph id="HEEBEB3C3619B4842BA61002D955BF8C"><enum>(2)</enum><header>Satisfaction of

			 requirements for plan</header><text>The management plan shall be considered to

			 satisfy the requirements for a comprehensive management plan for the river

			 segments under section 3(d) of the Wild and Scenic Rivers Act (16 U.S.C.

			 1274(d)).</text>

				</paragraph><paragraph id="HBD0C0C815FC148C9A9AF68FA00A65889"><enum>(3)</enum><header>Restrictions on

			 water resource projects</header><text>For purposes of determining whether a

			 proposed water resources project would have a direct and adverse effect on the

			 values for which a river segment is designated as part of the Wild and Scenic

			 Rivers System under section 7(a) of the Wild and Scenic Rivers Act (16 U.S.C.

			 1278(a)), the Secretary shall consider the extent to which the proposed water

			 resources project is consistent with the management plan.</text>

				</paragraph><paragraph id="id96163767D3454737B570D3A28FFFC808"><enum>(4)</enum><header>Implementation</header><text>The

			 Secretary may provide technical assistance, staff support, and funding to

			 assist in the implementation of the management plan.</text>

				</paragraph></subsection><subsection id="H4324CD5BDD1E496F95A6C0918274D60"><enum>(b)</enum><header>Cooperation</header>

				<paragraph id="id20E11A5173574D6AA736B38DCBC0F7B1"><enum>(1)</enum><header>In

			 general</header><text>The Secretary shall manage the river segments in

			 cooperation with appropriate Federal, State, regional, and local agencies,

			 including—</text>

					<subparagraph id="H829B2FCBFB4A42F6AAF6989172915159"><enum>(A)</enum><text>the Musconetcong

			 River Management Committee;</text>

					</subparagraph><subparagraph id="H1E831B27DC5E466D852DA1693F015103"><enum>(B)</enum><text>the Musconetcong

			 Watershed Association;</text>

					</subparagraph><subparagraph id="H4B517C4A93D9498989DCAB2044096E00"><enum>(C)</enum><text>the Heritage

			 Conservancy;</text>

					</subparagraph><subparagraph id="HB07071A5E0384C31898183E2742FBD77"><enum>(D)</enum><text>the National Park

			 Service; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF995EE0FEDB445DF9980919F980C040C"><enum>(E)</enum><text>the New Jersey

			 Department of Environmental Protection.</text>

					</subparagraph></paragraph><paragraph id="H96467B84629B4B829BEF446DDF304B1C"><enum>(2)</enum><header>Cooperative

			 agreements</header><text>Any cooperative agreement entered into under section

			 10(e) of the Wild and Scenic Rivers Act (16 U.S.C. 1281(e)) relating to a river

			 segment—</text>

					<subparagraph id="HE3F09338A0E44733AEB51DDEB72EBA68"><enum>(A)</enum><text>shall be

			 consistent with the management plan; and</text>

					</subparagraph><subparagraph id="HC8EE491E42A94ED1B7CDB552B540F193"><enum>(B)</enum><text>may include

			 provisions for financial or other assistance from the United States to

			 facilitate the long-term protection, conservation, and enhancement of the river

			 segment.</text>

					</subparagraph></paragraph></subsection><subsection id="HD7087F57EE994DD3A34DC476F3A9B31"><enum>(c)</enum><header>Land

			 management</header>

				<paragraph id="H4E085BAE56D447E490088427A08EAFA"><enum>(1)</enum><header>In

			 general</header><text>The Secretary may provide planning, financial, and

			 technical assistance to local municipalities and nonprofit organizations to

			 assist in the implementation of actions to protect the natural and historic

			 resources of the river segments.</text>

				</paragraph><paragraph id="HBADEB5166CFC499186E72EFF859BBD83"><enum>(2)</enum><header>Plan

			 requirements</header><text>After adoption of recommendations made in section IV

			 of the management plan, the zoning ordinances of the municipalities bordering

			 the segments shall be considered to satisfy the standards and requirements

			 under section 6(c) of the Wild and Scenic Rivers Act (16 U.S.C.

			 1277(c)).</text>

				</paragraph></subsection><subsection id="H8A2B3D9FDFE9463E89BBCA2FFD250259"><enum>(d)</enum><header>Designation of

			 additional river segment</header>

				<paragraph id="H8D61E42661A540F3A48037A1C9F218F0"><enum>(1)</enum><header>Finding</header><text>Congress

			 finds that the additional river segment is suitable for designation as a

			 recreational river if the Secretary determines that there is adequate local

			 support for the designation of the additional river segment in accordance with

			 paragraph (3).</text>

				</paragraph><paragraph id="HB10EBA6EB4D9450BB400523F0078C3E"><enum>(2)</enum><header>Designation and

			 administration</header><text>If the Secretary determines that there is adequate

			 local support for designating the additional river segment as a recreational

			 river—</text>

					<subparagraph id="H93B2B713185345C8A966E8660024E190"><enum>(A)</enum><text>the Secretary

			 shall publish in the Federal Register notice of the designation of the

			 segment;</text>

					</subparagraph><subparagraph id="H278F90858A804EB49B7062DC00C222A0"><enum>(B)</enum><text>the segment shall

			 be designated as a recreational river in accordance with the Wild and Scenic

			 Rivers Act (16 U.S.C. 1271 et seq.); and</text>

					</subparagraph><subparagraph id="HBDAF9DF795BD41A983112107F5EFF16"><enum>(C)</enum><text>the Secretary shall

			 administer the additional river segment as a recreational river.</text>

					</subparagraph></paragraph><paragraph id="H7B49FBAACC764504AEB559B2A1790328"><enum>(3)</enum><header>Criteria for

			 local support</header><text>In determining whether there is adequate local

			 support for the designation of the additional river segment, the Secretary

			 shall consider the preferences of local governments expressed in resolutions

			 concerning designation of the additional river segment.</text>

				</paragraph></subsection><subsection id="HAC1CFD171594428A982FCA86D7C02C99"><enum>(e)</enum><header>Authorization of

			 appropriations</header><text>There are authorized to be appropriated such sums

			 as are necessary to carry out this Act and the amendments made by this

			 Act.</text>
