		  establish procedures for the reinstatement of leases terminated due to

		  unforeseeable circumstances.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H6F30577B68ED420488009D09BA46984" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Mineral Leasing Act Amendments of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HEB6906CAD15446FD9E41EF67EB5530E4" section-type="subsequent-section"><enum>2.</enum><header>Reinstatement of

			 leases</header><text display-inline="no-display-inline">Section 31(d) of the

			 Mineral Leasing Act (30 U.S.C. 188(d)) is amended by striking paragraph (2) and

			 inserting the following:</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id6CCE3B45DDEE46829D508021F5F372EE"><enum>(2)</enum><header>Requirement</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="id0AFE5405C84D46BC93A143E635840A42"><enum>(A)</enum><header>In

				general</header><text display-inline="yes-display-inline">A lease shall not be

				reinstated under paragraph (1) unless—</text>

						<clause commented="no" display-inline="no-display-inline" id="idCD094D0696B34650B87CF2CBD61C1330"><enum>(i)</enum><text display-inline="yes-display-inline">for a lease canceled under subsection (b)

				during the period beginning on September 1, 2001, and ending on the date that

				is 60 days after the date of enactment of the Mineral Leasing Act Amendments of

				2005, a lessee files a petition for reinstatement of the lease (together with

				any required back rent or royalty payment accruing after the date of

				termination of the lease) not later than the later of—</text>

							<subclause commented="no" display-inline="no-display-inline" id="idD2B028291C844782AD13CFB227580CA6"><enum>(I)</enum><text display-inline="yes-display-inline">the date that is 120 days after the date of

				enactment of the Mineral Leasing Act Amendments of 2005; or</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="id47E2D7D17A24400FA8502C1DCB424408"><enum>(II)</enum><text display-inline="yes-display-inline">the date that is 60 days after the date of

				receipt by the lessee of a notice of termination of the lease from the

				Secretary by certified mail; or</text>

							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC01314FE5E8E41E4902585FB485B436"><enum>(ii)</enum><text display-inline="yes-display-inline">for a lease canceled under subsection (b)

				after the date that is 60 days after the date of enactment of the Mineral

				Leasing Act Amendments of 2005, a lessee files a petition for reinstatement of

				the lease (together with any required back rent or royalty payment accruing

				after the date of termination of the lease) on or before the date that is 60

				days after the date of receipt by each lessee of record of the notice of

				termination of the lease from the Secretary by certified mail.</text>

						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26880381A4C6440E94FC1CD33F0267FC"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Subparagraph (A) shall not apply to a

				lessee that received a notice of termination from the Secretary on a date that

				is not later than 13 months after the date of termination of the

				lease.</text>
