			 petitions</header><text display-inline="no-display-inline">Section 2254(b) of

			 title 28, United States Code, is amended—</text>

			<paragraph id="IDA10B732F841E4DF985F51E348C739B32"><enum>(1)</enum><text>in paragraph (1),

			 by striking subparagraphs (A) and (B) and inserting the following:</text>

				<quoted-block id="ID508D5D42E6EF4B2DA1C90A5926413EA1">

					<subparagraph id="ID1FA50E18A9DB4036AB2443CD87AB97FF" indent="up1"><enum>(A)</enum><text>the applicant—</text>

						<clause id="IDAA3D325C76554075A5B75312F2C06117"><enum>(i)</enum><text>has exhausted the remedies

				available in the courts of the State by fairly presenting and arguing the

				specific Federal basis for each claim in the State courts; and</text>

						</clause><clause id="ID6063AC9ADB354A79B345B1F2F9AA3896"><enum>(ii)</enum><text>has described in the application

				how the applicant has exhausted each claim in the State courts; or</text>

						</clause></subparagraph><subparagraph id="IDBE460BD17D0F48EEA094472CB84F9B35" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="IDC6364BAACBAF4525A3115C33E1300D45"><enum>(i)</enum><text>the application

				presents a claim for relief that would qualify for consideration on the grounds

				described in subsection (e)(2); and</text>

						</clause><clause id="IDE989B41F93DF454B825A0EB33A685174" indent="up1"><enum>(ii)</enum><text>the denial of such relief is contrary

				to, or would entail an unreasonable application of, clearly established Federal

				law, as determined by the Supreme Court of the United

				States.</text>

						</clause></subparagraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

			</paragraph><paragraph id="ID309C63CB9F7D4EE49D6CC28A314D3865"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="ID3A4F25D8B21D43BC92893B1578D59F8F" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="ID0AFC5FB4F44648C699FC8CD1F87E6E22" indent="up1"><enum>(4)</enum><text>Any unexhausted claim that does not

				qualify for consideration on the grounds described in this subsection shall be

				dismissed with

				prejudice.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="ID72BFC362A0D346F29FE8136973129C7C"><enum>3.</enum><header>Amendments to

			 petitions</header>

			<subsection id="IDD0182A8CECEC408681807271791679F7"><enum>(a)</enum><header>In

			 general</header><text>Section 2244 of title 28, United States Code, is amended

			 by adding at the end the following:</text>

				<quoted-block id="ID2CB3DDA97D864F22A0F2B6632192F08D">

					<subsection id="ID20659F92CB744E15A9CF8CD567E25ECD"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="ID2B0D40C34253481FA326404BA07D83D3"><enum>(1)</enum><text>An application for a

				writ of habeas corpus may be amended once as a matter of course before the

				earlier of the date on which an answer to the application is filed or the

				expiration of the 1-year period described in subsection (d).</text>

						</paragraph><paragraph id="ID5A458759CE624973AD3FCA60A4FFAE90" indent="up1"><enum>(2)</enum><text>Except as provided under paragraph

				(1), an application may not be amended to modify existing claims or to present

				additional claims, unless the modified or newly presented claims would qualify

				for consideration on the grounds described in subsection

				(b)(2).</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="ID3D0B8A3D0DC74B5096F7D43622385D68"><enum>(b)</enum><header>Conforming

			 amendment</header><text>Section 2242 of title 28, United States Code, is

			 amended in the third undesignated paragraph by striking <quote>in the rules of

			 procedure applicable to civil actions</quote> and inserting <quote>under

			 section 2244(e)</quote>.</text>

			</subsection></section><section id="IDA1ABC8F05FAA40D7B840439B223DAC98"><enum>4.</enum><header>Procedurally

			 defaulted claims</header>

			<subsection id="ID5CE798EF5C5941419E1251958FBBA98A"><enum>(a)</enum><header>In

			 general</header><text>Section 2254 of title 28, United States Code, is

			 amended—</text>

				<paragraph id="ID98274A7C51BD463CBC54960B60A3D665"><enum>(1)</enum><text>by redesignating

			 subsections (h) and (i) as subsections (i) and (j), respectively; and</text>

				</paragraph><paragraph id="ID0A357E489F0E4F779F3116EE164094B3"><enum>(2)</enum><text>by adding after

			 subsection (g) the following:</text>

					<quoted-block id="IDC562C74606E94F0396517B893A7F7793">

						<subsection id="ID15DE8387E44F4364A131ED3EA0950D27"><enum>(h)</enum><paragraph commented="no" display-inline="yes-display-inline" id="ID7A779766095F49C2A585827E6B9C0AC9"><enum>(1)</enum><text>A court, justice, or

				judge shall not have jurisdiction to consider an application for a writ of

				habeas corpus on behalf of a person in custody pursuant to the judgment of a

				State court with respect to any claim that was found by the State court to be

				procedurally barred, or any claim of ineffective assistance of counsel related

				to such claim, unless—</text>

								<subparagraph id="ID52A2139E31CD420698D7296AB0B7A0E0" indent="up1"><enum>(A)</enum><text>the claim would qualify for

				consideration on the grounds described in subsection (e)(2); or</text>

								</subparagraph><subparagraph id="IDE411D83B7E624C7AA744E4FC3253F237" indent="up1"><enum>(B)</enum><text>the State, through counsel, expressly

				waives the provisions of this paragraph.</text>

								</subparagraph></paragraph><paragraph id="ID965319B1BEC84ACB99FFBE3C108481F9" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID4A7F89546F024F1BAAF113C5FEDDCA1F"><enum>(A)</enum><text>A court, justice, or

				judge shall not have jurisdiction to consider any claim that the State court

				denies on the merits and on the ground that the claim was not properly raised

				under State procedural law, or any claim of ineffective assistance of counsel

				related to such claim, unless the claim would qualify for consideration on the

				grounds described in subsection (e)(2).</text>

								</subparagraph><subparagraph id="IDA54B5CC567824CE68179FB9E50EA1C44" indent="up1"><enum>(B)</enum><text>A court, justice, or judge shall not

				have jurisdiction to consider any claim that is otherwise subject to paragraph

				(1) and that was reviewed by the State court for plain error, fundamental

				error, or under a similarly heightened standard of review, unless the claim

				would qualify for consideration on the grounds described in subsection

				(e)(2).</text>

								</subparagraph></paragraph><paragraph id="ID96e61b6d71244bad8a5bf960410f37c8" indent="up1"><enum>(3)</enum><text>The State shall not be required to

				answer any claim described in paragraph (1) or (2) unless the court first

				determines that the claim would qualify for consideration on the grounds

				described in subsection (e)(2).</text>

							</paragraph><paragraph id="ID2A671F0C200E483184F638DDA2052D4C" indent="up1"><enum>(4)</enum><text>If a court determines that a State

				court order denying relief on procedural grounds is ambiguous as to which

				claims were found to be procedurally barred, the court shall resolve any

				perceived ambiguity, if necessary, by examining the full record in the State

				court.</text>

							</paragraph><paragraph id="ID52C846C41FEE4163B01424B3B9EE9783" indent="up1"><enum>(5)</enum><text>An application for a writ of habeas

				corpus on behalf of a person in custody pursuant to the judgment of a State

				court shall not be granted with respect to any claim under paragraph (1) or (2)

				unless the denial of such relief is contrary to, or would entail an

				unreasonable application of, clearly established Federal law, as determined by

				the Supreme Court of the United

				States.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDFABCF1C0FFB940D5AAE7F556593C8D3F"><enum>(b)</enum><header>Limitation</header><text>Section

			 2244(d)(2) of title 28, United States Code, as amended by section 3, is amended

			 by adding at the end the following: <quote>An application that was otherwise

			 improperly filed in State court shall not be deemed to have been properly filed

			 because the State court exercises discretion in applying a rule or recognizes

			 exceptions to that rule.</quote>.</text>

			</subsection></section><section id="IDE710A46A20E64976AB9D1AAE0EE644A4"><enum>5.</enum><header>Tolling of

			 limitation period</header><text display-inline="no-display-inline">Section

			 2244(d) of title 28, United States Code, is amended—</text>

			<paragraph id="IDDA1B3B0FA8754F02BEC93591EB20D3C3"><enum>(1)</enum><text>in paragraph (2),

			 by striking <quote>judgment or</quote>; and</text>

			</paragraph><paragraph id="ID588BD70F5E514D63B39E22BCA1616864"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="idB157630B154D4F48A107F753C11A2C04" style="OLC">

					<paragraph id="IDEB58695DCD2C4FC688C6D0D18051496F" indent="up1"><enum>(3)</enum><text>In this section, an application for

				State post-conviction or other collateral review—</text>

						<subparagraph id="ID261808B65B92458E8CA193909E0E48E2"><enum>(A)</enum><text>is pending from the date on which the

				application is filed with a State court until the date on which the same State

				court rules on that application; and</text>

						</subparagraph><subparagraph id="ID078DFD01FAB64AF99F31860F3A236708"><enum>(B)</enum><text>is not pending during any period of

				time between the date on which a State court rules on that application and the

				date on which the application or a related application is filed, or is

				otherwise presented, for adjudication to such State court on rehearing

				authorized by State law or to a higher State court.</text>

						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID775CB4106EC643D598875D64299B8A92" indent="up1"><enum>(4)</enum><text>The period of limitation under

				paragraph (1) may be tolled, suspended, or extended only as provided under this

				subsection.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="IDFF0F22B448914689A523F4F349AA40F0"><enum>6.</enum><header>Harmless error

			 in sentencing</header><text display-inline="no-display-inline">Section 2254 of

			 title 28, United States Code, as amended by section 4, is amended by adding at

			 the end the following:</text>

			<quoted-block display-inline="no-display-inline" id="IDB15D9C332AEA4556BC8B29A8117B6A76" style="OLC">

				<subsection commented="no" display-inline="no-display-inline" id="ID8CB877E7BBA6475AB99A95964CFCC014"><enum>(k)</enum><text>A court, justice,

				or judge shall not have jurisdiction to consider an application with respect to

				an error relating to the applicant’s sentence or sentencing that has been found

				to be harmless or not prejudicial in State court proceedings, unless a

				determination that the error is not structural is contrary to clearly

				established Federal law, as determined by the Supreme Court of the United

				States.</text>

				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

		</section><section id="IDEDFEA72EEC404FF2AD0545A4FC205C6E"><enum>7.</enum><header>Unified review

			 standard</header><text display-inline="no-display-inline">Section 107(c) of the

			 Antiterrorism and Effective Death Penalty Act of 1996 (28 U.S.C. 2261 note) is

			 amended by striking <quote>Chapter 154 of title 28, United States Code (as

			 amended by subsection (a))</quote> and inserting <quote>This title and the

			 amendments made by this title</quote>.</text>

		</section><section id="IDd6ff349151a54b518b73b20cfa0973ac"><enum>8.</enum><header>Appeals</header>

			<subsection id="idAE8B64DA24EC4DFEB4450729938C6FB9"><enum>(a)</enum><header>Appellate time

			 limits</header><text display-inline="yes-display-inline">Section 2254 of title

			 28, United States Code, as amended by sections 4 and 6, is further amended by

			 adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id94ED6ADACDB04D2ABABAD73779939845" style="OLC">

					<subsection id="IDd4affeacb92f49a28c74bcdbad316b62"><enum>(l)</enum><text>In review by a

				court of appeals of a district court’s determination of an application for a

				writ of habeas corpus on behalf of a person in custody pursuant to the judgment

				of a State court, the following shall apply:</text>

						<paragraph id="IDae8f0d2644b5484384b21d1964267acf"><enum>(1)</enum><text>A timely filed

				notice of appeal from an order issuing a writ of habeas corpus shall operate as

				a stay of that order, pending final disposition of the appeal.</text>

						</paragraph><paragraph id="ID024cd5699f5d4952b5ea32a9acd5da0b"><enum>(2)</enum><text>A court of

				appeals shall decide the appeal from an order granting or denying a writ of

				habeas corpus—</text>

							<subparagraph id="ID520fc9cf55f54144b6db0db2944eecac"><enum>(A)</enum><text>not later than

				300 days after the date on which the brief of the appellee is filed or, if no

				timely brief is filed, the date on which such brief is due; or</text>

							</subparagraph><subparagraph id="ID7fd8d958ea7446c08f5fb07ada7f12a2"><enum>(B)</enum><text>if a cross-appeal

				is filed, not later than 300 days after the date on which the appellant files a

				brief in response to the issues presented by the cross-appeal or, if no timely

				brief is filed, the date on which such brief is due.</text>

							</subparagraph></paragraph><paragraph id="ID2e75397429b54b3bb5f0c467f790a6f6"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id93FFAF484AD54D89A6AD7E7F907230B4"><enum>(A)</enum><text>If a petition is filed

				for a panel rehearing or rehearing by the court of appeals en banc following a

				decision by a panel of a court of appeals under paragraph (2), the court of

				appeals shall decide whether to grant the petition not later than 90 days after

				the date on which the petition is filed, unless a response is required.</text>

							</subparagraph><subparagraph id="id9E9E1A30FA1440AA866AC7B2BB5964FA" indent="up1"><enum>(B)</enum><text>If a response to a petition is

				required under subparagraph (A), a court of appeals shall decide whether to

				grant the petition not later than 90 days after the date on which the response

				is filed or, if no timely response is filed, the date on which the response is

				due.</text>

							</subparagraph><subparagraph id="idA9A53E57AE7B4F0DA976D42BB29ADDF9" indent="up1"><enum>(C)</enum><text>If a panel rehearing is granted, the

				panel shall make a determination of the appeal on rehearing not later than 120

				days after the date on which the order granting a panel rehearing is entered.

				No second or successive petition for panel rehearing shall be allowed.</text>

							</subparagraph><subparagraph id="idDD7BC7CB405048DB9A65CF6E4733E535" indent="up1"><enum>(D)</enum><text>If rehearing en banc is granted, the

				court of appeals shall make a final determination of the appeal not later than

				180 days after the date on which the order granting rehearing en banc is

				entered.</text>

							</subparagraph></paragraph><paragraph id="IDf327be3e379a4bbb8f619567d3ca7c07"><enum>(4)</enum><text>If a court of

				appeals fails to comply with the requirements of this subsection, the State may

				petition the Supreme Court, or a justice thereof, for a writ of mandamus to

				enforce the requirements of this subsection.</text>

						</paragraph><paragraph id="ID404c49a012ab49488c2bb9ceaf53fe3f"><enum>(5)</enum><text>The time

				limitations in this subsection shall apply in all proceedings in a court of

				appeals on review of a district court’s determination of an application for a

				writ of habeas corpus, including any such proceedings in a court of appeals

				following a remand by the Supreme Court for further proceedings.</text>

						</paragraph><paragraph id="IDd1ed21af13cb4c1e827603edf35a8ad1"><enum>(6)</enum><text>In proceedings

				following remand in a court of appeals, the time limit specified in paragraph

				(2) shall begin on the date the remand is ordered if further briefing is not

				required in the court of appeals. If there is further briefing in the court of

				appeals, the time limit specified in paragraph (2) shall begin on the date on

				which a responsive brief is filed or, if no timely responsive brief is filed,

				from the date on which such brief is due.</text>

						</paragraph><paragraph id="ID5c15cb3bcc2040e0834caa6003ed5b78"><enum>(7)</enum><text>The failure of a

				court to meet or comply with a time limitation under this subsection shall not

				be a ground for granting relief from a judgment of conviction or sentence, nor

				shall the time limitations under this subsection be construed to entitle a

				capital applicant to a stay of execution, to which the applicant would

				otherwise not be entitled, for the purpose of litigating any application or

				appeal.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="id866ACDBBE5E9457C84F8B2242552758A"><enum>(b)</enum><header>Finality of

			 determination</header><text>Section 2244(b)(3)(E) of title 28, United States

			 Code, is amended by striking <quote>the subject of a petition</quote> and all

			 that follows and inserting the following: <quote>reheard in the court of

			 appeals or reviewed by writ of certiorari.</quote>.</text>

			</subsection></section><section id="id22940B933D024B7F87FB4DEBCAE10114"><enum>9.</enum><header>Capital

			 cases</header>

			<subsection id="ID7665762afa614187a1c8dce08f7b2be3"><enum>(a)</enum><header>Scope of

			 review</header><text>Chapter 154 of title 28, United States Code, is amended by

			 striking section 2264 and inserting the following:</text>

				<quoted-block act-name="" display-inline="no-display-inline" id="id9475AD9F02A847B78593BF277ADC80E5" style="USC">

					<section id="idE319C39109994EDE9A4B6B430E80F7B6"><enum>2264.</enum><header>Scope of

				Federal review</header>

						<subsection id="id1526A2BEC5024CB9ADBF731335C3357A"><enum>(a)</enum><header>In

				general</header><text display-inline="yes-display-inline">Except as provided in

				subsection (b), a court, justice, or judge shall not have jurisdiction to

				consider any claim relating to the judgment or sentence in an application

				covered under this chapter.</text>

						</subsection><subsection id="idE7B7B1BC480F4DB2AC01FD5F18B981BE"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">A court, justice, or judge has jurisdiction

				to consider an application under this chapter if—</text>

							<paragraph id="id64106817F2C54AB8B3E2978910BCE1C2"><enum>(1)</enum><text display-inline="yes-display-inline">the applicant shows that the claim relies

				on a new rule of constitutional law, made retroactive to cases on collateral

				review by the Supreme Court, that was previously unavailable; or</text>

							</paragraph><paragraph id="idCB7126105F4E4AADBF452928BCE05D4E"><enum>(2)</enum><text display-inline="yes-display-inline">both—</text>

								<subparagraph id="id88BB77932D6442DAAFD3FB5659533FDD"><enum>(A)</enum><text display-inline="yes-display-inline">the factual predicate for the claim could

				not have been discovered previously through the exercise of due diligence;

				and</text>

								</subparagraph><subparagraph id="id95AE374431C745BC8F1E3BEEFE820AC8"><enum>(B)</enum><text display-inline="yes-display-inline">the facts underlying the claim, if proven

				and viewed in light of the evidence as a whole, would be sufficient to

				establish by clear and convincing evidence that, but for constitutional error,

				no reasonable fact finder would have found the applicant guilty of the

				underlying

				offense.</text>

								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="id04532AF4A03848A491876D07ED138DAB"><enum>(b)</enum><header>Time

			 limits</header><text>Section 2266(b)(1)(A) of title 28, United States Code, is

			 amended by striking <quote>180 days</quote> and inserting <quote>15

			 months</quote>.</text>

			</subsection><subsection id="idC55395537A2940AEB4BBE2B5EFC3D8DB"><enum>(c)</enum><header>Review by

			 Attorney General</header>

				<paragraph id="idC0AF1BE29C00477A92818846327655B9"><enum>(1)</enum><header>In

			 general</header><text>Section 2261(b) of title 28, United States Code, is

			 amended—</text>

					<subparagraph id="id8E0D10A358D24AFEB6F05A9298EAA76B"><enum>(A)</enum><text>by striking

			 <quote>(b) This chapter is applicable if a State establishes</quote> and

			 inserting the following:</text>

							<subsection id="id47E92E3812AB473C935D33993F6644D5"><enum>(b)</enum><text>This chapter is

				applicable if—</text>

								<paragraph id="id6055E2CFC59F41AEACCF37CF3FA503C8"><enum>(1)</enum><text>the Attorney

				General of the United States certifies that a State has

				established</text>

								</paragraph></subsection><after-quoted-block>;

				</after-quoted-block></quoted-block>

					</subparagraph><subparagraph id="idE114CB192FCD45D594BB2D17536569D9"><enum>(B)</enum><text>in the first

			 sentence, by striking the period at the end and inserting a semicolon;</text>

					</subparagraph><subparagraph id="id96982BA99C3A49DAB8F4D83AA1B467BA"><enum>(C)</enum><text>by striking

			 <quote>The rule of court or statute must provide standards</quote> and

			 inserting the following:</text>

						<quoted-block display-inline="no-display-inline" id="idCE81CB9D0A8E4BDA99A0F382B8E23EE8" style="OLC">

							<paragraph id="id4A7B63F93A2A4BDB8659E886D3D72F27"><enum>(2)</enum><text>the court,

			 conforming amendments</header><text>Section 2265(a) of title 28, United States

			 Code, is amended—</text>

					<subparagraph id="id82F699BF6EEB4EDEAFFC1A817AAA8A6D"><enum>(A)</enum><text>by striking

			 <quote>(a) For purposes</quote> and inserting the following:</text>

				States certifies that a State has

				established</text>

								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph><subparagraph id="ID977fcb1d22b9493391d7034cd357e566"><enum>(C)</enum><text>by striking

			 <quote>or by statute</quote> and inserting <quote>, by statute, or by agency

			 rule</quote>;</text>

					</subparagraph><subparagraph id="idDB16856C668242AC9175992E17C1262E"><enum>(D)</enum><text>by striking the

			 period after <quote>proceedings</quote> and inserting a semicolon;</text>

					</subparagraph><subparagraph id="ID06b494411f334e3b980e3cc13c3adad0"><enum>(E)</enum><text>by striking

			 <quote>The rule of court or statute must provide</quote> and inserting the

			 following:</text>

					</subparagraph><subparagraph id="id1C9FF5C864814F83BE04CF9E0B5E2E3B"><enum>(F)</enum><text>by striking the

			 period at the end and inserting <quote>; and</quote>; and</text>

					</subparagraph><subparagraph id="id1BAC27F686244A219538F0F268B2F4A4"><enum>(G)</enum><text>by adding at the

			 end the following:</text>

							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

					</subparagraph></paragraph></subsection><subsection id="id19D13D922BDC4EEF9DB4F8B66875BE39"><enum>(d)</enum><header>Judicial

			 review</header><text>Chapter 154 of title 28, United States Code, is amended by

			 adding at the end the following:</text>

				<quoted-block act-name="" display-inline="no-display-inline" id="id8DD741EA85C745A1AD4C352C4EAFA618" style="USC">

					<section id="idB8F9991496804A438955140C956C412C"><enum>2267.</enum><header>Judicial

				Review</header>

						<subsection id="ID3d569cc12cd54fa692815ccd09ddf9e0"><enum>(a)</enum><header>In

				general</header><text>If requested by the chief law enforcement officer of a

				State, the Attorney General of the United States shall determine whether the

				State has established a qualifying mechanism for the purpose of section

				2261(b)(3) or 2265(a)(2)(C), and, if so, the date on which the mechanism was

				established. The date the mechanism was established shall be the effective date

				of the certification.</text>

						</subsection><subsection id="ID921a9293aa704296a87ac585d8c96e08"><enum>(b)</enum><header>Regulations</header><text>The

				Attorney General shall promulgate regulations to implement the certification

				procedure under subsection (a).</text>

						</subsection><subsection id="ID2e7765f7ec874fde9ddbacc9b7d3d9e1"><enum>(c)</enum><header>Review of

				certification</header>

							<paragraph id="id0A71AA700E2F4531B2D9687E8C6B92B2"><enum>(1)</enum><header>In

				general</header><text>The Attorney General's determination of whether to

				certify a State under this section is subject to review exclusively as provided

				under chapter 158.</text>

							</paragraph><paragraph id="idAFE53E94594B41D0829C47AA35CC51D9"><enum>(2)</enum><header>Venue</header><text>The

				Court of Appeals for the District of Columbia Circuit shall have exclusive

				jurisdiction over matters under paragraph (1), subject to review by the Supreme

				Court under section 2350.</text>

							</paragraph><paragraph id="id44EB5EA852E942C1AF15D587AF2621D5"><enum>(3)</enum><header>Standard of

				review</header><text>The Attorney General's determination of whether to certify

				a State under this section shall be conclusive unless manifestly contrary to

				the law and an abuse of

				discretion.</text>

							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection id="id36D4F2F4237149CC8814F3C2AD8DC09B"><enum>(e)</enum><header>Clerical

			 Amendments</header><text>The table of sections for chapter 154 of title 28,

				executive clemency or pardon power, or the process or procedures used under

				such power.</text>

						</subsection><subsection id="ID4a6c160313cc45f2bb4b4323c31c1d4f"><enum>(b)</enum><header>Exception</header><text>This

				section does not affect the jurisdiction of the Supreme Court to review any

				decision of the highest court of a State that involves a cause or claim arising

				from the exercise of a State’s executive clemency or pardon power, or the

				process or procedures used under such

				power.</text>

			<paragraph id="idAB0AFC2516C645058FA949428BC9BF5E"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>(9) Upon</quote> and

			 inserting the following: <quote>(9) (A) Upon</quote>;</text>

			</paragraph><paragraph id="id00BA879C37614716B1A485EC9087FA84"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the last two sentences and

			 inserting the following: <quote>An application for services under this

			 paragraph shall be decided by a judge other than the judge presiding over the

			 post conviction proceeding under section 2254 or 2255 of Title 28, United

			 States Code, seeking to vacate or set aside a death sentence. Any amounts

			 authorized to be paid under this paragraph shall be disclosed to the public

			 immediately.</quote>; and</text>

			</paragraph><paragraph id="id40B7016C8B14497B866F6FE684E88957"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id22B869EAF3264E6C980CD4DB58FE793C" style="OLC">

					<subparagraph id="id2F36C35FF6C04F0DB57720A8CC9A6BB6" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">No

				ex parte proceeding, communication, or request may be considered in a

				post-conviction action pursuant to this section, except to the extent necessary

				to protect any confidential-communications privilege between the defendant and

				post-conviction counsel. The court shall not grant an application for an ex

				parte proceeding, communication, or request unless the application has been

				served upon the respondent and the court has allowed the respondent a

				reasonable opportunity to answer the application. All proceedings,

				communications, or requests conducted pursuant to this section shall be

				transcribed and made a part of the record available for appellate

				review.</text>

					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="idC9FD8D32482D41D8B50809D55CB1CC42"><enum>12.</enum><header>Crime victims'

			 rights</header><text display-inline="no-display-inline">Section 3771(b) of

			 title 18, United States Code, is amended by adding at the end the following:

			 <quote>A crime victim shall also be afforded the rights established for crime

			 victims by this section in a Federal habeas corpus proceeding arising out of a

			 State conviction.</quote>.</text>

		</section><section id="idE45F4117D2B544369249F645BF82AD50"><enum>13.</enum><header>Technical

			 corrections</header>

			<subsection id="id94E1A96A574B4BB98FE81AC4F3BC3078"><enum>(a)</enum><header>Appeal</header><text>Section

			 2253(c)(1) of title 28, United States Code, is amended by striking

			 <quote>circuit justice or judge</quote> and inserting <quote>district or

			 circuit judge</quote>.</text>

			</subsection><subsection id="idAED16A7F9F3B4F5F8EA4FE2412724408"><enum>(b)</enum><header>Federal

			 custody</header><text>Section 2255 of title 28, United States Code, is amended

			 by designating the 8 undesignated paragraphs as subsections (a) through (h),

			 respectively.</text>

			</subsection></section><section id="id93CEF99F4CD34F8CADAA160D094500A7"><enum>14.</enum><header>Application to

			 pending cases</header>

			<subsection id="id481185D6AF4E40E1B746AF659069CB8A"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">This Act and the

			 amendments made by this Act shall apply to cases pending on and after the date

			 of enactment of this Act.</text>

			</subsection><subsection id="idF57F3AACCFFB4E84BF2A61762F082DEE"><enum>(b)</enum><header>Time

			 limits</header><text>In a case pending on the date of enactment of this Act, if

			 the amendments made by this Act establish a time limit for taking certain

			 action the period of which began on the date of an event that occurred prior to

			 the date of enactment of this Act, the period of such time limit shall instead

			 begin on the date of enactment of this Act.</text>
