			 Wetterling, Megan Nicole Kanka, &amp; Pam Lychner Sex Offender Registration and

			 Notification Program</header>

				<subsection id="HAAD36A26CF8247B0B2FF83DC3FAE4B7D"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Attorney General

			 shall carry out this title through a program to be known as the Jacob

			 Wetterling, Megan Nicole Kanka, &amp; Pam Lychner Sex Offender Registration and

			 Notification Program.</text>

				</subsection><subsection id="HF31F98CB60D24004AC00A945E4AE4CD8"><enum>(b)</enum><header>References to

			 former program or former law</header><text display-inline="yes-display-inline">Any reference (other than a reference in

			 this Act) in a law, regulation, document, paper, or other record of the United

			 States to the program carried out under subtitle A of title XVII of the Violent

			 Crime Control and Law Enforcement Act of 1994 (42 U.S.C. 14071 et seq.), or to

			 any provision of that subtitle, shall be deemed to be a reference to the

			 program referred to in subsection (a), or to the appropriate provision of this

			 title, as the case may be.</text>

				</subsection></section><section id="H41D97EC74C634150A55DADA0BF4E621E"><enum>102.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

				<paragraph id="H92916C05ABB14DA987CA95ECEC006D64"><enum>(1)</enum><header>Covered

			 individual</header><text>The term <term>covered individual</term> means any of

			 the following:</text>

					<subparagraph id="H36C83A366A9B464898928C31C2BB2434"><enum>(A)</enum><text>An individual who

			 has been convicted of a covered offense against a minor.</text>

					</subparagraph><subparagraph id="H32E657C302094A96AD35BDA94900ACE2"><enum>(B)</enum><text>An individual who

			 has been convicted of a sexually violent offense.</text>

					</subparagraph><subparagraph display-inline="no-display-inline" id="HCBB8818922A54D5DAA3E7C04E8A1F950"><enum>(C)</enum><text>An individual

			 described in section 4042(c)(4) of title 18, United States Code.</text>

					</subparagraph><subparagraph id="HB3F7E4EB91224C29ACD7963D988B982F"><enum>(D)</enum><text>An individual

			 sentenced by a court martial for conduct in a category specified by the

			 Secretary of Defense under section 115(a)(8)(C) of title I of Public Law

			 105–119 (10 U.S.C. 951 note).</text>

					</subparagraph><subparagraph id="HB748CC9DC5F74776B9FF449EDC5BA37"><enum>(E)</enum><text>An individual who

			 is a sexually violent predator.</text>

					</subparagraph></paragraph><paragraph id="H30ED0A67109648ACBBEC7222245700FE"><enum>(2)</enum><header>Covered offense

			 against a minor</header>

					<subparagraph id="H553797BC5918402596E3C8D1827C35A1"><enum>(A)</enum><header>In

			 general</header><text>Except as provided in subparagraphs (B) and (C), the term

			 <term>covered offense against a minor</term> means an offense (whether under

			 the law of a State actor or tribal actor, Federal law, military law, or the law

			 of a foreign country) that is comparable to or more severe than any of the

			 following offenses:</text>

						<clause id="H16119F49D5FC4852A5EC06BDFFB8EA81"><enum>(i)</enum><text>Kidnapping of a

			 minor, except by a parent of the minor.</text>

						</clause><clause id="H978BCBCE82CF400E88579D0052D11475"><enum>(ii)</enum><text>False

			 imprisonment of a minor, except by a parent of the minor.</text>

						</clause><clause id="H97F79A32433F4EB7A06C17D2FF482286"><enum>(iii)</enum><text>Criminal sexual

			 conduct toward a minor.</text>

						</clause><clause id="HE103B61704EB4A3B8955C201013C9365"><enum>(iv)</enum><text>Solicitation of a

			 minor to engage in sexual conduct.</text>

						</clause><clause id="HA3C59A6D232F4D47AC60186642A3AFA1"><enum>(v)</enum><text>Use

			 of a minor in a sexual performance.</text>

						</clause><clause id="HF4E7890646E84C41931FC8A696C5203"><enum>(vi)</enum><text>Solicitation of a

			 minor to practice prostitution.</text>

						</clause><clause id="H76CE34D220464E68BDEE0042A0B05858"><enum>(vii)</enum><text>Any conduct that

			 by its nature is a sexual offense against a minor.</text>

						</clause><clause id="HD2B5417236E84D0785201FFBE7E1448"><enum>(viii)</enum><text>Possession,

			 production, or distribution of child pornography, as described in section 2251,

			 2252, or 2252A of title 18, United States Code.</text>

						</clause><clause id="H8247F1D47411490C8DC762EA8EFF5951"><enum>(ix)</enum><text>Use

			 of the Internet to facilitate or commit a covered offense against a

			 minor.</text>

						</clause><clause id="H8D7248C1A45F458F94A1ACCA98E22500"><enum>(x)</enum><text>An

			 attempt to commit a covered offense against a minor.</text>

						</clause></subparagraph><subparagraph id="HC1AC25FC1D8446D7A745ECAA72DD5DEA"><enum>(B)</enum><header>Exception</header><text>The

			 term does not include an offense if the conduct on which the offense is based

			 is criminal only because of the age of the victim and the individual who

			 committed the offense had not attained the age of 18 years when the offense was

			 committed.</text>

					</subparagraph><subparagraph id="HB2FCE16A462749F9872EEA5D96A6C1A5"><enum>(C)</enum><header>Inclusion</header><text>The

			 term includes a violation of section 103 of this Act.</text>

					</subparagraph></paragraph><paragraph id="H0B907B8F3F04400AAAC05C399D7530B9"><enum>(3)</enum><header>Domicile</header><text>The

			 term <term>domicile</term> means, with respect to an individual, any place that

			 serves as the primary place at which the individual lives.</text>

				</paragraph><paragraph id="H3CE5251ECEAB469D9D21D7A6DC6487EC"><enum>(4)</enum><header>Domicile

			 State</header><text display-inline="yes-display-inline">The term <term>domicile

			 State</term> means, with respect to an individual, the State actor or tribal

			 actor within the jurisdiction of which is the individual’s domicile.</text>

				</paragraph><paragraph id="HD3371FCB5B4444BFB27855898B39CE8D"><enum>(5)</enum><header>Educational

			 institution</header><text>The term <term>educational institution</term>

			 includes (whether public or private) any secondary school, trade or

			 professional institution, and institution of higher education.</text>

				</paragraph><paragraph id="H568FD0736C814A24A8E18B27019C81C8"><enum>(6)</enum><header>Employment</header><text>The

			 term <term>employment</term> includes carrying on a vocation and covers any

			 labor or service rendered (whether as a volunteer or for compensation or for

			 government or educational benefit) on a full-time or part-time basis.</text>

				</paragraph><paragraph id="H542166F868194348AB3863E368B30849"><enum>(7)</enum><header>Jurisdiction</header><text>The

			 term <term>jurisdiction</term>, with respect to a tribal actor, means the

			 Indian country (as defined in section 1151 of title 18, United States Code) of

			 that tribal actor.</text>

				</paragraph><paragraph display-inline="no-display-inline" id="H8B76CC25635647C9977C66F6E769F00"><enum>(8)</enum><header>School

			 State</header><text display-inline="yes-display-inline">The term <term>school

			 State</term> means, with respect to an individual, the State actor or tribal

			 actor within the jurisdiction of which the educational institution at which the

			 individual is a student is located.</text>

				</paragraph><paragraph display-inline="no-display-inline" id="H28BCCB1F672A4E29BA8CB6E188E716E"><enum>(9)</enum><header>Sexually violent

			 offense</header><text display-inline="yes-display-inline">The term

			 <term>sexually violent offense</term> means an offense (whether under the law

			 of a State actor or tribal actor, Federal law, military law, or the law of a

			 foreign country) that is comparable to or more severe than any of the following

			 offenses:</text>

					<subparagraph id="H64CE6D015F7E4FEFA0C5043EA4DC462"><enum>(A)</enum><text>Aggravated sexual

			 abuse or sexual abuse (as described in sections 2241 and 2242 of title 18,

			 United States Code).</text>

					</subparagraph><subparagraph id="H04D6CDC5331D489C87EDA0CA72125683"><enum>(B)</enum><text>An offense an

			 element of which is engaging in physical contact with another person with

			 intent to commit aggravated sexual abuse or sexual abuse.</text>

					</subparagraph></paragraph><paragraph id="H6A71B7C4757343D99C357CAB8211EB69"><enum>(10)</enum><header>Sexually

			 violent predator</header><text>The term <term>sexually violent predator</term>

			 means an individual who—</text>

					<subparagraph id="H4B685A1A9522488A9D4933053623E257"><enum>(A)</enum><text>has a conviction

			 for a sexually violent offense; or</text>

					</subparagraph><subparagraph id="H1A0C3D0A1E0B4DBD9976BFE500293787"><enum>(B)</enum><text>suffers from a

			 mental abnormality (as defined in section 110 of this Act) or personality

			 disorder that makes the person likely to engage in a predatory (as defined in

			 section 110 of this Act) sexually violent offense.</text>

					</subparagraph></paragraph><paragraph id="H853F179FB2974C9486C493919729A68F"><enum>(11)</enum><header>State

			 actor</header><text>The term <term>State actor</term> means any of the

			 following:</text>

					<subparagraph id="HFD2516D29A2A4E6FA8B13CE2003E48DA"><enum>(A)</enum><text>A State.</text>

					</subparagraph><subparagraph id="H5F689947C4BA4C11B25BB82B96F7E8BB"><enum>(B)</enum><text>The District of

			 Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United

			 States Virgin Islands, or any other territory or possession of the United

			 States.</text>

					</subparagraph></paragraph><paragraph id="HEDEECD41CA9347528C8D5C69FE2C1CEA"><enum>(12)</enum><header>Student</header><text>The

			 term <term>student</term> means an individual who, whether on a full-time or

			 part-time basis, enrolls in or attends an educational institution.</text>

				</paragraph><paragraph id="H84B14E7DB9E140DA8EB7CC8B82F44780"><enum>(13)</enum><header>Tribal

			 actor</header><text>The term <term>tribal actor</term> means a federally

			 recognized Indian tribe.</text>

				</paragraph><paragraph display-inline="no-display-inline" id="HCAABED7E7EC241A39260009DC4AF27D8"><enum>(14)</enum><header>Work

			 State</header><text display-inline="yes-display-inline">The term <term>work

			 State</term> means, with respect to an individual, the State actor or tribal

			 actor within the jurisdiction of which the individual’s place of employment is

			 located.</text>

				</paragraph></section><section id="HC03B7AA25A764085BAF4503216233578"><enum>103.</enum><header>Duty of covered

			 individuals to provide information</header>

				<subsection id="H7EA97136583745FC97BCD500E0F36E86"><enum>(a)</enum><header>Information

			 required periodically</header><text>A covered individual shall, for the life of

			 that individual (except as provided in this section), provide information as

			 follows:</text>

					<paragraph id="H1B247091604D401C99BE903FCB757140"><enum>(1)</enum><header>Registration

			 information</header><text display-inline="yes-display-inline">Immediately after

			 being sentenced for an offense that qualifies the individual as a covered

			 individual (or, if the individual is imprisoned for that offense, immediately

			 before completing the term of imprisonment), and thereafter at least once every

			 6 months (or, in the case of a sexually violent predator, at least once every 3

			 months), the individual shall appear before a person designated by the

			 individual’s domicile State and provide—</text>

						<subparagraph id="H44E8BE008F7541D19D8C984559347E88"><enum>(A)</enum><text>the individual’s

			 name;</text>

						</subparagraph><subparagraph id="HE59DF31B9D65489AAFC705A6C89861BA"><enum>(B)</enum><text>the individual’s

			 Social Security number;</text>

						</subparagraph><subparagraph id="H22657A230A0048BC823E35CDBAF6B0A7"><enum>(C)</enum><text>the address of the

			 individual’s domicile;</text>

						</subparagraph><subparagraph id="HEB0FE8247BE04863883B1D5FD1495F07"><enum>(D)</enum><text>the license plate

			 number of, and other identifying information with respect to, each vehicle

			 owned or operated by the individual;</text>

						</subparagraph><subparagraph id="H401D62D67607489AB9F42E3074ADBC98"><enum>(E)</enum><text>any address at

			 which the individual expects to have a domicile in the future;</text>

						</subparagraph><subparagraph id="H5455EA0250544B6AAED8726675AE54E"><enum>(F)</enum><text>the name and

			 address of any person who employs the individual and the address at which the

			 individual is so employed; and</text>

						</subparagraph><subparagraph id="HF0F9FA10FBE7423DA637E03FF227E9BD"><enum>(G)</enum><text>the name and

			 address of any educational institution at which the individual is employed or

			 is a student.</text>

						</subparagraph></paragraph><paragraph id="H78E129F974A54CF083C352AB24A41DA7"><enum>(2)</enum><header>Photograph</header><text display-inline="yes-display-inline">Immediately after being sentenced for an

			 offense that qualifies the individual as a covered individual (or, if the

			 individual is imprisoned for that offense, immediately before completing the

			 term of imprisonment), and thereafter at least once every 12 months, the

			 individual shall appear before a person designated by the individual’s domicile

			 State and submit to the taking of a photograph.</text>

					</paragraph><paragraph id="HEB130C1EFE444E75B891FCDBCFF8531B"><enum>(3)</enum><header>Fingerprints</header><text display-inline="yes-display-inline">Immediately after being sentenced for an

			 offense that qualifies the individual as a covered individual (or, if the

			 individual is imprisoned for that offense, immediately before completing the

			 term of imprisonment), and thereafter at least once every 12 months, the

			 individual shall appear before a person designated by the individual’s domicile

			 State and submit to the taking of fingerprints.</text>

					</paragraph><paragraph id="H2CE0B76F5765448C911F8DCD2124493B"><enum>(4)</enum><header>Other regulatory

			 requirements</header><text>The Attorney General may, by regulation, require the

			 individual to provide any information that the Attorney General considers

			 appropriate on any basis, and at any time and in any manner, that the Attorney

			 General considers appropriate.</text>

					</paragraph><paragraph id="H6B25940497D740A2A33491BB9100E8D5"><enum>(5)</enum><header>Individual in

			 custody in State other than domicile State</header><text display-inline="yes-display-inline">Whenever an individual is required by any

			 paragraph of this subsection to provide information immediately after being

			 sentenced (or immediately before completing a term of imprisonment) and the

			 State actor or tribal actor that has sentenced (or imprisoned) the individual

			 is not the individual’s domicile State—</text>

						<subparagraph id="H26DE10BE7F644E288B2EDF25E7B52EFE"><enum>(A)</enum><text>the individual

			 shall provide that information (in the same time, place, and manner as

			 prescribed by that paragraph) to an appropriate official of the State actor or

			 tribal actor that has sentenced (or imprisoned) the individual; and</text>

						</subparagraph><subparagraph id="H7884E0A842DD482D881521242ED99CAF"><enum>(B)</enum><text>the State actor or

			 tribal actor that has sentenced (or imprisoned) the individual shall promptly

			 make available that information to the individual’s domicile State.</text>

						</subparagraph></paragraph></subsection><subsection id="H47B9AC5CB7B74AC8AFDF369DD28E35CD"><enum>(b)</enum><header>Information

			 required upon change of registry information</header><text display-inline="yes-display-inline">A covered individual shall, for the life of

			 that individual (except as provided in this section), provide information as

			 follows:</text>

					<paragraph id="H07E0F89DA9F44A2798ADBF95F8CAE040"><enum>(1)</enum><header>Change of

			 address</header><text>Not more than 3 days after establishing a new domicile,

			 the individual shall—</text>

						<subparagraph id="H5DEB41628F714612A6D28F20231C6D3F"><enum>(A)</enum><text display-inline="yes-display-inline">appear before a person designated by the

			 individual’s domicile State and provide the address of the new domicile, and

			 the address of the previous domicile; and</text>

						</subparagraph><subparagraph id="H337A709DE36049219C8099C6D5F057C9"><enum>(B)</enum><text>if the new

			 domicile and the previous domicile are not both within the jurisdiction of a

			 single State actor or tribal actor qualified under this Act, appear before a

			 person designated by the individual’s new domicile State and—</text>

							<clause id="H767F7B20A6C84973B8D6FF62C7A495AF"><enum>(i)</enum><text display-inline="yes-display-inline">provide the address of the new domicile and

			 the address of the previous domicile; and</text>

							</clause><clause id="H1BEDFC6CCB5245AD936057B3FE6BD6C"><enum>(ii)</enum><text>submit to the

			 taking of a photograph and the taking of fingerprints.</text>

							</clause></subparagraph></paragraph><paragraph id="H92A158F7703B4E6BACB4E4EEECB39D41"><enum>(2)</enum><header>Change of

			 employment</header><text>Not more than 3 days after beginning, or ceasing, to

			 be employed by an employer, the individual shall appear before, and provide

			 notice of the beginning or ceasing, and the name and address of the employer,

			 to—</text>

						<subparagraph id="HABCCF2E48D2B4A188D23A77956C7CF7B"><enum>(A)</enum><text>a person

			 designated by the individual’s domicile State; and</text>

						</subparagraph><subparagraph id="H64190FDA1AA347F28EA8ABEB036DB476"><enum>(B)</enum><text>if the

			 individual’s work State is different from the domicile State, a person

			 designated by the individual’s work State.</text>

						</subparagraph></paragraph><paragraph id="H99389EC6A75744A6AD906BF1B791A178"><enum>(3)</enum><header>Change of

			 student status</header><text>Not more than 3 days after beginning, or ceasing,

			 to be a student at an educational institution, the individual shall appear

			 before, and provide notice of the beginning or ceasing, and the name and

			 address of the educational institution, to—</text>

						<subparagraph id="H97C805BC5465417D815F386673A6E0E9"><enum>(A)</enum><text>a person

			 designated by the individual’s domicile State; and</text>

						</subparagraph><subparagraph id="HA30D2059FA4247B48464812600EE04B5"><enum>(B)</enum><text>if the

			 individual’s school State is different from the domicile State, a person

			 designated by the individual’s school State.</text>

						</subparagraph></paragraph></subsection><subsection id="H884B1E797D0448FE80F08F054EF6E2F"><enum>(c)</enum><header>Duty to provide

			 information to Attorney General</header>

					<paragraph id="HBCDDA7B0E97540B59F16AF71F4F1A985"><enum>(1)</enum><header>If State actor

			 or tribal actor not qualified</header><text>Whenever an individual is required

			 by subsection (a) or (b) to provide information to a State actor or tribal

			 actor, and the actor is not qualified for purposes of this Act, the individual

			 shall also provide that information (in the same time, place, and manner as

			 prescribed in subsection (a) or (b), as the case may be) to the Attorney

			 General, and a failure to do so shall be treated for purposes of this Act as a

			 violation of subsection (a) or (b), as the case may be.</text>

					</paragraph><paragraph id="H8016B25D8E8F4BE495AB072205B58E78"><enum>(2)</enum><header>If providing

			 information to more than one State</header><text display-inline="yes-display-inline">Whenever an individual is required by

			 subsection (a) or (b) to provide information to more than one State actor or

			 tribal actor, the individual shall also provide that information (in the same

			 time, place, and manner as prescribed in subsection (a) or (b), as the case may

			 be) to the Attorney General, and a failure to do so shall be treated for

			 purposes of this Act as a violation of subsection (a) or (b), as the case may

			 be.</text>

					</paragraph></subsection><subsection id="HA92F693BD2FB4835AD8D4C2B565F0816"><enum>(d)</enum><header>Punishment</header>

					<paragraph id="H22E51C4D7C684E1D83BB00DA8B5113A6"><enum>(1)</enum><header>In

			 general</header><text>A covered individual who violates subsection (a) or (b)

			 shall—</text>

						<subparagraph id="H9E65ECB143F4472A90AC71C8C4085F16"><enum>(A)</enum><text>on the first

			 conviction, be fined under title 18, United States Code, and imprisoned not

			 more than 5 years (or, in the case of a sexually violent predator, not more

			 than 10 years), and shall thereafter be subject to supervised release for not

			 less than 36 months; and</text>

						</subparagraph><subparagraph id="H9CC844C9F44645578867DC0973933FCA"><enum>(B)</enum><text>on any conviction

			 after the first, be fined under title 18, United States Code, and imprisoned

			 not more than 20 years (or, in the case of a sexually violent predator, for

			 life), and shall thereafter be subject to supervised release for life.</text>

						</subparagraph></paragraph><paragraph id="HC53808F1DE914B3798D700F600A3E85B"><enum>(2)</enum><header>Strict

			 culpability</header><text>In a prosecution for a violation of subsection (a) or

			 (b), the state of mind of the individual committing the violation is not an

			 element of the offense and it need not be proven that the individual had any

			 particular state of mind with respect to any element of the offense.</text>

					</paragraph><paragraph display-inline="no-display-inline" id="HDDFC75B82E7F44B58068EF2B8B615480"><enum>(3)</enum><header>Affirmative

			 defense</header><text display-inline="yes-display-inline">In a prosecution for

			 a violation of subsection (a) or (b), it is an affirmative defense that

			 uncontrollable circumstances prevented the individual from complying, and that

			 the individual did not contribute to the creation of such circumstances in

			 reckless disregard of the requirement to comply, and that the individual

			 complied as soon as such circumstances ceased to exist.</text>

					</paragraph><paragraph id="HC87513A904A74464A2525840F641B61F"><enum>(4)</enum><header>Violations are

			 continuing</header><text>A violation of subsection (a) or (b) is a continuing

			 violation for purposes of the statute of limitations.</text>

					</paragraph></subsection><subsection id="H81C2B4D5C0174F7000FA286D721D7F76"><enum>(e)</enum><header>Exception for

			 certain individuals</header><text>Subsections (a) and (b) apply to any covered

			 individual, unless each of the following is true with respect to the covered

			 individual:</text>

					<paragraph id="H887DFB59151541C6BB6730F4F3F8E874"><enum>(1)</enum><text>The individual is

			 not a sexually violent predator.</text>

					</paragraph><paragraph id="H2AD8E74FA87945049EF3A7003DFF00DF"><enum>(2)</enum><text>The individual has

			 only one conviction for an offense that qualifies the individual as a covered

			 individual.</text>

					</paragraph><paragraph id="H3AF19D7E47E6453E81B667FB92D51EFD"><enum>(3)</enum><text>A

			 period of at least 20 years, excluding ensuing periods of imprisonment, has

			 expired since the date on which the individual was sentenced for, or completed

			 the term of imprisonment for, the conviction described in paragraph (2).</text>

					</paragraph><paragraph id="H7EC81665C54C4EC9801CFE003E001BD5"><enum>(4)</enum><text>the conviction

			 referred to in paragraph (2) was not for aggravated sexual abuse (as defined in

			 section 2241 of title 18, United States Code) or a comparable, or more severe,

			 offense.</text>

					</paragraph></subsection></section><section id="HB0CCD26CBEA4429090E762D15F65CEF0"><enum>104.</enum><header>Duty of covered

			 individuals on parole or supervised release to comply with device

			 requirements</header>

				<subsection id="H3E89E70E86344ABF86C82472DDB2029E"><enum>(a)</enum><header>In

			 general</header><text>A covered individual shall comply with any requirements

			 that the Attorney General prescribes under subsection (b)—</text>

					<paragraph id="HE681DDE01EF640FD8CB0C408EC41F12"><enum>(1)</enum><text display-inline="yes-display-inline">for the period of supervised release or

			 parole, if the individual has only one conviction for an offense that qualifies

			 the individual as a covered individual; and</text>

					</paragraph><paragraph id="HE3A128DC44F04ED79B039BA611C15087"><enum>(2)</enum><text>for the life of

			 the individual, in all other cases.</text>

					</paragraph></subsection><subsection id="H4864CCDF823F4BC9904FD52462E9376"><enum>(b)</enum><header>Regulations

			 required</header>

					<paragraph id="H1E7AD8437758439F85818FEE899B4330"><enum>(1)</enum><header>In

			 general</header><text>The Attorney General, in consultation with State actors

			 and tribal actors, shall prescribe regulations to ensure that every covered

			 individual referred to in subsection (a) wears and maintains a device that

			 transmits information about the individual’s whereabouts to the domicile

			 State.</text>

					</paragraph><paragraph id="H1E0A0CB7B47347EE973FB853ECD5B250"><enum>(2)</enum><header>Penalties for

			 failure to comply</header><text>The regulations shall include penalties for the

			 failure of the covered individual to wear or maintain the device.</text>

					</paragraph><paragraph id="H01A18B4BAA444A75AF5D16D5B674F21B"><enum>(3)</enum><header>Devices and

			 procedures</header><text>The regulations shall describe the devices to be used

			 and, for each such device, the procedures to be followed by the individual and

			 the domicile State. The type of device to be used may vary from domicile State

			 to domicile State, from offense to offense, or both.</text>

					</paragraph></subsection></section><section id="H5E0C2065E0404933B3008F0800F0A573"><enum>105.</enum><header>Duties of

			 Attorney General and State or tribal actors</header>

				<subsection id="H7C70B504DF1C423BA75D1D2DD6FC8DE8"><enum>(a)</enum><header>When an

			 individual provides information</header><text display-inline="yes-display-inline">Whenever an individual is required by this

			 Act to provide information (including information such as photographs and

			 fingerprints) to the Attorney General, to a State actor or tribal actor, or to

			 both, the Attorney General (or the actor, or both, as the case may be)

			 shall—</text>

					<paragraph id="H2CC4EDC674924B1F9794009497325524"><enum>(1)</enum><text>ensure that the

			 individual complies with the requirement;</text>

					</paragraph><paragraph id="HAA2E2261D5B54EF5A29164B71F720895"><enum>(2)</enum><text>ensure that the

			 information provided is accurate and complete;</text>

					</paragraph><paragraph id="H05D829AB4C7549C28D1BC3ECEFE7C2DA"><enum>(3)</enum><text>ensure that the

			 information provided is included in the National Sex Offender Registry;

			 and</text>

					</paragraph><paragraph id="H9A7BA1103F744E1AB70258A939F9D6B6"><enum>(4)</enum><text>ensure that the

			 information is promptly—</text>

						<subparagraph id="H7ADBF1F735B24F908F48101BB1EA7E08"><enum>(A)</enum><text>made available to

			 any law enforcement agency responsible for the area in which the individual’s

			 domicile is located and to the State law enforcement agency of the domicile

			 State;</text>

						</subparagraph><subparagraph id="HB80081AF3E1141D4A649F526B200C258"><enum>(B)</enum><text>entered into the

			 appropriate records or data system of the actor; and</text>

						</subparagraph><subparagraph id="HE94F4F4D50B544A4AEB272101802656E"><enum>(C)</enum><text>made available by

			 the actor, together with information relating to criminal history, to the

			 Attorney General.</text>

						</subparagraph></paragraph></subsection><subsection id="H8FCA8477D721408C00FD538CB581348"><enum>(b)</enum><header>When a covered

			 individual is missing</header>

					<paragraph id="HBBF8F14132414FCA87008953376248DA"><enum>(1)</enum><header>State or tribal

			 actor</header><text>Whenever information is made known to a State actor or

			 tribal actor that an individual has violated section 103(a)(1) or section

			 103(b), the actor shall promptly notify the Attorney General of that

			 information.</text>

					</paragraph><paragraph id="H33C93C545CE74D1190A6FF000047B2B4"><enum>(2)</enum><header>Attorney

			 General</header><text>Whenever information is made known to the Attorney

			 General that an individual has violated section 103(a)(1) or section 103(b), or

			 is notified of information under paragraph (1), the Attorney General

			 shall—</text>

						<subparagraph id="H51D60C5C88E24749A23EACAE4C110984"><enum>(A)</enum><text>revise the

			 National Sex Offender Registry to reflect that information; and</text>

						</subparagraph><subparagraph id="H999B107122694D88B887B713316FBD96"><enum>(B)</enum><text>add the name of

			 the individual to the wanted person file of the National Crime Information

			 Center and create a wanted persons record: <italic>Provided, </italic>That an

			 arrest warrant which meets the requirements for entry into the file is issued

			 in connection with the violation.</text>

						</subparagraph></paragraph></subsection><subsection id="H674F8CE7C97342AD8EECB016DA780077"><enum>(c)</enum><header>When a covered

			 individual changes address</header>

					<paragraph id="H0A6A4CBBDD9F454B811666B32235A99D"><enum>(1)</enum><header>In

			 general</header><text>The Attorney General and each State actor or tribal actor

			 shall ensure that, whenever information is made known to the Attorney General

			 or to that actor (as the case may be) that a covered individual has established

			 a new domicile, and the individual’s new domicile State and previous domicile

			 State are not the same, the information about the new domicile and all other

			 information collected under this Act about the individual is promptly made

			 available to—</text>

						<subparagraph id="HC0CBDEDF1F9D448FA2B4DE1FB66F56C3"><enum>(A)</enum><text>the local law

			 enforcement agencies responsible for the area in which the previous domicile is

			 located, and to those responsible for the area in which the new domicile is

			 located;</text>

						</subparagraph><subparagraph id="H8535E1634514425297B312407329D4AB"><enum>(B)</enum><text>the previous

			 domicile State; and</text>

						</subparagraph><subparagraph id="H126467DC363147C1BC94896B3255CE9E"><enum>(C)</enum><text>the new domicile

			 State.</text>

						</subparagraph></paragraph><paragraph id="HA4B62DCF3C08457BABF8064CB33CE493"><enum>(2)</enum><header>Electronic

			 forwarding</header><text display-inline="yes-display-inline">In addition to the

			 requirements of paragraph (1), the Attorney General shall ensure (through the

			 National Sex Offender Registry or otherwise) that, whenever information is made

			 known to the Attorney General that a covered individual has established a new

			 domicile, and the individual’s new domicile State and previous domicile State

			 are not the same, the information about the new domicile and all other

			 information collected under this Act about the individual is automatically and

			 immediately, by means of electronic forwarding, transmitted to the new domicile

			 State, if the new domicile State is qualified for purposes of this Act.</text>

					</paragraph></subsection><subsection id="HD9A69592922F46D5ADEF90E7BAEC5C38"><enum>(d)</enum><header>When a covered

			 individual is sentenced or completes a term of imprisonment</header><text display-inline="yes-display-inline">The Attorney General and each State actor

			 or tribal actor shall ensure that, immediately after a covered individual is

			 sentenced for an offense that qualifies the individual as a covered individual

			 (or, if the individual is imprisoned for that offense, immediately before

			 completing the term of imprisonment), a responsible official—</text>

					<paragraph id="H58E74DDD50A545EDB307EFDC8EBFF1D3"><enum>(1)</enum><text>notifies the

			 Attorney General that the individual has completed the term of imprisonment;

			 and</text>

					</paragraph><paragraph id="HD35E54B2D492403BBFEFEFF42253E197"><enum>(2)</enum><text>notifies the

			 individual of the individual’s duties under this Act.</text>

					</paragraph></subsection></section><section id="HFED4203998F04BAEB4C5566127ADF1B"><enum>106.</enum><header>State and tribal

			 sex offender registries</header>

				<subsection id="HBF54BC0E7574428FB720CD3C98210780"><enum>(a)</enum><header>Statewide

			 registry required</header><text display-inline="yes-display-inline">Each State

			 actor or tribal actor shall maintain, throughout its jurisdiction, a single

			 comprehensive registry of information collected under this Act.</text>

				</subsection><subsection id="H39BBDFF9AAE34420A1238D1E5219F3E2"><enum>(b)</enum><header>Release of

			 information in registry</header><text>Each State actor or tribal actor shall

			 have in effect, throughout its jurisdiction, a single public information

			 program that includes the following elements:</text>

					<paragraph id="HD4A0CF9ACB6C406EA7C199F5BBEA9781"><enum>(1)</enum><header>Internet

			 site</header>

						<subparagraph id="HE63763287D554A19AE85A3BF1B00F862"><enum>(A)</enum><header>In

			 general</header><text>The actor shall release to the public, through an

			 Internet site maintained by the actor, all information, except for Social

			 Security numbers and information relating to a covered individual for an

			 offense committed when the covered individual had not attained the age of 18

			 years, collected under this Act. The site shall have multiple field search

			 capability and shall include, for each covered individual, the name, aliases,

			 home address, work address, photograph, conviction for which registration is

			 required, and risk level. The site shall include, as much as practicable, links

			 to sex offender safety and education resources.</text>

						</subparagraph><subparagraph id="H356FA000A4A94BEDA4A581C7E6B6CF98"><enum>(B)</enum><header>Integration of

			 State sites</header><text>The actor shall consult with other State actors and

			 tribal actors to ensure, as much as practicable, that the site integrates with

			 and shares information with the sites maintained by those other actors.</text>

						</subparagraph><subparagraph id="HA916B6BD50B04BF6845D229169BA84BA"><enum>(C)</enum><header>Correction of

			 errors</header><text>The site shall contain instructions on the process for

			 correcting information that a person alleges to be erroneous.</text>

						</subparagraph><subparagraph id="H85E1957925BE41189032C11F2C45CD9"><enum>(D)</enum><header>Risk

			 level</header><text>For purposes of this paragraph, the risk level for an

			 individual shall be determined under procedures established by the actor, under

			 which the individual is provided notice and an opportunity to present evidence,

			 including witnesses, to the trier of fact, and upon proof of indigent status is

			 provided counsel at the expense of the actor. The actor shall establish not

			 fewer than two risk levels.</text>

						</subparagraph></paragraph><paragraph id="HFA384AB638CC47BA9935CCD12105EA9"><enum>(2)</enum><header>Community

			 notification</header><text>Appropriate law enforcement agencies shall release

			 information collected under this Act relating to a covered individual

			 to—</text>

						<subparagraph id="HDA6B73A996EA47A8938B37AFF3789B7B"><enum>(A)</enum><text>public and private

			 schools, child care providers, and businesses that provide services or products

			 to children, located within a radius, prescribed by the Attorney General, of

			 the home or work address of the individual; and</text>

						</subparagraph><subparagraph id="H3CC71EFA55474EAA94195BA73D2F424D"><enum>(B)</enum><text>residents who

			 reside within a radius, prescribed by the Attorney General, of the home or work

			 address of the individual.</text>

						</subparagraph></paragraph></subsection><subsection id="H54EEF9F976B54BDF845E379D7374E8E1"><enum>(c)</enum><header>Publication of

			 number of offenders registered</header><text>Every three months, the Attorney

			 General shall collect from each State actor and tribal actor information on the

			 total number of covered individuals included in the registry maintained by that

			 State actor or tribal actor. The Attorney General shall release that

			 information to the public in a manner consistent with this Act.</text>

				</subsection><subsection id="H01F0E3EB05964BB680855930E2B5A976"><enum>(d)</enum><header>Report</header><text>Not

			 later than 1 year after the date of the enactment of this Act, the Attorney

			 General shall submit to Congress a report on the feasibility of requiring State

			 actors and tribal actors to actively notify individuals within a community

			 should a covered individual move into that community.</text>

				</subsection></section><section id="HC76D098318BB472EB199EA03C15D222D"><enum>107.</enum><header>National Sex

			 Offender Registry</header>

				<subsection id="HC4127FC5BBD349C3908BFFF72751E4BA"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Attorney General

			 shall maintain a database to track the whereabouts and movements of covered

			 individuals. The database shall be known as the National Sex Offender

			 Registry.</text>

				</subsection><subsection id="H0E13F83CC9674BD6927B66A3205FC769"><enum>(b)</enum><header>Discretionary

			 release of information</header>

					<paragraph id="H2C9EDDDD79314B93B30068991CF35EA6"><enum>(1)</enum><header>In

			 general</header><text>Subject to paragraph (2), the Attorney General may

			 release information in the National Sex Offender Registry concerning a covered

			 individual if the Attorney General determines that the information released is

			 relevant and necessary to protect the public.</text>

					</paragraph><paragraph id="HE0D72525560C4F16ADD6DD2DAA63B69C"><enum>(2)</enum><header>Identity of

			 victim</header><text display-inline="yes-display-inline">The Attorney General

			 shall not, under paragraph (1), release the identity of the victim of an

			 offense by reason of which an individual is a covered individual.</text>

					</paragraph></subsection><subsection display-inline="no-display-inline" id="H050976B3167944B39EE89B088148C974"><enum>(c)</enum><header>Required

			 disclosures to criminal justice agencies</header><text>The Attorney General

			 shall disclose information in the National Sex Offender Registry—</text>

					<paragraph id="HEA8A920DBAC94182B3809D9749276B12"><enum>(1)</enum><text>to Federal, State,

			 and local criminal justice agencies—</text>

						<subparagraph id="H0C06DCF73CFD4908BFEC3F82A1AB6300"><enum>(A)</enum><text>for law

			 enforcement purposes; and</text>

						</subparagraph><subparagraph id="HC4F0281D3E5744B6A6C3E000FEE600A5"><enum>(B)</enum><text>for releases of

			 information under subsection (b); and</text>

						</subparagraph></paragraph><paragraph id="H898D2BB506FA438B919BE55EA48DDA9C"><enum>(2)</enum><text>to Federal, State,

			 and local governmental agencies responsible for conducting employment-related

			 background checks under section 3 of the National Child Protection Act of 1993

			 (42 U.S.C. 5119a).</text>

					</paragraph></subsection></section><section id="H5144DF39913F4E84BD004C2D5FCE62E8"><enum>108.</enum><header>Development and

			 availability of registry management software</header>

				<subsection id="HEC2447F9FEDE4F87B1A25BDBC3C23D3F"><enum>(a)</enum><header>Development of

			 software required</header><text display-inline="yes-display-inline">The

			 Attorney General, in consultation with State actors and tribal actors, shall

			 develop a software application that can be used by State actors and tribal

			 actors for purposes of this Act. The software shall operate in such a manner

			 that a State actor or tribal actor can, by using the software, fully comply

			 with all the requirements under this Act for collecting, managing, and

			 exchanging information (including exchanging information with other State

			 actors and tribal actors).</text>

				</subsection><subsection id="H50F6D4D008074B11A921003D8600CD79"><enum>(b)</enum><header>Availability to

			 State and tribal actors</header>

					<paragraph id="H5E42E3872DE04CFB8DC4ADA22F6EEADC"><enum>(1)</enum><header>In

			 general</header><text>The Attorney General shall make the software developed

			 under this section available to State actors and tribal actors. The first

			 complete edition of the software shall be made available within 2 years after

			 the date of the enactment of this Act.</text>

					</paragraph><paragraph id="H9F11DB50540C4AA0A66664141377DB57"><enum>(2)</enum><header>Fee</header><text>The

			 Attorney General shall make the software available under paragraph (1) for a

			 fee not more than one percent of the Attorney General’s cost to develop,

			 implement, and support the software.</text>

					</paragraph></subsection><subsection id="H80D174E64AF844D3A602B75181DF67D7"><enum>(c)</enum><header>Support</header><text>The

			 Attorney General shall ensure that a State actor or tribal actor purchasing the

			 software is provided technical support for the installation of the software and

			 for maintaining the software.</text>

				</subsection></section><section id="HB082BEC3A6F74A9888466B008598A338"><enum>109.</enum><header>DNA database

			 for covered individuals</header>

				<subsection id="H0D4B98E0E473462593440065A02148CD"><enum>(a)</enum><header>Database

			 required</header><text display-inline="yes-display-inline">The Attorney General

			 shall establish and maintain a database for the purposes of—</text>

					<paragraph id="H75D807AC3B4D46628B58B6E3FA645C22"><enum>(1)</enum><text>managing DNA

			 information with respect to covered individuals; and</text>

					</paragraph><paragraph id="H94A5A12526ED4BC9A77308BDD4917273"><enum>(2)</enum><text>making that

			 information available to Federal, State, and local law enforcement agencies for

			 use by those agencies in a manner consistent with this Act.</text>

					</paragraph></subsection><subsection id="HBD9BE11606DC4B1A889462F8E7D08B4C"><enum>(b)</enum><header>Regulations</header><text>Under

			 regulations issued by the Attorney General—</text>

					<paragraph id="HC0152A1DE88A491A82F7E35D1E55CE79"><enum>(1)</enum><text>Federal, State,

			 and local agencies and other entities may submit DNA information to the

			 Attorney General for inclusion in the database;</text>

					</paragraph><paragraph id="H3B283712F26447D1A07700386C821D43"><enum>(2)</enum><text>Federal, State,

			 and local law enforcement agencies may compare DNA information against other

			 DNA information in the database; and</text>

					</paragraph><paragraph id="H86981AADEF73438F9C399423002150D6"><enum>(3)</enum><text>Federal, State,

			 and local prosecutors may use DNA information in prosecutions.</text>

					</paragraph></subsection></section><section id="HE24FDC2231C84E3C9C8FAD56DFCB2E5"><enum>110.</enum><header>Duty of courts

			 to determine whether an individual is a sexually violent predator</header>

				<subsection id="H7F4414536A2746278532313FAF65D3A5"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">A determination of

			 whether an individual is a sexually violent predator for purposes of this Act

			 shall be made by a court after considering the recommendation of a board

			 composed of experts in the behavior and treatment of sex offenders, victims’

			 rights advocates, and representatives of law enforcement agencies.</text>

				</subsection><subsection id="H4921D43108DE4D279B59B06EC300C347"><enum>(b)</enum><header>Waiver</header><text display-inline="yes-display-inline">The Attorney General may waive the

			 requirements of subsection (a) with respect to a State actor or tribal actor if

			 the Attorney General determines that the State actor or tribal actor has

			 established alternative procedures or legal standards for designating a person

			 as a sexually violent predator.</text>

				</subsection><subsection id="H5F71C024A4C640DD9C658807A0B84D14"><enum>(c)</enum><header>Definitions</header><text>In

			 this section:</text>

					<paragraph display-inline="no-display-inline" id="H42DEC4707A4E40FAA6C61FBFC20DC17"><enum>(1)</enum><header>Mental

			 abnormality</header><text>The term <term>mental abnormality</term> means a

			 congenital or acquired condition of an individual that affects the emotional or

			 volitional capacity of the individual in a manner that predisposes that

			 individual to the commission of criminal sexual acts to a degree that makes the

			 person a menace to the health and safety of other persons.</text>

					</paragraph><paragraph id="H2FC72E41212A401B8449D1A3D4A048CB"><enum>(2)</enum><header>Predatory</header><text>The

			 term <term>predatory</term> means an act directed at an individual (whether or

			 not a relationship with that individual has been established or promoted) for

			 the primary purpose of victimization.</text>

					</paragraph></subsection></section><section id="H711C185B719F466190363ECBEE2D82C4"><enum>111.</enum><header>Duty of

			 Attorney General to determine whether State or tribal actors are

			 qualified</header>

				<subsection id="H4998BE1F1F354C1E82B05C786FC69359"><enum>(a)</enum><header>In

			 general</header><text>A determination of whether a State actor or tribal actor

			 is qualified for purposes of this Act shall be made by the Attorney General in

			 accordance with this section.</text>

				</subsection><subsection id="H6BB9A4247D474A58914F89F4CA9DA51F"><enum>(b)</enum><header>Requirements</header><text>The

			 Attorney General may determine that a State actor or tribal actor is qualified

			 if, as determined by the Attorney General, each of the following apply:</text>

					<paragraph id="H6A16E44E747344789463C5D73D1E3EDD"><enum>(1)</enum><text>The actor has in

			 effect, throughout its jurisdiction, laws that implement the requirements of

			 section 103, or substantially similar requirements, with respect to each

			 covered individual whose domicile is within that jurisdiction.</text>

					</paragraph><paragraph id="H0E91FE3BFAC94B0AA149F786DD3C815"><enum>(2)</enum><text>The actor

			 participates in the National Sex Offender Registry in the manner that the

			 Attorney General considers appropriate.</text>

					</paragraph><paragraph id="H8FC2E37EF06142DF91ED414C1886A2"><enum>(3)</enum><text>The

			 actor ensures that an audit of the activities carried out under this Act is

			 carried out at least once each year and that the findings of each audit are

			 promptly reported to the Attorney General.</text>

					</paragraph></subsection><subsection display-inline="no-display-inline" id="H34F2D7C057E8466E9F9400C61244F165"><enum>(c)</enum><header>Reports to

			 Congress</header><text>Each year, the Attorney General shall submit to Congress

			 a report identifying the extent to which each State actor or tribal actor is

			 qualified for purposes of this Act.</text>

				</subsection></section><section id="H40CABBAD6EE348699540FFE1C9123114"><enum>112.</enum><header>Use of other

			 Federal information to track sex offenders</header>

				<subsection id="HCB5AF35A3E084B2790AEC062E9E4EDF2"><enum>(a)</enum><header>Taxpayer

			 information</header><text display-inline="yes-display-inline">The Secretary of

			 the Treasury, in coordination with the Attorney General, shall develop and

			 maintain a system under which taxpayer information that pertains to a covered

			 individual and is useful in locating the individual, or in verifying

			 information with respect to the individual, is made available to Federal,

			 State, and local law enforcement agencies for use by those agencies in a manner

			 consistent with this Act.</text>

				</subsection><subsection id="HF6C1410BC7D14131A473E19131139550"><enum>(b)</enum><header>Social Security

			 information</header><text display-inline="yes-display-inline">The Secretary of

			 Health and Human Services, in coordination with the Attorney General, shall

			 develop and maintain a system under which Social Security information that

			 pertains to a covered individual and is useful in locating the individual, or

			 in verifying information with respect to the individual, is made available to

			 Federal, State, and local law enforcement agencies for use by those agencies in

			 a manner consistent with this Act.</text>

				</subsection></section><section id="H868DFC9BBE3C4DEF8145DB00BE42134E"><enum>113.</enum><header>Implementation

			 by State and tribal actors and assistance grants to those actors</header>

				<subsection id="H5ADFCC146402405EAFE3E1BED2BC118E"><enum>(a)</enum><header>Implementation

			 by State and tribal actors</header>

					<paragraph id="HFE31B91F836F4E3CB5FE335B211FCDD2"><enum>(1)</enum><header>In

			 general</header><text>Each State actor or tribal actor shall have not more than

			 3 years from the date of the enactment of this Act in which to fully implement

			 this Act.</text>

					</paragraph><paragraph id="HF57BDFA1E4C24F7086EA5B93D11CC7F8"><enum>(2)</enum><header>Implementation

			 by tribes and in Indian country</header><text>The Attorney General shall

			 coordinate with the Secretary of the Interior to assist tribal actors in fully

			 implementing this Act throughout the jurisdiction of each tribal actor.</text>

					</paragraph></subsection><subsection id="H2875811F7C9D407788FC07CA32577184"><enum>(b)</enum><header>Ineligibility

			 for funds</header>

					<paragraph id="HD5FA3C8249CD4C15AF803254619BAE52"><enum>(1)</enum><header>In

			 general</header><text>For any fiscal year after the expiration of the period

			 specified in subsection (a)(1), a State actor or tribal actor that fails to

			 fully implement this Act shall not receive 10 percent of the funds that would

			 otherwise be allocated for that fiscal year to the actor under any of the

			 following programs:</text>

						<subparagraph id="H33461440C1B844B7ABA307E06480B595"><enum>(A)</enum><header>Byrne</header><text display-inline="yes-display-inline">Subpart 1 of Part E of title I of the

			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3750 et seq.),

			 whether characterized as the Edward Byrne Memorial State and Local Law

			 Enforcement Assistance Programs, the Edward Byrne Memorial Justice Assistance

			 Grant Program, or otherwise.</text>

						</subparagraph><subparagraph id="H74C3CDE5FB70442A8987CEC8F919538F"><enum>(B)</enum><header>LLEBG</header><text display-inline="yes-display-inline">The Local Government Law Enforcement Block

			 Grants program.</text>

						</subparagraph><subparagraph id="H19587EFBF94847AE9680283ED5927970"><enum>(C)</enum><header>Other law

			 enforcement grants</header><text>Any other program under which the Attorney

			 General provides grants or other financial assistance, except for the SOMA

			 program under this section.</text>

						</subparagraph></paragraph><paragraph id="H102CE5C01F4F4259BA39147254C3B6C8"><enum>(2)</enum><header>Reallocation</header><text>Amounts

			 not allocated under a program referred to in paragraph (1) to an actor for

			 failure to fully implement this Act shall be reallocated under that program to

			 State actors and tribal actors that have not failed to fully implement this

			 Act.</text>

					</paragraph></subsection><subsection id="HFB46C89A426047E49009F8001963317F"><enum>(c)</enum><header>Sex Offender

			 Management Assistance program</header>

					<paragraph id="HC2FEBF9C07B84DD2B8737B9169DEBEB8"><enum>(1)</enum><header>In

			 general</header><text>From amounts made available to carry out this subsection,

			 the Attorney General shall carry out a program, to be known as the Sex Offender

			 Management Assistance program (in this section referred to as the <quote>SOMA

			 program</quote>), under which the Attorney General awards a grant to each State

			 actor or tribal actor to offset costs directly associated with implementing

			 this Act.</text>

					</paragraph><paragraph id="H6C561BF5B2D6468D809BD4C5B6AE281C"><enum>(2)</enum><header>Distribution of

			 funds</header><text>Each grant awarded under the SOMA program shall be

			 distributed directly to the State actor or tribal actor for distribution by

			 that actor to public entities within that actor.</text>

					</paragraph><paragraph id="H2F90264CEB054B57A7A7AEE479402CA7"><enum>(3)</enum><header>Uses</header>

						<subparagraph id="H3481C7B6AB9B432500915F74A4C286DC"><enum>(A)</enum><header>In

			 general</header><text>Subject to subparagraph (B), each grant awarded under the

			 SOMA program shall be used for training, salaries, equipment, materials, and

			 other costs directly associated with implementing this Act, including the costs

			 of acquiring and using devices in carrying out section 104.</text>

						</subparagraph><subparagraph id="HBBFF05AA6737471A93B679AF02F66F61"><enum>(B)</enum><header>Databases of

			 individuals in custody</header><text>Up to 10 percent of a grant awarded under

			 the SOMA program may be used to participate in one or more databases that

			 identify individuals in custody, such as the JusticeXchange database.</text>

						</subparagraph></paragraph><paragraph id="H725C2525D3E9487BBF5ED2BAB4B50AC"><enum>(4)</enum><header>Eligibility</header>

						<subparagraph id="H3D40DCA1577A43149B85479863790814"><enum>(A)</enum><header>Application</header><text>To

			 be eligible to receive a grant under the SOMA program, the chief executive of a

			 State actor or tribal actor shall, on an annual basis, submit to the Attorney

			 General an application (in such form and containing such information as the

			 Attorney General may reasonably require) assuring that—</text>

							<clause id="H8785B351850B42BDBE623254B1BC349F"><enum>(i)</enum><text>the

			 actor has fully implemented (or is making a good faith effort to fully

			 implement) this Act; and</text>

							</clause><clause id="HE53ECFDB76324CABAA10BE6D093DB6EA"><enum>(ii)</enum><text>where applicable,

			 the actor has penalties comparable to or greater than Federal penalties for

			 crimes listed in this Act, except that the Attorney General may waive the

			 requirement of this clause if an actor demonstrates an overriding need for

			 assistance under the SOMA program.</text>

							</clause></subparagraph><subparagraph id="H0D706CF198E34C4CA8B604C8DD1DED9D"><enum>(B)</enum><header>Regulations</header><text>Not

			 later than 90 days after the date of the enactment of this Act, the Attorney

			 General shall promulgate regulations to implement the procedures used

			 (including the information that must be included and the requirements that the

			 State actors or tribal actors must meet) in submitting an application under the

			 SOMA program.</text>

						</subparagraph></paragraph><paragraph id="HFCDF0EA665454DF59F8E384D98D86100"><enum>(5)</enum><header>Allocation of

			 funds</header><text>In allocating funds under the SOMA program, the Attorney

			 General may consider the number of covered individuals registered in each

			 actor’s registry.</text>

					</paragraph><paragraph id="HAED099D4EE2D44FC842459F5089B9908"><enum>(6)</enum><header>Incorporation of

			 certain training programs</header><text>Before implementing the SOMA program,

			 the Attorney General shall study the feasibility of incorporating into the SOMA

			 program the activities of any technical assistance or training program

			 established as a result of section 40152 of the Violent Crime Control and Law

			 Enforcement Act of 1994 (42 U.S.C. 13941). In a case in which incorporating

			 such activities into the SOMA program will eliminate duplication of efforts or

			 administrative costs, the Attorney General shall take administrative actions,

			 as allowable, and make recommendations to Congress to incorporate such

			 activities into the SOMA program.</text>

					</paragraph></subsection><subsection id="H6E8DA79CE8464542B3B35635F5EC26A1"><enum>(d)</enum><header>Incentives</header>

					<paragraph id="HD0455A62BF3045709C994526091087D1"><enum>(1)</enum><header>Bonus payments

			 for early compliance</header><text>A State actor or tribal actor that has fully

			 implemented this Act within 2 years after the date of the enactment of this Act

			 is eligible for a bonus payment under the SOMA program for the fiscal year

			 after the Attorney General certifies that the actor has achieved full

			 implementation. The amount of the bonus payment shall be equal to 5 percent of

			 the funds that the actor received under the SOMA program for the preceding

			 fiscal year. However, if the actor has fully implemented this Act within 1 year

			 after such date of enactment, the amount of the bonus payment shall instead be

			 equal to 10 percent of the funds that the actor received under the SOMA program

			 for the preceding fiscal year. An actor may receive a bonus payment under this

			 paragraph only once during the course of the SOMA program.</text>

					</paragraph><paragraph id="H392C788B5E3F4C538DB65593A7EB0003"><enum>(2)</enum><header>Reduced payments

			 for late compliance</header><text>A State actor or tribal actor that has failed

			 to fully implement this Act within 3 years after the date of the enactment of

			 this Act is subject to a payment reduction under the SOMA program for the

			 following fiscal year. The amount of the payment reduction shall be equal to 5

			 percent of the funds that would otherwise be allocated to the actor under the

			 SOMA program for that fiscal year. In addition, if the actor has failed to

			 fully implement this Act within 4 years after such date of enactment, the

			 amount of the payment reduction shall be equal to 10 percent of the funds that

			 would otherwise be allocated to the actor under the SOMA program for that

			 fiscal year. An actor may be subject to a payment reduction under this

			 paragraph only twice during the course of the SOMA program.</text>

					</paragraph></subsection><subsection id="HFF4D23720EA14EE18071CAABF354C3A1"><enum>(e)</enum><header>Reports to

			 Congress</header><text>Each year, the Attorney General shall submit to Congress

			 a report identifying the extent to which each State actor or tribal actor has

			 fully implemented this Act.</text>

				</subsection></section><section id="HE6CD5ADE3CF148CDB117612900171B71"><enum>114.</enum><header>Immunity for

			 good faith conduct</header><text display-inline="no-display-inline">A law

			 enforcement agency, an employee of a law enforcement agency, a contractor

			 acting at the direction of a law enforcement agency, and an officer of a State

			 actor or tribal actor are immune from liability for good faith efforts to carry

			 out this Act.</text>

			</section><section id="HA78A3BFE4EC2452BAD8F1371F08DF94F"><enum>115.</enum><header>Regulations</header><text display-inline="no-display-inline">The Attorney General shall issue regulations

			 to carry out this Act.</text>

			</section><section id="HC58BD6C070E84B75BF48CBB742EB032B"><enum>116.</enum><header>Authorization

			 of appropriations</header><text display-inline="no-display-inline">There is

			 authorized to be appropriated for each of fiscal years 2006 through 2009 such

			 sums as may be necessary to carry out this Act.</text>

			</section></title><title id="H44E5749133EC4DD8BD9B2C677DCC3E3C"><enum>II</enum><header>Amendatory

			 Provisions, Transition Provisions, and Effective Date</header>

			<section id="H996C495A17E74AC88222D902A9BE5B9E"><enum>201.</enum><header>Failure to

			 provide information a deportable offense</header><text display-inline="no-display-inline">Section 237(a)(2)(A) of the Immigration and

			 Nationality Act (8 U.S.C. 1227(a)(2)(A)) is amended—</text>

				<paragraph id="H5AF7166E1A364D2094BB0015D692CAFE"><enum>(1)</enum><text>by redesignating

			 clause (v) as clause (vi); and</text>

				</paragraph><paragraph id="H791C5E2854D4460C8D00F2A20047C032"><enum>(2)</enum><text>by inserting after

			 clause (iv) the following new clause:</text>

					<quoted-block display-inline="no-display-inline" id="HE115A84D715F455ABE99D219AED5C48C" style="OLC">

						<clause id="H3F3A8F8213E94FEA8CC2A877D257024E"><enum>(v)</enum><header>Failure to

				provide registration information as a sex offender</header><text>Any alien who

				is convicted under subsection (d) of section 103 of the Sex Offender

				Registration and Notification Act of a violation of subsection (a) or (b) of

				such section is

				deportable.</text>

						</clause><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="HD0FD77E8F4C2463EBEF3591BF0705461"><enum>202.</enum><header>Repeal</header><text display-inline="no-display-inline">Sections 170101 (42 U.S.C. 14071) and 170102

			 (42 U.S.C. 14072) of the Violent Crime Control and Law Enforcement Act of 1994

			 are repealed.</text>

			</section><section id="HA4247F9A59154C19836659D27369CEC9"><enum>203.</enum><header>Conforming

			 amendments to title 18, United States Code</header><text display-inline="no-display-inline">The following provisions of title 18, United

			 States Code, are each amended by striking <quote>and that the person register

			 in any State where the person resides, is employed, carries on a vocation, or

			 is a student (as such terms are defined under section 170101(a)(3) of the

			 Violent Crime Control and Law Enforcement Act of 1994)</quote> and inserting

			 <quote>and that the person comply with the <short-title>Sex Offender Registration and Notification

			 Act</short-title></quote>:</text>

			 date</header><text display-inline="no-display-inline">This Act and the

			 amendments made by this Act take effect on the date that is 6 months after the

			 date of the enactment of this Act.</text>
