		<official-title>To amend the Safe Drinking Water Act to require the use

		  of nontoxic products in the case of hydraulic fracturing that occurs during oil

		  or natural gas production activities.</official-title>

		<section id="idD727CA1A6ED141A98C7CACD6C72EA0F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Hydraulic Fracturing Safety Act of

			 2005</short-title></quote>.</text>

		</section><section id="S1" section-type="subsequent-section"><enum>2.</enum><header>Hydraulic

			 fracturing</header><text display-inline="no-display-inline">Section 1421(d)(1)

			 of the Safe Drinking Water Act (42 U.S.C. 300h(d)(1)) is amended—</text>

			<paragraph id="id68A8C598696644FAB65B843FFC9D1224"><enum>(1)</enum><text display-inline="yes-display-inline">by adding at the end the following:

			 <quote>The term <term>underground injection</term> includes hydraulic

			 fracturing, which means the process of creating a fracture in a reservoir rock,

			 through the injection of fluids and propping agents, for the purpose of

			 reservoir stimulation relating to oil and gas production activities.</quote>;

			 and</text>

			</paragraph><paragraph id="idDCAFB37DB22C4618829C6939B4E037E9"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id1CB5958372CD45C288B65661F20E84EC" style="OLC">

					<paragraph id="idEDCE2BED9E0841268C18BDEDEBD5A2D7"><enum>(3)</enum><header>Hydraulic

				fracturing</header>

						<subparagraph id="ID2213fc3886e34adf84cff26701adf9c6"><enum>(A)</enum><header>In

				general</header><text>In the case of hydraulic fracturing that occurs during

				the exploration for, or the production of, oil or natural gas, a producer of

				oil or natural gas shall not use diesel fuel or any other material that the

				Administrator has listed as a priority pollutant under the

				<act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>

				(<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C.

				1251</external-xref> et seq.).</text>

						</subparagraph><subparagraph id="idFF3F0C67F24940AB9A42530ABE54E503"><enum>(B)</enum><header>Regulations</header><text>The

				Administrator shall promulgate such regulations as are necessary—</text>

							<clause id="id56C2E521E19A4729A994B00CD8149EB4"><enum>(i)</enum><text>to regulate

				hydraulic fracturing in accordance with this subsection; and</text>

							</clause><clause id="id4284BA827CE846DB9C698159424B688C"><enum>(ii)</enum><text>to ensure that

				State programs under section 1422 or 1425 regulate hydraulic fracturing in

				accordance with this

				subsection.</text>
