		<official-title>To promote and enhance public safety and to encourage the

		  rapid deployment of IP-enabled voice services.</official-title>

		<section display-inline="no-display-inline" id="HFF476D063E014CF0A2CC82C5F7CCB9E5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>IP-Enabled Voice Communications and

			 Public Safety Act of 2005</short-title></quote>.</text>

		</section><section id="HECEB84602B4747F8A079CFAC1587BBC1"><enum>2.</enum><header>Emergency

			 Service</header>

			<subsection id="H24E63AE6E2304AF3ACDC40423F69AA85"><enum>(a)</enum><header>911 and E–911

			 services</header><text display-inline="yes-display-inline">Notwithstanding

			 section 2(b) or any other provision of the Communications Act of 1934, the

			 Commission shall prescribe regulations to establish a set of requirements or

			 obligations on providers of IP-enabled voice service to ensure that 911 and

			 E–911 services are available to customers to IP-enabled voice service. Such

			 regulations shall include an appropriate transition period by which to comply

			 with such requirements or obligations and take into consideration available

			 industry technological and operational standards, including network

			 security.</text>

			</subsection><subsection id="HD898196A4463474AAD15D540D0E358F2"><enum>(b)</enum><header>Non-discriminatory

			 access to capabilities</header><text display-inline="yes-display-inline">Each

			 entity with ownership or control of the necessary emergency services

			 infrastructure shall provide any requesting IP-enabled voice service provider

			 with nondiscriminatory access to their equipment, network, databases,

			 interfaces and any other related capabilities necessary for the delivery and

			 completion of 911 and E911 calls and information related to such 911 or E911

			 calls. Such access shall be consistent with industry standards established by

			 the National Emergency Number Association or other applicable industry

			 standards organizations. Such entity shall provide access to the infrastructure

			 at just and reasonable, nondiscriminatory rates, terms and conditions. The

			 telecommunications carrier or other entity shall provide such access to the

			 infrastructure on a stand-alone basis.</text>

			</subsection><subsection id="HF8173049715B4C448BAA19191ED2F0CF"><enum>(c)</enum><header>State

			 authority</header><text display-inline="yes-display-inline">Nothing in this

			 Act, the Communications Act of 1934, or any Commission regulation or order

			 shall prevent the imposition on or collection from a provider of voice

			 services, including IP-enabled voice services, of any fee or charge

			 specifically designated or presented as dedicated by a State, political

			 subdivision thereof, or Indian tribe on an equitable, and non-discriminatory

			 basis for the support of 911 and E–911 services if no portion of the revenue

			 derived from such fee or charge is obligated or expended for any purpose other

			 than support of 911 and E–911 services or enhancements of such services.</text>

			</subsection><subsection id="HDDE9E5C23A9B4069A4D077CE16C09E30"><enum>(d)</enum><header>Standard</header><text display-inline="yes-display-inline">The Commission may establish regulations

			 imposing requirements or obligations on providers of voice services, entities

			 with ownership or control of emergency services infrastructure under

			 <internal-xref idref="H24E63AE6E2304AF3ACDC40423F69AA85" legis-path="2.(a)">subsections (a)</internal-xref> and

			 <internal-xref idref="HD898196A4463474AAD15D540D0E358F2" legis-path="2.(b)">(b)</internal-xref> only to the extent that the Commission

			 determines such regulations are technologically and operationally

			 feasible.</text>

			</subsection><subsection id="H20611A3D5F6141FEA5C5C8BF27CB22E9"><enum>(e)</enum><header>Customer

			 notice</header><text>Prior to the compliance with the rules as required by

			 <internal-xref idref="H24E63AE6E2304AF3ACDC40423F69AA85" legis-path="2.(a)">subsection (a)</internal-xref>, a provider of an IP-enabled

			 voice service that is not capable of providing 911 and E–911 services shall

			 provide a clear and conspicuous notice of the unavailability of such services

			 to each customer at the time of entering into a contract for such service with

			 that customer.</text>

			</subsection><subsection id="HE89AFDBF70A244EF9F619E9270EFF2F2"><enum>(f)</enum><header>Voice service

			 provider responsibility</header><text display-inline="yes-display-inline">An

			 IP-enabled voice service provider shall have the sole responsibility for the

			 proper design, operation, and function of the 911 and E911 access capabilities

			 offered to the provider’s customers.</text>

			</subsection><subsection id="H140E130297F4492596A987D7005E1F85"><enum>(g)</enum><header>Parity of

			 protection for provision or use of IP-Enabled voice service</header>

				<paragraph id="H7416875567254313ACA1CED11286ACC"><enum>(1)</enum><header>Provider

			 parity</header><text display-inline="yes-display-inline">If a provider of an

			 IP-enabled voice service offers 911 or E–911 services in compliance with the

			 rules required by

			 <internal-xref idref="H24E63AE6E2304AF3ACDC40423F69AA85" legis-path="2.(a)">subsection (a)</internal-xref>, that provider, its officers,

			 directors, employees, vendors, and agents, shall have immunity or other

			 protection from liability of a scope and extent that is not less than the scope

			 and extent of immunity or other protection from liability that any local

			 exchange company, and its officers directors, employees, vendors, or agents,

			 have under the applicable Federal and State law (whether through statute,

			 judicial decision, tariffs filed by such local exchange company, or otherwise),

			 including in connection with an act or omission involving the release of

			 subscriber information related to the emergency calls or emergency services to

			 a public safety answering point, emergency medical service provider, or

			 emergency dispatch provider, public safety, fire service, or law enforcement

			 official, or hospital emergency or trauma care facility.</text>

				</paragraph><paragraph id="H40AEBA0CE4C44EF2B56EAA9C009C9D46"><enum>(2)</enum><header>User

			 parity</header><text display-inline="yes-display-inline">A person using an

			 IP-enabled voice service that offers 911 or E–911 services pursuant to this

			 subsection shall have immunity or other protection from liability of a scope

			 and extent that is not less than the scope and extent of immunity or other

			 protection from liability under applicable law in similar circumstances of a

			 person using 911 or E–911 service that is not provided through an IP-enabled

			 voice service.</text>

				</paragraph><paragraph id="H8E47B1BF56EF4728B9D93F4CF3FAAA9"><enum>(3)</enum><header>PSAP

			 parity</header><text display-inline="yes-display-inline">In matters related to

			 IP-enabled 911 and E–911 communications, a PSAP, and its employees, vendors,

			 agents, and authorizing government entity (if any) shall have immunity or other

			 protection from liability of a scope and extent that is not less than the scope

			 and extent of immunity or other protection from liability under applicable law

			 accorded to such PSAP, employees, vendors, agents, and authorizing government

			 entity, respective, in matters related to 911 or E–911 communications that are

			 not provided via an IP-enabled voice service.</text>

				</paragraph></subsection><subsection id="HEEE85DBF001B4C5891DCD42300621E13"><enum>(h)</enum><header>Delegation

			 permitted</header><text>The Commission may, in the regulations prescribed under

			 this section, provide for the delegation to State commissions of authority to

			 implement and enforce the requirements of this section and the regulations

			 thereunder.</text>

			</subsection></section><section id="HFE5EDDF6DEF8441BABC800B2819B59C7"><enum>3.</enum><header>Migration to

			 IP–Enabled Emergency Network</header><text display-inline="no-display-inline">Section 158 of the National

			 Telecommunications and Information Administration Organization Act (as added by

			 section 104 of the ENHANCE 911 Act of 2004) is amended—</text>

			<paragraph id="H45B5DEE9036E43B99237A7312B00B700"><enum>(1)</enum><text>by redesignating

			 subsections (d) and (e) as subsections (e) and (f), respectively; and</text>

			</paragraph><paragraph id="H8CB4599C7C7544DDBB81DD414F4076CD"><enum>(2)</enum><text>by inserting after

			 subsection (c) the following:</text>

				<quoted-block display-inline="no-display-inline" id="HA3E426096ACD417D98B25FF01200ADC0" style="OLC">

					<subsection id="HC07BCADCA2F545EC8313D48EAA020008"><enum>(d)</enum><header>Migration plan

				required</header>

						<paragraph id="H1E07FD19BB344AFA0006FADEF09DD7B0"><enum>(1)</enum><header>National plan

				required</header><text>No more than 18 months after the date of the enactment

				of the ENHANCE 911 Act of 2004, the Office shall develop and report to Congress

				on a national plan for migrating to a national IP-enabled emergency network

				capable of receiving and responding to all citizen activated emergency

				communications.</text>

						</paragraph><paragraph id="H6C20E95070FA4C449609C7A8141BFFD1"><enum>(2)</enum><header>Contents of

				plan</header><text>The plan required by

				<internal-xref idref="HA3E426096ACD417D98B25FF01200ADC0" legis-path="(d)">paragraph (1)</internal-xref> shall—</text>

							<subparagraph id="H7F31ECCEF30B41E89F496BA4A4ED8775"><enum>(A)</enum><text>outline the

				potential benefits of such a migration;</text>

							</subparagraph><subparagraph id="H7E5452251F8E4E9BAAF16D566C4119B7"><enum>(B)</enum><text display-inline="yes-display-inline">identify barriers that must be overcome and

				funding mechanisms to address those barriers;</text>

							</subparagraph><subparagraph id="H0E9800EB25354D8BBE6F468556FD0954"><enum>(C)</enum><text>include a proposed

				timetable, an outline of costs and potential savings;</text>

							</subparagraph><subparagraph id="HBA8FE1BB652A4A7493EC94FE57B66DE6"><enum>(D)</enum><text>provide specific

				legislative language, if necessary, for achieving the plan; and</text>

							</subparagraph><subparagraph id="HA5D53361FC3C420B9C00FD5772A94729"><enum>(E)</enum><text>provide

				recommendations on any legislative changes, including updating definitions, to

				facilitate a national IP-enabled emergency network.</text>

							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HA76E01CE39214537B48C264897AC2339"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In developing the plan required by

				<internal-xref idref="HA3E426096ACD417D98B25FF01200ADC0" legis-path="(d)">paragraph (1)</internal-xref>, the Office shall consult with

				representatives of the public safety community, technology and

				telecommunications providers, and others it deems

				appropriate.</text>

						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="H076EEF178FAA47249E84E722DCDAF0AF"><enum>4.</enum><header>Definitions</header>

			<subsection id="H65E3C16B2EBA4A9697B3ECCB2FC820C9"><enum>(a)</enum><header>In

			 General</header><text>For purposes of this Act:</text>

				<paragraph id="H0C18C671206041FB93EE2E2575D81785"><enum>(1)</enum><header>911 and E–911

			 services</header>

					<subparagraph id="H00F478ECC52441218BB3295218B6BAD3"><enum>(A)</enum><header>911</header><text display-inline="yes-display-inline">The term <term>911</term> means a service

			 that allows a user, by dialing the three-digit code 911, to call a public

			 safety answering point operated by a State, local government, Indian tribe, or

			 authorized entity.</text>

					</subparagraph><subparagraph id="H22E23D7D96984A56945EA95FD57B99C1"><enum>(B)</enum><header>E–911</header><text>The

			 term <term>E–911 service</term> means a 911 service that automatically delivers

			 the 911 call to the appropriate public safety answering point, and provides

			 automatic identification data, including the originating number of an emergency

			 call, the physical location of the caller, and the capability for the public

			 safety answering point to call the user back if the call is

			 disconnected.</text>

					</subparagraph></paragraph><paragraph id="HB6C894F685644F4FBB2DC39E27D8448C"><enum>(2)</enum><header>IP-enabled voice

			 service</header><text display-inline="yes-display-inline">The term

			 <term>IP-enabled voice service</term> means an IP-enabled service used for

			 real-time 2-way or multidirectional voice communications offered to a customer

			 that—</text>

					<subparagraph id="H8B882CCFC37C4294B5DC8300D7254CF6"><enum>(A)</enum><text>uses North

			 American Numbering Plan administered telephone numbers, or successor protocol;

			 and</text>

					</subparagraph><subparagraph id="H32EFDC57A0E541BAAF8D63804B04D51E"><enum>(B)</enum><text>has two-way

			 interconnection or otherwise exchange traffic with the public switched

			 telephone network.</text>

					</subparagraph></paragraph><paragraph id="H2AC25618406448C40070DF900E3DB09"><enum>(3)</enum><header>Customer</header><text>The

			 term <term>customer</term> includes a consumer of goods or services whether for

			 a fee, in exchange for an explicit benefit, or provided for free.</text>

				</paragraph><paragraph id="HFD15108504624C939E136109A6C64E00"><enum>(4)</enum><header>IP-enabled

			 service</header><text display-inline="yes-display-inline">The term

			 <term>IP-enabled service</term> means the use of software, hardware, or network

			 equipment that enable an end user to send or receive a communication over the

			 public Internet or a private network utilizing Internet protocol, or any

			 successor protocol, in whole or part, to connect users—</text>

					<subparagraph id="HE78A3F2FB70E464FB067F1008EBDFD48"><enum>(A)</enum><text>regardless of

			 whether the communication is voice, data, video, or other form; and</text>

					</subparagraph><subparagraph id="HF1D95E305CC045308CDD0445BD082FE3"><enum>(B)</enum><text>notwithstanding

			 —</text>

						<clause id="H2AD57EE7CFB34E5588F9A5676E463C1"><enum>(i)</enum><text>the

			 underlying transmission technology used to transmit the communications;</text>

						</clause><clause id="H1FE2C5C52C934F40A0BAD23BBE1E853B"><enum>(ii)</enum><text>whether the

			 packetizing and depacketizing of the communications occurs at the customer

			 premise or network level; or</text>

						</clause><clause id="HE0F125D862D34BE999EC3439006568C9"><enum>(iii)</enum><text>the software,

			 hardware, or network equipment used to connect users.</text>

						</clause></subparagraph></paragraph><paragraph id="HCF74CA6F09E647D5B42DF04C00049BAB"><enum>(5)</enum><header>Public switched

			 telephone network</header><text display-inline="yes-display-inline">The term

			 <term>public switched telephone network</term> means any switched common

			 carrier service that is interconnected with the traditional local exchange or

			 interexchange switched network.</text>

				</paragraph><paragraph id="HC23021A481284BB38F4DB4E507752148"><enum>(6)</enum><header>PSAP</header><text display-inline="yes-display-inline">The term <term>public safety answering

			 point</term> or <term>PSAP</term> means a facility that has been designated to

			 receive 911 calls.</text>

				</paragraph></subsection><subsection id="H6E2720F9B5934E8CA7FB8DCAF0F8DAED"><enum>(b)</enum><header>Common

			 terminology</header><text>Except as otherwise provided in subsection (a), terms

			 used in this Act have the meanings provided under section 3 of the

			 Communications Act of 1934.</text>
