		<official-title>To amend the Robert T. Stafford Disaster Relief and

		  Emergency Assistance Act to specify procedures for the conduct of preliminary

		  damage assessments, to direct the Secretary of Homeland Security to vigorously

		  investigate and prosecute instances of fraud, including fraud in the handling

		  and approval of claims for Federal emergency assistance, and for other

		  purposes.</official-title>

		<section id="idA66FC2C277EA471BB8E5378B81D4C4C1" section-type="section-one"><enum>1.</enum><header>Findings and

			 Purposes</header>

			<subsection id="idB1EF1A1735CD4298B8D38CE345304854"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>

				<paragraph id="idA777E501BD31455A9864B989B95D43CE"><enum>(1)</enum><text display-inline="yes-display-inline">in the aftermath of the 4 hurricanes that

			 occurred within 6 weeks in the southeast United States during 2004, many of the

			 inspectors and managers employed to inspect and document disaster-related

			 damage in that area had criminal records;</text>

				</paragraph><paragraph id="id7712ACF541FD40758EC61B0D003BC885"><enum>(2)</enum><text>preliminary

			 damage assessments provide important information about the impact and magnitude

			 of damage and the needs of individuals, businesses, the public sector, and the

			 community as a whole; and</text>

				</paragraph><paragraph id="idB891D8D1CD4D46D08B7A69181D4B573E"><enum>(3)</enum><text>the failure to

			 conduct a preliminary damage assessment can result in Federal funds being

			 provided to areas that have not suffered the level of damage that would qualify

			 an area for Federal disaster assistance.</text>

				</paragraph></subsection><subsection id="id704F52308314475296E125250B5A2C78"><enum>(b)</enum><header>Purposes</header><text>The

			 purposes of this Act are—</text>

				<paragraph id="id47BBFBD81B7747E28569DE80422F77D6"><enum>(1)</enum><text>to ensure the

			 appropriate use of public funds;</text>

				</paragraph><paragraph id="idE7855AE397E2434ABA80CB543C2D13F7"><enum>(2)</enum><text>to protect

			 disaster victims; and</text>

				</paragraph><paragraph id="idCC21E7951787447783ED55701DA837A1"><enum>(3)</enum><text>to require more

			 stringent background checks for contractors of the Federal Emergency Management

			 Agency.</text>

				</paragraph></subsection></section><section id="idFC56E298193341F78AEEA9068F43A831" section-type="subsequent-section"><enum>2.</enum><header>Preliminary damage

			 assessments</header><text display-inline="no-display-inline">Section 401 of the

			 Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.

			 5170) is amended—</text>

			<paragraph id="idBADAAB410FF8468A8EE67A24882177AE"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>All requests for</quote>

			 and inserting the following:</text>

				<quoted-block display-inline="no-display-inline" id="id562A403FEE124143ACB2F650E5E466B0" style="OLC">

					<subsection id="id8C886A0D23D94F1FA1E3B1E5DE09C52A"><enum>(a)</enum><header>In

				general</header><text>All requests for</text>

					</subsection><after-quoted-block>;

				and</after-quoted-block></quoted-block>

			</paragraph><paragraph id="idF595FAF28E7E48A5A573EB1CB20D670E"><enum>(2)</enum><text>by adding at the

			 end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id37C9380EBD98418EBB300C9D76E69AAE" style="OLC">

					<subsection id="id227A509BD81D49C99566ED4F8D338137"><enum>(b)</enum><header>Preliminary

				damage assessments</header>

						<paragraph id="id29595A5EB60F4E06B874285797303768"><enum>(1)</enum><header>Definitions</header><text>In

				this subsection:</text>

							<subparagraph id="id47FA5D1A57E440A58AD54B59913AA60E"><enum>(A)</enum><header>Assessment</header><text>The

				term <term>assessment</term> means a preliminary damage assessment described in

				paragraph (2)(A).</text>

							</subparagraph><subparagraph id="idE5840531B98F481480708FAA574CF7D8"><enum>(B)</enum><header>Director</header><text>The

				term <term>Director</term> means the Director of FEMA.</text>

							</subparagraph><subparagraph id="idFE2AB496FD3747758947E8F05387C55C"><enum>(C)</enum><header>FEMA</header><text>The

				term <term>FEMA</term> means the Federal Emergency Management Agency.</text>

							</subparagraph><subparagraph id="id4A59B2D33EB243D4A642BA8138F68E9C"><enum>(D)</enum><header>Incident</header><text>The

				term <term>incident</term> means a condition or occurrence that causes such

				damage or hardship as may result in a Presidential declaration of a major

				disaster or emergency.</text>

							</subparagraph><subparagraph id="idB3B957E92D8C4C7E8132F845CA655CD0"><enum>(E)</enum><header>Secretary</header><text>The

				term <term>Secretary</term> means the Secretary of Homeland Security, acting

				through the Director.</text>

							</subparagraph></paragraph><paragraph id="ID60d48b2a99764112b1b66f36abb41647"><enum>(2)</enum><header>Preliminary

				damage assessment</header>

							<subparagraph id="IDcd95739b91cd4a729959c0ccc8a1e24a"><enum>(A)</enum><header>Preassessment

				by the State</header><text>Except as provided in subparagraph (E), on

				occurrence of an incident, or if a State determines that the occurrence of an

				incident is imminent, and the State official responsible for disaster

				operations determines that the State and local governments may lack the

				capability to adequately respond to the incident, the State shall—</text>

								<clause id="idAA3BE9A9B08D458F8B309B82831A520F"><enum>(i)</enum><text>verify the

				information of the State used to make the determination; and</text>

								</clause><clause id="id63452A7EA60349F9B0C198ECA610113E"><enum>(ii)</enum><text>request the

				Regional Director to perform a joint FEMA-State preliminary damage assessment

				of the type, extent, and location of any damage caused by the incident.</text>

								</clause></subparagraph><subparagraph id="ID9da251ed03ca4854986c26aa20708c12"><enum>(B)</enum><header>Damage

				assessment teams</header><text>Each State shall appoint a damage assessment

				team to carry out assessments described in subparagraph (A) that is composed

				of—</text>

								<clause id="id89D201D39EAB4B50A98DFD9BC9A35886"><enum>(i)</enum><text>at least 1

				representative of the Federal Government;</text>

								</clause><clause id="id7BFAB572FB3842878107961235F99F12"><enum>(ii)</enum><text>a least 1

				representative of the State;</text>

								</clause><clause id="id81AC118AC2334C24BF57664B7CE452D4"><enum>(iii)</enum><text>if practicable,

				a local government representative who is familiar with the extent and location

				of damage or potential damage in any applicable communities; and</text>

								</clause><clause id="id28F06F46739E453AA3D0090477C9B845"><enum>(iv)</enum><text>such additional

				representatives from Federal and State agencies and voluntary relief

				organizations as are necessary, as determined by the State.</text>

								</clause></subparagraph><subparagraph id="idE7AE3101876E4869A462A1C441CC8BD8"><enum>(C)</enum><header>Responsibility

				of state</header><text>A State shall assume responsibility for—</text>

								<clause id="id2F30C8CBE9534522AA7A50E8A747B574"><enum>(i)</enum><text>coordination of

				State and local participation in an assessment conducted under this paragraph;

				and</text>

								</clause><clause id="idDBDF928B3BE144328AE348244074F8F4"><enum>(ii)</enum><text>ensuring that

				participants in the assessment receive timely notification concerning the

				schedule of activities for the assessment.</text>

								</clause></subparagraph><subparagraph id="idFFC3D2A877434179AD20A9250D0F4E99"><enum>(D)</enum><header>Responsibility

				of fema</header><text>The Secretary shall designate an official of FEMA—</text>

								<clause id="id2F793065833C4A3B83E86FCA98001F63"><enum>(i)</enum><text>to brief members

				of the assessment team on—</text>

									<subclause id="id8B7615663491418FB93FF3654A0748C2"><enum>(I)</enum><text>damage

				criteria;</text>

									</subclause><subclause id="idC69F563445F64FB3A753D9A6FC21229C"><enum>(II)</enum><text>the kind of

				information to be collected for the particular incident that is the subject of

				the assessment; and</text>

									</subclause><subclause id="id08A719D07C96493396664809FEE832B5"><enum>(III)</enum><text>applicable

				reporting requirements; and</text>

									</subclause></clause><clause id="IDfd44327946f34c0ab6d813645a000740"><enum>(ii)</enum><text>on completion of

				the assessment, to consult with State officials to discuss findings and

				reconcile any differences.</text>

								</clause></subparagraph><subparagraph id="ID651ddd996f95492391b6fceb7077a13c"><enum>(E)</enum><header>Waiver</header>

								<clause id="idC2CDF39539C64E7BA58E8969B8318BE4"><enum>(i)</enum><header>In

				general</header><text>The State, in consultation with the Regional Director or

				FEMA, may elect not to carry out an assessment—</text>

									<subclause id="id429BAAAE81E149F397FE0501BA633191"><enum>(I)</enum><text>in the case of an

				incident of unusual severity and magnitude that does not require any field

				damage assessments to determine the need for supplemental Federal assistance

				under this Act; or</text>

									</subclause><subclause id="id1B3FD992C8AF44F1BB1C7A91295431EC"><enum>(II)</enum><text>in other

				appropriate cases, as determined by the State, in consultation with the

				Regional Director of FEMA.</text>

									</subclause></clause><clause id="idE0F57704D0C14FE78DD60C566E7527D1"><enum>(ii)</enum><header>Managerial

				response</header><text>Nothing in this subparagraph prevents the conduct of an

				assessment to determine unmet needs for managerial response

				purposes.</text>

								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</paragraph></section><section id="id9DFD3374D6154199B91A7E1330060CBD"><enum>3.</enum><header>Fraud</header>

			<subsection id="id78ABBA70D5A049EFB1E447FE8DCD4443"><enum>(a)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 314(d) of the Robert T. Stafford

			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5157(d)) is amended by

			 striking <quote>$5,000</quote> and inserting <quote>$10,000</quote>.</text>

			</subsection><subsection id="id20114857E660491DAAA3CF98F5C4F432"><enum>(b)</enum><header>Fraud

			 investigations</header><text display-inline="yes-display-inline">Section 318 of

			 the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.

			 5161) is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="id8443805B72CC47BEAA35724E63A2E0EC" style="OLC">

					<subsection id="idA6202E165E3A483C8FFDEF05A3302C59"><enum>(d)</enum><header>Fraud

				investigations</header>

						<paragraph id="id1F7CBFE1129F4463B1AF28001E231B0F"><enum>(1)</enum><header>In

				general</header><text>The President shall—</text>

							<subparagraph id="id2E2F7FD65AE74CD48D8581EDE0636866"><enum>(A)</enum><text>vigorously

				investigate allegations and instances of fraud under this Act, including fraud

				relating to the handling and approval of claims for Federal emergency

				assistance; and</text>

							</subparagraph><subparagraph id="id70DDFA3F99AF4DFE910D63C5453B6E98"><enum>(B)</enum><text>refer to the

				Attorney General of the United States, in accordance with section 314(c), such

				allegations, instances, and results of investigations described in subparagraph

				(A) as the President determines to be appropriate.</text>

							</subparagraph></paragraph><paragraph id="id6DE242900FF144BB8030997059B4DE64"><enum>(2)</enum><header>Attorney

				general</header><text>The Attorney General of the United States shall—</text>

							<subparagraph id="id3BA51DC0D19443AE817DED13B01E62A3"><enum>(A)</enum><text>give serious

				consideration to any allegations or instances of fraud referred under paragraph

				(1)(B);</text>

							</subparagraph><subparagraph id="idB66EBADB01BE44BC80155E48C451216A"><enum>(B)</enum><text>not later than 10

				days after the date of receipt of such a referral, begin an investigation into

				the allegation; and</text>

							</subparagraph><subparagraph id="id248C03F704064CC49B4018DD81FA0959"><enum>(C)</enum><text>not later than 45

				days after the date of receipt of the referral, submit to the Secretary of

				Homeland Security a report describing the progress and results of the

				investigation.</text>

							</subparagraph></paragraph><paragraph id="idE449B86DCE714AD1ABD3853CDC6DC60E"><enum>(3)</enum><header>Federal

				Emergency Management Agency</header>

							<subparagraph id="idC0E16A6A069244D88B6AA57CE2EE2D80"><enum>(A)</enum><header>Procedures and

				guidelines</header><text>Not later than 120 days after the date of enactment of

				this subsection, the Director of the Federal Emergency Management Agency

				(referred to in this paragraph as the <term>Director</term>) shall—</text>

								<clause id="ID36ced18a332546b39f38e6ecc7af986a"><enum>(i)</enum><text>propose new

				inspection procedures that more accurately identify disaster-related losses of

				household items for which applicants should be compensated;</text>

								</clause><clause id="ID179526cee0654a72b02b4510ea1f7e79"><enum>(ii)</enum><text>modify

				guidelines relating to individual and housing inspections to require inspectors

				to specify any item that was not available for inspection;</text>

								</clause><clause id="ID0d79dcbf08084f619fa0ab3df11251ec"><enum>(iii)</enum><text>develop

				eligibility criteria for funding vehicle damage, taking into consideration

				damage to a vehicle sustained as a result of a disaster;</text>

								</clause><clause id="id9FF1DA00A725473AAA6766D8DA7A40C8"><enum>(iv)</enum><text>propose new

				inspection guidelines that prohibit inspectors from entering into a contract

				with any individual or entity for whom the inspector performs an inspection for

				purposes of determining eligibility for assistance from the Federal Emergency

				Management Agency;</text>

								</clause><clause id="IDb0cd713c3f70428abb5a5f4c0b8a6110"><enum>(v)</enum><text>modify guidelines

				to require contract inspectors to—</text>

									<subclause id="id9D902E7BC99F4D49A04D9CB92A56A6C0"><enum>(I)</enum><text>document vehicle

				damage to allow the Director to justify an award based on disaster-related

				need; and</text>

									</subclause><subclause id="idC151FCF8BC4A4BBCB7FEFD782ECE4BC5"><enum>(II)</enum><text>base any funding

				recommendation of the contract inspector for miscellaneous items on

				disaster-related need;</text>

									</subclause></clause><clause id="ID0b526249ea254be8a9d9bed1b2d12337"><enum>(vi)</enum><text>modify

				guidelines to establish a reasonable replacement value for destroyed vehicles,

				as determined by the Director, taking into consideration the cost of acquiring

				a comparable vehicle;</text>

								</clause><clause id="ID3af730b8a1bd4413817fd62727a15c29"><enum>(vii)</enum><text>develop

				criteria and guidelines for defining the term <quote>disaster-related

				death</quote>, including a requirement that an employee of the Federal

				Emergency Management Agency document each request for funeral expenses

				assistance in order to support the approval or disapproval of the

				assistance;</text>

								</clause><clause id="IDcda83f1f81554d2999f7097435783e8d"><enum>(viii)</enum><text>modify home

				inspection procedures to require contract inspectors to document—</text>

									<subclause id="id22B333EF768C46A0BAD81A947CBA7E9B"><enum>(I)</enum><text>any reason why

				the contractor determined a home was unsafe; and</text>

									</subclause><subclause id="id4E47AF8DCF7B4EF3AB2493859B19D77B"><enum>(II)</enum><text>any instance of

				deferred maintenance, including an evaluation of the severity of housing

				conditions;</text>

									</subclause></clause><clause id="ID3c6c756ec4fc45b2a97152bc8c8bd575"><enum>(ix)</enum><text>modify

				inspection guidelines for repair and replacement of homes to require inspectors

				to justify a determination that a home is destroyed by identifying and

				documenting each type of damage sustained by the home; and</text>

								</clause><clause id="ID71001561f4404c14b56ce35883161755"><enum>(x)</enum><text>review and modify

				each inspection contract to require contractors to—</text>

									<subclause id="id6FD4F0CA20B6475196DBB1E0C8871B9D"><enum>(I)</enum><text>review the

				quality of work of an inspector before submitting inspection data to the

				Director;</text>

									</subclause><subclause id="ID21a36915ffde416fa84ecb55db00ccdd"><enum>(II)</enum><text>certify the

				independence of the contractor during each inspection;</text>

									</subclause><subclause id="idF3F915CF9DCD47CEB98A6B4CD50E50DB"><enum>(III)</enum><text>recuse

				themselves from any inspections that present a possible conflict of interest;

				and</text>

									</subclause><subclause id="id4B82EC7C27F542EA83FD7C14ADCE69BB"><enum>(IV)</enum><text>consent to a

				criminal background check in accordance with subparagraph (B).</text>

									</subclause></clause></subparagraph><subparagraph id="id2C873B6CCC574C95BC47173A86FDBE67"><enum>(B)</enum><header>Report</header><text>Not

				later than 180 days after the Director develops procedures and guidelines under

				subparagraph (A), the Director shall submit to the Committee on Homeland

				Security and Governmental Affairs of the Senate and the Committee on

				Transportation and Infrastructure of the House of Representatives a report that

				describes any change to the procedures and guidelines of the Federal Emergency

				Management Agency.</text>

							</subparagraph><subparagraph id="id8EB1C7EFD0A845C0AAF8FF8B10CAD788"><enum>(C)</enum><header>Background

				checks</header><text>The Director shall include in any contract with an

				inspector the requirements that—</text>

								<clause id="id5D9A295F6A7C4C67AC7BC1EB13EE5CA6"><enum>(i)</enum><text>a

				background check shall be performed on the inspector;</text>

								</clause><clause id="idAFB74A2FE52F4B99924BC5F66043F112"><enum>(ii)</enum><text>the results of

				the background check shall be submitted to the Director not later than 7 days

				after the date on which the inspector is hired by the Director; and</text>

								</clause><clause id="id0524F51827A94D35813B9D3892D853E4"><enum>(iii)</enum><text>an inspector

				who has been convicted of criminal misconduct (including fraud, robbery,

				burglary, forgery, and felony drug possession) shall not be employed by the

				Federal Emergency Management Agency as an

				inspector.</text>

								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
