			 <quote><short-title>No Child Left Behind Improvement Act

			 of 2005</short-title></quote>.</text>

		</section><title id="ID2601527E6FB64ADBAB946D455CCE2764"><enum>I</enum><header>Public school

			 choice, supplemental educational services, and teacher quality</header>

			<section id="IDD91D7487EC5947D29EE1D03918F078C3"><enum>101.</enum><header>Public school

			 choice capacity</header>

				<subsection id="IDCF3E90DDA34F458DB71D186146692DC1"><enum>(a)</enum><header>School

			 capacity</header><text><external-xref legal-doc="act" parsable-cite="ESEA/1116(b)(1)(E)">Section 1116(b)(1)(E)</external-xref> of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316(b)">20 U.S.C. 6316(b)(1)(E)</external-xref>) is

			 amended—</text>

					<paragraph id="ID407DA16976CB431E9C736CEB89826CB4"><enum>(1)</enum><text>in clause (i), by

			 striking <quote>In the case</quote> and inserting <quote>Subject to clauses

			 (ii) and (iii), in the case</quote>;</text>

					</paragraph><paragraph id="ID6B82B0291A3F46A89BA61B2CB609A297"><enum>(2)</enum><text>by redesignating

			 clause (ii) as clause (iii);</text>

					</paragraph><paragraph id="IDA851E874D4FB4CC2870375645A674125"><enum>(3)</enum><text>by inserting

			 after clause (i) the following:</text>

				capacity</header><text>The obligation of a local educational agency to provide

				the option to transfer to students under clause (i) is subject to all

				applicable State and local health and safety code requirements regarding

				facility capacity.</text>

				and</after-quoted-block></quoted-block>

					</paragraph><paragraph id="IDC684C580CA1540349ACB6ADE08B938C2"><enum>(4)</enum><text>in clause (iii)

			 (as redesignated by paragraph (2)), by inserting <quote>and subject to clause

			 (ii),</quote> after <quote>public school,</quote>.</text>

					</paragraph></subsection><subsection id="ID5A0DEE832F324DA6B3B6816F9477452D"><enum>(b)</enum><header>Grants for

			 school construction and renovation</header><text>Subpart 1 of part A of title I

			 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20

			 U.S.C. 6311</external-xref> et seq.) is amended by adding at the end the

			 following:</text>

					<quoted-block act-name="Elementary and Secondary Education Act of 1965" id="IDDDBC3A854A5B431A9C9E2C45102676C7">

						<section id="ID1752DACF8EC64E30B8FBB8F99352DB8C"><enum>1120C.</enum><header>Grants for

				school construction and renovation</header>

							<subsection id="ID6A2E46CBD67446CF851C639443623847"><enum>(a)</enum><header>Program

				authorized</header><text>From funds appropriated under subsection (g), the

				Secretary is authorized to award grants to local educational agencies

				experiencing overcrowding in the schools served by the local educational

				agencies, for the construction and renovation of safe, healthy,

				high-performance school buildings.</text>

							</subsection><subsection id="ID49E646C03AC2470D8DAE9755652544A3"><enum>(b)</enum><header>Application</header><text>Each

				local educational agency desiring a grant under this section shall submit an

				application to the Secretary at such time, in such manner, and accompanied by

				such additional information as the Secretary may require.</text>

							</subsection><subsection id="ID6B79E35541424F2585C01C6CEBCB754C"><enum>(c)</enum><header>Priority</header><text>In

				awarding grants under this section, the Secretary shall give priority to local

				educational agencies—</text>

								<paragraph id="ID49055F372D3D475C8D99B69C2A4392E5"><enum>(1)</enum><text>who have

				documented difficulties in meeting the public school choice requirements of

				paragraph (1)(E), (5)(A), (7)(C)(i), or (8)(A)(i) of section 1116(b), or

				section 1116(c)(10)(C)(vii); and</text>

								</paragraph><paragraph id="IDC06B806A89794FA69F89BC67EFB6E2EF"><enum>(2)</enum><text>with the highest

				number of schools at or above capacity.</text>

								</paragraph></subsection><subsection id="ID86CBE0DC02414670A62A473FB5F6F8A2"><enum>(d)</enum><header>Award

				basis</header><text>From funds remaining after awarding grants under subsection

				(c), the Secretary shall award grants to local educational agencies that are

				experiencing overcrowding in the schools served by the local educational

				agencies.</text>

							</subsection><subsection id="ID1949FFD417ED433B9943DDC7820851C8"><enum>(e)</enum><header>Prevailing

				wages</header><text>Any laborer or mechanic employed by any contractor or

				subcontractor in the performance of work on any construction funded by a grant

				awarded under this section will be paid wages at rates not less than those

				prevailing on similar construction in the locality as determined by the

				Secretary of Labor under subchapter IV of chapter 31 of title 40, United States

				Code (commonly referred to as the <act-name parsable-cite="DBA">Davis-Bacon

				Act</act-name>).</text>

							</subsection><subsection id="ID731B17C1EF4040AD988D0AE96A3A5055"><enum>(f)</enum><header>Definitions</header><text>In

				this section:</text>

								<paragraph id="ID3EEF67FA66774D01A14A5479D003CB5D"><enum>(1)</enum><header>At or above

				capacity</header><text>The term <term>at or above capacity</term>, in reference

				to a school, means a school in which 1 additional student would increase the

				average class size of the school above the average class size of all schools in

				the State in which the school is located.</text>

								</paragraph><paragraph id="ID79932C3780014D26BA5E8CDC95A47D11"><enum>(2)</enum><header>Healthy,

				high-performance school building</header><text>The term <term>healthy,

				high-performance school building</term> has the meaning given such term in

				section 5586.</text>

								</paragraph></subsection><subsection id="ID2C98F22BC7F142E188430B3F338E6F9F"><enum>(g)</enum><header>Authorization

				of appropriations</header><text>There are authorized to be appropriated to

				carry out this section $250,000,000 for fiscal year 2006, and such sums as may

				be necessary for each of the 2 succeeding fiscal

				years.</text>

							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

				</subsection></section><section id="IDD828516D94C746039512CD8764F4A062"><enum>102.</enum><header>Supplemental

			 educational services</header><text display-inline="no-display-inline">Section

			 1116(e) of the <act-name parsable-cite="ESEA">Elementary and Secondary

			 Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316(e)">20 U.S.C. 6316(e)</external-xref>) is

			 amended—</text>

				<paragraph id="IDFFB0C6D2C6C0453A84F2D52787B73394"><enum>(1)</enum><text>in paragraph

			 (4)—</text>

					<subparagraph id="IDC6660AD922394A6D8935EE9407D42788"><enum>(A)</enum><text>in subparagraph

			 (B), by striking the semicolon and inserting</text>

						<quoted-block display-inline="yes-display-inline" id="IDEF552C52A26A4C1BAEAD4562C494E6C3">

							<text>,

			 including criteria that—</text><clause id="IDEAFB962A73E54F32B6B6BF4B9CE57FCF"><enum>(i)</enum><text>ensure that

				personnel delivering supplemental educational services to students have

				adequate qualifications; and</text>

							</clause><clause id="ID25C4BBB5461D4B7A8795E8AEF028F615"><enum>(ii)</enum><text>may, at the

				State’s discretion, ensure that personnel delivering supplemental educational

				services to students are teachers that are highly qualified, as such term is

				defined in section

				9101;</text>

							</clause><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph><subparagraph id="ID5F6E5986D04F429DAF79E40EC0332385"><enum>(B)</enum><text>in subparagraph

			 (D), by striking <quote>and</quote> after the semicolon;</text>

					</subparagraph><subparagraph id="ID4A8FF7EE5E314123870D6E7CE60209E8"><enum>(C)</enum><text>in subparagraph

			 (E), by striking the period and inserting <quote>; and</quote>; and</text>

					</subparagraph><subparagraph id="IDA4CF8537F5644DE49820A3A672BE1140"><enum>(D)</enum><text>by adding at the

			 end the following:</text>

						<quoted-block id="IDCCC97F040F3546DCA6651597FBEC16BD">

							<subparagraph id="IDD54DDA5E3E664323A9BA3DF20D4E43A2"><enum>(F)</enum><text>ensure that the

				list of approved providers of supplemental educational services described in

				subparagraph (C) includes a choice of providers that have sufficient capacity

				to provide effective services for children who are limited English proficient

				and children with

				disabilities.</text>

							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph id="IDA10FFE7EE596444EB6B03C86A2E3B605"><enum>(2)</enum><text>in paragraph

			 (5)(C)—</text>

					<subparagraph id="ID661FC13E51FA4367AD98CD6225F64538"><enum>(A)</enum><text>by striking

			 <quote>applicable</quote>; and</text>

					</subparagraph><subparagraph id="ID6B3CCC828042438B99724551D29B11EC"><enum>(B)</enum><text>by inserting

			 before the period <quote>, and acknowledge in writing that, as an approved

			 provider in the relevant State educational agency program of providing

			 supplemental educational services, the provider is deemed to be a recipient of

			 Federal financial assistance</quote>;</text>

					</subparagraph></paragraph><paragraph id="ID3C5A3BFBC04B467EA687B147982CF33F"><enum>(3)</enum><text>by redesignating

			 paragraphs (6), (7), (8), (9), (10), (11), and (12) as paragraphs (7), (8),

			 (9), (10), (11), (12), and (13), respectively;</text>

				</paragraph><paragraph id="IDBCF2D4158D664109BBE8D1F98202DCCD"><enum>(4)</enum><text>by inserting

			 after paragraph (5) the following:</text>

						<paragraph id="IDF808B3875AFF484F93E55B2B240EEAC1"><enum>(6)</enum><header>Rule of

				construction</header><text>Nothing in this section shall be construed to

				prohibit a local educational agency from being considered by a State

				educational agency as a potential provider of supplemental educational services

				under this subsection, if such local educational agency meets the criteria

				adopted by the State educational agency in accordance with paragraph

				(5).</text>

						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>

				</paragraph><paragraph id="IDAACFB0ACC9274651A88B8B2D62C4702F"><enum>(5)</enum><text>in paragraph (13)

			 (as redesignated by paragraph (3))—</text>

					<subparagraph id="ID05ACBCBDBC834D6C8D74AB42144C974C"><enum>(A)</enum><text>in subparagraph

			 (B)—</text>

				paragraph (4)(C), is deemed to be a recipient of Federal financial assistance;

				and</after-quoted-block></quoted-block>

						</clause></subparagraph><subparagraph id="ID55FAAFB062F8418BBF3FA4BF76D9F997"><enum>(B)</enum><text>in subparagraph

			 (C)—</text>

						<clause id="ID484C4AEAAA6345D3B896A5AE91500641"><enum>(i)</enum><text>in

			 the matter preceding subclause (i), by striking <quote>are</quote>;</text>

						</clause><clause id="IDF0679D19E6CD43B2B5052FE423D03EBD"><enum>(ii)</enum><text>in

			 subclause (i)—</text>

						</clause></subparagraph></paragraph><paragraph id="IDCDD13CC26C284BBBAD3BFC8A115C974C"><enum>(6)</enum><text>by adding at the

			 end the following:</text>

						<paragraph id="ID23AD4D0ED8FC40319EA50C427E1C1448"><enum>(14)</enum><header>Civil

				rights</header><text>In providing supplemental educational services under this

				subsection, no State educational agency or local educational agency may,

				directly or through contractual, licensing, or other arrangements with a

				provider of supplemental educational services, engage in any form of

				discrimination prohibited by—</text>

							<subparagraph id="ID30D0A6C53CD84EAB83822617EA5B733E"><enum>(A)</enum><text>title VI of the

				<act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name>;</text>

							</subparagraph><subparagraph id="IDCD6377CDF5BB4C8F9FF7B02FA41EACAD"><enum>(B)</enum><text>title IX of the

				Education Amendments of 1972;</text>

							</subparagraph><subparagraph id="ID562587F64422442C88D71045B1B02C0F"><enum>(C)</enum><text>section 504 of

				the <act-name parsable-cite="REH">Rehabilitation Act of 1973</act-name>;</text>

							</subparagraph><subparagraph id="IDBBDCFA7D4EAA4AC99213BC772D9D0232"><enum>(D)</enum><text>titles II and III

				of the Americans with Disabilities Act;</text>

							</subparagraph><subparagraph id="ID0275BC1DD88A4E41B74325B060869999"><enum>(E)</enum><text>the

				<act-name parsable-cite="ADA75">Age Discrimination Act of

				1975</act-name>;</text>

							</subparagraph><subparagraph id="ID8A559DDF02954CFA823D65F4014B3B76"><enum>(F)</enum><text>regulations

				promulgated under the authority of the laws listed in subparagraphs (A) through

				(E); or</text>

							</subparagraph><subparagraph id="ID3282EC163F504BB4B843361BF2098073"><enum>(G)</enum><text>other Federal

				civil rights

				laws.</text>

							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></section><section id="IDF4AEAFD3086D4E4CA7FE78A52AFA144D"><enum>103.</enum><header>Qualifications

			 for teachers and paraprofessionals</header>

				<subsection id="IDBDE13E61DABD4CF4866A1FCCE1B496EF"><enum>(a)</enum><header>High objective

			 uniform State standard of evaluation</header><text><external-xref legal-doc="act" parsable-cite="ESEA/1119">Section 1119</external-xref> of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6319">20

			 U.S.C. 6319</external-xref>) is amended—</text>

					<paragraph id="ID1F7999A6D5DE48A78612E8BD1B5DB8DC"><enum>(1)</enum><text>in subsection

			 (a)(2)—</text>

						<subparagraph id="IDC0460A49BFF04FC2933869DF5F445B2B"><enum>(A)</enum><text>by redesignating

			 subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and

			 indenting as appropriate;</text>

				available to teachers in the State the high objective uniform State standard of

				evaluation, as described in section 9101(23)(C)(ii), for the purpose of meeting

				the teacher qualification requirements established under this

				section.</text>

								</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>

						</subparagraph></paragraph><paragraph id="ID6A3DEE9D72A94664A10EF73CF9895245"><enum>(2)</enum><text>by redesignating

			 subsections (e), (f), (g), (h), (i), (j), (k), and (l) as subsections (f), (g),

			 (h), (i), (j), (k), (l), and (m), respectively;</text>

					</paragraph><paragraph id="ID21897B7F7AB0436EAB77FD574192582B"><enum>(3)</enum><text>by inserting

			 after subsection (d) the following:</text>

				responsibilities</header><text>Each State educational agency shall ensure that

				local educational agencies in the State make available all options described in

				subparagraphs (A) through (C) of subsection (c)(1) to each new or existing

				paraprofessional for the purpose of demonstrating the qualifications of the

				paraprofessional, consistent with the requirements of this

				section.</text>

							</subsection><after-quoted-block>;

				and</after-quoted-block></quoted-block>

					</paragraph><paragraph id="IDB95CDFBA1C3947EA8AF9AA12498D8C07"><enum>(4)</enum><text>in subsection (l)

			 (as redesignated in paragraph (2)), by striking <quote>subsection (l)</quote>

			 and inserting <quote>subsection (m)</quote>.</text>

					</paragraph></subsection><subsection id="ID34ACFFAFDD3E45C092AFB037C48921E2"><enum>(b)</enum><header>Definition of

			 highly qualified teachers</header><text>Section 9101(23)(B)(ii) of the

			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801(23)(B)(ii)) is

			 amended—</text>

					<paragraph id="IDD4B2A169C8B249F78EA111BEFCE6EFFA"><enum>(1)</enum><text>in subclause (I),

			 by striking <quote>or</quote> after the semicolon;</text>

					</paragraph><paragraph id="IDAE43F2040DC5403D9207CCD6BEE75D15"><enum>(2)</enum><text>in subclause

			 (II), by striking <quote>and</quote> after the semicolon; and</text>

					</paragraph><paragraph id="IDDAE6F98D374C450295D5FF1197FEF768"><enum>(3)</enum><text>by adding at the

			 end the following:</text>

						<quoted-block id="IDD63E6C77F87D42D8AE68A00B41CC7399">

							<subclause id="ID712A4B479C99407E884CAAFE98E99600"><enum>(III)</enum><text>in the case of

				a middle school teacher, passing a State-approved middle school generalist exam

				when the teacher receives a license to teach middle school in the State;</text>

							</subclause><subclause id="ID96110FB88C024C75B6B457A496C6A0A7"><enum>(IV)</enum><text>obtaining a

				State middle school or secondary school social studies certificate that

				qualifies the teacher to teach history, geography, economics, civics, and

				government in middle schools or in secondary schools, respectively, in the

				State; or</text>

							</subclause><subclause id="ID0F4FCAF76ED643A086CCA4345CE8C3C7"><enum>(V)</enum><text>obtaining a State

				middle school or secondary school science certificate that qualifies the

				teacher to teach earth science, biology, chemistry, and physics in middle

				schools or secondary schools, respectively, in the State;

				and</text>

							</subclause><after-quoted-block>.</after-quoted-block></quoted-block>

					</paragraph></subsection></section><section id="idCFABB7FAA8084917BB56B935F27CE0FB"><enum>104.</enum><header>Ensuring

			 highly qualified teachers</header>

				<subsection id="IDb210193accd9495e8b06b1f7a66247a7"><enum>(a)</enum><header>Requirement</header><text>The

			 Secretary of Education shall improve coordination among the teacher quality

			 programs authorized under the Elementary and Secondary Education Act of 1965

			 (20 U.S.C. 6301 et seq.), the Individuals with Disabilities Education Act (20

			 U.S.C. 1400 et seq.), the Higher Education Act of 1965 (20 U.S.C. 1001 et

			 seq.), and the Carl D. Perkins Vocational and Technical Education Act of 1998

			 (20 U.S.C. 2301 et seq.), to provide a unified effort in strengthening the

			 American teaching workforce and ensuring highly qualified teachers.</text>

				</subsection><subsection id="ID42fb63a0961f4fa8a2f7af391c2bf667"><enum>(b)</enum><header>Report</header><text>Not

			 later than 6 months after the date of enactment of this Act, the Secretary of

			 Education shall submit a report to the relevant committees of Congress on

			 efforts to coordinate programs pursuant to subsection (a), which shall be made

			 available on the website of the Department of Education.</text>

				</subsection></section></title><title id="id8F979214853E44FBA3F72B12B209F9E6"><enum>II</enum><header>Adequate yearly

			 progress determinations</header>

			<section id="IDD882819A9C7A4A4494AB1922BFF2825D"><enum>201.</enum><header>Review of

			 adequate yearly progress determinations for schools for the 2002–2003 school

			 year</header>

				<subsection id="ID5D53A3BF8AF44345A3C7BB09597E734F"><enum>(a)</enum><header>In

			 general</header><text>The Secretary shall require each local educational agency

			 to provide each school served by the agency with an opportunity to request a

			 review of a determination by the agency that the school did not make adequate

			 yearly progress for the 2002–2003 school year.</text>

				</subsection><subsection id="ID2A8BF026004947C7B60AAE25B18B941B"><enum>(b)</enum><header>Final

			 determination</header><text>Not later than 30 days after receipt of a request

			 by a school for a review under this section, a local educational agency shall

			 issue and make publicly available a final determination on whether the school

			 made adequate yearly progress for the 2002–2003 school year.</text>

				</subsection><subsection id="ID3C78170B01F94846B992617AFD41A696"><enum>(c)</enum><header>Evidence</header><text>In

			 conducting a review under this section, a local educational agency

			 shall—</text>

					<paragraph id="ID44E3630B02CC4EC0A50228C443116B94"><enum>(1)</enum><text>allow the

			 principal of the school involved to submit evidence on whether the school made

			 adequate yearly progress for the 2002–2003 school year; and</text>

					</paragraph><paragraph id="ID9171351998064C1DA2D501BBAD3771CE"><enum>(2)</enum><text>consider that

			 evidence before making a final determination under subsection (b).</text>

					</paragraph></subsection><subsection id="ID7B7E0422D33342FF8E99A5348E16B7DA"><enum>(d)</enum><header>Standard of

			 review</header><text>In conducting a review under this section, a local

			 educational agency shall revise, consistent with the applicable State plan

			 under <external-xref legal-doc="act" parsable-cite="ESEA/1111">section

			 1111</external-xref> of the <act-name parsable-cite="ESEA">Elementary and

			 Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>), the local

			 educational agency’s original determination that a school did not make adequate

			 yearly progress for the 2002–2003 school year if the agency finds that the

			 school made such progress, taking into consideration—</text>

					<paragraph id="ID6F251C56FB6147B3B0FB442BE136341E"><enum>(1)</enum><text>the amendments

			 made to part 200 of title 34, Code of Federal Regulations (68 Fed. Reg. 68698)

			 (relating to accountability for the academic achievement of students with the

			 most significant cognitive disabilities); or</text>

					</paragraph><paragraph id="ID922A0798980945A580CF16D0DFF8EE4D"><enum>(2)</enum><text>any regulation or

			 guidance that, subsequent to the date of such original determination, was

			 issued by the Secretary relating to—</text>

						<subparagraph id="ID83A9A81FD2394143949B954D4A843FBC"><enum>(A)</enum><text>the assessment of

			 limited English proficient children;</text>

						</subparagraph><subparagraph id="ID4E959C45E90F40D191D72BEAB6F6495A"><enum>(B)</enum><text>the inclusion of

			 limited English proficient children as part of the subgroup described in

			 <external-xref legal-doc="act" parsable-cite="ESEA/1111(b)(2)(C)(v)(II)(dd)">section

			 1111(b)(2)(C)(v)(II)(dd)</external-xref> of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311(b)(2)(C)(v)(II)(dd)">20 U.S.C.

			 6311(b)(2)(C)(v)(II)(dd)</external-xref>) after such children have obtained

			 English proficiency; or</text>

						</subparagraph><subparagraph id="ID22A7CE1958354D63A23659FDCDB7EA41"><enum>(C)</enum><text>any requirement

			 under <external-xref legal-doc="act" parsable-cite="ESEA/1111(b)(2)(I)(ii)">section

			 1111(b)(2)(I)(ii)</external-xref> of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311(b)(2)(I)(ii)">20

			 U.S.C. 6311(b)(2)(I)(ii)</external-xref>).</text>

						</subparagraph></paragraph></subsection><subsection id="ID6CD73DFB1F954A26A85932A92DBFCCD3"><enum>(e)</enum><header>Effect of

			 revised determination</header>

					<paragraph id="ID3D2D980A59B64760AA1F78A815C757F3"><enum>(1)</enum><header>In

			 general</header><text>If pursuant to a review under this section a local

			 educational agency determines that a school made adequate yearly progress for

			 the 2002–2003 school year, upon such determination—</text>

						<subparagraph id="IDE014F6F9225A49888BC6B5AFDC7DB656"><enum>(A)</enum><text>any action by the

			 Secretary, the State educational agency, or the local educational agency that

			 was taken because of a prior determination that the school did not make such

			 progress shall be terminated; and</text>

						</subparagraph><subparagraph id="ID56D412A7411A4F54BF20C96982A38B02"><enum>(B)</enum><text>any obligations

			 or actions required of the local educational agency or the school because of

			 the prior determination shall cease to be required.</text>

						</subparagraph></paragraph><paragraph id="IDC000628414C04D3EA80F10B99363A89E"><enum>(2)</enum><header>Exceptions</header><text>Notwithstanding

			 paragraph (1), a determination under this section shall not affect any

			 obligation or action required of a local educational agency or school under the

			 following:</text>

						<subparagraph id="ID6F385EFF1EC94C0AAB007BF4B1F082C3"><enum>(A)</enum><text><external-xref legal-doc="act" parsable-cite="ESEA/1116(b)(13)">Section

			 1116(b)(13)</external-xref> of the <act-name parsable-cite="ESEA">Elementary

			 and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316(b)(13)">20 U.S.C. 6316(b)(13)</external-xref>)

			 (requiring a local educational agency to continue to permit a child who

			 transferred to another school under such section to remain in that school until

			 completion of the highest grade in the school).</text>

						</subparagraph><subparagraph id="IDEFB00F62BC3E4512B24E7A5EB1FD9B4D"><enum>(B)</enum><text><external-xref legal-doc="act" parsable-cite="ESEA/1116(e)(9)">Section

			 1116(e)(9)</external-xref> of the <act-name parsable-cite="ESEA">Elementary and

			 Secondary Education Act of 1965</act-name> (as redesignated by section 102(3))

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/6316(e)(9)">20 U.S.C.

			 6316(e)(9)</external-xref>) (requiring a local educational agency to continue

			 to provide supplemental educational services under such section until the end

			 of the school year).</text>

						</subparagraph></paragraph><paragraph id="IDDA04E745332A4783BFD51071DC05778F"><enum>(3)</enum><header>Subsequent

			 determinations</header><text>In determining whether a school is subject to

			 school improvement, corrective action, or restructuring as a result of not

			 making adequate yearly progress, the Secretary, a State educational agency, or

			 a local educational agency may not take into account a determination that the

			 school did not make adequate yearly progress for the 2002–2003 school year if

			 such determination was revised under this section and the school received a

			 final determination of having made adequate yearly progress for the 2002–2003

			 school year.</text>

					</paragraph></subsection><subsection id="ID3A0712CB6EAA4E579504423A4101071A"><enum>(f)</enum><header>Notification</header><text>The

			 Secretary—</text>

					<paragraph id="ID2EE048EDD9E242239C352C20A4C1D878"><enum>(1)</enum><text>shall require

			 each State educational agency to notify each school served by the agency of the

			 school’s ability to request a review under this section; and</text>

					</paragraph><paragraph id="ID4B1A952915F648E1A62A1B078029DCC2"><enum>(2)</enum><text>not later than 30

			 days after the date of enactment of this section, shall notify the public by

			 means of the Department of Education’s website of the review process

			 established under this section.</text>

					</paragraph></subsection></section><section id="IDCF4BF269FB974D8598CF0BC87642D817"><enum>202.</enum><header>Review of

			 adequate yearly progress determinations for local educational agencies for the

			 2002–2003 school year</header>

				<subsection id="IDFCEE597720D1484BB5BBF883BD925614"><enum>(a)</enum><header>In

			 general</header><text>The Secretary shall require each State educational agency

			 to provide each local educational agency in the State with an opportunity to

			 request a review of a determination by the State educational agency that the

			 local educational agency did not make adequate yearly progress for the

			 2002–2003 school year.</text>

				</subsection><subsection id="ID37BCC9D827334244ADF39DF032E3E2B7"><enum>(b)</enum><header>Application of

			 certain provisions</header><text>Except as inconsistent with, or inapplicable

			 to, this section, the provisions of section 201 shall apply to review by a

			 State educational agency of a determination described in subsection (a) in the

			 same manner and to the same extent as such provisions apply to review by a

			 local educational agency of a determination described in section 201(a).</text>

				</subsection></section><section id="ID619079D9FF9A4735849FDA79B45DAE5C"><enum>203.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>

				<paragraph id="IDD56E2A48DF874562B92F974389B20FDA"><enum>(1)</enum><text>The term

			 <term>adequate yearly progress</term> has the meaning given to that term in

			 <external-xref legal-doc="act" parsable-cite="ESEA/1111(b)(2)(C)">section

			 1111(b)(2)(C)</external-xref> of the <act-name parsable-cite="ESEA">Elementary

			 and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311(b)(2)(C)">20 U.S.C.

			 6311(b)(2)(C)</external-xref>).</text>

				</paragraph><paragraph id="IDBB9456D4D39E46B5AE28838AAD23A74A"><enum>(2)</enum><text>The term

			 <term>local educational agency</term> means a local educational agency (as that

			 term is defined in <external-xref legal-doc="act" parsable-cite="ESEA/9101">section 9101</external-xref> of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20

			 U.S.C. 7801</external-xref>)) receiving funds under part A of title I of such

			 Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C.

			 6311</external-xref> et seq.).</text>

				</paragraph><paragraph id="ID7988F9093C1946E3BB1081863317789C"><enum>(3)</enum><text>The term

			 <term>Secretary</term> means the Secretary of Education.</text>

				</paragraph><paragraph id="ID7D32AEB2A02140CAB1C73DEAAF796776"><enum>(4)</enum><text>The term

			 <term>school</term> means an elementary school or a secondary school (as those

			 terms are defined in <external-xref legal-doc="act" parsable-cite="ESEA/9101">section 9101</external-xref> of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20

			 U.S.C. 7801</external-xref>)) served under part A of title I of such Act

			 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C.

			 6311</external-xref> et seq.).</text>

				</paragraph><paragraph id="ID676E0FAE398744D1BC3A3E7A9C7874CF"><enum>(5)</enum><text>The term

			 <term>State educational agency</term> means a State educational agency (as that

			 term is defined in <external-xref legal-doc="act" parsable-cite="ESEA/9101">section 9101</external-xref> of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20

			 U.S.C. 7801</external-xref>)) receiving funds under part A of title I of such

			 Act (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C.

			 6311</external-xref> et seq.).</text>

				</paragraph></section></title><title id="ID10CDF8D501AB4E7D8D2B3518C212B57F"><enum>III</enum><header>Improving

			 assessment and accountability</header>

			<section id="IDB29F443941A5471A9FD64850DC260D4E"><enum>301.</enum><header>Grants for

			 increasing data capacity for purposes of assessment and accountability</header>

				<subsection id="ID3ECE61F2DF11413FBCA57A9D8349B115"><enum>(a)</enum><header>Program

			 authorized</header><text>From funds appropriated under subsection (g) for a

			 fiscal year, the Secretary may award grants, on a competitive basis, to State

			 educational agencies—</text>

					<paragraph id="ID5CD0781972A24EFAA9769003E43404F8"><enum>(1)</enum><text>to enable the

			 State educational agencies to develop or increase the capacity of data systems

			 for assessment and accountability purposes, including the collection of

			 graduation rates; and</text>

					</paragraph><paragraph id="IDF75A834226EA43E990146AE9EB12D052"><enum>(2)</enum><text>to award

			 subgrants to increase the capacity of local educational agencies to upgrade,

			 create, or manage longitudinal data systems for the purpose of measuring

			 student academic progress and achievement.</text>

					</paragraph></subsection><subsection id="ID5D1D0E00FF3D471DA0B76ED59D6A71FB"><enum>(b)</enum><header>State

			 application</header><text>Each State educational agency desiring a grant under

			 this section shall submit an application to the Secretary at such time, in such

			 manner, and containing such information as the Secretary may require.</text>

				</subsection><subsection id="IDC1F1F6FE9BEF428097C997BCD8C73E18"><enum>(c)</enum><header>State use of

			 funds</header><text>Each State educational agency that receives a grant under

			 this section shall use—</text>

					<paragraph id="ID72B94729EED6416188DA0F32C5EEC1A9"><enum>(1)</enum><text>not more than 20

			 percent of the grant funds for the purpose of—</text>

						<subparagraph id="ID1E10CD4C80F94FD58246B68FB1DBA842"><enum>(A)</enum><text>increasing the

			 capacity of, or creating, State databases to collect, disaggregate, and report

			 information related to student achievement, enrollment, and graduation rates

			 for assessment and accountability purposes; and</text>

						</subparagraph><subparagraph id="ID5078914508604AA1825D88C50329AC66"><enum>(B)</enum><text>reporting, on an

			 annual basis, for the elementary schools and secondary schools within the

			 State, on—</text>

							<clause id="IDF9F2BD01D163484BA4EA17B16EE68FC6"><enum>(i)</enum><text>the

			 enrollment data from the beginning of the academic year;</text>

							</clause><clause id="IDAF59176FBD8B4BBCAEDCC53D01E2FADF"><enum>(ii)</enum><text>the enrollment

			 data from the end of the academic year; and</text>

							</clause><clause id="ID612E10F85F864D58B0D8E3471D5332A3"><enum>(iii)</enum><text>the twelfth

			 grade graduation rates; and</text>

							</clause></subparagraph></paragraph><paragraph id="ID6BB489B29D62401D845A40D37891D2A4"><enum>(2)</enum><text>not less than 80

			 percent of the grant funds to award subgrants to local educational agencies

			 within the State to enable the local educational agencies to carry out the

			 authorized activities described in subsection (e).</text>

					</paragraph></subsection><subsection id="ID57FD7CEADDC1441CBA89B959D13490BD"><enum>(d)</enum><header>Local

			 application</header><text>Each local educational agency desiring a subgrant

			 under this section shall submit an application to the State educational agency

			 at such time, in such manner, and containing such information as the State

			 educational agency may require. Each such application shall include, at a

			 minimum, a demonstration of the local educational agency’s ability to put a

			 longitudinal data system in place.</text>

				</subsection><subsection id="ID4E7ABD3636364D79AE28001FE5406E2D"><enum>(e)</enum><header>Local

			 authorized activities</header><text>Each local educational agency that receives

			 a subgrant under this section shall use the subgrant funds to increase the

			 capacity of the local educational agency to upgrade or manage longitudinal data

			 systems consistent with the uses in subsection (c)(1), by—</text>

					<paragraph id="ID26725223D5004E599D18C0C64AB2238C"><enum>(1)</enum><text>purchasing

			 database software or hardware;</text>

					</paragraph><paragraph id="ID985CF8DBB450496EBB28514417BC4180"><enum>(2)</enum><text>hiring additional

			 staff for the purpose of managing such data;</text>

					</paragraph><paragraph id="ID20BEA8BF1DC34F4996E0688039A22DF6"><enum>(3)</enum><text>providing

			 professional development or additional training for such staff; and</text>

					</paragraph><paragraph id="IDFCEA68D97BF145C3B1292D473D15C607"><enum>(4)</enum><text>providing

			 professional development or training for principals and teachers on how to

			 effectively use such data to implement instructional strategies to improve

			 student achievement and graduation rates.</text>

					</paragraph></subsection><subsection id="ID1F6E828E9CFA48D0814C309635890789"><enum>(f)</enum><header>Definitions</header><text>In

			 this section:</text>

					<paragraph id="ID3F946848928546F1B6AEE7225E49F91F"><enum>(1)</enum><text>The term

			 <term>graduation rate</term> means the percentage that—</text>

						<subparagraph id="IDA9FF6C57CBD044A19C4E480FC22688B0"><enum>(A)</enum><text>the total number

			 of students who—</text>

							<clause id="IDA5B43376B94F418BABACFBA8692F4FE0"><enum>(i)</enum><text>graduate from a

			 secondary school with a regular diploma (which shall not include the recognized

			 equivalent of a secondary school diploma or an alternative degree) in an

			 academic year; and</text>

							</clause><clause id="ID905A1D78ED6C447ABD06849510F87514"><enum>(ii)</enum><text>graduated on

			 time by progressing 1 grade per academic year; represents of</text>

							</clause></subparagraph><subparagraph id="ID1205CE0288BD47F9B6B66B86A32B69FC"><enum>(B)</enum><text>the total number

			 of students who entered the secondary school in the entry level academic year

			 applicable to the graduating students.</text>

						</subparagraph></paragraph><paragraph id="IDCEB733BA30D646CB967C1ADBF84AE52F"><enum>(2)</enum><text>The terms

			 <term>State educational agency</term> and <term>local educational agency</term>

			 have the meanings given such terms in

			 <external-xref legal-doc="act" parsable-cite="ESEA/9101">section

			 9101</external-xref> of the <act-name parsable-cite="ESEA">Elementary and

			 Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text>

					</paragraph><paragraph id="ID8D09B489295E4483BEE5A30294B1782F"><enum>(3)</enum><text>The term

			 <term>Secretary</term> means the Secretary of Education.</text>

					</paragraph></subsection><subsection id="IDFADC438CB27A42AEA4D24468F6BD54AD"><enum>(g)</enum><header>Authorization

			 of appropriations</header><text>There are authorized to be appropriated to

			 carry out this section $100,000,000 for fiscal year 2006, and such sums as may

			 be necessary for each of the 2 succeeding fiscal years.</text>

				</subsection></section><section id="IDBB164AC3492A431D811C3D07D46E3151"><enum>302.</enum><header>Grants for

			 assessment of children with disabilities and children who are limited English

			 proficient</header><text display-inline="no-display-inline">Part E of title I

			 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6491">20

			 U.S.C. 6491</external-xref> et seq.) is amended by adding at the end the

			 following:</text>

				<quoted-block act-name="Elementary and Secondary Education Act of 1965" id="ID9F0C5F532B3A4312B391770D026F6651">

					<section id="ID9D47139F90D6490593455A0B74DB4832"><enum>1505.</enum><header>Grants for

				assessment of children with disabilities and children who are limited English

				proficient</header>

						<subsection id="ID87BA7C7D03FF4F93B71AFEA48F47A971"><enum>(a)</enum><header>Grants

				authorized</header><text>From amounts authorized under subsection (e) for a

				fiscal year, the Secretary shall award grants, on a competitive basis, to State

				educational agencies, or to consortia of State educational agencies, to enable

				the State educational agencies or consortia to collaborate with institutions of

				higher education, research institutions, or other organizations—</text>

							<paragraph id="IDC3629633A520407781636AC95FB203F0"><enum>(1)</enum><text>to design and

				improve State academic assessments for students who are limited English

				proficient and students with disabilities; and</text>

							</paragraph><paragraph id="ID36AA536412554307953B504A1FD30250"><enum>(2)</enum><text>to ensure the

				most accurate, valid, and reliable means to assess academic content standards

				and student academic achievement standards for students who are limited English

				proficient and students with disabilities.</text>

							</paragraph></subsection><subsection id="ID4514884F92254ACE9B1EB4EBC6AC147E"><enum>(b)</enum><header>Authorized

				activities</header><text>A State educational agency or consortium that receives

				a grant under this section shall use the grant funds to carry out 1 or more of

				the following activities:</text>

							<paragraph id="IDEEC8E4069AD74C36AFEA92B99875BEC1"><enum>(1)</enum><text>Developing

				alternate assessments for students with disabilities, consistent with section

				1111 and the amendments made on December 9, 2003, to part 200 of title 34, Code

				of Federal Regulations (68 Fed. Reg. 68698) (relating to accountability for the

				academic achievement of students with the most significant cognitive

				disabilities), including—</text>

								<subparagraph id="ID95811AEC04C447D99EA77F785E6D1F61"><enum>(A)</enum><text>the alignment of

				such assessments, as appropriate and consistent with such amendments,

				with—</text>

									<clause id="ID5D894B4CC0174EC19AD3A75C420D2C10"><enum>(i)</enum><text>State academic

				achievement standards and State academic content standards for all students;

				or</text>

									</clause><clause id="ID0910FC0D9CDC422D93D308E0124B0B1E"><enum>(ii)</enum><text>alternate State

				academic achievement standards that reflect the intended instructional

				construct for students with disabilities;</text>

									</clause></subparagraph><subparagraph id="ID56D14E70E1DA477986D23ACFAF0FB33B"><enum>(B)</enum><text>activities to

				ensure that such assessments do not reflect the disabilities, or associated

				characteristics, of the students that are extraneous to the intent of the

				measurement;</text>

								</subparagraph><subparagraph id="ID4F149A69CB79417F9C693B7BF48E69E9"><enum>(C)</enum><text>the development

				of an implementation plan for pilot tests for such assessments, in order to

				determine the level of appropriateness and feasibility of full-scale

				administration; and</text>

								</subparagraph><subparagraph id="ID0AF0F4A3DC4B4F188F7816A53E4B6955"><enum>(D)</enum><text>activities that

				provide for the retention of all feasible standardized features in the

				alternate assessments.</text>

								</subparagraph></paragraph><paragraph id="IDA3DB18A303A5425ABBDAC27FA7EBA770"><enum>(2)</enum><text>Developing

				alternate assessments that meet the requirements of section 1111 for students

				who are limited English proficient, including—</text>

								<subparagraph id="ID346C7271CF2B480EA002C37EC13DA73F"><enum>(A)</enum><text>the alignment of

				such assessments with State academic achievement standards and State academic

				content standards for all students;</text>

								</subparagraph><subparagraph id="ID52D07B0F2E754A6D96494A101E6CF3A6"><enum>(B)</enum><text>the development

				of parallel native language assessments or linguistically modified assessments

				for limited English proficient students that meet the requirements of section

				1111(b)(3)(C)(ix)(III);</text>

								</subparagraph><subparagraph id="IDAD6F70D0CC9F48DCA91E7E891A72991D"><enum>(C)</enum><text>the development

				of an implementation plan for pilot tests for such assessments, in order to

				determine the level of appropriateness and feasibility of full-scale

				administration; and</text>

								</subparagraph><subparagraph id="ID8FC523ADA3834090B8BA9B36F2C5AB27"><enum>(D)</enum><text>activities that

				provide for the retention of all feasible standardized features in the

				alternate assessments.</text>

								</subparagraph></paragraph><paragraph id="ID6FF83BE8EB364F5C8079CE1D922BA2AF"><enum>(3)</enum><text>Developing,

				modifying, or revising State policies and criteria for appropriate

				accommodations to ensure the full participation of students who are limited

				English proficient and students with disabilities in State academic

				assessments, including—</text>

								<subparagraph id="ID366CF2CD94AE402DB2DEE1A14ED19D29"><enum>(A)</enum><text>developing a plan

				to ensure that assessments provided with accommodations are fully included and

				integrated into the accountability system, for the purpose of making the

				determinations of adequate yearly progress required under section 1116;</text>

								</subparagraph><subparagraph id="IDFE4670AE3E90463FB775C826E4D9ED14"><enum>(B)</enum><text>ensuring the

				validity, reliability, and appropriateness of such accommodations, such

				as—</text>

									<clause id="ID2777A4FE43034D7983096E276B4A2781"><enum>(i)</enum><text>a

				modification to the presentation or format of the assessment;</text>

									</clause><clause id="ID88DB15A4B5D84DCD82A4D1E68D2FE1EF"><enum>(ii)</enum><text>the use of

				assistive devices;</text>

									</clause><clause id="ID2B4B70B713114054A82F46D60D6F0E2F"><enum>(iii)</enum><text>an extension of

				the time allowed for testing;</text>

									</clause><clause id="ID477861F593D04E658010442C58CC6380"><enum>(iv)</enum><text>an alteration of

				the test setting or procedures;</text>

									</clause><clause id="IDB57735A121534FFA831C2C26105DB92D"><enum>(v)</enum><text>the

				administration of portions of the test in a method appropriate for the level of

				language proficiency of the test taker;</text>

									</clause><clause id="ID318204ED7C114DE5A88059C3A9872E0A"><enum>(vi)</enum><text>the use of a

				glossary or dictionary; and</text>

									</clause><clause id="IDCB5DBCB2A72D4347A21567BC817B10E6"><enum>(vii)</enum><text>the use of a

				linguistically modified assessment;</text>

									</clause></subparagraph><subparagraph id="ID3888A1EC250144319E3E6780E805A14D"><enum>(C)</enum><text>ensuring that

				State policies and criteria for appropriate accommodations take into account

				the form or program of instruction provided to students, including the level of

				difficulty, reliability, cultural difference, and content equivalence of such

				form or program;</text>

								</subparagraph><subparagraph id="ID9CAE59FA9B564F409A292FB671A99953"><enum>(D)</enum><text>ensuring that

				such policies are consistent with the standards prepared by the Joint Committee

				on Standards for Educational and Psychological Testing of the American

				Educational Research Association, the American Psychological Association, and

				the National Council on Measurement in Education; and</text>

								</subparagraph><subparagraph id="ID7EA4CCBAA24A4F60867B7420089D9B65"><enum>(E)</enum><text>developing a plan

				for providing training on the use of accommodations to school instructional

				staff, families, students, and other appropriate parties.</text>

								</subparagraph></paragraph><paragraph id="IDF85E7415D11240EE91D227E3827FD82B"><enum>(4)</enum><text>Developing

				universally designed assessments that can be accessible to all students,

				including—</text>

								<subparagraph id="ID6DB53C04CD1C4101B23755DED1516624"><enum>(A)</enum><text>examining test

				item or test performance for students with disabilities and students who are

				limited English proficient, to determine the extent to which the test item or

				test is universally designed;</text>

								</subparagraph><subparagraph id="IDFACE4938770743CF8210F200405BC5CD"><enum>(B)</enum><text>using think aloud

				and cognitive laboratory procedures, as well as item statistics, to identify

				test items that may pose particular problems for students with disabilities or

				students who are limited English proficient;</text>

								</subparagraph><subparagraph id="IDD9C81891464D4CC3970977E7E26E73C1"><enum>(C)</enum><text>developing and

				implementing a plan to ensure that developers and reviewers of test items are

				trained in the principles of universal design; and</text>

								</subparagraph><subparagraph id="ID4DE341132F034F918BE07161EBE011AE"><enum>(D)</enum><text>developing

				computer-based applications of universal design principles.</text>

								</subparagraph></paragraph></subsection><subsection id="IDF9DAF6F8DC4F47BC801C738E40D58615"><enum>(c)</enum><header>Application</header><text>Each

				State educational agency, or consortium of State educational agencies, desiring

				to apply for a grant under this section shall submit an application to the

				Secretary at such time, in such manner, and containing such information as the

				Secretary may require, including—</text>

							<paragraph id="IDBE7A6826EDC141D19F74D2BFDC0647CC"><enum>(1)</enum><text>information

				regarding the institutions of higher education, research institutions, or other

				organizations that are collaborating with the State educational agency or

				consortium, in accordance with subsection (a);</text>

							</paragraph><paragraph id="IDBBFFDB60DBF9410C919497EDCC1B0651"><enum>(2)</enum><text>in the case of a

				consortium of State educational agencies, the designation of 1 State

				educational agency as the fiscal agent for the receipt of grant funds;</text>

							</paragraph><paragraph id="ID0A4088EB1EAE4718B995D442576CBD52"><enum>(3)</enum><text>a description of

				the process and criteria by which the State educational agency will identify

				students that are unable to participate in general State content assessments

				and are eligible to take alternate assessments, consistent with the amendments

				made to part 200 of title 34, Code of Federal Regulations (68 Fed. Reg.

				68698);</text>

							</paragraph><paragraph id="ID8F98835BA377417EAD04AE463AF400C0"><enum>(4)</enum><text>in the case of a

				State educational agency or consortium carrying out the activity described in

				subsection (b)(1)(A), a description of how the State educational agency or

				consortium plans to fulfill the requirement of subsection (b)(1)(A);</text>

							</paragraph><paragraph id="ID57BEF922A19A426AAC14F1A3CAB08B7A"><enum>(5)</enum><text>in the case of a

				State educational agency or consortium carrying out the activities described in

				paragraphs (1), (2), and (4) of subsection (b), information regarding the

				proposed techniques for the development of alternate assessments, including a

				description of the technical adequacy of, technical aspects of, and scoring

				for, such assessments;</text>

							</paragraph><paragraph id="ID6160B06954F440C9A090E3A5E2A5A6AE"><enum>(6)</enum><text>a plan for

				providing training for school instructional staff, families, students, and

				other appropriate parties on the use of alternate assessments; and</text>

							</paragraph><paragraph id="ID1432B993C1F548598A4AE4B1C87042A1"><enum>(7)</enum><text>information on

				how the scores of students participating in alternate assessments will be

				reported to the public and to parents.</text>

							</paragraph></subsection><subsection id="ID0AA7B442312A40A59A5F8399AACD98AB"><enum>(d)</enum><header>Evaluation and

				reporting requirements</header><text>Each State educational agency receiving a

				grant under this section shall submit an annual report to the Secretary

				describing the activities carried out under the grant and the result of such

				activities, including—</text>

							<paragraph id="IDE9350E0F21CB4F5F91FB4BACC9A455FD"><enum>(1)</enum><text>details on the

				effectiveness of the activities supported under this section in helping

				students with disabilities, or students who are limited English proficient,

				better participate in State assessment programs; and</text>

							</paragraph><paragraph id="ID3BA6938C7298461A85163DD159761FF6"><enum>(2)</enum><text>information on

				the change in achievement, if any, of students with disabilities and students

				who are limited English proficient, as a result of a more accurate assessment

				of such students.</text>

							</paragraph></subsection><subsection id="ID6028631AE5A44401B8FE1A7B3D1708EC"><enum>(e)</enum><header>Authorization

				of appropriations</header><text>There are authorized to be appropriated to

				carry out this section $50,000,000 for fiscal year 2006, and such sums as may

				be necessary for each of the 2 succeeding fiscal

				years.</text>

						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			</section><section id="IDE7F08E9088124C86BB059B9CAF7B6BB2"><enum>303.</enum><header>Reports on

			 student enrollment and graduation rates</header><text display-inline="no-display-inline">Part E of title I of the

			 <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of

			 1965</act-name> (as amended by section 302) (<external-xref legal-doc="usc" parsable-cite="usc/20/6491">20 U.S.C. 6491</external-xref> et seq.) is amended

			 by adding at the end the following:</text>

				agency, local educational agency, and school, on an annual basis, the following

							<paragraph id="IDE89C5B9A4933478FBAA9A2D1F036414F"><enum>(1)</enum><text>The number of

				students enrolled in each of grades 7 through 12 at the beginning of the most

				recent school year.</text>

							</paragraph><paragraph id="IDD56EDC25D79643CB92C0257AAD6A1B22"><enum>(2)</enum><text>The number of

				students enrolled in each of grades 7 through 12 at the end of the most recent

				school year.</text>

							</paragraph><paragraph id="ID93A358BD2BB141D2925F47B647AD6893"><enum>(3)</enum><text>The graduation

				rate for the most recent school year.</text>

							</paragraph><paragraph id="IDBE791396C627484FB357C5C048E6DA8C"><enum>(4)</enum><text>The data

				described in paragraphs (1) through (3), disaggregated by the groups of

				students described in section 1111(b)(2)(C)(v)(II).</text>

							</paragraph></subsection><subsection id="ID450C443E072A4BE2861D59ACCAC318AF"><enum>(b)</enum><header>Annual

				report</header><text>The Secretary shall report the information collected under

				subsection (a) on an annual

				basis.</text>

				Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9501">20 U.S.C. 9501</external-xref> et seq.) and other

				federally-supported clearinghouses, that have been successful in improving

				educational opportunities and achievement for all

				students.</text>
