		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>United States Seaport Multiyear

			 Security Enhancement Act</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID8D6BE668BFC747F98ABF9C93BB7D2C71" section-type="subsequent-section"><enum>2.</enum><header>Seaport security

			 improvement projects</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID46E2476B548E493BAF893810E6FBEF07"><enum>(a)</enum><header>Grant

			 authority</header><text display-inline="yes-display-inline">Subject to the

			 requirements of this section, the Transportation Security Administration may

			 make grants to seaports to enhance security.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID35829274A3524E7DA78F9E860214B3AA"><enum>(b)</enum><header>Applications</header><text display-inline="yes-display-inline">A seaport seeking a grant under this

			 section shall submit to the Administration an application in such form and

			 containing such information as the Administration prescribes.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0ED423DE1E354324BB79DBD90516AACF"><enum>(c)</enum><header>Grant

			 awards</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID41E995B0412243C5BB8F656FA633F874"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">The Administration,

			 after consultation with the Secretary of Transportation, may approve an

			 application of a seaport for a grant under this section only if the

			 Administration determines that the project will improve security at a seaport

			 or improve the efficiency of the seaport without lessening security.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7E87FE326CF7424F91115E446625C80D"><enum>(2)</enum><header>Priority</header><text display-inline="yes-display-inline">The Administration shall give priority in

			 awarding grants under this section to seaports that the Administration

			 considers will impact or enhance the Nation’s seaport security.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID04F746AF7E354A06A5E0411652E6CBF8"><enum>(d)</enum><header>Matching

			 requirements</header>

				<paragraph commented="no" display-inline="no-display-inline" id="IDC4A5D256E5BC4581995FAADE229EE772"><enum>(1)</enum><header>75-percent

			 Federal funding</header><text display-inline="yes-display-inline">Except as

			 provided in paragraph (2), Federal funds for any eligible project under this

			 section shall not exceed 75 percent of the total cost of such project.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID912306C1FEFE42DDAA18A6F82762F208"><enum>(2)</enum><header>Exceptions</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDFDAE0BE5008F4333B42059752FE99397"><enum>(A)</enum><header>Small

			 projects</header><text display-inline="yes-display-inline">A seaport with a

			 project under subsection (a) that costs less than $25,000 shall not be required

			 to match Federal funds.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB6DDD698378C42048BCD84DBF83A77AF"><enum>(B)</enum><header>Higher level of

			 support required</header><text display-inline="yes-display-inline">If the

			 Administration determines that a proposed project merits support and cannot be

			 undertaken without a higher rate of Federal support, the Administration may

			 approve grants under this section with a matching requirement other than that

			 specified in paragraph (1).</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID38AA06B0EF1C4A368496DF73FBAA03F0"><enum>(e)</enum><header>Letters of

			 intent</header>

				<paragraph commented="no" display-inline="no-display-inline" id="ID6FB7C93D75C44636902299BE3FADECE4"><enum>(1)</enum><header>Issuance</header><text display-inline="yes-display-inline">The Administration may issue a letter of

			 intent to a seaport committing to obligate from future budget authority an

			 amount, not more than the Federal Government’s share of the project’s cost, for

			 a seaport security improvement project (including interest costs and costs of

			 formulating the project).</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE7E111ADB78F4CE1812571B13BEF87E0"><enum>(2)</enum><header>Schedule</header><text display-inline="yes-display-inline">A letter of intent under this subsection

			 shall establish a schedule under which the Administration will reimburse the

			 seaport for the Government’s share of the project’s costs, as amounts become

			 available, if the seaport, after the Administration issues the letter, carries

			 out the project without receiving amounts under this section.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6D7345BBC976470BB9E872E1D4E87369"><enum>(3)</enum><header>Notice to

			 Administration</header><text display-inline="yes-display-inline">A seaport that

			 has been issued a letter of intent under this subsection shall notify the

			 Administration of the seaport’s intent to carry out a project before the

			 project begins.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC559B88561AE4D41A6AEA817BF7E8D54"><enum>(4)</enum><header>Notice to

			 Congress</header><text display-inline="yes-display-inline">The Administration

			 shall transmit to the Committees on Appropriations and Transportation and

			 Infrastructure of the House of Representatives and the Committees on

			 Appropriations and Commerce, Science, and Transportation of the Senate a

			 written notification at least 3 days before the issuance of a letter of intent

			 under this section.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID08AB7815FD54487582707FA4A37E6BBC"><enum>(5)</enum><header>Limitations</header><text display-inline="yes-display-inline">A letter of intent issued under this

			 subsection is not an obligation of the Government under section 1501 of title

			 31, and the letter is not deemed to be an administrative commitment for

			 financing. An obligation or administrative commitment may be made only as

			 amounts are provided in authorization and appropriations laws.</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8B1A8952C76B4BE8BCCCD269647B7B80"><enum>(6)</enum><header>Statutory

			 construction</header><text display-inline="yes-display-inline">Nothing in this

			 subsection shall be construed to prohibit the obligation of amounts pursuant to

			 a letter of intent under this subsection in the same fiscal year as the letter

			 of intent is issued.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6024233E756D4CE096EDAAA455886971"><enum>(f)</enum><header>Application of

			 additional requirements</header><text display-inline="yes-display-inline">The

			 Administration may require as a condition for issuance of a letter of intent

			 such reasonable administrative requirements as necessary to carry out the

			 provisions of this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID281ABF5542D648CAACEDC4FA9849B38F"><enum>(g)</enum><header>Notification to

			 committee</header><text display-inline="yes-display-inline">The Administration

			 shall notify the appropriate committees of Congress when a grant is made under

			 this section.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4E5B5906ADA346ED91B9EC30A35A3973"><enum>(h)</enum><header>Authorization

			 of appropriations</header><text display-inline="yes-display-inline">There is

			 authorized to be appropriated to carry out this section $800,000,000 for each

			 of fiscal years 2006 through 2010. Such sums shall remain available until

			 expended.</text>
