		<section commented="no" display-inline="no-display-inline" id="HCADBB509142B42DEBEE0D1C27D756280" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Wichita

			 Project Equus Beds Division Authorization Act of 2005</quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="HBB19BB711192425789EBE6047B76DD1D" section-type="subsequent-section"><enum>2.</enum><header>Equus Beds

			 Division</header><text display-inline="no-display-inline">The Act entitled

			 <quote>An Act to provide for the construction of the Cheney division, Wichita

			 Federal reclamation project, Kansas, and for other purposes</quote> (Public Law

			 86–787; 74 Stat. 1026) is amended by adding the following new section:</text>

			<quoted-block display-inline="no-display-inline" id="H599522B2CA6E4E7F8C8546009C817CE2" style="OLC">

				<section commented="no" display-inline="no-display-inline" id="HF90E0777309A4E0F84CEE5B563BBC" section-type="subsequent-section"><enum>10.</enum><header>Equus Beds

				Division</header>

					<subsection commented="no" display-inline="no-display-inline" id="H99B054A8A70E46A5AF3CA3BA90FDA94F"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary of the Interior may assist in

				the funding and implementation of the Equus Beds Aquifer Recharge and Recovery

				Component which is a part of the <quote>Integrated Local Water Supply Plan,

				Wichita, Kansas</quote> (referred to in this section as the <quote>Equus Beds

				Division</quote>). Construction of the Equus Beds Division shall be in

				substantial accordance with the plans and designs.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="H96F111537BE041179F3DF457FF851D11"><enum>(b)</enum><header>Operation,

				Maintenance, and Replacement</header><text display-inline="yes-display-inline">Operation, maintenance, and replacement of

				the Equus Beds Division, including funding for those purposes, shall be the

				sole responsibility of the City of Wichita, Kansas. The Equus Beds Division

				shall be operated in accordance with applicable laws and regulations.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="H42B10145DE7448B2A2CE7EC0BA01889D"><enum>(c)</enum><header>Agreements</header><text display-inline="yes-display-inline">The Secretary of the Interior may enter

				into, or agree to amendments of, cooperative agreements and other appropriate

				agreements to carry out this section.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="HEA8B268A883D497989E00218C4673AA"><enum>(d)</enum><header>Administrative

				costs</header><text display-inline="yes-display-inline">From funds made

				available for this section, the Secretary of the Interior may charge an

				appropriate share related to administrative costs incurred.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="HA0D072535F3B47DD83CEBCBA0918422F"><enum>(e)</enum><header>Plans and

				analyses consistent with Federal law</header><text display-inline="yes-display-inline">Before obligating funds for design or

				construction under this section, the Secretary of the Interior shall work

				cooperatively with the City of Wichita, Kansas, to use, to the extent possible,

				plans, designs, and engineering and environmental analyses that have already

				been prepared by the City for the Equus Beds Division. The Secretary of the

				Interior shall assure that such information is used consistent with applicable

				Federal laws and regulations<deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">, including principles and guidelines

				used in preparing feasibility level project studies</deleted-phrase>.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="H049F7FA7CE024553875899F1AF22D19D"><enum>(f)</enum><header>Title;

				responsibility; liability</header><text display-inline="yes-display-inline">Nothing in this section or assistance

				provided under this section shall be construed to transfer title,

				responsibility, or liability related to the Equus Beds Division (including

				portions or features thereof) to the United States.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="H705793D847DC4DC3B013B75E53ED10EE"><enum>(g)</enum><header>Authorization of

				appropriations</header><text display-inline="yes-display-inline">There is

				authorized to be appropriated as the Federal share of the total cost of the

				Equus Beds Division, an amount not to not exceed 25 percent of the total cost

				or $30,000,000 (January, 2003 prices), whichever is less, plus or minus such

				amounts, if any, as may be justified by reason of ordinary fluctuations in

				construction costs as indicated by engineering cost indexes applicable to the

				type of construction involved herein, whichever is less. Such sums shall be

				nonreimbursable.</text>

					</subsection><subsection commented="no" display-inline="no-display-inline" id="id62C1A7BFFA324BFDA8B2D69385F49579"><enum>(h)</enum><header>Termination of

				authority</header><text display-inline="yes-display-inline">The authority of

				the Secretary of the Interior to carry out any provision of this section shall

				terminate 10 years after the date of enactment of this

				section.</text>
