		<official-title display="yes">To provide that transit pass transportation

		  fringe benefits be made available to all qualified Federal employees in the

		  National Capital Region; to allow passenger carriers which are owned or leased

		  by the Government to be used to transport Government employees between their

		  place of employment and mass transit facilities, and for other

		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="ID9501C23276E848D0BCA6267C4206B9A9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Federal Employee Commuter Benefits Act

			 of 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="IDDCAA9FAAE6544FBFAC8E643D1F00ECE0" section-type="subsequent-section"><enum>2.</enum><header>Transit pass

			 transportation fringe benefits</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDD9E82AFAF45F4E2492436FEA33863051"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Effective as of the

			 first day of the next fiscal year beginning after the date of the enactment of

			 this Act, each covered agency shall implement a program under which all

			 qualified Federal employees serving in or under such agency shall be offered

			 transit pass transportation fringe benefits, as described in subsection

			 (b).</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID256CF1EA9AD447C48DE8BD30A3F11908"><enum>(b)</enum><header>Benefits

			 described</header><text display-inline="yes-display-inline">The benefits

			 described in this subsection are the transit pass transportation fringe

			 benefits which, under section 2 of Executive Order 13150, are required to be

			 offered by Federal agencies in the National Capital Region on the date of

			 enactment of this Act.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA39D53A28EC1445A892874E768B15DE1"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDCF43643F5CCE45D9A3BDE107517E21A5"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>covered agency</term> means

			 any agency, to the extent of its facilities in the National Capital

			 Region;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID34BA232C902345C2BAF1B656F81CAE7F"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>agency</term> means any

			 agency (as defined by 7905(a)(2) of title 5, United States Code), the United

			 States Postal Service, the Postal Rate Commission, and the Smithsonian

			 Institution;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID279A292DC66643D6A89139D6739B3337"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>National Capital

			 Region</term> includes the District of Columbia and every county or other

			 geographic area covered by section 2 of Executive Order 13150;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC59E189E1DC14AD589F5DF2753E3CCDE"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>Executive Order 13150</term>

			 refers to Executive Order 13150 (<external-xref legal-doc="usc" parsable-cite="usc/5/7905 note">5 U.S.C. 7905 note</external-xref>);</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID284667E96ECE4EA09E811C9770515560"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>Federal agency</term> is

			 used in the same way as under section 2 of Executive Order 13150; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0016191B2F354CB38C45FDC0FA001D8B"><enum>(6)</enum><text display-inline="yes-display-inline">any determination as to whether or not one

			 is a <quote>qualified Federal employee</quote> shall be made applying the same

			 criteria as would apply under section 2 of Executive Order 13150.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBE4B196DF1F84E90BE5C31022B8EC236"><enum>(d)</enum><header>Rule of

			 construction</header><text display-inline="yes-display-inline">Nothing in this

			 section shall be considered to require that a covered agency—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="IDF821C735B881421BBFB2E991D3E52600"><enum>(1)</enum><text display-inline="yes-display-inline">terminate any program or benefits in

			 existence on the date of the enactment of this Act, or postpone any plans to

			 implement (before the effective date referred to in subsection (a)) any program

			 or benefits permitted or required under any other provision of law; or</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5E2DA9084BC74CB7A500E76633E9E255"><enum>(2)</enum><text display-inline="yes-display-inline">discontinue (on or after the effective date

			 referred to in subsection (a)) any program or benefits referred to in paragraph

			 (1), so long as such program or benefits satisfy the requirements of

			 subsections (a) through (c).</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID7C8D65DEAFF444AF8981974B19515E65" section-type="subsequent-section"><enum>3.</enum><header>Authority to use

			 Government vehicles to transport Federal employees between their place of

			 employment and mass transit facilities</header>

			<subsection commented="no" display-inline="no-display-inline" id="ID05B992212AD746BC88936B4798ACBB06"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 1344 of title

			 31, United States Code, is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="ID724D4695D96943BC0082E02611003056"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (g) and (h) as

			 subsections (h) and (i), respectively; and</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD8D70400E5A84226A0CFFD7F4535EEC2"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (f) the

			 following:</text>

					<quoted-block display-inline="no-display-inline" id="ID3F55FAB39EDE4CEE8B0887A71BA6DF45" style="OLC">

						<subsection commented="no" display-inline="no-display-inline" id="ID1285792B27B54A4098C979BFC3F9D845"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="IDE7395FDDBA6441D98480D814D2E36375"><enum>(1)</enum><text display-inline="yes-display-inline">A passenger carrier may be used to

				transport an officer or employee of a Federal agency between the officer’s or

				employee’s place of employment and a mass transit facility (whether or not

				publicly owned) in accordance with succeeding provisions of this

				subsection.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID15B0B4C6DE7D425B951D4738FDD4EEB3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding section 1343, a Federal

				agency that provides transportation services under this subsection (including

				by passenger carrier) shall absorb the costs of such services using any funds

				available to such agency, whether by appropriation or otherwise.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1A86ED7F689F4530A4D22CA96898C8B0" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In carrying out this subsection, a Federal

				agency shall—</text>

								<subparagraph commented="no" display-inline="no-display-inline" id="ID1FEF4B8630B54CF680D5B55C1DA900A5"><enum>(A)</enum><text display-inline="yes-display-inline">to

				the maximum extent practicable, use alternative fuel vehicles to provide

				transportation services;</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6E20915374154FDFB9E0C3B0C05E4E32"><enum>(B)</enum><text display-inline="yes-display-inline">to

				the extent consistent with the purposes of this subsection, provide

				transportation services in a manner that does not result in additional gross

				income for Federal income tax purposes; and</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEEBBD0B585A14239BFB111049EB22755"><enum>(C)</enum><text display-inline="yes-display-inline">coordinate with other Federal agencies to

				share, and otherwise avoid duplication of, transportation services provided

				under this subsection.</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCCBC17073BDD438C94CA627491E16C7E" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of any determination under

				chapter 81 of title 5, an individual shall not be considered to be in the

				<quote>performance of duty</quote> by virtue of the fact that such individual

				is receiving transportation services under this subsection.</text>

							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE5CC44234EFF408B927C6F611B65B2EC" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="IDB7173E260B2343D28EE937DEBB593B48"><enum>(A)</enum><text display-inline="yes-display-inline">The Administrator of General Services,

				after consultation with the National Capital Planning Commission and other

				appropriate agencies, shall prescribe any regulations necessary to carry out

				this subsection.</text>

								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID77289A098D824CD8B87DECF58B7E157C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Transportation services under this

				subsection shall be subject neither to the last sentence of subsection (d)(3)

				nor to any regulations under the last sentence of subsection (e)(1).</text>

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7EB50C13A8C8491196456BFAE84EABF5" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">In this subsection, the term

				<term>passenger carrier</term> means a passenger motor vehicle, aircraft, boat,

				ship, or other similar means of transportation that is owned or leased by the

				United States Government or the government of the District of

				Columbia.</text>

							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4BBC395DAB614457B50638DA7F138C7F"><enum>(b)</enum><header>Funds for

			 maintenance, repair, etc</header><text display-inline="yes-display-inline">Subsection (a) of section 1344 of title 31,

			 United States Code, is amended by adding at the end the following:</text>

				<quoted-block display-inline="no-display-inline" id="IDF2A03B7820E6445B912DE7B7FBD62373" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="IDC22335FF98B74B8287BCFD53E6125587" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of paragraph (1), the

				transportation of an individual between such individual’s place of employment

				and a mass transit facility pursuant to subsection (g) is transportation for an

				official

				purpose.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDEB4F9A23FB174F458DB23957B882C3C9"><enum>(c)</enum><header>Coordination</header><text display-inline="yes-display-inline">The authority to provide transportation

			 services under section 1344(g) of title 31, United States Code (as amended by

			 subsection (a)) shall be in addition to any authority otherwise available to

			 the agency involved.</text>
