		<official-title>To direct the Secretary of Energy to make incentive

		  payments to the owners or operators of qualified desalination facilities to

		  partially offset the cost of electrical energy required to operate the

		  facilities, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="HC6F360138F694226A605BD5DEE0D3C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the

			 <quote><short-title>Desalination Water Supply Shortage

			 Prevention Act of 2005</short-title></quote>.</text>

		</section><section display-inline="no-display-inline" id="idBCD04EB7B57D49DF86F274EA19B932A4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>

			<paragraph display-inline="no-display-inline" id="idB01A81F6C6A44E41B86F834C4442E067"><enum>(1)</enum><header>Qualified

			 desalination facility</header><text>The term <term>qualified desalination

			 facility</term> means a facility that—</text>

				<subparagraph id="id44007C06B1F2491891DFE69A90E55C72"><enum>(A)</enum><text>produces for sale

			 to domestic customers—</text>

					<clause id="idA65DF782235C4EA8A2100A52B46B8EED"><enum>(i)</enum><text>desalinated

			 seawater;</text>

					</clause><clause id="idF0D57542F30146DB8E71626B6CDD7669"><enum>(ii)</enum><text>brackish

			 groundwater; or</text>

					</clause><clause id="id9A427BFBD5AD48F6AE7B4A94832F1FC9"><enum>(iii)</enum><text>surface water

			 the source water of which is greater than 1,000 parts per million total

			 dissolved solids;</text>

					</clause></subparagraph><subparagraph id="idC125DC759A5A4C98AD3E57F9E687F5FB"><enum>(B)</enum><text>is owned or

			 operated by—</text>

					<clause id="id164C47EA935341B2B4AFAEC09B92E47C"><enum>(i)</enum><text>a

			 State or any political subdivision, agency, authority, or instrumentality of a

			 State; or</text>

					</clause><clause id="idA77FD1F98B5C4258AB161A8C4B153437"><enum>(ii)</enum><text>a

			 corporation responsible for providing municipal water service in accordance

			 with State law; and</text>

					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76BD8108E6444E418688D2754B4B54D4"><enum>(C)</enum><text>is first used to

			 produce desalinated water during the 10-year period beginning on October 1 of

			 the first full fiscal year occurring after the date of the enactment of this

			 Act.</text>

				</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="id1683068930794DCBA5A2E64052A3F086"><enum>(2)</enum><header>Secretary</header><text>The

			 term <term>Secretary</term> means the Secretary of Energy.</text>

			</paragraph></section><section id="H2CE66342E9254D2DB0E080E0CC31CC8F"><enum>3.</enum><header>Desalinated water

			 production incentive payments</header>

			<subsection id="H39B9A6E814204A409E49D1229E5D14CB"><enum>(a)</enum><header>Incentive

			 Payments</header><text>The Secretary shall make incentive payments in an amount

			 determined under subsection (d) to the owners or operators of qualified

			 desalination facilities to partially offset the cost of electrical energy

			 required to operate the facilities.</text>

			</subsection><subsection id="H1DA4E89F9F4B48F998DA64D54969124C"><enum>(b)</enum><header>Requirements</header><text>The

			 Secretary may not make a payment to the owner or operator of a qualified

			 desalination facility under this section unless—</text>

				<paragraph id="idC756AE7EBE034F4E9512CC8848D4B209"><enum>(1)</enum><text>not later than

			 the end of fiscal year 2015, the Secretary enters into a written agreement with

			 the owner or operator to make the payment; and</text>

				</paragraph><paragraph id="idAAC75E366157454F86E1A2A413D9F0C0"><enum>(2)</enum><text>the owner or

			 operator submits an application to the Secretary in such form, at such time,

			 and containing such information and assurances as the Secretary may

			 require.</text>

				</paragraph></subsection><subsection id="HF912342D00F34E2BAEE2605E5CE0E623"><enum>(c)</enum><header>Payment

			 period</header><text>The Secretary may make payments to the owner or operator

			 of a qualified desalination facility under this section for a period not to

			 exceed 10 years—</text>

				<paragraph id="H3C18CFAC43D94AE683F77B56FBCCA376"><enum>(1)</enum><text>beginning on the

			 date on which the facility is first used to produce desalinated water;

			 and</text>

				</paragraph><paragraph id="H1F1EA2E81D29496C8F8D713FD7EB72F9"><enum>(2)</enum><text>ending not later

			 than September 30, 2025.</text>

				</paragraph></subsection><subsection id="H4EFFFC207761474D8CFB3317C227CE7F"><enum>(d)</enum><header>Amount of

			 Payment</header>

				<paragraph id="H9E835D7008C842D5A6798E00897F64E5"><enum>(1)</enum><header>In

			 general</header><text>A payment made by the Secretary under this section to the

			 owner or operator of a qualified desalination facility shall be based on the

			 amount of desalinated water produced by the facility during the payment period

			 described in subsection (c).</text>

				</paragraph><paragraph id="id17EDE17D103048FE95C90E1C992873F0"><enum>(2)</enum><header>Base

			 payment</header><text>For any facility, the amount of a payment described in

			 paragraph (1) shall be 62 cents for every 14 kilowatt hours of electricity used

			 to produce desalinated water, as adjusted under paragraph (3).</text>

				</paragraph><paragraph id="HC90743A04D7C49AB92272873BC00C83E"><enum>(3)</enum><header>Adjustments</header><text>The

			 amount of the payment described in paragraph (2) shall be adjusted for

			 inflation for fiscal year 2007 and each subsequent fiscal year—</text>

					<subparagraph id="id4B6F1BAEC06F423A85DBB347B61C1D69"><enum>(A)</enum><text>using the

			 inflation adjustment factor defined in section 29(d)(2)(B) of the Internal

			 Revenue Code of 1986; but</text>

					</subparagraph><subparagraph id="idEE215F9899774064995CE57FB35A7651"><enum>(B)</enum><text>substituting

			 calendar year 2005 for calendar year 1979.</text>

					</subparagraph></paragraph></subsection><subsection id="H04F77BA2AE0546A4AE3755E03CB514FD"><enum>(e)</enum><header>Limitation</header><text>In

			 any fiscal year, not more than 60 percent of the funds made available by the

			 Secretary under this section shall be made available to the owners or operators

			 of qualified desalination facilities that obtain source water directly from the

			 sea, an estuary, or an in-bank extraction well that is of seawater

			 origin.</text>

			</subsection><subsection id="H60F13FE97B954CEE802E57FB86A837E8"><enum>(f)</enum><header>Budget act

			 compliance</header><text>The authority provided by this section may be

			 exercised only in such amounts or to such extent as provided in advance in an

			 appropriations Act.</text>

			</subsection><subsection id="H9A4DAA66349C492D90C6BBF4C3E0B8EF"><enum>(g)</enum><header>Authorization of

			 Appropriations</header><text>There is authorized to be appropriated to the

			 Secretary to carry out this section $200,000,000.</text>
