		<official-title>To reimburse States and local governments for indirect

		  costs relating to the incarceration of illegal criminal

		  aliens.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short

			 title</header><text display-inline="no-display-inline">This Act may be cited as

			 the <quote><short-title>State Criminal Alien Assistance

			 Program II</short-title></quote>.</text>

		</section><section id="ID0eef2e0fe4f040da9a1b12bf4a90d99c"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to assist States

			 and units of local governments by providing financial assistance for costs

			 incurred by such States and local governments for processing illegal immigrants

			 through their law enforcement and criminal justice systems.</text>

		</section><section id="id6D702CA216334254B14A51E639A27E91"><enum>3.</enum><header>Reimbursement of

			 indirect costs relating to the incarceration of illegal aliens</header>

			<subsection id="id1157DA7B99524AE6BF19F1E77D775451"><enum>(a)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 501 of the

			 Immigration Reform and Control Act of 1986 (8 U.S.C. 1365) is amended—</text>

				<paragraph id="ID4bd5d48113bc460aa595ef6a8d3f07ad"><enum>(1)</enum><text>in subsection

			 (a), by striking <quote>a State for</quote> and all that follows through

			 <quote>State</quote> and inserting the following: “each State and unit of local

			 government for—</text>

					<quoted-block display-inline="no-display-inline" id="id8ACC895265914477BBA2694BEA83D5C5" style="OLC">

						<paragraph id="ID5301955ffba948bc8639a2c33a9db79b"><enum>(1)</enum><text>costs incurred by

				the State or unit of local government for the imprisonment of any illegal alien

				who is convicted of a felony by such State; and</text>

						</paragraph><paragraph id="IDbd46fd7544eb493c93a8f90ba90fd490"><enum>(2)</enum><text>indirect costs

				related to the imprisonment described in paragraph

				(1).</text>

						</paragraph><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph id="ID4d5dcc8036354bb4a8bf5b6b89cd509e"><enum>(2)</enum><text>by striking

			 subsections (c) through (e) and inserting the following:</text>

					<quoted-block display-inline="no-display-inline" id="idC75AB646340744CBAF3F2F5D98D3BB27" style="OLC">

						<subsection id="ID6dd71e3f613f45df9c16d4aeb1d7b03d"><enum>(c)</enum><header>Definitions</header><text>As

				used in this section—</text>

							<paragraph id="id0237B4BDD5664BFF987926ACBB306AD2"><enum>(1)</enum><text>the term

				<quote>indirect costs</quote> includes costs relating to—</text>

								<subparagraph id="IDc161b568970242f6b6c1e7148b42ea24"><enum>(A)</enum><text>court

				proceedings, attorneys for units of local government, and detention of illegal

				aliens;</text>

								</subparagraph><subparagraph id="ID8195bbff9dcc4dbcb80fc8c52adc11b6"><enum>(B)</enum><text>indigent

				defense;</text>

								</subparagraph><subparagraph id="ID9be30dd7ccea477fac0ccc6b20c1c916"><enum>(C)</enum><text>State and local

				prosecution;</text>

								</subparagraph><subparagraph id="ID1cbde5ccf65b4a08a416e9ba4de9920d"><enum>(D)</enum><text>autopsies;

				and</text>

								</subparagraph><subparagraph id="id6142EB0B9A8A430F8FE1DC5CBDE9B41A"><enum>(E)</enum><text>translation and

				interpreter services; and</text>

								</subparagraph></paragraph><paragraph id="idBF306DA6B0874630BA7B964C7DD82F67"><enum>(2)</enum><text>the term

				<quote>State</quote> has the meaning given such term in section 1101(a)(36) of

				this title.</text>

							</paragraph></subsection><subsection id="ID93372bd5624447beae10af15a1d237c0"><enum>(d)</enum><header>Authorization

				of appropriations</header><text>There are authorized to be appropriated

				$500,000,000 for each of the fiscal years 2006 through 2009 to carry out

				subsection

				(a)(2).</text>

						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection id="IDD6033454398B469D92B2424B31B499CA"><enum>(b)</enum><header>State

			 allocations</header>

				<paragraph id="IDB76D62F5D55E47D891F35E32D70843FE"><enum>(1)</enum><header>Based on

			 percentage of undocumented aliens</header>

					<subparagraph id="ID09161B5B05834BD48E8ABDE09EEC21F4"><enum>(A)</enum><header>In

			 general</header><text>From the amount appropriated for a fiscal year pursuant

			 to section 501(d) of the Immigration Reform and Control Act of 1986 (8 U.S.C.

			 1365(d)), the Attorney General shall allocate $333,000,000 for States and units

			 of local government in accordance with subparagraph (B).</text>

					</subparagraph><subparagraph id="IDC08151B6E3754AF494FFEA1A854D5BD7"><enum>(B)</enum><header>Formula</header><text>The

			 amount allocated under this paragraph for each State (including units of local

			 government within such State) for a fiscal year shall be equal to the product

			 of—</text>

						<clause id="IDB8883B401B914560930EA46F55C5FCFE"><enum>(i)</enum><text>the

			 total amount available to be allocated under this paragraph for that fiscal

			 year; and</text>

						</clause><clause id="ID0A6141F810924B4B99519CE4E30580D4"><enum>(ii)</enum><text>the percentage

			 of undocumented aliens residing in the State compared to the total number of

			 such aliens residing in all States, as determined by the Statistics Division of

			 the Immigration and Naturalization Service, as of January 2005, based on the

			 2000 decennial census.</text>

						</clause></subparagraph></paragraph><paragraph id="IDC22DC83C964A41CD819883FD98CB92C9"><enum>(2)</enum><header>Based on number

			 of undocumented alien apprehension States</header>

					<subparagraph id="ID33709862025E401D9487EA582456CC47"><enum>(A)</enum><header>In

			 general</header><text>From the amount appropriated for a fiscal year pursuant

			 to such section 501(d), the Attorney General shall allocate $167,000,000, in

			 addition to amounts allocated under paragraph (1), for each of the 6 States

			 with the highest number of undocumented alien apprehensions for such fiscal

			 year.</text>

					</subparagraph><subparagraph id="ID69B00900F56744DD89082BCD0EE98F54"><enum>(B)</enum><header>Determination

			 of allotments</header><text>The amount allocated under this paragraph for a

			 fiscal year for each State described in subparagraph (A) (including units of

			 local government within each such State) shall be equal to the product

			 of—</text>

						<clause id="IDB44401DA0C0A40DDB581AF936AECD887"><enum>(i)</enum><text>the

			 total amount available to be allocated under this paragraph for the fiscal

			 year; and</text>

						</clause><clause id="ID3984D4C0CAE240298F8EFC6134CE97AA"><enum>(ii)</enum><text>the percentage

			 of undocumented alien apprehensions in the State in that fiscal year compared

			 to the total of such apprehensions for all such States for the preceding fiscal

			 year.</text>

						</clause></subparagraph><subparagraph id="ID44A24B12910D422AA741AA889276A1D9"><enum>(C)</enum><header>Data</header><text>For

			 purposes of this paragraph, the highest number of undocumented alien

			 apprehensions for a fiscal year shall be based on the apprehension rates for

			 the 4-consecutive-quarter period ending before the beginning of the fiscal year

			 for which information is available for undocumented aliens in such States, as

			 reported by the Department of Homeland Security.</text>

					</subparagraph></paragraph></subsection></section></legis-body>
