			 <quote><short-title>Hospital Fair Competition Act of

			 2005</short-title></quote>.</text>

		</section><section commented="no" display-inline="no-display-inline" id="ID8FF9D3E86CF8484983ECCAC8DF961EBF" section-type="subsequent-section"><enum>2.</enum><header>Hospital payment

			 improvements</header>

			<subsection commented="no" display-inline="no-display-inline" id="id3CD6CBF53F424220858A12531E4532CC"><enum>(a)</enum><header>Use of

			 estimated costs rather than average charges in establishing weighting factors

			 for diagnosis-Related groups under the inpatient hospital prospective payment

			 system</header>

				<paragraph commented="no" display-inline="no-display-inline" id="id3229C4A8D1424A20A4C02FF9E525074F"><enum>(1)</enum><header>In

			 general</header><text display-inline="yes-display-inline">Section 1886(d)(4)(B)

			 of the <act-name parsable-cite="SSA">Social Security Act</act-name>

			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww(d)(4)(B)">42

			 U.S.C. 1395ww(d)(4)(B)</external-xref>) is amended—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDF7C41C1766CB4511BAB6C25C97B9E691"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(i)</quote> after

			 <quote>(B)</quote>; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID74D6770BFF2A47998C280F2D7171B814"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new

			 clause:</text>

							<clause commented="no" display-inline="no-display-inline" id="id3411BD359D8D4001BF7EBEA79D2792FB" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">For fiscal years beginning after fiscal

				year 2006, in establishing the weighting factors under clause (i), the

				Secretary shall ensure (to the extent feasible) that such factors reflect the

				estimated costs of furnishing care in each diagnosis-related

				group.</text>

							</clause><after-quoted-block>.</after-quoted-block></quoted-block>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id73029A9D04DD4E34A3D5C3700135A5A3"><enum>(2)</enum><header>No requirement

			 for annual adjustment for changes in costs</header><text display-inline="yes-display-inline">Section 1886(d)(4)(C)(i) of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww(d)(4)(B)">42 U.S.C.

			 1395ww(d)(4)(C)(i)</external-xref>) is amended by adding at the end the

			 following new sentence: <quote>Notwithstanding the preceding sentence, the

			 Secretary may adjust the weighting factors established under subparagraph (B)

			 less frequently than annually (but in no case less frequently than once every 5

			 years) in carrying out the requirement under clause (ii) of such

			 subparagraph.</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA3B8D7D4469B4A229483999CC5AF2FD1"><enum>(b)</enum><header>Calculation of

			 weighting factors at hospital level under the inpatient hospital prospective

			 payment system</header><text display-inline="yes-display-inline">Section

			 1886(d)(4)(B) of the <act-name parsable-cite="SSA">Social Security

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww(d)(4)(B)">42 U.S.C.

			 1395ww(d)(4)(B)</external-xref>), as amended by subsection (a)(1), is amended

			 by adding at the end the following new clause:</text>

				year 2006, in establishing the weighting factors under clause (i), the

				Secretary shall calculate such factors at a hospital level and then aggregate

				such factors to a national

				level.</text>

			 for changes in the distribution of such cases</header>

			 general</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1886(d)(3)(B)">Section

			 1886(d)(3)(B)</external-xref> of the <act-name parsable-cite="SSA">Social

				amounts</header><text display-inline="yes-display-inline">The Secretary shall,

				for discharges occurring before fiscal year 2007, reduce each of the average

				standardized amounts determined under subparagraph (A) by a factor equal to the

				proportion of payments under this subsection (as estimated by the Secretary)

				based on DRG prospective payment amounts which are additional payments

				described in paragraph (5)(A) (relating to outlier payments).</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="IDB196479CEC50410F87FF4AE1B9D6AC78"><enum>(ii)</enum><header>Reduction of weighting

				factors</header><text display-inline="yes-display-inline">The Secretary shall,

				for discharges occurring after fiscal year 2006, reduce each of the weighting

				factors determined under paragraph (4)(B) by a factor equal to the proportion

				of payments in the diagnosis-related group under this subsection (as estimated

				by the Secretary) based on DRG prospective payment amounts which are additional

				payments described in paragraph (5)(A) (relating to outlier

				payments).</text>

			 diagnostic-Related groups appropriately capture the difference in severity of

			 illness of patients</header><text display-inline="yes-display-inline">Section

			 1886(d)(4)(A) of the <act-name parsable-cite="SSA">Social Security

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww(d)(4)(B)">42 U.S.C.

			 1395ww(d)(4)(A)</external-xref>) is amended by adding at the end the following

			 new sentence: <quote>In establishing the classification of inpatient discharges

			 by diagnosis-related groups under the preceding sentence, the Secretary shall

			 ensure that such groups appropriately capture the difference in severity of

			 illness of patients.</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id176206F8EC254386A287F6A71444AC67"><enum>(e)</enum><header>Phase-In of

			 changes to the inpatient hospital prospective payment system</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1886(d)(9)(C)(iii)">Section 1886(d) </external-xref>of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww(d)(9)(C)(iii)">42 U.S.C.

			 1395ww(d)</external-xref>) is amended by adding at the end the following new

			 paragraph:</text>

				<quoted-block display-inline="no-display-inline" id="idFD4C98CC61C34BDA831C94B38B698CC9" style="OLC">

					<paragraph commented="no" display-inline="no-display-inline" id="id9BF07515AAF541F0BDB1A23F1FBDEA5D" indent="up1"><enum>(14)</enum><text display-inline="yes-display-inline">Notwithstanding the preceding provisions of

				this subsection, the Secretary shall phase in the application of the amendments

				made by subsections (a), (b), (c), and (d) of section 2 of the

				<short-title>Hospital Fair Competition Act of

				2005</short-title> over a 3-fiscal year period beginning with fiscal year 2007.

				In implementing the phase-in under the preceding sentence, the Secretary shall

				take into account the negative impact that the phase-in may have on certain

				hospitals.</text>

					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDAB694425CAD54BBABBA73B4E93F84C26" section-type="subsequent-section"><enum>3.</enum><header>Prohibition on certain

			 physician self referrals</header>

			<subsection commented="no" display-inline="no-display-inline" id="IDEB6EC27B134349AE88DF512FBBF18CBC"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1877(d)(3)(B)">Section 1877(d) </external-xref>of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn(d)(3)(B)">42 U.S.C.

			 1395nn(d)</external-xref>) is amended in each of paragraphs (2)(B) and (3)(B)

			 by striking <quote>effective for the 18-month period beginning on the date of

			 enactment of the Medicare Prescription Drug, Improvement, and Modernization Act

			 of 2003</quote> and inserting <quote>on and after December 8,

			 2003</quote>.</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC3FB46A5F0B44701986FA12D9215B302"><enum>(b)</enum><header>Revisions to

			 the requirements to qualify for the exception to the definition of specialty

			 hospital</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1877(d)(3)(B)">Section 1877(h)(7)(B)

			 </external-xref>of the <act-name parsable-cite="SSA">Social Security

			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn(d)(3)(B)">42 U.S.C.

			 1395nn(h)</external-xref>(7)(B)) is amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id80AC72EDD51D49B884A11E5FCD4B067E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating clauses (iii), (iv), and

			 (v) as clauses (vi), (vii), and (viii), respectively;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID203FE583B3104533B26837B8D279474B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after clause (ii) the

			 following new clauses:</text>

					<quoted-block display-inline="no-display-inline" id="id3346FE163FFC4A1AA6007D217B17EA6B" style="OLC">

						<clause commented="no" display-inline="no-display-inline" id="ID13640B9F4AFF449B86F41655BB0B3B62"><enum>(iii)</enum><text display-inline="yes-display-inline">for which the percent of investment in the

				hospital by physician investors at any time on or after June 8, 2005, is no

				greater than the percent of such investment by physician investors as of such

				date;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="idCAFCFD2C288C45D49DE4E4DB81A2D731"><enum>(iv)</enum><text display-inline="yes-display-inline">for which the percent of investment in the

				hospital by any physician investor at any time on or after June 8, 2005, is no

				greater than the percent of such investment by such physician as of such

				date;</text>

						</clause><clause commented="no" display-inline="no-display-inline" id="ID605FD9CD1486482B98E35D35937A8B20"><enum>(v)</enum><text display-inline="yes-display-inline">for which the number of operating rooms at

				the hospital at any time on or after June 8, 2005, is no greater than the

				number of such rooms as of such date;</text>

						</clause><after-quoted-block>;

				and</after-quoted-block></quoted-block>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA0600F69BF9146579D9F411EBED39256"><enum>(3)</enum><text display-inline="yes-display-inline">by striking clause (vii), as so

			 redesignated, and inserting the following:</text>

					<quoted-block display-inline="no-display-inline" id="id249D96BE46D84CB99ABF95EADECF4982" style="OLC">

						<clause commented="no" display-inline="no-display-inline" id="ID0884C0A103974B61B231A8C91CE7E1BE"><enum>(vii)</enum><text display-inline="yes-display-inline">for which—</text>

							<subclause commented="no" display-inline="no-display-inline" id="idDF96B5D5A2C9489A89DAF8D05EFF40D0"><enum>(I)</enum><text display-inline="yes-display-inline">during the period beginning on December 8,

				2003, and ending on June 7, 2005, any increase in the number of beds occurs

				only in the facilities on the main campus of the hospital and does not exceed

				50 percent of the number of beds in the hospital as of November 18, 2003, or 5

				beds, whichever is greater; and</text>

							</subclause><subclause commented="no" display-inline="no-display-inline" id="id9C52A5ABD8824E7EA66CA5FED2B42C50"><enum>(II)</enum><text display-inline="yes-display-inline">the number of beds at the hospital at any

				time on or after June 8, 2005, is no greater than the number of such beds as of

				such date;

				and</text>

							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID358EB6F58B91458EA37EC73D7A90F250"><enum>(c)</enum><header>Effective

			 date</header><text display-inline="yes-display-inline">The amendments made by

			 this section shall take effect on June 8, 2005.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="idF76F9693B0FF476EADC475AB4A4BDFFB" section-type="subsequent-section"><enum>4.</enum><header>Permissible

			 coordinated care incentive arrangements between hospitals and

			 physicians</header>

			<subsection commented="no" display-inline="no-display-inline" id="idBC2819E821624222BA94B7F8BBAC76E7"><enum>(a)</enum><header>Establishment

			 of requirements for arrangements and exemption from imposition of civil

			 monetary penalties</header><text display-inline="yes-display-inline">Section

			 1128A of the Social Security Act (42 U.S.C. 1320a–7a) is amended by adding at

			 the end the following new subsection:</text>

				<quoted-block display-inline="no-display-inline" id="id498D37B63E394892A7CDF4B591ABDB64" style="OLC">

					<subsection commented="no" display-inline="no-display-inline" id="id1CDA777D18EE4EC5850F638128F4F6DC"><enum>(o)</enum><header>Arrangements

				between hospitals and physicians</header>

						<paragraph commented="no" display-inline="no-display-inline" id="id0CBE3AC2925B43E6A0D92E8AD5D6CAAF"><enum>(1)</enum><header>In

				general</header><text display-inline="yes-display-inline">Subsection (b) shall

				not apply to an arrangement that meets the requirements under paragraph

				(2).</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1560BC8EF1704044AD66715EA4465E49"><enum>(2)</enum><header>Requirements</header>

							<subparagraph commented="no" display-inline="no-display-inline" id="idB5BD8983CC244B1781C4FA086D5F37D9"><enum>(A)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish requirements

				for arrangements between hospitals or critical access hospitals and physicians

				in which physicians share in the savings experienced by the hospital or

				critical access hospital by reason of cost-reduction efforts that involve the

				physicians.</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61BC7308EEC34EC0B24D2B7D6F154008"><enum>(B)</enum><header>Protections</header><text display-inline="yes-display-inline">In establishing the requirements under

				subparagraph (A), the Secretary shall ensure that—</text>

								<clause commented="no" display-inline="no-display-inline" id="id3891B63E17C145C7A48F51CB454CDCAB"><enum>(i)</enum><text display-inline="yes-display-inline">the quality of care provided to individuals

				is protected under the arrangement; and</text>

								</clause><clause commented="no" display-inline="no-display-inline" id="idFA2FFF6AA48F4841A26DACD74D31FE9B"><enum>(ii)</enum><text display-inline="yes-display-inline">financial incentives that could affect

				physician referrals are minimized.</text>

								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6072397E58B64AB7A2636B4BFD182886"><enum>(C)</enum><header>Monitor</header><text display-inline="yes-display-inline">The Secretary shall establish procedures to

				monitor arrangements described in subparagraph (A) to ensure that such

				agreements meet the requirements under such

				subparagraph.</text>

							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="idF0E8E9F273944142AF8FE407AA351557"><enum>(b)</enum><header>Exemption from

			 criminal penalties</header><text display-inline="yes-display-inline">Section

			 1128B(b)(3) of the Social Security Act (42 U.S.C. 1320a–7b(b)(3)) is

			 amended—</text>

				<paragraph commented="no" display-inline="no-display-inline" id="id5B1C1C58F9C845278A67093DBA2B15F5"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (G), by striking

			 <quote>and</quote> at the end;</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5E6CD7F08B784E499EC5461424CD81EE"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (H), as added by section

			 237(d) of the Medicare Prescription Drug, Improvement, and Modernization Act of

			 2003 (Public Law 108–173; 117 Stat. 2213)—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id0599C5CCDCA7427C8BB1C22297AA4A92"><enum>(A)</enum><text display-inline="yes-display-inline">by moving such subparagraph 2 ems to the

			 left; and</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id32506C2C0668458AA12154FA350FFA34"><enum>(B)</enum><text display-inline="yes-display-inline">by striking the period at the end and

			 inserting a semicolon;</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id20376EAA2C9149538A3C611B526ABE5F"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (H), as added

			 by section 431(a) of the Medicare Prescription Drug, Improvement, and

			 Modernization Act of 2003 (Public Law 108–173; 117 Stat. 2287), as subparagraph

			 (I);</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50D724ED0170443BACCD7C4183B21944"><enum>(4)</enum><text display-inline="yes-display-inline">in subparagraph (I), as so

			 redesignated—</text>

					<subparagraph commented="no" display-inline="no-display-inline" id="id06C509F784CF420398A3CA1B25F38B23"><enum>(A)</enum><text display-inline="yes-display-inline">by moving such subparagraph 2 ems to the

			 limitation on certain physician referrals</header><text display-inline="yes-display-inline"><external-xref legal-doc="act" parsable-cite="SSA/1877(d)(3)(B)">Section 1877(e) </external-xref>of the

			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn(d)(3)(B)">42 U.S.C.

			 1395nn(e)</external-xref>) is amended by adding at the end the following new

			 paragraph:</text>
