<section id="HC263B31E371C4EA7A760617E58EC75E9" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Servicemembers Anti-Predatory Lending Protection Act</short-title></quote>.</text></section> 
<section id="H3A083E2130044539A06F124F802D1E1F"><enum>2.</enum><header>Terms of consumer credit extended to servicemember or servicemember’s dependent</header> 
<subsection id="H226204A43F3C43D6B4E9A6C6AABE54AE"><enum>(a)</enum><header>Terms of consumer credit</header><text display-inline="yes-display-inline">Title II of the Servicemembers Civil Relief Act (50 U.S.C. App. 521 et seq.) is amended by adding at the end the following new section:</text>

<section id="H62F33A5E9E7D4DDFBB4F00FD59A7F3B1"><enum>208.</enum><header>Terms of consumer credit</header> 
<subsection id="H8D0BA00AD7DA44B4B4F633D132B4769"><enum>(a)</enum><header>Interest</header><text display-inline="yes-display-inline">A creditor who extends consumer credit to a servicemember or a servicemember’s dependent shall not require the servicemember or the servicemember’s dependent to pay interest with respect to the extension of such credit, except as—</text> 
<paragraph id="HD7161E74A07A4EDC90BF12A1407C1CF3"><enum>(1)</enum><text>agreed to under the terms of the credit agreement or promissory note;</text></paragraph> 
<paragraph id="HB6694865F2DE4264827E0032DDCEE2D2"><enum>(2)</enum><text>authorized by the applicable State law; and</text></paragraph> 
<paragraph id="H9ED9AE1D4CE340DFA4E2E0FC55DEBEF5"><enum>(3)</enum><text>not specifically prohibited by this section.</text></paragraph></subsection> 
<subsection id="HB90E99DA62BF445FB2002E3DACA85F04"><enum>(b)</enum><header>Annual percentage rate</header><text display-inline="yes-display-inline">A creditor described in subsection (a) shall not impose an annual percentage rate greater than 36 percent with respect to the consumer credit extended to a servicemember or a servicemember’s dependent.</text></subsection> 
<subsection id="HBA42A30DD2D5449D8C05948309BEAF30"><enum>(c)</enum><header>Mandatory loan disclosures</header> 
<paragraph id="H2EA40EA7AB4040C0854931CCB05EFB7"><enum>(1)</enum><header>Information required</header><text display-inline="yes-display-inline">With respect to any extension of consumer credit to a servicemember or a servicemember’s dependent, a creditor shall provide to the servicemember or the servicemember’s dependent the following information in writing at or before the issuance of the credit:</text> 
<subparagraph id="HE75EDD7B02B141ADBBFE41008E4B02C4"><enum>(A)</enum><text>A statement of the annual percentage rate applicable to the extension of credit. </text></subparagraph> 
<subparagraph id="H1B0B9546D1654DEE9CC2FCA4D9D8F06D"><enum>(B)</enum><text display-inline="yes-display-inline">Any disclosures required under the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>). </text></subparagraph> 
<subparagraph id="HAF17E19676604532A6363CBCCB00C05B"><enum>(C)</enum><text>A clear description of the payment obligations of the servicemember or the servicemember’s dependent, as applicable.</text></subparagraph></paragraph> 
<paragraph id="HE1A4CA3F30F949730030CD10027FA810"><enum>(2)</enum><header>Terms</header><text>Such disclosures shall be presented in accordance with terms prescribed by the regulations issued by the Board of Governors of the Federal Reserve System to implement the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>).</text></paragraph></subsection> 
<subsection id="H33BAF65FE69F450583E940DA869CE582"><enum>(d)</enum><header>Limitation</header><text display-inline="yes-display-inline">A creditor described in subsection (a) shall not automatically renew, repay, refinance, or consolidate with the proceeds of other credit extended by the same creditor any consumer credit extended to a servicemember or a servicemember’s dependent without—</text> 
<paragraph id="HB1AA457D17724C74BFA5ACB8D49318BD"><enum>(1)</enum><text display-inline="yes-display-inline">executing new loan documentation signed by the servicemember or the servicemember’s dependent, as applicable; and</text></paragraph> 
<paragraph id="H30C84FA03F9245E29385E564F8137BC"><enum>(2)</enum><text>providing the loan disclosures described in subsection (c) to the servicemember or the servicemember’s dependent.</text></paragraph></subsection> 
<subsection id="HDBF0E6FB19A2493294B056A568237623"><enum>(e)</enum><header>Preemption</header><text display-inline="yes-display-inline">Except as provided in subsection (f)(2), this section preempts any State or Federal law, rule, or regulation, including any State usury law, to the extent that such laws, rules, or regulations are inconsistent with this section, except that this section shall not preempt any such law, rule, or regulation that provides additional protection to a servicemember or a servicemember’s dependent.</text></subsection> 
<subsection id="H9F95C553BBD14B15B03FF898503BF384"><enum>(f)</enum><header>Penalties</header><text display-inline="yes-display-inline"></text> 
<paragraph id="HBF85DE5C047744698248A85B71A10097"><enum>(1)</enum><header>Misdemeanor</header><text>Any creditor who knowingly violates this section shall be fined as provided in title 18, United States Code, or imprisoned for not more than one year, or both. </text></paragraph> 
<paragraph id="HE414D4DE491D46CAA7C2008EB400EAE4"><enum>(2)</enum><header>Preservation of other remedies</header><text display-inline="yes-display-inline">The remedies and rights provided under this section are in addition to and do not preclude any remedy otherwise available under law to the person claiming relief under this section, including any award for consequential and punitive damages. </text></paragraph></subsection> 
<subsection id="H77E99CC8AD7E4425BCC2FB117CC8AB45"><enum>(g)</enum><header>Definition</header><text>For purposes of this section, the term <term>interest</term> includes service charges, renewal charges, fees, or any other charges (except bona fide insurance) with respect to the extension of consumer credit.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HEED715DF46BA4CDFB2C1B44F5E3E0029"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents of the Servicemembers Civil Relief Act (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/50/501">50 U.S.C. App. 501</external-xref>) is amended by inserting after the item relating to section 207 the following new item:</text>
