<section section-type="section-one" id="H0DE2B8E98B4345E3A73818E5347139B9" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Flagship Species Conservation Act of 2005</short-title></quote>.</text></section> 
<section id="HE5A237946F9F45BD8EC800F997382901"><enum>2.</enum><header>Findings and purpose</header> 
<subsection id="HCA441E09D8794E0D9676B7DBF9F511E"><enum>(a)</enum><header>Findings</header><text>The Congress finds the following:</text> 
<paragraph id="H3E38B7B12B764630BB92427868CDD7E1"><enum>(1)</enum><text>Numerous species of fauna have continued to decline to the point that the long-term survival of those species in the wild is in serious jeopardy.</text></paragraph> 
<paragraph id="HF8DEC11D18734290975E2008C0203650"><enum>(2)</enum><text>Many of those species are listed under section 4 of the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>) or in Appendix I or II of the Convention on International Trade in Endangered Species of Wild Fauna and Flora.</text></paragraph> 
<paragraph id="H891F36712F924F999909202673681D2F"><enum>(3)</enum><text>There are insufficient resources available for addressing the threats facing those species, which will require the joint commitment and effort of countries within the range of those species, the United States and other countries, and the private sector.</text></paragraph> 
<paragraph id="H0A547648213C4066AEDDE6BEEC8F0013"><enum>(4)</enum><text>The grant programs established by the Congress for tigers, rhinoceroses, Asian elephants, African elephants, great apes, neotropical migratory birds, and marine turtles have proven to be extremely successful, provide Federal funds for conservation projects in an efficient and expeditious manner, and encourage additional support for conservation in countries where those species exist in the wild.</text></paragraph> 
<paragraph id="H87D37D8AB86D4B30B0E73BF73ACE105"><enum>(5)</enum><text>A new grant program modeled on the existing programs for tigers, rhinoceroses, elephants, great apes, neotropical migratory birds, and marine turtles would provide an effective means to assist in the conservation of flagship species for which there are no existing grant programs.</text></paragraph></subsection> 
<subsection id="H48B63FBC26464A68A222E5D645A515DE"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to conserve flagship species of fauna throughout the world, and the ecosystems on which those species depend, by supporting the conservation programs for those species and the CITES Secretariat, promoting partnerships between the public and private sectors, and providing financial resources for those programs and partnerships.</text></subsection></section> 
<section id="HE6C76CB4D3CE4D97999700CBB5708E2B"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HAC37A97E99AA45BA82101488AA4C5754"><enum>(1)</enum><header>Account</header><text>The term <term>Fund</term> means the Flagship Species Conservation Fund established by section 5.</text></paragraph> 
<paragraph id="H76B48042FCAE47F585F8250042462127"><enum>(2)</enum><header>CITES</header><text>The term <term>CITES</term> means the Convention on International Trade in Endangered Species of Wild Fauna and Flora, done at Washington March 3, 1973 (27 UST 1087; TIAS 8249), including its appendices and amendments.</text></paragraph> 
<paragraph id="HBF1EB226E9EC4D709FEA542945F7FCBB"><enum>(3)</enum><header>Conservation</header><text>The term <term>conservation</term> means the use of methods and procedures necessary to bring a flagship species to the point at which there are sufficient populations in the wild to ensure that the species does not become extinct, including—</text> 
<subparagraph id="H7FEE289D7C2C43E697C0D05870E0D5EC"><enum>(A)</enum><text>protection and management of populations of a flagship species;</text></subparagraph> 
<subparagraph id="H4EB662F5C3864C2EA353B6E37FB3CDE6"><enum>(B)</enum><text>maintenance, management, protection, and restoration of habitat of a flagship species;</text></subparagraph> 
<subparagraph id="HAD63080875E447549CD3D7B2ABE9EDD4"><enum>(C)</enum><text>research and monitoring;</text></subparagraph> 
<subparagraph id="H83FE5EC784E44B9982DB2B5EECF066BE"><enum>(D)</enum><text>law enforcement; and</text></subparagraph> 
<subparagraph id="HDE31D71F650E47539295734CA665B77"><enum>(E)</enum><text>community outreach and education.</text></subparagraph></paragraph> 
<paragraph id="HDDE98DCCAE33469289DAFF6F03999907"><enum>(4)</enum><header>Fish or wildlife</header><text>The term <term>fish or wildlife</term> means any mammal, fish, bird, or reptile.</text></paragraph> 
<paragraph id="H092595E7E546466DB3CBB837409B0524"><enum>(5)</enum><header>Flagship species</header><text>The term <term>flagship species</term>—</text> 
<subparagraph id="HAE5F61B2BE63453BBD7FA6761263AD60"><enum>(A)</enum><text>subject to subparagraph (B), means a species of fish or wildlife—</text> 
<clause id="HAB8D734B5E1843DE00BB24D1DB81C3D8"><enum>(i)</enum><text>that is listed as an endangered species or threatened species under section 4 of the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>) or that is listed in Appendix I or II of CITES;</text></clause> 
<clause id="HA24F688C07004B41B1CE69618636BC20"><enum>(ii)</enum><text>whose range is wholly outside of the United States; and</text></clause> 
<clause id="H581FA2EEB4E64DC4A0689953E7ABD689"><enum>(iii)</enum><text>that appeals to the public and has other features that make it suitable for communicating conservation concerns; and</text></clause></subparagraph> 
<subparagraph id="HBEDD5F802D9746DE9F6B841FD215A614"><enum>(B)</enum><text>does not include African elephants, Asian elephants, rhinoceros, tigers, great apes, neotropical migratory birds, and marine turtles.</text></subparagraph></paragraph> 
<paragraph id="H81009073AAAA4CAD93E5BB00A8DCB200"><enum>(6)</enum><header>Multinational Species Conservation Fund</header><text>The term <term>Multinational Species Conservation Fund</term> means the fund established under the heading <quote>multinational species conservation fund</quote> in title I of the Department of the Interior and Related Agencies Appropriations Act, 1999 (<external-xref legal-doc="usc" parsable-cite="usc/16/4246">16 U.S.C. 4246</external-xref>).</text></paragraph> 
<paragraph id="H6F9FC353F7B14DB4B2F215105C17B848"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> 
<section id="HDD7DE39477B94923B091E8341E6E6C00"><enum>4.</enum><header>Flagship species conservation assistance</header> 
<subsection id="H40EA782176004659947E3ED032139321"><enum>(a)</enum><header>In general</header><text>Subject to the availability of funds, the Secretary shall use amounts in the Fund to provide financial assistance for projects for the conservation of that flagship species throughout the world, for which project proposals are approved by the Secretary in accordance with this section.</text></subsection> 
<subsection id="HC885E3A73F9244948565000059451E23"><enum>(b)</enum><header>Project proposals</header> 
<paragraph id="H97867551CDF24BD8A6CE7DCD33BE36A0"><enum>(1)</enum><header>Eligible applicants</header><text>A proposal for a project for the conservation of a flagship species may be submitted to the Secretary by—</text> 
<subparagraph id="H4FB141389DB1444AB7E38227EA894FBB"><enum>(A)</enum><text>any relevant wildlife management authority of a country that has within its boundaries any part of the range of a flagship species, if the agency has authority over fish or wildlife and the activities of the agency directly or indirectly affect the species;</text></subparagraph> 
<subparagraph id="H84A16F769E804A35B7A9FB00001B4179"><enum>(B)</enum><text>the CITES Secretariat; or</text></subparagraph> 
<subparagraph id="H0C716DDE9FE240F0A2C3D586CE346EA5"><enum>(C)</enum><text>any person with demonstrated expertise in the conservation of that flagship species.</text></subparagraph></paragraph> 
<paragraph id="H46B85B95545648309200065411248C89"><enum>(2)</enum><header>Required information</header><text>A project proposal shall include—</text> 
<subparagraph id="HF8AF0378DC3E4C609D4ED48350213798"><enum>(A)</enum><text>the name of the individual with primary responsibility for conducting the project;</text></subparagraph> 
<subparagraph id="HD228523891934BC89C3F53F44085D87"><enum>(B)</enum><text>a succinct statement of—</text> 
<clause id="HA23C33A5090C42E6875C2C99DCBCCBBA"><enum>(i)</enum><text>the purposes of the project and the methodology for implementing the project, including an assessment of the status of the flagship species that is the subject of the project; and</text></clause> 
<clause id="HF3A1A3FE19C54ED08705EFD705B372BE"><enum>(ii)</enum><text>how the project will benefit that species and other species that reside within the same habitat;</text></clause></subparagraph> 
<subparagraph id="H4A8628B443C44D0594F6371482EC45D1"><enum>(C)</enum><text>a description of the qualifications of the individuals who will conduct the project;</text></subparagraph> 
<subparagraph id="HF5D7856AEEF846AB85F3F036515C6BE1"><enum>(D)</enum><text>an estimate of the funds and time required to complete the project;</text></subparagraph> 
<subparagraph id="H3CC9F2412CA242FE998B79DC9F84B9C5"><enum>(E)</enum><text>evidence of support for the project by appropriate governmental entities of countries in which the project will be conducted, if the Secretary determines that such support is required for the success of the project;</text></subparagraph> 
<subparagraph id="HDA337F3EA41D4F69BD7BB3C7AC869736"><enum>(F)</enum><text>information regarding the source and amount of matching funds available for the project; and</text></subparagraph> 
<subparagraph id="H573AE9B357C84EC38138A1C757CFC825"><enum>(G)</enum><text>any other information that the Secretary considers to be necessary for evaluating the eligibility of the project for funding under this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="HABEFB03CC7524D0AAB8DDADF16BD42B"><enum>(c)</enum><header>Project review and approval</header> 
<paragraph id="H868D9CEE64934D50A22475A9DC290080"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text> 
<subparagraph id="H867310D7D7174A2E825B92F74E6FDB75"><enum>(A)</enum><text>not later than 30 days after receiving a project proposal, provide a copy of the proposal to other Federal officials, as appropriate; and</text></subparagraph> 
<subparagraph id="H49865A0D54E2418C9E3B95091B00F683"><enum>(B)</enum><text>review each project proposal in a timely manner to determine whether the proposal meets the criteria specified in subsection (d).</text></subparagraph></paragraph> 
<paragraph id="H5AE371A5BB7549669456C1BA234B5B00"><enum>(2)</enum><header>Consultation; approval or disapproval</header><text>Not later than 180 days after receiving a project proposal, and subject to the availability of funds, the Secretary, after consulting with other Federal officials, as appropriate, shall—</text> 
<subparagraph id="HA23EC2BC85A7424EB3008422CC62E42"><enum>(A)</enum><text>consult on the proposal with the government of each country in which the project is to be conducted;</text></subparagraph> 
<subparagraph id="HC17CCB8F28784D8885185DD512B5EF5"><enum>(B)</enum><text>after taking into consideration any comments resulting from the consultation, approve or disapprove the project proposal; and</text></subparagraph> 
<subparagraph id="HB4CD38B1744442CCBA20244DF500B866"><enum>(C)</enum><text>provide written notification of the approval or disapproval to the person that submitted the project proposal, other Federal officials, and each country described in subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="HAA872C9E63444ADAB7D64BD606064375"><enum>(d)</enum><header>Criteria for approval</header><text>The Secretary may approve a project proposal under this section if the project will help recover and sustain viable populations of flagship species in the wild by assisting efforts in foreign countries to implement flagship species conservation programs.</text></subsection> 
<subsection id="HA454C7829EEC4092BF2B21A7927EBC92"><enum>(e)</enum><header>Project sustainability</header><text>To the maximum extent practicable, in determining whether to approve project proposals under this section, the Secretary shall give preference to conservation projects that are designed to ensure effective, long-term conservation of flagship species and their nesting habitats.</text></subsection> 
<subsection id="HBFB41977A33F43EBB168247F19E8E0C5"><enum>(f)</enum><header>Matching funds</header><text>In determining whether to approve project proposals under this section, the Secretary shall give preference to projects for which matching funds are available.</text></subsection> 
<subsection id="HBDC3D50991A5450BBE925C257127AE6"><enum>(g)</enum><header>Project reporting</header> 
<paragraph id="H2DFEA031C4754D01A04DD100E0E96C91"><enum>(1)</enum><header>In general</header><text>Each person that receives assistance under this section for a project shall submit to the Secretary periodic reports (at such intervals as the Secretary may require) that include all information that the Secretary, after consultation with other government officials, determines is necessary to evaluate the progress and success of the project for the purposes of ensuring positive results, assessing problems, and fostering improvements.</text></paragraph> 
<paragraph id="H9C373AEC3C1940DB88E162F92C60C759"><enum>(2)</enum><header>Availability to the public</header><text>Reports under paragraph (1), and any other documents relating to projects for which financial assistance is provided under this Act, shall be made available to the public.</text></paragraph></subsection></section> 
<section id="H7B92A73579AF4248A01DE39B5B64CC8"><enum>5.</enum><header>Flagship Species Conservation Fund</header> 
<subsection id="HD732B14F3FDD4A91B3B7B3B5F92CC50"><enum>(a)</enum><header>Establishment</header><text>There is established in the Multinational Species Conservation Fund a separate account to be known as the <quote>Flagship Species Conservation Fund</quote>, consisting of—</text> 
<paragraph id="H8ABF4D60D208476EBD3B153E0089A88F"><enum>(1)</enum><text>amounts transferred to the Secretary of the Treasury for deposit into the Fund under subsection (e);</text></paragraph> 
<paragraph id="HAA87242F306349D3AAFF6BFD015B02FC"><enum>(2)</enum><text>amounts appropriated to the Fund under section 6; and</text></paragraph> 
<paragraph id="HCE0F340C39194EF18439FF87D3DE7927"><enum>(3)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c).</text></paragraph></subsection> 
<subsection id="HFB6773D4699B4B2DA0AB00AD6946B3C"><enum>(b)</enum><header>Expenditures from Fund</header> 
<paragraph id="H614DCD62983647E09DF2461404A4C4FB"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), on request by the Secretary, the Secretary of the Treasury shall transfer from the Fund to the Secretary, without further appropriation, such amounts as the Secretary determines are necessary to carry out section 4.</text></paragraph> 
<paragraph id="HFC8DAA2D88C04D80BD87F13B00DB9F87"><enum>(2)</enum><header>Administrative expenses</header><text>Of the amounts in the account available for each fiscal year, the Secretary may expend not more than 3 percent, or up to $80,000, whichever is greater, to pay the administrative expenses necessary to carry out this Act.</text></paragraph></subsection> 
<subsection id="H6E1B3FEC74824428A6ED916F441EEC00"><enum>(c)</enum><header>Investment of amounts</header> 
<paragraph id="H51CC109DEADF462A93F751E7EC4E2D00"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall invest such portion of the Fund as is not, in the judgment of the Secretary of the Treasury, required to meet current withdrawals. Investments may be made only in interest-bearing obligations of the United States.</text></paragraph> 
<paragraph id="H5D8C13DCBA9C4EF382B229DFF563B1BA"><enum>(2)</enum><header>Acquisition of obligations</header><text>For the purpose of investments under paragraph (1), obligations may be acquired—</text> 
<subparagraph id="H889BDAED0CA744BDBB8DABD39591581D"><enum>(A)</enum><text>on original issue at the issue price; or</text></subparagraph> 
<subparagraph id="H833B0E9665A54756AD92ADF474695146"><enum>(B)</enum><text>by purchase of outstanding obligations at the market price.</text></subparagraph></paragraph> 
<paragraph id="H2C9BCB29C00E4C6B9FCA9F2697BFF991"><enum>(3)</enum><header>Sale of obligations</header><text>Any obligation acquired by the Fund may be sold by the Secretary of the Treasury at the market price.</text></paragraph> 
<paragraph id="H9BD718B196BD4EB8B7F84A828AAC7E5"><enum>(4)</enum><header>Credits to Fund</header><text>The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund.</text></paragraph></subsection> 
<subsection id="H1C2DB42C35194300B9603B8400C4DCAC"><enum>(d)</enum><header>Transfers of amounts</header> 
<paragraph id="H409F4F0929FF41618F213FA7983929B"><enum>(1)</enum><header>In general</header><text>The amounts required to be transferred to the Fund under this section shall be transferred at least monthly from the general fund of the Treasury to the Fund on the basis of estimates made by the Secretary of the Treasury.</text></paragraph> 
<paragraph id="HFF6BDB583C394F8AB2CB41EC0DF9CD5"><enum>(2)</enum><header>Adjustments</header><text>Proper adjustment shall be made in amounts subsequently transferred to the extent prior estimates were in excess of or less than the amounts required to be transferred.</text></paragraph></subsection> 
<subsection id="H8FCF377DCAA44AA58CA30985C84310FB"><enum>(e)</enum><header>Acceptance and use of donations</header><text>The Secretary may accept and use donations to provide assistance under section 4. Amounts received by the Secretary in the form of donations shall be transferred to the Secretary of the Treasury for deposit in the Fund.</text></subsection></section> 
<section id="HEF11B2D7E1724874ACBA853FD944B550"><enum>6.</enum><header>Advisory Group</header> 
<subsection id="H72C4CEF3D2CF476F8C187400E4E71639"><enum>(a)</enum><header>In general</header><text>To assist in carrying out this Act, the Secretary may convene an advisory group consisting of individuals representing public and private organizations actively involved in the conservation of flagship species.</text></subsection> 
<subsection id="H5E8335FAFCA14D22823D16821383F8C7"><enum>(b)</enum><header>Public participation</header> 
<paragraph id="HC812339174FD42D2875CA93EED3FD32E"><enum>(1)</enum><header>Meetings</header><text>The advisory group shall—</text> 
<subparagraph id="H2D2545D7C3C6442D9DBAAB095029F61E"><enum>(A)</enum><text>ensure that each meeting of the advisory group is open to the public; and</text></subparagraph> 
<subparagraph id="H17183FA9B6664561A6F4123911656451"><enum>(B)</enum><text>provide, at each meeting, an opportunity for interested persons to present oral or written statements concerning items on the agenda.</text></subparagraph></paragraph> 
<paragraph id="H0B66BA3898194ED3BB2ECEFAFA0089D1"><enum>(2)</enum><header>Notice</header><text>The Secretary shall provide to the public timely notice of each meeting of the advisory group.</text></paragraph> 
<paragraph id="H6BD10D633DAD4368B62EB4121C43FCA0"><enum>(3)</enum><header>Minutes</header><text>Minutes of each meeting of the advisory group shall be kept by the Secretary and shall be made available to the public.</text></paragraph></subsection> 
<subsection id="H63740676CEAB45AC8FE99200BC86B628"><enum>(c)</enum><header>Exemption from <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></header><text>The <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) shall not apply to the advisory group.</text></subsection></section> 
<section id="HD8E9B86721194F4A8188D831C266B0D0"><enum>7.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Fund $10,000,000 for each of fiscal years 2006 through 2008.</text></section> 
<section id="HC83CA4D32F384C018CFB3D172088E670"><enum>8.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than October 1, 2006, the Secretary shall submit to the Congress a report on the results and effectiveness of the program carried out under this Act, including—</text> 
<paragraph id="H6BE7916DA8F54CBAA1A7536E421DE3D5"><enum>(1)</enum><text>recommendations concerning how this Act might be improved, including guidelines for determining species that are flagship species; and</text></paragraph> 
<paragraph id="HE54C17F49501428280AB4C0219DBC5CB"><enum>(2)</enum><text>recommendations concerning whether the Fund should be continued in the future.</text></paragraph></section>
