<section id="HD28BF2A8F7FF4949889CC1C444583B06"><enum>101.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Funds are authorized to be appropriated for fiscal year 2006 for necessary expenses of the Coast Guard as follows:</text> 
<paragraph id="HFDD07E8374F0440CB31BC6F7717E2B99"><enum>(1)</enum><text>For the operation and maintenance of the Coast Guard, $5,586,400,000, of which $24,500,000 is authorized to be derived from the Oil Spill Liability Trust Fund to carry out the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990.</text></paragraph> 
<paragraph id="H9A69FEB1F8854AC59C14CDABC6493F1"><enum>(2)</enum><text>For the acquisition, construction, rebuilding, and improvement of aids to navigation, shore and offshore facilities, vessels, and aircraft, including equipment related thereto, $1,903,821,000, of which—</text> 
<subparagraph id="H0BCFBD8D97924A2B922688AAD9537921"><enum>(A)</enum><text>$20,000,000 shall be derived from the Oil Spill Liability Trust Fund to carry out the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990), to remain available until expended;</text></subparagraph> 
<subparagraph id="H582A8C7E8AE64126A5BC820888FD67A"><enum>(B)</enum><text display-inline="yes-display-inline">$1,316,300,000 is authorized for acquisition and construction of shore and offshore facilities, vessels, and aircraft, including equipment related thereto, and other activities that constitute the Integrated Deepwater Systems; and</text></subparagraph> 
<subparagraph id="H556D049DBC834AB5A4D3B6F3D2DAC9AD"><enum>(C)</enum><text>$284,369,000 is authorized for sustainment of legacy vessels and aircraft, including equipment related thereto, and other activities that constitute the Integrated Deepwater Systems.</text></subparagraph></paragraph> 
<paragraph id="H9214E5E8BA624D8795C5BAB2BAE928F9"><enum>(3)</enum><text>To the Commandant of the Coast Guard for research, development, test, and evaluation of technologies, materials, and human factors directly relating to improving the performance of the Coast Guard’s mission in search and rescue, aids to navigation, marine safety, marine environmental protection, enforcement of laws and treaties, ice operations, oceanographic research, and defense readiness, $24,000,000, to remain available until expended, of which $3,500,000 shall be derived from the Oil Spill Liability Trust Fund to carry out the purposes of section 1012(a)(5) of the Oil Pollution Act of 1990.</text></paragraph> 
<paragraph id="H590113113A7F44B3B37945E9E1C063B"><enum>(4)</enum><text>For retired pay (including the payment of obligations otherwise chargeable to lapsed appropriations for this purpose), payments under the Retired Serviceman’s Family Protection and Survivor Benefit Plans, and payments for medical care of retired personnel and their dependents under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code, $1,014,080,000, to remain available until expended.</text></paragraph> 
<paragraph id="HCEB503DB95EC4ED683D7253E4B7C92ED"><enum>(5)</enum><text display-inline="yes-display-inline">For alteration or removal of bridges over navigable waters of the United States constituting obstructions to navigation, and for personnel and administrative costs associated with the Bridge Alteration Program, $35,900,000.</text></paragraph> 
<paragraph id="H2AADB4C193E546559CAB81A93D47C3FE"><enum>(6)</enum><text>For environmental compliance and restoration at Coast Guard facilities (other than parts and equipment associated with operation and maintenance), $12,000,000, to remain available until expended.</text></paragraph> 
<paragraph id="HB2040A43713A4FFAB0864BBEBC324651"><enum>(7)</enum><text>For the Coast Guard Reserve program, including personnel and training costs, equipment, and services, $119,000,000.</text></paragraph></section> 
<section id="HAC01A910B8F84EB68C8010EFE300671E"><enum>102.</enum><header>Authorized levels of military strength and training</header> 
<subsection id="HA18522A1B79A43DD81A2CC4DFC89D464"><enum>(a)</enum><header>Active duty strength</header><text>The Coast Guard is authorized an end-of-year strength for active duty personnel of 45,500 for the years ending on September 30, 2005, and September 30, 2006.</text></subsection> 
<subsection id="HB4543ED12D794E5E8E8BCD195DC25FCD"><enum>(b)</enum><header>Military training student loads</header><text>The Coast Guard is authorized average military training student loads as follows:</text> 
<paragraph id="HCC4A7064B6F2412E8007293E9F1C951E"><enum>(1)</enum><text>For recruit and special training for fiscal year 2006, 2,500 student years.</text></paragraph> 
<paragraph id="H8A16970BD5BF4CB59E2FAF7500BA4300"><enum>(2)</enum><text>For flight training for fiscal year 2006, 125 student years.</text></paragraph> 
<paragraph id="H98BC4DA6200440429F3C9CE645F6FC23"><enum>(3)</enum><text>For professional training in military and civilian institutions for fiscal year 2006, 350 student years.</text></paragraph> 
<paragraph id="H939D9A0D091F42A782DB68E17B24BAE"><enum>(4)</enum><text>For officer acquisition for fiscal year 2006, 1,200 student years.</text></paragraph></subsection></section></title>

<section id="H7B7A22FA688B4682B0BC4B4F00C90003"><enum>201.</enum><header>Extension of Coast Guard vessel anchorage and movement authority</header><text display-inline="no-display-inline"> <external-xref legal-doc="usc" parsable-cite="usc/14/91">Section 91</external-xref> of title 14, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H03869F2C61174CC69D589B4073D832F8"><enum>(d)</enum><text>As used in this section <quote>navigable waters of the United States</quote> includes all waters of the territorial sea of the United States as described in Presidential Proclamation No. 5928 of December 27, 1988.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subsection id="H9EAD4B8AFEC8476BA4D2C0A98B00E623"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/14/149">Section 149</external-xref> of title 14, United States Code, is amended—</text> 
<paragraph id="HEC7D3474CB534036AE1D910042C18317"><enum>(1)</enum><text>by amending the section heading to read as follows:</text>

<subsection id="HFFEA7F36094646E1A4520078F58EB09"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The item related to such section in the analysis at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/7">chapter 7</external-xref> of title 14, United States Code, is amended to read as follows:</text>

<subsection id="HDF01110F31064792887F1000D0ECFC53"><enum>(f)</enum><text>The Secretary may waive subsection (a) of this section to the extent necessary to allow officers described therein to have at least two opportunities for consideration for promotion to the next higher grade as officers below the promotion zone.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subsection id="HA4464AF7528245CA86A3650067EE5893"><enum>(a)</enum><header>Band director appointment and grade</header><text><external-xref legal-doc="usc" parsable-cite="usc/14/336">Section 336</external-xref> of title 14, United States Code, is amended—</text> 
<paragraph id="HF8C660AEB049457080994E3014566689"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="HF0F60182F3574AD491F973AF7B678F85"><enum>(A)</enum><text>by amending the first sentence to read as follows: <quote>The Secretary may designate as the director any individual determined by the Secretary to possess the necessary qualifications.</quote>; and</text></subparagraph> 
<subparagraph id="H5A603534EB0D4C75BECCC186CADE412C"><enum>(B)</enum><text>in the second sentence, by striking <quote>a member so designated</quote> and inserting <quote>an individual so designated</quote>;</text></subparagraph></paragraph>

<subsection id="H61659FD4FE504D4492696844B65E6B29"><enum>(b)</enum><header>Current director</header><text>The individual serving as Coast Guard band director on the date of the enactment of this Act may be immediately promoted to a commissioned grade, not to exceed captain, determined by the Secretary to be most appropriate to the qualifications and experience of that individual.</text></subsection></section> 
<section id="H0BA5E0BA348C49E0B78E9FDCD0E3887D"><enum>205.</enum><header>Authority for one-step turnkey design-build contracting</header> 
<subsection id="H341A10E83DD74839BC8FB8BAF68F42A8"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/17">Chapter 17</external-xref> of title 14, United States Code, is amended by adding at the end the following new section:</text>

<section id="HC105A36B8BD24AEF8601C9DCF33E51D7"><enum>677.</enum><header>Turnkey selection procedures</header> 
<subsection id="H4A8177C683EE4A2B008D00429514E9A9"><enum>(a)</enum><header>Authority to use</header><text>The Secretary may use one-step turnkey selection procedures for the purpose of entering into contracts for construction projects.</text></subsection> 
<subsection id="H256743960E04490B0034A200E86F0000"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H51A038A9316D4BB0907C372F35188DF5"><enum>(1)</enum><text>The term <term>one-step turn-key selection procedures</term> means procedures used for the selection of a contractor on the basis of price and other evaluation criteria to perform, in accordance with the provisions of a firm fixed-price contract, both the design and construction of a facility using performance specifications supplied by the Secretary.</text></paragraph> 
<paragraph id="HC6609E28D8D14F32A96CC644CA2CAE4"><enum>(2)</enum><text>The term <term>construction</term> includes the construction, procurement, development, conversion, or extension, of any facility.</text></paragraph> 
<paragraph id="H12614C130B854DDBA2C398A936A739B3"><enum>(3)</enum><text>The term <term>facility</term> means a building, structure, or other improvement to real property.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA008305E49D741EAA119D79C2BC2E9"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis at the beginning of such chapter is amended by inserting after the item relating to section 676 the following:</text>

The number of Reserve officers in an active status below the grade of rear admiral (lower half) shall be distributed by pay grade so as not to exceed percentages of commissioned officers authorized by section 42(b) of this title. When the actual number of Reserve officers in an active status in a particular pay grade is less than the maximum percentage authorized, the difference may be applied to the number in the next lower grade. A Reserve officer may not be reduced in rank or grade solely because of a reduction in an authorized number as provided for in this subsection, or because an excess results directly from the operation of law.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>

<paragraph id="H4A472D3EA9DC47E481423EC6BCA9100"><enum>(2)</enum><text>has completed all requirements for a doctoral degree other than preparation of a dissertation; and</text></paragraph> 
<paragraph id="H6CE544CBC5284A9BB860FD06E408BE7"><enum>(3)</enum><text>agrees to prepare a dissertation in a subject area of Coast Guard history determined by the Commandant.</text></paragraph></subsection> 
<subsection id="H481EE5B31A2E4ECEB3D7D4E8783DF71D"><enum>(c)</enum><header>Regulations</header><text>The regulations prescribed under this section shall include—</text>

<section id="H913FCF04D67E4040A5FDBD4D621DF48D" display-inline="no-display-inline" section-type="subsequent-section"><enum>402.</enum><header>Authorization of junior reserve officers training program pilot program</header> 
<subsection id="H0C2CB89C4C444C11909CBDB37BD2FAEF"><enum>(a)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating (in this section referred to as the <quote>Secretary</quote>) may carry out a pilot program to establish and maintain a junior reserve officers training program in cooperation with the Camden County High School in Camden County, North Carolina.</text></subsection> 
<subsection id="HAC3B8B6625864B4895FC76C7D9DA15D3"><enum>(b)</enum><header>Program requirements</header><text>A pilot program carried out by the Secretary under this section shall provide to students at Camden County High School—</text> 
<paragraph id="H4DA54104F9C643DFBE65A17E00AB4D87"><enum>(1)</enum><text>instruction in subject areas relating to operations of the Coast Guard; and</text></paragraph> 
<paragraph id="H5181EDC03A0B46BAB8F8649BF9572479"><enum>(2)</enum><text>training in skills which are useful and appropriate for a career in the Coast Guard.</text></paragraph></subsection> 
<subsection id="HE367E23ED9CF4E2E9F08F8700A9739C"><enum>(c)</enum><header>Provision of additional support</header><text>To carry out a pilot program under this section, the Secretary may provide to Camden County High School—</text> 
<paragraph id="HA32642DE878C45FE9E02273F72655FD9"><enum>(1)</enum><text>assistance in course development, instruction, and other support activities;</text></paragraph> 
<paragraph id="H0B92218E7C0A46EF9600381488A947FE"><enum>(2)</enum><text>commissioned, warrant, and petty officers of the Coast Guard to serve as administrators and instructors; and</text></paragraph> 
<paragraph id="H4D7D07B8B9784CE9BBD45937DD7EABE7"><enum>(3)</enum><text>necessary and appropriate course materials, equipment, and uniforms.</text></paragraph></subsection> 
<subsection id="HAB383CE4960E4238928CF0C858A8EE4B"><enum>(d)</enum><header>Employment of retired Coast Guard personnel</header> 
<paragraph id="H1DC391397C47445F9E7CDBEDB78A100"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2) of this subsection, the Secretary may authorize the Camden County High School to employ as administrators and instructors for the pilot program retired Coast Guard and Coast Guard Reserve commissioned, warrant, and petty officers who request that employment and who are approved by the Secretary and Camden County High School.</text></paragraph> 
<paragraph id="HB1BAC07B01804502846F2ED882711373"><enum>(2)</enum><header>Authorized pay</header> 
<subparagraph id="H58DB78BAB99D4FF9B7673EA6D1A0DAD5" display-inline="no-display-inline"><enum>(A)</enum><header>In general</header><text>Retired members employed under paragraph (1) of this subsection are entitled to receive their retired or retainer pay and an additional amount of not more than the difference between—</text> 
<clause id="H7F58AB23D3D2423D82C3B74200CB7DF6"><enum>(i)</enum><text>the amount the individual would be paid as pay and allowance if they were considered to have been ordered to active duty during that period of employment; and</text></clause> 
<clause id="H2DC2FAEAD0734D4BB7F86F829EBC1484"><enum>(ii)</enum><text>the amount of retired pay the individual is entitled to receive during that period.</text></clause></subparagraph> 
<subparagraph id="H2C74926E0AFE4EAE8DB6926D64B64EFD"><enum>(B)</enum><header>Payment to school</header><text display-inline="yes-display-inline">The Secretary shall pay to Camden County High School an amount equal to one half of the amount described in subparagraph (A) of this paragraph, from funds appropriated for that purpose.</text></subparagraph> 
<subparagraph id="HB431CC4E001F4E4AB0494836D4E9700"><enum>(C)</enum><header>Not duty or duty training</header><text>Notwithstanding any other law, while employed under this subsection, an individual is not considered to be on active duty or inactive duty training.</text></subparagraph></paragraph></subsection></section> 
<section id="H826C091A05D1498BBFBFE4EBA1DEB4" section-type="subsequent-section" display-inline="no-display-inline"><enum>403.</enum><header>Transfer</header><text display-inline="no-display-inline">Section 602(b)(2) of the Coast Guard and Maritime Transportation Act of 2004 (118 Stat. 1051) is amended by striking <quote>to be conveyed</quote> and all that follows through the period and inserting <quote>to be conveyed to CAS Foundation, Inc. (a nonprofit corporation under the laws of the State of Indiana.</quote>. </text></section> 
<section id="HDC2244BAC1EA4D32BB74B272407BCA9E"><enum>404.</enum><header>Long-range vessel tracking system</header> 
<subsection id="H0F5481E6DDAF446EB946B700005004AC"><enum>(a)</enum><header>Pilot project</header><text>Subject to the availability of appropriations, the Secretary of the department in which the Coast Guard is operating, acting through the Commandant of the Coast Guard, shall conduct a pilot program for long range tracking of up to 2,000 vessels using satellite systems pursuant to <external-xref legal-doc="usc" parsable-cite="usc/46/70115">section 70115</external-xref> of title 46, United States Code.</text></subsection> 
<subsection id="H63F98DB1B0484E44917C03F900426FDC"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of the department in which the Coast Guard is operating $4,000,000 for fiscal year 2006 to carry out the pilot program authorized under subsection (a).</text></subsection></section> 
<section id="H6BC6A84871464CC4A7B8A77B098CCA83" display-inline="no-display-inline" section-type="subsequent-section"><enum>405.</enum><header>Report</header> 
<subsection id="H5B8FF35D8E85405C9FB73E014E6EA4D5"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard shall review the adequacy of assets described in subsection (b) to carry out the Coast Guard’s missions including search and rescue, illegal drug and migrant interdiction, and fisheries law enforcement. Not later than 180 days after the date of the enactment of this Act, the Commandant shall submit a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate that includes the findings of that review and any recommendations to enhance mission capabilities in those areas.</text></subsection> 
<subsection id="HC39C0F06982C432E8CCE56C491BAD447"><enum>(b)</enum><header>Areas of review</header><text>The report under subsection (a) shall provide information and recommendations on the following assets:</text> 
<paragraph id="H68E393735CA5467FB93F4EE8D67C5FA3"><enum>(1)</enum><text>Coast Guard aircraft, including helicopters, stationed at Air Station Detroit in the State of Michigan.</text></paragraph> 
<paragraph id="HE13C350D72AD414181A6CC25342075AF"><enum>(2)</enum><text>Coast Guard vessels and aircraft stationed in the Commonwealth of Puerto Rico.</text></paragraph> 
<paragraph id="HEF6F195BBF47466A8EF9FB406D8FB313"><enum>(3)</enum><text>Coast Guard vessels and aircraft stationed in the State of Louisiana along the Lower Mississippi River between the Port of New Orleans and the Red River.</text></paragraph></subsection></section> 
<section id="HF7DFA339FEF547838C941FD941E8F5A" display-inline="no-display-inline" section-type="subsequent-section"><enum>406.</enum><header>Training of cadets at United States Merchant Marine Academy</header><text display-inline="no-display-inline"> Section 1303(f) of the Merchant Marine Act, 1936 (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/1295b">46 App. U.S.C. 1295b(f)</external-xref>) is amended—</text> 
<paragraph id="H6DDA9C50C5E64EF890A42B218FD7C0F4"><enum>(1)</enum><text>in paragraph (2) by striking <quote>and</quote> after the semicolon at the end;</text></paragraph> 
<paragraph id="H387C4C9036D94783BCDF2BC85C005FD"><enum>(2)</enum><text>in paragraph (3) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H8A25A0A8FA66471500581779EC35DC8"><enum>(3)</enum><text>by adding at the end the following:</text>

<paragraph id="HF76E7F70B61E48438BA4AE9454DF4750"><enum>(4)</enum><text>on any other vessel considered necessary or appropriate or in the national interest.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H138775F3974F4D169D14294F9400BFD1"><enum>407.</enum><header>Marine casualty investigations study</header> 
<subsection id="H61327891664847E494FE133700DFB297"><enum>(a)</enum><header>Study</header><text>Within 3 months after the date of enactment of this Act, the Commandant of the Coast Guard shall enter into an agreement with National Institute for Occupational Safety and Health for a study of the Coast Guard marine casualty investigation program to examine the extent to which marine casualty investigations and reports—</text> 
<paragraph id="HCCF060C6C97C4EC9A402E5EF5E42B3C"><enum>(1)</enum><text>result in information and recommendations that prevent similar casualties;</text></paragraph> 
<paragraph id="HD48457EC871D438B9BC1374020BC74F9"><enum>(2)</enum><text>minimize the effect of similar casualties, given that it has occurred; and</text></paragraph> 
<paragraph id="H782A7710CD9B471296E20835B557B9F2"><enum>(3)</enum><text>maximize lives saved in similar casualties, given that the vessel has become uninhabitable.</text></paragraph></subsection> 
<subsection id="HC78BF7858F61419887FC0455FF097067"><enum>(b)</enum><header>Included elements</header><text display-inline="yes-display-inline">To promote the safety of all those who work on or travel by water and to protect the marine environment, the study shall include consideration of—</text> 
<paragraph id="H92A776AF441444BDBA89848000382D65"><enum>(1)</enum><text>the adequacy of resources devoted to marine casualty investigations considering caseload, training and experience of marine casualty investigators, and duty assignment practices;</text></paragraph> 
<paragraph id="H2AC00D0F829249CCBCB8D2C5060981E"><enum>(2)</enum><text>investigation standards and methods, including a comparison of the formal and informal investigation processes;</text></paragraph> 
<paragraph id="H94B8FF9CA5B24F3D9BD83F91578E2322"><enum>(3)</enum><text>use of best investigation practices considering transportation investigation practices used by other Federal agencies and foreign governments, including the British MAIB program;</text></paragraph> 
<paragraph id="H56BD72A4EEA846BFA9CB9106DD442B96"><enum>(4)</enum><text>marine casualty data base management and use of casualty data and information as an input to marine casualty prevention programs; </text></paragraph> 
<paragraph id="H7ADAE8E1F2C44AD58CC6E8CB2D5DE119"><enum>(5)</enum><text>the extent to which marine casualty data and information have been used to improve the survivability and habitability of vessels involved in marine casualties; and</text></paragraph> 
<paragraph id="H5C876A88AE77420583B041829F57C00"><enum>(6)</enum><text>any changes to current statutes that would clarify Coast Guard responsibilities for marine casualty investigations and report.</text></paragraph></subsection> 
<subsection id="H7698B6DAAAA44451BD6CA235F10572D5"><enum>(c)</enum><header>Report to Congress</header><text>The study, along with its findings and recommendations, shall be provided to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate within 18 months after entering into a contract with the Institute.</text></subsection> 
<subsection id="H5BFB33BDFBB443D4B5B3CA5066FCDFB"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $625,000 to carry out the study required by this section.</text></subsection></section> 
<section id="HE12AF0CB0CD1498EB026495FD7FD24A9"><enum>408.</enum><header>Conveyance of decommissioned Coast Guard Cutter MACKINAW</header> 
<subsection id="H79A28357BECB43409E2767AB56ABB761"><enum>(a)</enum><header>In general</header><text>Upon the scheduled decommissioning of the Coast Guard Cutter MACKINAW, the Commandant of the Coast Guard shall convey all right, title, and interest of the United States in and to that vessel to the City and County of Cheboygan, Michigan, without consideration, if—</text> 
<paragraph id="H8835D79F7D134E25841BB8CF2D99D154"><enum>(1)</enum><text>the recipient agrees—</text> 
<subparagraph id="H2A7E07C06E2A44C094F6B9D84481BBA0"><enum>(A)</enum><text>to use the vessel for purposes of a museum;</text></subparagraph> 
<subparagraph id="H1173D2523AEE4FF2A535C3CC30F97F77"><enum>(B)</enum><text>not to use the vessel for commercial transportation purposes;</text></subparagraph> 
<subparagraph id="H0E1FFCBD83504E7285F9F7B14C444575"><enum>(C)</enum><text>to make the vessel available to the United States Government if needed for use by the Commandant in time of war or a national emergency; and</text></subparagraph> 
<subparagraph id="H281913D0D5624F48BCB315602D004DC6"><enum>(D)</enum><text>to hold the Government harmless for any claims arising from exposure to hazardous materials, including asbestos and polychlorinated biphenyls (PCBs), after conveyance of the vessel, except for claims arising from the use by the Government under subparagraph (C);</text></subparagraph></paragraph> 
<paragraph id="H6BEC896C8E404F7FB700004200B45D1D"><enum>(2)</enum><text>the recipient has funds available that will be committed to operate and maintain the vessel conveyed in good working condition, in the form of cash, liquid assets, or a written loan commitment, and in an amount of at least $700,000; and</text></paragraph> 
<paragraph id="HDD6869FEE0374A9A9734CFAA4827F90"><enum>(3)</enum><text>the recipient agrees to any other conditions the Commandant considers appropriate.</text></paragraph></subsection> 
<subsection id="H78DF109E2B5B4B2E99C992C6A4325142"><enum>(b)</enum><header>Maintenance and delivery of vessel</header><text>Prior to conveyance of the vessel under this section, the Commandant shall, to the extent practical, and subject to other Coast Guard mission requirements, make every effort to maintain the integrity of the vessel and its equipment until the time of delivery. If a conveyance is made under this section, the Commandant shall deliver the vessel at the place where the vessel is located, in its present condition, and without cost to the Government. The conveyance of the vessel under this section shall not be considered a distribution in commerce for purposes of section 6(e) of <external-xref legal-doc="public-law" parsable-cite="pl/94/469">Public Law 94–469</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(e)</external-xref>).</text></subsection> 
<subsection id="HBBA1783EB140476886F24DF284837F3E"><enum>(c)</enum><header>Other excess equipment</header><text>The Commandant may convey to the recipient any excess equipment or parts from other decommissioned Coast Guard vessels for use to enhance the vessel’s operability and function for purposes of a museum.</text></subsection></section> 
<section id="HC94CA87E97054E959DF3536B59DFCBE0"><enum>409.</enum><header>Deepwater implementation report</header><text display-inline="no-display-inline">Within 30 days after the date of the enactment of this Act, the Secretary of the department in which the Coast Guard is operating shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the implementation of the Integrated Deepwater Program that includes—</text> 
<paragraph id="HC406D6B6ADFB499A89E84C4FE99A348"><enum>(1)</enum><text>a complete timeline for the acquisition of each new Deepwater asset and the phase-out of legacy assets for the life of such program;</text></paragraph> 
<paragraph id="H9DC31DB55A8141C193B29D83C42CCBCC"><enum>(2)</enum><text>a projection of the remaining operational lifespan of each legacy asset;</text></paragraph> 
<paragraph id="H0B8A1085139A4ACDA1695B2FC24B79AB"><enum>(3)</enum><text>a detailed justification for each modification in each Integrated Deepwater Program asset that fulfills the revised mission needs statement for the program; and</text></paragraph> 
<paragraph id="H1D98785FF9CA4415986F2507C5E47F3D"><enum>(4)</enum><text>a total cost of the program that aligns with the revised mission needs statement for the program.</text></paragraph></section> 
<section id="H79B1CB64512B414998392900BEC398EF"><enum>410.</enum><header>Helicopters</header> 
<subsection id="H4E1B288180C0403D8137A5D576055C62"><enum>(a)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating may in accordance with this section acquire or lease up to four previously used HH–65 helicopters or airframes (or any combination thereof) that were not under the administrative control of the Coast Guard on January 1, 2005.</text></subsection> 
<subsection id="HDBBFAA64C80F442EA7C8EF588D9C5752"><enum>(b)</enum><header>Determination and certification</header><text>The Secretary shall not acquire or lease any previously used HH–65 helicopters or airframes under subsection (a), until the end of the 90-day period beginning on the date the Secretary notifies the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate that the Secretary has—</text> 
<paragraph id="H97E11DF142DB4E288CF7F38C004F7001"><enum>(1)</enum><text>determined that acquiring or leasing such previously used helicopters or airframes, and making any modifications to such helicopters or airframes that are needed to ensure those helicopters and airframes meet the design, construction, and equipment standards that apply to H–65 helicopters under the administrative control of the Coast Guard on May 18, 2005, is more cost-effective than acquiring or leasing an equal number of MH-68 helicopters; and</text></paragraph> 
<paragraph id="H3E8BD41BAFF24A0F9C1B6BB3390006D0"><enum>(2)</enum><text display-inline="yes-display-inline">certified that the helicopters and airframes will meet all applicable Coast Guard safety requirements.</text></paragraph></subsection></section> 
<section id="H6A82578985594D8D883CF544E6D886E" display-inline="no-display-inline" section-type="subsequent-section"><enum>411.</enum><header>Reports from mortgagees of vessels</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/12120">Section 12120</external-xref> of title 46, United States Code, is amended by striking <quote>owners, masters, and charterers</quote> and inserting <quote>owners, masters, charterers, and mortgagees</quote>.</text></section> 
<section id="HCBCE61DA5AA446A8904646F6A03123DC"><enum>412.</enum><header>Newtown Creek, New York City, New York</header> 
<subsection id="HA68EEE94DAE44B6D8DB5658EB2882E00"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">Of the amounts provided under section 1012 of the Oil Pollution Act, the Coast Guard shall conduct a study of public health and safety concerns related to the pollution of Newtown Creek, New York City, New York, caused by seepage of oil into Newtown Creek from 17,000,000 gallons of underground oil spills in Greenpoint, Brooklyn, New York.</text></subsection> 
<subsection id="HFA79C38CF8C74FEDB6E24D261FFAA184"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Coast Guard shall transmit to Congress a report containing the results of the study.</text></subsection></section></title>
