<section id="H28A9E979A40A471D85E6BB83D5D615E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Wireless Privacy Protection Act of 2005</short-title></quote>.</text></section> 
<section id="HED9E6BC4BB344C48835873928230AA73"><enum>2.</enum><header>Authority to provide call location information concerning wireless customers</header> 
<subsection id="H723A3DFDDBB041448DF32EE2F91400AD"><enum>(a)</enum><header>Informed consent to provision of location information</header><text>Section 222 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/222">47 U.S.C. 222</external-xref>) is amended—</text> 
<paragraph id="H108AB696F6704F1CB4C4218EECA2F5EB"><enum>(1)</enum><text>by redesignating subsection (h) as subsection (i); and</text></paragraph> 
<paragraph id="H4923B790BF0E4305AFDBE0529E85612F"><enum>(2)</enum><text>by inserting before such subsection the following new subsection:</text> 
<quoted-block id="H2C573B204C2942A1A8456F0095203FE4" style="OLC"> 
<subsection id="H64C5A6C39BF9422F9EF85EEBD73C10EB"><enum>(h)</enum><header>Authority to use wireless location and crash information</header><text>A customer shall not be considered to have granted express prior authorization for purposes of subsection (f) unless—</text> 
<paragraph id="H8406C0F2CCAE4FA0BB8B96F7F98C25ED"><enum>(1)</enum><text>the carrier has provided the customer in writing a clear, conspicuous, and complete disclosure of the carrier’s practices with respect to the collection and use of location information, transaction information, and automatic crash identification information, before any such information is disclosed or used, and such disclosure includes a description of—</text> 
<subparagraph id="H1671FE4915424246BBEFD0094915C77"><enum>(A)</enum><text>the specific types of information that is collected by the carrier;</text></subparagraph> 
<subparagraph id="H30A416D9395847C0B5FB3333D6D3B1EC"><enum>(B)</enum><text>how the carrier uses such information; and</text></subparagraph> 
<subparagraph id="H07CAC9FCDBFE4694929CF9068ED13778"><enum>(C)</enum><text>what information may be shared or sold to other companies and third parties;</text></subparagraph></paragraph> 
<paragraph id="H8E6E101408044705B2AD71BC3ECED3B3"><enum>(2)</enum><text>the customer has agreed in writing to the collection and use of such information, or has agreed in writing to such collection and use subject to certain limitations; and</text></paragraph> 
<paragraph id="H81A9F3B0712241F6BFDF3FF5B5B98DFB"><enum>(3)</enum><text>the carrier has established and maintains reasonable procedures to protect the confidentiality, security, and integrity of the information the carrier collects and maintains in accordance with such customer consents.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0EFF757A613B44DE96CC83FE8FBEDEF5"><enum>(b)</enum><header>Regulations required</header><text>The Federal Communications Commission shall prescribe regulations to implement the amendments made by subsection (a) within 6 months after the date of enactment of this Act.</text></subsection></section>
