<official-title>To clarify the authority of States to establish conditions for insurers to conduct the business of insurance within a State based on provision of information regarding Holocaust era insurance policies of the insurer and to establish a Federal cause of action for claims for payment of such insurance policies, and for other purposes.</official-title>

<section section-type="section-one" id="HFF34040A7DD345D89660311E4CE6E7CC" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Comprehensive Holocaust Accountability in Insurance Measure</short-title></quote>.</text></section> 
<section id="HC535CCC7C09C47E49361C3CF8BB3B038"><enum>2.</enum><header>Congressional findings</header><text display-inline="no-display-inline">The Congress finds that—</text> 
<paragraph id="HB4F99172C1D7464FAB49C45E12A9B4A9"><enum>(1)</enum><text>between 1933 and 1945, the Nazi regime and its collaborators conducted systematic, bureaucratic, and State-sponsored persecution and murder of approximately six million Jews—the genocidal act known as the Holocaust;</text></paragraph> 
<paragraph id="HCE20A5E066CA4B2483183F30B749C7EB"><enum>(2)</enum><text>before and during World War II, millions of European Jews had purchased, in good faith, life insurance policies with certain European insurance companies because these policies were a popular form of savings and investment that provided a means of safeguarding a family’s assets, assisting in retirement planning, providing for a dowry, or saving for the education of children;</text></paragraph> 
<paragraph id="H4C53493AA7894BBF9338224DED988376"><enum>(3)</enum><text>after the Nazis came to power in Germany, they systematically confiscated the insurance assets, including the cash value of life insurance policies, of Jews and other designated enemies of the Nazi regime;</text></paragraph> 
<paragraph id="H02A354A67E7E4A689740A846940421ED"><enum>(4)</enum><text>after the conclusion of World War II, European insurers often rejected insurance claims of Holocaust victims and heirs who lacked required documentation, such as death certificates;</text></paragraph> 
<paragraph id="HEE01B2CA71B84AB7B3356EB5DFAC6C55"><enum>(5)</enum><text>during the 50 years since the end of the war, only a small percentage of Holocaust victims and their families have been successful in collecting on their policies;</text></paragraph> 
<paragraph id="H94ADC8C0F4D54F7E8B89D6003BD06B4D"><enum>(6)</enum><text>in 1998, the International Commission on Holocaust Era Insurance Claims (ICHEIC) was established by U.S. State insurance regulators, European insurers, and certain nongovernmental organizations to act as a facilitator between insurers and beneficiaries to help expedite payouts on contested insurance policies;</text></paragraph> 
<paragraph id="H601B9EDA79E44B27A2FDBE8C68BF7287"><enum>(7)</enum><text>to date ICHEIC has received over 90,000 claims and has only made 2,281 settlement offers, which amounts to less than a 3% success rate;</text></paragraph> 
<paragraph id="H56A4264363B84096A54E1491AD88FC26"><enum>(8)</enum><text>these insurance payments should be expedited to the victims of the most heinous crime of the 20th century to ensure that they do not become victims a second time;</text></paragraph> 
<paragraph id="H144D423A4A6D4ECBA3912789BFE1E6B3"><enum>(9)</enum><text>States should be allowed to collect Holocaust-era insurance information from foreign-based insurance companies that want to do business in the State; and</text></paragraph> 
<paragraph id="H32C45AD32D47490EB5C89FC1589D7B3"><enum>(10)</enum><text>Holocaust victims and their families should be able to recover claims on Holocaust era insurance policies in Federal court when they deem it necessary to seek redress through the judicial system.</text></paragraph></section> 
<section id="HDF8515CD01E74156BB159D7E5913F660"><enum>3.</enum><header>State authority to establish requirements for conducting insurance business</header> 
<subsection id="HADB53691CDA04E57BF1D7ED93C3032E"><enum>(a)</enum><header>In general</header><text>A State may establish requirements on insurers as a condition of doing insurance business in that State, to the extent such requirements are consistent with the due process guarantees of the Constitution of the United States, as follows:</text> 
<paragraph id="H79C168A0B66F4F10ADA4B99BF98BFAB3"><enum>(1)</enum><header>Information requirements</header><text>The State may require that an insurer provide to the State the following information regarding Holocaust era insurance policies:</text> 
<subparagraph id="HC3B15EB9C07F443485C0B301074C298B"><enum>(A)</enum><text>Whether the insurer, or any affiliate or predecessor company, sold any such policies.</text></subparagraph> 
<subparagraph id="H2409ED216F594509B708B841209953A7"><enum>(B)</enum><text>The number of such policies sold by the insurer, and any affiliates and predecessor companies, and the number the insurer and its affiliates currently have in their possession.</text></subparagraph> 
<subparagraph id="HF6F236B65E0C4422BEEC93CCCE6BC98"><enum>(C)</enum><text>The identity of the holder and beneficiary of each such policy sold or held and current status of each such policy.</text></subparagraph> 
<subparagraph id="HF3CE8E2CBF4C4EF59DBA3E86FEEDC451"><enum>(D)</enum><text>The city of origin, domicile, and address for each policyholder listed.</text></subparagraph> 
<subparagraph id="H55FD8B2E8C1D4C8D8359C1811EB6B12D"><enum>(E)</enum><text>If an insurer has no such policies to report because records are no longer in the possession of the insurer or its affiliates, a statement explaining the reasons for the lack of possession of such records.</text></subparagraph> 
<subparagraph id="HB57FB75EF9C84C708F02B9B8B2B90020"><enum>(F)</enum><text>Any other information regarding such policies as the State considers appropriate.</text></subparagraph></paragraph> 
<paragraph id="H70716E8736184EE79922B0524100113D"><enum>(2)</enum><header>Requirements regarding payment of policies</header><text>A State may require that an insurer certify that, with respect to any Holocaust era insurance policies sold or at any time held by the insurer—</text> 
<subparagraph id="H6D6DBE3A095C4079B1B8D0C03EFD337B"><enum>(A)</enum><text>the proceeds of the policy were paid;</text></subparagraph> 
<subparagraph id="H8949ED58DDF741B08EDC8900C4D02881"><enum>(B)</enum><text>the beneficiaries of the policy or heirs or such beneficiaries could not, after diligent search, be located, and the proceeds were distributed to Holocaust survivors or charities;</text></subparagraph> 
<subparagraph id="H2DDD0376225C486A9D4DAEF1136D1EE"><enum>(C)</enum><text>a court of law has certified a plan for the distribution of the proceeds; or</text></subparagraph> 
<subparagraph id="HA0D2F36B60B44691900194FB1D6DCF20"><enum>(D)</enum><text>the proceeds have not been distributed.</text></subparagraph></paragraph></subsection> 
<subsection id="H6A9750EF41F7411A87FFC0008EC814DC"><enum>(b)</enum><header>Holocaust era insurance policies</header><text>For purposes of this section, the term <term>Holocaust era insurance policy</term> means a policy for insurance coverage that—</text> 
<paragraph id="H4DDF2340D2884936BA993DA53EF21658"><enum>(1)</enum><text>was in force at any time during the 26-year period beginning with 1920 and ending with 1945; and</text></paragraph> 
<paragraph id="H203C0B73A0C043F8B600589D8700E6BD"><enum>(2)</enum><text>has a policy beneficiary, policyholder, or insured life that is a listed Holocaust victim.</text></paragraph></subsection></section> 
<section id="HF83D4E3C59F44369ACA8B9F0C81B2CC7"><enum>4.</enum><header>Federal cause of action for covered claims</header> 
<subsection id="H33E93CB3601D4CA39D5151A300734F8E"><enum>(a)</enum><header>Federal cause of action</header> 
<paragraph id="H01E04AEDA5FE47C0A3B455B5B3751FC4"><enum>(1)</enum><header>In general</header><text>There shall exist a Federal cause of action for any covered claim.</text></paragraph> 
<paragraph id="H6A09F2BFF6354C258EF334E36960EB42"><enum>(2)</enum><header>Statute of limitations</header><text>Any action brought under paragraph (1) shall be filed not later than 10 years after the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="H653450555F274E2A82021642ECD8FFB1"><enum>(b)</enum><header>Subject matter jurisdiction</header><text>The district courts shall have original jurisdiction of any civil action on a covered claim (whether brought under subsection (a) or otherwise).</text></subsection> 
<subsection id="H76D411BD551F475D9913CCEC1460000"><enum>(c)</enum><header>Personal jurisdiction</header><text>Notwithstanding any provision of Rule 4 of the Federal Rules of Civil Procedure to the contrary, in a civil action on a covered claim (whether brought under subsection (a) or otherwise) commenced in a district where the defendant is not a resident—</text> 
<paragraph id="HA2922E84792249DF823EE7D68206A105"><enum>(1)</enum><text>the court may exercise jurisdiction over such defendant on any basis not inconsistent with the Constitution of the United States; and</text></paragraph> 
<paragraph id="H23F60803290D4541B6FAE55C73F6CC3C"><enum>(2)</enum><text>service of process, summons, and subpoena may be made on such defendant in any manner not inconsistent with the Constitution of the United States.</text></paragraph></subsection> 
<subsection id="HC7337D45A7C2411F96D55794DD19C11F"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HF7CDA899191145E89EDC248152B4F3AC"><enum>(1)</enum><header>Covered claim</header><text>The term <term>covered claim</term> means a claim against a covered foreign insurance company that arises out of the insurance coverage involved in an original request.</text></paragraph> 
<paragraph id="H5C1570D790F248FA81240065F0ECCE94"><enum>(2)</enum><header>Original request</header><text>The term <term>original request</term> means a request that—</text> 
<subparagraph id="HAAC879DC8EF240EDABA9A692FA59C1F7"><enum>(A)</enum><text>seeks payment of any claim on insurance coverage that—</text> 
<clause id="H75F4D85CA5A94B579177517939F2B6F9"><enum>(i)</enum><text>was provided by a covered foreign insurance company;</text></clause> 
<clause id="HDEA6569A76A74F5F86ECB2626E8B4E63"><enum>(ii)</enum><text>had as the policyholder, insured, or beneficiary a listed Holocaust victim; and</text></clause> 
<clause id="H45802101483043C596C240DEA04F10B4"><enum>(iii)</enum><text>was in effect during any portion of the 13-year period beginning with 1933 and ending with 1945; and</text></clause></subparagraph> 
<subparagraph id="H45D5A52E5C574B98B81227E00BFF42B"><enum>(B)</enum><text>was made by a listed Holocaust victim, or the heirs or beneficiaries of such victim, to the covered foreign insurance company or the International Commission on Holocaust Era Insurance Claims.</text></subparagraph></paragraph> 
<paragraph id="HFD3B84C4E8834432A1DFB63D3C58003E"><enum>(3)</enum><header>Covered foreign insurance company</header><text>The term <term>covered foreign insurance company</term> means each of the following companies, and its affiliates and predecessor companies:</text> 
<subparagraph id="H8E77F421B28B4B55999EB6B71DED57C7"><enum>(A)</enum><text>Assicurazioni Generali S.p.A.</text></subparagraph> 
<subparagraph id="H33430F288A8745A59EDAEC4918C190B6"><enum>(B)</enum><text>Union Des Assurances de Paris.</text></subparagraph> 
<subparagraph id="H9FEDA836813F4E03A5C0AA125151954"><enum>(C)</enum><text>Victoria Lebenversicherungs AG.</text></subparagraph> 
<subparagraph id="HDBEB915AD93D417F83BA249D77431FF"><enum>(D)</enum><text>Winterthur Lebensversicherungs Gesellschaft.</text></subparagraph> 
<subparagraph id="H1ED76743F2D24E4083344441C1511DD9"><enum>(E)</enum><text>Allianz Lebensversicherungs AG.</text></subparagraph>

<subparagraph id="H5E780E1DED7B4699BD5447AFDD599388"><enum>(Q)</enum><text>Any other foreign insurance company that the States or the Attorney General of the United States determines was in a position to have financial dealings with any individual who was a victim of the Holocaust.</text></subparagraph></paragraph></subsection></section> 
<section id="H605427135E864D208FBA656C4DBDC86D"><enum>5.</enum><header>Listed Holocaust victims</header><text display-inline="no-display-inline">For purposes of this Act, the term <quote>listed Holocaust victim</quote> means the following individuals:</text> 
<paragraph id="H286ADA76C0D1469E8F00FBDB12C200C1"><enum>(1)</enum><header>List of survivors</header><text>Any individual whose name is on the list of Jewish Holocaust Survivors maintained by the United States Holocaust Memorial Museum in Washington, D.C.</text></paragraph> 
<paragraph id="HBAE272244F9F4502BE9C5272E0D5EC72"><enum>(2)</enum><header>List of deceased</header><text>Any individual whose name is on the list of individuals who died in the Holocaust maintained by the Yad Veshem of Jerusalem in its Hall of Names.</text></paragraph> 
<paragraph id="H186D7EAD90804A2BA839068C37113FED"><enum>(3)</enum><header>Other lists</header><text>Any individual whose name is on—</text> 
<subparagraph id="H5B0CD960967B43AFAB3DB34581E63737"><enum>(A)</enum><text>any list of Holocaust victims that is designated as appropriate for use under this Act by the chief executive officer of a State or a State insurance commissioner or other principal insurance regulatory authority of a State; or</text></subparagraph> 
<subparagraph id="HFCB642FF4F01414FA7C4FDE88EF4F79B"><enum>(B)</enum><text>any similar list, such as a list of the International Red Cross, the League of Red Cross Societies, the Supreme Headquarters of the Allied Expeditionary Forces, or other regularly accessed source of information regarding Holocaust victims.</text></subparagraph></paragraph></section>
