<official-title>To amend the Occupational Safety and Health Act of 1970 to provide for the award of attorneys’ fees and costs to small employers when such employers prevail in litigation prompted by the issuance of a citation by the Occupational Safety and Health Administration.</official-title>

<section id="H8AD842E58B854676A3290300A0DC42B6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Occupational Safety and Health Small Employer Access to Justice Act of 2005</short-title></quote>.</text></section> 
<section id="H666E934ACCF64804A6C9B1BCEA03889"><enum>2.</enum><header>Award of attorneys’ fees and costs</header><text display-inline="no-display-inline">The Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/651">29 U.S.C. 651 et seq.</external-xref>) is amended by redesignating sections 32, 33, and 34 as sections 33, 34, and 35, respectively, and by inserting after section 31 the following new section:</text>

<section id="H53EED7527996483E84966633DFFC291F"><enum>32.</enum><header>Award of attorneys’ fees and costs</header> 
<subsection id="H4A6D6CBC9376432FB90025EDF82962DA" display-inline="yes-display-inline"><enum>(a)</enum><header>Administrative Proceedings</header><text>An employer who—</text> 
<paragraph id="H1282DA11D6394F15998C5EBF5FD2A6DB"><enum>(1)</enum><text display-inline="yes-display-inline">is the prevailing party in any adversary adjudication instituted under this Act, and</text></paragraph> 
<paragraph id="HEF21D05C22684D4B897DEC6E00A20071"><enum>(2)</enum><text display-inline="yes-display-inline">had not more than 100 employees and a net worth of not more than $7,000,000 at the time the adversary adjudication was initiated,</text></paragraph><continuation-text continuation-text-level="subsection">shall be awarded fees and other expenses as a prevailing party under <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504</external-xref> of title 5, United States Code, in accordance with the provisions of that section, but without regard to whether the position of the Secretary was substantially justified or special circumstances make an award unjust. For purposes of this section the term <quote>adversary adjudication</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504(b)(1)(C)</external-xref> of title 5, United States Code.</continuation-text></subsection> 
<subsection id="HD104BD82183B4B3B9709C74486B50048"><enum>(b)</enum><header>Proceedings</header><text>An employer who—</text> 
<paragraph id="H26CCC038BB4840599108250951EC7765"><enum>(1)</enum><text display-inline="yes-display-inline">is the prevailing party in any proceeding for judicial review of any action instituted under this Act, and</text></paragraph> 
<paragraph id="H445A80CF9A2740D9A2B157128D3FBA78"><enum>(2)</enum><text display-inline="yes-display-inline">had not more than 100 employees and a net worth of not more than $7,000,000 at the time the action addressed under subsection (1) was filed,</text></paragraph><continuation-text continuation-text-level="subsection">shall be awarded fees and other expenses as a prevailing party under <external-xref legal-doc="usc" parsable-cite="usc/28/2412">section 2412(d)</external-xref> of title 28, United States Code, in accordance with the provisions of that section, but without regard to whether the position of the United States was substantially justified or special circumstances make an award unjust. Any appeal of a determination of fees pursuant to subsection (a) of this subsection shall be determined without regard to whether the position of the United States was substantially justified or special circumstances make an award unjust.</continuation-text></subsection> 
<subsection id="H0A6F46FE692540E194A63DB709F063FB"><enum>(c)</enum><header>Applicability</header> 
<paragraph id="H37082412368641A184399FB3465BEA5C"><enum>(1)</enum><header>Commission proceedings</header><text display-inline="yes-display-inline">Subsection (a) shall apply to proceedings commenced on or after the date of enactment of this section.</text></paragraph> 
<paragraph id="H5BB709D1F8E3437E8436FE3B57B66201"><enum>(2)</enum><header>Court proceedings</header><text display-inline="yes-display-inline">Subsection (b) shall apply to proceedings for judicial review commenced on or after the date of enactment of this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
