<section id="H1A6880D21CC1432093E17C7CB34E643B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Occupational Safety and Health Review Commission Efficiency Act of 2005</short-title></quote>.</text></section> 
<section id="H31E918A09943489B95DB8CD9D0D01B8E"><enum>2.</enum><header>Occupational Safety and Health Review Commission</header> 
<subsection id="H5AA10F2DF9B4469DA2CF4B376200C52"><enum>(a)</enum><header>Increase in number of members and requirement for membership</header><text display-inline="yes-display-inline">Section 12 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/661">29 U.S.C. 661</external-xref>) is amended—</text> 
<paragraph id="H7CBD4765FA4D40B8BDD679E634E7D017"><enum>(1)</enum><text>in the second sentence of subsection (a)—</text> 
<subparagraph id="HFE518A7C2ECB4A38A5F0D97CD4E6B0F0"><enum>(A)</enum><text>by striking <quote>three members</quote> and inserting <quote>five members</quote>; and</text></subparagraph> 
<subparagraph id="HF2CCBF088AD74FCE8302A47E80A001C"><enum>(B)</enum><text>by inserting <quote>legal</quote> before <quote>training</quote>;</text></subparagraph></paragraph> 
<paragraph id="H8F135CC207944258B3E7B952B44500A4"><enum>(2)</enum><text>in the first sentence of subsection (b), by striking <quote>except that</quote> and all that follows through the period and inserting the following: <quote>except that the President may extend the term of a member for no more than 365 consecutive days to allow a continuation in service at the pleasure of the President after the expiration of the term of that member until a successor nominated by the President has been confirmed to serve. Any vacancy caused by the death, resignation, or removal of a member before the expiration of a term for which a member was appointed shall be filled only for the remainder of such term.</quote>; and</text></paragraph> 
<paragraph id="H0847842A4DCE4DE5811700B216851C23"><enum>(3)</enum><text>in subsection (f), by striking <quote>two members</quote> each place it appears and inserting <quote>three members</quote>.</text></paragraph></subsection> 
<subsection id="H00DE129498194A0E005EB2355CD160FB"><enum>(b)</enum><header>New positions</header><text>Of the two vacancies for membership on the Occupational Safety and Health Review Commission created by subsection (a)(1)(A), one shall be appointed by the President for a term expiring on April 27, 2008, and the other shall be appointed by the President for a term expiring on April 27, 2010.</text></subsection> 
<subsection id="H47B94EF89598413A99606B3329B0D733"><enum>(c)</enum><header>Effective date for legal training requirement</header><text>The amendment made by subsection (a)(1)(B), requiring a member of the Commission to possess a background in legal training, shall apply beginning with the two vacancies referred to in subsection (b) and all subsequent appointments to the Commission.</text> </subsection></section>

<subsection id="H50A7D5DA41164E4FA730A91076A9C924"><enum>(a)</enum><header>Increase in number of members and criteria for membership</header><text display-inline="yes-display-inline">Section 12 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/661">29 U.S.C. 661</external-xref>) is amended—</text>

<subparagraph id="H0A1040AFCAA448E09F9441C6653F9871"><enum>(A)</enum><text>by striking <quote>three members</quote> and inserting <quote>five members</quote>; and</text></subparagraph> 
<subparagraph id="HE1769521016744CEAB8897DDD5E371B7"><enum>(B)</enum><text>by inserting <quote>legal</quote> before <quote>training</quote>;</text></subparagraph></paragraph>
