<section id="H49B76C61DCB44735A0DA06A442285DA9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Occupational Safety and Health Small Business Day in Court Act of 2005</short-title></quote>.</text></section> 
<section id="H0D409E34A0AF4398A000D2B68F394F56"><enum>2.</enum><header>Contesting citations under the Occupational Safety and Health Act of 1970</header><text display-inline="no-display-inline">Section 10 of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/659">29 U.S.C. 659</external-xref>) is amended—</text> 
<paragraph id="HF625E421E7CD46AC80A6928E385C1186"><enum>(1)</enum><text>in the second sentence of subsection (a), by inserting after <quote>assessment of penalty</quote> the following: <quote>(unless such failure results from mistake, inadvertence, surprise, or excusable neglect)</quote>; and</text></paragraph> 
<paragraph id="HE698FAE6BED94B5CA38113B1EAAA949B"><enum>(2)</enum><text display-inline="yes-display-inline">in the second sentence of subsection (b), by inserting after <quote>assessment of penalty</quote> the following: <quote>(unless such failure results from mistake, inadvertence, surprise, or excusable neglect)</quote>.</text></paragraph></section> 
<section id="HB17FEBBFCEE944A590F7A600B4B81FAC"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to a citation or proposed assessment of penalty issued by the Occupational Safety and Health Administration that is issued on or after the date of the enactment of this Act.</text></section>
