<official-title>To protect the civil rights of victims of gender-motivated violence and to promote public safety, health, and regulate activities affecting interstate commerce by creating employer liability for negligent conduct that results in an individual’s committing a gender-motivated crime of violence against another individual on premises controlled by the employer, and for other purposes.</official-title>

<section section-type="section-one" id="H3CF312EFDAB94CE5A5888525CC01777C" display-inline="no-display-inline"><enum>1.</enum><header>Negligently allowing gender-motivated violence</header><text display-inline="no-display-inline">An employer—</text> 
<paragraph id="H3E6EFCF612074A9E8C808945957000F1"><enum>(1)</enum><text>whose business is in or affects interstate or foreign commerce; and</text></paragraph> 
<paragraph id="HB06F39457A3F4669B6DD591A67DA955"><enum>(2)</enum><text>whose negligent conduct results in a person’s (including a person who acts under color of statute, ordinance, regulation, custom, or usage of any State) committing a crime of violence motivated by gender against another person on premises under the control of the employer;</text></paragraph><continuation-text continuation-text-level="section">shall be liable to the party injured, in an action for the recovery of compensatory and punitive damages, injunctive and declaratory relief, and such other relief as a court may deem appropriate.</continuation-text></section> 
<section id="H4C442B01EAF54BE3BF011793718BFAD9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text> 
<paragraph id="H818F0E64E4E34C42AF5D5BE7B7F3E59F"><enum>(1)</enum><text>the term <term>crime of violence motivated by gender</term> means a crime of violence committed because of gender or on the basis of gender; and</text></paragraph> 
<paragraph id="H4050BF00DE5C4956A4AE9F6BFFEE195D"><enum>(2)</enum><text>the term <term>crime of violence</term>—</text> 
<subparagraph id="H4CA9CBC9DB3B4ED4AA24DBB47DD9678E"><enum>(A)</enum><text>means an act or series of acts that would constitute a crime, for which imprisonment of more than one year may be imposed, against the person of another if that crime is a crime of violence as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/16">section 16</external-xref> of title 18, United States Code; and</text></subparagraph> 
<subparagraph id="H2632454982E845ECAF33CA372D234257"><enum>(B)</enum><text>includes any conduct that would constitute a crime described in subparagraph (A) but for the relationship between the person engaging in that conduct and the individual against whom such conduct is directed.</text></subparagraph></paragraph></section> 
<section id="H5605952D4C9E423A807B2408D1DFAC74"><enum>3.</enum><header>Limitation and procedure</header> 
<subsection id="H32DA3D539AE94BA88E714040E6438191"><enum>(a)</enum><header>Limitation</header><text>Nothing in this Act entitles a person to a cause of action under section 1 for random acts of violence unrelated to gender or for acts that cannot be demonstrated, by a preponderance of the evidence, to be motivated by gender.</text></subsection> 
<subsection id="H02F9895315AE42E58FD16224FFF7413C"><enum>(b)</enum><header>No prior criminal action</header><text>Nothing in this section requires a prior criminal complaint, prosecution, or conviction to establish the elements of a cause of action under section 1.</text></subsection> 
<subsection id="HEB3D640272084294835B71B87C7BC66B"><enum>(c)</enum><header>Concurrent jurisdiction</header><text>The Federal and State courts shall have concurrent jurisdiction over actions brought pursuant to this Act.</text></subsection></section> 
<section id="HDFD39B911E5E4DD4AB5C95951F73359C"><enum>4.</enum><header>Materials to assist employers</header><text display-inline="no-display-inline">The Equal Employment Opportunity Commission shall create and provide materials to employers regarding personnel policies and safety standards to assist employers in avoiding liability under this Act.</text></section>
