<section id="H084D4548A5D145AE8C5F17194823D2B3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HB733E45D425C4757B758905810677146"><enum>(1)</enum><text>A vibrant and growing small business sector is critical to creating jobs in a dynamic economy.</text></paragraph> 
<paragraph id="H2A718000FC3F4C7FB4186BF1B93DE8C2"><enum>(2)</enum><text>Regulations designed for application to large-scale entities have been applied uniformly to small businesses and other small entities even though the problems sought to be solved by such regulations are not usually caused by these small businesses and other small entities.</text></paragraph> 
<paragraph id="H2982E9E7A79E439FA269C04D173B1CD2"><enum>(3)</enum><text>Uniform Federal regulatory and reporting requirements in many instances have imposed on small businesses and other small entities unnecessary and disproportionately burdensome demands, including legal, accounting, and consulting costs.</text></paragraph> 
<paragraph id="HCCF18CB55E7B4A73AF4657ADB0ED8E75"><enum>(4)</enum><text>Since 1980, Federal agencies have been required to recognize and take account of the differences in the scale and resources of regulated entities but have failed to do so.</text></paragraph> 
<paragraph id="HECC8AA37166946DA8700784F096800A8"><enum>(5)</enum><text>Alternative regulatory approaches that do not conflict with the stated objectives of the statutes the regulations seek to implement may be available and may minimize the significant economic impact of regulations on small businesses and other small entities.</text></paragraph> 
<paragraph id="HEF513329E4474E45BE9B967206B40076"><enum>(6)</enum><text>Federal agencies have failed to analyze and uncover less costly alternative regulatory approaches, despite the fact that the <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code (commonly known as the Regulatory Flexibility Act), requires them to do so.</text></paragraph> 
<paragraph id="H5B6249DAD119480B992B2F8B04AB3B3F"><enum>(7)</enum><text>Federal agencies continue to interpret <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code, in a manner that permits them to avoid their analytical responsibilities.</text></paragraph> 
<paragraph id="H730E0B25EFE7403BA2F51D9C21CED6B1"><enum>(8)</enum><text>The existing oversight of the compliance of Federal agencies with the analytical requirements to assess regulatory impacts on small businesses and other small entities and obtain input from the Chief Counsel for Advocacy has not sufficiently modified the Federal agency regulatory culture.</text></paragraph> 
<paragraph id="HDC50F62602EC45F1A265E23C4CDDEC00"><enum>(9)</enum><text>Significant changes are needed in the methods by which Federal agencies develop and analyze regulations, receive input from affected entities, and develop regulatory alternatives that will lessen the burden or maximize the benefits of final rules to small businesses and other small entities.</text></paragraph> 
<paragraph id="HE49F9BD565B24E45BE08089047327C1F"><enum>(10)</enum><text>It is the intention of the Congress to amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">chapter 6</external-xref> of title 5, United States Code, to ensure that all impacts, including foreseeable indirect effects, of proposed and final rules are considered by agencies during the rulemaking process and that the agencies assess a full range of alternatives that will limit adverse economic consequences or enhance economic benefits.</text></paragraph> 
<paragraph id="H0F593B5E3D0C4B1FB699514000FA71AC"><enum>(11)</enum><text>Federal agencies should be capable of assessing the impact of proposed and final rules without delaying the regulatory process or impinging on the ability of Federal agencies to fulfill their statutory mandates.</text></paragraph></section> 
<section id="HB7FF813E82924A18A6BFEB9B28269CF5"><enum>3.</enum><header>Clarification and expansion of rules covered by the Regulatory Flexibility Act</header> 
<subsection id="HB7BFD730ECC24B6900DAD4D62F7E8BEA"><enum>(a)</enum><header>In general</header><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/5/601">section 601</external-xref> of title 5, United States Code, is amended to read as follows:</text> 
<quoted-block id="HC3677277E76C473A86FDC775D6B5EF0"> 
<paragraph id="H332CABF3A83E4358AC1F837173ED1A7"><enum>(2)</enum><header>Rule</header><text>The term <term>rule</term> has the meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/5/551">section 551(4)</external-xref> of this title, except that—</text> 
<subparagraph id="HF3E9C12BB5C24AB8B14F876F97047585"><enum>(A)</enum><text>such term includes any rule of general applicability governing grants to State and local governments for which the agency provides an opportunity for notice and comment; and</text></subparagraph> 
<subparagraph id="HE44C33A5865648C89509591B7BEC7F89"><enum>(B)</enum><text>such term does not include a rule of particular (and not general) applicability relating to rates, wages, corporate or financial structures or reorganizations thereof, prices, facilities, appliances, services, or allowances therefor or to valuations, costs or accounting, or practices relating to such rates, wages, structures, prices, appliances, services, or allowances.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA77FB0C87ED2400AA4A8D9F8B7855B9B"><enum>(b)</enum><header>Inclusion of rules with indirect effects</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/601">Section 601</external-xref> of title 5, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H3BCB805C89144D55B2F8729FF6C615E"><enum>(9)</enum><header>Economic impact</header><text>The term <term>economic impact</term> means, with respect to a proposed or final rule—</text> 
<subparagraph id="HB936FF32267A4DE7A0896D3C311B8C3B"><enum>(A)</enum><text>any direct economic effect on small entities of such rule; and</text></subparagraph> 
<subparagraph id="H0B50D91AE20D4CEFAD77D5DCBB99A852"><enum>(B)</enum><text>any indirect economic effect on small entities which is reasonably foreseeable and results from such rule (without regard to whether small entities will be directly regulated by the rule).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H40A0A3E32F0F4D8D86EAD5496B7D1912"><enum>(c)</enum><header>Inclusion of rules with beneficial effects</header> 
<paragraph id="H726CD2E2DE234348963375D1903D6CF2"><enum>(1)</enum><header>Initial regulatory flexibility analysis</header><text>Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/5/603">section 603</external-xref> of title 5, United States Code, is amended by striking the first sentence and inserting <quote>Each initial regulatory flexibility analysis shall also contain a detailed description of alternatives to the proposed rule which minimize any significant adverse economic impact or maximize any significant beneficial economic impact on small entities.</quote>.</text></paragraph> 
<paragraph id="H20C9A325F9A54920A8C363CBD858A643"><enum>(2)</enum><header>Final regulatory flexibility analysis</header><text>Paragraph (5) of <external-xref legal-doc="usc" parsable-cite="usc/5/604">section 604(a)</external-xref> of title 5, United States Code, is amended by striking <quote>minimize the significant economic impact</quote> and inserting <quote>minimize the significant adverse economic impact or maximize the significant beneficial economic impact</quote>.</text></paragraph></subsection> 
<subsection id="HCF187DE7CAE2418AB7E66B3C42593880"><enum>(d)</enum><header>Inclusion of rules affecting tribal organizations</header><text>Paragraph (5) of <external-xref legal-doc="usc" parsable-cite="usc/5/601">section 601</external-xref> of title 5, United States Code, is amended by inserting <quote>and tribal organizations (as defined in section 4(l) of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b(l)</external-xref>)),</quote> after <quote>special districts,</quote>.</text></subsection> 
<subsection id="HCA74A8EC2E854200B2D3E0885C79A301"><enum>(e)</enum><header>Inclusion of land management plans and formal rulemaking</header> 
<paragraph id="H90213F5820EF460EB3DD1D82069645A7"><enum>(1)</enum><header>Initial regulatory flexibility analysis</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/5/603">section 603</external-xref> of title 5, United States Code, is amended in the first sentence—</text> 
<subparagraph id="H36F06966D50D40788E1E6BAAFAC9A7E0"><enum>(A)</enum><text>by striking <quote>or</quote> after <quote>proposed rule,</quote>; and</text></subparagraph> 
<subparagraph id="HD3955608278244C6A5617BB941A25867"><enum>(B)</enum><text>by inserting <quote>publishes a revision or amendment to a land management plan, or issues a proposed rule made on the record after opportunity for an agency hearing,</quote> after <quote>United States,</quote>.</text></subparagraph></paragraph>

<subparagraph id="H3A1E6F9348EA437091B21FABF2467045"><enum>(A)</enum><text>by striking <quote>or</quote> after <quote>proposed rulemaking,</quote>; and</text></subparagraph> 
<subparagraph id="HE3FAAC8219734D45B452F2F4C605CB50"><enum>(B)</enum><text>by inserting <quote>, adopts a revision or amendment to a land management plan, or issues a final rule made on the record after opportunity for an agency hearing,</quote> after <quote>section 603(a),</quote>.</text></subparagraph></paragraph> 
<paragraph id="H47B3DF35D8664093A8BEC14577CAF0F2"><enum>(3)</enum><header>Land management plan defined</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/601">Section 601</external-xref> of title 5, United States Code (as amended by subsection (b)), is further amended by adding at the end the following new paragraph:</text>

<subparagraph id="HD50DC06B5543406FBC8100564800A69B"><enum>(A)</enum><header>In general</header><text>The term <term>land management plan</term> means—</text> 
<clause id="HBB4690AC04FE41759F01FD025AB30A0"><enum>(i)</enum><text>any plan developed by the Secretary of Agriculture under section 6 of the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604</external-xref>); and</text></clause> 
<clause id="HE06278A4E5C64DD19DB18D39A67D98F6"><enum>(ii)</enum><text>any plan developed by the Secretary of Interior under section 202 of the <act-name parsable-cite="FLPMA">Federal Land Policy and Management Act of 1976</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>).</text></clause></subparagraph> 
<subparagraph id="H6FF564289578475C8E89B8D96E66A64B"><enum>(B)</enum><header>Revision</header><text>The term <term>revision</term> means any change to a land management plan which—</text> 
<clause id="HBE4844C030454026BC8CA0DED6BFD4F"><enum>(i)</enum><text>in the case of a plan described in subparagraph (A)(i), is made under section 6(f)(5) of the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604(f)(5)</external-xref>); or</text></clause> 
<clause id="H87A3E0CC08F54D408C45D072C6C27D01"><enum>(ii)</enum><text>in the case of a plan described in subparagraph (A)(ii), is made under <external-xref legal-doc="regulation" parsable-cite="cfr/43/1610.5">section 1610.5–6</external-xref> of title 43, Code of Federal Regulations (or any successor regulation).</text></clause></subparagraph> 
<subparagraph id="H03E4EE0CE1554BAEBA06DCE282195141"><enum>(C)</enum><header>Amendment</header><text>The term <term>amendment</term> means any change to a land management plan which—</text> 
<clause id="HEB8B4CCC02734221B2B029900797007D"><enum>(i)</enum><text>in the case of a plan described in subparagraph (A)(i), is made under section 6(f)(4) of the <act-name parsable-cite="FRRRP">Forest and Rangeland Renewable Resources Planning Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604(f)(4)</external-xref>) and with respect to which the Secretary of Agriculture prepares a statement described in section 102(2)(C) of the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>); or</text></clause> 
<clause id="H3C1D5112D6DF45B29E54CC352D8D54F"><enum>(ii)</enum><text>in the case of a plan described in subparagraph (A)(ii), is made under <external-xref legal-doc="regulation" parsable-cite="cfr/43/1610.5">section 1610.5–5</external-xref> of title 43, Code of Federal Regulations (or any successor regulation) and with respect to which the Secretary of the Interior prepares a statement described in section 102(2)(C) of the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<paragraph id="HEA25EA7D950E4DA900484C1250A36915"><enum>(1)</enum><header>In general</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/5/603">section 603</external-xref> of title 5, United States Code, is amended by striking the period at the end and inserting <quote>or a recordkeeping requirement, and without regard to whether such requirement is imposed by statute or regulation.</quote>.</text></paragraph>

<paragraph id="HDE48D0EFD3C4491800C81EFB19F382FB"><enum>(4)</enum><header>Small organization</header> 
<subparagraph id="H4146E133A3D24AE4AC1EDE40E782BE5"><enum>(A)</enum><header>In general</header><text>The term <term>small organization</term> means any not-for-profit enterprise which, as of the issuance of the notice of proposed rulemaking—</text> 
<clause id="H515347EB0C1C4E7E83B16C380967C5E3"><enum>(i)</enum><text>in the case of an enterprise which is described by a classification code of the North American Industrial Classification System, does not exceed the size standard established by the Administrator of the Small Business Administration pursuant to section 3 of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>) for small business concerns described by such classification code, and</text></clause> 
<clause id="HA04D74CB84D845D6AEC8810086322351"><enum>(ii)</enum><text>in the case of any other enterprise, has a net worth that does not exceed $7,000,000 and has not more than 500 employees.</text></clause></subparagraph> 
<subparagraph id="H64363FF9A5334B31B53470A6CAE8597"><enum>(B)</enum><header>Local labor organizations</header><text>In the case of any local labor organization, subparagraph (A) shall be applied without regard to any national or international organization of which such local labor organization is a part.</text></subparagraph> 
<subparagraph id="H5718F56B9BA34400992DBA76CF9C44F5"><enum>(C)</enum><header>Professional and trade associations</header><text>In the case of any professional or trade association, subparagraph (A) shall be applied without regard to the net worth or number of employees of any member of such association.</text></subparagraph> 
<subparagraph id="HA490D639D16449C48BCDCB9632ED0065"><enum>(D)</enum><header>Agency definitions</header><text>Subparagraphs (A), (B), and (C) shall not apply to the extent that an agency establishes, after opportunity for public comment, one or more definitions for such term which are appropriate to the activities of the agency and publishes such definition(s) in the Federal Register.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H34B30D163ABA4D8CB497EBE3007BC59D"><enum>(a)</enum><header>Initial regulatory flexibility analysis</header><text>Subsection (b) of <external-xref legal-doc="usc" parsable-cite="usc/5/603">section 603</external-xref> of title 5, United States Code, is amended to read as follows:</text>

<paragraph id="H34AEB1837FF0420982B782DBE207AD9"><enum>(5)</enum><text>describing all relevant Federal rules which may duplicate, overlap, or conflict with the proposed rule, or the reasons why such a description could not be provided; and</text></paragraph>

<subparagraph indent="up1" id="HD78BA7C6EE4947D0A0FFF820CBF55972"><enum>(A)</enum><text>all materials prepared or utilized by the agency in making the proposed rule, including the draft of the proposed rule; and</text></subparagraph> 
<subparagraph indent="up1" id="HCDD2ABFA1A1449118BC303577DC0F8E"><enum>(B)</enum><text>information on the potential adverse and beneficial economic impacts of the proposed rule on small entities and the type of small entities that might be affected.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H8D55CE36F2C84B1BB250A2D3769D12F0"><enum>(2)</enum><text>An agency shall not be required under paragraph (1) to provide the exact language of any draft if the rule—</text> 
<subparagraph id="HFD9D44C13C0743788429AAAB442E8C1C"><enum>(A)</enum><text>relates to the internal revenue laws of the United States; or</text></subparagraph> 
<subparagraph id="HD874E9362640450290D700E17186D3D"><enum>(B)</enum><text>is proposed by an <quote>independent regulatory agency</quote>, as that term is defined in <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502(5)</external-xref> of title 44, United States Code. </text></subparagraph></paragraph></subsection> 
<subsection id="H6C957155180D4C6F9509A1DF62493952"><enum>(c)</enum><text>Not later than 15 days after the receipt of such information, the Chief Counsel for Advocacy shall—</text> 
<paragraph id="HA3B98CB467F646ECBB25A96F332BCA4D"><enum>(1)</enum><text>identify small entities or representatives of small entities or a combination of both for the purpose of obtaining advice, input, and recommendations from those persons about the potential economic impacts of the proposed rule and the compliance of the agency with section 603 or <external-xref legal-doc="usc" parsable-cite="usc/5/605">section 605(b)</external-xref> of this title; and</text></paragraph> 
<paragraph id="HC9C65C2D4C0B4ECD98F5151CF1250864"><enum>(2)</enum><text>convene a review panel consisting of an employee from the Office of Advocacy, an employee from the agency making the rule, and in the case of an agency other than an independent regulatory agency (as defined in <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502(5)</external-xref> of title 44, United States Code), an employee from the Office of Information and Regulatory Affairs of the Office of Management and Budget to review the information provided to the Chief Counsel under subsection (b).</text></paragraph></subsection> 
<subsection id="HA9FD6EED2C3D44C2B9F354ABF8E038F0"><enum>(d)</enum> 
<paragraph display-inline="yes-display-inline" id="HCDD33757FDD7423300361600003289E3"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than 60 days after the review panel described in subsection (c)(2) is convened, the Chief Counsel for Advocacy shall, after consultation with the members of such panel, submit a report to the agency and, in the case of an agency other than an independent regulatory agency (as defined in <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502(5)</external-xref> of title 44, United States Code), the Office of Information and Regulatory Affairs of the Office of Management and Budget.</text></paragraph> 
<paragraph indent="up1" id="HFA2B0D35BA85468DBEF04CBDAE1E7"><enum>(2)</enum><text>Such report shall include an assessment of the impact of the proposed rule on small entities and a discussion of any alternatives that will minimize adverse economic impacts or maximize beneficial economic impacts on small entities.</text></paragraph> 
<paragraph indent="up1" id="HF9516077620B4F6587C212A7BE231571"><enum>(3)</enum><text>Such report shall become part of the rulemaking record. In the publication of the proposed rule, the agency shall explain what actions, if any, the agency took in response to such report.</text></paragraph></subsection> 
<subsection id="HC770720DABE44564BF99F2E3BE811EA9"><enum>(e)</enum><text>A proposed rule is described by this subsection if the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget, the head of the agency (or the delegatee of the head of the agency), or an independent regulatory agency determines that the proposed rule is likely to result in—</text> 
<paragraph id="H184D322022F740C1A509FEEDB2339F83"><enum>(1)</enum><text>an annual effect on the economy of $100,000,000 or more;</text></paragraph> 
<paragraph id="H2C7F839BED704313B6F8DBC1B7DA0018"><enum>(2)</enum><text>a major increase in costs or prices for consumers, individual industries, Federal, State, or local governments, tribal organizations, or geographic regions;</text></paragraph> 
<paragraph id="H339BADF2D1EF4FA18C9EE66353AF9F44"><enum>(3)</enum><text>significant adverse effects on competition, employment, investment, productivity, innovation, or on the ability of United States-based enterprises to compete with foreign-based enterprises in domestic and export markets; or</text></paragraph> 
<paragraph id="H2B02F9800CA340B6B3A392002079A415"><enum>(4)</enum><text>a significant economic impact on a substantial number of small entities.</text></paragraph></subsection> 
<subsection id="H928A79B92F3E4B009231B09EF16801A0"><enum>(f)</enum><text>Upon application by the agency, the Chief Counsel for Advocacy may waive the requirements of subsections (b) through (e) if the Chief Counsel determines that compliance with the requirements of such subsections are impracticable, unnecessary, or contrary to the public interest.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H014FB587D52846598819B7946BBB3918"><enum>7.</enum><header>Periodic review of rules</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/5/610">Section 610</external-xref> of title 5, United States Code, is amended to read as follows:</text>

<section id="H7D0991D6D6F4428DACD5D7C7C1032718"><enum>610.</enum><header>Periodic review of rules</header> 
<subsection id="H8990835752564830876D520398FEC871"><enum>(a)</enum><text>Not later than 180 days after the enactment of the Regulatory Flexibility Improvements Act, each agency shall publish in the Federal Register and place on its website a plan for the periodic review of rules issued by the agency which the head of the agency determines has a significant economic impact on a substantial number of small entities. Such determination shall be made without regard to whether the agency performed an analysis under section 604. The purpose of the review shall be to determine whether such rules should be continued without change, or should be amended or rescinded, consistent with the stated objectives of applicable statutes, to minimize any significant adverse economic impacts or maximize any significant beneficial economic impacts on a substantial number of small entities. Such plan may be amended by the agency at any time by publishing the revision in the Federal Register and subsequently placing the amended plan on the agency’s website.</text></subsection> 
<subsection id="H69058823A8774EB88C03001BCCC66FFC"><enum>(b)</enum><text>The plan shall provide for the review of all such agency rules existing on the date of the enactment of the Regulatory Flexibility Improvements Act within 10 years of the date of publication of the plan in the Federal Register and for review of rules adopted after the date of enactment of the Regulatory Flexibility Improvements Act within 10 years after the publication of the final rule in the Federal Register. If the head of the agency determines that completion of the review of existing rules is not feasible by the established date, the head of the agency shall so certify in a statement published in the Federal Register and may extend the review for not longer than 2 years after publication of notice of extension in the Federal Register. Such certification and notice shall be sent to the Chief Counsel for Advocacy and the Congress.</text></subsection> 
<subsection id="HBC0FC8ABF03A41B29DDC7929BC6C993B"><enum>(c)</enum><text>Each agency shall annually submit a report regarding the results of its review pursuant to such plan to the Congress and, in the case of agencies other than independent regulatory agencies (as defined in <external-xref legal-doc="usc" parsable-cite="usc/44/3502">section 3502(5)</external-xref> of title 44, United States Code) to the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget. Such report shall include the identification of any rule with respect to which the head of the agency made a determination described in paragraph (5) or (6) of subsection (d) and a detailed explanation of the reasons for such determination.</text></subsection> 
<subsection id="HC182F4F71CB84788812507E4D86EFBFF"><enum>(d)</enum><text>In reviewing rules under such plan, the agency shall consider the following factors:</text> 
<paragraph id="HB6F3B60183224982AFF6C04C86CB3CB1"><enum>(1)</enum><text>The continued need for the rule.</text></paragraph> 
<paragraph id="H9B7E14F17FA54F96A492924D8B8CDFDC"><enum>(2)</enum><text>The nature of complaints received by the agency from small entities concerning the rule.</text></paragraph> 
<paragraph id="HE6AB653F2A0D425D9970D4CA52183534"><enum>(3)</enum><text>Comments by the Regulatory Enforcement Ombudsman and the Chief Counsel for Advocacy.</text></paragraph> 
<paragraph id="H5C0767767E454432A219C6C8B2DBA8A8"><enum>(4)</enum><text>The complexity of the rule.</text></paragraph> 
<paragraph id="H45520D58341741509E514F68CC851821"><enum>(5)</enum><text>The extent to which the rule overlaps, duplicates, or conflicts with other Federal rules and, unless the head of the agency determines it to be infeasible, State and local rules.</text></paragraph> 
<paragraph id="H431650593252408F82CCCF8F6C00D800"><enum>(6)</enum><text>The contribution of the rule to the cumulative economic impact of all Federal rules on the class of small entities affected by the rule, unless the head of the agency determines that such calculations cannot be made and reports that determination in the annual report required under subsection (c).</text></paragraph> 
<paragraph id="HA872E3BE20C54A2C9BF94E4F2905E4E1"><enum>(7)</enum><text>The length of time since the rule has been evaluated or the degree to which technology, economic conditions, or other factors have changed in the area affected by the rule.</text></paragraph></subsection> 
<subsection id="H298F34864CA84B979FB7C826D9EEFCB"><enum>(e)</enum><text>The agency shall publish in the Federal Register and on its website a list of rules to be reviewed pursuant to such plan. Such publication shall include a brief description of the rule, the reason why the agency determined that it has a significant economic impact on a substantial number of small entities (without regard to whether it had prepared a final regulatory flexibility analysis for the rule), and request comments from the public, the Chief Counsel for Advocacy, and the Regulatory Enforcement Ombudsman concerning the enforcement of the rule.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HAC24512A157542CAB14D009FDEEE5D8F"><enum>8.</enum><header>Judicial review of compliance with the requirements of the Regulatory Flexibility Act available after publication of the final rule</header>

<subsection id="H1CB6BEA8BCE24FDBB1E303D113A43742"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/6">Chapter 6</external-xref> of title 5, United States Code, is amended by adding at the end the following new section:</text>

<subsection id="H39A014EEAF3943D9B7855B225498142C"><enum>(a)</enum> 
<paragraph display-inline="yes-display-inline" id="H1BB8053BBA7D4112A62B6C9F1FD9AE88"><enum>(1)</enum><text>Not later than 270 days after the date of the enactment of the Regulatory Flexibility Improvements Act, the Chief Counsel for Advocacy shall, after opportunity for notice and comment under section 553, issue rules governing agency compliance with this chapter. The Chief Counsel may modify or amend such rules after notice and comment under section 553. This chapter (other than this subsection and section 614) shall not apply with respect to the issuance, modification, and amendment of rules under this paragraph.</text></paragraph> 
<paragraph indent="up1" id="HC53A82E9D115475C83778B083F6FE105"><enum>(2)</enum><text>An agency shall not issue rules which supplement the rules issued under subsection (a) unless such agency has first consulted with the Chief Counsel for Advocacy to ensure that such supplemental rules comply with this chapter and the rules issued under paragraph (1).</text></paragraph></subsection> 
<subsection id="HA7A0F3F78CCC461888258FB82E24497"><enum>(b)</enum><text>Notwithstanding any other law, the Chief Counsel for Advocacy may intervene in any adjudication before any Federal agency (unless such agency is authorized to impose a fine or penalty under such adjudication), and may inform the agency of the impact that any decision on the record may have on small entities. The Chief Counsel shall not initiate an appeal with respect to any adjudication in which the Chief Counsel intervenes under this subsection.</text></subsection> 
<subsection id="H67658AFE5898410E9E00C3DE10AFAC7D"><enum>(c)</enum><text>The Chief Counsel for Advocacy may file comments in response to any agency notice requesting comment, regardless of whether the agency is required to file a general notice of proposed rulemaking under section 553.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
