<official-title>To amend the Mineral Leasing Act to authorize the Secretary of the Interior to issue separately, for the same area, a lease for tar sand and a lease for oil and gas, and for other purposes.</official-title>

<section id="HA79C25C2DC53437CB30147C831346E41" section-type="section-one"><enum>1.</enum><header>Combined hydrocarbon leasing</header>
<subsection id="H6A716AE9D94848A6BD1270E08F570069"><enum>(a)</enum><header>Special provisions regarding leasing</header><text>Section 17(b)(2) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(b)(2)</external-xref>) is amended—</text>
<paragraph id="HFDE1CBA3A7E14304886D004FC8001313"><enum>(1)</enum><text>by inserting <quote>(A)</quote> after <quote>(2)</quote>; and</text></paragraph>
<paragraph id="H47CCEBAB403343F0AFE420D3EC53D0BA"><enum>(2)</enum><text>by adding at the end the following:</text>
<quoted-block id="H60DA42D2C3764B6AA22211CB68B761F9" style="OLC">
<subparagraph id="H2207B9CB2AB24677AB54B773AA421F34"><enum>(B)</enum><text>The Secretary may issue under this Act for the same area, separately—</text>
<clause id="H9BEFAD0C07E44B9CAD23945053801371"><enum>(i)</enum><text>a lease for exploration for and extraction of tar sand; and</text></clause>
<clause id="H30462C089E6540B19F6779D24F395469"><enum>(ii)</enum><text>a lease for exploration for and development of oil and gas.</text></clause></subparagraph>
<subparagraph id="H440A1C113B334006AF3DB6AF46ED9602"><enum>(C)</enum><text>A lease issued under subparagraph (B)(ii) shall not be further subject to the Combined Hydrocarbon Leasing Act of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>).</text></subparagraph>
<subparagraph id="H43F23AFE3CCE4C89B8BF11346678FFC8"><enum>(D)</enum><text>A lease issued for tar sand shall be issued using the same bidding process, annual rental, and posting period as a lease issued for oil and gas, except that the minimum acceptable bid required for a lease issued for tar sand shall be $2 per acre.</text></subparagraph>
<subparagraph id="H50730DD07B6D43B989F443A5C0004300"><enum>(E)</enum><text>The Secretary may waive, suspend, or alter any requirement under section 26 that a permittee under a permit authorizing prospecting for tar sand must exercise due diligence, to promote any resource covered by a combined hydrocarbon lease.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HAE243DDF10D54B64A3C754F865CFE11F"><enum>(b)</enum><header>Conforming amendment</header><text>Section 17(b)(1)(B) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/226">30 U.S.C. 226(b)(1)(B)</external-xref>) is amended in the second sentence by inserting <quote>, subject to paragraph (2)(B),</quote> after <quote>the Secretary</quote>.</text></subsection>
<subsection id="H780164BE4E3449E2B67816E5FAD92B46"><enum>(c)</enum><header>Regulations</header><text>Within 45 days after the date of the enactment of this Act, the Secretary of the Interior shall issue final regulations to implement this section.</text></subsection></section>
