<official-title>To amend the Uniform Code of Military Justice to bring sexual assault crimes under military law into parallel with sexual assault crimes under Federal law, and for other purposes.</official-title>

<section section-type="section-one" id="H12B1ABF000984A4B8DC6B8A219CB42D" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Sexual Assault Crimes Revision Act of 2005</short-title></quote>.</text></section> 
<section id="HAC2DFC3F47554A6D82328B27EAE34153"><enum>2.</enum><header>Military sexual abuse</header> 
<subsection id="HC497C8330E7649839BA9B3E09E4DE75C"><enum>(a)</enum><header>Sexual abuse</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/920">Section 920</external-xref> of title 10, United States Code (article 120 of the Uniform Code of Military Justice), is amended to read as follows:</text> 
<quoted-block style="USC" id="H791D5C58F0B3491AB8CD008912C492BB"> 
<section id="HD886C0F76833436E8DEB00B5DAA003D"><enum>920.</enum><header>Art. 120. Sexual abuse</header> 
<subsection id="HFDC35236D4174EBAB21557A447201598"><enum>(a)</enum><text>Any person subject to this chapter who knowingly—</text> 
<paragraph id="H2E4C4EB2C27142FE898E5E793D939C44"><enum>(1)</enum><text>causes another person to engage in a sexual act by using force against that other person;</text></paragraph> 
<paragraph id="H665E44560D444D2EBA62B2242F33FA82"><enum>(2)</enum><text>causes another person to engage in a sexual act by threatening or placing that other person in fear that any person will be subjected to death, grievous bodily harm, or kidnapping;</text></paragraph> 
<paragraph id="H56FBA4D542754F4FA178754EC26CCA00"><enum>(3)</enum><text>renders another person unconscious and thereby engages in a sexual act with that other person; or</text></paragraph> 
<paragraph id="HA4170917337E44F986BC291FEBB28FDE"><enum>(4)</enum><text>administers to another person by force or threat of force, or without the knowledge or permission of that other person, a drug, intoxicant, or other similar substance and thereby—</text> 
<subparagraph id="H94E7D997443E4BC9AC25EB445CE577EF"><enum>(A)</enum><text>substantially impairs the ability of that other person to appraise or control conduct; and</text></subparagraph> 
<subparagraph id="H5811D356D9304176BB8DE1660663816F"><enum>(B)</enum><text>engages in a sexual act with that other person;</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">is guilty of aggravated sexual abuse and shall be punished as a court-martial may direct.</continuation-text></subsection> 
<subsection id="HE9B2166AD47D4F8CA19E005BD6479484"><enum>(b)</enum><text>Any person subject to this chapter who knowingly engages in a sexual act with another person who has not attained the age of twelve years is guilty of aggravated sexual abuse of a child and shall be punished as a court-martial may direct. In a prosecution under this subsection, it need not be proven that the accused knew that the other person engaging in the sexual act had not attained the age of twelve years.</text></subsection> 
<subsection id="H0D974769BC58483D977DAB03CA9BABC6"><enum>(c)</enum><text>Any person subject to this chapter who knowingly—</text> 
<paragraph id="H64A36464683545E9BC9E2D8FBCBF3C7D"><enum>(1)</enum><text>causes another person to engage in a sexual act by threatening or placing that other person in fear (other than by threatening or placing that other person in fear that any person will be subjected to death, grievous bodily harm, or kidnapping); or</text></paragraph> 
<paragraph id="H03BA2C027A50452E8B00B0CC73F65C57"><enum>(2)</enum><text>engages in a sexual act with another person if that other person is—</text> 
<subparagraph id="HE8ECCAD36E314E37BB5861BB71934228"><enum>(A)</enum><text>incapable of appraising the nature of the conduct; or</text></subparagraph> 
<subparagraph id="H05319C75F9A842FBA537089E12138D9F"><enum>(B)</enum><text>physically incapable of declining participation in, or communicating unwillingness to engage in, that sexual act;</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">is guilty of sexual abuse and shall be punished as a court-martial may direct.</continuation-text></subsection> 
<subsection id="H497D08BDA6DB427DA177915B82E543A2"><enum>(d)</enum> 
<paragraph id="H1D15FBF469364B2D8DEA0021214384C" display-inline="yes-display-inline"><enum>(1)</enum><text>Any person subject to this chapter who knowingly engages in a sexual act with another person who—</text> </paragraph> 
<paragraph id="HEA3958EB986B48B6A076B765F6600040"><enum>(A)</enum><text>has attained the age of twelve years but has not attained the age of sixteen years; and</text> 
<subparagraph indent="up1" id="H3504859A084941A89494988B442ED689"><enum>(B)</enum><text>is not that person’s spouse;</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">is guilty of sexual abuse of a minor and shall be punished as a court-martial may direct.</continuation-text> 
<paragraph indent="up1" id="H92233E57379343EEBF00DD00AADCEAFC"><enum>(2)</enum><text>In a prosecution under this subsection, it need not be proven that the accused knew the age of the other person engaging in the sexual act.</text></paragraph> 
<paragraph indent="up1" id="HE5F33B32182B43748DED0988FA847271"><enum>(3)</enum><text>In a prosecution under this subsection, it is an affirmative defense that the accused reasonably believed that the other person had attained the age of sixteen years. The accused has the burden of proving a defense under this paragraph by a preponderance of the evidence.</text></paragraph></subsection> 
<subsection id="H14F75D7DEDB542F8807EAC92AE005209"><enum>(e)</enum><text>Any person subject to this chapter who knowingly engages in a sexual act with another person who is—</text> 
<paragraph id="H43D3C27C2C304995B6EC6DB9E14EAA36"><enum>(1)</enum><text>in official detention or confinement;</text></paragraph> 
<paragraph id="HA1957403A362444297975286CC907F65"><enum>(2)</enum><text>under the custodial, supervisory, or disciplinary authority of the person so engaging; and</text></paragraph> 
<paragraph id="H74F24EF642DD4F82BC7EFE02FC285531"><enum>(3)</enum><text>is not that person’s spouse;</text></paragraph><continuation-text continuation-text-level="subsection">is guilty of sexual abuse of a prisoner and shall be punished as a court-martial may direct.</continuation-text></subsection> 
<subsection id="HC0FB3A705D254B35AB40954EC4A63503"><enum>(f)</enum><text>In this section, the term <term>sexual act</term> means—</text> 
<paragraph id="H639FF30C3946439CB54EA20502C95C9B"><enum>(1)</enum><text>contact between the penis and the vulva or the penis and the anus, and for purposes of this subparagraph contact involving the penis occurs upon penetration, however slight;</text></paragraph> 
<paragraph id="H652D16C7C92D4655A749F1D1F2668202"><enum>(2)</enum><text>contact between the mouth and the penis, the mouth and the vulva, or the mouth and the anus;</text></paragraph> 
<paragraph id="H7FCD4210DF85485B9C66E9550260799"><enum>(3)</enum><text>the penetration, however slight, of the anal or genital opening of another by a hand or finger or by any object, with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person; or</text></paragraph> 
<paragraph id="HF567334FCD2644F29F529FEA08428CD8"><enum>(4)</enum><text>the intentional touching, not through the clothing, of the genitalia of another person who has not attained the age of sixteen years with an intent to abuse, humiliate, harass, degrade, or arouse or gratify the sexual desire of any person.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDA1DA5F397EE4C5DA2003F2D05C63BE7"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph display-inline="yes-display-inline" id="H40A3AB2F2A564442AF99CC5CC0FFAD31"><enum>(1)</enum><text>Paragraph (4) of <external-xref legal-doc="usc" parsable-cite="usc/10/918">section 918</external-xref> of title 10, United States Code (article 118 of the Uniform Code of Military Justice), is amended by striking <quote>rape,</quote> and inserting <quote>aggravated sexual abuse, aggravated sexual abuse of a child,</quote>.</text></paragraph> 
<paragraph indent="up1" id="HBD5DA9B4A9E644798D59E4CF98048033"><enum>(2)</enum><text>Subsection (b)(2)(B)(i) of <external-xref legal-doc="usc" parsable-cite="usc/10/843">section 843</external-xref> of title 10, United States Code (article 43 of the Uniform Code of Military Justice), is amended by striking <quote>Rape or carnal knowledge</quote> and inserting <quote>Aggravated sexual abuse of a child or sexual abuse of a minor</quote>.</text></paragraph></subsection> 
<subsection id="H98B7B79C093C4402007CE57177C7D910"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10, United States Code, is amended by striking the item relating to section 920 and inserting the following new item:</text>

<toc-entry level="section">920. Art. 120. Sexual abuse</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3DDCEAA0BC6F40BB9100B119638980AA"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect 6 months after the date of the enactment of this Act and apply with respect to offenses committed after such effective date.</text></subsection> 
<subsection id="H02E5EE9D87BC4B9B9FA7DB24667B458B"><enum>(e)</enum><header>Interim maximum punishments</header><text>Until the President otherwise provides pursuant to <external-xref legal-doc="usc" parsable-cite="usc/10/856">section 856</external-xref> of title 10, United States Code (article 56 of the Uniform Code of Military Justice), the punishment which a court-martial may direct for an offense under section 920 of such title (article 120 of the Uniform Code of Military Justice), as amended by this section, may not exceed the following limits:</text> 
<paragraph id="H35FA0AC0E34B4C7489258B6F758100AB"><enum>(1)</enum><text>For aggravated sexual abuse or aggravated sexual abuse of a child, such punishment may not exceed dishonorable discharge, forfeiture of all pay and allowances, and confinement for life without eligibility for parole.</text></paragraph> 
<paragraph id="HD69831E62AE44A69BD7E63E478905C19"><enum>(2)</enum><text>For sexual abuse or sexual abuse of a minor, such punishment may not exceed dishonorable discharge, forfeiture of all pay and allowances, and confinement for twenty years.</text></paragraph> 
<paragraph id="H6AFE70A6A4E5440480C2FE966AF7500"><enum>(3)</enum><text>For sexual abuse of a prisoner, such punishment may not exceed bad-conduct discharge, forfeiture of all pay and allowances, and confinement for one year.</text></paragraph></subsection> 
<subsection id="HD4B8F20EC7F848E68BA600FCE1A33618"><enum>(f)</enum><header>No preemption</header><text>The prosecution or punishment of an accused for an offense under <external-xref legal-doc="usc" parsable-cite="usc/10/920">section 920</external-xref> of title 10, United States Code (article 120 of the Uniform Code of Military Justice), as amended by this section, does not preclude the prosecution or punishment of that accused for any other offense.</text></subsection></section>
