<official-title>To amend part D of title XVIII of the Social Security Act to condition the payment of employer prescription drug subsidies on the maintenance of current prescription drug benefits.</official-title>

<section id="H12DD5DC9093942CFB0B0AED16D00B26F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prescription Plan Preservation Act of 2005</short-title></quote>.</text></section> 
<section id="HCB86154883EE4D86916BD64109292505"><enum>2.</enum><header>Conditioning the payment of medicare employer prescription drug subsidies on the maintenance of current prescription drug benefits</header> 
<subsection id="HD02BC63973F14C0ABC83AE19A3A4B138"><enum>(a)</enum><header>In general</header><text>Section 1860D–22(a)(2)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-132">42 U.S.C. 1395w–132(a)(2)(A)</external-xref>) is amended to read as follows::</text>

<subparagraph id="H84FB9D98760A45B3A3EED048FAC5A8D"><enum>(A)</enum><header>Attestation of actuarial equivalence to standard coverage</header><text display-inline="yes-display-inline">The sponsor of the plan provides the Secretary, annually or at such other time as the Secretary may require, with an attestation that the actuarial value of prescription drug coverage under the plan (as determined using the processes and methods described in section 1860D–11(c)) is at least equal to the greater of—</text> 
<clause id="HD3DEC3CBF8964875ADA1153F834C7800"><enum>(i)</enum><text>the actuarial value of standard prescription drug coverage; or</text></clause> 
<clause id="H6F9A7F5F5E7D465A9D4DF1D93E8C1FB4"><enum>(ii)</enum><text>the actuarial value of the employment-based retiree health coverage that was in effect as of December 8, 2003.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDF91C051B6E24374AC58A21042E72E55"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text></subsection></section>
