<official-title>To amend title 18, United States Code, to provide a criminal penalty for journalists, who, without disclosure, accept Government payments to promote Government policies, and for other purposes.</official-title>

<section id="HBCE7AA73EDF7408480F519D039A1AEB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sunshine in Journalism Act of 2005</short-title></quote>.</text></section> 
<section id="HD0437D84BAB34BFFB861E7FF44B32B95"><enum>2.</enum><header>Purpose of legislation</header> 
<subsection id="H87C96E0C9AC8425483326C54C5F442F2"><enum>(a)</enum><header>Media reports</header><text>In January 2005, media reports revealed that some journalists received Federal payments from various Federal Government executive branch agencies to promote or comment upon certain government policies and legislation.</text></subsection> 
<subsection id="H37F9114B61A94414972F72A236910A9"><enum>(b)</enum><header>President’s order</header><text>Subsequently, the President of the United States ordered all cabinet agencies to cease making any such payments to journalists in the future.</text></subsection> 
<subsection id="HEE73C67D7EAB416EB8004F1196B71135"><enum>(c)</enum><header>Intent of Act</header><text display-inline="yes-display-inline">It is the intent of this Act is to—</text> 
<paragraph id="H2F11C733BD784B8A86946C003ED771E3"><enum>(1)</enum><text>require the prompt disclosure of all sums of dollars received from the Federal Government, by journalists, for the purpose of promoting, opposing, or commenting upon legislation, or administration policies; and</text></paragraph> 
<paragraph id="HF08A27C3FC774A0D9B8117ABE2FD590"><enum>(2)</enum><text>ensure that any journalist who fails to make the required disclosure will be deemed to be in violation of this law and be subject to prosecution for a Federal class C misdemeanor.</text></paragraph></subsection></section> 
<section id="HD2D2D5AF9D0D460A82D909BE860656E8"><enum>3.</enum><header>Disclosure requirement</header> 
<subsection id="H082B6D93F0DB4742A94080FD638777DF"><enum>(a)</enum><header>Journalist Disclosure</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/63">Chapter 63</external-xref> of title 18, United States Code is amended by inserting the following after section 1343:</text>

<section id="H9FBDD944C4B44511BBD1E54ED196FAE"><enum>1343a.</enum><header>Broadcast and print journalism disclosures; criminal penalties for failure to disclose agreements</header> 
<subsection id="H6C1AC76CF8D141DC9BCA72985F3EDFE5"><enum>(a)</enum><text>Any print journalist or broadcast journalist within the United States who accepts, or agrees to accept, any money, service, or other valuable consideration from any Federal Government agency for promoting, opposing, or commenting on legislation, policies, regulations, or laws, shall file a disclosure form with the Department of Justice within 30 days of any such acceptance or agreement, whichever is earlier.</text></subsection> 
<subsection id="H0186C521BE0B465BA32E9E00006127CC"><enum>(b)</enum><text>The term <quote> print journalist</quote> means a person employed by a newspaper, magazine, or other publication which is in one or more issues each year in interstate commerce, and in which a substantial portion of the content is devoted to the dissemination of news and editorial opinion.</text></subsection> 
<subsection id="HF571451A5F9E4DE2B1C3AE669C7FE070"><enum>(c)</enum><text>The term <quote>broadcast journalist</quote> means a person employed by a radio, television, or cable television network or channel which broadcasts or otherwise transmits news and editorial opinion.</text></subsection> 
<subsection id="HA5B1A18529B34375AFAF49E89E598D94"><enum>(d)</enum><text>Whoever violates subsection (a) by failing to make the required timely, disclosure shall be fined up to $5,000 or imprisoned for not more than 30 days, or both; any organization who violates subsection (a) shall be fined not more than $10,000.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2E5A405F306946F1B57566807DF50017"><enum>(b)</enum><header>Rules and regulations</header><text>The Attorney General shall, not later than 90 days after the date of the enactment of this Act, make all necessary rules and regulations to implement the disclosure requirement, including a disclosure form to be used by print and broadcast journalists who are subject to the requirement set forth in subsection (a) of the section 1343a, as added to title 18, United States Code, by this Act, and all such disclosure forms completed by journalists shall be made available to the public under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code (commonly called the Freedom of Information Act).</text></subsection> 
<subsection id="H904E2C8CC4114E9290015D988D102746"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/63">chapter 63</external-xref> of title 18, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/1343">section 1343</external-xref> the following new item: </text>
