<official-title>To amend title 18, United States Code, to provide penalties with respect to employers’ conduct relating to persons engaging in sexual conduct with children, and for other purposes.</official-title>

<section id="H0ABF06456DB44338B5BABDE102F5E9D" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Jeremy Bell Act of 2006</short-title></quote>.</text></section> 
<section id="HDC868096AB0E4E5BB5C7AE24867F614C" section-type="subsequent-section"><enum>2.</enum><header>Offense</header> 
<subsection id="HC773FE5F7F734B5580FC92464DD6F65"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/98">Chapter 98</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H0EFAD23A9CCA4D48B171B942DE072198" display-inline="no-display-inline"> 
<section id="H5BC8B5D812D64312BC8C2762B2457F28"><enum>1822.</enum><header>Transfers for employment of individuals engaging in child sex acts</header> 
<subsection id="HC3B4D886131D484A87D3D2BC6800EE7F"><enum>(a)</enum><header>Prohibition on the interstate transfer of child sex offenders</header><text display-inline="yes-display-inline">Whoever, being an employer, directs, causes, persuades, induces, or entices the travel in interstate commerce of an employee in one State with the purpose or effect of facilitating the employment of such employee in another State, if the employer knows that such employee engaged in a sexual conduct with an individual who has not attained the age of 18 years, shall be fined under this title or imprisoned not more than 5 years, or both. </text></subsection> 
<subsection id="H78C3A45342AC4B8AAC5CDB853FEB00E7"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">As used in this section—</text> 
<paragraph id="H54414BB8966F4B61A1D605CBDC587314"><enum>(1)</enum><text>the term <quote>sexual conduct</quote> means any sexual conduct, unless the employee was convicted of a crime for that conduct and has satisfied the terms and conditions imposed as a result of that conviction, if the conduct—</text> 
<subparagraph id="HD6EE228208F848F5978B32D6A252BC31"><enum>(A)</enum><text>is a sexual act or sexual contact as those terms are defined in section 2246; </text></subparagraph> 
<subparagraph id="H7FD4FEFE27B44A4BB4775CD0F6D6BDF9"><enum>(B)</enum><text>occurred during the course of employment; and</text></subparagraph> 
<subparagraph id="H2F7AB6DF6ABC486EA6009508E9723062"><enum>(C)</enum><text>would constitute a felony violation of the criminal law applicable where it took place; and</text></subparagraph></paragraph> 
<paragraph id="H5ACD1DEA213B43FF8EA94339814200AA"><enum>(2)</enum><text>the term <quote>State</quote> includes the District of Columbia and any other territory or possession of the United States.</text></paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3E8D5244E0AE47D691C4DA3328B7BF19"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/98">chapter 98</external-xref> of title 18, United States Code, is amended by adding after the item relating to section 1821 the following new item:</text>

<section id="HA2B5BAC8CAB64A31AF78B63DDE005BA2" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header>Schools required to carry out background checks on all employees</header><text display-inline="no-display-inline">The Elementary and Secondary Education Act of 1965 is amended as follows:</text> 
<paragraph id="H03E62BA423F84FBC8BA10A3492E799F"><enum>(1)</enum><text>Subpart 2 of part E of title IX is amended by adding at the end the following:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H13BEED009E3947E09C4D7BDBFD8B4402"> 
<section id="H43518F605B2748EC96EA1936747D51FE"><enum>9537.</enum><header> Background checks on all employees</header><text display-inline="no-display-inline">A private or public elementary school, a private or public secondary school, a local educational agency, or State educational agency may receive funds under this Act for a fiscal year only if the school or agency has in effect a policy that ensures that every individual employed by the school or agency has undergone a fingerprint-based check of the national crime information databases (as described in subsection (b) of section 153 of the Adam Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/42/16962">42 U.S.C. 16962</external-xref>)) and, where possible, a fingerprint-based check of State criminal history databases (as described in subsection (c) of such section).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HFA0DED09858C48DA9CAF2251D3134159"><enum>(2)</enum><text>The table of contents at the beginning of such Act is amended by adding after the item relating to section 9536 the following new item:</text>
