<official-title>To amend the Communications Act of 1934 to prohibit a provider of telephone exchange service, exchange access, or commercial mobile service from imposing a charge for number portability (other than a one-time, separate charge to port a number), and for other purposes.</official-title>

<section id="H213C5948DD3842A583C673C20463791D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Profit Honesty in Offering Number Emancipation Act of 2006</short-title></quote>.</text></section> 
<section id="HF9262A620CE04712A1785EF6695CFEA6"><enum>2.</enum><header>Charges for number portability</header> 
<subsection id="H8070350330374D52ACA71571A5CF3B84"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Section 251 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/251">47 U.S.C. 251</external-xref>) is amended—</text> 
<paragraph id="H270008E3851E465B9D37E4BEB1AE00C6"><enum>(1)</enum><text>by redesignating subsections (h) and (i) as subsections (i) and (j), respectively; and</text></paragraph> 
<paragraph id="H092FCB70D10E4A28AA1952A608735159"><enum>(2)</enum><text>by inserting after subsection (g) the following:</text>

<subsection id="H9D3C24A3B3684F30AE39F43F43D66F80"><enum>(h)</enum><header>Charges for number portability</header> 
<paragraph id="HBD2CB947D5C54A8A9E3645FE5E5B9FA7"><enum>(1)</enum><header>Prohibition</header><text>Except as provided in paragraph (2), a provider of telephone exchange service, exchange access, or commercial mobile service (as defined in section 332(d)) shall not impose any charge on a customer (whether imposed separately or incorporated into the customer’s monthly rates) to recover the costs of providing number portability in accordance with this section and Commission requirements thereunder.</text></paragraph> 
<paragraph id="H58D4E2A16C1F4AEEA019E7006546497E"><enum>(2)</enum><header>One-time, separate charge</header> 
<subparagraph id="HAEA32FEFD8A3417CA000A18B5FCEEB24"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A provider described in paragraph (1) may impose a one-time, separate charge on a customer in connection with porting a number to or from another provider at the request of the customer.</text></subparagraph> 
<subparagraph id="H7E65BD5A606746C1814EDCD44EF944CE"><enum>(B)</enum><header>Amount</header><text>The Commission shall set the maximum amount of a charge allowed under subparagraph (A). Such amount—</text> 
<clause id="HE6A6A7698939465BBF00D8FD16CCEB0"><enum>(i)</enum><text>shall be the same in any case; and</text></clause> 
<clause id="H4DE818C44C844C01A44EB8B1ADF1F41"><enum>(ii)</enum><text>shall be equal to the approximate cost incurred by a provider in porting a number.</text></clause></subparagraph> 
<subparagraph id="H60ACDB97A0C446AA8B46B43B241CF3B7"><enum>(C)</enum><header>Considerations</header><text>In setting the maximum amount under subparagraph (B), the Commission—</text> 
<clause id="H4AEE4A77EBAF4795A832535CA7AB0533"><enum>(i)</enum><text>may consider the ongoing costs of maintaining and operating a number portability system; and</text></clause> 
<clause id="H6D9CCAA1EEED498CB1C0A885A2B61276"><enum>(ii)</enum><text>may not consider costs recovered pursuant to regulations under this section (as in effect on the date of the enactment of the Profit Honesty in Offering Number Emancipation Act of 2006) for the implementation of number portability.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="HFEFFB8D31D54482FA536ADB89036F023"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) apply only with respect to charges imposed on or after the date that is 90 days after the date of the enactment of this Act.</text></subsection></section>
