<section changed="not-changed" id="H5D79D1EA12AC463CA31B74251C0243B1" section-type="section-one"><enum>1.</enum><header>Leases, easements, and rights-of-way on the outer Continental Shelf</header><text display-inline="no-display-inline">Section 8 of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1337">43 U.S.C. 1337</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="idB108B6C15BBC49F3BBB8968B0C1F47EA" style="OLC"> 
<subsection changed="not-changed" id="H1ECABC7FAD8343689F8853C87020C120"><enum>(q)</enum><header>Royalty suspension provisions</header> 
<paragraph changed="not-changed" id="id1C245566B4A4413C8FD457ACB2025736"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) through (4), the Secretary shall agree to a request by any lessee to amend any lease issued as a result of a Central or Western Gulf of Mexico lease sale held during the period beginning on January 1, 1998, and ending on December 31, 1999, to incorporate price thresholds applicable to royalty suspension provisions in the amount of $34.73 per barrel (2005 dollars) for oil and for natural gas of $4.34 per million Btu (2005 dollars).</text> </paragraph> 
<paragraph changed="not-changed" id="id2E6000848159446B96EA81FC3972B557"><enum>(2)</enum><header>Adjustment</header><text>The oil and natural gas price thresholds established under paragraph (1) shall be adjusted during any calendar year after 2005 by the percentage, if any, by which the implicit price deflator for the gross domestic product as computed and published by the Department of Commerce changed during the preceding calendar year.</text> </paragraph> 
<paragraph changed="not-changed" id="idA427C97F5D3D4083A648B9901216A24C"><enum>(3)</enum><header>New royalty suspension volumes</header><text>After the date of enactment of this subsection, price thresholds shall apply to any royalty suspension volumes granted by the Secretary.</text> </paragraph> 
<paragraph changed="not-changed" id="id1B604DE2E64E40F883CE356EC070CF90"><enum>(4)</enum><header>Effective date</header><text>Any amended lease shall impose the new price thresholds effective beginning October 1, 2006.</text> </paragraph></subsection> 
<subsection changed="not-changed" id="H4E147EC6C80E4D329168E94D6700CCFA"><enum>(r)</enum><header>Conservation of resources fees</header> 
<paragraph changed="not-changed" id="id928314F5A8744DEE890055775B637B7E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this subsection, the Secretary shall establish, by regulation, a conservation of resources fee for producing leases that will apply to new and existing leases which shall be established at $9 per barrel for oil and $1.25 per million Btu for gas (2006 dollars).</text> </paragraph> 
<paragraph changed="not-changed" id="idCB9E4ED0E6E7486EA86AC6396B4B771C"><enum>(2)</enum><header>Covered areas</header><text display-inline="yes-display-inline">The fee shall only apply to leases issued with deep water royalty relief for which royalties are not being paid when prices exceed $34.73 per barrel for oil and $4.34 per million Btu for natural gas (2005 dollars).</text> </paragraph> 
<paragraph changed="not-changed" id="id174C899C7A1D42B9B78AB325C05061D0"><enum>(3)</enum><header>Effective date</header><text display-inline="yes-display-inline">A fee imposed under this subsection shall apply to production that occurs on or after October 1, 2006.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="id92792740FC7A4F8D850E39A5649CDC6D"><enum>2.</enum><header>Coastal impact assistance program</header><text display-inline="no-display-inline">Section 31(b) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1356a">43 U.S.C. 1356a(b)</external-xref>) is amended—</text> 
<paragraph id="id9EE419FD42B24C339912D5E6A2AC6237"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text> 
<subparagraph id="id7B1CFD1C4E0445DB9454663FCD1CD67B"><enum>(A)</enum><text>by striking <quote>The</quote> and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="idCD87B4FDAD8846CBB9E916BEB817913A" style="OLC"> 
<subparagraph id="id1D0A5C378CFC4CF1B89BAD54962F1CDA"><enum>(A)</enum><header>Fiscal years 2007 through 2010</header><text>The</text> </subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph> 
<subparagraph id="idDC685039AFFD48CB8793FB36C13874FE"><enum>(B)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id060BCBA4CA6A45DD99C6CFF6EA2857C7" style="OLC"> 
<subparagraph id="id1AAA29E4A30C46B78FFF1C3D70FFC977"><enum>(B)</enum><header>Certain royalty revenues</header><text>Notwithstanding section 9, of the amount of any royalty revenues payable to the United States from any lease issued with deep water royalty relief as the result of a Central or Western Gulf of Mexico lease sale held during the period beginning on January 1, 1998, and ending on December 31, 1999, the Secretary of the Treasury shall deposit—</text> 
<clause id="id069934A079DB4564A8910FC213C84662"><enum>(i)</enum><text display-inline="yes-display-inline">the amount of the royalty revenues in a special account in the Treasury, to be available to the Secretary of the Interior, without further appropriation, for each of fiscal years 2007 through 2016, for disbursement to Gulf producing States and coastal political subdivisions in accordance with this section, except that the amount made available under this clause shall not exceed a total of $5,450,000,000; and</text> </clause> 
<clause commented="no" display-inline="no-display-inline" id="id943C0424F25C4FB4A833B1101D47C5F6"><enum>(ii)</enum><text>any remainder of the royalty revenues in the general fund of the Treasury, to be used for deficit reduction.</text> </clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block> </subparagraph></paragraph> 
<paragraph id="id1CB3C41BAF6243EF88B09DDA7C2987E0"><enum>(2)</enum><text>in paragraph (3)(B)—</text> 
<subparagraph id="id91A452C9222141DFAF5045F11827CCB4"><enum>(A)</enum><text>in clause (i), by striking <quote>and</quote> after the semicolon at the end;</text> </subparagraph> 
<subparagraph id="idA710EB9850CA496A860664089090ABFD"><enum>(B)</enum><text>in clause (ii), by striking the period at the end and inserting <quote>; and</quote>; and</text> </subparagraph> 
<subparagraph id="idE129D26523424504B0B532CBCE1638F4"><enum>(C)</enum><text>by adding at the end the following:</text>

<clause commented="no" display-inline="no-display-inline" id="ID3B8D18105DAC401CB96BBFCF1484CFD0"><enum>(iii)</enum><text display-inline="yes-display-inline">the amount of qualified outer Continental Shelf revenues for each of fiscal years 2011 through 2016 shall be determined using qualified outer Continental Shelf revenues received for fiscal year 2010.</text> </clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> 
<section id="H489E3A67B9414755A576B661AF2CD860"><enum>3.</enum><header>Sense of the congress to buy and build american</header> 
<subsection id="HA97C519022F3438E00263401DBC9B67D"><enum>(a)</enum><header>Buy and Build American</header><text>It is the intention of the Congress that this Act, among other things, result in a healthy and growing American industrial, manufacturing, transportation, and service sector employing the vast talents of America’s workforce to assist in the development of affordable energy from the Outer Continental Shelf. Moreover, the Congress intends to monitor the deployment of personnel and material in the Outer Continental Shelf to encourage the development of American technology and manufacturing to enable United States workers to benefit from this Act by good jobs and careers, as well as the establishment of important industrial facilities to support expanded access to American resources.</text></subsection> 
<subsection id="HAA2514DD550E4940AB86DFFCCBFD00C8"><enum>(b)</enum><header>Safeguard for Extraordinary Ability</header><text>Section 30(a) of the Outer Continental Shelf Lands Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1356">43 U.S.C. 1356(a)</external-xref>) is amended in the matter preceding paragraph (1) by striking <quote>regulations which</quote> and inserting <quote>regulations that shall be supplemental and complimentary with and under no circumstances a substitution for the provisions of the Constitution and laws of the United States extended to the subsoil and seabed of the outer Continental Shelf pursuant to section 4(a)(1) of this Act, except insofar as such laws would otherwise apply to individuals who have extraordinary ability in the sciences, arts, education, or business, which has been demonstrated by sustained national or international acclaim, and that</quote>.</text></subsection></section>
