<official-title>To establish a temporary program under which emergency loans are made to small businesses that are nonprofit child care businesses.</official-title>

<section id="H791D294FCA6F4710A05E491CBD4B7772" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emergency Child Care Lending for the Gulf Coast Act of 2006</short-title></quote>.</text></section> 
<section id="H820C3C8B61244B6E00F1E8979825ADEB"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HEEF264CBEE16462BB6C0AC5FE32F6EA1"><enum>(1)</enum><text display-inline="yes-display-inline">The Census reported pre-Katrina that there were—</text> 
<subparagraph id="H48F2226591E64846A1EEE645E0893BDF"><enum>(A)</enum><text>25,000 two-parent families in New Orleans with children under 18;</text></subparagraph> 
<subparagraph id="HDDD89B11C3F349ECBE5B8813D78DAEC1"><enum>(B)</enum><text>26,000 female householders with children under 18, and no husband present; and</text></subparagraph> 
<subparagraph id="HF8A7004AD7EC439FAFB10907C33F7634"><enum>(C)</enum><text>more than 18,000 householders who were more than 65 years old and living alone. </text></subparagraph></paragraph> 
<paragraph id="HFC8BFF0BDD004664BF065B8F6EDC728B"><enum>(2)</enum><text>Studies have stated that reopening child care facilities was crucial for helping parents get back to work and businesses to recover.</text></paragraph> 
<paragraph id="HBD74170E689340F28DEF19ECD059CD47"><enum>(3)</enum><text>Studies have shown that without available and affordable child care economic recovery will be greatly impeded and lead to a reduction in worker productivity. </text></paragraph> 
<paragraph id="HA849346FB99944388BC0CC86AF11B1C2"><enum>(4)</enum><text>In New Orleans before the Hurricanes Katrina and Rita, the city had 1,912 day-care slots at 266 licensed centers, but now 80 percent of those centers and 75 percent of those slots are gone. </text></paragraph> 
<paragraph id="HA15BD34F0DB64D37BECA83B69C76CDD5"><enum>(5)</enum><text>The National Association of Child Care Resource and Referral Agencies, reported in a study published by the Mississippi State University Early Childhood Institute that between 62 percent to 94 percent of the licensed child care slots in the three coastal counties hardest hit by Hurricanes Katrina and Rita in Mississippi were lost. </text></paragraph> 
<paragraph id="H80FA6E7D4ADD4CB5AD62C4FE48166FB"><enum>(6)</enum><text>In Jackson County, Mississippi, initial assessment found that one-fourth of the county’s licensed centers were damaged beyond repair, representing 11 percent of the county’s licensed child care capacity and another 39 percent of centers needed repairs. </text></paragraph> 
<paragraph id="HF9610A1D58CE4ACF93E5F5DF5DF1B07"><enum>(7)</enum><text>Studies have stated the most effective way to rebuild the child care infrastructure is to—</text> 
<subparagraph id="HCE622D1466374C5FA8A55E081A6A147"><enum>(A)</enum><text>help child care programs in the disaster area reopen as rapidly as was safe by giving priority to licensed early childhood facilities; and</text></subparagraph> 
<subparagraph id="H01B06D1B35B548A4A019C8DCB0F67B5"><enum>(B)</enum><text>recruit, train, and retain child-care professionals.</text></subparagraph></paragraph></section> 
<section id="H58DB89D6640B48D4BB10F80644795F5E"><enum>3.</enum><header>Emergency child care lending pilot program</header> 
<subsection id="H4BCD5C3E36884862B703C2AC45C456C8"><enum>(a)</enum><header>Loans authorized</header><text>Notwithstanding section 502(1) of the Small Business Investment Act of 1958, the proceeds of any loan described in section 502 of such Act may be used by the certified development company to provide loans to small, nonprofit child care businesses, provided that—</text> 
<paragraph id="H6B35F1C960974D5B9E247C1979FE3164"><enum>(1)</enum><text>the loan will be used for a sound business purpose that has been approved by the Administrator of the Small Business Administration (hereafter in this section referred to as the Administrator);</text></paragraph> 
<paragraph id="HE255AF84043E44B8A2D9D07C47E63D5B"><enum>(2)</enum><text>each such business meets the eligibility requirements applicable to for-profit businesses receiving a similar loan, except for status as a for-profit business;</text></paragraph> 
<paragraph id="H288D529D0D81475C999B5C00A04D06DC"><enum>(3)</enum><text>1 or more individuals have personally guaranteed the loan;</text></paragraph> 
<paragraph id="H48F4B52C22B84EB980C5C6D7E1F2C8E2"><enum>(4)</enum><text>the small, non-profit child care business has clear and singular title to the collateral for the loan;</text></paragraph> 
<paragraph id="H6018E41797A44C179750A4EF39CCE9E8"><enum>(5)</enum><text>the small, non-profit child care business has supplied sufficient information supporting the ability to obtain future cash flow from its operations to meet its obligations on the loan and its normal and reasonable operating expenses; and</text></paragraph> 
<paragraph id="H5D76E57FAEE04821861C1BFD2E6C4A1"><enum>(6)</enum><text>have a track record of providing child care services in the presidentially declared disaster areas in the Gulf Coast region.</text></paragraph></subsection> 
<subsection id="H26EDDC2EE69A4646B59E2D33BED1A630"><enum>(b)</enum><header>Limitation on volume</header><text>Not more than 3 percent of the total number of loans guaranteed in fiscal year 2007, and 2008 under title V of the Small Business Investment Act of 1958 may be awarded under the program described in this section.</text></subsection> 
<subsection id="H3DA492C155A044FD0060CBB78CCFAEF"><enum>(c)</enum><header>Small, non-profit child care business</header><text>For purposes of this section, the term <quote>small, non-profit child care business</quote> means an organization that—</text> 
<paragraph id="HD62CA319AB704B6D8371AD2DD9FB43E2"><enum>(1)</enum><text>is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code;</text></paragraph> 
<paragraph id="H2ACA0B60E56F427BAB80E5ABC54F6525"><enum>(2)</enum><text>is primarily engaged in providing child care for infants, toddlers, pre-school, or pre-kindergarten children (or any combination thereof), may provide care for older children when they are not in school, and may offer pre-kindergarten educational programs;</text></paragraph> 
<paragraph id="H44CC5DC999DB45ECA600EC00D38D1332"><enum>(3)</enum><text>including its affiliates, has tangible net worth that does not exceed $7,000,000, and has average net income (excluding any carryover losses) for the preceding 2 completed fiscal years that does not exceed $2,500,000; and</text></paragraph> 
<paragraph id="H6DB3198EFEB14CBF9B8CEF79B6F262C9"><enum>(4)</enum><text>is licensed as a child care provider by the District of Columbia, the insular area, or the State, in which it is located.</text></paragraph></subsection> 
<subsection id="HCAD8452C0C52451E006BEAE9C3E51D1D"><enum>(d)</enum><header>Termination</header><text>No loan shall be made under this section after December 30, 2007.</text></subsection> 
<subsection id="H5BD8C542D9A14AF58BAD611E175CF1C4"><enum>(e)</enum><header>Reports</header> 
<paragraph id="HC6B4AAFD5BC04470B3AC759DAC0FACE"><enum>(1)</enum><header>Small business administration</header><text>Not later than 3 months after the date of the enactment of this Act, and every 3 months thereafter until September 30, 2008, the Administrator shall submit a report to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives regarding the implementation of the loan program described in this section. Each such report shall include—</text> 
<subparagraph id="HBA53F1241A914F42B3EE6099A10086A1"><enum>(A)</enum><text>the date on which the loan program is implemented;</text></subparagraph> 
<subparagraph id="HE4B01E782452482B00E15644F693213D"><enum>(B)</enum><text>the date on which the rules are issued pursuant to subsection (f);</text></subparagraph> 
<subparagraph id="H3C69FF2F09574CA18F1E70C5047BC6DF"><enum>(C)</enum><text>the number and dollar amount of loans under the program; applied for, approved, and disbursed during the previous 3 months; and</text></subparagraph> 
<subparagraph id="HA8AED07D9156479C007B77A0A30818C"><enum>(D)</enum><text>number of loans made to minority-owned firms and to woman-owned firms.</text></subparagraph></paragraph> 
<paragraph id="H696EB693BD974BF7B6519F3F1D092E3D"><enum>(2)</enum><header>General accounting office</header><text>Not later than March 31, 2008, the Comptroller General of the United States shall submit a report to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives regarding the assistance provided under the loan program established by this section. Such report shall include information regarding the first 2 years of the loan program, including—</text> 
<subparagraph id="H3A9CD62A55EC44B99EB54215E82EE74F"><enum>(A)</enum><text>an evaluation of the timeliness of the implementation of the loan program;</text></subparagraph> 
<subparagraph id="H3DAF0A17CAA94D78BF16ED827B00A100"><enum>(B)</enum><text>a description of the effectiveness and ease with which certified development companies, lenders, and small businesses have participated in the loan program;</text></subparagraph> 
<subparagraph id="H18470D83578F4AE9B69F91694EEA728D"><enum>(C)</enum><text>a description and assessment of how the loan program was marketed;</text></subparagraph> 
<subparagraph id="H724CDAD49ECE4AD3AA57AF28653B3605"><enum>(D)</enum><text>by location in total, the number of small, nonprofit child care businesses that—</text> 
<clause id="HF21DE24EF9C64291BEF6B37165C465CA"><enum>(i)</enum><text>applied for loans under the program (stated separately for new and expanding child care providers); and</text></clause> 
<clause id="H091A850220A2419595D6F629C8F500F4"><enum>(ii)</enum><text>received loan disbursements under the program (stated separately for new and expanding child care providers);</text></clause></subparagraph> 
<subparagraph id="HC9B921E6571F431DAE571E00EE7F78D"><enum>(E)</enum><text>the total amount loaned to such businesses under the program;</text></subparagraph> 
<subparagraph id="HAFAC47B732494030B7AD332D8DA83FA8"><enum>(F)</enum><text>the total number of loans made to such businesses under the program;</text></subparagraph> 
<subparagraph id="HCF4D792588EF4FAC8DB8E5B0794BA254"><enum>(G)</enum><text>the average loan amount and term of loans made under the program;</text></subparagraph> 
<subparagraph id="HFFBFC3F35B9946FEB8017FD23777C2C3"><enum>(H)</enum><text>the currency rate, delinquencies, defaults, and losses of the loans made under the program;</text></subparagraph> 
<subparagraph id="H70E82758D5964C9597F00785EF12FC8"><enum>(I)</enum><text>the number and percent of children served through the program who receive subsidized assistance; and</text></subparagraph> 
<subparagraph id="H21CC2874915D4DA2B3995F27FC006CBF"><enum>(J)</enum><text>the number and percent of children served through the program who are minority or low-income.</text></subparagraph></paragraph> 
<paragraph id="HDE694CB9B81340BF9288B07B6700CC43"><enum>(3)</enum><header>Access to information</header> 
<subparagraph id="H2E58700500E24792BF45E21BD66124AA"><enum>(A)</enum><header>Collection</header><text>The Administrator shall collect and maintain such information as may be necessary to carry out paragraph (2) from certified development centers and child care providers, and such centers and providers shall comply with a request for information from the Administrator for that purpose.</text></subparagraph> 
<subparagraph id="H2BBBCC91E1D84BC4974700FD801169C5"><enum>(B)</enum><header>Provision of information to gao</header><text>The Administrator shall provide information collected under subparagraph (A) to the Comptroller General of the United States for purposes of the report required by paragraph (2).</text></subparagraph></paragraph></subsection> 
<subsection id="H84520955A45947C5BF24C4984D1C4D24"><enum>(f)</enum><header>Rulemaking authority</header><text>Not later than 60 days after the date of the enactment of this Act, the Administrator shall issue final rules to carry out the loan program authorized by this section.</text></subsection></section>
