<official-title>To direct the Secretary of the Interior to convey the Alta-Hualapai Site to the city of Las Vegas, Nevada, for the development of a cancer treatment facility.</official-title>

<section id="HBDAD958C84ED43358C7FEB757B217FA" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nevada Cancer Institute Expansion Act</short-title></quote>.</text></section> 
<section id="H648615319AFF499DBC15BAEDAC5D50AD"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HCCE73E0C06EA42629707B34B7ED6EE60"><enum>(1)</enum><header>Agreement</header><text>The term <quote>Agreement</quote> means the memorandum of understanding entered into by the City and the Institute on December 21, 2005.</text></paragraph> 
<paragraph id="HAF97C3AE05614388AA30AA678745B04C"><enum>(2)</enum><header>Alta-Hualapai Site</header><text>The term <quote>Alta-Hualapai Site</quote> means the approximately 80 acres of land that is—</text> 
<subparagraph id="H75B5CEF561E54FE581D3B2FD13D36D6"><enum>(A)</enum><text>patented to the City under the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (<external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869 et seq.</external-xref>); and</text></subparagraph> 
<subparagraph id="H441CC2EB06674D0697CEF9C778AC669F"><enum>(B)</enum><text>identified on the map as the <quote>Alta-Hualapai Site</quote>.</text></subparagraph></paragraph> 
<paragraph id="HF6A9FB37E6414539A5EA923D6F163E21"><enum>(3)</enum><header>City</header><text>The term <quote>City</quote> means the city of Las Vegas, Nevada.</text></paragraph> 
<paragraph id="H2352020AB280451185BBDEF75480AA4"><enum>(4)</enum><header>Institute</header><text>The term <quote>Institute</quote> means the Nevada Cancer Institute, which is a nonprofit organization described under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986, the principal place of business of which is at 10441 West Twain Avenue, Las Vegas, Nevada.</text></paragraph> 
<paragraph id="H8A02818F4A1C40B481825DDBD97FFF37"><enum>(5)</enum><header>Map</header><text>The term <quote>map</quote> means the map entitled <quote>Nevada Cancer Institute Expansion Act</quote> and dated July 17, 2006.</text></paragraph> 
<paragraph id="HE01DD98029114EBEA627649C411E3FBA"><enum>(6)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior, acting through the Director of the Bureau of Land Management.</text></paragraph> 
<paragraph id="H0633DA6BE24F415CA863C6C9B17F25FA"><enum>(7)</enum><header>Water District</header><text>The term <term>Water District</term> means the Las Vegas Valley Water District.</text></paragraph></section> 
<section id="H42802A62BA03437DA002F50079C167F"><enum>3.</enum><header>Land conveyance, Alta-Hualapai site, Las Vegas, Nevada</header> 
<subsection id="HDD85D839F79F4CE5A69257829F009F1D"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall convey to the City, without consideration, all right, title, and interest of the United States in and to the Alta-Hualapai Site for use by City for the development, in accordance with the Agreement, of—</text> 
<paragraph id="H8EFF1CD09ECC4667B3FC397F8646C53"><enum>(1)</enum><text>a nonprofit cancer treatment facility;</text></paragraph> 
<paragraph id="H077188C8DEF044B3BFD67FF79225D7B"><enum>(2)</enum><text>ancillary commercial projects;</text></paragraph> 
<paragraph id="H272D258BB4774D7FAA2419465F3533A0"><enum>(3)</enum><text>an adjacent park;</text></paragraph> 
<paragraph id="HB38388F6E93447468D511F7C9FCAE5FC"><enum>(4)</enum><text>a flood control project; and</text></paragraph> 
<paragraph id="HB2A9D335D6D64DF68F38CE7C46A966AD"><enum>(5)</enum><text>a water pumping facility.</text></paragraph></subsection> 
<subsection id="HD5C59A41B2C04CC900B4DCDC1C2EFB9F"><enum>(b)</enum><header>Institute transfer</header> 
<paragraph id="H44296D83625346A3A93C6B6E333DB4C6"><enum>(1)</enum><header>In general</header><text>The City may subsequently transfer to the Institute, without consideration, a portion of the Alta-Hualapai Site conveyed to the City under subsection (a).</text></paragraph> 
<paragraph id="H44A3DA65A12B4C0F8871DB94690178DD"><enum>(2)</enum><header>Reversion</header><text>If a portion of the Alta-Hualapai Site transferred under paragraph (1) ceases to be used by the Institute, all right, title, and interest in and to the portion of the Alta-Hualapai Site, and any improvements to the Alta-Hualapai Site, shall revert to the United States, at the discretion of the Secretary.</text></paragraph></subsection> 
<subsection id="H89360164B09C4071B9C55ED93060A239"><enum>(c)</enum><header>Water District transfer</header> 
<paragraph id="H72EF46629C34479CB7879348B440095"><enum>(1)</enum><header>In general</header><text>The City may subsequently transfer to the Water District, without consideration, a portion of the Alta-Hualapai Site conveyed to the City under subsection (a) that is necessary for a pumping facility.</text></paragraph> 
<paragraph id="HD3C938E0F2B34B26B450D926D1783072"><enum>(2)</enum><header>Reversion</header><text>If a portion of the Alta-Hualapai Site transferred under paragraph (1) ceases to be used by the Water District, all right, title, and interest in and to the portion of the Alta-Hualapai Site, and any improvements to the Alta-Hualapai Site, shall revert to the United States, at the discretion of the Secretary.</text></paragraph></subsection> 
<subsection id="H12CC08E3B8514CF0AEC623045827DC71"><enum>(d)</enum><header>Subsequent conveyance</header><text>Except as provided in subsections (b) and (c), if the City subsequently sells, leases, or otherwise conveys any portion of the Alta-Hualapai Site conveyed to the City under subsection (a)—</text> 
<paragraph id="H16D43181709B4310AE32B26B1C7DEFEF"><enum>(1)</enum><text>the amount of consideration for the sale, lease, or conveyance shall be for not less than fair market value; and</text></paragraph> 
<paragraph id="H3B73A669D55E4F588FFE0790239C6007"><enum>(2)</enum><text>an amount equal to the consideration received by the City for the land sold, leased, or conveyed shall be paid or otherwise deposited by the City in accordance with section 4(e)(1) of the Southern Nevada Public Land Management Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/263">Public Law 105–263</external-xref>; 112 Stat. 2345).</text></paragraph></subsection> 
<subsection id="H5D8035E7ABFE4076A8C38C2D00ABABE0"><enum>(e)</enum><header>Costs</header><text>Any costs relating to a conveyance under subsection (a) (including any costs for surveys and other administrative expenses) shall be paid by the City.</text></subsection></section>
