<section id="H1C4889F9ABB242BEB723BA79897403FD" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Annual report to Congress and notice to public on congressional initiatives in funds authorized or made available to Department of Defense</header> 
<subsection id="HBE668EE44AA44F2C991F1FF5FEF6CD27"><enum>(a)</enum><header>In general</header> 
<paragraph id="HBBAFD74F392B437A82DF47FE9D6330EE" display-inline="no-display-inline"><enum>(1)</enum><header>Identification of congressional initiatives</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/23">Chapter 23</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text> 
<quoted-block style="USC" id="HAC7F6D5CE0124B079F1BFDF1B0BF79C7" display-inline="no-display-inline"> 
<section id="HE31BC6D98916418EA5003E0700E32BA8"><enum>490. </enum><header>Congressional initiatives in funds authorized or made available to Department of Defense: annual report to Congress; notice to public</header> 
<subsection id="HA0B33B983DF24F019CF9456458D6F31"><enum>(a)</enum><header>Annual Report and public notice required</header><text display-inline="yes-display-inline">Not later than 90 days after the close of each fiscal year, the Secretary of Defense shall submit to Congress a report on congressional initiatives applicable to funds authorized or made available for the Department of Defense for that fiscal year. Upon being submitted to Congress, each such report shall be posted on a publicly available Internet website of the Department of Defense.</text> </subsection> 
<subsection id="HD700ADF4D09045128887ABF26693ACA0"><enum>(b)</enum><header>Content</header><text display-inline="yes-display-inline">Each report under subsection (a) shall include, for each congressional initiative applicable to funds that were authorized or made available to the Department of Defense for the fiscal year covered by the report, the following:</text> 
<paragraph id="HF5413C04DF8343BF95BDC5B1517B8663"><enum>(1)</enum><text display-inline="yes-display-inline">A description of each such congressional initiative, including—</text> 
<subparagraph id="H3FEBF927EEB343DAB0AE7151C5645CC9"><enum>(A)</enum><text display-inline="yes-display-inline">the geographic location (by city, State, country, and congressional district, if relevant) in which the funds covered by such congressional initiative are to be used; </text></subparagraph> 
<subparagraph id="HBEF6DEAD64EF40828D21EE2E88AC6EC5"><enum>(B)</enum><text display-inline="yes-display-inline">the purpose of such congressional initiative (if known); and</text></subparagraph> 
<subparagraph id="HF948326D0D4C43C6923641B78B36BB68"><enum>(C)</enum><text display-inline="yes-display-inline">the recipient of the funding covered by such congressional initiative.</text></subparagraph></paragraph> 
<paragraph id="HD4DDDD5D0F8A48758B268858BE768009"><enum>(2)</enum><text display-inline="yes-display-inline">For each such congressional initiative, an assessment of the utility of the congressional initiative in meeting the goals of the Department, set forth using a rating system as follows:</text> 
<subparagraph id="H1A734F2D2E4D40CFB49F1E00159C1605"><enum>(A)</enum><text display-inline="yes-display-inline">A rating of <quote>A</quote> for a congressional initiative that directly advances the primary goals of the Department or an agency, element, or component of the Department.</text></subparagraph> 
<subparagraph id="H006BDDE2C48F48D8B7A7DA3C1C1B3634"><enum>(B)</enum><text display-inline="yes-display-inline">A rating of <quote>B</quote> for a congressional initiative that advances many of the primary goals of the Department or an agency, element, or component of the Department.</text></subparagraph> 
<subparagraph id="H7484552D49B445E19EFDF11565D70022"><enum>(C)</enum><text display-inline="yes-display-inline">A rating of <quote>C</quote> for a congressional initiative that may advance some of the primary goals of the Department or an agency, element, or component of the Department.</text></subparagraph> 
<subparagraph id="HC754DB696C3444D69E1BF26F52F7B307"><enum>(D)</enum><text display-inline="yes-display-inline">A rating of <quote>D</quote> for a congressional initiative that cannot be demonstrated as being cost-effective in advancing the primary goals of the Department or any agency, element, or component of the Department.</text> </subparagraph> 
<subparagraph id="H0D3EBE6F5ADF4F6E9F1D481B5EEF9DE5"><enum>(E)</enum><text display-inline="yes-display-inline">A rating of <quote>F</quote> for a congressional initiative that distracts from or otherwise impedes that capacity of the Department to meet the primary goals of the Department.</text></subparagraph></paragraph></subsection> 
<subsection id="H4C5D95C79C694A858E5C5E6600FACA27"><enum>(c)</enum><header>Congressional initiative defined</header><text>In this section, the term <term>congressional initiative</term> means a provision of law, or a directive contained within a joint explanatory statement or report accompanying a conference report or bill (as applicable), that specifies—</text> 
<paragraph id="H3D723F12882F411C868549B22C5A34B"><enum>(1)</enum><text display-inline="yes-display-inline">the identity of an entity or project, including a defense system, for which funds are authorized or made available in that law (or conference report or bill) and that was not requested by the President in a budget submission to Congress; and</text></paragraph> 
<paragraph id="H233D245AFBB1430D885554DAC282300"><enum>(2)</enum><text>the amounts of the funds so authorized or made available.</text> </paragraph></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HDD96CD646512486180F427D2B0991B81"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<subsection id="H681AD979234C4F7C85D1459EDC3F67F"><enum>(b)</enum><header>Effective date</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/490">Section 490</external-xref> of title 10, United States Code, as added by subsection (a), shall apply with respect to funds made available to the Department of Defense for each fiscal year after fiscal year 2006.</text> </subsection></section>
