<official-title>To establish a voluntary framework through which commercial mobile service providers can elect to transmit emergency alerts to subscribers.</official-title>

<section id="HE76486F481AA4DE000CA85FE7EC91D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Warning, Alert, and Response Network Act</short-title></quote>.</text></section> 
<section id="H6C2966F576144379B7A12800A3F83106"><enum>2.</enum><header>Federal Communications Commission duties</header> 
<subsection id="HCD7294C3CE4C4CDD9D653DF666E274F6"><enum>(a)</enum><header>Commercial Mobile Service Alert Regulations</header><text display-inline="yes-display-inline">Within 180 days after the date on which the Commercial Mobile Service Alert Advisory Committee, established pursuant to section 3(a), transmits recommendations to the Federal Communications Commission, the Commission shall complete a proceeding to adopt relevant technical standards, protocols, procedures, and other technical requirements based on the recommendations of such Advisory Committee necessary to enable commercial mobile service alerting capability for commercial mobile service providers that voluntarily elect to transmit emergency alerts. The Commission shall consult with the National Institute of Standards and Technology regarding the adoption of technical standards under this subsection.</text></subsection> 
<subsection id="HB3192270BED34BE0AFED4900D23CBAFA"><enum>(b)</enum><header>Commercial Mobile Service Election</header> 
<paragraph id="H5D72A481573442E09F5DD690D1BC75E2"><enum>(1)</enum><header>Amendment of commercial mobile service license</header><text>Within 120 days after the date on which the Federal Communications Commission adopts relevant technical standards and other technical requirements pursuant to subsection (a), the Commission shall complete a proceeding—</text> 
<subparagraph id="H5E72977E7A444DE58737B96FFE7BF2"><enum>(A)</enum><text>to allow any licensee providing commercial mobile service (as defined in section 332(d)(1) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/332">47 U.S.C. 332(d)(1)</external-xref>)) to transmit emergency alerts to subscribers to, or users of, the commercial mobile service provided by such licensee;</text></subparagraph> 
<subparagraph id="H06960F2FEA7843F3BD6CFB46AE45F4F9"><enum>(B)</enum><text>to require any licensee providing commercial mobile service that elects, in whole or in part, under paragraph (2) not to transmit emergency alerts to provide clear and conspicuous notice at the point of sale of any devices with which its commercial mobile service is included, that it will not transmit such alerts via the service it provides for the device; and</text></subparagraph> 
<subparagraph id="H80B54A2A304142A5AEE6F600BB9EB09D"><enum>(C)</enum><text>to require any licensee providing commercial mobile service that elects under paragraph (2) not to transmit emergency alerts to notify its existing subscribers of its election.</text></subparagraph></paragraph> 
<paragraph id="H89E2636B6B5B4F63A86444D5DFC74EA9"><enum>(2)</enum><header>Election</header> 
<subparagraph id="H4BD33105E9B74CBF8B155352D0C8D8E"><enum>(A)</enum><header>In general</header><text>Within 30 days after the Commission issues its order under paragraph (1), each licensee providing commercial mobile service shall file an election with the Commission with respect to whether or not it intends to transmit emergency alerts.</text></subparagraph> 
<subparagraph id="H81E1A712661045DAAAD43646A51DB400"><enum>(B)</enum><header>Transmission standards; notification</header><text>If a licensee providing commercial mobile service elects to transmit emergency alerts via its commercial mobile service, the licensee shall—</text> 
<clause id="HDE4771D85CCB433F9E42C2551D9574C7"><enum>(i)</enum><text>notify the Commission of its election; and</text></clause> 
<clause id="HCA49099A9E6E41E0959739E4C5998900"><enum>(ii)</enum><text>agree to transmit such alerts in a manner consistent with the technical standards, protocols, procedures and other technical requirements implemented by the Commission.</text></clause></subparagraph> 
<subparagraph id="H841CF5D02FE449560014CC61489CB71C"><enum>(C)</enum><header>No fee for service</header><text>A commercial mobile service licensee that elects to transmit emergency alerts may not impose a separate or additional charge for such transmission or capability.</text></subparagraph> 
<subparagraph id="HCE820012A5654D78AE5386D084634F5D"><enum>(D)</enum><header>Withdrawal; late election</header><text>The Commission shall establish a procedure—</text> 
<clause id="HDCA1EA2194014B108332F5E8DF45C78"><enum>(i)</enum><text>for a commercial mobile service licensee that has elected to transmit emergency alerts to withdraw its election without regulatory penalty or forfeiture upon advance written notification of the withdrawal to its affected subscribers;</text></clause> 
<clause id="H30B2B766C39045A69FD048AA99623DA9"><enum>(ii)</enum><text>for a commercial mobile service licensee to elect to transmit emergency alerts at a date later than provided in subparagraph (A); and</text></clause> 
<clause id="H6417D0825F3E4EDAAD07ABF7B325D6AE"><enum>(iii)</enum><text>under which a subscriber may terminate a subscription to service provided by a commercial mobile service licensee that withdraws its election without penalty or early termination fee.</text></clause></subparagraph> 
<subparagraph id="H67985C5ADDA047468BE8953C6795B6F0"><enum>(E)</enum><header>Consumer choice technology</header><text display-inline="yes-display-inline">Any commercial mobile service licensee electing to transmit emergency alerts may offer subscribers the capability of preventing the subscriber’s device from receiving such alerts, or classes of such alerts, other than an alert issued by the President. Within 2 years after the Commission completes the proceeding under paragraph (1), the Commission shall examine the issue of whether a commercial mobile service provider should continue to be permitted to offer its subscribers such capability. The Commission shall submit a report with its recommendations to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph></subsection> 
<subsection id="HA7D6EC2C8EFD494300FDDF4FFD62334E"><enum>(c)</enum><header>Digital Television Transmission Towers Retransmission Capability</header><text display-inline="yes-display-inline">Within 90 days after the date on which the Commission adopts relevant technical standards based on recommendations of the Commercial Mobile Service Alert Advisory Committee, established pursuant to section 3(a), the Commission shall complete a proceeding to require licensees and permittees of noncommercial educational broadcast stations or public broadcast stations (as those terms are defined in section 397(6) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/397">47 U.S.C. 397(6)</external-xref>)) to install necessary equipment and technologies on, or as part of, any broadcast television digital signal transmitter to enable the distribution of geographically targeted alerts by commercial mobile service providers that have elected to transmit emergency alerts under this section.</text></subsection> 
<subsection id="H9D49C34BCEC44AA7B177C5B085D82106"><enum>(d)</enum><header>FCC Regulation of Compliance</header><text>The Federal Communications Commission may enforce compliance with this Act but shall have no rulemaking authority under this Act, except as provided in subsections (a), (b), (c), and (f).</text></subsection> 
<subsection id="HEF109692C56E4840A0E900D12E9CDCC0"><enum>(e)</enum><header>Limitation of Liability</header> 
<paragraph id="HBC87161BFF144771B1D500522400E717"><enum>(1)</enum><header>In general</header><text>Any commercial mobile service provider (including its officers, directors, employees, vendors, and agents) that transmits emergency alerts and meets its obligations under this Act shall not be liable to any subscriber to, or user of, such person’s service or equipment for—</text> 
<subparagraph id="H1DB0644F982A42738846493DE593603"><enum>(A)</enum><text>any act or omission related to or any harm resulting from the transmission of, or failure to transmit, an emergency alert; or</text></subparagraph> 
<subparagraph id="HD6B54DFEBD1B4D8AADF5CC43CA9E9D8"><enum>(B)</enum><text>the release to a government agency or entity, public safety, fire service, law enforcement official, emergency medical service, or emergency facility of subscriber information used in connection with delivering such an alert.</text></subparagraph></paragraph> 
<paragraph id="HC67F8054B6F445E3BAE4BCE359CB1223"><enum>(2)</enum><header>Election not to transmit alerts</header><text>The election by a commercial mobile service provider under subsection (b)(2)(A) not to transmit emergency alerts, or to withdraw its election to transmit such alerts under subsection (b)(2)(D) shall not, by itself, provide a basis for liability against the provider (including its officers, directors, employees, vendors, and agents).</text></paragraph></subsection> 
<subsection id="HEE49D9C19BAB472EBE0701302006DD55"><enum>(f)</enum><header>Testing</header><text>The Commission shall require by regulation technical testing for commercial mobile service providers that elect to transmit emergency alerts and for the devices and equipment used by such providers for transmitting such alerts.</text></subsection></section> 
<section id="H26230F6F00C844B49EB112A9BBC28B00"><enum>3.</enum><header>Commercial Mobile Service Alert Advisory Committee</header> 
<subsection id="H1FF0DCBCE520472C8F5810F9478423E6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the chairman of the Federal Communications Commission shall establish an advisory committee, to be known as the Commercial Mobile Service Alert Advisory Committee (referred to in this section as the <quote>Advisory Committee</quote>).</text></subsection> 
<subsection id="H6FE415C259C140B29FD288E3BD92E14"><enum>(b)</enum><header>Membership</header><text>The chairman of the Federal Communications Commission shall appoint the members of the Advisory Committee, as soon as practicable after the date of enactment of this Act, from the following groups:</text> 
<paragraph id="H1456EDF3FD8D4FCCA1BCC0D285E4FF17"><enum>(1)</enum><header>State and local government representatives</header><text>Representatives of State and local governments and representatives of emergency response providers, selected from among individuals nominated by national organizations representing such governments and personnel.</text></paragraph> 
<paragraph id="H7116F0D1011045A18E1284CEEAF14C9E"><enum>(2)</enum><header>Tribal governments</header><text>Representatives from Federally recognized Indian tribes and National Indian organizations.</text></paragraph> 
<paragraph id="H0C422B34D1D942388D9DB74DA4A4FD6"><enum>(3)</enum><header>Subject matter experts</header><text>Individuals who have the requisite technical knowledge and expertise to serve on the Advisory Committee in the fulfillment of its duties, including representatives of—</text> 
<subparagraph id="H8E666FA4CEBA41D68D9E5C11C0F1A6B5"><enum>(A)</enum><text>communications service providers;</text></subparagraph> 
<subparagraph id="H997ECA5EC9CA42E00047BA133C4692F"><enum>(B)</enum><text>vendors, developers, and manufacturers of systems, facilities, equipment, and capabilities for the provision of communications services;</text></subparagraph> 
<subparagraph id="H4467083628544E75B142C06BC53C9635"><enum>(C)</enum><text>third-party service bureaus;</text></subparagraph> 
<subparagraph id="H06E96BAA1DBA4BB9844338106502C41E"><enum>(D)</enum><text>technical experts from the broadcasting industry;</text></subparagraph> 
<subparagraph id="H30A895604AE74EFEB95FAE7B00BF0959"><enum>(E)</enum><text>the national organization representing the licensees and permittees of noncommercial broadcast television stations;</text></subparagraph> 
<subparagraph id="HBED6707AA6C441359CE441BFD4BBEC1"><enum>(F)</enum><text>national organizations representing individuals with special needs, including individuals with disabilities and the elderly; and</text></subparagraph> 
<subparagraph id="HC7BF75939C1B438CBB4301A5C2809F9"><enum>(G)</enum><text>other individuals with relevant technical expertise.</text></subparagraph></paragraph> 
<paragraph id="H74D71B86ED8D4EBE96A2017D9C000001"><enum>(4)</enum><header>Qualified Representatives of other stakeholders and interested parties</header><text>Qualified representatives of such other stakeholders and interested and affected parties as the chairman deems appropriate.</text></paragraph></subsection> 
<subsection id="H8329C590428D40AE90BEC0FCFF659F97"><enum>(c)</enum><header>Development of system-critical recommendations</header><text>Within 1 year after the date of enactment of this Act, the Advisory Committee shall develop and submit to the Federal Communications Commission recommendations—</text> 
<paragraph id="HF0E085329D9441A392EBC96D466B7B82"><enum>(1)</enum><text>for protocols, technical capabilities, and technical procedures through which electing commercial mobile service providers receive, verify, and transmit alerts to subscribers;</text></paragraph> 
<paragraph id="H26D2421FF325442DBFBE00E6684390D5"><enum>(2)</enum><text>for the establishment of technical standards for priority transmission of alerts by electing commercial mobile service providers to subscribers;</text></paragraph> 
<paragraph id="H1CCB6112B1074AE09DED795143FD3560"><enum>(3)</enum><text>for relevant technical standards for devices and equipment and technologies used by electing commercial mobile service providers to transmit emergency alerts to subscribers;</text></paragraph> 
<paragraph id="H161E243E576946E9880021926D21439C"><enum>(4)</enum><text>for the technical capability to transmit emergency alerts by electing commercial mobile providers to subscribers in languages in addition to English, to the extent practicable and feasible;</text></paragraph> 
<paragraph id="HD2408C1ACD02442EAEAA525C7DB15B37"><enum>(5)</enum><text>under which electing commercial mobile service providers may offer subscribers the capability of preventing the subscriber’s device from receiving emergency alerts, or classes of such alerts, (other than an alert issued by the President), consistent with section 2(b)(2)(E);</text></paragraph> 
<paragraph id="H71CED59BDB644DF59B3DF683430B94E"><enum>(6)</enum><text>for a process under which commercial mobile service providers can elect to transmit emergency alerts if—</text> 
<subparagraph id="H57E0D1B6EB56412CBCB38BD9E71E0823"><enum>(A)</enum><text>not all of the devices or equipment used by such provider are capable of receiving such alerts; or</text></subparagraph> 
<subparagraph id="HD4C627FB7B274F8B00198DCCA9D14247"><enum>(B)</enum><text>the provider cannot offer such alerts throughout the entirety of its service area; and</text></subparagraph></paragraph> 
<paragraph id="HBA0551D52D214BA99DDB86BDA4DB8098"><enum>(7)</enum><text>as otherwise necessary to enable electing commercial mobile service providers to transmit emergency alerts to subscribers.</text></paragraph></subsection> 
<subsection id="H271E70FD33DC45FF816467A81E2644D7"><enum>(d)</enum><header>Meetings</header> 
<paragraph id="H9B1B9570128D4AC88B5BFD7DE4F580E"><enum>(1)</enum><header>Initial meeting</header><text>The initial meeting of the Advisory Committee shall take place not later than 60 days after the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H2AB3C4F6264B4AD08F60916D96A5931B"><enum>(2)</enum><header>Other meetings</header><text>After the initial meeting, the Advisory Committee shall meet at the call of the chair.</text></paragraph> 
<paragraph id="HB2D574470EEB440188FE949D3BA83248"><enum>(3)</enum><header>Notice; open meetings</header><text>Any meetings held by the Advisory Committee shall be duly noticed at least 14 days in advance and shall be open to the public.</text></paragraph></subsection> 
<subsection id="HDA61C2201E4F427495F29BBA85E56054"><enum>(e)</enum><header>Rules</header> 
<paragraph id="H57F4044B870F4E15805CBF1700758D42"><enum>(1)</enum><header>Quorum</header><text>One-third of the members of the Advisory Committee shall constitute a quorum for conducting business of the Advisory Committee.</text></paragraph> 
<paragraph id="H8A73196351304D7D80F65DDE2FCD604E"><enum>(2)</enum><header>Subcommittees</header><text>To assist the Advisory Committee in carrying out its functions, the chair may establish appropriate subcommittees composed of members of the Advisory Committee and other subject matter experts as deemed necessary.</text></paragraph> 
<paragraph id="H3AE5FDA79382411B87BA7EEAD759D5C"><enum>(3)</enum><header>Additional rules</header><text>The Advisory Committee may adopt other rules as needed.</text></paragraph></subsection> 
<subsection id="H72E39055849D425AAF80F89767EC9444"><enum>(f)</enum><header><act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name></header><text>Neither the <act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5 U.S.C. App.) nor any rule, order, or regulation promulgated under that Act shall apply to the Commercial Mobile Service Alert Advisory Committee.</text></subsection> 
<subsection id="HA2EF7B5A1CDD48EA8CEA1CA42909142F"><enum>(g)</enum><header>Consultation with NIST</header><text>The Advisory Committee shall consult with the National Institute of Standards and Technology in its work on developing recommendations under subsections (c)(2) and (c)(3).</text></subsection></section> 
<section id="HF90189DD22B94971ADDEF6A863514CF8"><enum>4.</enum><header>Research and development</header> 
<subsection id="HDDF022BEA8F94F1EAC877DD2B017D7E3"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">The Undersecretary of Homeland Security for Science and Technology, in consultation with the director of the National Institute of Standards and Technology and the chairman of the Federal Communications Commission, shall establish a research, development, testing, and evaluation program based on the recommendations of the Commercial Mobile Service Alert Advisory Committee, established pursuant to section 3(a), to support the development of technologies to increase the number of commercial mobile service devices that can receive emergency alerts.</text></subsection> 
<subsection id="H4528B3F2B2F64100B3BA4C9F997B7DAC"><enum>(b)</enum><header>Functions</header><text>The program established under subsection (a) shall—</text> 
<paragraph id="H8FB477F77E014332904C14FCA0D5EA9D"><enum>(1)</enum><text>fund research, development, testing, and evaluation at academic institutions, private sector entities, government laboratories, and other appropriate entities; and</text></paragraph> 
<paragraph id="HC5243EB5075041068D24C9EC6D957700"><enum>(2)</enum><text>ensure that the program addresses, at a minimum—</text> 
<subparagraph id="H2DF40C8F7D9449DABE02CF14C1BC73AF"><enum>(A)</enum><text>developing innovative technologies that will transmit geographically targeted emergency alerts to the public; and</text></subparagraph> 
<subparagraph id="H3DD5A8E1A83648B0A6BA32D7E1C5BED2"><enum>(B)</enum><text>research on understanding and improving public response to warnings.</text></subparagraph></paragraph></subsection></section> 
<section id="H8E8EDE7A50354D94B3FBFFAFF3D375D"><enum>5.</enum><header>Grant program for remote community alert systems</header> 
<subsection id="H36A2C4AABD0C48F4A3E014DE061DC161"><enum>(a)</enum><header>Grant Program</header><text>The Undersecretary of Commerce for Oceans and Atmosphere, in consultation with the Secretary of Homeland Security, shall establish a program under which grants may be made to provide for outdoor alerting technologies in remote communities effectively unserved by commercial mobile service (as determined by the Federal Communications Commission within 180 days after the date of enactment of this Act) for the purpose of enabling residents of those communities to receive emergency alerts.</text></subsection> 
<subsection id="H2DB9C40DD59444BA9BBEFA79B89CA000"><enum>(b)</enum><header>Applications and Conditions</header><text>In conducting the program, the Undersecretary—</text> 
<paragraph id="H372A2725F2B049939842386294690678"><enum>(1)</enum><text>shall establish a notification and application procedure; and</text></paragraph> 
<paragraph id="HCEDC6DBEB2104BE7A47481EEF13FA15E"><enum>(2)</enum><text>may establish such conditions, and require such assurances, as may be appropriate to ensure the efficiency and integrity of the grant program.</text></paragraph></subsection> 
<subsection id="H0B1ECC7BDC7B4A369F3FFB2380011F5"><enum>(c)</enum><header>Sunset</header><text>The Undersecretary may not make grants under subsection (a) more than 5 years after the date of enactment of this Act.</text></subsection> 
<subsection id="H58841772232241D29080636817D61C8B"><enum>(d)</enum><header>Limitation</header><text>The sum of the amounts awarded for all fiscal years as grants under this section may not exceed $10,000,000.</text></subsection></section> 
<section id="HB411C75598CC4834970014035D084406"><enum>6.</enum><header>Funding</header> 
<subsection id="HAB6DC6BA3AF045C98D1C8D1378F87B31"><enum>(a)</enum><header>In General</header><text>In addition to any amounts provided by appropriation Acts, funding for this Act shall be provided from the Digital Transition and Public Safety Fund in accordance with section 3010 of the Digital Television Transition and Public Safety Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309</external-xref> note).</text></subsection> 
<subsection id="HFADE54DF09014D0EA120C554EBAD2DF5"><enum>(b)</enum><header>Compensation</header><text>The Assistant Secretary of Commerce for Communications and Information shall compensate any such broadcast station licensee or permittee for reasonable costs incurred in complying with the requirements imposed pursuant to section 2(c) from funds made available under this section. The Assistant Secretary shall ensure that sufficient funds are made available to effectuate geographically targeted alerts.</text></subsection> 
<subsection id="HD5E8C890079E42179FF22B0012006427"><enum>(c)</enum><header>Credit</header><text>The Assistant Secretary of Commerce for Communications and Information, in consultation with the Undersecretary of Homeland Security for Science and Technology and the Undersecretary of Commerce for Oceans and Atmosphere, may borrow from the Treasury beginning on October 1, 2006, such sums as may be necessary, but not to exceed $106,000,000, to implement this Act. The Assistant Secretary of Commerce for Communications and Information shall ensure that the Under Secretary of Homeland Security for Science and Technology and the Undersecretary of Commerce for Oceans and Atmosphere are provided adequate funds to carry out their responsibilities under sections 4 and 5 of this Act. The Treasury shall be reimbursed, without interest, from amounts in the Digital Television Transition and Public Safety Fund as funds are deposited into the Fund.</text></subsection></section>
