<subsection id="HB31473AEE81D4164A6BE7278283E2BFE"><enum>(b)</enum><header>Amendment of Office of National Drug Control Policy Reauthorization Act of 1998</header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/277">Public Law 105–277</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/21/1701">21 U.S.C. 1701 et seq.</external-xref>).</text></subsection>

<subparagraph id="HF15480B93ECD41C0A65300DF06E12C7B"><enum>(A)</enum><text>coordination and enhancement of Federal, State, local, and tribal law enforcement drug control efforts;</text></subparagraph> 
<subparagraph id="HF038D0831ABD4C9E9C54545F03D3C553"><enum>(B)</enum><text>coordination and enhancement of efforts among National Drug Control Program agencies and State, local, and tribal demand reduction and supply reduction agencies;</text></subparagraph> 
<subparagraph id="H508D672365214E8CB505C3A1D3699DA6"><enum>(C)</enum><text>coordination and enhancement of Federal, State, local, and tribal law enforcement initiatives to gather, analyze, and disseminate information and law enforcement intelligence relating to drug control among domestic law enforcement agencies; and</text></subparagraph> 
<subparagraph id="H37209F03B7AA490700B3C43DE493EF60"><enum>(D)</enum><text>other coordinated and joint initiatives among Federal, State, local, and tribal agencies to promote comprehensive drug control strategies designed to reduce the demand for, and the availability of, illegal drugs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDC390F6EE0224031AD90AA09CE5545F0"><enum>(f)</enum><header>Supply reduction</header><text>Section 702(11) is amended to read as follows:</text>

<paragraph id="H513EFCD510614DB99600C9D6249F6B8E"><enum>(11)</enum><header>Supply reduction</header><text>The term <term>supply reduction</term> means any activity or program conducted by a National Drug Control Program agency that is intended to reduce the availability or use of illegal drugs in the United States or abroad, including—</text> 
<subparagraph id="H669E548EE36640F8800084E600E36500"><enum>(A)</enum><text>law enforcement outside the United States;</text></subparagraph> 
<subparagraph id="H195375A3781D4ADBAEA6128103FFC300"><enum>(B)</enum><text>source country programs, including economic development programs primarily intended to reduce the production or trafficking of illicit drugs;</text></subparagraph> 
<subparagraph id="H8CBC0761157A4146BF5E719334A8F5C5"><enum>(C)</enum><text>activities to control international trafficking in, and availability of, illegal drugs, including—</text> 
<clause id="H1DAB5D4334034555B8561FA80E1798"><enum>(i)</enum><text>accurate assessment and monitoring of international drug production and interdiction programs and policies; and</text></clause> 
<clause id="H98CBCED81F6C41638735A147260027C8"><enum>(ii)</enum><text>coordination and promotion of compliance with international treaties relating to the production, transportation, or interdiction of illegal drugs;</text></clause></subparagraph> 
<subparagraph id="H8757990F7F0F42BD8CB91211007EB2EB"><enum>(D)</enum><text>activities to conduct and promote international law enforcement programs and policies to reduce the supply of drugs; and</text></subparagraph> 
<subparagraph id="H333966E685C74C8D83F98583BD067880"><enum>(E)</enum><text>activities to facilitate and enhance the sharing of domestic and foreign intelligence information among National Drug Control Program agencies, relating to the production and trafficking of drugs in the United States and in foreign countries.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD65FE2F8DE1C4042A0178539F812D890"><enum>(g)</enum><header>Definitions of appropriate congressional committees and law enforcement</header><text>Section 702 is amended by adding at the end the following:</text>

<paragraph id="H7F3592075B0A4A08B3623535394BCBAE"><enum>(12)</enum><header>Appropriate congressional committees</header><text>Except where otherwise provided, the term <term>appropriate congressional committees</term> means the Committee on the Judiciary, the Committee on Appropriations, and the Caucus on International Narcotics Control of the Senate and the Committee on Government Reform, the Committee on the Judiciary, and the Committee on Appropriations of the House of Representatives.</text></paragraph> 
<paragraph id="H4DC2C556BE4B44CA0098EA49EAB7DB05"><enum>(13)</enum><header>Law enforcement</header><text>The term <term>law enforcement</term> or <term>drug law enforcement</term> means all efforts by a Federal, State, local, or tribal government agency to enforce the drug laws of the United States or any State, including investigation, arrest, prosecution, and incarceration or other punishments or penalties.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H7E110DFCF0844F2ABE68DC6EABFBE41B"><enum>102.</enum><header>Establishment of the Office of National Drug Control Policy</header> 
<subsection id="HE70D29E7E35F41BF8797672DEE7CBB27"><enum>(a)</enum><header>Responsibilities</header><text>Section 703(a) is amended to read as follows:</text> 
<quoted-block id="H7C0EA333945B4B4A96395BBCE600B7C2" style="OLC"> 
<subsection id="H5269C639F2CD40EA8D44AEA86230DB7B"><enum>(a)</enum><header>Establishment of Office</header><text>There is established in the Executive Office of the President an Office of National Drug Control Policy, which shall—</text> 
<paragraph id="H020726B8AAD7434F9E2E2D92314F1870"><enum>(1)</enum><text>develop national drug control policy;</text></paragraph> 
<paragraph id="H93412472CF2A4713B89C006C1E77957C"><enum>(2)</enum><text>coordinate and oversee the implementation of the national drug control policy;</text></paragraph> 
<paragraph id="H05B1E464D6A44965BB97EF00A28341A7"><enum>(3)</enum><text>assess and certify the adequacy of National Drug Control Programs and the budget for those programs; and</text></paragraph> 
<paragraph id="H73B5CF0407F44E6BBBC7174FB495F36D"><enum>(4)</enum><text>evaluate the effectiveness of the national drug control policy and the National Drug Control Program agencies’ programs, by developing and applying specific goals and performance measurements.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0BB19EF37A2C4D618C4CBAC986516819"><enum>(b)</enum><header>Positions</header><text>Section 703(b) is amended to read as follows:</text>

<subsection id="HAE5EB87AE23C4DFA00CB8B517035897"><enum>(b)</enum><header>Director of National Drug Control Policy and Deputy Directors</header> 
<paragraph id="HD881656FDAB04065958F7BDC53833FD6"><enum>(1)</enum><header>Director</header><text>There shall be a Director of National Drug Control Policy who shall head the Office (referred to in this Act as the <quote>Director</quote>) and shall hold the same rank and status as the head of an executive department listed in <external-xref legal-doc="usc" parsable-cite="usc/5/101">section 101</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="H0487BD698A5342CB861E98CA43020709"><enum>(2)</enum><header>Deputy director</header><text>There shall be a Deputy Director of National Drug Control Policy who shall report directly to the Director (referred to in this Act as the <quote>Deputy Director</quote>).</text></paragraph> 
<paragraph id="HCC124B0E10C34680006C7E64B459DD6"><enum>(3)</enum><header>Other deputy directors</header> 
<subparagraph id="H4C87D22D88804C5EB8046199CD98CF36"><enum>(A)</enum><header>In general</header><text>There shall be a Deputy Director for Demand Reduction, a Deputy Director for Supply Reduction, and a Deputy Director for State, Local, and Tribal Affairs.</text></subparagraph> 
<subparagraph id="H0F2CC8EA9C9E4ECB0023D12FABF1EF2"><enum>(B)</enum><header>Reporting</header><text>The Deputy Director for Demand Reduction, the Deputy Director for Supply Reduction, and the Deputy Director for State, Local, and Tribal Affairs shall report directly to the Deputy Director of the Office of National Drug Control Policy.</text></subparagraph> 
<subparagraph id="H1123890AAA8241FCABE93D0273E12D5B"><enum>(C)</enum><header>Deputy director for demand reduction</header><text>The Deputy Director for Demand Reduction shall be responsible for the activities in subparagraphs (A) through (H) of section 702(l).</text></subparagraph> 
<subparagraph id="H7C6E92CDBD8F4D608587768C608DB85C"><enum>(D)</enum><header>Deputy director for supply reduction</header><text>The Deputy Director for Supply Reduction shall—</text> 
<clause id="H94DD8A9120984F579685F5F7E22CA8C"><enum>(i)</enum><text>have substantial experience and expertise in drug interdiction and other supply reduction activities; and</text></clause>

<paragraph id="H1BB07DB728FA4ADCB0F905CD99A95775"><enum>(19)</enum><text>shall submit an annual report to Congress detailing how the Office of National Drug Control Policy has consulted with and assisted State, local, and tribal governments with respect to the formulation and implementation of the National Drug Control Strategy and other relevant issues; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H208F27B7B3D14DBCBB39C8E092A3AA81"><enum>(20)</enum><text display-inline="yes-display-inline">shall, within 1 year after the date of the enactment of the Office of National Drug Control Policy Reauthorization Act of 2006, report to Congress on the impact of each Federal drug reduction strategy upon the availability, addiction rate, use rate, and other harms of illegal drugs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H01970F0D1E65440688B6BEEF85B43C0"><enum>(c)</enum><header>Review and certification of National Drug Control Program budget</header><text>Section 704(c)(3) is amended—</text> 
<paragraph id="H198FB863D6644E5E9534433561DD62C8"><enum>(1)</enum><text>in subparagraph (C)(iii), by inserting <quote>and the appropriate congressional committees,</quote> after <quote>House of Representatives</quote>; and</text></paragraph>

<paragraph id="H531567B31E794C508349C29ED0CA5C51"><enum>(5)</enum><header>Restrictions</header><text>The Director shall not issue a fund control notice to direct that all or part of an amount appropriated to the National Drug Control Program agency account be obligated, modified, or altered in any manner—</text> 
<subparagraph id="HCC0BE49785414AF79300194FA935FC3"><enum>(A)</enum><text>contrary, in whole or in part, to a specific appropriation; or</text></subparagraph> 
<subparagraph id="H994DE260E78E439EAA4E7723738C641B"><enum>(B)</enum><text>contrary, in whole or in part, to the expressed intent of Congress.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3A964A73354248EBBE11839596C6C23E"><enum>(f)</enum><header>Drug Interdiction</header> 
<paragraph id="HECC1E9D2C07F4607AD400607D6005F28"><enum>(1)</enum><header>In general</header><text>Section 711 is amended by adding at the end the following:</text>

<subsection id="H040ADBE01E6F47F9955556C2209B6800"><enum>(a)</enum><header>United States Interdiction Coordinator</header> 
<paragraph id="HF9BCBD4BA45D4FB70064ADF42E174591"><enum>(1)</enum><header>In general</header><text>The United States Interdiction Coordinator shall perform the duties of that position described in paragraph (2) and such other duties as may be determined by the Director with respect to coordination of efforts to interdict illicit drugs from entering the United States.</text></paragraph> 
<paragraph id="H6724848FBDE143DE9D164860B1825EFF"><enum>(2)</enum><header>Responsibilities</header><text>The United States Interdiction Coordinator shall be responsible to the Director for—</text> 
<subparagraph id="H9B6C9864D95341B78483E640A310AEA9"><enum>(A)</enum><text>coordinating the interdiction activities of the National Drug Control Program agencies to ensure consistency with the National Drug Control Strategy;</text></subparagraph> 
<subparagraph id="H958A093D46A24315B2C8EADBC395944"><enum>(B)</enum><text>on behalf of the Director, developing and issuing, on or before March 1 of each year and in accordance with paragraph (3), a National Interdiction Command and Control Plan to ensure the coordination and consistency described in subparagraph (A);</text></subparagraph> 
<subparagraph id="HE4113D9CB7B2461CA62346E3E7117F9D"><enum>(C)</enum><text>assessing the sufficiency of assets committed to illicit drug interdiction by the relevant National Drug Control Program agencies; and</text></subparagraph> 
<subparagraph id="HC1495203678F4C34A485D7288E9D6E7"><enum>(D)</enum><text>advising the Director on the efforts of each National Drug Control Program agency to implement the National Interdiction Command and Control Plan.</text></subparagraph></paragraph> 
<paragraph id="HE0D416C57911410B00E4FE0C105F602"><enum>(3)</enum><header>Staff</header><text>The Director shall assign such permanent staff of the Office as he considers appropriate to assist the United States Interdiction Coordinator to carry out the responsibilities described in paragraph (2), and may also, at his discretion, request that appropriate National Drug Control Program agencies detail or assign staff to the Office of Supply Reduction for that purpose.</text></paragraph> 
<paragraph id="H33922E05BB1E40B8AE5069B283B53304"><enum>(4)</enum><header>National interdiction command and control plan</header> 
<subparagraph id="HA86A8A4982594EFC00222D3DE4DAACFC"><enum>(A)</enum><header>Purposes</header><text>The National Interdiction Command and Control Plan shall—</text> 
<clause id="H2562419806DE48C1A6B7CDD1E4CCA12D"><enum>(i)</enum><text>set forth the Government’s strategy for drug interdiction;</text></clause> 
<clause id="H09F2BBB1345D47F790A4B1358004C85"><enum>(ii)</enum><text>state the specific roles and responsibilities of the relevant National Drug Control Program agencies for implementing that strategy; and</text></clause> 
<clause id="HC15BA6362DBC4520972696787D9165DA"><enum>(iii)</enum><text>identify the specific resources required to enable the relevant National Drug Control Program agencies to implement that strategy.</text></clause></subparagraph> 
<subparagraph id="H9842104F101948A79FFF297051A416C8"><enum>(B)</enum><header>Consultation with other agencies</header><text>The United States Interdiction Coordinator shall issue the National Interdiction Command and Control Plan in consultation with the other members of the Interdiction Committee described in subsection (b).</text></subparagraph> 
<subparagraph id="H01131755926B492BB2CF6C47A6317068"><enum>(C)</enum><header>Limitation</header><text>The National Interdiction Command and Control Plan shall not change existing agency authorities or the laws governing interagency relationships, but may include recommendations about changes to such authorities or laws.</text></subparagraph> 
<subparagraph id="H0A0FDF7E0CC245B98222B4B62359D3FF"><enum>(D)</enum><header>Report to congress</header><text>On or before March 1 of each year, the United States Interdiction Coordinator shall provide a report on behalf of the Director to the appropriate congressional committees, to the Committee on Armed Services and the Committee on Homeland Security of the House of Representatives, and to the Committee on Homeland Security and Governmental Affairs and the Committee on Armed Services of the Senate, which shall include—</text> 
<clause id="HD999269A7D244A7999CABA67A7E9D9F"><enum>(i)</enum><text>a copy of that year’s National Interdiction Command and Control Plan;</text></clause> 
<clause id="HC22B088709E94731A9CE01FC61460084"><enum>(ii)</enum><text>information for the previous 10 years regarding the number and type of seizures of drugs by each National Drug Control Program agency conducting drug interdiction activities, as well as statistical information on the geographic areas of such seizures; and</text></clause> 
<clause id="H8E664017A6CF403A8234953EABB91C91"><enum>(iii)</enum><text>information for the previous 10 years regarding the number of air and maritime patrol hours undertaken by each National Drug Control Program agency conducting drug interdiction activities, as well as statistical information on the geographic areas in which such patrol hours took place.</text></clause></subparagraph> 
<subparagraph id="HFDB5502D848A4854833794D29F66F18"><enum>(E)</enum><header>Treatment of classified or law enforcement sensitive information</header><text>Any content of the report described in subparagraph (D) that involves information classified under criteria established by an Executive order, or the public disclosure of which, as determined by the Director, the Director of National Intelligence, or the head of any Federal Government agency the activities of which are described in the plan, would be detrimental to the law enforcement or national security activities of any Federal, State, or local agency, shall be presented to Congress separately from the rest of the report.</text></subparagraph></paragraph></subsection> 
<subsection id="H2E6648AF5BD34FB69217C18D37002BBE"><enum>(b)</enum><header>Interdiction Committee</header> 
<paragraph id="H43FB30A3B5F54846B410EF82C22C0100"><enum>(1)</enum><header>In general</header><text>The Interdiction Committee shall meet to—</text> 
<subparagraph id="HC8A802B8AF3D46E29BD6A2BC73C039D"><enum>(A)</enum><text>discuss and resolve issues related to the coordination, oversight and integration of international, border, and domestic drug interdiction efforts in support of the National Drug Control Strategy;</text></subparagraph> 
<subparagraph id="H89EB4F54206D40A2AD00B507BAAAB96B"><enum>(B)</enum><text>review the annual National Interdiction Command and Control Plan, and provide advice to the Director and the United States Interdiction Coordinator concerning that plan; and</text></subparagraph> 
<subparagraph id="H7F74D5B546F74DDF8D7776B1935647E0"><enum>(C)</enum><text>provide such other advice to the Director concerning drug interdiction strategy and policies as the committee determines is appropriate.</text></subparagraph></paragraph> 
<paragraph id="HC84B2DAA60204159A3A45000EFFDF547"><enum>(2)</enum><header>Chairman</header><text>The Director shall designate one of the members of the Interdiction Committee to serve as chairman.</text></paragraph> 
<paragraph id="H893AAF909AEE49E483C74BFBF86C0038"><enum>(3)</enum><header>Meetings</header><text>The members of the Interdiction Committee shall meet, in person and not through any delegate or representative, at least once per calendar year, prior to March 1. At the call of either the Director or the current chairman, the Interdiction Committee may hold additional meetings, which shall be attended by the members either in person, or through such delegates or representatives as they may choose.</text></paragraph> 
<paragraph id="H3AFC5548F91347CFA59667EFDF5E95F5"><enum>(4)</enum><header>Report</header><text>Not later than September 30 of each year, the chairman of the Interdiction Committee shall submit a report to the Director and to the appropriate congressional committees describing the results of the meetings and any significant findings of the Committee during the previous 12 months. Any content of such a report that involves information classified under criteria established by an Executive order, or whose public disclosure, as determined by the Director, the chairman, or any member, would be detrimental to the law enforcement or national security activities of any Federal, State, local, or tribal agency, shall be presented to Congress separately from the rest of the report. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H87E7BC4B6ECF40CCB316258C3DDE9398"><enum>(2)</enum><header>Conforming Amendment to Homeland Security Act of 2002</header><text>Section 878 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/458">6 U.S.C. 458</external-xref>) is amended—</text> 
<subparagraph id="H1B38120A9B9548A59BA5C0240048F3D1"><enum>(A)</enum><text>in subsection (c), by striking <quote>Except as provided in subsection (d), the</quote> and inserting <quote>The</quote>; and</text></subparagraph>

<subparagraph id="H07343FF4FFF44900810832DC9600AD32"><enum>(B)</enum><header>Secretary of Homeland Security</header><text>Not later than July 1 of each year, the Secretary of Homeland Security shall submit to the Director and the appropriate congressional committees information for the preceding year regarding—</text> 
<clause id="HE7E66C5404074EBF8521C5CF4DA0C7F8"><enum>(i)</enum><text>the number and type of seizures of drugs by each component of the Department of Homeland Security seizing drugs, as well as statistical information on the geographic areas of such seizures; and</text></clause> 
<clause id="H2754CEC1B21A4FB7AF52FFF67200F1E4"><enum>(ii)</enum><text>the number of air and maritime patrol hours primarily dedicated to drug supply reduction missions undertaken by each component of the Department of Homeland Security.</text></clause></subparagraph> 
<subparagraph id="H1B1A4B98A3134DC9A134C4F94BC529E"><enum>(C)</enum><header>Secretary of Defense</header><text>The Secretary of Defense shall, by July 1 of each year, submit to the Director and the appropriate congressional committees information for the preceding year regarding the number of air and maritime patrol hours primarily dedicated to drug supply reduction missions undertaken by each component of the Department of Defense.</text></subparagraph> 
<subparagraph id="HB250F556618A40B1BCD22BCBAD28F399"><enum>(D)</enum><header>Attorney general</header><text>The Attorney General shall, by July 1 of each year, submit to the Director and the appropriate congressional committees information for the preceding year regarding the number and type of—</text>

If an activity has both drug control and nondrug control purposes or applications, the department, agency, or program shall estimate by a documented calculation the total funds requested for that activity that would be used for drug control, and shall set forth in its request the basis and method for making the estimate.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8C144F059286408094AC222D60D91459"><enum>(b)</enum><header>National drug control budget proposal</header> 
<paragraph id="HF03A6E9ED70D41C89B249F34FDEA8D91"><enum>(1)</enum><header>National organizations</header><text>Section 704(c)(2) is amended by inserting <quote>and the head of each major national organization that represents law enforcement officers, agencies, or associations</quote> after <quote>agency</quote>.</text></paragraph> 
<paragraph id="H07624B5E57194683ABD2A5D2FDDE8B1"><enum>(2)</enum><header>Total budget</header><text>Section 704(c)(2)(A) is amended by inserting before the semicolon: <quote>and to inform Congress and the public about the total amount proposed to be spent on all supply reduction, demand reduction, State, local, and tribal affairs, including any drug law enforcement, and other drug control activities by the Federal Government, which shall conform to the content requirements set forth in paragraph (1)(C)</quote>.</text></paragraph></subsection>

<clause id="H9E4D89D2BB2646AAB8E9931D15E47668"><enum>(v)</enum><text>requests funding for drug treatment activities that do not adequately support and enhance Federal drug treatment programs and capacity;</text></clause> 
<clause id="H81D075F120504B468007530500757F25"><enum>(vi)</enum><text>requests funding for fiscal year 2007 for activities of the Department of Education, unless it is accompanied by a report setting forth a plan for providing expedited consideration of student loan applications for all individuals who submitted an application for any Federal grant, loan, or work assistance that was rejected or denied pursuant to 484(r)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(r)(1)</external-xref>) by reason of a conviction for a drug-related offense not occurring during a period of enrollment for which the individual was receiving any Federal grant, loan, or work assistance; and</text></clause> 
<clause id="HC5A32D41391C4B4B0045A3DA69E9E80"><enum>(vii)</enum><text>requests funding for the operations and management of the Department of Homeland Security that does not include a specific request for funds for the Office of Counternarcotics Enforcement to carry out its responsibilities under section 878 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/458">6 U.S.C. 458</external-xref>).</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<section id="H036F037459A547B1B87751D2B3997E9E"><enum>201.</enum><header>Annual preparation and submission of National Drug Control Strategy</header><text display-inline="no-display-inline">Section 706 is amended to read as follows:</text>

<subsection id="HB9EAB2F4B6C54D54AAE677FF273C3796"><enum>(a)</enum><header>Timing, contents, and process for development and submission of National Drug Control Strategy</header> 
<paragraph id="H481FF8C1013E49BD956FD6BEB4581D8F"><enum>(1)</enum><header>Timing</header><text>Not later than February 1 of each year, the President shall submit to Congress a National Drug Control Strategy, which shall set forth a comprehensive plan for the year to reduce illicit drug use and the consequences of such illicit drug use in the United States by limiting the availability of, and reducing the demand for, illegal drugs.</text></paragraph> 
<paragraph id="H7579E818C69F46E5A781BAFE99C9F053"><enum>(2)</enum><header>Contents</header> 
<subparagraph id="H81635A5AE1C140F79EE23827D6C8622"><enum>(A)</enum><header>In general</header><text>The National Drug Control Strategy submitted under paragraph (1) shall include the following:</text> 
<clause id="H4CCAD8E80AC54200BCF9F33DC014D236"><enum>(i)</enum><text>Comprehensive, research-based, long-range, quantifiable goals for reducing illicit drug use and the consequences of illicit drug use in the United States.</text></clause> 
<clause id="H39FDB0F097E9480D864336DDC5C001D"><enum>(ii)</enum><text>Annual quantifiable and measurable objectives and specific targets to accomplish long-term quantifiable goals that the Director determines may be achieved during each year beginning on the date on which the National Drug Control Strategy is submitted.</text></clause> 
<clause id="HE8608FF1C08B4D24BC9386E3FEB3EE7"><enum>(iii)</enum><text>A 5-year projection for program and budget priorities.</text></clause> 
<clause id="H5E3167364F294064AA328E376F095515"><enum>(iv)</enum><text>A review of international, State, local, and private sector drug control activities to ensure that the United States pursues coordinated and effective drug control at all levels of government.</text></clause> 
<clause id="H615E536E1E914241933D9600FBA185E4"><enum>(v)</enum><text>An assessment of current illicit drug use (including inhalants and steroids) and availability, impact of illicit drug use, and treatment availability, which assessment shall include—</text> 
<subclause id="H5B18D52C1438437300FFBC04D5361E7E"><enum>(I)</enum><text>estimates of drug prevalence and frequency of use as measured by national, State, and local surveys of illicit drug use and by other special studies of nondependent and dependent illicit drug use;</text></subclause> 
<subclause id="H2D2779D79CED40008345171CA22988C8"><enum>(II)</enum><text>illicit drug use in the workplace and the productivity lost by such use; and</text></subclause> 
<subclause id="HAF8ECDD1155B4854B880C638817EA85"><enum>(III)</enum><text>illicit drug use by arrestees, probationers, and parolees.</text></subclause></clause> 
<clause id="H803EAE511C2F4363B9742273D3CD6752"><enum>(vi)</enum><text>An assessment of the reduction of illicit drug availability, as measured by—</text> 
<subclause id="H1420696E3EC94F37AC9115B31CADA035"><enum>(I)</enum><text>the quantities of cocaine, heroin, marijuana, methamphetamine, ecstasy, and other drugs available for consumption in the United States;</text></subclause> 
<subclause id="HE1D89B28548A444B9E3CF51E8F8FFCD9"><enum>(II)</enum><text>the amount of marijuana, cocaine, heroin, methamphetamine, ecstasy, and precursor chemicals and other drugs entering the United States;</text></subclause> 
<subclause id="HBA017A37AAAD4C97A547AE07607BC52F"><enum>(III)</enum><text>the number of illicit drug manufacturing laboratories seized and destroyed and the number of hectares of marijuana, poppy, and coca cultivated and destroyed domestically and in other countries;</text></subclause> 
<subclause id="HE17D14B1A76245459900D58CD005DF9"><enum>(IV)</enum><text>the number of metric tons of marijuana, heroin, cocaine, and methamphetamine seized and other drugs; and</text></subclause> 
<subclause id="H9CA14FD75100475EBD851E49501D1FF3"><enum>(V)</enum><text>changes in the price and purity of heroin, methamphetamine, and cocaine, changes in the price of ecstasy, and changes in tetrahydrocannabinol level of marijuana and other drugs.</text></subclause></clause> 
<clause id="HF1712DE09B47420782F2000056ECD1D3"><enum>(vii)</enum><text>An assessment of the reduction of the consequences of illicit drug use and availability, which shall include—</text> 
<subclause id="HBF16E224673640C2BAE1AFDDD941CA66"><enum>(I)</enum><text>the burden illicit drug users placed on hospital emergency departments in the United States, such as the quantity of illicit drug-related services provided;</text></subclause> 
<subclause id="H3045E74C977E4031B79E730298B08F6"><enum>(II)</enum><text>the annual national health care cost of illicit drug use; and</text></subclause> 
<subclause id="H9C3E4704A99640EC8EE1B73006F9CFD"><enum>(III)</enum><text>the extent of illicit drug-related crime and criminal activity.</text></subclause></clause> 
<clause id="HF6C1D6BF0A75451A8DE7646713378328"><enum>(viii)</enum><text>A determination of the status of drug treatment in the United States, by assessing—</text> 
<subclause id="HFE2E818379834E2DBBC485B93665FBA4"><enum>(I)</enum><text>public and private treatment utilization; and</text></subclause> 
<subclause id="HB630A6425A2B4042AB8CB2A7C3ACA2C"><enum>(II)</enum><text>the number of illicit drug users the Director estimates meet diagnostic criteria for treatment.</text></subclause></clause> 
<clause id="H4C375933515C4D30A1BD6575DDE7E1BE"><enum>(ix)</enum><text>A review of the research agenda of the Counterdrug Technology Assessment Center to reduce the availability and abuse of drugs.</text></clause> 
<clause id="HA91EDE5FA0DD49D998E7F838F7F0000"><enum>(x)</enum><text>A summary of the efforts made to coordinate with private sector entities to conduct private research and development of medications to treat addiction by—</text> 
<subclause id="H837E53A36ABF4FB69ED981F7572F0094"><enum>(I)</enum><text>screening chemicals for potential therapeutic value;</text></subclause> 
<subclause id="H8A71965544AE421095C1E39308C8AC00"><enum>(II)</enum><text>developing promising compounds;</text></subclause> 
<subclause id="HBB0B3D645E5C4CC8A324A018ACBB0000"><enum>(III)</enum><text>conducting clinical trials;</text></subclause> 
<subclause id="H90A098B458AD492CA782764899D47947"><enum>(IV)</enum><text>seeking Food and Drug Administration approval for drugs to treat addiction;</text></subclause> 
<subclause id="H99BCF0B5C8914760A4C76B8BFB87981B"><enum>(V)</enum><text>marketing the drug for the treatment of addiction;</text></subclause> 
<subclause id="HC2C8A8E3F5804A1FA5DC74BEC86F9C55"><enum>(VI)</enum><text>urging physicians to use the drug in the treatment of addiction; and</text></subclause> 
<subclause id="H0408CDDFE9064B3991315EA8E5F15C6B"><enum>(VII)</enum><text>encouraging insurance companies to reimburse the cost of the drug for the treatment of addiction.</text></subclause></clause> 
<clause id="HD45C3DB49DA543D283D0898666EE5802"><enum>(xi)</enum><text>An assessment of Federal effectiveness in achieving the National Drug Control Strategy for the previous year, including a specific evaluation of whether the objectives and targets for reducing illicit drug use for the previous year were met and reasons for the success or failure of the previous year’s Strategy.</text></clause> 
<clause id="HD2582CBDA4BA4938B17F6E4CE68CCAFD"><enum>(xii)</enum><text>A general review of the status of, and trends in, demand reduction activities by private sector entities and community-based organizations, including faith-based organizations, to determine their effectiveness and the extent of cooperation, coordination, and mutual support between such entities and organizations and Federal, State, local, and tribal government agencies.</text></clause> 
<clause id="H0CF79A4F982C4FE697A8B4747B7CF8E6"><enum>(xiii)</enum><text>Such additional statistical data and information as the Director considers appropriate to demonstrate and assess trends relating to illicit drug use, the effects and consequences of illicit drug use (including the effects on children of substance abusers), supply reduction, demand reduction, drug-related law enforcement, and the implementation of the National Drug Control Strategy.</text></clause> 
<clause id="HDCA8F3EADE2541D798EF6E7877DF1FA3"><enum>(xiv)</enum><text>A supplement reviewing the activities of each individual National Drug Control Program agency during the previous year with respect to the National Drug Control Strategy and the Director’s assessment of the progress of each National Drug Control Program agency in meeting its responsibilities under the National Drug Control Strategy.</text></clause></subparagraph> 
<subparagraph id="H0A061F4B0834462C93EFDE114E901B37"><enum>(B)</enum><header>Classified information</header><text>Any contents of the National Drug Control Strategy that involve information properly classified under criteria established by an Executive order shall be presented to Congress separately from the rest of the National Drug Control Strategy.</text></subparagraph> 
<subparagraph id="HA2EA9993CF184BC6B26D02000002676C"><enum>(C)</enum><header>Selection of data and information</header><text>In selecting data and information for inclusion under subparagraph (A), the Director shall ensure—</text> 
<clause id="HC2E0A7DD200A4035A5B40573BDE8E457"><enum>(i)</enum><text>the inclusion of data and information that will permit analysis of current trends against previously compiled data and information where the Director believes such analysis enhances long-term assessment of the National Drug Control Strategy; and</text></clause> 
<clause id="HA44B730B70194533B7DD3DC9B0A953FB"><enum>(ii)</enum><text>the inclusion of data and information to permit a standardized and uniform assessment of the effectiveness of drug treatment programs in the United States.</text></clause></subparagraph></paragraph> 
<paragraph id="H7992D04C5AA24BA4A278F1749098F89E"><enum>(3)</enum><header>Process for development and submission</header><text>In developing and effectively implementing the National Drug Control Strategy, the Director—</text> 
<subparagraph id="H27466970A4544E3A9BC5C1E07DB27851"><enum>(A)</enum><text>shall consult with—</text> 
<clause id="HBEBD8A731510493CB8A8545884B7A167"><enum>(i)</enum><text>the heads of the National Drug Control Program agencies;</text></clause> 
<clause id="H4814D25BB8E2476384221381C1DE02DB"><enum>(ii)</enum><text>Congress;</text></clause> 
<clause id="H92E08778FB604EA3A2B8C96501AFDCC"><enum>(iii)</enum><text>State, local, and tribal officials;</text></clause> 
<clause id="HAE60303F554A475A9C622129CFD7CC9C"><enum>(iv)</enum><text>private citizens and organizations, including community and faith-based organizations with experience and expertise in demand reduction;</text></clause> 
<clause id="HD2EBAE5254894378B8F846CDDF00C1C1"><enum>(v)</enum><text>private citizens and organizations with experience and expertise in supply reduction; and</text></clause> 
<clause id="HC24BCF2E4C1E42B982271550F9BCDD00"><enum>(vi)</enum><text>appropriate representatives of foreign governments;</text></clause></subparagraph> 
<subparagraph id="HA269ED6C01AF48CEAA49E6C4151C2E31"><enum>(B)</enum><text>in satisfying the requirements of subparagraph (A), shall ensure, to the maximum extent possible, that State, local, and tribal officials and relevant private organizations commit to support and take steps to achieve the goals and objectives of the National Drug Control Strategy;</text></subparagraph> 
<subparagraph id="HBC132881B5F544F08E356C72663996F6"><enum>(C)</enum><text>with the concurrence of the Attorney General, may require the El Paso Intelligence Center to undertake specific tasks or projects to support or implement the National Drug Control Strategy; and</text></subparagraph> 
<subparagraph id="HF5CA6490E5824A50AA5FBF62EEF0000"><enum>(D)</enum><text>with the concurrence of the Director of National Intelligence and the Attorney General, may request that the National Drug Intelligence Center undertake specific tasks or projects to support or implement the National Drug Control Strategy.</text></subparagraph></paragraph></subsection> 
<subsection id="H55795E50880D4D5BACB2AAB9CFA77903"><enum>(b)</enum><header>Submission of revised strategy</header><text>The President may submit to Congress a revised National Drug Control Strategy that meets the requirements of this section—</text> 
<paragraph id="HCBE9C3891C194449B852E8BAE3E2251"><enum>(1)</enum><text>at any time, upon a determination of the President, in consultation with the Director, that the National Drug Control Strategy in effect is not sufficiently effective; or</text></paragraph> 
<paragraph id="H12252E1C6B0049099B5E3518CB02805F"><enum>(2)</enum><text>if a new President or Director takes office.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H17225453F30C4ACDB3C4D0E079502769"><enum>202.</enum><header>Performance measurements</header><text display-inline="no-display-inline">Section 706 is amended by adding at the end the following:</text> 
<quoted-block id="H0711FED427244241B079F2CC00FA7D8F" style="OLC"> 
<subsection id="H575B714073FB45D98639FDD787CE21EF"><enum>(c)</enum><header>Performance measurement system</header><text>Not later than February 1 of each year, the Director shall submit to Congress as part of the National Drug Control Strategy, a description of a national drug control performance measurement system, that—</text> 
<paragraph id="HCA4981E6FFEB4E2CA785D385CCFCC25C"><enum>(1)</enum><text>develops 2-year and 5-year performance measures and targets for each National Drug Control Strategy goal and objective established for reducing drug use, availability, and the consequences of drug use;</text></paragraph> 
<paragraph id="HE13ED3D6A1DF444BB2C19C0739F0105B"><enum>(2)</enum><text>describes the sources of information and data that will be used for each performance measure incorporated into the performance measurement system;</text></paragraph> 
<paragraph id="H5CB6F55238B34373A22CC3ECFEA81B14"><enum>(3)</enum><text>identifies major programs and activities of the National Drug Control Program agencies that support the goals and annual objectives of the National Drug Control Strategy;</text></paragraph> 
<paragraph id="HD373AE0044CD45C0B167B3D5155181B7"><enum>(4)</enum><text>evaluates the contribution of demand reduction and supply reduction activities as defined in section 702 implemented by each National Drug Control Program agency in support of the National Drug Control Strategy;</text></paragraph> 
<paragraph id="H0DF4C11F825F483B97F0659560AC6DC0"><enum>(5)</enum><text>monitors consistency between the drug-related goals and objectives of the National Drug Control Program agencies and ensures that each agency’s goals and budgets support and are fully consistent with the National Drug Control Strategy; and</text></paragraph> 
<paragraph id="H3685329AA6864E4EA60064B3F100F200"><enum>(6)</enum><text>coordinates the development and implementation of national drug control data collection and reporting systems to support policy formulation and performance measurement, including an assessment of—</text> 
<subparagraph id="H99E35A95486649B58F5F80B5083C818E"><enum>(A)</enum><text>the quality of current drug use measurement instruments and techniques to measure supply reduction and demand reduction activities;</text></subparagraph> 
<subparagraph id="H362C179CB86947B0BBE3BBDD52D56A5"><enum>(B)</enum><text>the adequacy of the coverage of existing national drug use measurement instruments and techniques to measure the illicit drug user population, and groups that are at risk for illicit drug use;</text></subparagraph> 
<subparagraph id="H5798FFDB14614B9FB7599E4490FE7469"><enum>(C)</enum><text>the adequacy of the coverage of existing national treatment outcome monitoring systems to measure the effectiveness of drug abuse treatment in reducing illicit drug use and criminal behavior during and after the completion of substance abuse treatment; and</text></subparagraph> 
<subparagraph id="H20992BAC05F642A386A9EAE6B2F6980"><enum>(D)</enum><text>the actions the Director shall take to correct any deficiencies and limitations identified pursuant to subparagraphs (A) and (B) of this subsection.</text></subparagraph></paragraph></subsection> 
<subsection id="H3548D4F4AFCB412CA6D3BAEFA4FAB4A7"><enum>(d)</enum><header>Modifications</header><text>A description of any modifications made during the preceding year to the national drug performance measurement system described in subsection (c) shall be included in each report submitted under subsection (b).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC04BC01EC5D849C49CE0C6CC3C8465AF"><enum>203.</enum><header>Annual report requirement</header> 
<subsection id="H90FFCB1787BF419C865FBEE977C5FE52"><enum>(a)</enum><header>In general</header><text>On or before February 1 of each year, the Director shall submit a report to Congress that describes—</text> 
<paragraph id="H551A7EFFBA9744CC94B68483738F5B42"><enum>(1)</enum><text>the strategy of the national media campaign and whether specific objectives of the campaign were accomplished;</text></paragraph> 
<paragraph id="H0B640BEB53204A5CB9F5EE7E9DAA3C"><enum>(2)</enum><text>steps taken to ensure that the national media campaign operates in an effective and efficient manner consistent with the overall strategy and focus of the campaign;</text></paragraph> 
<paragraph id="H15D058106623480AA518C5D9A8041B79"><enum>(3)</enum><text>plans to purchase advertising time and space;</text></paragraph> 
<paragraph id="H7B88997F47E544C69D7E4CE674055588"><enum>(4)</enum><text>policies and practices implemented to ensure that Federal funds are used responsibly to purchase advertising time and space and eliminate the potential for waste, fraud, and abuse;</text></paragraph> 
<paragraph id="H3E02DA31A98044BE94FA569692D17086"><enum>(5)</enum><text>all contracts entered into with a corporation, partnership, or individual working on behalf of the national media campaign;</text></paragraph> 
<paragraph id="HCEC0E6F9C2D047C9A47749001974EE95"><enum>(6)</enum><text>specific policies and steps implemented to ensure compliance with title IV of this Act;</text></paragraph> 
<paragraph id="H078F2A48A18B48738E1598834D056203"><enum>(7)</enum><text>steps taken to ensure that the national media campaign will secure, to the maximum extent possible, no cost matches of advertising time and space or in-kind contributions that are directly related to the campaign in accordance with title IV of this Act; and</text></paragraph> 
<paragraph id="H24F88223E6624B16A5F524C57232BC14"><enum>(8)</enum><text>a review and evaluation of the effectiveness of the national media campaign strategy for the past year.</text></paragraph></subsection> 
<subsection id="HABAFF02B53D2462ABF716E87CFDF0470"><enum>(b)</enum><header>Audit</header><text>The Government Accountability Office shall, at a frequency of not less than once per year—</text> 
<paragraph id="H310B1C2A7C6143528F9C7C6CEBA2AADC"><enum>(1)</enum><text>conduct and supervise an audit and investigation relating to the programs and operations of the—</text> 
<subparagraph id="H510E2C4ADC8F4612B1CC9733AA5B00BC"><enum>(A)</enum><text>Office; or</text></subparagraph> 
<subparagraph id="H117B8279AB4E49BBAA46499700C15FFB"><enum>(B)</enum><text>certain programs within the Office, including—</text> 
<clause id="H6979DA7E4907495FB748A5704300EAC"><enum>(i)</enum><text>the High Intensity Drug Trafficking Areas Program;</text></clause> 
<clause id="H04AEAACD38514F46AE40004800E4C1C6"><enum>(ii)</enum><text>the Counterdrug Technology Assessment Center; or</text></clause> 
<clause id="HEFDDB55C9202428BBFEB66B2A394EFBD"><enum>(iii)</enum><text>the National Youth Anti-drug Media Campaign; and</text></clause></subparagraph></paragraph> 
<paragraph id="H77FA6C0E5300421B88E469BE512B41E3"><enum>(2)</enum><text>provide the Director and the appropriate congressional committees with a report containing an evaluation of and recommendations on the—</text> 
<subparagraph id="H6AFD443D2F10486EB000ED9AD1CB510"><enum>(A)</enum><text>policies and activities of the programs and operations subject to the audit and investigation;</text></subparagraph> 
<subparagraph id="H307C6B0E9C19436E00FF30DDDA8BE2B5"><enum>(B)</enum><text>economy, efficiency, and effectiveness in the administration of the reviewed programs and operations; and</text></subparagraph> 
<subparagraph id="HDB3E1B49487C49458CF00082C3FF2D08"><enum>(C)</enum><text>policy or management changes needed to prevent and detect fraud and abuse in such programs and operations.</text></subparagraph></paragraph></subsection></section></title> 
<title id="H287B748E856748098E1DCF617957B3B"><enum>III</enum><header>High intensity drug trafficking areas </header> 
<section id="H33EE70459B9D4657B60422C7AF81D557"><enum>301.</enum><header>High Intensity Drug Trafficking Areas Program</header><text display-inline="no-display-inline">Section 707 is amended to read as follows:</text>

<section id="HDE3E185E634C419199B081256DB03700"><enum>707.</enum><header>High Intensity Drug Trafficking Areas Program</header> 
<subsection id="H89B82C1E7921430C00DA004DACE3A634"><enum>(a)</enum><header>Establishment</header> 
<paragraph id="H88A9583CBBCE4EDF88055D69643D4256"><enum>(1)</enum><header>In general</header><text>There is established in the Office a program to be known as the High Intensity Drug Trafficking Areas Program (in this section referred to as the <quote>Program</quote>).</text></paragraph> 
<paragraph id="HB36FD8471B5547E9827B15EEA46C00BB"><enum>(2)</enum><header>Purpose</header><text>The purpose of the Program is to reduce drug trafficking and drug production in the United States by—</text> 
<subparagraph id="HBD245748A29741E7A549F858C55B98BB"><enum>(A)</enum><text>facilitating cooperation among Federal, State, local, and tribal law enforcement agencies to share information and implement coordinated enforcement activities;</text></subparagraph> 
<subparagraph id="HAF7D0CFF81004316AF32006335358653"><enum>(B)</enum><text>enhancing law enforcement intelligence sharing among Federal, State, local, and tribal law enforcement agencies;</text></subparagraph> 
<subparagraph id="HB52F588DC5DF4DD0A2CCD39CA6008D78"><enum>(C)</enum><text>providing reliable law enforcement intelligence to law enforcement agencies needed to design effective enforcement strategies and operations; and</text></subparagraph> 
<subparagraph id="H3E58EE0D64D34B208519EA8C051BBE4F"><enum>(D)</enum><text>supporting coordinated law enforcement strategies which maximize use of available resources to reduce the supply of illegal drugs in designated areas and in the United States as a whole.</text></subparagraph></paragraph></subsection> 
<subsection id="H6665D19CCA214E949C89E1DD20E9D078"><enum>(b)</enum><header>Designation</header> 
<paragraph id="H7177B1756F1B44839D8F55B2B9F2168"><enum>(1)</enum><header>In general</header><text>The Director, in consultation with the Attorney General, the Secretary of the Treasury, the Secretary of Homeland Security, heads of the National Drug Control Program agencies, and the Governor of each applicable State, may designate any specified area of the United States as a high intensity drug trafficking area.</text></paragraph> 
<paragraph id="H00BA3C7E29EB4631ABC8636920601C5D"><enum>(2)</enum><header>Activities</header><text>After making a designation under paragraph (1) and in order to provide Federal assistance to the area so designated, the Director may—</text> 
<subparagraph id="H4E9F1AE176E64B4BBBF26793289993D3"><enum>(A)</enum><text>obligate such sums as are appropriated for the Program;</text></subparagraph> 
<subparagraph id="HE3320A1E61BB4B36A2C208298FA272F8"><enum>(B)</enum><text>direct the temporary reassignment of Federal personnel to such area, subject to the approval of the head of the department or agency that employs such personnel;</text></subparagraph> 
<subparagraph id="H42D6885C97B748F600497273B73B800"><enum>(C)</enum><text>take any other action authorized under section 704 to provide increased Federal assistance to those areas; and</text></subparagraph> 
<subparagraph id="H35B8294588E742BC96F25B758C55B546"><enum>(D)</enum><text>coordinate activities under this section (specifically administrative, recordkeeping, and funds management activities) with State, local, and tribal officials.</text></subparagraph></paragraph></subsection> 
<subsection id="H96F0570C135B479282EB86C933A93DE1"><enum>(c)</enum><header>Petitions for designation</header><text>The Director shall establish regulations under which a coalition of interested law enforcement agencies from an area may petition for designation as a high intensity drug trafficking area. Such regulations shall provide for a regular review by the Director of the petition, including a recommendation regarding the merit of the petition to the Director by a panel of qualified, independent experts.</text></subsection> 
<subsection id="HE22B0A1B593645C88074977F20282D06"><enum>(d)</enum><header>Factors for consideration</header><text>In considering whether to designate an area under this section as a high intensity drug trafficking area, the Director shall consider, in addition to such other criteria as the Director considers to be appropriate, the extent to which—</text> 
<paragraph id="H568ACA9E28E14F409DF30289AE926BF"><enum>(1)</enum><text>the area is a significant center of illegal drug production, manufacturing, importation, or distribution;</text></paragraph> 
<paragraph id="H033558FFB53643F5BB554563F8896978"><enum>(2)</enum><text>State, local, and tribal law enforcement agencies have committed resources to respond to the drug trafficking problem in the area, thereby indicating a determination to respond aggressively to the problem;</text></paragraph> 
<paragraph id="H7B7987AFB45C4606B77E005133147F9B"><enum>(3)</enum><text>drug-related activities in the area are having a significant harmful impact in the area, and in other areas of the country; and</text></paragraph> 
<paragraph id="HE139A35DBF484F7B0069483BAF4E88A6"><enum>(4)</enum><text>a significant increase in allocation of Federal resources is necessary to respond adequately to drug-related activities in the area.</text></paragraph></subsection> 
<subsection id="H10FF20734168423DB1A93CB7ED2F2958"><enum>(e)</enum><header>Organization of high intensity drug trafficking areas</header> 
<paragraph id="H3252BC3E706E44E2AC70CFC0343C8E50"><enum>(1)</enum><header>Executive Board and officers</header><text>To be eligible for funds appropriated under this section, each high intensity drug trafficking area shall be governed by an Executive Board. The Executive Board shall designate a chairman, vice chairman, and any other officers to the Executive Board that it determines are necessary.</text></paragraph> 
<paragraph id="H10331F97E9A14ED1AED7423206879687"><enum>(2)</enum><header>Responsibilities</header><text>The Executive Board of a high intensity drug trafficking area shall be responsible for—</text> 
<subparagraph id="HAF5930D9930B470700A6BC4C93F178BF"><enum>(A)</enum><text>providing direction and oversight in establishing and achieving the goals of the high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="HA634AE5CDF114C25B9C59046924F6971"><enum>(B)</enum><text>managing the funds of the high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="H2494EF0ABCC7468EACCF01BDEA6EF374"><enum>(C)</enum><text>reviewing and approving all funding proposals consistent with the overall objective of the high intensity drug trafficking area; and</text></subparagraph> 
<subparagraph id="H300E9BB003A34D0BA1D171E4F5E51756"><enum>(D)</enum><text>reviewing and approving all reports to the Director on the activities of the high intensity drug trafficking area.</text></subparagraph></paragraph> 
<paragraph id="HD62371F605D2434AB65FCB5F44E0CAA"><enum>(3)</enum><header>Board representation</header><text>None of the funds appropriated under this section may be expended for any high intensity drug trafficking area, or for a partnership or region of a high intensity drug trafficking area, if the Executive Board for such area, region, or partnership, does not apportion an equal number of votes between representatives of participating Federal agencies and representatives of participating State, local, and tribal agencies. Where it is impractical for an equal number of representatives of Federal agencies and State, local, and tribal agencies to attend a meeting of an Executive Board in person, the Executive Board may use a system of proxy votes or weighted votes to achieve the voting balance required by this paragraph.</text></paragraph> 
<paragraph id="H63B04065FBD045088D27E6C03400F6D"><enum>(4)</enum><header>No agency relationship</header><text>The eligibility requirements of this section are intended to ensure the responsible use of Federal funds. Nothing in this section is intended to create an agency relationship between individual high intensity drug trafficking areas and the Federal Government.</text></paragraph></subsection> 
<subsection id="HE0B814D962AB423D9190CACDD25885E6"><enum>(f)</enum><header>Use of funds</header><text>The Director shall ensure that no Federal funds appropriated for the Program are expended for the establishment or expansion of drug treatment programs, and shall ensure that not more than 5 percent of the Federal funds appropriated for the Program are expended for the establishment of drug prevention programs.</text></subsection> 
<subsection id="H4B574B3B2FE14AA2BEBD3C6977DD99F7"><enum>(g)</enum><header>Counterterrorism activities</header> 
<paragraph id="H42981073DF6B447286F10061277F9281"><enum>(1)</enum><header>Assistance authorized</header><text>The Director may authorize use of resources available for the Program to assist Federal, State, local, and tribal law enforcement agencies in investigations and activities related to terrorism and prevention of terrorism, especially but not exclusively with respect to such investigations and activities that are also related to drug trafficking.</text></paragraph> 
<paragraph id="H1858C61AB0F946E6B8F9157138FD0035"><enum>(2)</enum><header>Limitation</header><text>The Director shall ensure—</text> 
<subparagraph id="HD17A85BF089843D3A3F15C9D406200B6"><enum>(A)</enum><text>that assistance provided under paragraph (1) remains incidental to the purpose of the Program to reduce drug availability and carry out drug-related law enforcement activities; and</text></subparagraph> 
<subparagraph id="H50E6DBB4293D497E82AACD4C2B1993E4"><enum>(B)</enum><text>that significant resources of the Program are not redirected to activities exclusively related to terrorism, except on a temporary basis under extraordinary circumstances, as determined by the Director.</text></subparagraph></paragraph></subsection> 
<subsection id="HBFC4E20CF12A42DC9872D8CDF5E2C80"><enum>(h)</enum><header>Role of Drug Enforcement Administration</header><text>The Director, in consultation with the Attorney General, shall ensure that a representative of the Drug Enforcement Administration is included in the Intelligence Support Center for each high intensity drug trafficking area.</text></subsection> 
<subsection id="H2E2CD87FC3C74F319543EDD51CD365A5"><enum>(i)</enum><header>Annual HIDTA program budget submissions</header><text>As part of the documentation that supports the President’s annual budget request for the Office, the Director shall submit to Congress a budget justification that includes—</text> 
<paragraph id="H28A83D8E71AD42AE877224D7E742CB9D"><enum>(1)</enum><text>the amount proposed for each high intensity drug trafficking area, conditional upon a review by the Office of the request submitted by the HIDTA and the performance of the HIDTA, with supporting narrative descriptions and rationale for each request;</text></paragraph> 
<paragraph id="H27A6B6881DA74FAEAC57DBB300DCEC6B"><enum>(2)</enum><text>a detailed justification that explains—</text> 
<subparagraph id="H6C96170864C543579B7BE6B776AE36FB"><enum>(A)</enum><text>the reasons for the proposed funding level; how such funding level was determined based on a current assessment of the drug trafficking threat in each high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="H20B0117A49904FC788D60002BF42FD3F"><enum>(B)</enum><text>how such funding will ensure that the goals and objectives of each such area will be achieved; and</text></subparagraph> 
<subparagraph id="H4A2DF0D5BE33405986AABE0905F70000"><enum>(C)</enum><text>how such funding supports the National Drug Control Strategy; and</text></subparagraph></paragraph> 
<paragraph id="H98DC8159DA78476BB112F9E392926123"><enum>(3)</enum><text>the amount of HIDTA funds used to investigate and prosecute organizations and individuals trafficking in methamphetamine in the prior calendar year, and a description of how those funds were used.</text></paragraph></subsection> 
<subsection id="HCD8E534FB48443F99E9904A902BB24F"><enum>(j)</enum><header>Emerging threat response fund</header> 
<paragraph id="HA7CEFB19FA414ED4924935A8738D4D48"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations, the Director may expend up to 10 percent of the amounts appropriated under this section on a discretionary basis, to respond to any emerging drug trafficking threat in an existing high intensity drug trafficking area, or to establish a new high intensity drug trafficking area or expand an existing high intensity drug trafficking area, in accordance with the criteria established under paragraph (2).</text></paragraph> 
<paragraph id="HCCD1BA62F74343F99720C228C5273DA6"><enum>(2)</enum><header>Consideration of impact</header><text>In allocating funds under this subsection, the Director shall consider—</text> 
<subparagraph id="HB22D552F081141398CB26C43DDEC24B"><enum>(A)</enum><text>the impact of activities funded on reducing overall drug traffic in the United States, or minimizing the probability that an emerging drug trafficking threat will spread to other areas of the United States; and</text></subparagraph> 
<subparagraph id="HF72C630FEF324E0F884D6CAEE1D1DD57"><enum>(B)</enum><text>such other criteria as the Director considers appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="HEC79062ECE214CAEBDC0F5928D411B04"><enum>(k)</enum><header>Evaluation</header> 
<paragraph id="HE3BB1F5E32DB4C82AD068F40EF306619"><enum>(1)</enum><header>Initial report</header><text>Not later than 90 days after the date of the enactment of this section, the Director shall, after consulting with the Executive Boards of each designated high intensity drug trafficking area, submit a report to Congress that describes, for each designated high intensity drug trafficking area—</text> 
<subparagraph id="HE3E469F09E5A4782B2010800DDB2F490"><enum>(A)</enum><text>the specific purposes for the high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="HCA70E410BFE84AE4BD29EF091B884DDB"><enum>(B)</enum><text>the specific long-term and short-term goals and objectives for the high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="HC03BB98B4DF04D4AB3BD1CB20C23E47"><enum>(C)</enum><text>the measurements that will be used to evaluate the performance of the high intensity drug trafficking area in achieving the long-term and short-term goals; and</text></subparagraph> 
<subparagraph id="H5BC86D66EDA34FC4B57142B79F69F551"><enum>(D)</enum><text>the reporting requirements needed to evaluate the performance of the high intensity drug trafficking area in achieving the long-term and short-term goals.</text></subparagraph></paragraph> 
<paragraph id="H3DFEB596F5BE419384588288E9348B83"><enum>(2)</enum><header>Evaluation of HIDTA program as part of national drug control strategy</header><text>For each designated high intensity drug trafficking area, the Director shall submit, as part of the annual National Drug Control Strategy report, a report that—</text> 
<subparagraph id="H44463603619047DF82E6B05670E41E00"><enum>(A)</enum><text>describes—</text> 
<clause id="HACAAF016C1FC4E3299EE87C18E290063"><enum>(i)</enum><text>the specific purposes for the high intensity drug trafficking area; and</text></clause> 
<clause id="H7D8DCCE7235941DE9993265B81EC81FB"><enum>(ii)</enum><text>the specific long-term and short-term goals and objectives for the high intensity drug trafficking area; and</text></clause></subparagraph> 
<subparagraph id="HD8D986BB3FFA4018A42297517CAB4261"><enum>(B)</enum><text>includes an evaluation of the performance of the high intensity drug trafficking area in accomplishing the specific long-term and short-term goals and objectives identified under paragraph (1)(B).</text></subparagraph></paragraph></subsection> 
<subsection id="HF7C5F8367A924CB49073305ED3E127F0"><enum>(l)</enum><header>Assessment of drug enforcement task forces in high intensity drug trafficking areas</header><text>Not later than 1 year after the date of enactment of this subsection, and as part of each subsequent annual National Drug Control Strategy report, the Director shall submit to Congress a report—</text> 
<paragraph id="H84B4FE0C866E481B885B99BC1F80673E"><enum>(1)</enum><text>assessing the number and operation of all federally funded drug enforcement task forces within each high intensity drug trafficking area; and</text></paragraph> 
<paragraph id="H16A87A17FDEB4B2F9E573DB06D645CE"><enum>(2)</enum><text>describing—</text> 
<subparagraph id="H96FF8F24042A420BBAF3768438EC20F6"><enum>(A)</enum><text>each Federal, State, local, and tribal drug enforcement task force operating in the high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="H884232D8ED7C4F26B695903F14432419"><enum>(B)</enum><text>how such task forces coordinate with each other, with any high intensity drug trafficking area task force, and with investigations receiving funds from the Organized Crime and Drug Enforcement Task Force;</text></subparagraph> 
<subparagraph id="HB32800696ABD43CDB161CF0094AB3012"><enum>(C)</enum><text>what steps, if any, each such task force takes to share information regarding drug trafficking and drug production with other federally funded drug enforcement task forces in the high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="HAD8114F4411548398188E7BFC564EE6"><enum>(D)</enum><text>the role of the high intensity drug trafficking area in coordinating the sharing of such information among task forces;</text></subparagraph> 
<subparagraph id="H1DB0C8C25878482DA682B16B67F21D1"><enum>(E)</enum><text>the nature and extent of cooperation by each Federal, State, local, and tribal participant in ensuring that such information is shared among law enforcement agencies and with the high intensity drug trafficking area;</text></subparagraph> 
<subparagraph id="HB31325E91CF0463CBF6D4DE39F00962F"><enum>(F)</enum><text>the nature and extent to which information sharing and enforcement activities are coordinated with joint terrorism task forces in the high intensity drug trafficking area; and</text></subparagraph> 
<subparagraph id="H8A2E2684212446F19456B4FC1E75C04"><enum>(G)</enum><text>any recommendations for measures needed to ensure that task force resources are utilized efficiently and effectively to reduce the availability of illegal drugs in the high intensity drug trafficking areas.</text></subparagraph></paragraph></subsection> 
<subsection id="H1EC57A1C774744C191D1AC1413514B48"><enum>(m)</enum><header>Assessment of Law Enforcement Intelligence Sharing in High Intensity Drug Trafficking Areas program</header><text>Not later than 180 days after the date of the enactment of this section, and as part of each subsequent annual National Drug Control Strategy report, the Director, in consultation with the Director of National Intelligence, shall submit to Congress a report—</text> 
<paragraph id="HF5B15C1D620E417BBAC915B91F4DEA00"><enum>(1)</enum><text>evaluating existing and planned law enforcement intelligence systems supported by each high intensity drug trafficking area, or utilized by task forces receiving any funding under the Program, including the extent to which such systems ensure access and availability of law enforcement intelligence to Federal, State, local, and tribal law enforcement agencies within the high intensity drug trafficking area and outside of it;</text></paragraph> 
<paragraph id="HB6766915646943289FE5A5A2F0D6B302"><enum>(2)</enum><text>the extent to which Federal, State, local, and tribal law enforcement agencies participating in each high intensity drug trafficking area are sharing law enforcement intelligence information to assess current drug trafficking threats and design appropriate enforcement strategies; and</text></paragraph> 
<paragraph id="HE5881D9C42B545948BCD00008728CF11"><enum>(3)</enum><text>the measures needed to improve effective sharing of information and law enforcement intelligence regarding drug trafficking and drug production among Federal, State, local, and tribal law enforcement participating in a high intensity drug trafficking area, and between such agencies and similar agencies outside the high intensity drug trafficking area.</text></paragraph></subsection> 
<subsection id="H9B6D18F48C654328A4FC48DF6332A329"><enum>(n)</enum><header>Coordination of law enforcement intelligence sharing with Organized Crime Drug Enforcement Task Force program</header><text>The Director, in consultation with the Attorney General, shall ensure that any drug enforcement intelligence obtained by the Intelligence Support Center for each high intensity drug trafficking area is shared, on a timely basis, with the drug intelligence fusion center operated by the Organized Crime Drug Enforcement Task Force of the Department of Justice.</text></subsection> 
<subsection id="HF9054B2EB6CD4017BE1EBEF6D6C77249"><enum>(o)</enum><header>Use of funds To combat methamphetamine trafficking</header> 
<paragraph id="H6E069CE5AD60479B9F956EBCC2B144C6"><enum>(1)</enum><header>Requirement</header><text>As part of the documentation that supports the President’s annual budget request for the Office, the Director shall submit to Congress a report describing the use of HIDTA funds to investigate and prosecute organizations and individuals trafficking in methamphetamine in the prior calendar year.</text></paragraph> 
<paragraph id="H8AC3B4E93842410CABFFF79943C9E55"><enum>(2)</enum><header>Contents</header><text>The report shall include—</text> 
<subparagraph id="HEF573B91A8DB4666BE9233E87C6F66"><enum>(A)</enum><text>the number of methamphetamine manufacturing facilities discovered through HIDTA-funded initiatives in the previous fiscal year;</text></subparagraph> 
<subparagraph id="HE614A69AE9AB442CB2B33F1B4374AAF8"><enum>(B)</enum><text>the amounts of methamphetamine or listed chemicals (as that term is defined in section 102(33) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(33)</external-xref>) seized by HIDTA-funded initiatives in the area during the previous year; and</text></subparagraph> 
<subparagraph id="H9025CF435D714DFF811C96FFAF64C05"><enum>(C)</enum><text>law enforcement intelligence and predictive data from the Drug Enforcement Administration showing patterns and trends in abuse, trafficking, and transportation in methamphetamine and listed chemicals.</text></subparagraph></paragraph> 
<paragraph id="H94F0653D08234C720079386DCFF08070"><enum>(3)</enum><header>Certification</header><text>Before the Director awards any funds to a high intensity drug trafficking area, the Director shall certify that the law enforcement entities participating in that HIDTA are providing laboratory seizure data to the national clandestine laboratory database at the El Paso Intelligence Center.</text></paragraph></subsection> 
<subsection id="HFCB73E2D572B4B9499DC462067C9F498"><enum>(p)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Office of National Drug Control Policy to carry out this section—</text>

<section id="H3D21AF0286E042A28332347853A2AF69"><enum>302.</enum><header>Funding for certain high intensity drug trafficking areas</header> 
<subsection id="H8E38672A3F28446A9B9F118B95064627"><enum>(a)</enum><header>Short Title</header><text>This section may be cited as the <quote>Dawson Family Community Protection Act</quote>.</text></subsection> 
<subsection id="H5A731F56317047F7B5D2E67CAEB8D0A0"><enum>(b)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="HE87942B2C1B048C293785945976C2FB7"><enum>(1)</enum><text>In the early morning hours of October 16, 2002, the home of Carnell and Angela Dawson was firebombed in apparent retaliation for Mrs. Dawson’s notification to police about persistent drug distribution activity in their East Baltimore City neighborhood.</text></paragraph> 
<paragraph id="H7AB1975B08C24EE3A6C19F6272E1B8E3"><enum>(2)</enum><text>The arson claimed the lives of Mr. and Mrs. Dawson and their 5 young children, aged 9 to 14.</text></paragraph> 
<paragraph id="H8ED8378EB8C849DFBA8B61CCEEE20078"><enum>(3)</enum><text>The horrific murder of the Dawson family is a stark example of domestic narco-terrorism.</text></paragraph> 
<paragraph id="H8FB06D51BB764F8898FAD727D17D4B7"><enum>(4)</enum><text>In all phases of counternarcotics law enforcement—from prevention to investigation to prosecution to reentry—the voluntary cooperation of ordinary citizens is a critical component.</text></paragraph> 
<paragraph id="H787845D552BF4E2C9B51E672BD55D900"><enum>(5)</enum><text>Voluntary cooperation is difficult for law enforcement officials to obtain when citizens feel that cooperation carries the risk of violent retaliation by illegal drug trafficking organizations and their affiliates.</text></paragraph> 
<paragraph id="HDFB8285B29604139BAECAC7E58BFB400"><enum>(6)</enum><text>Public confidence that law enforcement is doing all it can to make communities safe is a prerequisite for voluntary cooperation among people who may be subject to intimidation or reprisal (or both).</text></paragraph> 
<paragraph id="H0B94B7BA95604DD291C400A76003F3C3"><enum>(7)</enum><text>Witness protection programs are insufficient on their own to provide security because many individuals and families who strive every day to make distressed neighborhoods livable for their children, other relatives, and neighbors will resist or refuse offers of relocation by local, State, and Federal prosecutorial agencies and because, moreover, the continued presence of strong individuals and families is critical to preserving and strengthening the social fabric in such communities.</text></paragraph> 
<paragraph id="H3962B17DC2294AD0BF1400447544681E"><enum>(8)</enum><text>Where (as in certain sections of Baltimore City) interstate trafficking of illegal drugs has severe ancillary local consequences within areas designated as high intensity drug trafficking areas, it is important that supplementary High Intensity Drug Trafficking Areas Program funds be committed to support initiatives aimed at making the affected communities safe for the residents of those communities and encouraging their cooperation with tribal, local, State, and Federal law enforcement efforts to combat illegal drug trafficking.</text></paragraph></subsection> 
<subsection id="H6030DFEA30374346AA60AE8D8D45A2A5"><enum>(c)</enum><header>Funding for Certain High Intensity Drug Trafficking Areas</header><text>Section 707, as amended by section 301, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H8A04697EA97F402BB600BBD6A16BF36D" style="OLC"> 
<subsection id="H4BD8B5AAFBBB4A54A7CFC0304E0AF6B"><enum>(q)</enum><header>Specific Purposes</header> 
<paragraph id="H71B9B1D3F37C4B2897A0669D3BAF293F"><enum>(1)</enum><header>In general</header><text>The Director shall ensure that, of the amounts appropriated for a fiscal year for the Program, at least $7,000,000 is used in high intensity drug trafficking areas with severe neighborhood safety and illegal drug distribution problems.</text></paragraph> 
<paragraph id="HB549B00EE05748F08D916B3B69853559"><enum>(2)</enum><header>Required uses</header><text>The funds used under paragraph (1) shall be used—</text> 
<subparagraph id="H01B364C015AB4FB88FC0ED53ED60849E"><enum>(A)</enum><text>to ensure the safety of neighborhoods and the protection of communities, including the prevention of the intimidation of potential witnesses of illegal drug distribution and related activities; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA9CFC67C941E4FC2A9E49B127F0019BC"><enum>(B)</enum><text>to combat illegal drug trafficking through such methods as the Director considers appropriate, such as establishing or operating (or both) a toll-free telephone hotline for use by the public to provide information about illegal drug-related activities.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HD13085FB5EC14C34A17204811533697F"><enum>303.</enum><header>Assessment</header><text display-inline="no-display-inline">The Director shall assess the ability of the HIDTA Program to respond to the so-called <quote>balloon effect</quote>, whereby urban drug traffickers facing intensive law enforcement efforts expand and spread their trafficking and distribution into rural, suburban, and smaller urban areas by conducting a demonstration project examining the ability of the New York/New Jersey HIDTA, with its new single colocated Organized Crime and Drug Enforcement Task Force/High Intensity Drug Trafficking Area Strike Force and HIDTA Regional Intelligence Center, to address the movement of drug traffickers into the more rural, suburban, and smaller areas encompassed by the counties of Albany, Onondaga, Monroe, and Erie in New York State and by annexing these counties into the existing New York/New Jersey HIDTA.</text></section></title>

<subparagraph id="H660C2D127E9F4892B28D35A255A573E4"><enum>(E)</enum><text>chemical, biological, radiological (including neutron and electron), and other means of detection;</text></subparagraph></paragraph> 
<paragraph id="HC166E3F06775432580008B2C0080D6F0"><enum>(2)</enum><text>identify demand reduction basic and applied research needs and initiatives, in consultation with affected National Drug Control Program agencies, including—</text> 
<subparagraph id="HA8BDDBB4A12B41AC9957A04F54CB8693"><enum>(A)</enum><text>improving treatment through neuroscientific advances;</text></subparagraph> 
<subparagraph id="H4BBAD72CC4DF42E7B600924F004BAFA8"><enum>(B)</enum><text>improving the transfer of biomedical research to the clinical setting; and</text></subparagraph> 
<subparagraph id="H9DD3185A9BA746338200AEBDED35D6C8"><enum>(C)</enum><text>in consultation with the National Institute of Drug Abuse and the Substance Abuse and Mental Health Services Administration, and through interagency agreements or grants, examining addiction and rehabilitation research and the application of technology to expanding the effectiveness and availability of drug treatment;</text></subparagraph></paragraph> 
<paragraph id="H0F93B23FAFA34C79B2847BFFB0E16127"><enum>(3)</enum><text>make a priority ranking of such needs identified in paragraphs (1) and (2) according to fiscal and technological feasibility, as part of a National Counterdrug Research and Development Program;</text></paragraph> 
<paragraph id="H9F9DC14423D045F8AAB3B60783CE3C16"><enum>(4)</enum><text>oversee and coordinate counterdrug technology initiatives with related activities of other Federal civilian and military departments;</text></paragraph> 
<paragraph id="H6A77308E26774DF2A6A9A877C7545365"><enum>(5)</enum><text>provide support to the development and implementation of the national drug control performance measurement system established under subsection (c) of section 706; and</text></paragraph> 
<paragraph id="HC75FD2B9E2CC4003A4EC775C50921FDA"><enum>(6)</enum><text>pursuant to the authority of the Director of National Drug Control Policy under section 704, submit requests to Congress for the reprogramming or transfer of funds appropriated for counterdrug technology research and development.</text></paragraph></subsection> 
<subsection id="H51537CBEDA3047079D62DFCB164D69CD"><enum>(d)</enum><header>Limitation on Authority</header><text>The authority granted to the Director under this section shall not extend to the awarding of contracts, management of individual projects, or other operational activities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

<paragraph id="HA830DC15E88B419087DE8E231122BF8E"><enum>(1)</enum><header>Program</header><text>The Chief Scientist, with the advice and counsel of experts from State, local, and tribal law enforcement agencies, shall be responsible to the Director for coordination and implementation of a counterdrug technology transfer program.</text></paragraph> 
<paragraph id="H68619C6EE5454285A4C9AEEE5CFDA572"><enum>(2)</enum><header>Purpose</header><text>The purpose of the Technology Transfer Program shall be for the Counterdrug Technology Assessment Center to transfer technology and associated training directly to State, local, and tribal law enforcement agencies.</text></paragraph> 
<paragraph id="H8563E0470FEB425EBAFE4CAA325E6783"><enum>(3)</enum><header>Priority of receipts</header><text>Transfers shall be made in priority order based on—</text> 
<subparagraph id="HDF5CF32624E14EDBBDB39F60079CF77E"><enum>(A)</enum><text>the need of potential recipients for such technology;</text></subparagraph> 
<subparagraph id="H0E934977FCD347E5BC78FA48FBA2D5ED"><enum>(B)</enum><text>the effectiveness of the technology to enhance current counterdrug activities of potential recipients; and</text></subparagraph> 
<subparagraph id="HB12D85995F9E491C8100F11EA0002F08"><enum>(C)</enum><text>the ability and willingness of potential recipients to evaluate transferred technology.</text></subparagraph></paragraph> 
<paragraph id="H47EE1EC894C24857A521E4C97FF0C4D9"><enum>(4)</enum><header>Agreement authority</header><text>The Director may enter into an agreement with the Secretary of Homeland Security to transfer technology with both counterdrug and homeland security applications to State, local, and tribal law enforcement agencies on a reimbursable basis.</text></paragraph> 
<paragraph id="H091F0EF91DDE43949E706400A199DCD3"><enum>(5)</enum><header>Report</header><text>On or before July 1 of each year, the Director shall submit a report to the appropriate congressional committees that addresses the following:</text> 
<subparagraph id="HB945650410364E5DA773CBE577E94D95"><enum>(A)</enum><text>The number of requests received during the previous 12 months, including the identity of each requesting agency and the type of technology requested.</text></subparagraph> 
<subparagraph id="HE989A656592C4B8CAAABFA04FE813173"><enum>(B)</enum><text>The number of requests fulfilled during the previous 12 months, including the identity of each recipient agency and the type of technology transferred.</text></subparagraph> 
<subparagraph id="HF12BB4E681F441F691E87EC6FAB8078"><enum>(C)</enum><text>A summary of the criteria used in making the determination on what requests were funded and what requests were not funded, except that such summary shall not include specific information on any individual requests.</text></subparagraph> 
<subparagraph id="H10B57006AF0C4FA18DF6DBE45479B7A5"><enum>(D)</enum><text>A general assessment of the future needs of the program, based on expected changes in threats, expected technologies, and likely need from potential recipients.</text></subparagraph> 
<subparagraph id="H62D67D87D2754CDB816F10514F09ADC6"><enum>(E)</enum><text>An assessment of the effectiveness of the technologies transferred, based in part on the evaluations provided by the recipients, with a recommendation whether the technology should continue to be offered through the program.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subparagraph id="H4D2C10599AF4454BB435E928821B00C2"><enum>(G)</enum><text>Partnerships with professional and civic groups, community-based organizations, including faith-based organizations, and government organizations related to the national media campaign.</text></subparagraph> 
<subparagraph id="H93C65A55C39848B9ABCDDC5BC44F5129"><enum>(H)</enum><text>Entertainment industry outreach, interactive outreach, media projects and activities, public information, news media outreach, and corporate sponsorship and participation.</text></subparagraph> 
<subparagraph id="H7D5701596C6D48AFACF0848C9DAE4974"><enum>(I)</enum><text>Operational and management expenses.</text></subparagraph></paragraph> 
<paragraph id="HD9B7262CE8AB44A2856DFF3DAEC2A1C9"><enum>(2)</enum><header>Specific requirements</header> 
<subparagraph id="H29259FDE42D4419AAE00E9C5C3BF7CA9"><enum>(A)</enum><header>Creative services</header> 
<clause id="HEFF238411B0B48E49211749297EC9931"><enum>(i)</enum><text>In using amounts for creative and talent costs under paragraph (1)(B), the Director shall use creative services donated at no cost to the Government (including creative services provided by the Partnership for a Drug-Free America) wherever feasible and may only procure creative services for advertising—</text> 
<subclause id="HD2B98DA14B36438A934D74CCA6C3BCDD"><enum>(I)</enum><text>responding to high-priority or emergent campaign needs that cannot timely be obtained at no cost; or</text></subclause> 
<subclause id="H7295256A7AFE4888903386D8A5A9E800"><enum>(II)</enum><text>intended to reach a minority, ethnic, or other special audience that cannot reasonably be obtained at no cost; or</text></subclause> 
<subclause id="HF191E5F2F9574C4C81FCDEFCAA3BAD2C"><enum>(III)</enum><text>the Director determines that the Partnership for a Drug-Free America is unable to provide, pursuant to subsection (d)(2)(B).</text></subclause></clause> 
<clause id="HD1943E9FC89B4B4DB11E004D9413607B"><enum>(ii)</enum><text>Subject to the availability of appropriations, no more than $1,500,000 may be expended under this section each fiscal year on creative services, except that the Director may expend up to $2,000,000 in a fiscal year on creative services to meet urgent needs of the national media campaign with advance approval from the Committee on Appropriations of the Senate and of the House of Representatives upon a showing of the circumstances causing such urgent needs of the national media campaign.</text></clause></subparagraph> 
<subparagraph id="H30A9B2C41DE6489184C25E2E79FD9BB"><enum>(B)</enum><header>Testing and evaluation of advertising</header><text>In using amounts for testing and evaluation of advertising under paragraph (1)(D), the Director shall test all advertisements prior to use in the national media campaign to ensure that the advertisements are effective and meet industry-accepted standards. The Director may waive this requirement for advertisements using no more than 10 percent of the purchase of advertising time purchased under this section in a fiscal year and no more than 10 percent of the advertising space purchased under this section in a fiscal year, if the advertisements respond to emergent and time-sensitive campaign needs or the advertisements will not be widely utilized in the national media campaign.</text></subparagraph> 
<subparagraph id="HAA2079EDFDF74144B48978186E316D17"><enum>(C)</enum><header>Evaluation of effectiveness of media campaign</header><text>In using amounts for the evaluation of the effectiveness of the national media campaign under paragraph (1)(E), the Director shall—</text> 
<clause id="HFC3564C6BAFF4A518CAAD91C8F21D7FA"><enum>(i)</enum><text>designate an independent entity to evaluate by April 20 of each year the effectiveness of the national media campaign based on data from—</text> 
<subclause id="H8350329654734BDCBF41CEF409A0B733"><enum>(I)</enum><text>the Monitoring the Future Study published by the Department of Health and Human Services;</text></subclause> 
<subclause id="H8812396831C44479A1494B35D41EEC38"><enum>(II)</enum><text>the Attitude Tracking Study published by the Partnership for a Drug-Free America;</text></subclause> 
<subclause id="HE373049A7D754EB08334016364D91163"><enum>(III)</enum><text>the National Household Survey on Drug Abuse; and</text></subclause> 
<subclause id="H0E9770AD637541EEAD1CF936B4920072"><enum>(IV)</enum><text>other relevant studies or publications, as determined by the Director, including tracking and evaluation data collected according to marketing and advertising industry standards; and</text></subclause></clause> 
<clause id="HEBCA4874C28241E98CB9005EA146D3F9"><enum>(ii)</enum><text>ensure that the effectiveness of the national media campaign is evaluated in a manner that enables consideration of whether the national media campaign has contributed to reduction of illicit drug use among youth and such other measures of evaluation as the Director determines are appropriate.</text></clause></subparagraph></paragraph> 
<paragraph id="H1320F7A7FEDB460AB4D6D74D4D8F49DB"><enum>(3)</enum><header>Purchase of advertising time and space</header><text>Subject to the availability of appropriations, for each fiscal year, not less than 77 percent of the amounts appropriated under this section shall be used for the purchase of advertising time and space for the national media campaign, subject to the following exceptions:</text> 
<subparagraph id="HD9EE33D583D94789A6D21B4642B08424"><enum>(A)</enum><text>In any fiscal year for which less than $125,000,000 is appropriated for the national media campaign, not less than 72 percent of the amounts appropriated under this section shall be used for the purchase of advertising time and space for the national media campaign.</text></subparagraph> 
<subparagraph id="H54864683075741D09937238E54C17F46"><enum>(B)</enum><text>In any fiscal year for which more than $195,000,000 is appropriated under this section, not less than 82 percent shall be used for advertising production costs and the purchase of advertising time and space for the national media campaign.</text></subparagraph></paragraph></subsection> 
<subsection id="H4A1DD6F8074F405DA62DD4D888FE3800"><enum>(c)</enum><header>Advertising</header><text>In carrying out this section, the Director shall ensure that sufficient funds are allocated to meet the stated goals of the national media campaign.</text></subsection> 
<subsection id="HACFEAF1321B94AD2938CD9CD19037DC3"><enum>(d)</enum><header>Division of Responsibilities and Functions Under the Program</header> 
<paragraph id="H32937FD851844AE1902697673BEB24C8"><enum>(1)</enum><header>In general</header><text>The Director, in consultation with the Partnership for a Drug-Free America, shall determine the overall purposes and strategy of the national media campaign.</text></paragraph> 
<paragraph id="H8B8501D3DC2943D38CBD3E0090A878"><enum>(2)</enum><header>Responsibilities</header> 
<subparagraph id="H0F09A7F181864562A412B55CCE09EEB"><enum>(A)</enum><header>Director</header><text>The Director shall be responsible for implementing a focused national media campaign to meet the purposes set forth in subsection (a), and shall approve—</text> 
<clause id="H6E48AD83F32D4771881633E7E4FBAC94"><enum>(i)</enum><text>the strategy of the national media campaign;</text></clause> 
<clause id="H4FED98265DC24BD900FC469B30CEEF4F"><enum>(ii)</enum><text>all advertising and promotional material used in the national media campaign; and</text></clause> 
<clause id="H580FCAF0CC564911A286DD149989A939"><enum>(iii)</enum><text>the plan for the purchase of advertising time and space for the national media campaign.</text></clause></subparagraph> 
<subparagraph id="HBD99024F39E64AB7966DB32B6F033C26"><enum>(B)</enum><header>The partnership for a drug-free america</header><text>The Director shall request that the Partnership for a Drug-Free America—</text> 
<clause id="HCF0728438FF8400AA6EC1400B8917B32"><enum>(i)</enum><text>develop and recommend strategies to achieve the goals of the national media campaign, including addressing national and local drug threats in specific regions or States, such as methamphetamine and ecstasy;</text></clause> 
<clause id="H056A45F8585C4D4480F50362E156DC01"><enum>(ii)</enum><text>create all advertising to be used in the national media campaign, except advertisements that are—</text> 
<subclause id="H4D5AF30808FD42E293AED02249BD17CA"><enum>(I)</enum><text>provided by other nonprofit entities pursuant to subsection (f);</text></subclause> 
<subclause id="HF24BA580B0414844A3913DEC267F8963"><enum>(II)</enum><text>intended to respond to high-priority or emergent campaign needs that cannot timely be obtained at no cost (not including production costs and talent reuse payments), provided that any such advertising material is reviewed by the Partnership for a Drug-Free America;</text></subclause> 
<subclause id="H06AC2523C48A416FBF4B70E12C52159B"><enum>(III)</enum><text>intended to reach a minority, ethnic, or other special audience that cannot be obtained at no cost (not including production costs and talent reuse payments), provided that any such advertising material is reviewed by the Partnership for a Drug-Free America; or</text></subclause> 
<subclause id="HBEC0816F168D4367A0DACCFF00E7DE2B"><enum>(IV)</enum><text>any other advertisements that the Director determines that the Partnership for a Drug-Free America is unable to provide or if the Director determines that another entity is more appropriate, subject to the requirements of subsection (b)(2)(A).</text></subclause></clause><continuation-text continuation-text-level="subparagraph">If the Director determines that another entity is more appropriate under clause (ii)(IV), the Director shall notify Congress, through the committees of jurisdiction in the House and Senate, in writing, not less than 30 days prior to contracting with a party other than the Partnership for a Drug-Free America.</continuation-text></subparagraph> 
<subparagraph id="H08B830A1852B4F089F4F9717103654AC"><enum>(C)</enum><header>Media buying contractor</header><text>The Director shall enter into a contract with a media buying contractor to plan and purchase advertising time and space for the national media campaign. The media buying contractor shall not provide any other service or material, or conduct any other function or activity which the Director determines should be provided by the Partnership for a Drug-Free America.</text></subparagraph></paragraph></subsection> 
<subsection id="H8A8F0C65F8BB4EAA82F5E9AF9C3EACC6"><enum>(e)</enum><header>Prohibitions</header><text>None of the amounts made available under subsection (b) may be obligated or expended for any of the following:</text> 
<paragraph id="HA97B0BD6F37A4B1CB37EC6F6522695D8"><enum>(1)</enum><text>To supplant current anti-drug community-based coalitions.</text></paragraph> 
<paragraph id="H22E4E9CAEC1446EDB673A50283E69291"><enum>(2)</enum><text>To supplant pro bono public service time donated by national and local broadcasting networks for other public service campaigns.</text></paragraph> 
<paragraph id="H98A2D5084391429C9B8373F4974F1200"><enum>(3)</enum><text>For partisan political purposes, or express advocacy in support of or to defeat any clearly identified candidate, clearly identified ballot initiative, or clearly identified legislative or regulatory proposal.</text></paragraph> 
<paragraph id="H2BCCA8A9763A4B0B86EEF69E00686510"><enum>(4)</enum><text>To fund advertising that features any elected officials, persons seeking elected office, cabinet level officials, or other Federal officials employed pursuant to section 213 of Schedule C of title 5, Code of Federal Regulations.</text></paragraph> 
<paragraph id="H6A36E9115DD34932A95F09E0CC1045C4"><enum>(5)</enum><text>To fund advertising that does not contain a primary message intended to reduce or prevent illicit drug use.</text></paragraph> 
<paragraph id="HE49B307C083C4CF8B3F3E3ED5CBED9B4"><enum>(6)</enum><text>To fund advertising containing a primary message intended to promote support for the media campaign or private sector contributions to the media campaign.</text></paragraph></subsection> 
<subsection id="HFE21EB25AF9C4D3FAABC35DC7227DC7B"><enum>(f)</enum><header>Matching Requirement</header> 
<paragraph id="HF9F88D73DC534245944F8E00CF1B94D7"><enum>(1)</enum><header>In general</header><text>Amounts made available under subsection (b) for media time and space shall be matched by an equal amount of non-Federal funds for the national media campaign, or be matched with in-kind contributions of the same value.</text></paragraph> 
<paragraph id="HDF1AF56EC7F44D16A3CE6723FD418C17"><enum>(2)</enum><header>No-cost match advertising direct relationship requirement</header><text>The Director shall ensure that at least 70 percent of no-cost match advertising provided directly relates to substance abuse prevention consistent with the specific purposes of the national media campaign, except that in any fiscal year in which less than $125,000,000 is appropriated to the national media campaign, the Director shall ensure that at least 85 percent of no-cost match advertising directly relates to substance abuse prevention consistent with the specific purposes of the national media campaign.</text></paragraph> 
<paragraph id="H6C03F3BEA79F461C85F574C79482F87B"><enum>(3)</enum><header>No-cost match advertising not directly related</header><text>The Director shall ensure that no-cost match advertising that does not directly relate to substance abuse prevention consistent with the purposes of the national media campaign includes a clear anti-drug message. Such message is not required to be the primary message of the match advertising.</text></paragraph></subsection> 
<subsection id="HE82120D052F54559B318AB2500527019"><enum>(g)</enum><header>Financial and Performance Accountability</header><text>The Director shall cause to be performed—</text> 
<paragraph id="H1CB2731A8EC04370B91FFCF2BDD3776"><enum>(1)</enum><text>audits and reviews of costs of the national media campaign pursuant to section 304C of the <act-name parsable-cite="FPASA">Federal Property and Administrative Services Act of 1949</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/41/254d">41 U.S.C. 254d</external-xref>); and</text></paragraph> 
<paragraph id="HDC609CBD3F6847F183FF1C005BBC30BE"><enum>(2)</enum><text>an audit to determine whether the costs of the national media campaign are allowable under section 306 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/256">41 U.S.C. 256</external-xref>).</text></paragraph></subsection> 
<subsection id="H3A3D834955244D3D804951F1DA406203"><enum>(h)</enum><header>Report to Congress</header><text>The Director shall submit on an annual basis a report to Congress that describes—</text> 
<paragraph id="H07520F2C89EE4ABBBD062B0057ACDFC5"><enum>(1)</enum><text>the strategy of the national media campaign and whether specific objectives of the media campaign were accomplished;</text></paragraph> 
<paragraph id="H29E73563993B45A89BCE600678BFB2F6"><enum>(2)</enum><text>steps taken to ensure that the national media campaign operates in an effective and efficient manner consistent with the overall strategy and focus of the national media campaign;</text></paragraph> 
<paragraph id="HE1B55513A0EC480A80B33BF2DFFCADA"><enum>(3)</enum><text>plans to purchase advertising time and space;</text></paragraph> 
<paragraph id="H76DCB3C22962494FB91708825E10523E"><enum>(4)</enum><text>policies and practices implemented to ensure that Federal funds are used responsibly to purchase advertising time and space and eliminate the potential for waste, fraud, and abuse; and</text></paragraph> 
<paragraph id="H2E2F0AB7ED2B495FBFE52E058868437D"><enum>(5)</enum><text>all contracts entered into with a corporation, partnership, or individual working on behalf of the national media campaign.</text></paragraph></subsection> 
<subsection id="H8A83A2B218ED46DAA1BB9342AF8095A7"><enum>(i)</enum><header>Local Target Requirement</header><text>The Director shall, to the maximum extent feasible, use amounts made available under this section for media that focuses on, or includes specific information on, prevention or treatment resources for consumers within specific local areas.</text></subsection> 
<subsection id="H925186958C85494FB145B859E8F5DDE"><enum>(j)</enum><header>Prevention of Marijuana Use</header> 
<paragraph id="H311F3F27F5F6415DA84DC3A7742D9580"><enum>(1)</enum><header>Findings</header><text>The Congress finds the following:</text> 
<subparagraph id="H8511A1FEF90345F3B95F2973C2A3B0B5"><enum>(A)</enum><text>60 percent of adolescent admissions for drug treatment are based on marijuana use.</text></subparagraph> 
<subparagraph id="H23C6BB4D50314AD286168525B92ECFE1"><enum>(B)</enum><text>Potency levels of contemporary marijuana, particularly hydroponically grown marijuana, are significantly higher than in the past, rising from under 1 percent of THC in the mid-1970s to as high as 30 percent today.</text></subparagraph> 
<subparagraph id="H45996F18891E4E37B0D34EDB3F1E8BD6"><enum>(C)</enum><text>Contemporary research has demonstrated that youths smoking marijuana early in life may be up to 5 times more likely to use hard drugs.</text></subparagraph> 
<subparagraph id="HAE17FB55127643FF8BDC8F9F7F807254"><enum>(D)</enum><text>Contemporary research has demonstrated clear detrimental effects in adolescent educational achievement resulting from marijuana use.</text></subparagraph> 
<subparagraph id="H723FCF44157E42659600150071EB7205"><enum>(E)</enum><text>Contemporary research has demonstrated clear detrimental effects in adolescent brain development resulting from marijuana use.</text></subparagraph> 
<subparagraph id="H94664526AC2B45E48E2121C4495D7D48"><enum>(F)</enum><text>An estimated 9,000,000 Americans a year drive while under the influence of illegal drugs, including marijuana.</text></subparagraph> 
<subparagraph id="H06D73FE08F1E46D995394330886878C4"><enum>(G)</enum><text>Marijuana smoke contains 50 to 70 percent more of certain cancer causing chemicals than tobacco smoke.</text></subparagraph> 
<subparagraph id="HB47B01ABEB55484894CE006975129046"><enum>(H)</enum><text>Teens who use marijuana are up to 4 times more likely to have a teen pregnancy than teens who have not.</text></subparagraph> 
<subparagraph id="HE4B180369C0F40B2AB7BDACFE1B0050"><enum>(I)</enum><text>Federal law enforcement agencies have identified clear links suggesting that trade in hydroponic marijuana facilitates trade by criminal organizations in hard drugs, including heroin.</text></subparagraph> 
<subparagraph id="HE71BD3875C1A476399C3477400EFD2EA"><enum>(J)</enum><text>Federal law enforcement agencies have identified possible links between trade in cannabis products and financing for terrorist organizations.</text></subparagraph></paragraph> 
<paragraph id="HA74EEDDDAAA94484B0455ECE28A8C1A1"><enum>(2)</enum><header>Emphasis on prevention of youth marijuana use</header><text>In conducting advertising and activities otherwise authorized under this section, the Director may emphasize prevention of youth marijuana use.</text></paragraph></subsection> 
<subsection id="H2840E0BBE74843CAA87DCDA11C34DFE5"><enum>(k)</enum><header>Prevention of Methamphetamine Abuse and Other Emerging Drug Abuse Threats</header> 
<paragraph id="HFA93FF2D788E4C38B77C00973B68ABAA"><enum>(1)</enum><header>Requirement to use 10 percent of funds for methamphetamine abuse prevention</header><text>The Director shall ensure that, of the amounts appropriated under this section for the national media campaign for a fiscal year, not less than 10 percent shall be expended solely for the activities described in subsection (b)(1) with respect to advertisements specifically intended to reduce the use of methamphetamine.</text></paragraph> 
<paragraph id="H1FB90440E2D549A0AB2357712904D5E2"><enum>(2)</enum><header>Authority to use funds for other drug abuse upon certification that methamphetamine abuse fell during fiscal year 2007</header><text>With respect to fiscal year 2008 and any fiscal year thereafter, if the Director certifies in writing to Congress that domestic methamphetamine laboratory seizures (as reported to the El Paso Intelligence Center of the Drug Enforcement Administration) decreased to at least 75 percent of the 2006 level, or the Director has documented a highly, statistically significant increase in a specific drug, from a baseline determined by locally collected data, that can be defined as a local drug crisis, the Director may apply paragraph (1)(A) for that fiscal year with respect to advertisements specifically intended to reduce the use of such other drugs.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7177A14EE94F440B852F5359C155B257"><enum>(l)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated to the Office to carry out this section, $195,000,000 for each of fiscal years 2007 and 2008 and $210,000,000 for each of fiscal years 2009 through 2011.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF7F3772E2079411F8D66B43F08D916C8"><enum>(b)</enum><header>Repeal of Superseded Provisions</header><text>The Drug-Free Media Campaign Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1801">21 U.S.C. 1801 et seq.</external-xref>) is repealed.</text></subsection></section></title>

<subsection id="H3F0DBE7F68E348DABC64A9F440FD1C21"><enum>(a)</enum><header>Definitions</header><text>In this title:</text> 
<paragraph id="H4D96748944C64FB7B94B74A8DD5D00F8"><enum>(1)</enum><header>United States Olympic Committee</header><text>The term <term>United States Olympic Committee</term> means the organization established by the <quote>Ted Stevens Olympic and Amateur Sports Act</quote> (<external-xref legal-doc="usc" parsable-cite="usc/36/220501">36 U.S.C. 220501 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H62ECD40B0DAA440288C2CB00AD25AE82"><enum>(2)</enum><header>Amateur athletic competition</header><text>The term <term>amateur athletic competition</term> means a contest, game, meet, match, tournament, regatta, or other event in which amateur athletes compete (<external-xref legal-doc="usc" parsable-cite="usc/36/220501">36 U.S.C. 220501(b)(2)</external-xref>).</text></paragraph> 
<paragraph id="HCD8661F382604ED182A80038FFAE5E72"><enum>(3)</enum><header>Amateur athlete</header><text>The term <term>amateur athlete</term> means an athlete who meets the eligibility standards established by the national governing body or paralympic sports organization for the sport in which the athlete competes (<external-xref legal-doc="usc" parsable-cite="usc/36/22501">36 U.S.C. 22501(b)(1)</external-xref>).</text></paragraph> 
<paragraph id="H4314EC0B37D244A6979307042E40EAD"><enum>(4)</enum><header>Gene doping</header><text>The term <term>gene doping</term> means the nontherapeutic use of cells, genes, genetic elements, or of the modulation of gene expression, having the capacity to enhance athletic performance.</text></paragraph></subsection> 
<subsection id="H59442A8C5A7E4A79872700009636EC97"><enum>(b)</enum><header>In general</header><text>The United States Anti-Doping Agency shall—</text> 
<paragraph id="H6426010FB3974FE49D1C9BF57EB7528D"><enum>(1)</enum><text>serve as the independent anti-doping organization for the amateur athletic competitions recognized by the United States Olympic Committee;</text></paragraph> 
<paragraph id="H946D3205FAB247BAB13C0381D66D9741"><enum>(2)</enum><text>ensure that athletes participating in amateur athletic activities recognized by the United States Olympic Committee are prevented from using performance-enhancing drugs, or performance-enhancing genetic modifications accomplished through gene-doping;</text></paragraph> 
<paragraph id="H129B9F881F7B47DF82F200CB279037D"><enum>(3)</enum><text>implement anti-doping education, research, testing, and adjudication programs to prevent United States Amateur Athletes participating in any activity recognized by the United States Olympic Committee from using performance-enhancing drugs, or performance-enhancing genetic modifications accomplished through gene-doping;</text></paragraph>

<paragraph id="HF55713673CFC4F62A6007BCCF4D340FC"><enum>(5)</enum><text>permanently include <quote>gene doping</quote> among any list of prohibited substances adopted by the Agency.</text></paragraph></subsection></section>

<subsection id="H5248CA0DCDAF4E06BC477C47B99DF012"><enum>(a)</enum><header>Records</header><text>The United States Anti-Doping Agency shall keep correct and complete records of account.</text></subsection> 
<subsection id="HA8F9688635EE4F9B9226E20014971F98"><enum>(b)</enum><header>Report</header><text>The United States Anti-Doping Agency shall submit an annual report to Congress which shall include—</text>

<subsection id="HC9DC8C7E007243E091006876C9C421EB"><enum>(a)</enum><header>Authority To Operate</header><text>Under such regulations as the Secretary of Defense may prescribe, the Chief of the National Guard Bureau may establish and operate, or provide financial assistance to the States to establish and operate, not more than 5 schools (to be known generally as <quote>National Guard counterdrug schools</quote>).</text></subsection> 
<subsection id="HE76DD278A762474C97FD4B6782C362A3"><enum>(b)</enum><header>Purpose</header><text>The purpose of the National Guard counterdrug schools shall be the provision by the National Guard of training in drug interdiction and counterdrug activities and drug demand reduction activities to personnel of the following:</text> 
<paragraph id="H9BF7BFA35C914D02B900BB3788AC7C77"><enum>(1)</enum><text>Federal agencies.</text></paragraph> 
<paragraph id="H76E83BB91F1F407C88CE82FAADCCE98F"><enum>(2)</enum><text>State, local, and tribal law enforcement agencies.</text></paragraph> 
<paragraph id="H553AAC74735E4B56A9D59F2C00095BA9"><enum>(3)</enum><text>Community-based organizations engaged in such activities.</text></paragraph> 
<paragraph id="HA1810F10C3DB4F989ED1AD57ADD6F57D"><enum>(4)</enum><text>Other non-Federal governmental and private entities and organizations engaged in such activities.</text></paragraph></subsection>

<paragraph id="H398CA0F365764C5C8EABFC25271DF5E"><enum>(1)</enum><header>In general</header><text>To the extent provided for in the State drug interdiction and counterdrug activities plan of a State in which a National Guard counterdrug school is located, personnel of the National Guard of that State who are ordered to perform full-time National Guard duty authorized under section 112(b) of that title 32, United States Code, may provide training referred to in subsection (b) at that school.</text></paragraph> 
<paragraph id="HB1B168D2BBA2471CBBB747EE733C22F"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <term>State drug interdiction and counterdrug activities plan</term>, in the case of a State, means the current plan submitted by the Governor of the State to the Secretary of Defense under <external-xref legal-doc="usc" parsable-cite="usc/32/112">section 112</external-xref> of title 32, United States Code.</text></paragraph></subsection> 
<subsection id="HD3AC439CA9BD40A8995BFF037A92D00"><enum>(e)</enum><header>Treatment Under Authority To Provide Counterdrug Support</header><text>The provisions of section 1004 of the National Defense Authorization Act for Fiscal Year 1991 (<external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/374">10 U.S.C. 374</external-xref> note) shall apply to any activities of a National Guard counterdrug school under this section that are for an agency referred to in subsection (a) of such section 1004 and for a purpose set forth in subsection (b) of such section 1004.</text></subsection> 
<subsection id="H1FF02FCC91814DD280E046C5B575B8C4"><enum>(f)</enum><header>Annual Reports on Activities</header> 
<paragraph id="H6CF3A4B7B4C8489A91C9B0B3E25D80C7"><enum>(1)</enum><header>In general</header><text>Not later than February 1 each year, the Secretary of Defense shall submit to Congress a report on the activities of the National Guard counterdrug schools during the preceding year.</text></paragraph> 
<paragraph id="H2270450FFCD341E396C2218F0C0EA2"><enum>(2)</enum><header>Contents</header><text>Each report under paragraph (1) shall set forth the following:</text> 
<subparagraph id="HD2324C31732A44DAA6B535AD4424FD6E"><enum>(A)</enum><header>Funding</header><text>The amount made available for each National Guard counterdrug school during the fiscal year ending in the year preceding the year in which such report is submitted.</text></subparagraph> 
<subparagraph id="HEEF729E6250C474BAA11AECB0542DA22"><enum>(B)</enum><header>Activities</header><text>A description of the activities of each National Guard counterdrug school during the year preceding the year in which such report is submitted.</text></subparagraph></paragraph></subsection> 
<subsection id="HEFBDDD9065494D2996FB27F015C9E266"><enum>(g)</enum><header>Authorization of Appropriations</header> 
<paragraph id="HFC6122BE97214D2DA3285341B9CF7200"><enum>(1)</enum><header>In general</header><text>There is hereby authorized to be appropriated for the Department of Defense for the National Guard for each of fiscal years 2006 through 2010, $30,000,000 for purposes of the National Guard counterdrug schools in such fiscal year.</text></paragraph> 
<paragraph id="H19DE364E3555457FA3040082DE3409D3"><enum>(2)</enum><header>Construction</header><text>The amount authorized to be appropriated by paragraph (1) for a fiscal year is in addition to any other amount authorized to be appropriated for the Department of Defense for the National Guard for such fiscal year.</text></paragraph></subsection></section></title> 
<title id="H577E9DD180E541298E989898F54E4C2D"><enum>X</enum><header>National Methamphetamine Information Clearinghouse Act of 2006</header> 
<section id="H8E1B27DC003747D5A5A09FA6F49F99E"><enum>1001.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the <quote><short-title>National Methamphetamine Information Clearinghouse Act of 2006</short-title></quote>.</text></section> 
<section id="HB8C3D22E369440E49EA22B5D3AA6D96"><enum>1002.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title—</text> 
<paragraph id="H462560A571484F6FA4044528A5300D1"><enum>(1)</enum><text>the term <term>Council</term> means the National Methamphetamine Advisory Council established under section 1003(b)(1);</text></paragraph> 
<paragraph id="H3CF08E8B226943FAB857077F32008EAE"><enum>(2)</enum><text>the term <term>drug endangered children</term> means children whose physical, mental, or emotional health are at risk because of the production, use, or other effects of methamphetamine production or use by another person;</text></paragraph> 
<paragraph id="H9C4B5FCF04F1470A8F1F6497E8726F12"><enum>(3)</enum><text>the term <term>National Methamphetamine Information Clearinghouse</term> or <term>NMIC</term> means the information clearinghouse established under section 1003(a); and</text></paragraph> 
<paragraph id="H78E877F3BB804090A173550000AAC396"><enum>(4)</enum><text>the term <term>qualified entity</term> means a State, local, or tribal government, school board, or public health, law enforcement, nonprofit, community anti-drug coalition, or other nongovernmental organization providing services related to methamphetamines.</text></paragraph></section> 
<section id="H3B0A73C5B5F4419C8392BABD6AE1556"><enum>1003.</enum><header>Establishment of clearinghouse and advisory council</header> 
<subsection id="HB391C99F48EB43ED8FE0D932B7C9DE74"><enum>(a)</enum><header>Clearinghouse</header><text>There is established, under the supervision of the Attorney General of the United States, an information clearinghouse to be known as the National Methamphetamine Information Clearinghouse.</text></subsection> 
<subsection id="HB10DAFEC72674F04B886FB7C98BDAAAC"><enum>(b)</enum><header>Advisory Council</header> 
<paragraph id="H3559AF58701F4CBCB3C38D705BEAE25"><enum>(1)</enum><header>In general</header><text>There is established an advisory council to be known as the National Methamphetamine Advisory Council.</text></paragraph> 
<paragraph id="H496125FDC3D54105B90772CD33E2D59"><enum>(2)</enum><header>Membership</header><text>The Council shall consist of 10 members appointed by the Attorney General—</text> 
<subparagraph id="H8E39FE7D6D2446D8B4A12300CB74BF88"><enum>(A)</enum><text>not fewer than 3 of whom shall be representatives of law enforcement agencies;</text></subparagraph> 
<subparagraph id="HE98ED64A317140CBA344D5E0A01400E7"><enum>(B)</enum><text>not fewer than 4 of whom shall be representatives of nongovernmental and nonprofit organizations providing services or training and implementing programs or strategies related to methamphetamines; and</text></subparagraph> 
<subparagraph id="H36CD4B5B37F345A0AB5EC47BD8BDC42"><enum>(C)</enum><text>1 of whom shall be a representative of the Department of Health and Human Services.</text></subparagraph></paragraph> 
<paragraph id="H606DF41E16AE4EE296D6A9ED956204A7"><enum>(3)</enum><header>Period of appointment; vacancies</header><text>Members shall be appointed for 3 years. Any vacancy in the Council shall not affect its powers, but shall be filled in the same manner as the original appointment.</text></paragraph> 
<paragraph id="H8DA5D64382B04704A2A3DAB6211E468C"><enum>(4)</enum><header>Personnel matters</header> 
<subparagraph id="HA0240F8B54D04D87A072CD20B6FB80F"><enum>(A)</enum><header>Travel expenses</header><text>The members of the Council shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the Council.</text></subparagraph> 
<subparagraph id="HBE1C202B27C848B585A929296983581C"><enum>(B)</enum><header>No compensation</header><text>The members of the Council shall not receive compensation for the performance of the duties of a member of the Council.</text></subparagraph></paragraph></subsection></section> 
<section id="H4D6872E3C230444A9636227BDA2D81A8"><enum>1004.</enum><header>NMIC requirements and review</header> 
<subsection id="H1A2ABD968E0F470EB2707715B8C21E8E"><enum>(a)</enum><header>In general</header><text>The NMIC shall promote sharing information regarding successful law enforcement, treatment, environmental, prevention, social services, and other programs related to the production, use, or effects of methamphetamine and grants available for such programs.</text></subsection> 
<subsection id="HA6D1D303069E4D3F8BD48F0576C2D8D1"><enum>(b)</enum><header>Components</header><text>The NMIC shall include—</text> 
<paragraph id="H2AD6FEB690C447B300CACD117EAE1763"><enum>(1)</enum><text>a toll-free number; and</text></paragraph> 
<paragraph id="H8B8DAED3B3BB4A3A811CAD3943D3E690"><enum>(2)</enum><text>a website that provides a searchable database, which—</text> 
<subparagraph id="HAA3C4D18E8AE4736A5924F49FB436900"><enum>(A)</enum><text>provides information on the short-term and long-term effects of methamphetamine use;</text></subparagraph> 
<subparagraph id="H26DE1EFB400A413600DD7C5477E13E42"><enum>(B)</enum><text>provides information regarding methamphetamine treatment and prevention programs and strategies and programs for drug endangered children, including descriptions of successful programs and strategies and contact information for such programs and strategies;</text></subparagraph> 
<subparagraph id="HA6DF396E145C4C78A5B07241D38FD60"><enum>(C)</enum><text>provides information regarding grants for methamphetamine-related programs, including contact information and links to websites;</text></subparagraph> 
<subparagraph id="HE3D6CDB4AAFE4B2D865BBFF2A5FB6F72"><enum>(D)</enum><text>allows a qualified entity to submit items to be posted on the website regarding successful public or private programs or other useful information related to the production, use, or effects of methamphetamine;</text></subparagraph> 
<subparagraph id="H779D82562E904486A6070048A493551E"><enum>(E)</enum><text>includes a restricted section that may only be accessed by a law enforcement organization that contains successful strategies, training techniques, and other information that the Council determines helpful to law enforcement agency efforts to identify or combat the production, use, or effects of methamphetamine;</text></subparagraph> 
<subparagraph id="HCE188D34B295477ABEAEE900C69B778F"><enum>(F)</enum><text>allows public access to all information not in a restricted section; and</text></subparagraph> 
<subparagraph id="HC26A5ABC689546FF9E560039D43063C7"><enum>(G)</enum><text>contains any additional information the Council determines may be useful in identifying or combating the production, use, or effects of methamphetamine.</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">Thirty days after the website in paragraph (2) is operational, no funds shall be expended to continue the website methresources.gov.</continuation-text></subsection> 
<subsection id="H720523A2362B4A9FAC588437A238CAE1"><enum>(c)</enum><header>Review of posted information</header> 
<paragraph id="H2FC9163D8F7B4875B9A51EA72932DB26"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of submission of an item by a qualified entity, the Council shall review an item submitted for posting on the website described in subsection (b)(2)—</text> 
<subparagraph id="H640E362BC19B4901AB71CA2E3988CCD"><enum>(A)</enum><text>to evaluate and determine whether the item, as submitted or as modified, meets the requirements for posting; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC83497A6D4A946DBAB8157127943D1AC"><enum>(B)</enum><text>in consultation with the Attorney General, to determine whether the item should be posted in a restricted section of the website.</text></subparagraph></paragraph> 
<paragraph id="H97F1F3535FE34E889D5293DDB281CF7E"><enum>(2)</enum><header>Determination</header><text>Not later than 45 days after the date of submission of an item, the Council shall—</text> 
<subparagraph id="H41F4625B47B941E5AD7E3C7979B403B"><enum>(A)</enum><text>post the item on the website described in subsection (b)(2); or</text></subparagraph> 
<subparagraph id="HC1252F3974314204A1ACF96102F5036D"><enum>(B)</enum><text>notify the qualified entity that submitted the item regarding the reason such item shall not be posted and modifications, if any, that the qualified entity may make to allow the item to be posted.</text></subparagraph></paragraph></subsection></section> 
<section id="H8E59FDAE656E4301006CAECFAF16059D"><enum>1005.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated—</text> 
<paragraph id="H83B019D79ADF4752A415FA4C13CB7EF"><enum>(1)</enum><text>for fiscal year 2007—</text> 
<subparagraph id="H32C25E09A37D4F2DA01EF53C00497931"><enum>(A)</enum><text>$500,000 to establish the NMIC and Council; and</text></subparagraph> 
<subparagraph id="H3867BD6EAE034D6096AC099B6F44FD16"><enum>(B)</enum><text>such sums as are necessary for the operation of the NMIC and Council; and</text></subparagraph></paragraph> 
<paragraph id="HEFA1EF5492B841F2B284F75FB2BCFA1E"><enum>(2)</enum><text>for each of fiscal years 2008 and 2009, such sums as are necessary for the operation of the NMIC and Council.</text></paragraph></section></title>

<section id="HD48C5979E6884DC4971998E0FBBFAE8B"><enum>1101.</enum><header>Repeals</header> 
<subsection id="H6EC4E515C7DC4DFF9C0067E848100484"><enum>(a)</enum><header>Act</header><text>Section 710 is repealed.</text></subsection> 
<subsection id="H9BC2FC7AAA2D45BDBAD1375F38A73700"><enum>(b)</enum><header>Forfeiture assets</header><text>Section 6073 of the Assets Forfeiture Amendments Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/21/1509">21 U.S.C. 1509</external-xref>) is repealed.</text></subsection></section> 
<section id="H9C430AF7743A48AD99AA36B1DE366D3"><enum>1102.</enum><header><act-name parsable-cite="CSA">Controlled Substances Act</act-name> amendments</header><text display-inline="no-display-inline">Section 303(g)(2) of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/823">21 U.S.C. 823(g)(2)</external-xref>) is amended—</text> 
<paragraph id="HAECBF5AF488049E9A0F70023615E43B6"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)(iii), by striking <quote>except that the</quote> and inserting the following: <quote>unless, not sooner than 1 year after the date on which the practitioner submitted the initial notification, the practitioner submits a second notification to the Secretary of the need and intent of the practitioner to treat up to 100 patients. A second notification under this clause shall contain the certifications required by clauses (i) and (ii) of this subparagraph. The</quote>; and</text></paragraph> 
<paragraph id="HEE05A7A17E32407CB76148358E001800"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (J)—</text> 
<subparagraph id="H8B8E433EAA2F4913B9D161317368D300"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>thereafter</quote> and all that follows through the period and inserting <quote>thereafter.</quote>;</text></subparagraph> 
<subparagraph id="H31C70FEDEB2945F490634100B3BE64FB"><enum>(B)</enum><text>in clause (ii), by striking <quote>Drug Addiction Treatment Act of 2000</quote> and inserting <quote>Office of National Drug Control Policy Reauthorization Act of 2006</quote>; and</text></subparagraph>

<section id="H11A2253A37B94A91A9B42FBD1059009B"><enum>1103.</enum><header>Report on law enforcement intelligence sharing</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Director shall submit to Congress a report—</text> 
<paragraph id="HF5D75D111F9040F2BA2E00B40941ED08"><enum>(1)</enum><text>evaluating existing and planned law enforcement intelligence systems used by Federal, State, local, and tribal law enforcement agencies responsible for drug trafficking and drug production enforcement; and</text></paragraph> 
<paragraph id="HFF8B227E91B74AB681315674EA00B677"><enum>(2)</enum><text>addressing—</text> 
<subparagraph id="H25DDD8F721734B218DB37DEC34FE76EA"><enum>(A)</enum><text>the current law enforcement intelligence systems used by Federal, State, local, and tribal law enforcement agencies;</text></subparagraph> 
<subparagraph id="H81A30752880A4C7792C5F68EC69887B8"><enum>(B)</enum><text>the compatibility of such systems in ensuring access and availability of law enforcement intelligence to Federal, State, local, and tribal law enforcement;</text></subparagraph> 
<subparagraph id="H1389FDCC39BF4268BEC96EF7C3B4E4D"><enum>(C)</enum><text>the extent to which Federal, State, local, and tribal law enforcement are sharing law enforcement intelligence information to assess current threats and design appropriate enforcement strategies; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3ADEF4795DEF4E719B4C2900AD5CA346"><enum>(D)</enum><text>the measures needed to ensure and to promote effective information sharing among law enforcement intelligence systems operated by Federal, State, local, and tribal law enforcement agencies responsible for drug trafficking and drug production enforcement.</text></subparagraph></paragraph></section> 
<section id="H40DA48B474774F3B8517F8A2D5112D46"><enum>1104.</enum><header>Requirement for South American heroin strategy</header> 
<subsection id="H6845D097D33F4980BFD52BCB1F8806EF"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of this Act, the Director, in coordination with the Secretary of State, shall submit to Congress a comprehensive strategy that addresses the increased threat from South American heroin, and in particular Colombian heroin, and the emerging threat from opium poppy grown in Peru and often intended for transit to Columbia for processing into heroin.</text></subsection> 
<subsection id="H59E67DBE215E4B0387038375A49B9929"><enum>(b)</enum><header>Contents</header><text>The strategy submitted under subsection (a) shall include—</text> 
<paragraph id="H3A333C519DBA44C99FDFA853894D228F"><enum>(1)</enum><text>opium eradication efforts to eliminate the problem at the source to prevent heroin from entering the stream of commerce;</text></paragraph> 
<paragraph id="HA2E7EB9B66EB452389172B0868957564"><enum>(2)</enum><text>interdiction and precursor chemical controls;</text></paragraph> 
<paragraph id="HB82EF07EDD4F427CA9165286DF7425B1"><enum>(3)</enum><text>demand reduction and treatment;</text></paragraph> 
<paragraph id="H016C70233A0949E7BA4500336DEB8587"><enum>(4)</enum><text>alternative development programs, including direct assistance to regional governments to demobilize and provide alternative livelihoods to former members of insurgent or other groups engaged in heroin, cocoa, or other illicit drug production or trafficking;</text></paragraph> 
<paragraph id="HF5FF9102CB9F40779FF82EB7DCD8C87B"><enum>(5)</enum><text>efforts to inform and involve local citizens in the programs described in paragraphs (1) through (4), such as through leaflets advertising rewards for information; and</text></paragraph> 
<paragraph id="H6E443852BA354614B0AD732200941551"><enum>(6)</enum><text>an assessment of the specific level of funding and resources necessary to simultaneously address the threat from South American heroin and the threat from Colombian and Peruvian coca.</text></paragraph></subsection> 
<subsection id="HCB2A5B83F92B4D1798AFE3B648913BA9"><enum>(c)</enum><header>Treatment of classified or law enforcement sensitive information</header><text>Any content of the strategy submitted under subsection (a) that involves information classified under criteria established by an Executive order, or whose public disclosure, as determined by the Director or the head of any relevant Federal agency, would be detrimental to the law enforcement of national security activities of any Federal, foreign, or international agency, shall be presented to Congress separately from the rest of the strategy.</text></subsection></section> 
<section id="H559876503BC04A07BC86590011FD9850"><enum>1105.</enum><header>Model acts</header> 
<subsection id="HDC881E7B67254175003D948CF63D8918"><enum>(a)</enum><header>In general</header><text>The Director of the Office of National Drug Control Policy shall provide for or shall enter into an agreement with a non-profit corporation that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code to—</text> 
<paragraph id="HDB27677754084FA09EABBD72049BB96D"><enum>(1)</enum><text>advise States on establishing laws and policies to address alcohol and other drug issues, based on the model State drug laws developed by the President’s Commission on Model State Drug Laws in 1993; and</text></paragraph> 
<paragraph id="HFA7F2CF6890344F5B55084C5784BE776"><enum>(2)</enum><text>revise such model State drug laws and draft supplementary model State laws to take into consideration changes in the alcohol and drug abuse problems in the State involved.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H1298893837E74DD28EC9FCD5B0B521DC"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $1,500,000 for each of fiscal years 2007 through 2011.</text></subsection></section> 
<section id="H42C38DA46DF04B62B4E6D511A3D2A623"><enum>1106.</enum><header>Study on iatrogenic addiction associated with prescription opioid analgesic drugs</header> 
<subsection id="HDB02AAA905D74AD99E05CA2A6EC2938"><enum>(a)</enum><header>In general</header> 
<paragraph id="H2EA19431C1074548BEA9C3C318BE72FE"><enum>(1)</enum><header>Study</header><text>The Director of the Office of National Drug Control Policy shall request the Institute of Medicine of the National Academy of Sciences to enter into an agreement under which the Institute agrees to study certain aspects of iatrogenic addiction to prescription opioid analgesics included in schedules II and III of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/812">21 U.S.C. 812</external-xref>).</text></paragraph> 
<paragraph id="H97C105A8643F45A89C183FB85029F1C5"><enum>(2)</enum><header>Iatrogenic addiction</header><text>In this section, the term <term>iatrogenic addiction</term> means an addiction developed from the use of an opioid analgesic by an individual with no previous history of any addiction, who has lawfully obtained and used the drug for a legitimate medical purpose by administration from, or pursuant to the prescription or order of, an individual practitioner acting in the usual course of professional practice.</text></paragraph></subsection> 
<subsection id="H03BF7678D3B94960A48FE40829158710"><enum>(b)</enum><header>Requirements</header><text>The study conducted pursuant to this section shall assess the current scientific literature to determine, if possible—</text> 
<paragraph id="HA39E99CBBB914901B486C958E9D72290"><enum>(1)</enum><text>the rate of iatrogenic addiction associated with the appropriate use of prescription drugs described in subsection (a);</text></paragraph> 
<paragraph id="HE4719345C79540F089009700C64EBA87"><enum>(2)</enum><text>the impact of iatrogenic addiction associated with the appropriate use of prescription drugs described in subsection (a) on the individual, the prescriber, other patients, and society in general;</text></paragraph> 
<paragraph id="H72FE1C031A044BA6A607A125FE482D11"><enum>(3)</enum><text>the comparative abuse liability of prescription drugs described in subsection (a) when used properly by the ultimate user for a legitimate medical purpose; and</text></paragraph> 
<paragraph id="H593E613F26264D83B801CEFF4F381708"><enum>(4)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H04E06C64510B4F54A4F512264E14B46E"><enum>(A)</enum><text>what types of prospective or retrospective studies should be undertaken to determine the rate of iatrogenic addiction associated with the appropriate use of the prescription drugs described in subsection (a); and</text></subparagraph> 
<subparagraph id="H9B818866C41B48D983D995D989148BC5" indent="up1"><enum>(B)</enum><text>a feasible timeline for conducting and reporting such studies, should the current state of the scientific literature be insufficient to determine the rate, impact, and comparative abuse liability of prescription drugs described in subsection (a).</text></subparagraph></paragraph></subsection> 
<subsection id="H46AFC7449B8F4CC8A206D898D9494979"><enum>(c)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Director of the Office of National Drug Control Policy shall ensure that the agreement under subsection (a) provides for the submission of a report to the Congress on the status of the study conducted pursuant to this section.</text></subsection></section> 
<section id="H9A3039D9E1A64F98A72B4461E0DFFE5E"><enum>1107.</enum><header>Requirement for strategy to stop Internet advertising of prescription medicines without a prescription</header><text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of the Office of National Drug Control Policy shall submit to Congress a strategy to stop advertisements that provide information about obtaining over the Internet drugs (as defined in section 702(3) of the Office of National Drug Control Policy Reauthorization Act of 1998) for which a prescription is required without the use of such a lawful prescription.</text></section> 
<section id="H1971C80ADE634ACC95DBC83D3C059E00"><enum>1108.</enum><header>Requirement for study on diversion and inappropriate uses of prescription drugs</header><text display-inline="no-display-inline">Not later than 90 days after the date of enactment of this Act, the Director of the Office of National Drug Control Policy, in consultation with the Secretary of Health and Human Services, shall submit to Congress a report that includes a plan to conduct a study on the illegal diversion and inappropriate uses of prescription drugs, including the following:</text> 
<paragraph id="H96260F8B4363484AAFDD56B1FB75B701"><enum>(1)</enum><text>Methods to utilize both public use surveys that are in existence as of the date of enactment of this Act and other surveys to provide appropriate baseline data on the natural history of diversion and abuse of prescription drugs that are included in schedules under the Controlled Substances Act to evaluate the extent and nature of potential problems with such use to guide corrective actions which may reduce such problems without unintentionally hindering access to these drugs for legitimate medical purposes. Specifically, other surveys to be considered are those that address the abuse of these substances on a regional or national basis, and those that address the diversion of these substances on a regional or national basis.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H86CC8263908F4F3188D42C7D868FB9AD"><enum>(2)</enum><text>A scientifically based analysis of the relative contribution of both innate and acquired genetic factors, environmental factors, psychological factors, and drug characteristics that contribute to addiction to prescription drugs.</text></paragraph></section> 
<section id="H4BE3A8A088394DF7914FB4531E7900E1"><enum>1109.</enum><header>Requirement for Afghan Heroin Strategy</header> 
<subsection id="H965B6830A3464AB099031E0070A9BDF2"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of the Office of National Drug Control Policy shall submit to the Congress a comprehensive strategy that addresses the increased threat from Afghan heroin.</text></subsection> 
<subsection id="H34CFF22948BD4E65BF3125000000BD40"><enum>(b)</enum><header>Contents</header><text>The strategy shall include—</text> 
<paragraph id="H7162D479C58743348E0026FCFD78F527"><enum>(1)</enum><text>opium crop eradication efforts to eliminate the problem at the source to prevent heroin from entering the stream of commerce;</text></paragraph> 
<paragraph id="H8E01951F98504819907D3710B9699637"><enum>(2)</enum><text>destruction or other direct elimination of stockpiles of heroin and raw opium, and heroin production and storage facilities;</text></paragraph> 
<paragraph id="HAF7B193B2F8D44CDA115ABDF397B35E5"><enum>(3)</enum><text>interdiction and precursor chemical controls;</text></paragraph> 
<paragraph id="H048BDB6FD12B463580C0B7096DAC7D1D"><enum>(4)</enum><text>demand reduction and treatment;</text></paragraph> 
<paragraph id="H15BFD90F9EF249CAA94F76C09ED57F9C"><enum>(5)</enum><text>alternative development programs;</text></paragraph> 
<paragraph id="HEC809EFF1433497CB46CFB807BA6BE65"><enum>(6)</enum><text>measures to improve cooperation and coordination between Federal Government agencies, and between such agencies, agencies of foreign governments, and international organizations with responsibility for the prevention of heroin production in, or trafficking out of, Afghanistan; and</text></paragraph> 
<paragraph id="H83A8E01D917C4BC6B08C3833E97D1FA1"><enum>(7)</enum><text>an assessment of the specific level of funding and resources necessary to significantly reduce the production and trafficking of heroin.</text></paragraph></subsection> 
<subsection id="H44660C72E20B4D6AB57B16AF4BC829B1"><enum>(c)</enum><header>Treatment of classified or law enforcement sensitive information</header><text>Any content of the strategy that involves information classified under criteria established by an Executive order, or whose public disclosure, as determined by the Director or the head of any relevant Federal agency, would be detrimental to the law enforcement or national security activities of any Federal, foreign, or international agency, shall be presented to Congress separately from the rest of the strategy.</text></subsection></section> 
<section id="HE2A87915FF764D5B96FC5324C8D5B1DA"><enum>1110.</enum><header>Requirement for Southwest Border Counternarcotics Strategy</header> 
<subsection id="HE95BDBDB1A37435EB934FA00E62C694B"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, and every 2 years thereafter, the Director of National Drug Control Policy shall submit to the Congress a Southwest Border Counternarcotics Strategy.</text></subsection> 
<subsection id="HA05B69B09EB34DCEA71E2D7B37B14DFC"><enum>(b)</enum><header>Purposes</header><text>The Southwest Border Counternarcotics Strategy shall—</text> 
<paragraph id="H23F73C036EEA43EE9BF06BDFFF00B69E"><enum>(1)</enum><text>set forth the Government’s strategy for preventing the illegal trafficking of drugs across the international border between the United States and Mexico, including through ports of entry and between ports of entry on that border;</text></paragraph> 
<paragraph id="H7939BACCD3B94E7091624EABACA68E6"><enum>(2)</enum><text>state the specific roles and responsibilities of the relevant National Drug Control Program agencies (as defined in section 702 of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1701">21 U.S.C. 1701</external-xref>)) for implementing that strategy; and</text></paragraph> 
<paragraph id="H6D48FB46E3EE45ADA2FCD143AD015C70"><enum>(3)</enum><text>identify the specific resources required to enable the relevant National Drug Control Program agencies to implement that strategy.</text></paragraph></subsection> 
<subsection id="H6CFEAEF0AF0C49EE8E78FC00F881A730"><enum>(c)</enum><header>Specific content related to drug tunnels between the united states and mexico</header><text>The Southwest Border Counternarcotics Strategy shall include—</text> 
<paragraph id="H9FE50A9435F748D3A46903DCF96C054"><enum>(1)</enum><text>a strategy to end the construction and use of tunnels and subterranean passages that cross the international border between the United States and Mexico for the purpose of illegal trafficking of drugs across such border; and</text></paragraph> 
<paragraph id="H9A5D8A939AD74ADBACFB00B04DD1EF00"><enum>(2)</enum><text>recommendations for criminal penalties for persons who construct or use such a tunnel or subterranean passage for such a purpose.</text></paragraph></subsection> 
<subsection id="HE5FF2AC0E3814A6E004E11006D1B6509"><enum>(d)</enum><header>Consultation with other agencies</header><text>The Director shall issue the Southwest Border Counternarcotics Strategy in consultation with the heads of the relevant National Drug Control Program agencies.</text></subsection> 
<subsection id="H0A85F2173785402B9BDCEB8009D0ABD7"><enum>(e)</enum><header>Limitation</header><text>The Southwest Border Counternarcotics Strategy shall not change existing agency authorities or the laws governing interagency relationships, but may include recommendations about changes to such authorities or laws.</text></subsection> 
<subsection id="HA01FD3FAFED04D0E9F7E584C2C7C70F2"><enum>(f)</enum><header>Report to congress</header><text>The Director shall provide a copy of the Southwest Border Counternarcotics Strategy to the appropriate congressional committees (as defined in section 702 of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1701">21 U.S.C. 1701</external-xref>)), and to the Committee on Armed Services and the Committee on Homeland Security of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs and the Committee on Armed Services of the Senate.</text></subsection> 
<subsection id="H69974A13577E4032AA08BE94FA07E037"><enum>(g)</enum><header>Treatment of classified or law enforcement sensitive information</header><text>Any content of the Southwest Border Counternarcotics Strategy that involves information classified under criteria established by an Executive order, or whose public disclosure, as determined by the Director or the head of any relevant National Drug Control Program agency, would be detrimental to the law enforcement or national security activities of any Federal, State, local, or tribal agency, shall be presented to Congress separately from the rest of the strategy.</text></subsection></section> 
<section id="HA870D35C7BF9467E8D8331CD3F0E655"><enum>1111.</enum><header>Requirement for Scientific Study of Mycoherbicide in Illicit Drug Crop Eradication</header> 
<subsection id="H50FDA4384B654BDD9B0203B7BC232E28"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Director of the Office of National Drug Control Policy shall submit to the Congress a report that includes a plan to conduct, on an expedited basis, a scientific study of the use of mycoherbicide as a means of illicit drug crop elimination by an appropriate Government scientific research entity, including a complete and thorough scientific peer review. The study shall include an evaluation of the likely human health and environmental impacts of mycoherbicides derived from fungus naturally existing in the soil.</text></subsection> 
<subsection id="H80D4F3B80467402CB1142E5525691400"><enum>(b)</enum><header>Study</header><text display-inline="yes-display-inline">The study required by this section shall be conducted in United States territory and not in any foreign country. </text></subsection></section> 
<section id="HE6A2FF346D454F2DB6DD3D5F2D8205D6"><enum>1112.</enum><header>Requirement for Study of State Precursor Chemical Control Laws</header> 
<subsection id="H7BD78E0BAC494E47BC42F4B6536992DC"><enum>(a)</enum><header>Study</header><text>The Director of National Drug Control Policy, in consultation with the National Alliance for Model State Drug Laws, shall conduct a study of State laws with respect to precursor chemical controls.</text></subsection> 
<subsection id="HB978A59C5A7941DA9CBB32C7FCE300C4"><enum>(b)</enum><header>Report</header><text>Not later than 6 months after the date of the enactment of this Act, the Director of National Drug Control Policy shall submit a report to Congress on the results of the study under subsection (a), including—</text> 
<paragraph id="H06772A12FE89451000008600567D29C4"><enum>(1)</enum><text>a comparison of the State laws studied and the effectiveness of each such law; and</text></paragraph> 
<paragraph id="H74C8D28D8D4F45F29093723224472698"><enum>(2)</enum><text>a list of best practices observed with respect to such laws.</text></paragraph></subsection></section> 
<section id="H3467E2A85A7B4753A8DF989052E170A2"><enum>1113.</enum><header>Requirement for Study of Drug Endangered Children Programs</header> 
<subsection id="HCBD15E63B89440B3BA2702D1B8FBE54"><enum>(a)</enum><header>Study</header><text>The Director of National Drug Control Policy shall conduct a study of methamphetamine-related activities that are conducted by different Drug Endangered Children programs administered by States.</text></subsection> 
<subsection id="H584D6455467F4E51997BC5D241F4103E"><enum>(b)</enum><header>Report</header><text>Not later than 6 months after the date of the enactment of this Act, the Director of National Drug Control Policy shall submit to Congress a report on the results of the study under subsection (a). Such report shall include—</text> 
<paragraph id="HAA52A623D9084BA5BAB3FB1E900053A2"><enum>(1)</enum><text>an analysis of the best practices of the activities studied; and</text></paragraph> 
<paragraph id="H97A2E5D0D6D748208F5B9BE005EB9D14"><enum>(2)</enum><text>recommendations for establishing a national policy to address drug endangered children, based on the Drug Endangered Children programs administered by States.</text></paragraph></subsection> 
<subsection id="H968F012F43CF4664A2D3A0BE6C06B413"><enum>(c)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="H1BA345780C1C4D93BB578D4153E78838"><enum>(1)</enum><text>the term <term>methamphetamine-related activity</term> means any activity related to the production, use, or effects of methamphetamine; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8C8A99EBC1224AECB327DABF5FA37E28"><enum>(2)</enum><text>the term <term>drug endangered children</term> means children whose physical, mental, or emotional health are at risk because of the production, use, or effects of methamphetamine by another person.</text></paragraph></subsection></section> 
<section id="H59A1FF1D2EDB42DD8B177346B8E59F83"><enum>1114.</enum><header>Study on drug court hearings in nontraditional places</header> 
<subsection id="HFCE9AE2332394CF38B00653E9B599EE"><enum>(a)</enum><header>Finding</header><text>Congress finds that encouraging drug courts and schools to enter into partnerships that allow students to see the repercussions of drug abuse by non-violent offenders may serve as a strong deterrent and promote demand reduction.</text></subsection> 
<subsection id="HD2017C25F52F411586026D96A36B5F78"><enum>(b)</enum><header>Study</header><text>The Director of the Office of National Drug Control Policy shall conduct a study on drug court programs that conduct hearings in nontraditional public places, such as schools. At a minimum, the study shall evaluate similar programs in operation, such as the program operated in the Fourth Judicial District Drug Court, in Washington County, Arkansas.</text></subsection> 
<subsection id="H7022C49F1362480A89D27537CC40D8C2"><enum>(c)</enum><header>Requirement</header><text>At the same time the President submits to Congress the National Drug Control Strategy due February 1, 2007, pursuant to section 706 of the Office of National Drug Control Policy Reauthorization Act of 1998, the President shall submit to Congress a report on the study conducted under subsection (b). The report shall include an evaluation of the results of the study and such recommendations as the President considers appropriate.</text></subsection> 
<subsection id="HA010CD2B4BF04DB9883F2EB9923239F"><enum>(d)</enum><header>Demand Reduction</header><text>In this section, the term <term>demand reduction</term> has the meaning provided in section 702(1) of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1701">21 U.S.C. 1701(1)</external-xref>).</text></subsection></section> 
<section id="H85B89552E33C4398BF48343BBF53200"><enum>1115.</enum><header>Report on tribal Government participation in HIDTA process</header> 
<subsection id="H9956299ECC464A5398F170E5B7FDFBE"><enum>(a)</enum><header>Report Requirement</header><text>The Director of the Office of National Drug Control Policy shall prepare a report for Congress on the representation of tribal governments in the High Intensity Drug Trafficking Areas Program and in high intensity drug trafficking areas designated under that Program. The report shall include—</text> 
<paragraph id="H19A548350C3346F4ABFFD4FD1FB3F55"><enum>(1)</enum><text>a list of the tribal governments represented in the Program and a description of the participation by such governments in the Program;</text></paragraph> 
<paragraph id="H80B8A67634CA4163906EA6CEE6EDFBA"><enum>(2)</enum><text>an explanation of the rationale for the level of representation by such governments; and</text></paragraph> 
<paragraph id="HB8CFB7B162BD4F388DC9AE9C5FF16025"><enum>(3)</enum><text>recommendations by the Director for methods for increasing the number of tribal governments represented in the Program.</text></paragraph></subsection> 
<subsection id="HB65BAC6A130E462CAEB300D29D665C43"><enum>(b)</enum><header>Deadline</header><text>The report prepared under subsection (a) shall be submitted not later than 1 year after the date of the enactment of this Act.</text></subsection> 
<subsection id="HBF81EF3FF6514737A70055350820664E"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>High Intensity Drug Trafficking Areas Program</term> means the program established under section 707 of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1706">21 U.S.C. 1706</external-xref>)</text></subsection></section> 
<section id="H711EA498068548139F1E1936A1217F8B"><enum>1116.</enum><header>Report on school drug testing</header> 
<subsection id="HE4A8A4F96EB04F24891CDA00F35FAF53"><enum>(a)</enum><header>Report Requirement</header><text>The Director of National Drug Control Policy shall prepare a report on drug testing in schools. The report shall include a list of secondary schools that have initiated drug testing from among those schools that have attended conferences on drug testing sponsored by the Office of National Drug Control Policy.</text></subsection> 
<subsection id="H85372287903C44BDBB28694CD8546B46"><enum>(b)</enum><header>Deadline</header><text>Not later than 120 days after the date of the enactment of this Act, the Director of National Drug Control Policy shall submit to Congress the report required under subsection (a).</text></subsection></section> 
<section id="HF1852074EDEF4EF9948CBBCE17D64762"><enum>1117.</enum><header>Report on ONDCP performance bonuses</header> 
<subsection id="H06982139B0B94061A8C0786977E97F11"><enum>(a)</enum><header>Report Requirement</header><text>The Director of National Drug Control Policy shall prepare a report on performance bonuses at the Office of National Drug Control Policy. The report shall include a list of employees who received performance bonuses, and the amount of such bonuses, for the period beginning on October 1, 2004, and ending on the date of submission of the report.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H64399DB671484D04804DC633C41E8F94"><enum>(b)</enum><header>Deadline</header><text>Not later than 120 days after the date of the enactment of this Act, the Director of National Drug Control Policy shall submit to Congress the report required under subsection (a).</text></subsection></section> 
<section id="H9D1E1DD16179415F00A28909D0B25F86"><enum>1118.</enum><header>Requirement for disclosure of Federal sponsorship of all Federal advertising or other communication materials</header><text display-inline="no-display-inline">Section 712 is amended to read as follows:</text>

<section id="H853C72976F884CF8AFEF7F84EF5CC686"><enum>712.</enum><header>Requirement for disclosure of Federal sponsorship of all Federal advertising or other communication materials</header> 
<subsection id="H012573FFF1C94F548E631290AE95FDEB"><enum>(a)</enum><header>Requirement</header><text>Each advertisement or other communication paid for by the Office, either directly or through a contract awarded by the Office, shall include a prominent notice informing the target audience that the advertisement or other communication is paid for by the Office.</text></subsection> 
<subsection id="H32E3962358804FC0A8DE80ADC759F986"><enum>(b)</enum><header>Advertisement or Other Communication</header><text>In this section, the term <term>advertisement or other communication</term> includes—</text> 
<paragraph id="HAE2E26342DF843E9BFFBEFC8908C52FD"><enum>(1)</enum><text>an advertisement disseminated in any form, including print or by any electronic means; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H994DA14DF095458896376DFD7E402634"><enum>(2)</enum><text>a communication by an individual in any form, including speech, print, or by any electronic means.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H49013DAC7D9E47F2909E274D70F931D3"><enum>1119.</enum><header>Awards for demonstration programs by local partnerships to coerce abstinence in chronic hard-drug users under community supervision through the use of drug testing and sanctions</header><text display-inline="no-display-inline">At the end of the Act, insert the following:</text> 
<quoted-block display-inline="no-display-inline" id="H0057DCC50FD14FEE9E00467B3EB21D52" style="OLC"> 
<section id="H3E37A88A9B0B4968AAAB3FD962C2BA46"><enum>716.</enum><header>Awards for demonstration programs by local partnerships to coerce abstinence in chronic hard-drug users under community supervision through the use of drug testing and sanctions</header> 
<subsection id="H690F74EC54774C2898B9AD44B8F7F00"><enum>(a)</enum><header>Awards Required</header><text>The Director shall make competitive awards to fund demonstration programs by eligible partnerships for the purpose of reducing the use of illicit drugs by chronic hard-drug users living in the community while under the supervision of the criminal justice system.</text></subsection> 
<subsection id="HB453C539BF084F02ACEA8D00039523AF"><enum>(b)</enum><header>Use of Award Amounts</header><text>Award amounts received under this section shall be used—</text> 
<paragraph id="HED2A1DEF7DFD47FCA0CEEA9648DED779"><enum>(1)</enum><text>to support the efforts of the agencies, organizations, and researchers included in the eligible partnership;</text></paragraph> 
<paragraph id="H9CE33619FAB8463F9E7CF154F7A044AB"><enum>(2)</enum><text>to develop and field a drug testing and graduated sanctions program for chronic hard-drug users living in the community under criminal justice supervision; and</text></paragraph> 
<paragraph id="HAEB7966AA92346608EF112F113567F86"><enum>(3)</enum><text>to assist individuals described in subsection (a) by strengthening rehabilitation efforts through such means as job training, drug treatment, or other services.</text></paragraph></subsection> 
<subsection id="HDF8A4B0FF50145A0ACDCEBF1AB092590"><enum>(c)</enum><header>Eligible Partnership Defined</header><text>In this section, the term <term>eligible partnership</term> means a working group whose application to the Director—</text> 
<paragraph id="H13C47055D5B74B4D91E0E31F00C44FAF"><enum>(1)</enum><text>identifies the roles played, and certifies the involvement of, two or more agencies or organizations, which may include—</text> 
<subparagraph id="HFF9A820D36B444D500E6EFABC8D77F5"><enum>(A)</enum><text>State, local, or tribal agencies (such as those carrying out police, probation, prosecution, courts, corrections, parole, or treatment functions);</text></subparagraph> 
<subparagraph id="H979D0A5839AD421EBFA0E601D88C00EA"><enum>(B)</enum><text>Federal agencies (such as the Drug Enforcement Agency, the Bureau of Alcohol, Tobacco, Firearms, and Explosives, and United States Attorney offices); and</text></subparagraph> 
<subparagraph id="H097CDEFD04994DD5A954006744671FD2"><enum>(C)</enum><text>community-based organizations;</text></subparagraph></paragraph> 
<paragraph id="HD19F80BC85D4429F95A6B7BE214DB6AD"><enum>(2)</enum><text>includes a qualified researcher;</text></paragraph> 
<paragraph id="HAA4E17E9E8F54E9A9D90A17CD4F2F3C"><enum>(3)</enum><text>includes a plan for using judicial or other criminal justice authority to administer drug tests to individuals described in subsection (a) at least twice a week, and to swiftly and certainly impose a known set of graduated sanctions for non-compliance with community-release provisions relating to drug abstinence (whether imposed as a pre-trial, probation, or parole condition or otherwise);</text></paragraph> 
<paragraph id="H11B658D4E7BD4F2BAD3EFBEA2145D490"><enum>(4)</enum><text>includes a strategy for responding to a range of substance use and abuse problems and a range of criminal histories;</text></paragraph> 
<paragraph id="H0D825C6CB0554E38BFFA133945BB41C2"><enum>(5)</enum><text>includes a plan for integrating data infrastructure among the agencies and organizations included in the eligible partnership to enable seamless, real-time tracking of individuals described in subsection (a);</text></paragraph> 
<paragraph id="H487185F8FC374CD6B0AABE430790E4CA"><enum>(6)</enum><text>includes a plan to monitor and measure the progress toward reducing the percentage of the population of individuals described in subsection (a) who, upon being summoned for a drug test, either fail to show up or who test positive for drugs.</text></paragraph></subsection> 
<subsection id="H5157BED4B30742BD00DA59A84E82BB35"><enum>(d)</enum><header>Reports to Congress</header> 
<paragraph id="H6576F07F95A8452C9DF0803CE8921FD8"><enum>(1)</enum><header>Interim report</header><text>Not later than June 1, 2009, the Director shall submit to Congress a report that identifies the best practices in reducing the use of illicit drugs by chronic hard-drug users, including the best practices identified through the activities funded under this section.</text></paragraph> 
<paragraph id="H96EE1398E515460CAF1C07D0EAE1055"><enum>(2)</enum><header>Final report</header><text>Not later than June 1, 2010, the Director shall submit to Congress a report on the demonstration programs funded under this section, including on the matters specified in paragraph (1).</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H9D81A338C50042DD8BF02FE000E64CDA"><enum>(e)</enum><header>Authorization of Appropriations</header><text>There is authorized to be appropriated to carry out this section $4,900,000 for each of fiscal years 2007 through 2009.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H7BC47804B8584C519364F7ECB851ECC3"><enum>1120.</enum><header>Policy relating to syringe exchange programs</header><text display-inline="no-display-inline">Section 703(a) (<external-xref legal-doc="usc" parsable-cite="usc/21/1702">21 U.S.C. 1702(a)</external-xref>) is amended by adding at the end the following:</text>

<quoted-block-continuation-text quoted-block-continuation-text-level="section">When developing the national drug control policy, any policy of the Director relating to syringe exchange programs for intravenous drug users shall be based on the best available medical and scientific evidence regarding their effectiveness in promoting individual health and preventing the spread of infectious disease, and their impact on drug addiction and use. In making any policy relating to syringe exchange programs, the Director shall consult with the National Institutes of Health and the National Academy of Sciences.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></section></title>
