<section commented="no" display-inline="no-display-inline" id="HD37A70DF483F4C21B18D775ED52B004B" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HC2B988783FDC40F19E7494E964AF75C9"><enum>(1)</enum><text display-inline="yes-display-inline">the Cape Fox Corporation (referred to in this Act as <term>Cape Fox</term>) is a Village Corporation for the Native Village of Saxman, Alaska, organized pursuant to the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>);</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HDA11639568CC4D5FA16CF2F9B34B94C9"><enum>(2)</enum><text display-inline="yes-display-inline">similar to other Village Corporations in southeast Alaska, under section 16 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1615">43 U.S.C. 1615</external-xref>), Cape Fox could select only 23,040 acres from land withdrawn for the purpose of that selection;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF5EDEE80ED2E4E6990BBE7E462AE1019"><enum>(3)</enum><text display-inline="yes-display-inline">under section 22(l) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1621">43 U.S.C. 1621(l)</external-xref>)—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3AF5CF5220DF4594BE3250CA86CCB81"><enum>(A)</enum><text display-inline="yes-display-inline">the Village Corporations in southeast Alaska, other than Cape Fox, were restricted with respect to the selection of land within 2 miles of a home rule city (as that term is used in that Act); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2C90032ECFB940B982D35EEAD745BF8"><enum>(B)</enum><text display-inline="yes-display-inline">to protect the watersheds in the vicinity, Cape Fox was restricted with respect to the selection of land within 6 miles of the boundary of the home rule city of Ketchikan, Alaska;</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H15249EB810E84482008B922F5F5C9E97"><enum>(4)</enum><text display-inline="yes-display-inline">the 6-mile restriction described in paragraph (3)(B) precluded Cape Fox from selecting valuable timber land, industrial sites, and other commercial property located—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H87095B77F7094B158B99285FAC42F6C1"><enum>(A)</enum><text display-inline="yes-display-inline">within the townships in which the Native Village of Saxman is located, more particularly described as T.75 S., T.76 S., R.91 E., Copper River Meridian; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA8F0CD8FB1DF4FB986F959AB7B00B183"><enum>(B)</enum><text display-inline="yes-display-inline">on surrounding land that is far removed from Ketchikan, Alaska, and its watersheds;</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD1EB79CF9A664F5C8F4EBA03961F004C"><enum>(5)</enum><text display-inline="yes-display-inline">as a result of that 6-mile restriction, only the remote, mountainous, northeast corner of the property described in paragraph (4)(A), which is nonproductive and has no known economic value, was available for selection by Cape Fox, as required under section 16(b) of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1615">43 U.S.C. 1615(b)</external-xref>);</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3D5E024D978342E6B5E92B6650AD2870"><enum>(6)</enum><text display-inline="yes-display-inline">land selections by Cape Fox under that Act were further limited by the fact that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H3A5897F64CBF40D681E289FF27FC135B"><enum>(A)</enum><text display-inline="yes-display-inline">the Annette Island Indian Reservation is located within the applicable selection area; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H8586BA8D32F64481B7D3671BDFBA3B8"><enum>(B)</enum><text display-inline="yes-display-inline">land of that reservation is unavailable for selection by Cape Fox;</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2899E16D921749408C1CA6DB4F28ED37"><enum>(7)</enum><text display-inline="yes-display-inline">Cape Fox is the only Village Corporation affected by the restrictions described in paragraphs (3)(B) and (6);</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H3D99CB955AAE4AC69BB83F2EB88BD562"><enum>(8)</enum><text display-inline="yes-display-inline">the Secretary of the Interior (referred to in this Act as the <quote>Secretary</quote>) has advised Congress that the predicament of Cape Fox is sufficiently unique to warrant the legislative remedy provided by this Act; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H586DC49840DA450BBBD31CA1F3D870AD"><enum>(9)</enum><text display-inline="yes-display-inline">the adjustment of the selections available and conveyances of land to Cape Fox under the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), and the related adjustment of selections available and conveyances of land to the Regional Corporation for Sealaska established pursuant to that Act, are in accordance with—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC0180F12F613430F82A698CD822B785C"><enum>(A)</enum><text display-inline="yes-display-inline">the purposes of that Act; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H38A06968BEDC46229241AACB70BBAF40"><enum>(B)</enum><text display-inline="yes-display-inline">the public interest.</text></subparagraph></paragraph></section> 
<section commented="no" display-inline="no-display-inline" id="H362520D827624BD5B126C64DDD5506E" section-type="subsequent-section"><enum>2.</enum><header>Waiver of core township requirement for certain land</header><text display-inline="no-display-inline">Notwithstanding section 16(b) of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1615">43 U.S.C. 1615(b)</external-xref>), Cape Fox shall not be required to select or receive conveyance of the approximately 160 acres of unconveyed Federal land located within sec. 1, T.75 S., R.91 E., Copper River Meridian.</text></section> 
<section commented="no" display-inline="no-display-inline" id="HACBA23C5D3EF4366B0A3ABFA62E228E5" section-type="subsequent-section"><enum>3.</enum><header>Selection outside exterior selection boundary</header> 
<subsection commented="no" display-inline="no-display-inline" id="HF10E3642B9BC439198CFDF2CDB00371E"><enum>(a)</enum><header>Selection and Conveyance of Surface Estate</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, in addition to land made available for selection under the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), Cape Fox may select, and, on receiving written notice of the selection, the Secretary shall convey, the approximately 99 acres of the surface estate of Tongass National Forest land located outside the exterior selection boundary of Cape Fox (as in existence on the day before the date of enactment of this Act) and more particularly described as follows:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H24DC80C713AF458B8C767D58D27F29A2"><enum>(1)</enum><text display-inline="yes-display-inline">T.73 S., R.90 E., Copper River Meridian.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7628C9ADCA7B448B962B99B2254C8205"><enum>(2)</enum><text display-inline="yes-display-inline">Of land located in sec. 33—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD119F274A0ED4A3689002ED35D135E30"><enum>(A)</enum><text display-inline="yes-display-inline">the 38 acres located within the SW<fraction>1/4</fraction>SE<fraction>1/4</fraction>;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H43F8F60445C640EFA026727711D7006C"><enum>(B)</enum><text display-inline="yes-display-inline">the 13 acres located within the NW<fraction>1/4</fraction>SE<fraction>1/4</fraction>;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDF6B0EA3DBD14652BAE24CB5E1E5CC7"><enum>(C)</enum><text display-inline="yes-display-inline">the 40 acres located within the SE<fraction>1/4</fraction>SE<fraction>1/4</fraction>; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H2EDB31EB111744570073B36FF73B9CB9"><enum>(D)</enum><text display-inline="yes-display-inline">the 8 acres located within the SE<fraction>1/4</fraction>SW<fraction>1/4</fraction>.</text></subparagraph></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H937E7D43A6F74586B4E949DA9B622133"><enum>(b)</enum><header>Conveyance of Subsurface Estate</header><text display-inline="yes-display-inline">On conveyance to Cape Fox of the surface estate to the land identified in subsection (a), the Secretary shall convey to Sealaska Corporation the subsurface estate to the land.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H12BA37C9261E4A5B86D30350D1E11590"><enum>(c)</enum><header>Timing</header><text display-inline="yes-display-inline">The Secretary shall complete the conveyances to Cape Fox and Sealaska Corporation under this section as soon as practicable after the date on which the Secretary receives a notice of the selection of Cape Fox under subsection (a).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HBC25BDE83C164DC78C71CB8084286172"><enum>(d)</enum><header>Entitlement fulfilled</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H2A4EB6DB9A9D4F4892F1CBF47B25F200"><enum>(1)</enum><header>Definition of approved conveyance</header><text display-inline="yes-display-inline">The term <term>approved conveyance</term> means the conveyance of the 40 acres described as the SW<fraction>1/4</fraction>NE<fraction>1/4</fraction> of sec. 10, T.74 S., R.90 E., Copper River Meridian, selected and approved for conveyance by the decision of the Bureau of Land Management dated May 3, 2000.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H788396C79D0A4B91B140F21EFA0025A7"><enum>(2)</enum><header>Treatment as full entitlement</header><text display-inline="yes-display-inline">The conveyance of land to Cape Fox and Sealaska Corporation pursuant to subsection (a) and the approved conveyance shall be considered to fulfill the entitlement of—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD6B7E430A39E4C18B769B8F334931C3C"><enum>(A)</enum><text display-inline="yes-display-inline">Cape Fox under section 16 of the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1615">43 U.S.C. 1615</external-xref>); and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H846F1061ACEE4A409F29994872B78BA8"><enum>(B)</enum><text display-inline="yes-display-inline">Sealaska Corporation to any subsurface interest in the land under section 14(f) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1613">43 U.S.C. 1613(f)</external-xref>).</text></subparagraph></paragraph></subsection></section>
