<section id="H90D033D7752940D5B1B8A3BB4D99832B" section-type="section-one"><enum>1.</enum><header>Ground and surface water conservation assistance under environmental quality incentives program</header> 
<subsection id="H314CE26B58DF4830B9DAAE4FC8D3BADD"><enum>(a)</enum><header>Assistance for construction of water reservoirs</header><text>Subsection (a)(4) of section 1240I of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-9">16 U.S.C. 3839aa–9</external-xref>) is amended by striking <quote>water banking</quote> inserting <quote>the construction of reservoirs to be used for water storage in agricultural operations, water banking,</quote>.</text></subsection> 
<subsection id="H45198DF750E24C4FAF5B25B7EAD8DF78"><enum>(b)</enum><header>Special rules for provision of assistance</header><text>Such section is further amended—</text> 
<paragraph id="HFF238B2AA4E047BFBDE85740D0FDB86"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph> 
<paragraph id="H302F1943B2C8499684FFCD061B99007D"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection:</text>

<subsection id="H7F703A69D50E4890934BC09CD98BA35"><enum>(c)</enum><header>Special rules for assistance for reservoir construction</header> 
<paragraph id="HD2B6FB0B57BE4B5B9CFEF37F8EB1CB3D"><enum>(1)</enum><header>Waiver of irrigation requirements</header><text display-inline="yes-display-inline">The Secretary may not require, as a precondition for making cost-sharing or incentive payments available to a producer under this section for the construction of a water reservoir, that the agricultural operations of the producer utilize irrigation in the production of a commodity. </text></paragraph> 
<paragraph id="HCF5F41A11CC84152AE8265D6C918D4C3"><enum>(2)</enum><header>Maximum amount of assistance</header><text display-inline="yes-display-inline">In making cost-sharing or incentive payments to a producer under this section for the construction of a water reservoir, the Secretary may not pay more than 50 percent of the cost of constructing the reservoir.</text></paragraph> 
<paragraph id="HBC8E42002C70459E930057EE2C11D847"><enum>(3)</enum><header>Considerations of cost-effectiveness</header><text display-inline="yes-display-inline">If the Secretary determines that two or more applications for assistance for the construction of a water reservoir are comparable in achieving the conservation purposes of this section, the Secretary shall assign a higher priority to those applications for reservoir construction projects that would be the most cost-effective in achieving the conservation purposes of this section. In determining the cost-effectiveness of a proposed project, the Secretary shall consider both the cost per square foot acre of water and the cost per acre of irrigated land.</text> </paragraph> 
<paragraph id="H6E44D6B71B5C4F93A55BA29254009DE6"><enum>(4)</enum><header>Required use in agricultural operations</header><text display-inline="yes-display-inline">As a condition on the receipt of assistance under this section for the construction of a water reservoir, the producer shall agree to maintain the lands to be served by the reservoir in agricultural production for at least five years after the date of completion of the reservoir.</text></paragraph> 
<paragraph id="H56F91F18DEC04F9DB3A1D9F63C17FFB7"><enum>(5)</enum><header>Repayment</header><text>If the Secretary determines, on the record after an opportunity for a hearing, that a producer has failed to comply with the agreement required by paragraph (4), the Secretary shall require the producer to repay to the Secretary all or a part of the assistance provided for the construction of the reservoir. The repayment amount required shall be based on the severity and duration of the violation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection></section>
