<official-title>To authorize the Secretary of the Interior to convey certain Federal lands to the City of Yuma, Arizona, in exchange for certain lands owned by the City of Yuma, Arizona, and for other purposes.</official-title>

<section id="H693E08CB16FD4443A6F351FA3364929C" section-type="section-one"><enum>1.</enum><header>Authority to convey</header><text display-inline="no-display-inline"> The Secretary of the Interior (in this Act referred to as the <quote>Secretary</quote>) may, within 2 years after the date of enactment of this Act, execute an agreement with the City of Yuma, Arizona (in this Act referred to as the City), and pursuant to its terms, convey to the City all right, title, and interest of the United States in and to the Federal lands described in section 2(a), subject to the following conditions:</text> 
<paragraph id="H4F197F4F222F41E2B80262D5C37E3875"><enum>(1)</enum><text>The City shall convey by warranty deed to the United States the lands owned by the City described in section 2(b).</text></paragraph> 
<paragraph id="H7FFB57D1A4D9423690A148E27E21FF75"><enum>(2)</enum><text>The City and the Yuma County Water Users Association shall execute and fulfill all the terms of a separately negotiated Letter of Agreement between the Yuma County Water Users Association and the City regarding relocation of the Yuma County Water Users Association facility from the lands described in section 2(a)(2).</text> </paragraph> 
<paragraph id="H9B7E3D4857D84A5A9D4CAA7FEA827DBA"><enum>(3)</enum><text>The fulfillment of any other terms or conditions established pursuant to section 8.</text> </paragraph></section> 
<section id="H2D1E05BF81B34C0E825314AEA5B2918B"><enum>2.</enum><header>Lands described</header> 
<subsection id="HDD1E28F632ED4B49897C41B9C99C9081"><enum>(a)</enum><header>Federal lands</header><text>The Federal lands referred to in section 1 are administered by the Bureau of Reclamation and described as follows:</text> 
<paragraph id="H3AE9217D91934E600073F9ECA903A967"><enum>(1)</enum><text>The lands depicted on the map entitled <quote>city of yuma proposed property ownership</quote> dated august 9, 2004, and generally known as—</text> 
<subparagraph id="HAF3367BB354241A1B7E05F000719CAD5"><enum>(A)</enum><text>parcels 2 and 3 of Tract 1;</text></subparagraph> 
<subparagraph id="HAF4CBC82A0544A65B47CCBFBAF31007C"><enum>(B)</enum><text>a portion of parcel 110-73-019; and</text></subparagraph> 
<subparagraph id="H656C344B62F54C1F86968F6713139BB2"><enum>(C)</enum><text>the old ADOT Weigh Station.</text></subparagraph></paragraph> 
<paragraph id="HFCFE7219423D4AC98EE50070E0CBB473"><enum>(2)</enum><text>In accordance with the letter of agreement referred to in section 1(2), the lands depicted on the map entitled <quote>city of yuma proposed property ownership</quote> dated august 9, 2004, and generally known as—</text> 
<subparagraph id="H6BB38DF06F0C4674874812661BF6EB4F"><enum>(A)</enum><text>portions of Blocks 52, 53, 54, and 55;</text></subparagraph> 
<subparagraph id="HA66FB6CD24894683B0C169EA9F273151"><enum>(B)</enum><text>the future drying bed location; and</text></subparagraph> 
<subparagraph id="HD230CDD947314D68B1A3F7454D553334"><enum>(C)</enum><text>the future Arizona Welcome Center.</text></subparagraph></paragraph></subsection> 
<subsection id="HD773070F8EDF43AE97E5492584543D62"><enum>(b)</enum><header>Lands owned by the city</header><text>The lands owned by the City referred to in section 1(1) are the lands depicted on the map entitled <quote>City of Yuma Proposed Property Ownership</quote> dated August 9, 2004, and generally known as the Railroad Parcels.</text></subsection></section> 
<section id="H768552A75BE64699B62489EA50AB632F"><enum>3.</enum><header>No consideration</header><text display-inline="no-display-inline">The Secretary shall not require payment of, nor pay any consideration for, the value of the lands conveyed to the City by the United States or the lands conveyed to the United States by the City, respectively, pursuant to section 1.</text></section> 
<section id="HEFAB7619F3B74D0DA886FD50F8EFDD78"><enum>4.</enum><header>Administrative costs</header><text display-inline="no-display-inline">As a condition of any conveyance of lands under this Act, the Secretary shall require that the full cost (as defined by and determined consistent with Office of Management and Budget Circular No. A-25) for all administrative tasks associated with the conveyances under this Act shall be paid by the City to the United States.</text></section> 
<section id="HB7C204A007784EED8FDB319BAA3DA689"><enum>5.</enum><header>Compliance with environmental laws</header> 
<subsection id="HA41EB4A3B12B420291D1F80000445524"><enum>(a)</enum><header>In general</header><text>Before conveying land and facilities pursuant to section 1, the Secretary shall comply with all applicable requirements under—</text> 
<paragraph id="HFF57191EAF354376B83E95A3577217D"><enum>(1)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></paragraph> 
<paragraph id="H5C3AF51E7A244418A298E404AC71A781"><enum>(2)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="H22254CC8F47446138C16AE2941830534"><enum>(3)</enum><text>any other law applicable to the land and facilities.</text> </paragraph></subsection> 
<subsection id="H8AFED4B922124C80B231E931C568F54E"><enum>(b)</enum><header>Effect</header><text>Nothing in this Act modifies or alters any obligations under—</text> 
<paragraph id="H7BB801572DBB45A1AAB2657BEEBD5B27"><enum>(1)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); or</text></paragraph> 
<paragraph id="HFAD4079A62654B55BB15F23DFCDE5E8"><enum>(2)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text> </paragraph></subsection></section> 
<section id="HDE511CFDEBEA4112B51F3488BE01F51"><enum>6.</enum><header>Release from liability</header><text display-inline="no-display-inline">Effective on the date of conveyance to the City of any parcel under this Act, the United States shall not be liable for damages arising out of any act, omission, or occurrence relating to the land and facilities, but shall continue to be liable for damages caused by acts of negligence committed by the United States or by any employee or agent of the United States before the date of conveyance, consistent with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code.</text> </section> 
<section id="HEA16270BD73A49EE957378BDDBC654F9"><enum>7.</enum><header>Acceptable title</header><text display-inline="no-display-inline">Title to the non-Federal land shall conform with the regulations and title approval standards of the Attorney General applicable to Federal land acquisitions and shall be acceptable to the Secretary before title is transferred to the United States.</text> </section> 
<section id="H93574E1E10A04E9A9B1ED2E2D92518B9"><enum>8.</enum><header>Additional terms and conditions</header><text display-inline="no-display-inline">The Secretary may require such additional terms and conditions in connection with any conveyance under this Act as the Secretary considers appropriate to protect the interests of the United States.</text></section> 
<section id="H1A4A4FC5BA394B81BE7C6DFE2937AF98"><enum>9.</enum><header>Administration of acquired lands</header><text display-inline="no-display-inline">Lands acquired by the United States under this Act shall be administered by the Secretary through the Bureau of Reclamation.</text></section>
