		<section commented="no" display-inline="no-display-inline" id="H3878A3D858FC4CD98511519D9F9F005E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Eastern New Mexico Rural Water System
			 Act of 2006</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H48B07DA049A84DEBB9D6BE26C47F79D6"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H035A29FB2B7A42FF9860CD2669E4B6F"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The term <term>Authority</term> means the
			 Eastern New Mexico Rural Water Authority, an entity formed under State law for
			 the purposes of planning, financing, developing, and operating the
			 System.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5827F06EDA444872B90661075597DB72"><enum>(2)</enum><header>Plan</header><text display-inline="yes-display-inline">The term <term>plan</term> means the
			 operation, maintenance, and replacement plan required by section 4(b).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFDC0ED42DCAA41ABB1441621FD993C24"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8AA28D554AA04869B6D32006941CF7A6"><enum>(4)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State
			 of New Mexico.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9CD5CB0ED35743059BDAD9E9DED18B03"><enum>(5)</enum><header>System</header>
				<subparagraph commented="no" display-inline="no-display-inline" id="H56D6036662E04EB79D001649E9F5E64E"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The term
			 <term>System</term> means the Eastern New Mexico Rural Water System, a water
			 delivery project designed to deliver approximately 16,500 acre-feet of water
			 per year from the Ute Reservoir to the cities of Clovis, Elida, Grady, Melrose,
			 Portales, and Texico and other locations in Curry and Roosevelt Counties in the
			 State.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB09C643BB9A7454A82380635B4038617"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The term <term>System</term>
			 includes—</text>
					<clause commented="no" display-inline="no-display-inline" id="HCE6D294B1A794D908455493FD9E34EF2"><enum>(i)</enum><text display-inline="yes-display-inline">the intake structure at Ute
			 Reservoir;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H63491EB4E28147BC8BAC559FB9E6AE33"><enum>(ii)</enum><text>a water
			 treatment, administration, and maintenance facility with—</text>
						<subclause commented="no" display-inline="no-display-inline" id="H5D5950D0984544D89482ACB264AFDC5E"><enum>(I)</enum><text>a 30,000,000
			 gallon per day average peak capacity; and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="HF6517F85D3D5495C95C82C95AABB20D9"><enum>(II)</enum><text>a 15,000,000
			 gallon per day average capacity;</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HDB745D9C24AB4857ACB18A917C0845E"><enum>(iii)</enum><text>approximately 155
			 miles of transmission and lateral pipelines and tunnels that range in size from
			 4 to 60 inches in diameter;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H87BB4978F3B741D6B5C94B1B987E4FBA"><enum>(iv)</enum><text>3 pumping
			 stations, including—</text>
						<subclause commented="no" display-inline="no-display-inline" id="HA0DC901997984E9CBD47B25E04F28F09"><enum>(I)</enum><text>a raw water pump
			 station at Ute Reservoir;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="HBCEBED58D4AA47A4B3EE78863DEA6FA4"><enum>(II)</enum><text>a booster pump
			 station at the <quote>Caprock</quote> escarpment; and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="HF6DD773678F249B3B1975E7473B3D23B"><enum>(III)</enum><text>a booster pump
			 station to Elida; and</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB6333E9E13BE43CBAA0000B0A0156C39"><enum>(v)</enum><text display-inline="yes-display-inline">any associated appurtenances.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5BFBFFFF2C3E40BF87681E5B51499092"><enum>(6)</enum><header>Ute
			 reservoir</header><text display-inline="yes-display-inline">The term <term>Ute
			 Reservoir</term> means the impoundment of water created in 1962 by the
			 construction of the Ute Dam on the Canadian River, located approximately 32
			 miles upstream of the border between New Mexico and Texas.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H8D186C250C1245FE97A95CBE9C518D43"><enum>3.</enum><header>Eastern New
			 Mexico Rural Water System</header>
			<subsection commented="no" display-inline="no-display-inline" id="H6698E311322D465B9C8ECD1F40D46830"><enum>(a)</enum><header>Financial
			 Assistance</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H4B0730EA150846830087AC1B18DED169"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may
			 provide financial and technical assistance to the Authority to assist in
			 planning, designing, conducting related preconstruction activities for, and
			 constructing the System.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H249EE948EF4847408F01B8C3C632E76B"><enum>(2)</enum><header>Use</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="HC4416FD272BD4CFDA583891E006EC0AA"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any financial
			 assistance provided under paragraph (1) shall be obligated and expended only in
			 accordance with a cooperative agreement entered into under section
			 5(a)(2).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H320DEAC79DE6456C802E4DEBE0094C1"><enum>(B)</enum><header>Limitations</header><text display-inline="yes-display-inline">Financial assistance provided under
			 paragraph (1) shall not be used—</text>
						<clause commented="no" display-inline="no-display-inline" id="H1FCF66D4B3404750A080C5EE22FCAEAB"><enum>(i)</enum><text display-inline="yes-display-inline">for any activity that is inconsistent with
			 constructing the System; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H2103A5D8383446E691998DDFA4F3434B"><enum>(ii)</enum><text display-inline="yes-display-inline">to plan or construct facilities used to
			 supply irrigation water for agricultural purposes.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H084BB7035E3746CAB774BEB39FB0AEC3"><enum>(b)</enum><header>Cost-Sharing
			 Requirement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2C91A8FC517343299EF162D8D8AD0627"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Federal share of
			 the total cost of any activity or construction carried out using amounts made
			 available under this Act shall be not more than 75 percent of the total cost of
			 the System.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H416F33246C294740B6B1B85A1BEC281"><enum>(2)</enum><header>System
			 development costs</header><text display-inline="yes-display-inline">For
			 purposes of paragraph (1), the total cost of the System shall include any costs
			 incurred by the Authority on or after October 1, 2003, for the development of
			 the System.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB19BD5E797CC44C8A13D42BF90F7EA33"><enum>(c)</enum><header>Limitation</header><text display-inline="yes-display-inline">No amounts made available under this Act
			 may be used for the construction of the System until—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H80B3912CC17548158CDD3076EE30E3A7"><enum>(1)</enum><text display-inline="yes-display-inline">a plan is developed under section 4(b);
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6B1D30B9295A40A8B6F61B2768FF1B2F"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary and the Authority have
			 complied with any requirements of the <act-name parsable-cite="NEPA69">National
			 Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) applicable
			 to the System.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFCCD127B85BB4F14A047D5148E2200B"><enum>(d)</enum><header>Title to Project
			 Works</header><text display-inline="yes-display-inline">Title to the
			 infrastructure of the System shall be held by the Authority or as may otherwise
			 be specified under State law.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H64D0376162934C45AEB14176E483A126"><enum>4.</enum><header>Operation,
			 maintenance, and replacement costs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HE37125BDD7D947DB862FC818D47CEA53"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The Authority shall
			 be responsible for the annual operation, maintenance, and replacement costs
			 associated with the System.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC921B33F6C99438DA0DC47E11BC28737"><enum>(b)</enum><header>Operation,
			 Maintenance, and Replacement Plan</header><text display-inline="yes-display-inline">The Authority, in consultation with the
			 Secretary, shall develop an operation, maintenance, and replacement plan that
			 establishes the rates and fees for beneficiaries of the System in the amount
			 necessary to ensure that the System is properly maintained and capable of
			 delivering approximately 16,500 acre-feet of water per year.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HA749938A8C1F408F9EA47EFCFECDE34"><enum>5.</enum><header>Administrative
			 provisions</header>
			<subsection commented="no" display-inline="no-display-inline" id="H868C406EB13B439E8BA258DB6D945C97"><enum>(a)</enum><header>Cooperative
			 Agreements</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H5DB97C52C3F34D928068A0F5C73F9671"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may
			 enter into any contract, grant, cooperative agreement, or other agreement that
			 is necessary to carry out this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2A206C1BE4DA4C14A92239B3B6DCEA8C"><enum>(2)</enum><header>Cooperative
			 agreement for provision of financial assistance</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H4841430DB3694E1E9596308906C88EB2"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 enter into a cooperative agreement with the Authority to provide financial
			 assistance or any other assistance requested by the Authority for planning,
			 design, related preconstruction activities, and construction of the
			 System.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H089FD1CE03FB4C4D8F5208A4DCD7001F"><enum>(B)</enum><header>Requirements</header><text display-inline="yes-display-inline">The cooperative agreement entered into
			 under subparagraph (A) shall, at a minimum, specify the responsibilities of the
			 Secretary and the Authority with respect to—</text>
						<clause commented="no" display-inline="no-display-inline" id="H33D0582E8FB247A2B944F02141060240"><enum>(i)</enum><text display-inline="yes-display-inline">ensuring that the cost-share requirements
			 established by section 3(b) are met;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="HDA9A155ECDB741DB871C3052FCFE2177"><enum>(ii)</enum><text display-inline="yes-display-inline">completing the planning and final design of
			 the System;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H30AC20A17D3F42A9A0A59BACD93E9334"><enum>(iii)</enum><text display-inline="yes-display-inline">any environmental and cultural resource
			 compliance activities required for the System; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H634FB8C4B1A843158E3F5B3BF8349F37"><enum>(iv)</enum><text display-inline="yes-display-inline">the construction of the System.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0C68C83FCECF42EEA3D6B44724C92F01"><enum>(b)</enum><header>Technical
			 Assistance</header><text display-inline="yes-display-inline">At the request of
			 the Authority, the Secretary may provide to the Authority any technical
			 assistance that is necessary to assist the Authority in planning, designing,
			 constructing, and operating the System.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H8FF8E244EE964EF681202D17B4BA00"><enum>(c)</enum><header>Biological
			 assessment</header><text>The Secretary shall consult with the New Mexico
			 Interstate Stream Commission and the Authority in preparing any biological
			 assessment under the <act-name parsable-cite="ESA">Endangered Species Act of
			 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) that may be required for planning and
			 constructing the System.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD2F19C81A2A04CF20048C37BFB8E0494"><enum>(d)</enum><header>Effect</header><text display-inline="yes-display-inline">Nothing in this Act—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HE37DFE468D8B465885FC00F31E9E10BC"><enum>(1)</enum><text display-inline="yes-display-inline">affects or preempts—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H1ECF5F9145F348E4AB374BAE36A300A9"><enum>(A)</enum><text display-inline="yes-display-inline">State water law; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2FE2A1E13E02460B9176009D97A1C3D7"><enum>(B)</enum><text display-inline="yes-display-inline">an interstate compact relating to the
			 allocation of water; or</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H20B4347905574D238D5CE1D4E5BE746D"><enum>(2)</enum><text display-inline="yes-display-inline">confers on any non-Federal entity the
			 ability to exercise any Federal rights to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HDF07417292B24BAE9433831F24F2E9E"><enum>(A)</enum><text display-inline="yes-display-inline">the water of a stream; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H48DDF8ED602D4DFD00FD49C9A1BF8797"><enum>(B)</enum><text display-inline="yes-display-inline">any groundwater resource.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H3B704B2657C841ACAD7FBB714EA46B7E"><enum>6.</enum><header>Authorization of
			 appropriations</header>
			<subsection commented="no" display-inline="no-display-inline" id="HBA48F76D5ECD4CD69ED9E06534170500"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated to the Secretary such sums as are necessary to carry out
			 this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HF7834B8F95544EF6B05237DD08422658"><enum>(b)</enum><header>Nonreimbursable
			 Amounts</header><text display-inline="yes-display-inline">Amounts made
			 available to the Authority in accordance with the cost-sharing requirement
			 under section 3(b) shall be nonreimbursable and nonreturnable to the United
			 States.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HADF0D4962D064892A76F746E68F7BDA"><enum>(c)</enum><header>Availability of
			 Funds</header><text display-inline="yes-display-inline">At the end of each
			 fiscal year, any unexpended funds appropriated pursuant to this Act shall be
			 retained for use in future fiscal years consistent with this Act.</text>
